Paul Cipywnyk, of the Byrne Creek Streamkeepers, measures the temperature of Byrne Creek. He’s worried the closure of federal libraries could mean the loss of data collected by the Department of Fisheries and Oceans over the years that is valuable to environmentalists and naturalists to determine the health of waterways.

And while the government says few people used the libraries, he noted that researchers must apply for access and can’t simply walk in. Libraries being affected include those for the Department of Fisheries and Oceans, Environment
Canada and the Canadian Food Inspection Agency. Streamkeepers are “citizen scientists” trained to help assess the health of local creeks and waterways, Cipywnyk said. Without hard data in government records about the environment, “then you can make whatever policies you want, it’s not based on anything scientific.” With a background in history, Cipywnyk called the destruction of documentation “frightening” and “very disquieting.” Please see CORRIGAN, A16

BurnabyDouglas NDP MP Kennedy Stewart managed a rare accomplishment Wednesday when his electronicpetitions motion was passed in the House of Commons by two votes. “That was a nail biter for sure!” Stewart tweeted shortly afterwards. It’s rare for private member’s motions to pass, particularly for opposition members. But Stewart managed it by securing the votes of several Conservative backbench MPs, whose own private member’s motions on democratic reform he agreed to support. In the end, MPs voted 142 to 140 in favour of Stewart’s motion, which calls for Parliament’s Procedures and House Affairs Committee to look at his idea for e-petitions and report back within 12 months. Council questions cleanup response Wanda Chow
wchow@burnabynewsleader.com
Burnaby council is questioning the optics of CN Rail hiring the firm that’s planning the environmental cleanup following a train derailment and coal spill earlier this month. On Jan. 11, a Canadian Pacific train travelling on a CN line derailed near Government Road and Brighton Avenue, resulting in the spill of 40 tonnes of metallurgical coal along the embankment and into Silver Creek, said a city staff report. CN, which is responsible for the cleanup, retained Triton Environmental Limited to develop the work plan for remediation of the spill. “I think most average people are quite surprised that the company who does the damage is permitted to hire the company that will advise on how much money should be spent to undo the damage,” said Mayor Derek Corrigan at Monday’s council meeting. He suggested the consulting firm’s “first duty is to the company that hires them or they won’t get hired again,” Corrigan said. Coun. Nick Volkow also questioned why the provincial environment ministry has not been vocal in addressing the fact the coal

landed near a western painted turtle nesting site. He recalled that during the dredging of Burnaby Lake, the city incurred $3 million in additional costs after the ministry demanded more be done to ensure the endangered species were not harmed. Burnaby city hall ended up buying an Italian ground-penetrating radar system to track where the turtles were going and what they were doing. “What we learned are turtles
aren’t that stupid. When dredging machines show up they scurry away to the little creeks on the side of the lake and they wait out the dredge,” said Volkow. “Well all of a sudden we’ve got CP dumping a whole load of coal on a nesting site and I haven’t heard a peep from the provincial ministry of the environment.” The B.C. environment ministry said in an emailed statement that it will review the report of the environmental consultant hired by CN when it is completed.
The rail company has submitted a preliminary work plan to the ministry outlining how it will assess and document areas where residual coal was deposited in Silver Creek, Burnaby Lake and the Brunette River. “Information from the assessments will be used to consider the feasibility and practical effectiveness of potential remediation measures,” the ministry said. As for the western painted turtle, their recovery is the jurisdiction of the Ministry of Forests, Lands and Natural Resource Operations while the Ministry of Environment has jurisdiction over the cleanup and water-quality testing. “We are working together with CN’s environmental consultants to identify and protect sensitive turtle habitat and reduce the likelihood of direct mortality to overwintering adult and juvenile turtles,” the environment ministry said. “The risks to the turtles and their habitat are associated with both the spill itself and its associated remediation efforts. We have identified the need to both restore any disturbed habitats and monitor the habitat and turtles during and after remediation.”
Too early to tell impact of schools court decision Second time province’s position deemed unconstitutional Wanda Chow
wchow@burnabynewsleader.com
The B.C. Teachers Federation (BCTF) may have won round two in its court battle with the education ministry, but the fight is likely far from over, says the Burnaby Teachers’ Association (BTA). “Obviously teachers are thrilled at the decision because it’s something that’s been hanging over our heads for 12 years and of course it did start with the now-premier who
was then the education minister,” said BTA president James Sanyshyn. In 2002, the ministry removed the limits on class size and composition that had been negotiated in an earlier contract with public school teachers, and ended their ability to negotiate for such measures. But it wasn’t until 2007, when the Supreme Court of Canada ruled that it was unconstitutional for the province to tear up its contract with the BC Hospital Employees’ Union, resulting in the privatization of services and thousands of layoffs, that the BCTF had a
precedent to work with for its own case. In 2011, BC Supreme Court ruled the ministry’s similar actions against the teachers’ contract was unconstitutional and ordered it to rectify the situation within a year. But earlier this week, the court decided the new legislation was no different from the one struck down earlier and that the province had even been attempting to goad the teachers into striking so Victoria could gain politically by legislating them back to work. The judgment also ordered the province to pay the BCTF $2 million in damages. Please see TEACHERS, A9

