son works in one of the neighbor communities— for him it’s a construction job in Kelowna— and despite the more than 20 kilometres between his home and work, he jumps on his bike and heads to work, normally riding along Highway 97, what he calls the safest route for cyclists to get between Lake Country and Kelowna.

Campaign goal to inform public Known and unknown costs to contend with YES CAMPAIGN A2 for the yes-side in the past month.

“This is a celebration of what we can become as a community,” said Thomson. “Lake Country has a wonderful future. We can take control of our lakeshore and increase our tourism industry. I think we’ve answered a lot of questions the no side had. Our goal was to inform the public, get a big turnout and try not to divide the community and I think we’ve done that.”

Much of the concerns raised about the purchase of the rail corridor centre around the unknown costs that could be associated with purchasing the corridor as well as the impact on residents who live close to the rail corridor.

Resident Roger Bailey, whose great grand-

father originally farmed his Oyama property and whose land is split by the corridor, says some of his questions have been answered but he has not been convinced there won’t be many issues surface if the corridor purchase goes ahead.

“At this point I don’t have much choice, I have to vote no,” said Bailey, who formed the group No to Being Railroaded to lobby against the purchase. “I see the community aspect of it but I think everyone would understand if the rail went a few feet from their kitchen window, they would think the same. I’m not confident anything is going to go well (with the purchase).

There are a lot of extra costs coming.”

Lake Country’s Scott Wilson, whose young family lives in the Davidson Road area, says he

understands the issues raised by residents who live close to the rail corridor. He says it would likely change the way he views it if he had the rail line coming that close to his property. But he also pointed to other trails, such as the KVR through Naramata that has had several trail-related businesses pop up around it, as one way to deal with it.

“If it was going through my yard I would have reservations,” said Wilson. “But I’ve seen what it’s done in other areas where there are businesses that have begun. I think there are opportunities. But you are losing some of your property. Yes or no, it’s important that you make your opinion noted.

Whether it’s yes or no, this has been good for the community to get people talking.”

Bissonette and a small group started Taxpayers 4 Responsible Tax and raised close to $7,000 to push their message. The money was spent on Canada Post mail-outs and newspaper advertisements.

Bissonette was one of the first vocal residents against the purchase of the rail corridor when it came to light. And the media took up his cause, publishing his letters and asking for comment. However, he soon found many of his letters were being ignored and his concerns being shrugged off by the Kelowna media.

“Initially a lot of my

letters were published but in the last month I have sent half a dozen well-written letters that weren’t published so I stopped writing them,” he said. “It seems as if the media is behind the yes campaign and they really don’t want to print anything that is damaging to this.

“There is tons of outside pressure on Lake Country residents. Provincial ministers are weighing in and people from r cities. I’m not whining. It’s their TV station or radio or newspaper and they can preach what they want but they are in the yes camp. It’s been David vs.

Goliath. A few thousand years ago David won the fight and we’re hoping it becomes 2-and-0 for David.”

In terms of his concerns, Bissonette says there are many more

costs associated with a yes vote than what the district has talked about.

He says Lake Country taxpayers will be on the hook for the total $5.1 million price tag when you factor in the re-payment of Kelowna’s $2.5 million investment in the rail corridor in Lake Country.

He says the mayor’s comments in last week’s letter, published in the Lake Country Calendar that there will be an increased tax base to draw on in Lake Country in three years time, is evidence that the district will indeed go back to taxpayers for money to pay back Kelowna.

He claims there will be much remediation work to be done on the rail corridor once CN Rail removes the ties and rails and restores it to “industrial” level. He calls claims by district coun-

cillors that Lake Country will lose lake-front access with a no vote a non-issue when you look at Pelmewash Parkway and the lake-front access the district will gain when the province hands over control of the old Highway 97 through Lake Country.

With regard to the two homes that have the right-of-first-refusal, Bissonette says he doubts the residents will sell only the corridor back to the municipal group and says purchasing those lands is going to be extremely expensive.

“When you look at it there are just so many question marks,” said Bissonette. “Yes there are unknown costs but there are also known costs.

Buying those (right-offirst-refusal) properties is going to cost millions we just don’t know how many million.”

Right-of-first-refusal negotiations won’t scuttle purchase deal KEVIN PARNELL If Lake Country residents vote yes on the acquisition of the CN Rail corridor, the issue of the two Oyama homeowners with the rightof-first-refusal to buy their strip of the corridor won’t scuttle the deal.

In fact, dealing with just two landowners in a deal that includes 47 kilometres of land is unheard of by the City of Kelowna, according to Doug Gilchrist the head of the inter-jurisdictional team putting together the rail line purchase and a community planning director for Kelowna.

