Jose Figueroa will be able to spend Christmas with his family without the worry of being forcibly deported, after a court ruling on Tuesday stayed his deportation order until January.

Figueroa’s deportation order has been stayed until Jan. 15, 2014, when there is a scheduled judicial review hearing for Figueroa, with a motion asking that he be allowed to stay in Canada on humanitarian or compas-

sionate grounds.

Figueroa got the news of the court decision while in sanctuary in his Walnut Grove church, where he has spent the last three weeks avoiding arrest and deportation back to El Salvador.

His lawyer Peter Edelmann was in federal court in Vancouver pleading Figueroa’s motion to stay the deportation order.

“I am a little bit happy but there is still a lot to do,” said Figueroa.

When word got out in June, 2012 that Langley Township planned to sell a forested area of Glen Valley to help pay for the Aldergrove pool project, local residents responded with a campaign and delegations to council.

They also issued photos of the forested area. This one shows Jada next to one of the large trees on the property, which has now been turned into a park, by council resolution.

A Langley Township forest that was going to be sold to raise money for a new Aldergrove recreation centre will now be preserved as a “Municipal Natural Park.”

Mayor Jack Froese announced the decision at the Monday night meeting of council, saying it was decided earlier in the day during a closeddoor meeting, The designation of Glen Valley’s McLellan Forest West municipal parkland covers 25.75 acres of wooded land on 84 Avenue between 252 and 254 Streets, a site that includes 80 to 100-year-old conifer trees.

“We’re kind of closing a chapter,” Froese said.

The forest was part of nearly 50 acres of Township-owned land that went on the market in 2012 to pay for construction of a new recreation centre on the five-acre site of the former Aldergrove Elementary

School on Fraser Highway.

McLellan Forest West was taken off the market a few months after the sale plans were made public.

The remaining forested lands, the Gray Pit Lands between 257A Street and 260 Street, remained on the market until it was purchased by Trinity Western University this year, with the assistance of a $2.5 million donation from the family of the late Thomas Blaauw.

A press release issued by the mayor on Tuesday noted Langley Township is also home to 4,665 acres or 7.3 square miles of municipal and Metro Vancouver parkland.

“We have a lot to be proud of,” Froese said in the release.

The construction company involved in the fatal Highway 1 crash in Langley where Mandeep Singh Aujla died has come out with a statement denying any wrongdoing on the foggy Oct. 22 night.

Jake’s Construction writes “precautionary safety measures were in place at the time of the accident. We have a reputation of being a very safe company and all our business practices reflect this.”

Jake’s Construction goes onto say that false allegations have been made against the company. it says it has no record that calls were made by other road maintenance crews warning their crews to move to the shoulder or halt work altogether because of the fog.

Jake’s Construction doesn’t

say what safety precautions were made that night but said they are always followed. They have an A+ rating from the Better Business Bureau.

Meanwhile, Lower Mainland RCMP confirm that a 911 call was made by a distressed driver who claimed he almost drove into the highway crew just hours before the deadly crash occurred.

The truck driver claims he told 911 dispatch that he was forced to veer out of the way just at the last minute, after seeing the construction crew working in the fast lane of the freeway.

RCMP Sgt. Peter Thiessen confirms the call was made and said it normally would be passed on to the ministry of transportation, but for some reason that didn’t happen.

He confirmed that police are

looking into where the communication breakdown took place and why.

The fatal crash took place about 3:50 a.m. The initial investigation indicates the driver of the Toyota RAV4 was travelling eastbound along Highway 1 when it slammed into the rear of a construction vehicle, which was parked in the passing lane of the highway.

The SUV burst into flames and Aujla, who is from Abbotsford, died at the scene.

The crash took place just west of the 264 Street overpass.

Roadwork along that portion of Highway 1 has been underway for months, as the freeway is being widened from two to three eastbound lanes. Work regularly takes place in the overnight hours, to reduce traffic congestion problems.

Fort Langley Residents for Sustainable Development, which launched the successful lawsuit against Langley Township over the Coulter Berry building in Fort Langley, has hailed the court decision, but it also expects an appeal.

“Although we were surprised Justice (Joel) Groves issued his verdict immediately following the two-day hearing, we had anticipated he would see the merits of our case,” the directors of FLRSD stated in a press release issued after they met Tuesday.

“We believe Justice Groves decided to issue his decision immediately in an effort to respect the importance of the decision to our society and many of the residents of Langley and Fort Langley, but also in an effort to spare the developer any further costs or hardship in proceeding any further in constructing the Coulter Berry Building with an invalid permit.

