The verdict is in from the National Energy Board—Kinder Morgan does not need the City of Burnaby’s permission to access city land for its geotechnical studies. Despite that, Burnaby still believes it can enforce any violations of its bylaws by the pipeline company. The company has applied to the NEB to expand its Trans Mountain pipeline. Its current preferred route between its Burnaby tank farm and Westridge Marine Terminal on Burrard Inlet is to drill through Burnaby Mountain. The NEB extended the review process by seven months. This is to give the company time to do the necessary surveys and geotechnical work in the city-owned Burnaby Mountain Conservation Area. But so far, Burnaby city hall, which opposes the project, has not given the company permission to do the work on its parkland. Kinder Morgan asked the NEB to confirm the NEB Act gives them access, even without the owner’s permission, to do the work. Please see CITY, A3

Food drive is back Mario Bartel

photo@burnabynewsleader.com

It’s not yet Labour Day, but the sixth annual B.C. Thanksgiving Food Drive is already gearing up. That’s because the BCTFD wants to ensure the shelves of local food banks are stocked to the rafters so everyone can enjoy a bountiful Thanksgiving holiday, said the drive’s coordinator in Burnaby, Jason Nagy. From Sept. 15 to 20, more than 100 volunteers will be delivering donation bags to residences in various neighbourhoods around Burnaby. Anyone wishing to donate non-perishable food items to the food bank can place them in the bag and leave it on their doorstep before

9:30 a.m. on Sept. 20, when it will be collected. Last year’s effort gathered about 5,400 pounds of food from an equal number of homes around Burnaby. It was part of a province-wide effort that collected 450,000 pounds of food in 50 communities. Nagy said the Burnaby group is hoping to double its collection this year. “We’re trying to raise awareness,” said Nagy. Households that don’t get a donation bag can still contribute by dropping off non-perishable food items to the Save-On Foods at Market Crossing on Sept. 20. Cariboo overpass last piece of Port Mann puzzle Mario Bartel

photo@burnabynewsleader.com

On Monday drivers on Cariboo Road crossed over Highway 1 on the oldest bridge that spans the highway in Metro Vancouver. On Tuesday they drove over the newest. The barriers came down on the new Cariboo Road overpass, giving drivers access to the three-lane span for the first time Tuesday even as work crews continue to put the finishing touches on the bridge. It’s the last of six overpasses between Brunette Avenue and the Ironworkers Memorial Bridge that had to be rebuilt as part of the Port Mann/Highway 1 Improvement Project that widened the Trans-Canada to eight lanes as it bisects Metro Vancouver. The new bridge is wider, with three lanes for traffic flanked by shoulder bike lanes on each side and a 3.5-metre multi-use path on the northbound side. It was also designed to be expanded to four lanes if needed in the future, said Greg Johnson of the Transportation Investment Corporation. The extra space will make the crossing safer for cyclists and pedestrians, as well as motorists, said Johnson.

MARIO BARTEL/NEWSLEADER

Workers are still putting the final touches on the new Cariboo Road overpass across Highway 1 even as traffic started using the new span on Monday. The three-lane bridge replaces the old two-lane bridge that was built in 1962 and was one of the oldest over the highway. The old bridge will be dismantled by the end of the summer.

“The key improvements have been for safety,” he said. At 5.5 metres, the new bridge is also two metres higher than the old one and half a metre higher than the provincial requirement. That’s because trucks have gotten larger

since the first Cariboo overpass was erected in 1962. While the overpass lacks architectural embellishments, its functional simplicity belies its complicated construction, said Mike Farynuk, the project’s senior supervisor.

For one thing, it had to be built with minimal disruption to traffic on the busy highway below. That meant each of the seven 50-metre slightly-curved steel girders had to be lifted into place through nighttime hours. The site where the bridge is located is also busy with hydro transmission lines, as well as the right of way for the Trans Mountain pipeline. The last thing his crews needed, said Farynuk, was to plunge the Lower Mainland into darkness or release a geyser of toxic oil as occurred on Inlet Drive in North Burnaby in 2007. So surveying work was done with precision, and cranes moved into position carefully. While the new bridge is open to traffic, work isn’t yet finished. The dismantling of the old bridge has already started and should be completed by the end of summer, said Johnson. Landscaping at the approaches should be done by year’s end. Some of that work could still disrupt traffic, he said. Notice of those disruptions can be found on the Port Mann project’s Twitter feed @PortMannHwy1. twitter.com/newsleaderfotog