“There are 147 titles (along the corridor) and we only have a few that are at all in question which is really unheard of in this kind of acqui-

sition,” said Gilchrist, who noted any financial settlement with private landowners would come from the existing inter-jurisdictional team budget. “There is only the two properties.

We have met with one of them and are working with them to find a resolution and they are being very amicable. The Day family has chosen to trigger the right-offirst-refusal, feeling that they are in a better place to negotiate to try and have the track relocated to benefit the house.

“We are fine with that.

It’s not ideal but we will work with them.”

Working with property owners not wanting to sell is something the real estate team at the City of Kelowna is pretty used to. According to

One land owner has opted to buy the parcel of land.

Gilchrist the municipality has a very robust real estate team that works on land deals every day.

The difference in the CN Rail corridor purchase is the length of the corridor and the fact there are a relatively small number

of parcels owned by individuals who have to be negotiated with.

He pointed to past land deals that saw the City of Kelowna acquire private land to extend Gordon Drive or Highway 33 as examples

where municipal staff had many files to work through before finishing the deals.

“Any new road that goes through might have upwards of 20 or 30 or 40 homeowners and we negotiate with

every property owner and many of them don’t want to sell,” he said. “It’s not unusual. We find a way to meet their needs and make sure they are fairly compensated. This is absolutely commonplace. The only thing that is unusual is we are getting so much of it in one transaction.”

Gilchrist said in no way will the negotiations between the inter-jurisdictional team and the two property owners scuttle the deal to purchase the corridor.

“If the referendum is positive and if things are worked out with the Okanagan Indian Band challenge, we will complete the deal, take title and continue to work with them,” he said.

As far as the Day family goes, they are one

of several homes that the rail corridor passes very close to. They have committed to purchasing their section of rail corridor from CN and then see what happens with the referendum.

Moira Day said it’s been a difficult process to hear criticism from some members of the public as she confirmed there have been negatives written about them online.

“I try not to let it bother me,” she said.

“Those people don’t know anything about us. They just see us as a threat. We are merely trying to stand up for what is ours. This (rail corridor) is going to devalue our property so we have to think long and hard about it.” newsroom @lakecountrynews.net

Land sales leave lingering odour VICTORIA—The B.C. Liberal government’s sale of Crown properties to help balance its election budget was the dominant story in the legislature last week, as the NDP revealed evidence of a “fire sale” that may have left millions on the table.

They started with Burke Mountain, the biggest single deal involving 14 view properties in Coquitlam. The buyer was a prominent developer whose array of companies happened to donate nearly $1 million to the B.C. Liberal Party since 2000.

The $85-million price tag was similar to the B.C. Assessment Authority value on these forested properties, but an outside appraisal concluded they could have fetched an additional $43 million if they had spent more time on the hot Lower Mainland real estate market.

The government’s defence of the sale went from wobbly to weak.

Citizens’ Services Minister Amrik Virk was caught flat-footed and tried to get by on platitudes rather than retreat and find some answers.

Premier Christy Clark weighed in, arguing that the budget would have balanced without the property sale, and that some sales closed too late

to help the election-year budget. Finance Minister Mike de Jong stressed that all these asset sales were detailed in three successive budgets. They downplayed the notion of land sales being rushed.

Then the NDP produced a string of emails sent between senior officials responsible for selling two big properties across the street from the legislature.

“To be part of the sale and development of over eight acres of Victoria’s beautiful inner harbour area is a oncein-a-lifetime opportunity. An opportunity that normally would warrant years of planning and preparation,” wrote one citizens’ services bureaucrat. “Unfortunately we don’t have unlimited time—our goal is to have For Sale signs up by Oct. 31 with sales proceeds in the bank by March 31, 2013.”

Then came a disclosure about a property in Surrey that had

been bought as a potential hospital site. Once the existing hospital was expanded, that property was declared surplus. Indeed, de Jong featured this property to promote the government’s plan to stimulate local economies with private sector investment on unused land.

The Surrey deal closed for $20.5 million on March 21, 2014, just days before the end of the fiscal year. NDP leader John Horgan pointed to an outside appraisal of $23.5 million, and an assessment for tax purposes of $27.2 million.

The appraiser also recommended that the “highest and best use” for the Surrey land was to hold it until had been rezoned for commercial, retail or office development.

De Jong cited another big health property in Vancouver that sold for more than its appraised and assessed value. It’s only the actual market

that determines worth, he insisted.