A pedestrian is recovering from non-life-threatening injuries after being struck by an SUV in a hit-and-run incident Tuesday morning. At about 7:45 a.m., a woman was crossing from the south side of Canada Way to the north side around Smith Avenue when she was struck by a westbound SUV, said Burnaby RCMP Sgt. Dave Bell. The female driver fled the scene but reported the incident to police shortly afterwards and has since been interviewed, Bell said. The pedestrian was actually jaywalking at the time, he noted. People from nearby businesses called 911 and she was taken to hospital where she was to stay overnight after being treated for cuts to her head. The driver has been issued a ticket under the Motor Vehicle Act for failure to remain at the scene of an accident, which comes with a hefty $368 fine. As for the pedestrian, to add insult to injury she was ticketed too—for failing to use a crosswalk, a violation that carries a $109 fine.

ADRIAN RAESIDE:
QUESTION OF THE WEEK:
Sizeable ruling A court decision on Monday awarding the B.C. Teachers Federation $2 million in damages, and ordering a return to class size and composition provisions in a teachers’ contract from almost 15 years ago, is almost certain to lead to political strife. Some estimates suggest the cost of the judgment to taxpayers could total $1 billion. If that indeed is the case, the provincial government is almost certain to appeal, as Premier Christy Clark hinted on Tuesday. The ruling by B.C. Supreme Court Justice Susan Griffin speculated (because there is no hard evidence on the record, due to cabinet confidentiality) that the provincial government deliberately stalled on renegotiating the class size and composition provisions with the BCTF in 2011. Griffin was the author of an earlier court ruling calling for new legislation within a year. In her ruling, she stated “(Negotiators’) strategy was to put such pressure on the union that it would provoke a strike by the union. The government representatives thought this would give government the opportunity to gain political support for imposing legislation on the union.” Nothing else in the lengthy ruling, other than a suggestion that cabinet documents back up this assertion, offers any proof. Those cabinet documents have not been released, but were used as evidence in the trial. The class size and composition provisions were inserted in a contract imposed by the former NDP government on school boards. There is no doubt that if classes are too large, it has an impact on how students learn. But hard and fast limits, imposed by a judge, will be costly to taxpayers, and have limited benefit for students. – Langley Times/Black Press

The family physician dilemma I had a doctor’s appointment earlier this month. Time for my post-40 physical. Even though I had an appointment, I was made to wait a couple hours. As frequently happens—because my doc delivers babies too—she was out bringing new life into the world. Frustrating. Even when she returns she’s rushed, trying to catch up. And I’m lucky. According to A GP for Me, an initiative of the provincial government and the BC Medical Association, approximately 176,000 people in B.C. don’t even have a family doctor. My bet is that number is actually much higher, but regardless, A GP for Me aims to fix that. For now, many people just go to the walk-in clinic and get whomever is on duty. From my experience, the service is curt, and a far cry from what you’d get when you see the same person, year-in, year-out. Dr. Baldev Sanghera, a local family physician, agrees. A family doctor provides continuity and a consistent
Chris Bryan editor@newwestnewsleader.com
connection that helps the patient stay healthy between visits too, says Sanghera, who is the lead doctor in the Burnaby Division of Family Practice, which represents almost all family doctors in Burnaby with the goal to support local doctors to benefit the whole community. The group is also the local lead on A GP for Me, and is in the process of surveying residents and medical professionals to find ways to boost the number of family doctors and the amount of patients served. It’s important, Sanghera says, because people with a family doctor are healthier and put less stress on the medical system. Even if you’re just in the office with a bad cold, he says, it’s a chance to receive coaching on healthy lifestyle, stress reduction and the need for strong relationships. “We know stressful lifestyles

