Progress for murder trial

The three men charged in the ganglandstyle slaying of Red Scorpions leader Jonathan Bacon will get their day in court nearly five years after the infamous shooting took place.

Jujhar Khun-Khun, Michael Kerry Hunter Jones and Jason Thomas McBride will face first-degree murder charges as well as four counts each of attempted murder, in a trial starting April 4, 2016. It’s expected to continue for six months.

The lengthy process could offer answers to questions lingering since Bacon was fatally wounded while departing Kelowna’s Delta Grand Jonathan Bacon Hotel, Aug. 14, 2011.

Gunmen opened fire on the Porsche Cayenne driven by Bacon in broad daylight, leaving the gangster dead and his four companions in various states of disrepair.

Full-patch Hells Angel Larry Amero and Independent Soldier James Riach, were wounded in the shooting. Leah HaddenWatts, whose uncle is the president of the Haney HA chapter, was shot in the neck and paralyzed. Another woman, Lyndsey Black, was said to be largely unscathed.

The shooting took place during the height of B.C.’s gang troubles. Representatives from the Combined Forces Special Enforcement Unit (CFSEU) recently reported on bc-anti-gang.com, that there has been a “significant decline” in organized crime homicides in the years that have followed.

The reason, the report highlighted, has to do with a series of high-profile investigations leading to charges, as well as new initiatives to prevent or reduce gang membership.

The investigation into the Bacon killing lasted 18 months and was dubbed E-Nitrogen. It culminated in the arrest of Khun-Khun, Jones and McBride in February of 2013.

The number of gang-related killings in B.C. fell to 13 last year from 18 in 2012 and has been cut by almost two-thirds from the 36 gang murders committed in 2009.

Nearly 100 organized crime figures or gang-related individuals were arrested and charged last year with more than 270 offenses in close to 30 B.C. communities, Hackett said.

The report’s release came after the province announced policing cuts that will pare the CFSEU budget by $2.8 million.

Kelowna city council likes what the owners of the Capri Centre Mall are selling. Council was presented with a plan to redevelop the Capri Centre site Monday afternoon and unanimously approved recommending a zoning change to allow the project to go to a public hearing.

“I’ve wanted to see something like this for the Capri Centre for a long time,” said Coun. Robert Hobson, adding he has long believed that the site was “under utilized.”

“I think it’s a great model.”

The plan, which centres around a small public park with an open air skating rink in the middle of the site and an adjacent public plaza, would see a mix of residential buildings ranging from six storeys to a 26-storey tower, as well as

Centre owner RG Properties’ plan envisions as many as 2,200 housing units.

While the development would be covered by a comprehensive development zone, the current commercial zoning would have to be changed as it only allows a maximum height of 12 storeys.

Despite that, city planning staff said the redevelopment fits with the city’s vision for the site and the department supports the plan.

In exchange for the public amenities on the site, including the park, rink, plaza and pedestrian accesses through the property to the park, the city is being asked to allow the taller buildings.

They would be oriented towards the centre of the property with shorter buildings on the outside, especially where the site

borders other residential areas.

But, while the council members all supported the plan and some gave it rave reviews, a note of caution was raised by three councillors—Gail Given, Luke Stack and Maxine DeHart.

Given questioned whether the local motoring public would use underground parking as that is where the majority of the parking for the new development would be located.

“Drivers use it in other, larger cities, but not here,” she said.

Also on the issue of parking, DeHart questioned whether there would be enough given the large estimated number of spaces required for people living on the site, the existing Capri Hotel, for those working there and visitors.

Planner Ryan Smith said the site is fully integrated

with local transit—there is a RapidBus stop at the location—and the attempt will be to make the site more “people friendly than car friendly.”

Stack said he felt the public amenities the city would receive were “a little light,” but nonetheless liked what he saw.

As for the park, he called it small and said its location could lead some to think it was only for those living on the site.

DeHart stressed the need for the continued maintenance of the public amenities after Stack said he has seen examples of similar projects elsewhere where the amenities are the first to be neglected in tough economic times.

But despite his concerns he said he liked the plan and even compared it to the much larger Metrotown shopping centre in Burnaby.

Here, he said, the site builds on being in a strong

residential core, has a major commercial component and is serviced by public transit.

Metrotown is a popular stop for Skytrain in the Lower Mainland.

The plan also allows for the Capri Hotel to remain on the site. The hotel, currently the second largest in the city, has 250 rooms.

With the extra height of the proposed buildings, the site would see a much higher level of population density. Hobson noted that the trade-off appears to be the public amenities for the allowance of taller buildings.

The redevelopment proposal will go to a special public hearing on Wednesday, Oct. 22.

That week, because of a heavy public hearing schedule, public hearings will be held both on the traditional Tuesday night, Oct. 21, as well as Wednesday.

A provincial announcement Friday, of a sponsored Crown grant to the District of West Kelowna of 11 acres of land at 2515 Bartley Rd., means West Kelowna council can check off a long-time top strategic priority, says West Kelowna Mayor Doug Findlater.

“During the Westside governance discussions (in 2006), it was raised that this municipality owns very little land for municipal purposes,” said Findlater, who chaired the governance committee from 2003 to 2007.

“When we incorporated, we were told by the province we would get support for Crown land grants to help the new municipality establish much-needed municipal facilities. It took seven years, but

I can tell you that West Kelowna council is extremely pleased to see this dream become a reality.”

Premier Christy Clark announced the transfer of the 11.93 acre parcel to the district Friday. The land will initially be used as a works yard. But additional uses could be seen later after all the property is cleared and set up for use.

During the past seven years, West Kelowna council never lost sight of this important goal and worked tirelessly with MLAs, provincial ministers and staff to secure a sponsored Crown grant, said Findlater, adding the Bartley Road location is ideal for West Kelowna’s needs.

“We have always envisioned the Bartley Road property as a future site for our public works operations,” he said.

given the timing of the public hearing in relation to the scheduled closure of the market for this season.

The market, located in a parking lot opposite Orchard Park Shopping Centre, operates Wednesdays and Saturdays from the spring to fall each year.

Market organizers want to allow local wineries, breweries and distilleries to sell their products on site but needs a change in the zoning that covers the land the market currently operates on to do so.

Alcohol sellers would also need a special permit from the city to sell there.

If approved, the market operators would determine which businesses could participate and when.

City staff said they expect only one or two sellers would be permitted to participate in the market on any given day.

A group of four Okanagan municipalities and two regional districts have decided to move forward with the potential acquisition of the decommissioned CN Rail line between Kelowna and Coldstream using the Canadian Transportation Agency (CTA) discontinuance process.

The move extends the time the group has to negotiate with CN Rail and came just before a 30-day window to negotiate with CN passed on Monday.

“Significant progress has been made in negotiations over the past several months, however there are still a few outstanding issues,” said Doug Gilchrist, divisional director for community planning and real estate for the City of Kelowna, who has led the negotiations on behalf of Kelowna, Lake Country, Coldstream and Vernon, as well as the regional districts of Central Okanagan and North Okanagan.

The CTA will determine a market value estimate of the corridor.

The case against the man charged with attempted murder following a wild 2012 police chase and shootout on Westside Road has been put to bed.

Crown counsel Duncan MacLeod called upon expert firearms witness Robert Caunt, on the last day of his case against Michael Ellis.

Caunt, who has testified in the same capacity at numerous trials and worked extensively with the Vancouver Police, was asked to review a sixpage document he created after examining the weaponry and bullets collected in the aftermath of the shootout.

As he traced the steps he took years earlier, Caunt told the court details about the numerous bullets, their casings and twisted bits of metal that he inspected.

The story of those

bullets has been largely laid out in previous testimony offered over the five weeks of trial.