But it’s now clear that these and perhaps other sales were done with arbitrary deadlines that had everything to do with the B.C. Liberals’ need to balance the books. When elections are a battle of sound bites, perception matters more than reality.

It’s also worth recalling that the budget deficits prior to the 2013 election were largely a result of the B.C. government’s costly undoing of the harmonized sales tax, rather than the harsh forces of international finance.

Surplus asset sales have a long tradition in B.C., where the government owns more than 90 per cent of all land.

But after this round, full disclosure will be demanded.

Solemn commitment to be the valid voice of the community D

uring the past month or so, covering the issues surrounding the potential purchase of the CN Rail corridor in Lake Country, one thing has become pretty evident: The Kelowna media is supporting the efforts of the inter-jurisdictional team to purchase the corridor.

There have been repeated columns in the daily newspaper in these nparts urging residents to have vision and see the benefits of the pur-

print—that have done the same. There has been one-sided commentary on Kelowna radio, including the host hanging up on one of the organizers of a no campaign when his opinion differed from the host.

Wherever it’s been coming from it hasn’t been hard to figure where most media falls on the potential purchase of the rail corridor: They love it.

The big question for me is what gives reporters who live and reside

This is a disturbing trend in the media today.

Reporters as the story.

Reporters are supposed to tell the story, and yes, they can become part of the story. But the basics of journalism are to tell both sides of the story— whether you like it or not. The answer is almost always somewhere in the

middle. Your opinion isn’t supposed to matter.

The editorials aren’t the only question. An opinion piece—just like this one—is part of what we as media get to do.

We’re not experts. We’re just people. Telling stories.

But in the past month as yes and no campaigns took place in Lake Country, the no side had more and more trouble being heard by the media. When the issue first started, reporters ran out to see Guy Bis-

A group of us had been sitting together around a table discussing the implications of evolution for tradition5al Christian theology.

When we broke for coffee and snacks, I picked up an orange from a bowl.

And suddenly, unaccountably, I saw that simple orange as the culmination of 14 billion years of evolution.

Everything that made up that orange—its colour, its scent, its taste— came into being with the universe itself. Every cell, every molecule, every atom, every quark and meson and gluon and boson, emerged from that initial eruption of something out of nothing.

Before that beginning, there was nothing; after that beginning, there was everything. Nothing has

been added since then, nothing removed.

Fourteen billion years gathered together into a humble orange.

As it rested in the palm of my hand, it seemed to glow with the inner fire that flamed into being 14 billion years ago.

It felt like a miracle.

And I became aware that if an orange is a mir-

acle, so are we all. For the elements of that initial flaming still burn in us, too. We too are the culminating achievement—but not the final product—of the cosmos.

Everything that has gone before has made this moment possible. Whatever is, only is because the components of the universe have been arranging and re-arranging

themselves for 14 billion years. And will continue to do so.

And so I am related to the trees and insects. To the great whales and the invisible plankton, to the cowering field mouse and the thundering lion, to Julian’s hazel-

nut and Blake’s grain of sand. They are flesh of my flesh, blood of my blood.

We are bound together by an evolving universe. Hallelujah!

Who cares who is against it or what the implications are for the small communities that make up Lake Country.

This kind of new-age reporting, where reporters let their opinions rule the way they cover things, is what makes me proud to work for

the Lake Country Calendar, now owned by Black Press, a company that owns community papers across B.C. I can tell you those of us who work for the Calendar also live and work in Kelowna. So I won’t be voting in your referendum. But we are the community paper. We take pride in being the only media in the Okanagan Valley to truly be involved in the Lake Country community.

Punishing current council not a lasting Do we need two lake-side trails? legacy; ‘the trail will be there forever’

To the editor: Lake country is a small community with a limited budget and the ever present challenge of how to spend local tax dollars wisely and satisfy the needs of all communities within the Lake Country district. How does the rail trail purchase proposal fit into our current fiscal plan? How will it impact other critical projects and needed local improvements?

Does Lake Country really need two trail corridors? Perhaps we’ve forgotten the recently acquired Pelmewash Parkway which departs Highway 97 at the north end of Winfield to become a lake shore recreation roadway that extends along the west side of Woods

Lake to Oyama and continues along Kalamalka Lake to the northern edge of Lake Country District where it merges back into the Highway.

Work is needed to upgrade this new area, but is this not intended as a potential tourist corridor for recreation—swimming, boating, hiking, biking. This is an asset we already own. Can’t this be incorporated as an alternate part of a connecting corridor between Kelowna and Vernon? If so, then perhaps we could buy the southern district portion of the CNR lands and save a great deal of money by integrating the northern part of the rail trail into Pelmewash Parkway. This option would allow a resident friendly compromise, where pri-

vate residents along the shores of both of these Lakes could directly purchase their own piece of the CN Rail corridor that currently divides their properties.