make people sick,” he says. “We’re coaching as well as treating and diagnosing.” So what has caused the family doctor shortage? Sanghera says women becoming family doctors has led to a “more sensible” idea of full-time work. They’ve pursued a more family friendly 35- to 45-hour work week instead of the 60-70-hour weeks common in the past. A positive development, he says, but it also means less service from the same number of doctors. The health care system shifted too, from a focus on primary care through family physicians to a greater emphasis on specialists and acute care. Med school teachers today are usually specialists, and students tend to gravitate the same way, Sanghera says. And with the costs of training rising, students seek areas with better earning potential (read: specialization) to pay hefty student loans. Though family practice often pays less, the training costs the same. But if the A GP for Me initiative succeeds, everyone

wins, Sanghera says. “We’re all coming to the same realization that things can’t continue the way they have. The only way to reduce the cost of health care is to keep people healthy—and there’s lots of things we can do to help people achieve that.” Sanghera says they plan to release the full results of their consultations in June. The goal is to recommend workable solutions that provide lasting results. “We want to align all the information we get and come up with a full, comprehensive plan.” Ironically, despite my frustration with long waits at my doctor’s office, Sanghera says she is going above and beyond, adding he stopped delivering babies 10 years ago due to the stress of running his office simultaneously. “She’s one of our heroes—she’s trying to do all she can. The rest of the people can wait, the baby won’t.” And he says the best way to improve my satisfaction is to improve her work life. “The system needs to provide her more support, and more physicians.”

COMMENT
Canada’s public health care future in jeopardy The future of public health care in Canada is in serious jeopardy. A health care crisis is looming because of decisions being made by the federal government. Unfortunately, this looming crisis is flying below the radar. Few seem to pay attention to what will bring an end to public health care as we know it today. In a world where we seem to be moving from one crisis to the next, it seems the public has become desensitized to issues that are not affecting them in the here and now. Decisions being made today will lead to a gradual deterioration of Canada’s public health care system. If the Canadian public allows the federal government to continue on its current path our health care system will become vulnerable to things like for-profit medical services or a multi-tiered health system this is defined by a person’s ability to pay. Canada is facing an important next step in our medicare history. In 2014, the current health care accord deal that sets funding and health care service delivery agreements between the federal and provincial and territorial governments expires and must be renegotiated. The federal government is ignoring the calls of the provinces and territories to work on a deal, and shockingly announced $36 billion worth of health care cuts which will come into effect after the next federal election in 2015. The provinces and territories will thus be forced to reduce health services, increase taxes, and/or privatize services; health care will vary widely across the country. In December 2011, the federal government unilaterally announced a withdrawal from anything but a reduced financing role: in 2017 the transfer of health care funds will be cut from the current annual six per cent increase to a percentage pegged to the GDP, with a guarantee base of three per cent. This is a time of an aging population and an increasing demand for health care services; unless transfer funding is stable and certain our cherished public health care system is in danger. Unless a new health accord is re-negotiated to establish community health centres and to include universal home and palliative care, health services cost
will continue to skyrocket; and elderly Canadians will continue to suffer, facing the end of their lives in unfamiliar environments while society pays billions for their care. More than 94 per cent of Canadians believe health care is a core social right, a symbol of Canada as a compassionate and caring society. Canadians want governments to work together to share information about how to best deliver public heath care and to ensure that every Canadian has equal access to quality care provide by a national, public system. The federal, provincial, and territorial governments need to negotiate a new health accord that protects and strengthens our universal public health care system. Our elected representatives need to advocate for a new accord and stop the federal government from undermining our health care system by refusing to come back to the bargaining table. Each of us needs to stand up and demand the federal government negotiate with the premiers to ensure every Canadian has access to quality health care services as needed. Rennie Maierle Burnaby
REFERENDUM CONUNDRUM During last year’s provincial election Christy Clark promised that any new funding for TransLink would be decided by a referendum held in conjunction with the 2014 municipal elections. It was a bad idea then, it’s a bad idea now. There is a body of opinion that government should not govern by referendum, that it’s purpose is to decide complex issues like taxation. Indeed, the BC Liberal government endorsed this view after it lost the HST referendum. So why the change of heart? We’re told the objective is to provide voters the opportunity to have a say about the preferred way to raise additional money to pay for TransLink projects. The options, however, appear rather limited: a new tax or an increase in an existing tax or a combination of both. The wording of the question hasn’t been decided yet, but it doesn’t take a political analyst with an economics degree to figure out
that it will beg the answer: “No. No more taxes, No increase in taxes.” People are like that. Hell, sometimes I’m like that. So, let’s say the referendum fails to “find” additional money for TransLink projects. What then? Well, the 76-year-old Pattullo Bridge will still need to be replaced. Light rail project plans will be filed away. Bus service wont be improved . And generally the on-going development of an efficient transportation plan for the region will suffer a major set back. On the other hand, maybe the majority of voters will agree to more taxation to ensure that doesn’t happen. But really, Premier Clark, is it worth the risk? Bill Brassington Burnaby