“Our fight was never with the

developer; it has always been with the Township of Langley. We have empathy for the predicament this has left the developer in. The Township should have never issued a heritage alteration permit for this development, and acted outside of their legal jurisdiction in doing so. It is important to note that this improper action was taken by the Township, not the developer.”

The society expressed the wish that the Township respect the court decision and “work with the developer to have a project that represents the community, respects its heritage and scale while also respecting the needs of the developer.

“We hope that the developer considers a two-storey building with many of the same features and benefits, but at a reduced scale, more in keeping with the existing streetscape and heritage guidelines.

We believe our society and the community would fully support this.”

The press release went

on to say that the society is “well-prepared for an appeal should one come.”

It noted that the Township has the ability to appeal the decision.

The written judgment by Justice Groves is not expected for several months. The Township has said it is awaiting that judgment, and in the meantime is discussing its options with staff and its legal counsel.

The society says it will await that response, before deciding on its next move.

In the meantime, work on the project has been halted.

Excavation work has been done under permit, but developer Eric Woodward of Statewood Properties does not have a building permit, and does not expect one until the legal situation has been resolved.

Langley Township council did not discuss the judgment at its open meeting on Monday, although it was almost certainly discussed in its afternoon closed session.

Residents argue the smaller lots will erode the character of their community, increase traffic and drive down property values.

Councillor Grant Ward agreed with the residents’ concerns, saying the proposed development was going into a “highend location” of roomier lots and larger houses.

Most members of council appeared to favour fewer and larger lots for the acreage, with Councillor Charlie Fox saying he would be happier with four lots on the site rather than six.

Township staff have been instructed to open talks with the developer about voluntarily reducing the number of lots.

Langley Township council has put the brakes on a controversial proposal to redevelop a large Walnut Grove lot into six smaller lots.

On Monday, Oct. 28, council postponed a decision on a developer’s application to rezone the one-acre parcel at 204 Street and 93A Avenue into six smaller lots to accommodate single family homes.

The decision came after more than 100 residents of the area packed Township council chambers at a public hearing on the application one week earlier.

Of the 40 people who spoke, all but three were against the

proposal by Green Grove Homes Ltd. Township staff reported another 28 written submissions were filed, all but six against the plan.

One letter arrived with a 74name petition against the project.

“I think the neighbourhood spoke very eloquently,” Councillor Kim Richter said.

Councillor Bev Dornan, who was the only member of council not present for the public hearing, has since been inundated with letters and emails against the plan.

She said the many messages have convinced her the current plan packs too many lots into too little space.

That means Figueroa will have to remain in sanctuary.

“If I try to go home they could arrest me and put me in a detention centre.

On the same day his deportation order was stayed, rallies of support for Figueroa were held around the country.

Rallies took place in Halifax, Ottawa, Toronto, Vancouver and at the Canadian Embassy in El Salvador.

More than 100 people showed up to a rally outside the Walnut Grove church on Oct. 12 and many rallies

deport Figueroa based on his past affiliation as a student in El Salvador with the leftwing Farabundo Martí National Liberation Front (FMLN) during the civil war.

The FMLN is now the democratically elected government of El Salvador.

Langley Township’s rebuke in B.C. Supreme Court over the heritage alteration permit it issued to allow construction of the Coulter Berry building in Fort Langley should prompt some reflection by council and staff.

The ongoing opposition to the building has been driven by a number of factors. Some believe it is too large for Fort Langley’s main street. Others believe it does not fit in with the heritage theme of Fort Langley. Others believe it was designed just for visitors, and will not make it possible for local residents to do more shopping in town.

The building was approved by council, in an 8-1 vote, because councillors accepted the arguments that it would bring with it more parking, more retail and office space, and that it fits in with Fort Langley’s heritage theme.

While there are many people opposed, there are also many in favour.

Fort Langley cannot remain in a vacuum, whether that vacuum is the late 1800s, the mid-20th century or the 2010s. Like any vibrant community, it is constantly changing.

What it does offer is a unique emphasis on heritage. As the first capital of B.C., and the location of a national historic site, it has something no other B.C. community can offer.

It also has passionate residents and enthusiastic business people — a big positive for any community.

If the Coulter Berry building is violating heritage guidelines, perhaps it is time to revisit the guidelines, which were drawn up 20 years ago.

At the same time, the voices of those who want to see more shops and services for village residents must be heeded. Tourism is good for the economy, but a well-balanced community doesn’t forget its own residents.

Victoria has finally unveiled proposed amendments to the province’s hopelessly antiquated Water Act. Existing legislation, more than a century old, was crafted to regulate surface water use to benefit farmers, miners and tiny clumps of early settlers.