They win and the District wins. This private purchase would reduce the Lake Country capital cost of buying the whole corridor and create an immediate new tax base for the district on this newly purchased private land.

There are many unanswered questions about the current proposal and any number of other good options that might be brought to light through community discussion.

The the editor: I was pleased to attend the Rail Trail information meeting last week at Creekside Theatre in Lake Country. Good information was provided and legitimate concerns were raised and addressed.

However, I have trouble understanding those who think we should not spend tax money for parks and recreation facilities such as the trail, because our roads need work or because we already have municipal debt. What a pathetic town we would be living in, if in earlier times, voters had voted “no” in previous referendums, or if past councils had chosen to fix the roads rather than build the arena and curling rink, the seniors’ centre, the community complex and Creekside Theatre, Beasley Park, Swalwell Park, etc.

Roads needed fixing back then and will always need fixing. Paying taxes for ongoing infra-

structure maintenance is the price of living in a decent community. Paying additional taxes for amenities that improve our standard of living, such as those mentioned above and the proposed lakeside rail trail, is a privilege that I look forward to, in order to continue the Lake Country tradition of building a community that is a great place to live.

Fixing existing infrastructure or acquiring new facilities such as the trail is not an “either or” decision. We need to do both and we need to recognize that we will have to pay for both.

Several people have told me they will vote no because they are mad at Lake Country and/or its council for decisions on other matters. They want to punish those currently in city hall, all of whom will move on; and I can say from experience, after they are gone, no one will remember who they were. The trail will be there forever.

Contrary to what some are saying, the District of Lake Country does not currently have excessive debt, nor will the rail trail boost it significantly.

As former Lake Country councillor Tim Witty used to say, buying long-term assets through borrowing not only ensures that the public can start enjoying those assets now, but it ensures that the cost will be spread amongst the people who will use those assets over the life of those assets.

This argument makes especially good sense at this time, when the municipality can borrow money at such low interest rates.

Those of us who will vote yes can see the future benefit of the rail trail, and many of us are willing and able to meet the challenge of building and maintaining it. Vote yes; do it for your grandchildren.

School trustees face hard budget cut decisions

MOU between Kelowna, Lake Country

KEVIN PARNELL Sending their kids to school on the bus is likely going to cost parents more next year.

Central Okanagan School Board trustees are pondering several recommendations to make up for a $1.5 million shortfall in education funding in its 201516 budget, including increasing the amount parents pay to bus their kids to school.

The school board’s finance committee heard several cost saving moves from school superintendent Hugh Gloster last week as the district tries to balance its 201516 budget by increasing some revenue and decreasing expenses.

The recommendations at this point are just that, as the school board’s finance committee will meet again tonight to debate the recommen-

dations before the entire school board decides which to follow, at its April 29 board meeting.

“I think it’s going to be difficult,” said finance committee chair Lee Mossman. “It’s not going to be an easy thing to do and we’ll try to mitigate the impact to students first and foremost.”

It’s being recommended to increase the cost for busing students from $10 to $20 per month ($200 per year) a move the district first made in 2009 but then cut in half in subsequent years. Putting it back to $20 per month would earn the district an extra $400,000, according to a report by Gloster.

A further $230,000 would be earned if the district increases enrolment in its International Education Program by some 25 international students who pay the district to attend school

in the area.

In terms of decreasing expenses, Gloster’s report pointed to several areas that could be cut. The operations department, which has the largest share of the school district’s budget at close to $18 million, would take the biggest hit with a $275,000 cut. To achieve this fewer summer students would be hired, video surveillance equipment would be eliminated and one special needs bus would be cut.

Other cuts could come from reducing technology software ($100,000), reducing departmental budgets targeting travel, food and promotional materials ($40,000) and chopping the budgets for several school district committees.

A further $300,000 could be saved by not funding any inflationary increases.

The following is taken from a Dec. 16, 2014 report to Lake Country council detailing the agreement between Lake Country and Kelowna when it comes to Lake Country’s total $5.1 million share of joining the inter-jurisdictional team looking to purchase the CN corridor.