They were let loose on at least one civilian and several police officers on the route taken from Mt. Boucherie Road, to the Swan Lake side of Westside Road. The bullets’ final resting places were on roadsides and rammed into car parts.

The casings were found, among other places, on the floors of vehicles alleged to have been stolen by the accused and his two accomplices as they tried to flee from police.

The number of weapons that were found and the state they were in, however, offered more questions about what Ellis and his accomplices were up to when they were intercepted by police in July of 2012.

Caunt found each of the weapons in evidence to be prohibited, largely because they had been altered in some rudimentary fashion.

First among the arsenal of guns he spoke about was a semiautomatic rifle, with its barrel and butt cut down.

The barrel should have been around 323 mm, but it was sawed off at the 78 mm mark, impacting its accuracy.

“It could fire as fast as you can pull the trigger,” said Caunt.

He also found a five shot revolver that also had the barrel cut down.

Its trigger was heavy, but it too could have been fired as fast as it took to squeeze off each round.

Another weapon believed to be used that day was a Ruger, model 122, carbine.

This semiautomatic weapon had its barrel cut down to 319 mm from its original 470 mm. It also had an after-market stock attached.

The piece that would traditionally rest on its user’s shoulder could fold down, allowing it to be fired one-handed.

Lastly, Caunt pointed

to a poorly constructed suppressor. Aimed at muffling sound, it was a glass jar stuffed with terry cloth that had been twisted and shoved into the cylinder. Black tape surrounded it all, and there was space for the gun barrel to fit inside.

The device was “crude” and “detrimental to accuracy,” said Caunt, but it would not have reduced the dangers the gun posed.

Each of the weapons entered into evidence were powerful enough, he told the court, to cause bodily harm and or death.

Ellis, 41, is facing numerous charges, among which are five counts of attempted murder. Shawn Adam Wysynski, 34, and Ashley Collins, then 19, have already confessed to being accomplices in the crime spree.

Ellis’s defence has not yet indicated whether he’ll bring forth witnesses now that Crown has wrapped up its case.

As is, it’s expected there will be a slight

adjournment before the defence portion gets

underway.

An alpaca killed by a bear in Ellison late last month suffered a very unusual fate.

Conflict with bears is routine this time of year but it does not need to result in the Conservation Officer Service putting the bear down if people behave correctly, according to the CSO officers.

“Where we have had a lot of conflict with bears, is bears in peoples’ garages, bears breaking fences, bears going into yards to get garbage,” said CSO Terry Myroniuk, when contacted to comment on several bears making headlines for their appearances in local yards and on trails.

Every spring, bears come out of hibernation hungry and seeking the most available food source.

Come fall, after roaming an alpine ripe with food all summer, the bears come down to the valley floor in search of the high calorie fruits and nuts they need to keep themselves going through the winter, Myroniuk explained.

Garbage is a high-calorie, though terribly

unhealthy, food source for the creatures and their desperation to protect and seek out garbage bins suggests it’s as addictive as a drug.

From food scraps to dirty diapers, it gives off a powerful odour and the bears will return again and again to get their fix.

Bears that threaten or kill livestock, such as the bear that killed an alpaca on Sept. 20 on an Ellison-area hobby farm, and those that become so hooked on the garbage they are defensive of that food source, are killed to eliminate any threat to the neighbourhoods they’re foraging.

To save the bears, the CSO recommends cutting down fruit trees where the fruit is unwanted and picking bare the trees laden with ripe fruit.

“The number one thing to keep our neighbourhoods safe, and to keep bears safe, is we need to not leave things out that are going to bring bears into our neighbourhoods. At this time of year, it’s fruit and nuts and garbage,” said Myroniuk.

HUNTING SEASON

Hunting season is off to a difficult start in

Ellison where the Eldorado Ranch continues to struggle with trespassers.

“In the past, there’s been everything from fences cut to livestock shot, and situations like that are becoming increasingly more problematic,” said CSO Terry Myroniuk.

Coming in on quads and dirt bikes, the trespassers both hunt and poach the area.

Poaching has been an issue in Vernon this year. At the beginning of hunting season, an individual was caught poaching a whole moose. The season was not open for moose and the individual did not have a tag.

Hunting season runs September through December, delineated by species with limitedentry tags for some to set the number of animals to be killed.

Hunters who violate the rules can be charged under the Wildlife Act, but with a limited number of conservation officers and vast tracts of land to patrol, the service relies heavily on hunters, hikers and those in the backwoods to report violations and potential infections.

A developer has agreed to foot the entire $7.6 million cost of the road, a project that would normally include a 15 per cent “taxpayer assist” that city staff estimates could be as much as $1 million.

Completion of the South Perimeter Road was not scheduled until 2025 because of the lack of development at the far south end of the city.

But with the offer from the developer, there is a chance to have it paid for in its entirety and save money.

But there would be a trade off.

While council went to great lengths Monday to stress that the public is not being asked about the proposed alignment of the new road—that was set in the 1990s— residents will be asked if they are wiling to see other road projects delayed in order to have it built at the developer’s cost.

“We’re not just going to blaze ahead and damn the public,” said Mayor Walter Gray, speaking about the plan to seek public input.

While he conceded the final say on how to proceed with the road will rest with the next city council after the November civic elections, he said his council should find out what the public thinks.

Included in the projects that could be delayed is adding turning lanes, curb gutters and other improvements to existing roads in the Mission.

Building the proposed section of the South Perimeter Road would provide another access and egress to the Upper Mission, said city staff, as well as spur more development in the area.

It would lead to improved transit and possibly speed up the construction of a planned new middle school.

High hopes that the Aquilini Development Group would easily acquire and complete a troubled Pandosy area development have been somewhat dampened.

Justice G.C. Weatherill rejected an application from Ernst and Young, SOPA Square’s receiver, to enter a process called the stalking horse bid.

If the court had approved, SOPA Square would have been put on the market at a baseline price of $29.5 million, which the Aquilinis set.

If nobody had made a higher bid, then the Aquilinis would have been able to buy the development.

It was an strategy that Justice Weatherill didn’t agree with.

“No course of action other than a stalking horse bidding process appears to have been considered, including the traditional tendering process. There is no evidence that the Receiver has attempted to market the development beyond discussions with three Developers,” read the decision by Weatherill.

“There is no evidence regarding the extent to which the Receiver attempted to identify other developers who

might be interested in bidding through a stalking horse bid. There is no evidence from which the court can assess whether the economic incentives behind the SH Agreement are fair and reasonable or whether they are excessive given the circumstances of the Bond Holders and the Lien Claimants.”

Weatherill also drew attention to the valuation of the bid, noting that the building had not recently been appraised and that’s required to maintain the integrity of the process.

Ernst and Young representatives had yet to return calls on the matter, but in recent days the Aquilini Group noted the value they saw in the project.

“We’re very optimistic, we’d love to finish the project,” said Kevin Hoffman, senior vicepresident of development and construction. “It’s a great location and would be a great place to live.”

SOPA Square isn’t the only Kelowna project in its portfolio. A Bernard Avenue project, named 24 Kelowna, has been on the books for years, but is currently on hold because of market conditions.

SOPA Square was to have included 48 townhouse units and 51 condominiums, as well as 40,000 sq ft of commercial and retail space on the ground level and 14,000 sq ft of office space on the second floor.

The planned mixeduse development was once touted as a potential anchor for the South Pandosy commercial area.

The original cost was estimated at $70 million.

Troubles for the developer started early

on, as there was a lengthy delay in starting work on the project. Then safety concerns about one of the cranes on the site shut down construction for awhile.