CANADA POST CASE NOT PROVED Adrian MacNair, in his opinion piece on Canada Post, says the Crown corporation is facing declining mail volumes and is on pace to lose $1B by 2020 (six years from now). And yet he advocates selling Canada Post to private sector investors. Who would invest in such a moneylosing enterprise? Or does he think the key to profitability is to get rid of the public sector union that he says refuses to make “reasonable” concessions? As for driving “even more people to e-commerce,” how is that germane? And how does he think those orders get delivered? By private services, to be sure, but also quite often by Canada Post--the same service that still handles huge volumes of parcel mail at Christmas time. He notes the current British government has privatized (60 per cent, actually) the Royal Mail. But that happened only a couple of months ago, hardly a blueprint for success at this point. As well, mail delivery in the United Kingdom does not have the same geographic challenges as it does in Canada. Case not proved, M’Lud! Véronique Boulanger New Westminster

HOW IT WORKS
Low Intensity Laser Therapy (LILT) is a highly sophisticated, non-toxic and non-invasive therapy that uses light energy from both superluminous and laser diodes. When placed in contact with the skin, this energy safely penetrates the tissue. At an intracellular level, the light is transformed into biochemical energy. Cells use this energy to repair and regenerate themselves, enhancing the body’s natural healing process.
WHO CAN BENEFIT?
Covered by most extended health care plans!
BioFlex Low Intensity Laser Therapy is an effective solution for musculoskeletal injuries, chronic and degenerative conditions, dermatological problems and the healing of open wounds. BioFlex therapy can safely increase the rate of recovery and help patients reduce the need for pain medication. BioFlex also has the ability to promote rapid recovery post surgery. The beneficial effects of LILT are cumulative over the course of a series of treatments.

‘Teachers spread thin’ ⫸

continued from PAGE A3
“Now 12 years later, basically the length of a child’s education, we can see for example in Burnaby, we’ve got over 400 classes that have three or more special needs students in them,” Sanyshyn said. In the past, under the previous teachers’ contract language, no classes would have had more than two such students, he said. Today, some have as many as seven or eight who would potentially require greater attention from teachers. “At the end of the day [teachers are] spread pretty thin.” Sanyshyn said the teachers know that it may still take time to see any tangible gains from the decision, such as funding for more teachers to lower class sizes. For one thing, the province will have about a month to decide whether or not to appeal, something Premier Christy Clark had suggested in media reports they were leaning towards, he noted. However, as far as the BCTF is concerned, the decision means the current contract negotiations will have the contract that existed in 2002 as a baseline. “If [the province has] any expectation of not honouring that we expect them to come with counterproposals,” he said. And concessions the ministry was hoping to achieve from the contract currently in place may no longer be feasible. “They may have to rethink their strategy because that could jeopardize their appeals process.” Sanyshyn stressed that school boards won’t be able to find the savings needed to restore class size and composition to 2002 levels, so the expectation is that the education ministry would have to come
up with the money. He added that funding in B.C. is now $1,000 lower per public school student than the national average. Among provinces, only Prince Edward Island funds at a lower level. Burnaby school board chair Baljinder Narang said it’s too early to know what the impact of the decision will be. “It’s a significant decision and it’s going to have some kind of impact but how it’s going to play out, I would be second-guessing if I said anything.” Ministry of Education spokesperson Ben Green said the ministry is carefully reviewing the 150-page decision, including whether to appeal. “The ministry is obviously going to continue to work with the BCTF in pursuit of a long-term labour agreement and long-term labour stability, but at this time it’s too early to determine what the impacts will be,” Green said.