City of Burnaby still believes it can enforce bylaws ⫸

continued from FRONT PAGE

Burnaby city hall argued against that interpretation. Burnaby has even launched a constitutional challenge, saying the NEB could not override municipal bylaws. But the NEB rejected Burnaby’s arguments on both counts. “The Board considers it telling that the legal basis so described lacks any reference to a violation of the Constitution,” the NEB decision said in dismissing the constitutional challenge. As for the land access issue, the NEB said, “Trans Mountain has the power to enter into and on

Burnaby land without Burnaby’s agreement … “Trans Mountain does not require a Board order for temporary access, nor has it requested a Board order.” It added that “it would not be logical that the Board be required to recommend approval or denial of a project without all the necessary information before it. This would not be in the public interest.” Carey Johannesson, Trans Mountain’s project lead for land and right-of-way, said it’s good news for the company. But they still want to work with Burnaby. They’ve applied to

the city for permission and have answered its questions. “It doesn’t just apply to Burnaby, it’s just a general right that any pipeline company gets under Section 73 [of the NEB Act] when it’s trying to fix the route of a pipeline that’s under NEB jurisdiction,” Johannesson said. He said the company will contact the city in light of the ruling. It intends to proceed with its surveying work and will let them know when it will happen. “Our plan is to still see if we can work with the city. We’ve had a relationship with Burnaby on this pipeline for over 60 years.” But Burnaby officials still

believe they can enforce their bylaws and plan to do so. “We launched our Constitutional challenge because we absolutely believe that our bylaws trump the Act in this case,” said Mayor Derek Corrigan in a press release. Corrigan said in its decision, the NEB did not deny the city’s assertion but only offered its interpretation of the NEB Act. “We will, therefore, continue to enforce our bylaws, ensuring that Kinder Morgan does not access Burnaby parkland and the Brunette Conservation area on which they want to perform deleterious actions that would

contravene the laws put in place by our City and citizens to protect our parkland.” “The NEB refused to address the City of Burnaby’s constitutional question,” said Burnaby’s legal counsel, Greg McDade. “By refusing to grant an access order, they ignored the question completely, meaning that Kinder Morgan still cannot access Burnaby’s land without the City’s permission.” NEB spokesperson Sarah Kiley said Burnaby could file a motion asking the NEB to reconsider either decision but otherwise it’s up to the company and city to decide how to proceed.

and acquaintances. It’s up to all of us to ensure our loved ones, especially those that are vulnerable, are protected against these financial vultures.” The Burnaby RCMP’s economic crime unit learned about the scam in October 2013 but believe it started in 1999. That’s when a man thought he was awarded contracts to do work on a pipeline for the Nigerian National Petroleum Corporation. The suspects instructed him to pay fees to get paid for the contracts. But even though the man died seven years ago, his 88-year-old wife continued paying the fees believing the contracts she thought were worth $58 million, would be awarded. She’s lost most of her money to the con artists and eventually asked friends and associates to help her

pay the fees, believing she’ll share the proceeds with them one day. Police said the woman believes she is communicating with real Nigerian officials. While similar scams were common in the early 2000s, their number dwindled as victims ran out of money or realized it was a fraud. But the fraud continues for the current victims. “There is no shame in falling victim to a scam,” said Drolet. “These people are extremely sophisticated and by their very nature, they prey on the vulnerable.” Anyone who has been victimized by the scam or who continue to pay into it are asked to call the Burnaby RCMP Economic Crime Unit at 604294-7922 or Crime Stoppers at 1-800-222TIPS (8477). twitter.com/WandaChow

Optimizing the Trans Mountain Pipeline Route Trans Mountain filed an Application with the National Energy Board (NEB) in December 2013 to expand our pipeline, which currently runs through your community. As a result of engineering and environmental studies, along with feedback and input from Aboriginal communities, stakeholders and landowners, we are working to refine the proposed pipeline corridor to minimize impacts to communities. OPINION NEWSLEADER’S VIEW:

PuBlIsHeD & PRINteD By BlACk PRess ltD. at 7438 Fraser Park Drive, Burnaby, B.C. V5J 5B9

PHOTO OF THE WEEK: Lynn Quesnel caught this shot of a Great Blue Heron on the morning of Aug. 6 from the Quayside boardwalk in New Westminster. ‘This heron was just there looking at us when my dog started to bark,’ Lynn says. ‘I was able to capture this shot as it flew away.’