The original developer ran out of money and after sitting idle, the project was revived when a second developer took over. The latter stepped out of the development leading to the most recent series of events. @KelownaNewsKat

Thanksgiving and the Walking Dead Nine hundred years ago, St. Bernard of Clairvaux wrote “We open our mouths wide till God opens His hand, but after, as if the filling of our mouths were the stopping of our throats, so are we speechless and heartless.” Do you resemble that remark?

I must confess that I do. It was Scripture that evoked Bernard’s words, one of Jesus’ miracles to be exact.

Now on his way to Jerusalem, Jesus traveled along the border between Samaria and Galilee. As he was going into a village, ten men who had leprosy met him. They stood at a distance and called out in a loud voice, “Jesus, Master, have pity on us!”

When he saw them, he said, “Go, show yourselves to the priests.” And as they went, they were cleansed. One of them, when he saw he was healed, came back, praising God in a loud voice. He threw himself at Jesus’ feet and thanked him—and he was a Samaritan. Jesus asked, “Were not all ten cleansed? Where are the other nine? Has no one returned to give praise to God except this foreigner?” Then he said to him, “Rise and go; your faith has made you well.” (Luke 17:11-19) The ten men before Jesus that day were to be pitied. They suffered from the skin disease we call leprosy. A Levitical Priest had examined each one of them and declared that they suffered from the dreaded disease.

This declaration meant the men had to stay away from people that were not infected (See Leviticus 13-14). They had to follow certain rules: “Anyone with such a defiling disease must wear torn clothes, let their hair be unkempt, cover the lower part of their face and cry out, ‘Unclean! Unclean!’ As long as they have the disease they remain unclean. They must live alone; they must live outside the camp.” (Leviticus 13:45-46) Their bodies decayed before their eyes and the eyes of their loved ones. Intimate contact with family and friends was strictly forbidden. A man could no longer hug and kiss his wife or children. For these reasons lepers were called the “walking dead.”

Leprosy was more than just a debilitating disease. It had a stigma attached to it. It was associated with sin. God struck Miriam with leprosy when she and her brother Aaron openly defied their brother Moses.

Moses interceded for her and begged God for mercy. God told Miriam to go outside the camp for seven days. She obeyed and was healed. Scriptures reveal that Miriam had sung a Psalm of thanksgiving when God defeated the Egyptian Army at the Red Sea. The Scripture is silent as to Miriam’s response to God’s mercy when He healed her of leprosy. For this reason each of our ten lepers, his family and community would most likely have wondered what the leper had done did to deserve this horrific disease. They also wondered if their loved one would ever be healed. They wondered if God would have pity on them.

The men had called out to Jesus for mercy to have pity on them. They believed that he could heal them somehow. Jesus had pity on them. A Levitical Priest’s examination of a skin disease led to a

diagnosis of “leprosy” and brought the demands of the Law to bear or fall upon each of these men. In the same way, a Levitical Priest’s examination and diagnosis was required to lift the legal consequences of the disease. Jesus did not come to abolish the Law, but to fulfill the Law. So in obedience to the Law he sent the men to a Levitical Priest for a pronouncement of healing. Jesus called the men to step out in faith. He gave them specific directions: “Go, show yourselves to the priests.” So they stepped out in faith and went. Jesus’ words took on flesh as they walked to Jerusalem to a Priest. They were healed in accordance with Jesus’ words. “And as they went, they were cleansed.”

True to St. Bernard’s words, the ten lepers had opened their mouths wide and asked God for help for healing. Through Jesus, God had opened His hand and filled their mouths. More accurately, God had filled their minds through Jesus’ words. When they chewed on these words by going to the Priests, their spiritual hunger was fed through the healing. True to St. Bernard’s words, God’s feeding seemed to bind their hearts and minds. It seemed as though not one would offer words of thanks and praise. However, one man broke away from the joyful band of transformed men. Jesus described him as a Samaritan, a foreigner.

Samaritans were regarded by Jews as Gentile people who pretended to be Jews, reading the Torah and offering sacrifices in their chief city of Samaria.

Jesus’ words caused something to grow inside the Samaritan’s heart and mind that had not grown inside the hearts and minds of the other nine men. The Samaritan man received a revelation from God that the others had not.

The outside of the body of each of the ten lepers was cleansed and transformed as they walked toward Jerusalem. However, for the Samaritan, an internal transformation had occurred. The Samaritan was given eyes to see Jesus in a different way. To the Samaritan, Jesus was not a prophet like Moses who interceded for him and the nine others to God. The Samaritan came to see Jesus as the source, the fountain, of his healing. He had come to see Jesus as the very Son of God and as such was worthy of his praise and worship. His revelation led to concrete action, he turned around and came back, praising God in a loud voice. He threw himself at Jesus’ feet and thanked him.”

This Gospel Lesson ends with Jesus’ words: “Rise and go; your faith has made you well.” It was his faith that Jesus was the Son of God and the source of his healing that made the Samaritan whole. All ten lepers were keenly aware of the mercy and the grace they had received. They saw it on their skin. However, only the Samaritan saw the true blessing of the healing, the knowledge that he had encountered the Son of the living God and had been cleansed by him. Jesus had taken a “walking dead” man and restored him to life.

The weekend of October 10-13 we will celebrate our Thanksgiving Holiday. On

January 31, 1957 our Parliament proclaimed: “A Day of General Thanksgiving to Almighty God for the bountiful harvest with which Canada has been blessed – to be observed on the 2nd Monday in October.” In the weeks up to Thanksgiving we will be asked: “What are you thankful for?” My first response is typically to be thankful for all the things I have. Just like the nine in the Gospel Lesson, I will be giving thanks to God for the externals. However, I am called by God to be thankful for much more.

I am called by God to be thankful for my internal blessings. I have to acknowledge before God that I am a leper. I have to admit that I am decaying. As each day passes, I grow older, and my body breaks down. Like the ten lepers I am one of the walking dead. My decay is also spiritual.

I sin and that sin separates me from God and from others that are hurt by my sin. My scars and decay are the result of the sin of others against me. I have to admit that my disease is incurable. I have to admit that there is no hope in any human being. God speaks into my hopelessness and gives me hope.

Like the lepers, God gave me Jesus. Jesus gave us the Gospel. The Gospel declares that Jesus is God’s Son. It declares that God’s Son took our leprosy upon him. Jesus became one of the walking dead for our sake. Jesus voluntarily allowed evil men and women to crucify him. He went from the walking dead to the dead in the tomb. God did not leave him there. God raised him from the dead.

Jesus went from the walking dead to the walking forever. He crossed over from the death to life for us. Jesus invites the walking dead to cross over from walking dead to walking forever. All that he requires is that we have faith in him, that he is the Son of the Eternal God. “Jesus said to her, “I am the resurrection and the life. The one who believes in me will live, even though they die; and whoever lives by believing in me will never die. Do you believe this?” John 11:25-26 What am I thankful for? For Jesus, that his Word and his real presence has touched me, has kindled faith in me and bid me to cross over from the “walking dead” to the “walking forever.”

Social media’s impact will be felt this election Social media platforms like Twitter and Facebook may just have a direct effect on the outcome of B.C.’s municipal elections in 2014.

Facebook, and other social media, have played supporting roles in the last few elections. But the 2014 municipal election may be the first where they can be seen to have a direct effect on the outcome.

These are people talking about the change they want to see in politics, which is a good thing, and will make them a force on Nov. 15.

Still, watching the discussion on both those platforms, you see how often opinion gets substituted for fact, and how fast discussions get hijacked or devolve into personal attacks and other forms of abuse.

It’s nothing new. This kind of behaviour is a well-known phenomenon for online discussions, dating back to the beginnings of the Internet and the old IRC chat channels.

In 1990, Mike Godwin jokingly stated what has become known as Godwin’s Law, that if an online discussion goes on long enough, the likelihood of a comparison to Hitler or Nazism becomes inevitable.

