The judgment left it open to the B.C. government to amend the Forest Act so it conforms with aboriginal title as it is declared.

In recent years the province has begun negotiating resource sharing agreements with aboriginal communities, including forest tenures and shares of provincial royalties from mines.

Two weeks before the Tsilhqot’in judgment, the B.C. government announced a three-year “stewardship agreement” with five Tsilhqot’in member communities.

The province is providing $670,000 per year for projects to address forest and wildlife effects from the mountain pine beetle epidemic in the region.

will take some time for the province to consider amending the Forest Act and other legislation that has been affected by the decision.

More than 90% of B.C. is Crown land, and much of that is subject to forest licences as well as unresolved aboriginal land claims. In the Tsilhqot’in territory west of Williams Lake, the high court’s landmark ruling clarified the effect of aboriginal title.

“Now that title has been established [in the Tsilhqot’in claim area], the timber on it no longer falls within the definition of ‘Crown timber’ and the Forest Act no longer applies,” wrote Chief Justice Beverley McLachlin in the unanimous judgment released June 26.

McLachlin wrote that the B.C. government can still enforce “general regulatory legislation” such as that dealing with pest invasions or forest fire control in areas of proven aboriginal title. But a timber licence in such an area is “a direct transfer of aboriginal property

Can you design the next Canada Games medal?

Submitted The search for the design of the medal to be awarded during the 2015 Canada Winter Games is now on. From June 24 until August 8, 2014, the 2015 Games invites submissions from across Canada to design the front side of the medal for the 2015 Games, as part of the Canada Games Medal Design Competition.

“The medal design competition is always a great way for the public to get involved to create a lasting legacy that Canada Games medalists will treasure for a lifetime,” says Tom Quinn, Chairman of the Canada Games Council. “ Seeing the creativity and all the effort that is put into the conception of the medal design continues to be a fun and rewarding process for the Council, the Host Society and the individuals who take part in the competition.”

“This is an exciting and unique opportunity for all Canadians,” says Karen Jeffery, Manager, Ceremonies & Culture with the 2015 Canada Winter Games. “With over 1,000 medals to be presented to successful athletes during the 2015 Games, designing the medal will bring national exposure to the artist and their winning design.”

The Canada Games Medal Design Competition is open to residents of Canada ages 13 and older.

Novice to seasoned artists are invited to apply. The chosen design will receive an honorarium and a commemorative set of the Canada Games medals: gold, silver and bronze.

Basically, character and destiny are tightly woven. In fact, it can be said that it is our basic destiny to be who we individually are, to live authentically. Implied in this statement is: attunement, rhythm and flow. Due to the influences of free will, we can choose to tune-in and live authentically and fulfill our destiny this way. A short while ago I heard a man on CBC radio saying that ‘doing what you love for a living is bad advice’. He asserted that we should not necessarily endeavor to love or even like our work. I certainly disagree. This tendency to sell-out to the market place may have its merits in the shorter term and may even be practically necessary and wise. Yet, the longer term implications of proverbially placing the round peg in the square hole is the source of its own long list of stresses and related issues.

With awareness, which Astrology provides and which can include deep personal insight (when the focus is person-centered) and timing, we can successfully guide us to ‘work towards doing what we love’. This means we can strategically do what we feel we must but steadily and deliberately aim for doing what we love, even if it takes many years. 1. What is Pollination? Pollination is the transfer of pollen from the male to the female parts within one flower, or from one to another flower of the same species. Pollen is mostly moved within a single flower or between flowers by an animal, usually an insect, and sometimes by the wind. In the garden, you can even help out yourself with a brush.

2. Pollinate if You Want to Eat! Pollination allows a plant to reproduce and to produce fruit. A single flower may need multiple pollinator visits to ensure that it will produce full-bodied fruit and a full set of seeds. Many of the plants we rely on for our daily meals need the help of pollinators, including apple trees, tomato plants, pumpkin vines and blueberry shrubs.

3. What’s All the Buzz? More than 200,000 animal species serve as pollinators. Most of them are from the insect family, but hummingbirds, bats and other small mammals can be quite helpful as well. Bees might be our favourite pollinators as some types also give us honey as a by-product. They usually like warm areas, but there are some types of bees that live in the Arctic and way up in the Andes and Himalayan mountains.

4. More Traffic is a Good Thing. If you want to boost the amount of pollinators that frequent your yard and garden, there are some things you can do.

