Panhandlers face fines, property seizures Updated Sidney bylaw will allow police, town officials to seize and sell obstructing items Steven Heywood News staff
Panhandlers in Sidney had better behave themselves or face new fines and potential seizure of their belongings. The Town of Sidney adopted a revised streets and traffic bylaw June 23 following debate over the distress caused by panhan-
dlers in the downtown area this spring. In the bylaw, fines of $65 to $130 could be levied against anyone who obstructs a sidewalk, impedes pedestrian traffic or causes an object to be an obstruction or a nuisance. Additionally, the bylaw states that a municipal official or police officer may seize the property of a person “unlawfully occupying any
street or other public place in contravention.” The possessions, continued the document, can be impounded until their owner pays the Town the costs associated with the seizure. If the items are not collected in 14 days, and after a five-day advertising period, the Town will be able to sell it to recoup their costs.
The bylaw also states that a person cannot solicit in a specific location for more than two hours continuously or cumulatively, within a 48-hour period. Enforcement is only listed as fines. Councillor Melissa Hailey noted that the bylaw is somewhat ironic in that it would fine people who are unlikely able to afford them. She added, however, that if people
want to help others, they should do so with charitable programs set up to target them directly. Coun. Kenny Podmore added the Town is acting on public feedback on the issue and Coun. Tim Chad noted the Town is following the province’s safe streets act. PLEASE SEE: Council has stepped up, page 7

Taking the plunge
A non-swimmer for 60 years, Bruce Easson does it for family
Steven Heywood News staff
Bruce Easson never learned how to swim. At age 12, he says he sank like a stone during lessons and people had to rescue him. “I got into the pool and I sank to the bottom,” says Easson, now 84. “I never learned how to get to the surface so at age 12, I decided I was going to be a non-swimmer.” Complicating matters as he grew older were health and mobility issues arising from Cerebral Palsy, a condition he has had all his life. That made it difficult to move, let alone jump into a pool or lake to go for a swim. He said it has been 60 years or so since he even tried. Yet, the desire to take the plunge never entirely vanished and when his granddaughter took to the water and became a competitive swimmer, Easson decided it was time to finally get his feet wet. “It’s time to learn,” he said during his first lesson at PanSteven Heywood/News staff orama Recreation Centre. “I’ve Bruce Easson, who suffers from Cerebral Palsy, is learning to swim so decided to fulfil one of my life he can enjoy time with his daughter and granddaughter. Smoking ban a clear sign
A
looming ban on smoking throughout most public areas of the Capital Region will be a sweeping change for the roughly 11 to 15 per cent of us who still light up on a daily basis. Once implemented, smokers will be prohibited from satisfying their nicotine fix at any park, playground, playing field, public square, beach or bus stop. On its surface (and likely to many smokers), the Capital Regional District’s strict Clean Air Bylaw appears a potential violation of personal freedoms. But look closer and it’s obvious the health concerns associated with secondhand smoke should accommodate the increased restrictions on smoking. Still, the increase in the non-smoking buffer zone between doors, windows and air intakes from three to seven metres means smokers are forced to wander for relief in dense urban areas for hundreds of metres, an inconvenient task and not feasible while on a quick break from work. As well, when the CRD first announced the bylaw last year, the B.C. Civil Liberties Association expressed concern that the government was asking too much of smokers. BCCLA policy director Micheal Vonn pointed specifically to comments made by Island Health officials that smoking near children can have a “significant positive social modelling” effect, a claim Vonn said was too broad in scope. Smokers should never have to shield their behaviour, nor should they need to quit altogether simply because of a bylaw. Regardless, the balance between smokers’ rights and non-smokers’ health concerns will likely need to be revisited by the courts, as a challenge to the new CRD bylaw is plausible in the next few years. In the meantime, smokers should take note of the pending changes and consider a switch to e-cigarettes, which for now (at least) aren’t included in the ban. What do you think? Central Saanich intersection dangerous The intersection of Mt. Newton Cross Road and East Saanich Road is a tragedy waiting to happen. The traffic control consists of a four-way stop. This might be sufficient when there’s four lanes of traffic. At Mt. Newton and East Saanich there are 12 lanes when you count through lanes and left and right turn lanes. This makes it dangerous for any pedestrian who is less-than nimblefooted to cross. Drivers are too busy checking all the other vehicles to figure out whose turn is next. Just the other day, a friend of mine was nearly run over in front of the Prairie Inn by a car barreling through the intersection. He had to shout to get the driver’s attention. The four-way stop also seems to infuriate impatient drivers when traffic is backed up. If a car in front of them hesitates, it is not uncommon for a driver to shout obscenities out the window. When Saanichton was a smaller community, the stop signs and red flashing lights may have been sufficient but today, increased traffic is funneling through this key intersection. It is time for Central Saanich council and the police to find a way to alleviate this dangerous situation. Whether it is a traffic light, a roundabout, or even a police officer stationed there all day, it is long past the time to do nothing. Let’s not wait for a tragedy to occur first. Be proactive, not reactive. Carole Pearson Saanichton

What is the rush?
The North Saanich council majority (Dunstan Browne, Ted Daly, Craig Mearns, and Conny McBride) have bypassed the Official Community Plan and zoning by asking the Capital Region District to increase density. In a 12 to 10 vote the CRD approved the amendment but demanded a public hearing in spite of about 97 per cent of resident submissions not supportive and only three presentations in favour. The debate about the public meeting is revealing and can be seen on the North Saanich web cast. Counc. Elsie McMurphy expressed concern that voting on the bylaw immediately after the public meeting may signal some counsellors have already decided. Browne demanded her comments be withdrawn. He was joined by McBride, Mearns and Daly to strike the comments from the record. You may notice that when Daly stated the mayor and ‘other’ counsellors drag proceedings out there is no comment. Daly makes a statement of commitment to approve development as soon as possible. Some may wonder if his mind is made up. The public hearing will be Monday, July 14, 7 p.m. at the Mary Winspear Centre. It is the opportunity for the residents of North Saanich to voice their opinion. The council vote will be a testimony of commitment to