The District of Lake Country and the City of Kelowna have approved a reciprocal Memorandum of Understanding (MOU) whereas the City of Kelowna will assist with the purchase cost portion of the District. The City will advance 50 per cent of the District of Lake Country purchase cost in exchange for 50 per cent tenancy in common of the asset. The purpose is to assist the district’s purchase of its portion with the intent to pay back the City of Kelowna as soon as funds are available, especially through the sale of excess land. This will alleviate

debt load of the district and protect the opportunity to finalize the deal with CN. The general terms of the MOU are as follows: • Kelowna and Lake Country will each pay 50 per cent of the purchase price for the acquisition of the Lake Country Corridor from CN, which purchase price is presently estimated to be $5,145,000.

• Kelowna and Lake Country will be registered as tenants in common of the Lake Country corridor each as to half interest (50 per cent each).

• As Lake Country reduces Kelowna’s investment interest, its interest in the ownership will increase while Kelowna’s will decrease.

• Lake Country purchase from Kelowna will not be based on market value but on actual purchase price.

• No interest will be applied to Kelowna’s investment in the land for three years. Subsequent

interest will be applied to Kelowna investment by a rate established by the Municipal Finance Authority on January 1st of each year.

• The proceeds from the disposition/sale of lands along the Lake Country corridor that are considered surplus will go entirely to reducing Kelowna’s investment in Lake Country lands.

• If funds become available, Lake Country can make additional payment to further reduce Kelowna’s share.

• Lake Country will maintain full decision‐ making authority for operating, maintaining and repairing the corridor until a decision is made to create a regional operation with all other participating partners.

A LEGACY OF DEBT FOR LAKE COUNTRY PRESSURED

Lately there has been an overwhelming amount of outside pressure being applied to Lake Country residents by provincial ministers, people from other cities and many of the Kelowna media personnel to vote in favour of this purchase. Lake Country residents need to vote for what is best for Lake Country and not what is best for these other special interest groups and other cities. They do not live with our $160 million of unfunded infrastructure problems or our debt.

ENVIRONMENTAL COSTS Contrary to Mayor Baker’s comment in his April 13 newspaper article claiming that CN is responsible for remediation to all lands to meet current environmental standards, we refer you to what the actual Memorandum of Understanding clearly states IN PRINT on the DLC website. CN is to remediate the rail corridor site(s) to an “Industrial State”. The Expo 86 lands were all previously industrial and required more remedial work to make them legally safe for public use than what the property sold for. This has the potential to add many millions to the end cost. An expensive environmental study would be required just to determine what that remedial cost would even be. Or will our Mayor go on public record and guarantee that the lands will be turned over in a 100 percent environmentally safe condition and thus require no remedial work to be paid for by the tax payers?

PROMISE OF NO REPRIORITIZATION Mayor Baker has repeatedly claimed that should this purchase be approved there will be no reprioritization of municipal funds and that any money needed to repay Kelowna would be generated by the sale of assets. In a meeting with Ron Volk on April 14, our Mayor expressed that in 3 years he feels that our tax base will have grown due to development

and that is how he would fund the Kelowna loan. This diversion of funds will affect the budget available for working on our $160 million dollar backlog of infrastructure needs. What happens if the projected development doesn’t bring in the required tax base growth, we only fall further in the hole. Loan payments to fund the Kelowna loan will be in the $165,000.00 per year range as per the MOU Kelowna is demanding repayment in 3 years.

CN LAND WILL NOT BE UNENCUMBERED Mayor Baker has claimed that the CN lands will all be provided in an unencumbered state, this would mean that it has clear title and all issues have been dealt with by CN. Aside from the obvious First Nations claim, in the April 14 meeting with Ron Volk, our Mayor admitted that this is not the case and it will be up to the District of Lake Country to negotiate the purchase of the properties from the two private residences that have first right of refusal with CN as those individuals will be exercising that right. These are waterfront acreages with a total of 940 lineal feet of shoreline and will be very expensive. If we were to use the ridiculous assessment formula that was suggested by Duane Thomson of the Yes campaign floated in his March 23 Castanet article, shoreline land is valued at $13,899 per lineal foot so the purchase price for these properties would be slightly over $13 million for land only, money would need to be added for value of homes on these properties so $14-$15 million range. Hopefully this formula was another yes camp exaggeration but regardless these properties will realistically be in the multimillion dollar range. These property owners won’t sell off a strip of the corridor, they want to sell and move to an area with privacy. Where will the funds come from to purchase these properties?

FENCING AND GATES

Mayor Baker, in a Global Television interview on April 13, stated that those whose property is bisected by the CN corridor that needed fencing and gates would have that provided. Sixteen kilometers of fencing along the corridor plus gates would be very expensive - how do we intend to fund this?