We’re not suggesting any of these local forums have gone that far, but the lesson here for voters is: As social media becomes evermore a source of political information free from checks and balances, it is imperative you do your own primary research.

Most importantly, never vote based on someone else’s beliefs and judgments. Learn to separate opinion from fact, and remember that even the most well-meaning people may be sharing inaccurate information.

As the starting line approaches for another municipal election campaign with the nomination deadline on Friday, the only sure thing seems to be that the winners will be elected for four-year terms.

Keep that in mind when you cast your vote.

Last year it was a misinformed, impossible demand to ban all traces of genetic engineering. Before that they thumbed their mobile phones and denounced wireless power meters. Both votes passed by narrow margins in a half-empty chamber, with many delegates focused on the serious community issues they are elected to address.

This year it was a charge led by Burnaby to denounce the proposed Trans Mountain oil pipeline expansion. And this time it was defeated.

Credit for this sudden attack of common sense goes largely to North Cowichan Coun. Al Siebring. Here’s part of his address to the recent Union of B.C. Municipalities convention in Whistler: “Ladies and gentlemen, we are elected to handle things like roads and water and sewer and land use, police, fire, garbage. We’re not here to talk about social policy, child poverty or heaven forbid, pipelines.

“Those kinds of things dilute our credibility as an organization. We’re becoming a social policy activist group rather than a group of municipal politicians.

“Half of this resolutions book is stuff that’s outside of our purview…. If you want to do social policy, get your butt elected to the provincial legislature.”

Burnaby, New Westminster, Victoria and Vancouver were undeterred. In tax-rich urban centres one can make a living at local politics. And grandstanding works.

Burnaby Coun. Nick Volkow rattled off a jumbled history of refineries in his region, noting that the sole surviving Chevron plant is bringing in crude by trucks and trains because the 60-year-old pipeline is over-subscribed.

He didn’t explain how stopping a pipeline upgrade would keep it open, or improve oil safety.

Volkow repeated the protester myth that a new pipeline would introduce diluted bitumen to the coast.

Burnaby Mayor Derek Corrigan boasted that after his first court challenge to the National Energy Board was tossed out, his high-priced eco-lawyer found a constitutional angle. Cha-ching!

Meanwhile, professional protesters bike-lock their necks to the fence at Burnaby’s Westridge oil terminal, and a radical Simon Fraser University professor revives his Occupy Vancouver team to step up the ground war if courts falter.

The comedy of all this was illustrated by Coun. Robin Cherbo from Nelson, who assured delegates he uses synthetic oil in his vehicle. Is that derived from organic sunflowers? And what significance does that gesture have compared with the gasoline and jet fuel that carried 1,200 delegates to Whistler?

Cherbo assumes that Ottawa can simply direct Alberta’s oil industry to start refining all the heavy oil there. Half a century into this industrial mega-project, this stuff should just be banned from pipelines. Peace, man.

This is why election-time posturing by local politicians is a slippery slope. Not only do they lack authority, they and their staff lack the required expertise and information.

The Trans Mountain pipeline starts in Alberta and branches into the U.S. It is by definition federal jurisdiction. NEB hearings on its expansion continue, with expert input, especially on shipping risks, from the B.C. government, Green MLA Andrew Weaver and others.

Municipal politicians should pipe down and defend their own performance.

I’m disappointed that this article mixed two separate trail use conflicts into one.

The issues in Gillard (Forest Service Road) are minor and infrequent and have nothing In common with the issues on the KVR (Kettle Valley Railway). Motorized use of Gillard trails is a small side note to the issue of legalization of the (motorized us of) KVR network.

MTBco has no formal position in regards to the KVR right of way. We support the rights of all responsible trail users and believe in fair access to the wilderness. Our issues are with illegal dumping, bush party refuse, gun range garbage, irresponsible firearm use and irresponsible trail users of all types.

Barking dogs To the editor: I keep hearing the same dogs barking over and over and over again. Why can’t a million dollar dog control budget quiet these barking dogs in five years? It seems the barking dogs die before they ever get a ticket for barking?

Did you know that RDCO requires two different properties to complain about the same barking dog before it will give a ticket?

Did you know that RDCO will do nothing if it’s two people complaining from the same household?

Did you know that RDCO will not attend to a barking dog when it’s barking and that you may have to listen to that same dog bark all night every night for years? If your neighbour that will complain about the barking and is never home, you will have to suffer with the barking if your neighbour doesn’t hear it.

I believe that if RDCO needs more than one property to complain about a barking dog, then RDCO should be the other property and be a witness to the barking so that there is enough evidence to issue a ticket.

I am sick of RDCO and I am sick of the same dogs barking over and over and over again.

I am banned from emailing my regional district over it all because the RDCO can do whatever it wants to do including not enforcing bylaws.

Blueberry picking experience continues To the editor: Re: Toasting The Family Farm: The Grape Patch Closes, Sept. 24, Kelowna Capital News.

I read with interest the article on The Grape Patch and the Teather family. While we’re practically neighbours, I had never been out there to pick as we have our own patch, which includes grapes. But I understand the comments, such as concern for the “end of an era,” expressed by the pickers going out to the Latta Road location for the last time.

My husband and I know the challenges of becoming second generation farmers. My parents bought our property on the bench in Rutland 51 years ago, and after initially planting a peach orchard, became the first blueberry farm in Kelowna almost 30 years ago. In the early years of our new crop, we (mostly my parents) did all of the picking.

Up at 6 a.m., pick until noon, back out after supper until dark, then sort and pack. Most days it was just too hot to be out in the afternoon, but sometimes it was necessary.

People placed orders by phone or by stopping by. Dad and one or two of my siblings would also sell out of the back of the truck along the highway, and a time or two at the farmer’s market.

I had to move away to work, but I always planned my vacation time to coincide with picking season so I could be here to help.

The bushes grew, and so did the amount of berries, so approximately 15 years ago we began to do u-pick. Now people still come with their teenagers, who were babies in strollers the first time they learned what a blueberry bush looked like.

After my dad had his first stroke, my husband and I started to work towards moving back here with the goal of buying

the farm. It took three years to apply for and receive permission to do a homesite severance from the Agricultural Land Reserve, so that my parents could continue to live in the house they built and where they raised their six kids, and so that my husband and I could have our own home.

We barely squeaked through the process— lots of hurdles to jump. But for the past six years my husband and I have been part-time farmers, and continue to work to develop the land to be more productive. Besides the blueberries, we also have grapes, raspberries, blackberries, walnut and hazelnut trees that my parents planted. Plus we still have two of the original peach trees, quite bent but producing delicious fruit!

We’re also trying to diversify with other berries. We use organic growing methods because we know others appreciate our nospray policy as much as we do.

We’ve been expanding electronically too: We now have a website to announce when our picking days and times are scheduled.

In fact, people are so good at checking out our website that we are no longer getting 50 phone calls per day during picking season.

I try to make a point of getting to know as many names as I can, although I definitely recognize more faces than I remember names. But in this type of business, you know that people are coming for more than a product, they also want an experience beyond the grocery store.

We have some people who come out practically every time we’re open, to spend time with their family and friends as they fill their own freezers, and then sometimes to pick a bit to share with their neighbours.

Others come alone to get away from it all, with only the distant chatter of other pickers

to interfere with their meditation.

Our clientele comes from Vernon to Penticton, and people from Calgary, Edmonton and Regina regularly make us part of their summer vacation plans.

We will continue trying to make a go of it and preventing that “loss of a lifestyle” that The Grape Patch’s pickers are worried about experiencing. But it’s hard to say if a third generation of our extended family will pick up the torch eventually—we can hope.

Air gun play risky business

It’s all fun and games until you’re arrested for robbery.