With today’s larger population and elevated industrial demands, it is unacceptable that B.C. remains the lone province with no legal protection of groundwater and aquifers.

In presenting a 100-page document last week, Environment Minister Mary Polak admitted as much about one of the province’s most-valuable yet often-undervalued resources.

Groundwater can be used without government approval or fees, Polak added, hinting at perhaps the strongest motivation for cash-poor Victoria.

The government expects to collect $5 million annually, mostly from industrial users. Domestic wells would be excluded.

A Water Sustainability Act would harmonize groundwater and surface water regulation as well as raise protection of surface water. Conservation would be encouraged.

This comes at a crossroads in Comox Valley water management.

Some jurisdictions use meters, while some do not. Metered rural residents are upset because some of us in municipalities pay less than they will.

That will be true as long as we have so many local governments. They can’t agree on a unified position and some refuse to install water meters.

Meters are the only way to accurately measure how much water is used by households and companies.

Without them, those who use less water will subsidize large users. In communities with a flat rate, many of us subsidize large users and water wasters. Without meters, leaks are undetected.

Those who say we live in a rainforest are blissfully and/ or willfully ignorant to the fact that the system can deliver only so much water.

Instead of promoting conservation, communities without meters encourage waste.

Much can be done to prevent cancer Editor: October, the breast cancer awareness month, is coming to an end.

But some of the cancer-linked toxins keep on flourishing, especially as temperatures drop, in the form of wood smoke emissions from wood-fuelled fireplaces.

Lung and respiratory diseases are also contributed to by wood smoke; and so are heart attacks and stroke.

The smoke emission of one wood-burning fireplace can pollute an entire neighbourhood and can put people at risk; and this health risk can be multiplied by secondhand tobacco smoke. Here too, cancer may be the end result.

Despite the near-unanimous neighborhood opposition to this street rezoning; despite the fact that previous councils have already rejected identical rezoning applications, our council is focused on a plan that leaves a normal old neighbourhood in a situation where they must remove most of the old trees and leave people with no parking, no park space and no yards.

Who would benefit with a doubling of the density to this street? Certainly nobody who has a future here.

As a homeowner, you pick an existing neighbourhood for your family to grow.

Developers who have no our future in the neighbourhood tell the council exactly what they want and get it. We are left with their legacy.

Where do we move to next? Why can’t we keep a nice neighbourhood right here in Walnut Grove?

By now it is common knowledge that smoking tobacco can kill, and it will, more often than not. But still manufacturers keep producing this poison and trap people to indulge whether it makes them or others sick. Again, cancer is the key word.

Cancer has brought much grief to so many families, not only through breast cancer but other strains as well. Year after year, millions of dollars are raised for cancer research and much of this fundraising will be in vain if cancer causing agents in our environment remain.

I believe that now is the time to have a more serious look into preventive mea-

sures at the home base, while scientists are looking for a cure.

Prevention is in many circumstances the key. And each and every one of us has the opportunity to participate. You and I have the power and ability to bring about a change and eliminate some of the suffering that is brought forth by cancer.

All levels of government and health authorities seem to have failed us by not setting stricter guidelines, which could have prevented many cancer cases. Cancer can strike any time; it can strike anyone. No one is immune to it.

Richard Bulpitt Elementary opens MONIQUE TAMMINGA Tim es Reporter

A large contingent of the Bulpitt family attended the grand opening of the Richard Bulpitt Elementary school on Monday morning. “Richard saw the best in everybody,� said his wife Valerie of her husband. He passed away while doing mission work with his wife in Vietnam in 2007.

While Bulpitt’s legacy lives on with the naming of the school, his son Corey has also left a visual legacy at the school too.

Corey Bulpitt created an Aboriginal mural depicting a bulldog in the school’s foyer. “This would have pleased Richard, because Winston Churchill was one of his favourite people and Churchill was known as the British bulldog,� said Valerie.

The school’s sport teams will now be known as the Bulpitt Bulldogs.

D.W. Poppy Redhawk drummers honoured the school with two songs and students also performed songs for the celebrations.

Originally from England, Bulpitt served as the Langley’s superintendent of schools from May 1996 until March 2001,

The $13.4 million K-5 school has 510 students, features a Neighbourhood Learning Centre which provides preschool and daycare.

The Township is building a

playing field on five acres beside the school. That field is expected to be ready by next spring.

The design of the school is identical to Lynn Fripps Elementary, which opened in September, 2012.

The middle school in Willoughby will open in September, 2014.

Education Minister Peter Fassbender was also on hand for the opening of the new school.

The 17th annual Business Excellence Awards were presented by Greater Langley Chamber of Commerce on Wednesday night.