BACKLOG We have a current backlog of $30 million for road repairs and will fall further behind by $2 million per year. Many of our roads are at the end of their life cycle right now as per the DLC engineering report. As of the last council meeting, there was no plan in place on how to fund the much needed road repairs. The $30 million is expected to double by year 2020.

PARKS AND TRAILS WITHIN CITY LIMITS Per the DLC website we currently have 22 parks, 11 of which are waterfront, we have 17 existing hiking trails with a total of well over 100 kilometers to hike within city limits. “We are talking about a $2.6 million expenditure,” said Bucholz. “Not spending this money does not fix the issue (of roads). It doesn’t solve the problem in the short term. In the long term it can be part of the solution. That corridor would be a very useful alternative to the car. It helps our vulnerable users... kids and people that can’t afford vehicles, transit users. You have a really nice corridor that links up to many of our amenities.”

Much has been made about the district’s shortfall when it comes to its aging roads in the leadup to the referendum.

And Bucholz admits it’s one of the biggest issues facing Lake Country and isn’t going to go away, whether residents pass the CN corridor referendum or not.

“Not spending this

money ($2.6 million on rail corridor) does not fix that (roads) issue,” said Bucholz. “It does provide an active transportation route and this is a lot of what our Transportation for Tomorrow plan is all about. It’s providing an alternative to cars and active transportation routes.”

Lake Country began work in earnest on the Transportation for Tomorrow plan in the spring of 2010 after nearly 900 residents signed a petition asking for safety improvements focusing on pedestrians and cyclists. That came after the tragic death of Josie Evans on Bottom Wood Lake Road.

The first phase of the plan was put in place by the fall of 2011 and Bucholz says “although we have made a lot of progress in the last five years we have a lot more to do.”

OKIB to ‘slow down’ purchase deal Infrastructure a line item in every budget KATHY MICHAELS Whether Lake Country votes yes or no this week is a moot point to members of the Okanagan Indian Band.

Dreams of a rail trail from Kelowna to Coldstream are far in the offing, considering a significant chunk of the land isn’t legitimately up for grabs, said Band Chief Byron Louis.

Last month the band filed a legal injunction to slow the sale of the corridor until the matter of land title is cleared away.

The injunction is expected to be dealt with in court before the sale goes through.

“It’s to, more or less say, ‘wait a minute, let’s put the brakes on this’…

There are more issues to be resolved,” Louis said Friday. “Move ahead on the sale of the other portion, but for the 20 kilometres of the historic

commonage, we’d like to put that on pause.”

The heart of the issue lies in B.C.’s history with First Nations commonage reserves.

In flyers it has circulated, the band says the Commonage Rail Corridor is a portion of the land allotted to them by the Joint Indian Reserve Commission in 1877.

Between 1886 and 1893 Canada and B.C. purportedly relinquished the band’s interest to the lands, but didn’t abide by the rules of the Indian Act when doing so. Therefore, the band claims the rights acquired by CN were limited to the use of the corridor for railway purposes only.

“When KPR went bankrupt and CN decided to abandon the entire rail corridor, the Commonage Rail Corridor, like the Duck Lake portion, should have re-

verted to reserve land,” they say.

If the courts support that claim, it means CN wouldn’t have the right to sell the stretch of land.

Also, Louis said the land is of special significance to the band.

“We had people who were still using it in the 1950s to 1960s, driving cattle to the south end of Vernon,” he said.

“It’s not like we suddenly stopped using that area, or didn’t have an interest. We had aunts, uncles and family who put medicines through there, and there are fishing stations where the rail trail would be. There are a lot of connections to it.”

Louis wants to make it clear that the band isn’t at odds with the community—just this plan.

“We are doing a lot of great things together, just not this,” he said.

A court date has yet to be set.

“We’ve been working on this since I started with the district five years ago,” said Bucholz.

“What I am taking away from it is people do understand the issue with our aging roads.

When it comes to purchasing the corridor I think if not purchasing it solved our problems that would shed a different light on it. But it doesn’t.

In fact I think it can help. The fact is this is not unique to us. Aging infrastructure is an issue across North America.”

eral the public is going to have to pay for upgrades to infrastructure. And they have already been doing so. In Lake Country next year will be the final year of five straight years of a $50 increase in water rates to fund the district’s water master plan.

“With the water mas-

We see a lot of communities that if they can’t afford to pave you have to go back to gravel roads,” he said. “The fact we may have to de-classify some roads, strip the pavement and put some gravel back for some of them, that may be a solution but it will come at a cost too. The impact to taxpayers will be there.”

For every million that the DLC borrows ~ $10.00 will be applied to your annual taxes.