That’s the lesson that six local teens between the ages of 13 and 15 are learning the hard way, following a series of events that started on the school grounds of Rutland Middle School, Oct. 4 at 8:08 p.m.

“A group of youth were hanging out in the area when they were approached by five masked individuals, armed with bats and pistols,” said Const. Kris Clark.

allegedly demanded to see what the others had on them before fleeing with a couple of small items of little value.”

No one was hurt in the incident and the pistols were later discovered to be airsoft guns. Two suspects were arrested a short time later on Fizet Avenue while three others turned themselves in to police the next day.

Clark said that despite the insignificant value and lack of injury in this case, a robbery is a very serious offence and has a devastating impact on the victims.

The accused appeared in court Monday.

The club membership and administrators of Airsoft Kelowna expressed their disappointment over a recent robbery in Rutland of an airsoft replica gun.

“We firmly believe that airsoft gear and activities should be restricted to 18+ adult age players, and we are very concerned the public understands that these minors were not members of our club and are not representative of our player base,” read a statement from Anthony Forster.

“We also believe parents who allow their underage children to purchase realistic replicas without proper safety

precautions like eye protection, safe play areas away from the public, and strict adult supervision are not acting responsibly. “ Members of the Airsoft Kelowna club say they continually work to improve their image in the community.

They came together in September, in association with the Ministry of Forests, for a large clean up day on the Crown land where they play.

“Our members removed a great deal of junk, including car parts and other refuse.

We look forward to further cooperation with the ministry and with Recreation and Trails BC.”

Kelowna city councillor Maxine DeHart is running for re-election on a platform of civic government experience and a willingness to listen to all opinions on a given issue.

“Council deals with a wide variety of issues and it is very important to elect people with experience, but also with open minds, who understand Kelowna, work hard and listen to people,” said DeHart, in officially kicking off her campaign last Friday.

“Many candidates will spend the campaign telling the people what they think; I plan to spend my time listening to people to better understand their issues.”

Besides her past threeyear term on council, the Capital News business columnist cites her 30+ Maxine DeHart years of community service through volunteer work, fundraising and business associations.

DeHart said she is proud of the achievements of the current council including its work to revitalize downtown Kelowna and energize town centres, the increase in staffing and resources for the RCMP in Kelowna helping to make the community safer, and a number of projects and investments that enhance the active lifestyle and fitness of Kelowna residents.

“I believe Kelowna is a better place to do business, a safer place, and a better place to enjoy a healthy lifestyle than it was three years ago. But there is more work to do and I am seeking re-election to continue working to improve our community.”

If re-elected for a second term, DeHart said she will work to ensure that the momentum keeps going on the revitalization of downtown and the regional town centres.

Music connects us to love and dreams gone by Singing was a big part of my life when I was growing up. It really began when my Mom took me to a series being held at the Paramount Theatre, here in Kelowna, where they were showing

popular old time musicals from a generation gone by. I remember sitting in the theatre listening to the featured movie that night with Nelson Eddy and Jeanette MacDonald.

I was awe struck as I

sat by my Mom at the age of eight, listening to the incredible range and passion of their melodic voices.

I suppose the joy I felt was also mixed in with the fact that this was a

His passion for giving was well honed as the founder of the Make A Wish Foundation, one I am sure you are all very familiar with.

He has brought his genuine desire to make a difference in people’s lives to help improve the health and well-being of older people through music.

Through holding 90 minute gatherings in our community, called Silver Song Clubs, seniors are joined together with a facilitator in participatory singing and music-making. They are given the opportunity to experience the well

Sing For Your Life has taken the initiative to bring the celebrated documentary Alive Inside, winner of the Audience Award at the 2014 Sundance Film Festival, to Kelowna as a fundraiser for the foundation’s good work.

This full-length movie follows social worker Dan Cohen as he attends to nursing home residents suffering from dementia, using music to help them re-engage and reconnect. He watches as their faces transform with joy as he plays their favourite songs from the past through headphones and feels the music connect their spirit to him and to pleasures that have long been forgotten.

A magical band of love and dreams is felt in this joining, and the power of it is unmistakeable.

I experience this myself

as I sit with my Mom, now in residential care, and begin to sing some of the songs we used to all belt out in unison as our family sat around the campfire many summer nights at my grandparent’s lakeside cottage. Being a horse gal, Strawberry Roan is her favourite and she joins in with me as I sing, remembering many of the words despite not knowing what she did half an hour before. The smile and the light in her eyes warms my heart in a shared moment once again, just like when I took her hand in the movie theatre many years ago as I basked in the melodic wonder of Jeanette and Eddy, harmonizing their incredible voices together on the big screen.

Please support this fundraiser by attending the screening of this show that will surely bring tears to your eyes, on Thursday, Oct. 23, 7 p.m., at the Paramount Theatre on Bernard Avenue.

Strata management: Broken water pipe case study Patricia Davies contributor It’s not my fault. Why do I need Insurance?

Question: The flood in the bathroom from a plumbing break was not my (the tenant’s) fault, why should I or my insurance company pay anything?

The damage caused by this broken pipe within the wall of an apartment style strata/condo included: • The pipe (near shower) was broken • The wood floor in the bathroom, hallway and part of the bedroom swelled and was removed

• The dampness caused swelling in some of the tenant’s wood furniture and, • The drywall within the unit and along the outside walls required removal for about two feet up.

The strata corporation, the unit owner and the tenant involved all said that they had insurance policies; but the tenant has not advised their insurance company—a full month after the incident.

For the purposes of this claim: • The tenant owns her belongings including all furniture

• The strata lot owner owns improvements installed at their cost. In this case, the wood floor and the upgraded tub and fixtures.

• The strata owns fixtures built or installed as part of the original construction, common areas of the building including hallways, plumbing pipes within walls or shared by more than one unit, drywall and original flooring. The council and/ or their strata manager also often work to assist adjoining owners in repairs caused to adjacent units.

Action was taken by the strata manager several hours after the initial

dripping was reported and a restoration company was called in to clean up and put the dehumidifiers in place to take as much moisture out of the unit as possible.

It took several hours to find the water shut off and this also added to the water accumulation in the unit.

In this situation all three insurance companies should be notified as there are overlapping responsibilities.

It is an insurance adjuster’s responsibility to interpret each policy and determine the specific responsibilities based on your purchased coverage.

In general, each policy should cover the following: The tenant’s insurance covers the tenant’s belongings being moved out and put back and damage to any of his/her items.

If needed, temporary accommodation will be provided for a specified period.

The strata lot owner’s insurance should replace the wood floor, baseboards and tub fixtures as they are not original to the unit.

The strata insurance will pay for replacement of the original construction including the drying out and replacement of any drywall

and the plumbing within the wall.

Due to the tenant’s insurance not being notified, the tenant’s belongings including heavy furniture were not moved.

The moisture in and around these items could not be measured and is unknown.

All drying of areas that were accessible are completed.

Replacement of the wood flooring cannot be completed until the furniture and belongings in three of the rooms can be relocated.

The timing for this is currently unknown as the tenant’s adjuster has not

been assigned, and they are unwilling to pay the moving costs personally.

It is important to note that fault is not an issue in this case. Each party has their own responsibilities.

A successful claim, resolved in the most efficient manner requires the cooperation, understanding and patience of all parties.

that lender if you are late on payments. Sometimes a collateral charge will be placed on all the properties you own, even the ones you thought were clear title.

Typically the lender will register as much as 125 per cent of the property value even though the amount may not have been advanced to you initially and allows the balance of the loan to float up or down depending on your use.

Since the collateral mortgage allows for the “re-advancing” of principal, like a revolving line of credit, the balance can rise, and very often does, with most people ignorant about the holes they are digging for themselves.

This is a product designed to lead you further into debt.

