Multiple liens placed on city hall

Building Surrey’s new city hall was a “nightmare for every party involved,” according to a contractor about to join a host of others suing the city and its general contractor.

Zoran Vukelic, owner of Wolf Masonry Ltd., says he’s owed $250,000, but absorbed another $500,000 because the project was months behind schedule.

As such, he was paying people to show up and wait and he was renting equipment that sat idle.

As a bonded tradesperson, he couldn’t walk away from the project or he would lose his house.

Vancouver’s Wolf Masonry was hired for $1.5 million to install all the stone work at city hall, including the black granite in council chambers.

“I started in October 2012 and I was supposed to start in June, so at that point, I was already behind,” Vukelic said this week. “I got the bulk of my men off that site in February-March 2014.”

The project was supposed to be finished in September 2013.

Vukelic expects to file a lawsuit for his $250,000 in the coming days.

His is one of many court actions aimed at the city and its general contractor over the building of the new city hall in City Centre.

Ron Fettback, vice-president of operations for Western Pacific Enterprises (WPE), says his company, and others, have been treated extremely poorly by the city.

He’s been waiting for a year-and-a-half for $6 million he says is owed WPE and it still hasn’t been paid.

Fettback says he was made responsible for retrofitting the unfinished city hall so it could be used for the mayor’s annual charity ball that took place Oct. 18, 2013.

He said the work cost him $90,000 – none of which he’s seen yet.

“It’s completely unacceptable to do that,” Fettback said Tuesday. “If we’re having a dispute, let’s resolve it in a fair and reasonable manner.”

“I think we’re just seeing the front end of (the court actions) because they’re not resolving anything,” Fettback said.

The construction of the new $97-million building became a hot-button election issue in the fall, with many saying it was an unnecessary use of taxpayer dollars.

For about the past year, liens have been placed on the property and legal action has been growing.

The problem began when construction for the project went past deadline, Fettback said. From there, the city held back money from general contractor PCL Constructors Westcoast Inc. (PCL). continued on page 4

Property values in this region have shown a small uptick in values, according to B.C. Assessment Authority’s (BCAA) latest figures.

On average, Delta homes highlighted by the authority saw an increase of 5.6 per cent in 2014 compared to 2013.

White Rock, properties went up by 4.05 per cent.

And in Surrey, there was an increase in values of 2.86 per cent.

“Most homes in the South Fraser region are worth more in value compared to last year’s assessment roll,” said Brian Smith, BCAA acting deputy assessor. “Most South Fraser homeowners will see modest changes (of up to 10 per cent).”

Some of the best-performing properties were single-family dwellings (SFD) built in White Rock in 1966, where they rose

from $612,300 in 2013 to $683,700 last year – an increase of 10.44 per cent.

The next biggest increase was in Sunshine Hills in North Delta, where SFDs built in 2001 boomed from $780,000 to $855,000 – an increase of 8.77 per cent.

In Surrey, the best performers were found in the south part of the city, where an SFD built in 1981 worth $672,000 shot up in value to $716,000 – a jump of 6.15 per cent.

In the three municipalities, apartments and townhomes didn’t fare as well as SFDs, with the best performers being Royal Oaks apartments in Tsawwassen, which went from $637,000 to $684,000 – a hike of 6.87 per cent.

In all, the total land value in this region increased by $9.3 billion, according to BCAA. Of that, $2.9 million is due to subdivisions, rezoning and new construction.

Lower Mainland real estate prices recorded modest to strong gains in 2014, with detached houses generally rising faster than townhouses or condos.

Year-end statistics released by the Greater Vancouver and Fraser Valley real estate boards show benchmark detached houses on average gained 6.7 per cent over the past year.

Those increases ranged from more than 10 per cent in Vancouver, Tsawwassen and Burnaby to less than five per cent in West Vancouver, Maple Ridge, Pitt Meadows, Port Coquitlam, Langley, Abbotsford,

Mission and parts of Surrey.

The increases pushed the benchmark price of houses above $1 million for the first time in Burnaby and for the Greater Vancouver area as a whole.

Benchmark house prices across the Fraser Valley area, which includes Surrey, White Rock and North Delta, ended the year at $573,100.

Benchmark prices show the shifts of a typical property and exclude the most expensive ones that can skew average prices much higher.

Price increases were more muted for townhouses and condos across the region.

