Workers’ cancer cluster claim denied by court Tyler Olsen ABBOTSFORD NEWS
The B.C. Court of Appeal has upheld a previous court ruling finding no proof for the claim that working at Mission Memorial Hospital’s lab caused breast cancer in former workers. In the December rul-
ing, the Court of Appeal set aside a previous Workers Compensation Appeal Tribunal decision that had found in favour of Patricia Schmidt, Katrina Hammer and Anne MacFarlane, and agreed with a 2013 Supreme Court decision. Six lab technicians at the hospital contracted breast cancer between
1970 and 2004 in what was deemed a “cancer cluster.” The Court of Appeal is just the latest body to rule on whether or not the women’s employment at the hospital led to the cancer. After the Workers Compensation Board ruled against the women, a Workers’
Compensation Administrative Tribunal (WCAT) disagreed and found in favour of the former MMH employees in 2011. But the Fraser Health Authority appealed and in 2013, that decision was quashed. In December, with the case back in court, three of five court of appeal justices again found that
the WCAT ruling was “patently unreasonable” and that beyond “an unexplained statistical anomaly” there was no evidence that employment in the lab caused the women to develop breast cancer. “The suggestion that the cancer was caused by her employment conditions does not
rise above speculation,” wrote Justice Richard Goepel. He agreed with the Supreme Court justice who noted that “a higher-than-expected rate of cancer in a workplace cannot alone provide evidence that the cancer was caused by occupational factors” given a report stating clusters of
cancer in a workplace are statistically certain to arise in various places and times. Two justices dissented, noting that while a court of law would favour a “more technical reading” of expert reports, the WCAT’s decision was not unreasonable and thus should not be before the courts.
Mission football star scores TD at all-star game in U.S. Mission Roadrunners star Jesse Walker has played a lot of football this season. It started in mid-August with pre-season training camp and didn’t end until early December, when his team made it to the Double-A final of the 2014 Subway Bowl at BC Place Stadium, where he scored three touchdowns in a losing effort. But he wasn’t able to put away his pads just yet. The 6’2”, 195-pound senior, who was named

the 2014 Double-A Player of the Year, was then selected to a B.C. all-star squad that participated in the 4th annual Tanoa Bowl Classic in Auburn, Wash., on Sunday. For the players on Team BC hoping to land U.S. scholarships, the game was a good opportunity to display their gridiron skills in front of American scouts and coaches. The month of January is named after the Roman god, Janus, the god of gates and doorways, who is usually depicted with two faces, each looking in opposite directions. Just as every doorway looks outward and inward, the month of January looks backward and forward. January is a good time to take stock of how far we’ve come during the previous year and to also look forward to the coming year. Many of us do this with New Year’s resolutions and superficial commitments to lose weight or save money in the coming year. But, if we are to have a successful year, we should do some serious soul-searching, asking ourselves how God would evaluate our previous year. How did we do in the really important areas of our lives? That is, how did we treat our families, friends, and co-workers over the past year? How is our present relationship with God? Are we a better person than we were twelve months ago? If we really want to have a better year this year, why not start by trying to be a better person. As Gandhi so rightly said, “Be the change you wish to see in the world.” And to do this, it really requires more than just thinking back on the previous year and looking forward to the coming one. We need to have a plan with a direction, and firm resolve as we cross the threshold into the New Year.