Effectively, collateral charges also allow lenders to change the interest rate and/or loan more money to qualified borrowers after closing.

You could trigger an increase in the interest rate if you miss a payment.

This cannot happen with a traditional mortgage. The collateral mortgages are being registered with rates as high as prime + 10 per cent (regardless of what they initially offer you) and lenders can cover their potential losses by increasing the rates if they get a whiff of potential default.

When your mortgage comes up for renewal the bank can offer you whatever rate they choose and your only option, if you do not like the terms, is to pay legal fees to move the mortgage.

Sure, they will let you have access to more money but only if you qualify for the extra funds and if their qualifying criteria has changed you may not qualify.

As well, there is no guarantee of the rate you will be offered.

A collateral loan also involves other debt you may

have and, under Canadian law, a lender may seize equity to cover other debt you have with the same lender.

So, in essence, you’re securing all your loans including credit cards, lines, car loans, or overdraft that you may have with the bank which holds your collateral loan.

Conventional Mortgage A normal, standard, conventional mortgage gives you the option to establish a set amount you are borrowing, the rate for the term you have chosen (say 2.99 per cent for a five-year fixed mortgage) and the amortization so you’ll know exactly when you will have the mortgage paid off.

You know what your payments will be for the term and if you stay on track the property is yours at the end of the amortization.

Should you need to borrow more using a second mortgage or by registering a home equity line of credit, you can.

If you don’t borrow any more money against the property, the principal balance on a conventional mortgage goes only one way: down.

Canadian major chartered banks will accept transfers of conventional mortgages from one to the other at little or no cost.

Beware the difference It’s the classic case of buyer beware. All banks and credit unions offer the collateral mortgage. Some offer you a choice with a conventional mortgage, others do not.

Be sure you have the mortgage that is best suited to you and your lifestyle before you sign up.

Shane Beatty admits it “almost killed” him not be on the sidelines coaching his Okanagan Sun football team on Sunday afternoon at the Apple Bowl.

Anyone who knows anything about the fiery and passionate head coach wouldn’t be the least bit surprised to hear Beatty utter such sentiments.

Still, if there was a game to miss among all games in 2014, it would be the Sun’s regular season finale against the Kamloops Broncos— one with absolutely no bearing on the final standings.

Beatty was forced to listen to the game from his condo via the Internet on Sunday after being suspended for one game by the B.C. Football Conference.

Beatty was disciplined for a breach of the conference’s coach conduct policy, based on a recent off-field conversation with another party.

The Sun head coach takes full responsibility for

his actions.

“It’s my fault, I made a mistake and shouldn’t have said what I said,” said Beatty. “It was an unfortunate situation and it won’t happen again. It’s time to put it behind us and move on.”

For Beatty, moving on means getting his club prepared for the BCFC semifinal on Oct. 19 against the Vancouver Island Raiders.

“We’ll give the kids a few days off this week, then be ready to go early next week,” said Beatty.

“It’s an exciting time of year.”

For the better part of two quarters on Sunday against Kamloops, the Sun looked like very much like a team without its inspirational leader, as evidenced by a 19-7 deficit early in the second half.

But after reloading at half time, it was all Sun the rest of the way as rookie quarterback Josiah Joseph helped direct the offense to 31 unanswered points, securing the club’s ninth win of the season.

Thomas Huber scored a pair of majors on passes—one each from Joseph and Cam Bedore,

who saw first half duty after missing three games with a concussion.

Wes Geisler spearheaded Okanagan’s defensive thrust with two interceptions.

Beatty credits assistant coaches Tony Lindsay (offensive coordinator) and Nathan Mollard (defensive coordinator) for rallying the troops at half time.

“The coaches made good adjustments and the players got the job done,” he said. “I’m proud of the way coaches Lindsay and Mollard handled it. Something like that makes you closer as a team.”

And as much as Beatty pined to be on the sidelines with his players, the head coach said the experience may just make the Sun an even better team.

“Obviously you never want to let the kids down, you want to be there for them,” said Beatty. “If anything, it’s galvanized us even more.

I got texts from kids after the game, so that was really nice. Some of them told me to never do that to them again,” he said with a laugh.

Okanagan receiver Thomas Huber caught two touchdown passes Sunday as the Sun wrapped up the BCFC regular season with a 38-19 win over the Kamloops Broncos.

The next order of business for Beatty is preparing his club for the semifinal against the

Raiders, Sunday, Oct. 19, 1 p.m. at the Apple Bowl.

The Sun took down in the Raiders in all three

meetings this season by a combined points total of 121-27, though the final meeting in Nanaimo was

Yochim named Most Valuable Player as Okanagan Sun hands out annual team awards In a summer of exceptional team accomplishments by the Okaganan Sun, there were, not surprisingly, more than a few noteworthy individual performances en route to a 9-1 record and BCFC regular season title.

None drew more attention than the onfield exploits of Robbie Yochim, who the Sun named Monday as their most valuable player in 2014.

The fifth-year player and Rutland grad was nothing short of electrifying as a punt and kick off returner this season, scoring six touchdowns on returns and rewriting the BCFC record books.

Yochim was also a standout in the club’s defensive secondary, leading the club with four

interceptions and adding 34 solo tackles.

Sun head coach Shane Beatty said Yochim matured greatly as a player and a person over the last couple of seasons, and deserves every bit of praise thrown his way.

“What Robbie did this season was phenomenal,” Beatty said. “He’s really grown up over the last couple of years and has become a real team player. He’s a tremendously talented player with a great attitude.”

“The (Flyers) wanted me to stay in the AHL, but my agent thought it was best for me to come back here and continue to develop my game,” said Goulbourne, a thirdround draft pick of the Flyers in 2013. “Obviously playing pro is the goal, but I look at this not as punishment but a chance to win with a great organization. I’m excited to be back.

“I have a lot of things to improve on before I become a great pro, and this is a great place to work on those.”

While in Philadelphia, Goulbourne underwent surgery on his elbow and didn’t suit up for any of Flyers’ training camp. However, with the stitches due to be

taken out this week, it won’t be long before the Edmonton native is back in the Rockets’ lineup.

Goulbourne’s return means the Rockets now have four over-age players on the roster— the other three are Cole Martin, Carter Rigby and Colton Heffley.

With just three spots available for 20-year-old players per WHL team, one Rocket must go by the league-mandated deadline of Oct. 15.

“I don’t know what’s going to happen there and I can’t control it,” said Goulbourne, who had 37 points and 114 penalty minutes with the Rockets last season. “If I happened to be moved, then I’m prepared to continue to work on my game and improve, wherever I go.”

If Goulbourne does remain in Kelowna for the duration of the season and brings his best game, head coach Dan Lambert said his aggressive style and energy can be a big asset to the hockey club.

The Rockets will be home to the Lethbridge Hurricanes on Saturday night. Face off at Prospera Place is 7:05 p.m.

Okanagan rivals battle in weekend set The ongoing rivalry between the West Kelowna Warriors and Pentiction Vees will be renewed this weekend as the clubs square off in a home-and-home set.

The clubs meet Friday at the South Okanagan Events Centre, followed by the rematch Saturday at Royal LePace Place.

Face off both nights is 7 p.m.

And even though it’s

still early, the two-game series carries its share of significance in the BCHL’s Interior Division.

The Vees (5-1) and Warriors (5-2) currently share top spot with the Merritt Centennials (5-1).

Penticton will host Merritt on Wednesday night.

Meanwhile, after coming up short on Saturday against Merritt, the Warriors rebounded Sunday at LePage to earn

a weekend split. Liam Blackburn and Jordan Masters each scored a goal and added an assist as the Warriors prevailed 5-3 over the Cowhican Valley Capital Valley Capitals in the Sunday matinee.