If you create conditions they like, provide them with a place to stay and feel safe and add plants they prefer, you will soon see a traffic increase you can actually enjoy.

5. Back in Black - and Yellow. Bees - both honeybees and their cousins, such as mason bees - are important pollinators that should be getting an invitation to your yard. They are looking for nectarand pollen-rich flowers that are brightly coloured and have a sweet scent. Choose a variety of plants of different shapes that flower at different times so there is always a snack available for whatever type of bee that might be around. Some good plants to choose are crab apples and cranberries, chives and catmint as well as coneflowers and cosmos.

6. Get a Hummer! Hummingbirds have long beaks and brush-like tongues. They generally look out for long, tube-shaped flowers colored red or orange. Plants they like in particular are honeysuckles and Russian sage, but you can also try canna, columbine, foxglove and lupines. Even annuals such as fuchsias, impatiens and petunias can get them zooming in.

7. Don’t Flutter By, Butterfly! Butterflies are often on top of the list of insects we like to have around us. The names of some plants already let you know that they would be good to plant. Buddleia, also known as ‘Butterfly Bush’, is irresistible to butterflies and hummingbirds with its large, honey-scented blooms in various colours. Asclepias tuberosa, the ‘Butterfly Weed’, is another example.

8. Creature Comforts. There are other things, besides the right plants that will make your yard a favourite hangout for bugs. Supplying a source of water, such as a bird bath, and a nice resting spot, such as a few flat stones in a sunny, sheltered spot, can also increase your chances of having a yard that will be frequented by a multitude of insects.

You can also think about hanging up a mason bee or bat house.

9. It Happens after Sunset! Most flowers rely on pollinators to visit them during the daytime and they count on bright colours to attract them. Plants that bloom at night often have more pale flowers and instead send out a heavy, sweet scent to catch the attention of moths, bats and other nocturnal pollinators. Moonflowers, datura and evening primrose are some examples.

10. We Need Pollinators and They Need Us. Throughout the world, there is evidence that many species of pollinators have decreased. There could be many reasons, including a loss of habitat, misuse of pesticides or diseases and parasites. If we create places for pollinators to live and thrive, they in turn will keep us growing.

Big questions and big changes after Tsilhqot’in decision B.C. Views

The Supreme Court of Canada’s landmark decision on aboriginal title held by the Tsilhqot’in Nation leaves many questions to be answered.

Perhaps the biggest is this: Will British Columbia exist as we know it today by the end of this century?

Or will it devolve into dozens of semi-autonomous regions, through treaties or similar court actions, as the only Canadian province that never completed historic treaties?

The Tsilhqot’in decision appears to uphold the key finding of the

2007 trial, that 1,700 square kilometres of the Nemiah Valley west of Williams Lake are essentially owned by the people who occupied it hundreds if not thousands of years ago.

It’s not quite ownership. Federal and provincial jurisdiction still applies, and their authority varies with the strength of the aboriginal title claim.

Chief Justice Beverley McLachlin ruled that the province overstepped its authority by issuing logging permits in the valley in 1983. McLachlin noted that lawyers for B.C. first argued that the logging was to control

mountain pine beetle, then dropped that argument in its first appeal.

She also upheld the decision of the trial judge, one-time NDP leadership contender David Vickers, who rejected B.C.’s position that the economic value of the timber to the province overrode the then-vaguely defined aboriginal title.

Here’s McLachlin’s definition: “The nature of aboriginal title is that it confers on the group that holds it the exclusive right to decide how land is used and the right to benefit from those uses, subject to the restriction that the uses must be consistent

with the group nature of the interest and the enjoyment of the land by future generations.”

That’s not land ownership in the fee-simple sense of the term.

It locks in communal ownership, which I and many others have argued is at the root of the poverty seen in many aboriginal communities.

Another big question: Is there any future for B.C.’s 20-year-old treaty process, or will this precedent-setting case send more First Nations to court, or to the barricades as the Tsilhqot’in did on a logging road in 1983?

One of the unique advantages that have

emerged from the handful of modern treaties in B.C. is that aboriginal communities have more options in land ownership. By voluntary agreement, they can convert land to fee-simple ownership, making it available for mortgage or sale.

Modern treaty holders also get out from under the federal Indian Act, which remains in force despite this latest decision.