Townhouses or attached homes averaged a 2.6 per cent gain across the Lower Mainland, with the strongest gains of more than seven per cent recorded in Maple Ridge, North Delta, Squamish and

Vancouver’s west side.

Benchmark townhouse prices were $293,500 in the Fraser Valley and $476,000 in Greater Vancouver.

Condo prices dropped in value in several areas in 2014, with the Fraser Valley benchmark down 0.8 per cent and the biggest drops of nearly 10 per cent in Maple Ridge and North Surrey. Greater Vancouver condos gained 3.5 per cent on average.

Benchmark condo prices ended the year at $191,100 for the Fraser Valley and $380,700 for Greater Vancouver.

The December 2014 statistics provided by realtor associations are different from the just-released home assessments, which are conducted by the B.C. Assessment Authority and are intended to provide a valuation snapshot as of each July 1.

Kelly said the city is withholding payments until the trades remedy deficiencies in the work.

Prediction and anecdotal experience beg the question of whether or not there exists measurement of the relationship between gas prices and traffic volume, holiday times and traffic volume, or weather and traffic volume.

Mayor Linda Hepner said she would not comment on the issue as it’s now in litigation.

She did say it’s her understanding the city has fulfilled all of its commitments.

“My understanding is the city has paid the primary contractor,” Hepner said. “I don’t know what more we can do when we have paid all of our bills.”

After sending a series of mixed messages, the provincial government now says it will back the yes side in the upcoming transit tax referendum.

“We support a ‘yes’ vote in the spring 2015 plebiscite but the voters of Metro Vancouver will have the final say – this is the commitment we made to them in the last provincial election campaign,” Transportation Minister Todd Stone said in a statement emailed by his staff.

He reiterated that transit expansion is “vital to economic development in Metro Vancouver and will be a critical component of ensuring that the region is able to accommodate the million additional people expected over the next 30 years.”

The proposed 0.5-per-cent Metro-only sales tax – dubbed the Congestion Improvement Tax – would raise $250 million a year for transit and transportation projects if a majority of regional voters approve it in a mail-in vote slated to run from March 16 to May 29.

Stone said the province believes the Metro mayors’ vision for expanded transportation is one people can get behind.

“We agree that a sales-based tax, dedicated to vital congestion improvement projects, is the most equitable funding option available.”

Provincial funding will only go to running the plebiscite, he added, while mayors and other organizations will be responsible for funding their campaigns.

It’s still unclear exactly how active Stone or other government members will be in encouraging a yes vote.

Some observers had concluded the province was abandoning the mayors to fight alone after the transportation ministry on Dec.

A referendum on funding transit will take place this spring. LEADER FILE PHOTO 29 told a Vancouver newspaper “the government will not be supporting either side – yes or no.”

That appeared to contradict Stone’s earlier comments to reporters in mid-December that he was “committed to success” and the province would speak out strongly during the

campaign on the need to fight congestion and make more transportation investments.

A subsequent Black Press request for clarification yielded a Dec. 30 ministry statement saying “government is only funding the referendum and will not be financially supporting either the

yes or the no side.”

There had been doubts about the province’s support since Premier Christy Clark in 2013 suggested government would remain officially neutral.

Metro Vancouver Board Chair Greg Moore said he’s confident the province will actively support the yes campaign.

“They understand the importance of transportation in the region, how good our plan is and that they need to get behind it,” he said.

New Democrats – with the exception of Burnaby Mayor Derek Corrigan – have vowed to campaign for yes and had accused the premier of trying to duck responsibility after forcing the referendum on the region.

Crime: No quick answer One year ago last week, Julie Paskall was murdered outside the Newton Arena.

It was the 25th murder of the year in Surrey, as 2013 was a terrible year for homicides in the city. The number of murders reached an all-time high.

Her death sparked a wave of outrage that has ebbed and flowed, but still managed to dominated the recent municipal election campaign and led to council recently agreeing to hire a significant number of new police officers.

While the politicians have heard loud and clear from the public about violent crime, many of the actions taken by various government agencies fly in the face of actually doing something about crime issues. Surrey continues to lag in dealing with mental illness, drug recovery houses and homelessness. While these may be contributing factors to crime, they most definitely do contribute to a general sense of disorder and confusion, and they all take up significant amounts of police time.

Most of these issues are the responsibilities of the federal and provincial governments, but there is little in the way of on-the-ground responses to them. Surrey continues to grow dramatically, but the services offered and funding made available is often more appropriate for a city half its size.