Blackburn leads the BCHL in scoring with 15 points.

The Warriors opened up a 4-1 lead early in the third period on a

shorthanded goal by Kade Kehoe early in the third. The Caps made it interesting with a pair of goals, before Brett Mennear sealed the game with an empty netter.

The UBC Okanagan men picked up a valuable point—but it could have been more—in their push for a playoff spot in their inaugural season of Canada West soccer.

Dante Zanatta’s Heat almost had three points in their possession on Friday night in Victoria, but yielded a late goal to settle for a draw against the host Vikes.

Enzo Paal’s third of the season gave UBCO a 1-nil edge at 56 minutes.

But in the 90th minute, Victoria’s Cameron Stokes beat sophomore Heat keeper Christopher Cuthill, as the game ended in a 1-1 tie. “(We) gave them an opportunity when we should have shut them down,” said Zanatta, the Heat’s head coach. “For a good portion of the game we were a better team.”

On Saturday, the Heat came up empty in a 2-0 loss against the UBC Thunderbirds in Vancouver. The powerhouse T’Birds have won 24 consecutive games dating back to September 2013.

All in all, Zanatta was relatively pleased with his team’s effort.

“The boys learned from the first game the kind of pace and things they (UBC) have, they adjusted the level of play and played well,” Dante said when comparing the first time his team met the Thunderbirds in a 4-0 loss on Sept. 20 in Kelowna.

“For the vast majority of the game we did quite well, they are a very good team and they create chances, but I didn’t think we did a good enough job of stringing enough passes together to give us a chance to create.”

The Heat (4-5-1) will have a bye this weekend, before wrapping up the

several top quality saves, stopping 23 of 26 shots.

The Rockets lone goal on Sunday came off the stick of Sam Binfet who picked up his first of the season.

The Giants are (6-00) this season and have given up just six goals in the process.

The Rockets (2-20) will look to get back on track this weekend as they host the South Island Royals at CNC. Face off on Saturday is 3 p.m., followed by 10 a.m.

The Okanagan Rockets’ monopoly on home ice has been put on hold—at least for one weekend.

The Rockets’ 22game B.C. Major Midget League win unbeaten streak at the Capital News Centre was halted by the Vancouver Northwest Giants who swept both games of a doubleheader from their Kelowna-based hosts.

Emma Nelsen, a rookie midfielder from Vancouver, has been showing well the past few games for the Heat women’s soccer team. regular season Oct. 18 and 19 against TRU. The Heat currently sits in third place in the Pacific division, with the top four teams making the postseason.

UBC Okanagan has 13 points, one more than UFV and three more Trinity Western who is currently fifth. Trinity has played just seven games, Fraser Valley eight, compared to 10 for the Heat.

HEAT WOMEN

The Heat women had more than a few positive moments on the road last weekend, but are still looking for their first Canada West victory of 2014.

On Friday, Victoria scored twice in a span of less than two minutes early in the game, then held off UBCO for a 2-1 win. Michelle Smith counted the Heat’s lone marker at 56 minutes against the nationallyranked Vikes.

“Unfortunately we came out flat at the start and good teams like University of Victoria will punish you and they did,” said Heat coach Claire Paterson.

Fifth-year keeper Christine Tallon had a strong game for UBCO, making nine saves including one on a late penalty kick.

On Saturday, the Heat dropped a 2-0 verdict to the UBC Thunderbirds in Vancouver.

Amrit Berar scored a goal in each half, her third and fourth on the season, and Emily Wilson posted her third clean sheet of the season against the visiting Heat.

“We are continuing to grow so much as a team,” said assistant coach Ashlee Davison.

“I’m always proud of our effort and grit.”

The Heat women (07-3) will wrap up their first Canada West season Oct. 18 and 19 against Thompson Rivers.

Convincing UFC win for MacDonald Rory MacDonald wants a title shot.

That much was clear following another convincing victory for the Canadian welterweight Saturday at UFC Fight Night 54.

MacDonald, who once trained in Kelowna with Toshido MMA’s David Lea, recorded a resounding third-round TKO over Tarec Saffiedine in the five-round main event in Halifax. The telling blow was a huge left cross to the head, which dropped Saffeidine for good at 1:28 into round THREE. “It felt really good…I couldn’t be happier,” MacDonald (18-2 MMA, 9-2 UFC) told reporters after the fight. “Tarec is one of the best in the world in the welterweight division, and I feel like I had a good fight against him tonight. Hopefully the UFC takes notice.”

With current champion Johny Hendricks and challenger Robbie Lawler to fight in December at UFC 181, MacDonald believes he should be next in line for a crack at the top prize.

“I really don’t see anyone else,” MacDonald said.

The Kelowna Chiefs are coming off their first two-game win streak of the season as they head into a busy Thanksgiving weekend of KIJHL action.

The Chiefs will play three in three on the road, starting with a visit to the Creston Valley Thundercats on Friday.

Kelowna then moves on to Fernie on Saturday, before wrapping up the eastern trip on Sunday afternoon in Kimberly.

Jason Tansem’s Chiefs (4-4-1) are coming off their first back-toback wins of the 201415 campaign beating Princeton and Columbia Valley over the weekend.

On Friday, the Chiefs took down the hometown Posse 5-3.

Jonathan Lee paced the

Chiefs with a hat-trick and four points while Ethan Rusnack added four assists.

On Saturday at home, Braeden Cyra scored with 55 seconds remaining in the first overtime session to push the Chiefs to a 5-4 win over the Rockets.

Cyra had a goal and two assists, Rusnack scored twice and Kevin Roth had four assists.

Lee had a goal and an assist and now shares the KIJHL scoring lead with 17 points (9 goals, 8 assists).

Chris Turner was in goal for both wins for the Chiefs, making 49 saves over the two games.

The Chiefs next home action is Saturday, Oct. 18 against the Kamloops Storm.

GREEN, MARIE (NEE FITZPATRICK) May 18, 1925 - September 29, 2014

June 9, 1953 - September 8, 2014 Milan Vukelic, beloved husband of Ana of Kelowna, BC, passed away suddenly on Monday, September 8, 2014 in Donji Kosinj, Croatia at the age of 61 years.

Milan was born on June 9, 1953 in Donji Kosinj, Croatia. He married his beloved wife, Ana in Croatia in September of 1976 and together they moved to beautiful Kelowna, BC where they settled themselves and had 3 sons, Martin, Zeljko and Adam. Although knowing very little of the English language, Milan successfully found work and was employed with Pascho Drilling in the 1980’s. He worked there until his proud and respectful retirement in June of 2013, the same time he, along with his family and friends, celebrated his 60th birthday. Milan had the innate ability to bring his family and friends together with laughter and love; as well, always maintained his devotion to his family and his native Croatia.

He was a proud Croatian Canadian and always stayed true to his roots, making sure to reflect the same pride onto his three boys. His greatest pride were his three sons and their families, specifically his six grandchildren, who he adored and cherished; he was their Dida and they will miss him dearly.

Besides his loving wife, Milan is survived, and lovingly remembered, by his three sons and daughters-in-law, Martin (Andrea) Vukelic of Calgary; Zeljko (Elena) Vukelic and Adam (Michelle) Vukelic, both of Vancouver; six beautiful grandchildren, Milan, Jure, Marko, Jelena, Maksimir and Dane; and many extended family from Kelowna, Vancouver, Calgary and Croatia. Milan was predeceased by his parents Martin and Danica in 2010.

A Mass of Catholic Burial will be held on Saturday, October 11, 2014 at 1:00 pm at St. Theresa’s Catholic Church, 750 Rutland Road N., Kelowna, BC, followed by a graveside memorial at the Kelowna Memorial Park Cemetery.