Railway safety The final report of the Transportation Safety Board (TSB) into the Lac-Megantic rail tragedy, which killed 47 residents of the quiet Quebec town last July, is a damning indictment of both Transport Canada and the poorly-run Montreal, Maine and Atlantic (MMA) Railway. Together, their indifferent attitude towards safety led to what the TSB report describes as 18 “factors” which came together to create the horrific tragedy. While the most egregious inattention to safety rules and practices was on the part of the company, which seemed interested only in profits and had little commitment to the communities which its rail line traversed, the federal agency was deficient in a number of key areas. One is that it did not follow through on many occasions, after inspectors had cited MMA for various safety issues. Another is that it did far too much checking for “compliance” verbally, instead of in person. A third is that the government department has left far too much of the responsibility for compliance with safety rules solely up to the railways. If railways were operating in a vacuum and not interacting with citizens, municipalities and vehicles every minute of every day across Canada, leaving all responsibility for safety up to the railways might be justified. Here in Burnaby, it is easy to see how much of an impact railways have on everyday life. Longer and longer trains block crossings for three to five minutes each time they pass. Last January a derailment spilled coal into a sensitive waterway. If railways operate safely, that impact may be annoying, but it won’t be devastating. Rail transport is a vital and important part of economic activity, but it must be conducted with a “Safety First” attitude at all times. —Black Press

B.C. salmon need protection

T

he annual run of salmon – returning to the Fraser River to go to a myriad of spawning channels all over B.C. – is one of the most iconic and awe-inspiring symbols of this province.

Unfortunately, with the rapid urbanization of the Lower Mainland (including cities like Surrey and Delta), many urban residents have no personal connection to the river, its fish or the people who fish for them. Nor do they understand the vital, historic and even spiritual connection between B.C.’s First Nations and the salmon. They do not know the importance of the salmon run, and the threats the returning fish have faced in the past, and continue to face right now. Accounts from the first Europeans who came into contact with First Nations here speak of the staggering number of returning fish. This occurred each year – not every four years, as is the case today with the major sockeye run

Frank Bucholtz – and was the most important factor in the thriving economy and well-developed culture of coastal First Nations people, and indeed of many in the interior. The gigantic runs continued into the early 20th century, and led to the establishment of a huge salmon fishery and numerous canneries, including some along the Fraser in Delta and Surrey. Communities like Annieville along the Fraser River thrived, and people involved in the industry, from shore workers to fishers and cannery owners, prospered. One of the greatest blows to the fishery occurred in 1913, when blasting by the Canadian Northern Railway in the Fraser Canyon changed the river flow near Hell’s Gate, and prevented

7438 Fraser Park Dr., Burnaby, B.C. V5J 5B9 newsroom@burnabynewsleader.com burnabynewsleader.com | newwestnewsleader.com

a massive number of fish from making their way to upstream spawning grounds. The fishery has never fully recovered from that blow, although the 2010 run was the biggest since that year. But even into the 1980s, there were continued significant runs, not just of sockeye, but also of coho (now in significant trouble), chinook, chum and pink. There were still a lot of people involved in the fishing industry. The United Fishermen and Allied Workers Union was a force in local labour circles, and the NDP in North Delta had an annual salmon barbecue and fundraiser each summer. The event I attended at Sunbury Hall about 30 years ago rates, for me, as the best meal I have ever enjoyed at a political fundraiser. The fact that former premier Dave Barrett, the most spellbinding orator on the provincial scene in the past halfcentury, was guest speaker also made it a memorable occasion.

Damage to spawning streams, in both urban and rural areas, combined with ocean temperature changes and other unknown factors have significantly hurt the salmon runs in the past 20 years. A small commercial opening took place for sockeye on Monday, and there will be other openings, but the fish are still under enormous pressure. That’s why news of a mine tailings pond collapse into the Quesnel River system on Aug. 4 hit like such a body blow. A large number of sockeye are headed that way. Whether they will be impacted isn’t yet clear, but even the potential for a major kill of spawning fish makes many people very angry. Salmon aren’t just good for eating, they are an important economic and cultural symbol of this province. Frank Bucholtz is editor of the Langley Times.