The man charged in Paskall’s murder is a prime example of why much more is necessary in the way of resources. Yosef Jomo Gopaul, 27, had just moved to Surrey eight weeks earlier from Brampton, Ontario. He was wellknown to police there, and his move to Surrey meant there was another person with a challenging background for police to look out for here.

He was considered at risk for reoffending after a violent assault in Ontario five years ago.

However, Surrey RCMP were not notified because Gopaul had served his full term and he was free to travel the country without having the public warned.

In 2010, Gopaul was sentenced to two years and seven months in jail after a violent assault on a woman in Brampton. Parole Board documents show he followed a woman home from a bar on Jan. 1, 2009 and attacked her.

There are many more people like him on the streets of Surrey.

Some are out of jail; in some cases they have been labelled high risks to reoffend. However, for many different reasons, police do not always know about them.

To use Johnston’s own words in his last sentence, “Oh, excuse me, that’s a definition for insanity.”

I could not have put it better myself. The letter writer has made a strong case for choosing SkyTrain over LRT. It so happens that most people love their cars and the last thing they want to do is increase congestion. We have too much congestion already.

SkyTrain would reduce congestion by not blocking road traffic and offer an alternative to leaving your car at home, if it makes practical sense to do so. That is the sane thing to do.

Every day I pass by the parking lot at Scottsdale Centre. I walk past the line of handicapped parking spots out front of the Chapters, SportChek and pet store. Inevitably every single one of the handicapped parking stalls are filled with cars that have no handicapped parking permit.

Why does no one ever do anything about this? Why do the police not give tickets for this? Why do they never get towed? Why is there zero accountability for these ignorant people who obviously do not care about the rights of the disabled?

The few times I’ve stood by and waited for the owners of the vehicles to appear, they are almost always young able-bodied men and women who respond to my complaints with disdain, sarcasm and even hostility.

It’s time people stand up for the disabled and the City of Surrey should make these people pay.

a teen. However, there is little she can do except offer words of sympathy.

It can be argued that Surrey has not put enough resources into policing as the city has grown, but it is now trying to catch up.

However, police need to have all the tools to do the job. They are hampered by the rights of criminals to privacy; by the cumbersome court system; by light (or no) sentencing; and by the limited ability to deal with repeat offenders, who cause an inordinate amount of crime.

The federal government has tried to toughen up sentencing, but in many cases, reforms passed by Parliament have fallen to Charter of Rights challenges in court. The court system seems determined to allow some dangerous people to prowl the streets of Surrey and other cities.

What is the solution? More policing will help, as will more vigilance by neighbours about trouble spots. However, it seems that the problems grow at a faster pace than solutions. If that is the case, Surrey may be in for many years of enormous challenges which have the potential to make some parts of the city quite undesirable.

It’s the end of an era for drivers of older vehicles in the Lower Mainland.

AirCare stations shut down for good on New Year’s Eve and now that it’s 2015, motorists will no longer line up to pay for mandatory emissions testing.

The requirement in order to get vehicle insurance in Metro Vancouver and the Fraser Valley was widely seen by drivers as a costly nuisance, particularly as cars got cleaner and most vehicles passed without being forced to get a tune-up.

But defenders argue the provincial government was wrong to scrap the TransLink-operated program.

“We know air quality from vehicles has improved over the last 10 or 15 years because we’ve been monitoring vehicles,” said Vancouver Coun.

Heather Deal, chair of Metro Vancouver’s environment and parks committee.

“It was a mistake to discontinue this pro-

gram. It will endanger the incredibly positive impacts it’s had over the years.”

The province’s environment ministry cited “great progress” in reducing air pollution from light duty vehicles as emissions technology improved and noted the AirCare failure rate has fallen from 14 per cent in 2007 to less than eight per cent.

No new program has been announced to replace AirCare, but the province is expected to release a discussion paper in the spring on possible options to cut pollution from heavy trucks.

trucks because Metro testing on roads has found alarming emissions from some “gross emitters.”

Dave Gourley, general manager of AirCare, said he “absolutely” believes Lower Mainland residents have breathed easier because AirCare enforced pollution limits for 22 years.

He notes nearly one million vehicles failed AirCare tests at some point since the program began in 1992.

Most were repaired and returned to the road cleaner, while some others got early retirement.