So for an average home, assessed at $475,000.00 there will be a $300.00 tax increase per year for twenty years upon the DLC borrowing $30 million.

We are currently headed for major tax increases and there is no way out - the taxpayers of this community and future generations will be taking on a huge debt load to pay for our crumbling infrastructure.

We have a large series of roads that are in serious disrepair. There are no streetlights or bike/walking spaces on many of our busy roads, i.e Okanagan Center Rd East, Carrs Landing Rd, and Oyama Rd. It’s impossible to pass a bike or a jogger without moving into oncoming traffic. When will our daily safety become a priority?

Should we need to drive to a walking path to feel safe? Shouldn’t we be able to go for a walk out our front door and feel safe?

• If we do not take greater preventative actions our roads can be expected to degrade at greatly accelerated rates - Engineering projects that by 2020 our roads debt will more than double.

Brynne Morrice, an actor and filmmaker who splits his time between New York and Vernon, has made a six-minute documentary called Mussel Threat, spotlighting the potential dangers of the invasive mussels on B.C. water systems.

“You have to think of these mussels like that.

They turn the water into aquatic deserts.

“There is nothing left except these mussels. The communities that have experienced this...there is no going back.

“We would be facing a new status quo that we would never heal from and B.C. would be a far less wonderful place to live and a far less wonderful place to visit.”

For the past six months, Morrice, 30, traveled to areas of North America that have suffered from infestations of zebra and quagga mussels.

The mussels have been found in Lake Winnipeg, in North Dakota and as close as Nevada, just a day and a half drive to the B.C. border.

They can survive outside of water for 10 days or in wet carpet or the bilge area of a boat for up to 30 days.

Morrice says it wouldn’t take much for a boat to pass through the border, into B.C. and zebra and quagga mussels would be infesting a local lake, devastating the ecosystem, eating up the plants, killing off native species and polluting the water with the associated algae blooms.

In fact it’s nearly happened in our region already. In 2012, a boat launched into Shuswap Lake with quagga mussels attached to it. Luck3ily they were dead and did not infest the lake.

Then last March, a boat infected by the quagga mussels was stopped at a border crossing at Osoyoos, heading for B.C. waters.

“People who really understand, who really get this, are up in arms,” said Morrice.

“This is a major issue.

This is going to affect the entire province in a profound way.

“Our communities in B.C. are built on lakes and rivers and this could be devastating if we had an infestation.”

••• A graduate of W.L. Seaton High School in Vernon, Brynne Morrice was a typical Okanagan resident growing up.

His grandmother had a cabin on Shuswap Lake, one of B.C.’s great vacation lakes. He spent his youth fishing, swimming and boating around the Okanagan.

As an actor and filmmaker, he has spent

news the past decade trying to break into the film world, beginning at the Kelowna Actors Studio, progressing to acting school and now to work as an actor in New York, where he spends parts of his year while

also spending time back in the Okanagan.

During one visit home last year, he read a newspaper article detailing the fight of the OBWB against zebra and quagga mussels.

“When I read that

newspaper article explaining the frustrations of a group like the Okanagan Basin Water Board, I saw a need for a project like this,” he said of his movie.

“After two years of raising alarms there

wasn’t any assertive protective measures being taken on our borders to protect us from the mussels. Having grown up in the valley, what we have here is pretty important, and I was quite honestly frightened about

the possibility, and as I looked into it more and more I became even more worried.”

With just 20 bucks in his wallet, Morrice approached the OBWB with an idea for a documentary, allowing him

to get in touch with experts to interview for the project.

public.

Within three days, he had raised $2,000 and within 30 days that increased to $5,000.

He then traveled to places in the U.S. that are dealing with the devastating effects of an infestation of the mussels.

He saw first-hand what kind of deadly effect they have on lakes and rivers.

He talked to people in B.C. who are pushing government to expand its detection policies and increase security at the border with Alberta and at the Canada-US border between B.C. and Washington.

What he came away with was enough information for a much larger feature. But he pared it down to six minutes in the hopes more people would see it and hear the message.

“I hope it reaches the people who haven’t heard about this before and to the people who have heard about this, I hope it gives them a really clear understanding of what we are talking about,” Morrice said.

“That this is just not

a minor little change to our environment that no one will notice. This is a catastrophic upheaval in our fresh water that will affect everybody.

“I can say that with confidence having spent six months researching this. Ultimately, I hope the government will really step up and do the maximum. Right now I think they are doing the minimum.”

enforcement and funding to deal with the invasive mussels (as well as other invasive species), there is some movement from government to try and deal with the issues.