JENNISON, DONNA HARRIETTE

On Monday, September 29th our sweet mom passed from this world to the next just after sunrise surrounded by family.

She was 89.

She is survived by her five children Greg (Dani) Cowie, Susan (Yogi) Krehbiel, Steven (Sheila) Cowie, Charlotte Levell, and Marilyn (Glen Wood) Green; ten grandchildren; three step grandchildren; eight great grandchildren; and five great step grandchildren. What a legacy! She is also survived by brother Hugh (Jacquie) Fitzpatrick and sister Kate (Gordon) Sladen. She was sadly predeceased by parents Bessie and Doc Fitzpatrick (co-founder of McLean and Fitzpatrick Packinghouse), sister Glenda, ex-husband Murray Cowie, and husband Walter Green.

Mom was born and raised in Rutland and trained as a Registered Nurse at the Royal Columbian Hospital in New Westminster BC. Mom had a 41 year career as an RN at Kelowna General Hospital in both the Maternity and Emergency wards. She was born to be a nurse, embodying grace, warmth, compassion and an innate ability to calm people in some of life’s most emotional circumstances. She loved her chosen career and thousands of people benefitted from her excellent care over the years.

Mom’s greatest joy came from her family though. We all say that we won the ‘Mom lottery’. She was quite simply the best mother and Nan in the world. Everything we have ever done in our lives has been made easier by her love and support.

Mom was full of life, positivity, and laughter. She met life’s many challenges with strength and optimism, and got up every day looking forward to enjoying what life had to offer.

We have a lifetime of memories of our many family gatherings where laughter and love were always first on the menu.

Our family would like to thank the staff at Lakeview Lodge for their tremendous love and caring of mom in the last year of her life. Special thanks and love go to Mom’s honorary daughter, Shirley Fontaine, for being mom’s protective and loving caregiver for the past several years. Special thanks also go to our Aunt Kate for her love, wisdom and presence in this journey we have been on with mom, particularly during the last night of mom’s life.

We are heartbroken to have to say goodbye to our mom, but though she is gone from our sight, she remains forever in our hearts, and we are beyond grateful for the gift she was and is to us.

A celebration of Thanksgiving for mom’s life will be held on Saturday, October 11th at 4:00 pm at Springfield Funeral Home.

In lieu of flowers, mom would be pleased if you made a donation to the BC Children’s Hospital, the Kelowna General Hospital Foundation, or to the charity of your choice.

1943 - 2014 After a thankfully short, but nevertheless heart wrenching and intense battle with cancer and subsequently pneumonia, Donna Jennison, resilient, strong, and independent until the very end, passed away on Saturday October 4, 2014 at the age of 71.

She was predeceased by her parents, William and Harriet, sisters Vera, Bernice, Doreen, Joyce and her brother Wayne. Donna was born in Killarney Manitoba on August 15, 1943 and grew up on the family farm in Mather before marrying Doug, of neighboring Cartwright in 1962. Soon after their wedding, their son Kirk was born and a few years later they braved the Rocky Mountains and moved to Kelowna BC. Once in BC, Donna continued her career as a Licensed Practical Nurse before becoming the “warden of the screen department” at NAP. Doug and Donna continued to do screens throughout their retirement under the business name DJ’s Screens. Donna boasts the unusual accomplishment of essentially having “two only children” as her daughter Melinda did not join the family until 16 years after Kirk, leaving Donna to balance both a newborn and a teenager while her friends were beginning to become empty-nesters.

Throughout her entire life, Donna loved nothing more than being surrounded by family and friends, love and laughter.

Inevitably, wherever Donna was, a story was soon to follow.

She adored being in the outdoors and was an avid camper, fisher and quadder and often said she was “sorting her life out” while having a drink by the fire. Donna also kept a suitcase packed at all times, so that she was ready in the off chance that someone suggested going to the States. Donna had a work ethic and willingness to help others that was unrivalled. Everyone who knew Donna in any capacity knew her as a woman who loved to laugh and to socialize and who always put everyone else’s needs, however minor, before her own.

Donna is lovingly survived and will be greatly missed by her husband Doug, son Kirk (Tina), granddaughter Britney (Glenn), daughter Melinda (Myles), grandson Kendon and granddaughter Kaelin, as well as sisters Grace and Sharon, sister-in-laws Bette, Louise, Donna and brother-in-law Bob. A celebration of life service to remember Donna will be held at the Kelowna Community Church – Kelowna Salvation Army (1480 Sutherland) on Saturday October 11, 2014 at 11 am. A “happy hour” will begin at Duffers at Mission Creek Golf Course on KLO at 2 pm with glasses being raised in a “toast of remembrance” of Donna at 3 pm.

The family requests that in lieu of flowers, donations are made to the Canadian Cancer Foundation, 1633 Pandosy Street Kelowna, BC V1Y 1P6 or that since Donna was an avid gardener, that a favorite plant or flower is dedicated to her memory.

Is it possible to die if you overdose on marijuana?

What are the best interest rates in today’s market?

Currently, I’m seeing Lenders/Banks offering exceptional pricing on interest rates! Typical rate on a 5 year fixed is 2.94% or better depending on the strength of the application. Variable rates also continue to be extremely attractive with Lenders offering deep discounts. At the moment, I have Lenders offering Prime (3%) less .70%. So that would be 2.30% for a variable rate mortgage! There is also some excellent 2,3 and 4 year terms available.

While it is true that prescription pain medication kills around 10,000 people a year in Canada, due to being prescribed the wrong drug, dosage errors, and adverse reactions, no one has died from a marijuana overdose.

So is it even possible to die from an overdose of marijuana? According to the National Cancer Institute, the answer is NO. Here is why, unlike opioid receptors, cannabinoid receptors are not located in the brainstem areas controlling respiration, lethal overdoses from cannabis and cannabinoids do not occur. Therefore, marijuana cannot cause someone to stop breathing, no matter how much they ingest.

Another way of measuring a drug’s safety is by its therapeutic index.

The therapeutic index is the ratio between a drug’s lethal dose and its therapeutic dose (amount that causes a therapeutic effect). Studies show that marijuana has a therapeutic index of 40,000:1. This means someone would have to take 40,000 times the normal amount of marijuana in order to die.

Although it is impossible to die from an overdose of marijuana, that does not mean you can’t take too much of it and “Green-Out”. If you green out, you can experience anxiety, restlessness, sweating, the spins, nausea, and even vomiting. The best thing to do is to lay down and sleep it off. The negative symptoms of a marijuana overdose are only temporary and should wear off within 24 hours. Unlike other drugs, taking too much marijuana won’t cost you your life.

Why choose carpet over hardwood?

Building credibility, trust is key to entrepreneurial success When you break the definition of an entrepreneur into its key elements, what you get are three operatives— innovator; organizer and manager and risk taker.

It is these basic elements that make a good business venture a great one.

However, dear friends, those are precisely the factors that will stunt growth if they’re not checked on from time to time and kept relevant in the context of future growth.

A good entrepreneur, the literature tells us, is also a builder of trust.

You simply can’t do all of the other things an entrepreneur is supposed to do if you can’t get others to trust you. Trust begins with credibility, does it not?

OK, it admittedly isn’t easy these days being an entrepreneurial leader.

With trust, confidence levels and credibility dropping rapidly among employees, leaders face an uphill task in rallying staff, conveying messages and moving forward toward an organization’s goals.

The usual grouse I hear in the Okanagan is that leaders don’t show up, are not putting value on communication, aren’t straightforward, don’t listen, and don’t take feedback seriously from their personnel.

Establishing credibility amongst personnel, investors and the external world is just as important when dealing with individuals and organizations external to the venture. In a recent survey about my favourite topic, entrepreneurial leadership, leaders didn’t fare well on questions dealing with ethics and a willingness to admit mistakes.