Ruling may be appealed: Premier The B.C. government is considering an appeal of a B.C. Supreme Court ruling that rejects legislation restricting teacher bargaining and assesses a penalty of $2 million plus court costs. “It doesn’t reflect government’s view of the case and the facts in the case,” Premier Christy Clark told a Kamloops radio station Tuesday. Education Minister Peter Fassbender said he is “disappointed” by the ruling, and ministry staff will study it before deciding on a possible appeal. Fassbender said he disagrees with the judge’s conclusion that the government tried to provoke a strike by reintroducing provisions that had been struck down by the same judge. “What we need to do is to review the judge’s ruling in detail to see what the implications are, but clearly my message to school districts, to parents, is it’s business as usual in our schools,” Fassbender said.

One bad Durango in a good way The 2014 Dodge Durango test truck was the perfect Christmas treat. This is the perfect kind of vehicle to have when you need to cart around extra kids and family from events like skating parties to Christmas dinners to anything else that needs getting done over the festive season. With three rows of seats and seating for six or seven passengers, the Durango is a large comfortable vehicle for any large family or a family of four that needs to take extra people to soccer or hockey practice. The Durango tester was the top of line Citadel model with a beautiful two-tine interior, large polished wheels and classy looking grille. It was not fitted with winter tires but we had no skiing plans, plus all Durango models come with AWD as standard equipment. Looks I can’t remember the last time a large SUV turned heads but this model had passersby, friends, and family all taking notice. Several neighbours commented on the stylish “racetrack” rear light bar that has migrated from the Dodge Dart and Charger sedans to this big SUV for 2014. Because of standard AWD and other packaging changes, the starting price is higher than direct competitors, the Ford Explorer or Nissan Pathfinder. Both those vehicles have a base model that starts around $30,000, the Durango, in contrast, starts at $39,995 and tops out at $51,995. This Citadel model, with options, is over $60,000. The base model comes nicely equipped with 18-inch wheels, keyless entry and
Bluetooth streaming to name a few. Dodge believes the $43,995 Limited model will be the volume seller thanks to a backup camera with sensors, heated seats over the first two rows and a higher level of interior trim.

I tried my hand at this but never its legs on the open road that number really mastered it. The biggest selling would have been much better. Handling point for the Durango is the amount of space it offers over three rows for 6 or 7 passengers. My youngest son loved climbing into the third row and could actually stretch out. I even tried it out and can report that adults have plenty of room in any seat. The Citadel model came equipped with a stunning two-tone interior featuring black carpets and tan seats. This contrast won over my wife who wouldn’t have looked twice at a Durango but after the first week she admitted how much she enjoyed the experience. If you