Earlier this month, the provincial government announced a twoyear $1.3 million program that would fund roaming teams to inspect and decontaminate boats identified as a concern either at the Canada-US border or boats coming into B.C. from Alberta.

Last December, the federal government announced new invasive species legislation that would make it illegal to bring an invasive species over the border.

However, that legislation has yet to make it into law as another boating season begins. It’s a complex issue with multiple jurisdictions including provinces, the federal government, several US states, a group known as the Pacific Northwest Economic Region and local governments all working towards a solution to the increas-

ing problem of invasive species.

Kelowna-Mission MLA Steve Thomson says government is trying to be proactive on the issue.

“We think we have responded with a significant investment,” he said.

“This new funding will allow us to build capacity, experience and additional partnerships to expand the program in the future.

“It’s part of a perimeter strategy that we continue to develop. I think everyone is nervous (about zebra and quagga mussels). That’s why there has been a real effort on the part of local governments and others like the Okanagan Basin Water Board to look to the province to put additional resources into the program.

“We recognize this is a foundation to build longer-term funding for a sustainable program because the risks will continue to be there.”

Loan authorization bylaw 2014 - 906 (copied from the DLC website) INTERGOVERNMENTAL IMPLICATIONS: The District of Lake Country and the City of Kelowna have approved a reciprocal Memorandum of Understanding (MOU) whereas the City of Kelowna will assist with the purchase cost portion of the District. The City will advance 50% of the District of Lake Country purchase cost in exchange for 50% tenancy in common of the asset. The purpose is to assist the District’s purchase of its portion with the intent to pay back the City of Kelowna as soon as funds are available, especially through the sale of excess land. This will alleviate debt load of the District and protect the opportunity to finalize the deal with CN. The general terms of the MOU are as follows: • Kelowna and Lake Country will each pay 50% of the purchase price for the acquisition of the Lake Country Corridor from CN, which purchase price is presently estimated to be $5,145,000.

• Kelowna and Lake Country will be registered as tenants in common of the Lake Country corridor each as to half interest (50% each).

• As Lake Country reduces Kelowna’s investment interest, its interest in the ownership will increase while Kelowna’s will decrease.

• Lake Country purchase from Kelowna will not be based on market value but on actual purchase price.

• No interest will be applied to Kelowna’s investment in the land

for three years. Subsequent interest will be applied to Kelowna investment by a rate established by the Municipal Finance Authority on January 1st of each year.

• The proceeds from the disposition/sale of lands along the Lake Country corridor that are considered surplus will go entirely to reducing Kelowna’s investment in Lake Country lands.

• If funds become available, Lake Country can make additional payment to further reduce Kelowna’s share.

• Lake Country will maintain full decision - making authority for operating, maintaining and repairing the corridor until a decision is made to create a regional operation with all other participating partners.

Where does this document imply that there is no obligation to pay back Kelowna the $2.5 million or that it is in any way an option as Mayor Baker has constantly stated?

“I think sometimes people think we are ex-

aggerating the issue and I think that’s unfortunate. When the province announced they were putting $1.3 million over two years, we certainly didn’t feel that was adequate. That’s not what we asked for.

“We are asking our borders be manned with the equipment and the training required to make sure (the mus-

sels) never come into our province.

“The OBWB feels very strongly that the reaction from government is not strong enough.”

Paint a panel in a community mural

A 24’x48’ mosaic-style mural to be mounted on the south wall of Winfield Memorial Hall will be developed from two artists’ work and using 480 (12”x12”) panels painted by local residents, students and artists.

Parcel Tax Review Panel Pursuant to the provisions of Section 204 of the Community Charter, the District of Lake Country will be holding a Review Panel in regard to parcel tax assessment rolls. Notices are being sent to registered owners of all properties being added to an assessment roll.

The 2015 Parcel Tax Review Panel will sit at 6:00 pm on Thursday, April 23rd, in the Council Chambers at the Municipal Hall. You may make a complaint to the Parcel Tax Review Panel on one or more of the following grounds:  there is an error or omission respecting a name or address on the parcel tax roll;  there is an error or omission respecting the inclusion of a parcel;  there is an error or omission respecting the taxable area or the taxable frontage of a parcel; or  an exemption has been improperly allowed or disallowed.

You or your agent must notify the District of Lake Country, in writing, of your complaint. The District of Lake Country must receive written notice of the complaint before 4:30 p.m. on Friday, April 17, 2015. Please address your complaints to the attention of the Collector.

The parcel tax assessment rolls will be available for public inspection starting Tuesday, April 7, 2015, at the Municipal Hall during regular office hours (8:30 am to 4:30 pm).