One of the big questions asked in the days after the Tsilhqot’in decision was this: Is the Northern Gateway pipeline project dead?

None of the aboriginal communities along the pipeline route has

this kind of declared aboriginal title. Few if any would have a similar strength of claim as the Tsilhqot’in, who fought a small war to defend their territory from a wave of gold seekers in the 1860s.

One that does is the Haida Nation, whose occupation of a beautiful group of islands was long defended militarily, and never challenged by any other aboriginal group.

Among others, the Haida Nation was represented in the Tsilhqot’in case as interveners. Council of the Haida Nation president Peter Lantin said after the decision that his team is preparing

its own aboriginal title case for trial.

Few doubt that this assertion of title will be successful, either by negotiation or court ruling. But there is a unique aspect to the Haida claim that would set another precedent.

They claim title to the ocean around Haida Gwaii, a challenge to anyone wishing to sail tankers through.

In 1997, Karin was honoured by her Chamber colleagues around BC when she was presented with the Gerry Frederick Memorial Executive of the Year Award. And in 2011, the Cranbrook and District Chamber of Commerce was named “Chamber of the Year” by the BC Chamber of Commerce.

Karin’s 30 years of inspiring community contributions were celebrated last December in a special Chamber luncheon and by Mayor Stetski and Councillors during a January 20th City Council meeting. This year, Karin is working with the current Chamber Board to

make the Chamber even more relevant to more businesses. Through Karin’s leadership, the Chamber is on track to reach a total membership of 500 area businesses by the end of 2014, with many new networking and professional development opportunities coming on-stream.

We’ll have more information available soon on what will be a very exciting opportunity for an individual to take on a key leadership role in our community, building on Karin’s legacy.”

Dental assistant program sees new milestone Submitted College of the Rockies’ Certified Dental Assistant program is marking a new milestone as students graduate from the program for the 30th year.

The Certified Dental Assistant program, first offered in 1983, has evolved over the past 30 years to match innovations in dental practice. The program provides access to a modern clinic with a digital radiography computer, a panoramic x-ray machine, a sterilization area and more, all which help prepare students for a real-life work environment.

The spring dental clinic, which sees 400 patients from the community, ensures students receive an abundance of practical experience – more than they could hope to receive at a larger institution. Many of the patients seen in the spring clinic are longterm repeat customers who have access

Matching funds for new bed

A new bariatric hospital bed will soon be making its appearance at the Swan Valley Residential Care Facility in Creston thanks to the coming together of two foundations.

The Creston Kootenay Foundation and the East Kootenay Foundation for Health decided to provide matching funds ($10,000 each) for a total of $20,000 to purchase the bed.

The Creston Kootenay Foundation selected the project as part of its annual community foundation grant giving evening while the health foundation allocated its

portion of funds from the Estate of Olga Kramer, a long time resident of the Creston Valley.

This is the third time that the two organizations have committed to partner funding.

Heather Suttie, Chair of the Creston Kootenay Foundation explains, “This is so very exciting and it is so good to have a partner like EKFH that has the best interests of Creston in mind. I predict that our Foundations have much more history to create together.”

With obesity trends on the rise, healthcare providers must be ready to

provide care for patients of size while keeping them safe and comfortable at the same time. A bariatric bed offers protection to patient’s skin, provides a wider and longer sleep and resting surface while allowing health care workers to deliver better care without compromising patient’s dignity.

“What an honour to be in Creston to receive this co-funding grant from the Creston Kootenay Foundation.

harvest, local farmers will be loading up their market tables for eager Kimberlites to pick up some local flavour. But there will be much more than just veggies to be found at the Farmers’ Market, including eggs, meat, and honey, plus bread and baked goods, and all kinds of local crafts and artisanal products. Of course, there will be hot food vendors serving up dinner and plenty of sweet treats.

The market will run from 5-7:30pm every Thursday until September 11th. One block of Howard St, just up from the Platzl, will be closed for the market every week.

Shoppers will want to arrive for 5pm to have the pick of the crop and to catch the farmyard flair of the special market opening ceremony.

“Response from local area vendors, downtown businesses, the CIty of Kimberley and the community at large has been 100%

positive, and we are all looking forward to Kimberley hosting its own Farmers’ Market!

Twenty-five vendors are signed up for our inaugural market this week, and we look forward to a great season,” said Wildsight’s market manager Erna JensenShill.