“Quite a lot of endangered species can actually be found in Mission,” said Lovena Morton, a wildlife habitat protection intern with the South Coast Conservation Program (SCCP). The most common are the Oregon Forest snail, Pacific Sideband snail, Northern RedLegged frog, Great Blue heron, and Band-tailed pigeon. “Mission also has Pacifc Watershrew, a rare plant called the Phantom Orchid, and there’s Western Painted turtles in Silvermere Lake.” “Each property is different,” added Tamsin Baker, stewardship coordinator with the program. “We’re mostly interested in finding areas with habitat.” Over the next few months, members of the SCCP are offering to help you learn more about the nature in your backyard and show you how to improve habitat for the native plants and wildlife. They can also suggest ways to incorporate native flowering plants on your property to attract certain birds and bees, while controlling invasive species. “On one property, we helped the landowner restore a portion of Windebank Creek by removing invasive blackberry and planting native vegetation along the creek,” said Morton. There are currently more than 260 endangered plant and animal species living in the Lower Mainland and Fraser Valley. As the human population grows, the natural areas and the species they support shrink, said Baker, noting stewardship is one way to help maintain the environment’s diversity. The free program is available to property owners with land adjacent to a forest, wetland, creek or pond. Financial support of the program is provided by Environment Canada. • Coun. Nelson Tilbury said Coun. Dave Hensman appeared to have a conflict of interest because he had “acquired an interest” in a property located on the southeast corner of First Avenue and Welton Street. The property is about a block away from the former Buy Low building, recently purchased by the city. • Mission council took steps to increase traffic on the Fraser River by amending its industrial general zone to include barge loading as a permitted use. The move was aimed at taking trucks off the roads, creating more good-paying jobs, and conforming the existing properties that have barge loading facilities. • District of Mission and police stepped up education and enforcement campaigns in West Stave Lake after the area was vandalized, shot up, and damaged by rowdy outdoor users. Every road sign and bridge marker was hit by bullets and garbage was piled in front of forestry gates. Outhouses and picnic areas were damaged and vehicles were burned. • Two councillors, Jeff Jewell and Jenny Stevens, resigned from the political slate, Citizens for Responsible Municipal Government. All council members elected in 2011 were part of CRMG. Stevens said recent conflict of interest allegations surrounding Coun. Hensman somewhat influenced her decision, but “are no more than the final straw.”
February • A legal opinion obtained by the District of Mission in regard to the conflict of interest allegations surrounding Coun. Dave Hensman concluded that the case of a conflict was not clear and obvious, and that there was a strong chance that an application to resolve the matter in BC Supreme Court would fail. Hensman and Mayor Ted Adlem referenced the legal opinion when they

Larry Nundal also rejected such a move. • Coun. Tony Luck broke away from Citizens for Responsible Municipal Government. Luck cited an “irreconcilable split of CRMG” and a lack of confidence in the mayor’s leadership as reasons for his departure. • Mayor Ted Adlem took over as chair of all six standing committees in Mission. In the past, each councillor was assigned one of six portfolios and was handed the gavel when items related to their department was up for discussion. The change, Adlem had said, would encour-
sociate themselves from the mayor’s actions and statements unless there was a prior resolution from council. Couns. Hensman and Nundal and the mayor opposed the motion. • District of Mission employee April Smith was charged in connection with the disappearance of $116,000 from the Mission RCMP detachment’s exhibit room. The money was discovered missing during a routine audit in January 2013. • More than 1,000 B.C. youth came to Mission for the B.C. Winter Games. Young athletes competed in 18 events over four days. The opening and closing ceremonies were

The $748-million project is expected to be finished in 2018. The meters were installed in the West Heights area where about 500 residences were built in the 1970s. About 300 homes built after 2009 will also be part of the program. • Construction for the Rotary Observatory and Space Centre at Fraser River Heritage Park began. About $140,000 was raised to build the 2,100-sq.ft. facility.

The trail was built on Crown land by local residents and is not a designated trail. • Searchers looked for a Mission man, Mike Murphy, on Kinbasket Lake. He was in the area
• Three suspicious fires were set in the Bowie Drive area in one night. Nobody was injured in the incidents, but the residents in the neighbourhood were shaken up and concerned about their safety. • Fraser Health Authority announced a residence for mental health clients will be part of Mission’s campus of care. The plan was to convert the former Pleasant View facility on Hurd Street to a 54-bed mental health residential campus.
May • A mobile home fire on Lougheed Highway claimed the life of 86-year-old Bill Murphy. His body was discovered inside the trailer after firefighters put out the deliberately set fire. • Nine teaching and seven CUPE (Canadian Union of Public Employee) support staff positions were eliminated to help Mission school district balance its budget. The majority of this year’s shortfall was a result of declining enrolment and CUPE contract increases. • A one-day teachers’ strike closed schools in Mission. The strike was part of the BC Teachers’ Federation job action plan to place pressure on the province during contract negotiations. • A barge in Silverdale was damaged by fire, but the water around it was not harmed by hydrocarbons, author-

To make up for loss time, the BC Custom Car Association combined the annual Smoke, Fire and Thunder event with the Lucas Oil Canadian National Open.
• Dedicated community volunteer, activist and author, Catherine Marcellus, passed away at the age of 91. She was a founding member of Lifetime Learning Centre Society and fought to keep services at Mission Memorial Hospital. She earned many awards, including Mission Citizen of the year, Freeman of the City, and Citizen of the Millennium.
• Mission dancer Gina Janus-Spedding returned home with Fiji’s VOU to be a part of the Mission Folk Music Festival. Janus-Spedding started dancing at age 10 and moved to the South Pacific after university to continue her career. CONTINUED ON 6

Festival organizers brought in Randy Houser in time for the event. • Skeletal remains discovered near Hayward Lake by forestry workers in May were identified by the BC Coroners Service as belonging to Mission resident Laura Pesek. Foul play was ruled out. • A new zone to accommodate businesses with barge loading facilities along the Fraser River was created by the district. The zoning amending bylaw was approved two days after a public hearing.