The event took place at Cascades Casino and Convention Centre, and was emceed by Jim McGregor.

A total of 48 individuals, businesses and organizations were nominated for awards.

The George Preston Business Person of the Year award went to chamber past president Angie Quaale, of Well Seasoned Gourmet Food Store.

She has been a tireless promoter of Langley, through her store, the Langley Community Farmers Market, Fraser Valley culinary tours and the annual BBQ on the Bypass that her business sponsors. She also write a regular column for The Times and is chair of Tourism Langley.

For a group of Lower Mainland seniors, being retired doesn’t mean quitting work.

In 2001 they formed an entertainment troupe, known as the Vaudevillians, as a way to have fun.

But they soon felt they needed a more meaningful purpose, so the group decided to raise money to support youth in the performing arts, hoping to keep live theatre alive.

Currently boasting three members from Langley, the Vaudevillians incorporated as a non-profit organization and

As works-in-progress go, this book was getting a little long in the tooth.

By the time authors Bruce Kilby and Ken Johnson put the finishing touches on their co-authored children’s fantasy novel, Legend of the Tooth Fairy, more than 15 years had passed since the men first set pen to paper, so to speak.

The book — about a boy’s desire to become friends with a dragon and all of the consequences that come with it — is loaded with references to teeth, oral hygiene and the importance of brushing.

But mostly, it is an adventure story with light moments, humorous situations and funny characters, said Kilby.

Still, a story wouldn’t be an adventure if there were no tense moments, he added.

Legend of the Tooth Fairy, a 240 page novel directed at children between eight and 10 years old, was written between 1998 and 2000.

However, after a rewrite in 2001, personal circumstances forced Kilby and Johnson to put their work on hold for more than a decade.

On Sunday, Nov. 3, from 1 p.m. to 4 p.m. the project will finally come full circle when the authors launch

Veteran wants to give back GARY AHUJA Tim es Reporter

Adam Coleman knows the importance of the Honour House Society.

The New Westminster-based organization is a refuge, a place for Canadian Forces personnel, emergency services personnel and their families to stay while they are receiving medical care and treatment in the Metro Vancouver area.

“The reason I chose (to fundraise for) Honour House is because I am a veteran myself,” the 32-year-old said.

Coleman, who served a tour of Afghanistan in 2008, has been a member of the Canadian Forces reserves since he was 17. He is still a reservist and sergeant in the 15th Field Artillery Regiment.

And while he avoided major injuries himself, others he knows have not been as fortunate.

“Honour House does great work and this is something that rings home closely for me because I am connected with it,” he explained.

“I have had friends and colleagues who have suffered traumatic injuries and have used Honour House.”

Coleman also owns and operates a pair of Langley Mobil 1 Lube Express — one is located at 200 Street and 64 Avenue and the other is at 56 Avenue and Langley Bypass.

Mobil 1 Lube Express owner Adam Coleman, who served in Afghanistan in 2008, is trying to raise $10,000 for the Honour House Society. as Canada remembers the dedicated men and women who have served in conflicts all over the world, Coleman thought it was the perfect time to show his appreciation.

Coleman is donating all of the proceeds from oil changes done tomorrow (Friday) to Honour House. Customers will also receive the standard free interior vacuum of their vehicle, coffee and a newspaper.

And for the rest of the month, he will donate $2 from every oil change.

Coleman is hoping to raise at least $10,000.

“I think if you are running a successful business, it is important to give back to the community or any charitable organiza-

tion,” he said.

He has owned the 64 Avenue location for two years and the 56 Avenue location for the past year.

Prior to that, Coleman had been working as a mechanic, both in automotive and heavy equipment, since he was 19.

When he returned from his tour in Afghanistan, the company he was working for was hit hard by the recession, forcing it to shut down some of its locations and lay employees off.

“I thought it was a good time for me to strike out on my own because I always wanted to own my own business,” he said.

As part of a thank you, both locations will have military and emergency personnel on hand tomorrow (Friday) at 9 a.m.

Strom set to build on record-setting year G ARY AH U J A Tim e s Spo r t s

After a record-setting season last year, the Trinity Western Spartans know they can count on forward Holly Strom.

The fifth-year forward set six TWU program records and led the Canada West conference in scoring with 19.2 points per game in 2012/13.

But while Strom may be a focal point of the offence for the women’s basketball team, the Spartans need help from those around her if they hope to return to the post-season after a fouryear absence.

“We have to take advantage of some of the skills that we have,” said coach Cheryl Jean-Paul, adding scoring and height are two of those skills which her team possesses.