In 2014, more than 34,000 vehicles failed AirCare, although that’s down from a peak of around

“The technology changed and the cars can more or less diagnose themselves,” Gourley said, making AirCare less relevant in recent years, at least in its current form.

“It’s hard to make an argument in favour of it,” he said. “I can’t honestly say anybody is going to die or the sky is going to turn brown.”

He said it’s too soon to say if enough drivers will now ignore check engine lights to significantly worsen vehicle pollution and air quality.

AirCare’s end here leaves just urban Ontario’s DriveClean program in Canada.

Officer absolved in fatal shooting ▶ RCMP DOG HANDLER KILLED SUICIDAL MAN ONE YEAR AGO KEVIN DIAKIW

The province’s police watchdog has cleared a Surrey RCMP dog handler of wrongdoing in shooting an intoxicated and suicidal man last year.

The Independent Investigations Office (IIO) released a 14-page report outlining the details of its investigation.

The report, released Monday, does not name either the victim or the officer.

The investigation stems from an incident in North Surrey on Jan. 17, 2014 when Surrey RCMP responded to a call about a suicidal man.

One officer went to the man’s residence with the landlord and found a suicide note. The dog handler initiated a search for the troubled man.

Less than five minutes later, the officer with the dog section shot and killed the suicidal man.

Witnesses indicated the officer’s shot was return fire from the suicidal man’s shotgun blast.

“It went right by my head; I felt it go

right by,” a witness officer heard the dog handler say.

He later told another officer, “I don’t know how I’m alive; I don’t know how I’m still here.”

A toxicology report indicated the man with the shotgun would have been impaired at the time.

The IIO found no criminal culpability on the part of the officer.

“Based on the evidence obtained as a result of the investigation, I cannot conclude that the subject officer may have committed an offense in this case,” wrote IIO’s Richard Rosenthal in his finding.

Surrey RCMP has released a composite drawing and IS asking for the public’s help to identify a male suspect in a Nov. 29 South Surrey incident in which a stranger pointed a firearm at a young woman.

The 18-year-old was walking home from a friend’s house near 152 Street and 20 Avenue at 11:30 p.m. when a man pointed a black handgun at her and told her not to run.

The woman, who had been wearing headphones, removed them when she realized someone was talking to her. The man was standing near the entrance to a pathway on the south side of 20 Avenue, in the 15100-block.

North Delta woman accused of trying to smuggle $900K in cocaine across border A North Delta woman is in custody in the U.S. after allegedly

A Surrey RCMP officer charged with numerous firearm offences in 2010 has been ordered to stand trial in B.C. Supreme Court.

Const. David Matthew Clarke was in Surrey Provincial Court Dec. 17 for a preliminary hearing of evidence.

He was initially charged with 15 offences, but has been ordered to stand trial on 12 of them.

The charges include breach of trust by a public officer, possession of stolen property, three counts of unauthorized possession of a firearm, three of knowingly possessing a firearm without a licence, two of possessing a prohibited or restricted firearm with ammunition, and two counts of knowingly possessing a prohibited weapon without a David Clarke licence.

The charges relate to offences that allegedly occurred in Chilliwack.

The case will now be heard in B.C. Supreme Court in New Westminster. A trial date has yet to be set.

When Clarke was charged four years ago, Surrey’s then-Chief Supt. Fraser MacRae said such situations “are very rare” but taken very seriously.

Clarke remains suspended without pay. His next court date is today (Jan. 8).

According to U.S. Customs and Border Protection (CBP), Robyn Courtney Bell, 32, was attempting to cross from Blaine into South Surrey on Dec. 17 in her 2007 Volvo when an officer deployed his canine partner, Zzook.

Zzook sniffed Bell’s vehicle and indicated an odour of narcotics.

The 14th annual Surrey Fire Fighters Goodwill Classic is underway at Lord Tweedsmuir Secondary School.

The all-Surrey senior girls high school basketball tournament tipped off Tuesday afternoon with the first eight of 36 games to be played over five days.

Hosted by the Surrey Fire Fighters Foundation, the tournament has distributed more than $70,000 in bursaries to participants over the years.

This year’s sponsors, which include the Fire Fighters Foundation, Big Kahuna Sports, AthElite Basketball Academy and Westland Insurance, will be awarding several $750 scholarships at the conclusion of the tournament.

Twenty-two teams will compete in the 2015 tournament, with 11 each in the Axe and Ladder divisions of competition.