RCMP detachment. De Jager was a 16-year veteran of the force and was in the Canadian Forces before joining the RCMP. • Mission council lifted the district’s ban on harm reduction treatment clinics for drug addicts. • A large clandestine drug lab was discovered after a structure fire brought fire crews to the area of Horne Street and Glasgow Avenue. About 60 kilograms

Hundert was a part of the Mission Artists Association, Mission Arts Council, Mission Health Care Auxiliary, and the Mission Heritage Association. She received numerous awards including the BC Seniors, Mission’s Citizen of the Year, Freeman, and the Queen’s Diamond Jubilee.
October • Three families on Best Avenue near Cedar Street launched court action against the District of Mission for damages on their properties. They claim their homes are sinking because they were built on unstable fill on top of a district culvert/right of way. • District of Mission sought input from the public on a plan to relocate Lougheed Highway traffic from First Avenue to N. Railway Avenue. Moving the highway was identified as one of the 10 big moves in the district’s plan to revitalize downtown. • Mission Secondary School was selected as the location for the district’s only high school. The school would accommodate students in Grades 10, 11, and 12. Heritage Park and Hatzic secondary schools would turn into middle schools for students in Grades 7, 8, and 9. • Rockin River MusicFest organizers announced plans to move the popular country music festival to Merritt next year. Festival president Kenny Hess said a new location was needed to accommodate the growth of the event.
November • Mayor Ted Adlem launched legal action in BC Supreme Court, alleging former councillor Ron Taylor and his wife sent defamatory statements about him, and threatening political blackmail to numerous election candidates and senior staff at the District of Mission. The

• Randy Hawes was elected as mayor in the civic election. Jim Hinds, Pam Alexis, Carol Hamilton, Danny Plecas, Jenny Stevens, and Rhett Nicholson were elected as councillors. Jim Taylor, Tracy Loffler, Rick McKamey, and Randy Cairns were elected as schools trustees. All members of the CRMG slate lost their seats, including incumbent Mayor Ted Adlem. • The Mission Friendship Centre was labelled as “in difficulty” by the provincial organization that oversees such centres following complaints from former employees and members. Executive director Grace Cunningham said the centre is working “to address the challenges…” • Doreen Cameron, a longtime Steelhead resident who helped shaped the northern community, passed away at the age of 89. Cameron was involved with community events and a walking route in the municipal forest called Doreen’s Trail was named in her honour.
December • Mission Mounties investigated a bomb scare at the Safeway in the Mission Hills Mall. The store was cleared and employees and shoppers returned a couple of hours later. No explosives were found. • Mission resident Dustin McDonald was charged with a number of offences after a police vehicle was shot at. The incident occurred in the 32900 block of Best Avenue. • Plans developed by the previous council to help revitalize downtown were put on hold by the newly elected politicians. Mission’s new council voted to not proceed with a $6-million project to move Highway 7 off First Avenue and to postpone development of the Welton Street plan until options exploring the acquisition of the post office building at the corner of First Avenue and Welton Street are considered.

Community-based program encourages children to read Grade 3 and 4 students at Windebank elementary school can win a bike by reading for at least 90 minutes each month until May. The Bikes for Books program is initiated by the Pacific Lodge number 16 of the
Ancient Free and Accepted Masons and supported by Wenting Cycle and Mountain Shop. Pacific Lodge is based in Abbotsford, but is made up of members from Mission as well. The p ro g ra m encourages children
to read for fun. Beginning on Jan. 5, students in Grades 3 and 4 will receive a calendar to record the amount of reading they do at home. At the end of each month, teachers will tally up the totals. For every 90 minutes
a student has read, they will receive a sticker to place their name on an ongoing reading graph in the school, and a ticket in the draw for a bicycle. There will be two bowls for the tickets – one for girls and one for boys.
At the end of April, the final calendar will be collected. When all the reading has been tallied, one name will be drawn from each bowl and the bikes will be presented at the May school assembly. Pacific Lodge No. 16
will supply the two BMX Maverick bikes. After the program is over, a review will be conducted with the school to determine the future viability of the program. Pacific Lodge No. 16 has a long history in Mission being formed
in 1892 by many employees of the CP Railway. Windbank Elementary school is named after one of the members, W.J. Windebank, who was the Master of the Lodge in 1926 and a past mayor of Mission.