Business needs help If anyone is wondering why Sidney’s merchants are suddenly becoming more vocal, I direct you to the comments of Sidney Councillor Mervyn Lougher-Goodey in the June 27 PNR task force article. I am sure the owners of the 41 retail stores that closed since the recession hit, are mortified by those comments. This, coupled with Coun. Kenny Podmore’s assertion in a recent letter to the editor that business is “significantly up from the same time last year” and calling our concerns and statements ‘doom and gloom’. I assure you it is not the small businesses who are ‘significantly up’. After reading these statements in the press, I am very happy that this is an election year. We know that the Sidney residents love the small shops and what we have to offer. We do not want them to think we don’t appreciate them. We are so very thankful that you shop local. When placed in the normal position, the legroom isn’t ample but on par with others in this class. Connecting to the Cherokee is a snap with the optional 8.4-inch Uconnect system that pairs with smartphone in seconds, is very quick between commands, and has nice looking graphics. The base screen is five inches but has many of the same functionality. Behind the steering wheel, inside the instrument cluster, is another programmable screen for all the information the driver needs frequently. Drive The base 2.4L 4-cylinder with 184hp is the base engine on all trim levels. For just $1,300 any Cherokee can be equipped with the optional 3.2L V6 engine – making the walk up to this 271hp engine within reach for many buyers. In addition, this is the very first application of a 9-speed automatic anywhere in the auto industry, providing improved fuel economy and drivability. Having a chance to drive both the 4-cylinder and V6 models with the all-new 9-speed automatic, I’m torn. The V6 is the engine of choice for towing, steep mountain
A good off-roader, comfortable and an easy street performer, the Cherokee does both equally well.
runs and longer distance driving. The flip side is that the 4-cylinder is a very good in-city commuter and the lighter engine helps this Cherokee to corner, brake and manouevre better. The 9-speed automatic shifts quickly and smoothly, in fact I forgot it had so many cogs but it does improve fuel economy with a highway rating of 6.4L/100km with the 4-cylinder and 7.0L with the V6. Most Canadians will opt for the AWD versions thanks to our winter conditions, but here too there are more choices. Jeep has included three AWD systems. The first is a called Active Drive 1 with a selectable drive mode called Select-Terrain, for automatic, snow, mud and sand settings. The second is called Active Drive 2 and offers a two-speed mode for low speed crawling. The most aggressive system is Active Drive Lock, which comes in the off-road purpose-built Cherokee called Trailhawk. The Trailhawk is a ‘real’ Jeep; this is thanks to a locking rear differential and a host of electronic aids. The most impressive feature is the low speed crawling mode for both up and down hill tasks. Therefore, Jeep purists, yes there is a Cherokee for you. Verdict This new Cherokee is off to a fantastic start. Sales are strong and the sharp design is bringing in buyers, not shoving them away. The 2014 Cherokee could not be further away from the last model; this is a thoroughly modern SUV with go-anywhere capability and aroundtown refinement that needs to be experienced. The Lowdown Power: 184hp 2.4L 4-cylinder, and 271hp 3.2L V6. Fill-up: 9.9L/7.0L/100km (city/highway AWD) Sticker price: $23,695-$32,195
There is talk in Greater Vancouver of introducing a regional carbon tax to fund transit and highway initiatives. Should such a tax be extended B.C.-wide to help fund much needed transport infrastructure throughout the rest of the province? Go to DrivewayCanada.ca to submit your answer. QUESTION

Since 2007, the region has seen a decrease in new home prices, though largely due to lower labour and material costs, not land costs, Edge says. As the market and economy continue to improve, these costs will rise again. What has stayed relatively untouched is the low interest rates that help offset the region’s high real
estate prices. The B.C. Real Estate Association expects B.C. housing starts to rise approximately two per cent in both 2014 and 2015, thanks to an expected acceleration of economic growth and employment. Looking beyond 2015, however, strong growth in the 20- to 44-year-old demographic is expected “to put pressure on new home inventories and drive up new construction activity, particularly multiple units that cater to price-sensitive first-time buyers,” the asso-
ciation says. The Greater Victoria townhouse market, for example, is “definitely seeing a bit of an uptake in sales and building,” Ayres says. Where condominiums catering to young families have been seen in the Vancouver area, for example, here on the south Island, builders have focused more on townhomes, small-footprint single-family homes, and in more established areas, infill projects of small multi-family projects. While townhomes and condominiums can have
a pricepoint appealing to first-time buyers, they also bring additional costs such as strata fees. The trade-off is the freedom from yardwork and maintenance that comes with a single-family home. Falling in the middle are some of the small-lot homes with minimal, easy-care landscaping. However, in family-friendly communities such as Westhills, parks, playgrounds and recreation areas are nearby, offering plenty of opportunities to get outside. While a great deal of new building is keeping the West Shore real estate market hopping, other areas of the Capital Region are seeing their own opportunities for more affordable housing. In some areas of Saanich, for example, it’s not unusual to see a single-family home on a large lot rezoned to allow a second attached home, effectively creating a duplex that doesn’t look like the standard mirror-image duplex. Though still falling under strata rules and with some shared expenses, duplexes typically don’t have strata fees and offer more of a single-family experience with a little property. In communities that have allowed secondary suites, or unique options such as “carriage house” accommodation or garden suites, these mortgage-helpers allow younger buyers even more options. editor@saanichnews.com