Four schools in the Axe Division are listed in the B.C. Secondary Schools Girls Basketball Association provincial rankings.

The Lord Tweedsmuir Panthers and Fleetwood Park Dragons have received honorable mention in the Senior AAA category, while the Holy Cross Crusaders are No. 5 in the Senior AA poll, with the Southridge Storm an

honorable mention.

Holy Cross and Fleetwood Park have met in the last three Axe Division finals, with the Crusaders winning two of the three.

The championship game in the Ladder Division will tip-off at 2:30 p.m.

Saturday at Lord Tweedmuir Secondary, followed by the Axe Division final at 4 p.m.

RCMP tourney starts Sunday With 76 games scheduled at nine schools over seven days, the Surrey RCMP Classic remains the biggest high school sports event in the city.

The Senior Boys and Junior Boys tournaments will feature 43 teams vying for the unofficial City of Surrey championship, with the first games scheduled for Sunday (Jan. 11) and the championship games on Saturday, Jan. 17 at Enver Creek Secondary.

Now in its 24th year, the RCMP Classic will include 24 senior teams, 16 of which will play in one of eight qualifying games Sunday at L.A. Matheson and Lord Tweedsmiur Secondary.

The eight winners advance to the 16-team championship round, the eight losers will play in the B pool at Frank Hurt Secondary.

The Southridge Storm, the top-ranked team in the Senior 2A category, are also competing at the RCMP Classic.

Nineteen teams will compete in the junior category, which begins Monday at Tamanawis and Princess Margaret Secondaries. The championship game is Jan. 17 at noon at Enver Creek.

Hawks impress with play at Mac’s ▶ MAJOR MIDGET TEAM JUST MISSES PLAYOFF ROUND AT CALGARY TOURNAMENT

The results weren’t enough to get them into the playoff round, but their play over four games at the Mac’s Tournament in Calgary definitely impressed their head coach.

The Valley West Hawks went 1-1-2 (wonlost-tied) at the 25-team tournament, placing third in their group and missing the

eight-team playoff round by two points.

Hawks head coach Jessie Leung said the Hawks “deserved a better fate” and could easily have finished atop their group after playing as well as “I’ve ever seen out team perform” over the six-day Major Midget hockey tournament.

“As a team we rose to the challenge and gave ourselves an opportunity to play for first place in our pool on the final day,” Leung said. “It was a great showing for our team against some of the very best teams in midget hockey.”

Their lone loss of the tournament came on

the final day of the round robin, a 6-1 loss to the German National U17 team in Dec. 30.

Christian Bosa of Langley scored the Valley West goal midway through the first period, which tied the game 1-1. Germany then scored four unanswered goals in the second period.

“It was while we were sniffing for goals that the Germans caught us,” said Leung. “We gave up a handful of odd man rushes midway through the period and that’s all it took for the Germans to take over. We gave them and inch and they took a couple feet.”

The Hawks began play with a 3-3 tie with

the Huron Perth Lakers of Ontario on Boxing Day. Malm scored all three goals for Valley West, the third coming with 11 minutes remaining in the game. The Hawks held a 2-0 lead early in the game, but trailed 3-2 after 40 minutes.

Some of the city’s most talented teenagers will be front and centre in Cloverdale later this month, when the Surrey Coast Capital Savings TeenFest kicks off.

The annual event, set for Jan. 31 at the Cloverdale Agriplex, will be highlighted by a teen talent contest, which will showcase singers, dancers, musicians, comedians and other entertainers, all between the ages of 12 and 18.

Verdict Starting at $37,395 and maxing out at $45,295 for an AWD platinum V6 model, there are many trims to choose (V8 equipped cars run roughly $2,000 more).

The base is the value leader, the S is the sporty model, with standard 20-inch wheels, and the 300C Platinum is the one featuring the opulent interior. Chrysler believes that the S model will be the volume leader thanks to the aggressive black trim and chunky wheels. This is a surprise because the Dodge Charger is based on the same platform and has the whole “bad boy” attitude in spades, something the 300 looks to be mimicking. The top Platinum would be my choice because it’s interior is so different from the Dodge, something that truly separates the two cars plus it has all the latest safety features including the autonomous braking system when a crash is detected. Much has changed in 10 years for the 300 but the same goodness that was in the 2005 model is still here; it is the refinement that makes this a modern sedan.