Changes to Council Meetings At the regular Council meeting of December 15, 2014, Council gave first three readings to proposed District of Mission Council Procedure Amending Bylaw 54722014-5345(3). Under the proposed amendments, Committee of the Whole will convene at 1:00 pm on the first and third Monday of each month to review staff reports and make recommendations to Council. Council will reconvene at 7:00 pm the same day to ratify the Committee of the Whole recommendations, conduct public hearings (if applicable), handle other orders of business as described in the bylaw, and hold Question Period. Both meetings will be broadcast live on the District website and are open for the public to attend. Question Period has been broadened to allow questions to Council on any topic, and these questions and answers will be recorded in detail in the minutes of the meeting. These proposed changes bring increased flexibility and transparency to the Council proceedings, as well as provide more effective use of staff time. It is anticipated the bylaw will be adopted at the January 5, 2015 meeting, making these changes effective for the January 19th, 2015 meeting. 2015 Dog Licenses The District would like to remind everyone that notices to purchase new dog licenses have been sent to all previously registered dog owners. If you purchase a
dog license by January 31, 2015, you will receive a $5.00 discount on each license you purchase. The fees collected are used to help fund the cost of animal control services within the municipality. Just as importantly, the license you purchase identifies you as the dog’s owner. This is important if you need to be contacted because your doc has been found or injured.

Balancing Health without Wealth Back to Health… For Good 2015 takes place Saturday, January 10, 2015 from 12:00 pm - 4:00 pm. The theme for this year’s event is Balancing Health Without Wealth with a focus on the five areas needed for balanced health – Mental, Emotional, Spiritual, Social and Physical as taught by the Medicine Wheel. I’ve loved these cars for so long, but perhaps electronics have ruined it for me. Yes, it’s much more competent and has some great features, but I miss the days of the supercharged version. Don’t get me wrong, it’s still a super fun car to drive, but the downshift rev matching in the Cooper S with the manual transmission was not amazing. It was harsh and jerky. I also feel it lost a little bit of personality along its way to adulthood. I’ll forever love them, quirks and all. Honda Fit: MSRP range $14,495-$21,295 The Fit is on my list because I think it is just such a fabulous little car. The Magic Seats really are magic, but the new touchscreen is a huge deterrent. I strongly dislike it. I like buttons. I don’t mind if there are a few to complement the screen but I feel it takes my eyes off the road for too long, even if I’m familiar with the system.

It is with profound sadness that we announce the passing of our beloved husband, best friend and father after a courageous battle with cancer. Fred’s journey ended with his loving family at his side. Fred is survived by his loving wife, Heather (Rowe); his son Telford; and his daughter, Danae. Fred was a great husband and a loving father. Over the years many more would come to call him father as well. He had a big heart and would do anything for anyone. He spent many happy hours with friends at Mission A&W. The family would like to thank the Tertiary Palliative Care Unit at the Abbotsford Regional Hospital and the dedicated, comforting staff. A Celebration of Fred’s Life is scheduled for January 17th 2015, 1:00 pm at The Elks Hall in Mission, BC. All are welcome to attend and celebrate Fred’s life. Donations can be made to the Canadian Cancer Society in the hopes of fighting this disease.

OATES H.R. (Bob) H.R. (Bob) Oates late of Abbotsford, BC, formerly of Toronto, ON, passed away suddenly at home on December 29, 2014 at the age of 64. He is survived by his loving wife of 32 years, Francine, 4 children: R. Matthew (Chelsea), Kurtis (Jessica), Natalie, Desirée and siblings: Jim, Don, Sandra, Raymond and Debbie and their families. Bob was a loving father and caring husband. A visitation will be held at Henderson’s Fraser Valley Funeral Home, 34537 Marshall Road, Abbotsford, BC on Sunday, January 4, 2015 from 2:30 pm to 4:30 pm. A memorial service will be held on Monday, January 5, 2015 at 11:00 am in the chapel of Henderson’s Fraser Valley Funeral Home.