Things are heating up Vancouver was recently gripped by another heat wave, with air temperature records repeatedly broken. And as California faces the worst drought in its history, and so forth, some people may wonder what happened to the claim, published in this very paper, that the Earth was cooling off. I am on record, also published in this paper, as stating that claim was entirely bogus, because, at best, it was based on a short-term fluctuation in some air temperature measurements. The Earth is a complex system, so you have to smooth the noisy data before you can say anything at all. However, it is also important to understand that the air temperature is not a reliable indicator of how hot the earth is. The atmosphere contains very little mass compared to the rest of the Earth. On the other hand, the

oceans have enormously more mass than the atmosphere, and heat can still flow through them fairly easily, so the ocean temperature gives a much better representation of the surface temperature of the Earth. But how do you determine the average temperature of the oceans, when most of them are very remote from any human presence? Everybody is familiar with the common thermometer, in which the volume of a fixed amount of liquid tells you the temperature. If the liquid expands, then you know that it absorbed heat, and you know that its temperature increased. In order for the thermometer to have practical value, these relationships need to be quantified. You need to know two properties of the liquid, its thermal expansion coefficient, and its heat capacity. It’s obvious what the first term means; the second term

Some fun ideas for fall

F

or me, this time of year—late August-early September—signifies a change.

Not the change like the start of the New Year, but a change nonetheless.

Geraldine Parent Once daylight hours begin to disappear and temperatures are cooler we are forced to spend a little more time indoors and routines develop out of necessity. We make plans for special outings and activities, take on new projects and start new programs and routines. If you are not quite ready to let summer go and are interested in finding some new and interesting things to do over the next few weeks, here are a couple of activities to consider: • Play the open air piano located in the Century Gardens in Deer Lake Park as part of the Pianos on the Street Program. Painted by students of the Shadbolt Centre, the piano is available for public playing until the end of September. www. supportpiano.com • Attend the Live at the Bolt performance Gloria’s Happy Hour on Sept. 19 at 8 p.m. for a cabaret-style evening of games and entertainment, it is sure to pique your curiosity. • Listen to some traditional blues at the A Little Lunch Music noon-hour concert on Sept. 25. Hot off his performance at the recent Burnaby Blues + Roots Festival, the Steve Kozak Band is sure to get your toes tapping and hands clapping. A buffet lunch ($12) is served starting at 11:30 a.m. with the music from noon to 1 p.m. • Participate in several of the activities scheduled in the cultural precinct during Culture Days (www.culturedays. ca), from Sept. 26 to 28, when the public is invited to participate in free activities to discover their cultural spirit and

The Tides at Birch Bay gives you the best of both worlds: privacy and relaxation while also being just moments from the beach and the amenities of Birch Bay.

Finding some family fun at The Tides

By Kerry Vital

Everyone has fond memories of their childhood summer vacations, spending time with family and friends and playing outside for hours. Now it’s time to make more of those memories with The Tides, just minutes from the Canada-U.S. border in Birch Bay,

Washington. “At The Tides, you get the best of both worlds,” says Chris Hughes, a local RE/ MAX broker and a partner in Compass Point Project Marketing. “It’s private, relaxed and quiet, but you can be at the beach in less than two minutes for all the activity and action you want.”

The Tides is located on a sunny plateau with over eleven acres in total, of which seven acres are set aside as nature preserve, private treed parkland and trails, which creates a perfect setting for a second home getaway. There will also be picnic areas, a bocce ball court and an ocean-view lookout with a fire pit. The Clubhouse has a heated outdoor pool and hot tub, billiards area, community kitchen, BBQ area and a lounge. The cottage-style townhomes themselves are homes away from home, with stainlesssteel appliances, granite or quartz countertops and a stone-faced gas fireplace. Outside, you’ll find West Coast Craftsmen architecture and a private deck or patio. There are a variety of two- and three-bedroom floorplans available, ranging from 1,082 to over 1,500 square feet, including five ready for immediate occupancy. The location is the biggest draw for buyers. The C Shop, which sells candy, ice cream, pizza, baked goods and other treats, is just a minute away. When the tide is out you can walk for miles on the sand. There are also a number of eclectic restaurants and cafes. You’ll also find Birch Bay State Park and boat launch, water slides, go-carts, mini-golf, two marinas and several golf courses nearby. Cottages at The Tides start in the low $200,000s. For more information, visit www.thetidesbirchbay.com, email info@ thetidesbirchbay.com or call 1-888-255-8121.

Believe it at fortisbc.com/calculator. *These are approximate savings based on the difference between annual natural gas and electricity costs for space and water heating of a 2,300 square-foot house with average insulation and four occupants in the FortisBC Lower Mainland service area. Calculation compared high-efficiency natural gas furnace and large storage tank water heater with electric resistance heating (baseboards) and equivalent water heater and is based on FortisBC natural gas rates as of July 2014 ($11.054/GJ) and electricity rates in the service area identified (Tier 1 and 2: $0.079 and $0.118 per kWh). Actual savings may vary. Savings do not include potential rebates and/or incentives.