The mantra for the market is “make it, bake it, or grow it” and that means everything on offer is created by a local artisan, made by a local baker, or grown or raised by a local farmer.

For market shoppers, that means tasty, fresh, nutritious food, direct from the producer. For producers, that means a connection with their customers and a fair, direct price for their products. For the community, the market is a place to gather. Eating local food has environmental benefits too, as produce need not be shipped long distances, and many market producers are organic or otherwise limit their

impacts.

“The Kimberley Farmers’ Market fits right in with our focus on food sustainability,” said Wildsight’s Jessica Windle. “It’s all about growing and eating our food in a way that sustains the planet and our community.” Wildsight’s Food Sustainability program also includes the new shared Open Gate Garden, the Edible Garden workshop series to help local gardeners grow their own food, kitchen workshops focused on preserving local food for our long winters, their long-running Apple Capture project, and a focus on composting to turn kitchen scraps into food for the next year’s crop.

“We would like to thank the members of the advisory committee and all of the volunteers who are working hard to bring this market to Kimberley,” said Jensen-Shill.

St. Aidan Orthodox Church Slugs: To both parties that seem to both be willing to put up rock walls between them and neither side seems to want to give and take to work at a solution. I am not saying one side is any better than the other but they both have the same thing in their statements, that it is the kids that we are fighting for and that being said I must say that using the children in the manner in which you are to me is wrong. It is like a hostage taking and the only difference is the kids are home and not held at school, so change your signs both sides and take the children out of it because this has gone on too long. I hope that this dispute has a quick end so children can go and do what your signs say -- “go to school” Slugs: To the dirt bikers in the Sam Steele Parade who performed dangerous wheelies and stunts in a congested area within 2 meters of toddlers. There are only two kinds of dirt bikers: those who have crashed and those who will crash. Imagine your bike piled on top of some kids.

Unfortunately you were the last act of the parade and left behind a bad impression, ringing eardrums and smelly fumes.

Slugs: Many slugs to the thoughtless person who drove up 12th Ave S & dumped grass clippings along the side. Did you not know that there is a place for this stuff at the Transfer Station? Shame on you! Who do you think is going to clean that up?

Slugs: Thumbs down to the folks that pulled out all the flowers outside the Bank of Montreal, seriously??????? Can’t people just leave the landscaping that businesses do alone!!!! We do it for a reason, to keep our businesses looking nice and you go and ruin it for everyone!!!

Hugs: A huge hug to my daughter, who needs one lately, due to other people dragging her into their dramas and making her life miserable.

Slugs: Many giant, slimy slugs to people who drag innocent people into their dramas. More of those slugs to people who ask others to alter the truth to save their own behinds. You people all deserve each other and don’t deserve those you’re hurting with your actions. Hopefully you

all plan to grow up one day but until then, shame on you!

Hugs: Big hugs to the old fella on June 25th, who stopped traffic in both directions on the strip in front of the Chamber of Commerce, to allow a Mama duck and her 8 babies to get across the road safely. He rounded up the little ones and made sure they made it across. Nice job buddy!! It put a smile on everyone’s face!

Slugs: To the clown 3 cars back who was honking his horn because traffic was stopped. If you are in that much of a hurry, and can’t enjoy what this area has to offer…..move!

Slugs: To the two people on pedal bikes Thursday evening (June 26) in Kimberley who thought they would let their dog run alongside them off a leash and chase the deer that was laying under the tree minding it’s own business. First of all, dogs are supposed to be on a leash at all times while walking around town. Secondly, if you know your dog doesn’t listen to you and chases wildlife like that, why is it off leash where you know you might encounter a deer? Don’t go blaming the deer if your dog gets attacked by a protective doe with a fawn!!! It’s people like you who are the cause of things like that.

The deer are not to blame.

Hugs: To the person who wrote a slug about cyclists riding on Baker St. Would like to add, that as a cyclist I will make an effort to dismount before getting on the sidewalk. I would encourage other cyclists to do the same.

Hugs: To the man with his dog picking up garbage on Victoria Ave. Would be nice if the city would put garbage bins along the route so we don’t have to walk so far to dump it.

Slugs: To the lazy dog owners who walk their dogs on the Overwaitea hill in Kimberley and let them poop on the path and then do not pick it up. As responsible dog owners/walkers we take offence to this.