Verdict This latest Durango is yet another example of what Chrysler is doing right. It is loaded with the latest technology, has a class leading 8-speed automatic, attitude and room to spare. I enjoyed my entire time with it and so did the rest of the family, we even gave it a name, “The Badongo” I don’t know why, but it really is one Bad Durango. If I can read the tea leaves for a moment, I would bet the EcoDiesel will be coming to the Durango, hopefully sooner rather then better. Stewart is proposing a system in which an hour of Parliamentary debate would be triggered if a significant number of signatures, 50,000 for example, are secured on an e-petition that’s also sponsored by at least five MPs, as STEWART a way to encourage public involvement in the democratic process. Currently, Canadian residents can only submit printed petitions with 25 or more signatures to their MP, who then submits it to the House of Commons. NEW HOME DEVELOPMENT
Vancouver’s top chefs will demonstrate their signature recipes, from barbecue to comfort food. Urban Fare will also present Chopping Block on the 22nd, with four home chefs competing against each other to emerge victorious. Some of the must-see features at the show will be the Ask an Expert space, where interior decorating experts, professional landscapers and certified contractors will give homeowners and renters alike free 10-minute consultations on solving their home problems, and the West Coast Power Smart Home, this year’s Dream Home that showcases green living and modern
West Coast design. If gardening is one of your interests, you’ll enjoy the Living Melodies display, with more than 7,000 square feet of green space with flowers, water and stone features and outdoor furniture, inspired by famous music. The Better Gnomes and Gardens event brings well-known Vancouver residents such as Real Housewives of Vancouver’s Mary Zilba, Love It or List It Vancouver’s Todd Talbot and Global BC’s Steve Darling together with a very popular garden decoration: the gnome. The participants will decorate their own garden gnome and auction them off, with proceeds going towards Sole Food Street Farms. There will also be a spot to sit and have some tea at The Twinings English Tea Garden, or take in some fashion and art at Portobello West, inspired by London’s famous street market. To celebrate Chinese New Year, the next eight buyers of G3’s Phase 2 homes will be able to choose a lucky red envelope that will reveal a discount ranging from $6,888 to $8,888 off the purchase of their new home, which will be ready for occupancy in March.
Beauty comes in threes at Guildford’s G3 By Kerry Vital
Three is a lucky number at G3 Residences, an exciting condominium development in Surrey’s Guildford neighbourhood that features three buildings with a wide variety of floor plans, suitable for the needs of all discerning buyers. Right now, there is an exciting offer at G3! To celebrate Chinese New Year, the next 8 buyers of G3’s Phase 2 homes will get to pick a lucky red envelope that will reveal a
discount ranging from $6,888 to $8,888 off the purchase of their beautiful new home, ready for move-in March 2014! There are numerous benefits for being a G3 Residences homeowner. For one, this residential development offers its buyers ultimate convenience. Its location is key, central to the blossoming Guildford community. Buyers have easy access to the Port Mann Bridge, giving them quick entry into neighbouring areas of the Lower Mainland. As sales manager, Margaret Bird says, “the quality here is excellent … it’s been especially appealing to first-time buyers. We’ve seen a huge draw from Fraser Heights with parents wanting their kids to live nearby. You’re within walking distance to so much.” One of the most impressive things about G3 Residences is the beautiful views from some of the homes. “From the north-facing
homes you can see the (North Shore) mountains,” says Bird. “From the east-facing homes, you can see Mount Baker and that area. It’s gorgeous.” As completion nears, Bird points out that many of the floor plans available now are unique. “They’re one-off plans where they’re the only one in the building,” she says. Additionally, within walking distance to G3 is the newly renovated Guildford Town Centre, the Guildford Recreation Centre inclusive of a public library, fitness centre, and soon-to-be an aquatic facility, restaurants, and schools. The interior details of these homes are also contributors to their popularity among home buyers. These beautifully packaged homes come equipped with stainless-steel appliances, quartz countertops and an eating bar perfect for a quick breakfast or evening cocktail party. Soft-closing cabinetry with brushed
nickel hardware is perfectly lit by the ceiling mounted track lighting and pendant lights. Laminate hardwood flooring is featured throughout the living areas, with lush carpeting in the bedrooms and imported porcelain tile in the kitchen, entry and bathrooms. The bathrooms are elegant and luxurious, with a deep soaker tub, semi-frameless glass shower and chic wall-mounted vanity light. Homeowners can still choose between two designer colour schemes, Sterling and Onyx, and will enjoy the nine-foot ceilings (higher on the top floor) and convenient frontloading washer and dryers that come with every home. Oversized storage and parking is also included. Residents will also have access to the G3 residents’ lounge, which will include a gym, fireside lounge and a guest suite, among other things The bathrooms are elegant and luxurious, with a deep soaker tub, semi-frameless glass shower and chic wall-mounted vanity light. G3 Residences is truly a balance between contemporary lifestyle and affordability. Available homes start at $149,900 for a studio, $182,900 for a one-bedroom and $223,900 for a two-bedroom. Take advantage of the limited time Chinese New Year offer and visit the G3 showroom at 10439 154th Street, Surrey, open every day except Friday between noon and 5 p.m. to pick up your lucky red envelope!