Last season saw the team finish 7-15, which was sixth in the Can-

ada West’s Pacific Division. And only two starters — Strom and guard Janelle Traber — are back for 2013/14.

“The two of them will be a big part of our offence,” Jean-Paul said.

Two other returnees, Chantelle Martin and Laurissa Weigl, combined with Traber to average 16.7 points from the guard position.

That number should go up with increased minutes.

The point guard position is expected to be manned by former Brookswood Bobcat Luca Schmidt. The second-year guard played a limited role last year but so far through the pre-season, she has been playing nearly 30 minutes a night.

Jean-Paul said the team will employ a more attacking style.

“We are using more ball screens this year, which is different than what we have done in the past,”

she said. “That is going to create some different looks for us.

“We are scoring in transition, we are trying to push the ball as much as possible.”

Making the playoffs will be a daunting challenge considering the depth and quality of teams in the conference.

“If you look at the (national) top 10, five or six teams are from our conference,” Jean-Paul said.

“There are no easy games; every week is going to be a dogfight.

“Every game matters and every game is the difference between making the playoffs and not making the playoffs, that is how we have to approach every weekend.”

The Spartans open the season with a pair of home games at the Langley Events Centre: Nov. 1 against the Calgary Dinos and Nov. 2 versus the Lethbridge Pronghorns.

There is no doubt that the Trinity Western Spartans men’s basketball team has athleticism and speed.

The question — and what their success hinges on — is whether coach Scott Allen can harness the team’s raw talent and turn that into victories.

“They are very exciting to watch, especially in the transition part of the game,” he said.

“A lot of them play above the rim.”

What remains to be seen is how successful the squad will be.

“They are very athletic and coachable, just lacking expe-

rience as a collective group,” Allen said.

“That has been the most difficult thing, establishing roles, but that is coming together.”

The team was in China earlier this month and won all three of their games to finish the pre-season at 3-3. The losses came to a trio of American colleges and universities.

Eight starters return from last year’s 12-10 Spartans team which won 10 of its final 13 games to make the playoffs with a 12-10 record.

Among the returnees is last year’s leading scorer Mark Perrin who led the team with 18.2 points and 7.2 rebounds per game. The guard was also tops among the Spartans in steals.

Another returnee who should provide a lift to the team is forward Denny McDonald, who has been arguably the team’s top performer in the pre-season.

While last season saw many of the players competing at the Canadian Interuniversity Sport or Canada West level for the first time, the players should benefit from having a full year under their belts.

The Spartans tip off the Canada West regular season with a pair of home games at the Langley Events Centre: Nov. 1 against the Calgary Dinos and Nov. 2 against the Lethbridge Pronghorns.

A Canada West coaches poll has the Spartans ranked seventh out of the conference’s

16 teams.

And just like last year, they face a daunting first half schedule that will see them play seven of the higher-ranked teams in the first 10 games.

On the flip side, the back half of the schedule — which follows the holiday break — will see them face just one opponent ahead of them in the last dozen games.

Allen knows the experiences — and bumps along the way — will help the team in the season’s second half.

“We have to go in believing that we have all the tools and we are going to do whatever it takes to win,” Allen said.

“That is the first part of our step to success.”

Horan plays hero as atom Broncos beat Colts 22-16

With the outcome of the game on the line, Langley Broncos’ Kaycen Horan came up with a game-saving quarterback sack, forcing a fumble and recovering the ball in the final minute to secure a 22-16 victory over the Cloverdale Lions.

The atom football teams were playing at Cloverdale Athletic Park on Sunday.

The offence came

from Joran Tomica, Quinton Steinmann and Vaughn Pinchin, who all rushed for touchdowns.

The atom football teams played Saturday at McLeod Athletic Park.

The Bears set the tone early as the opened the game with a methodical, 15-play drive that culminated with Mathieu Gale punching the ball into the end zone for a touchdown.

The ground game was at it again in the second quarter with Koan Zieger following his lead blockers Nic Reimer and Tyson Hoy into the end zone.

minder was the difference in a game where his team was outshot by a 38-21 margin. Fredeman allowed just a pair of goals.

Rounding up and riding the RAM range 2014 RAM Roundup The full-size truck market is big business for automakers and a big deal for the businesses and people who depend on them.

For almost five decades the Ford F-150 has been the best selling truck, with little chance they will lose that crown in the near future. What has been happening, over the last few years, is a strong shift from General Motors to RAM in terms of establishing the second best selling truck brand. The rise in RAM popularity can be traced back to a few key changes over the last several years, from muscular styling to class-leading interiors, a refined ride, plus engine and transmission advancements.

I drove the 2014 RAM model range recently, on a beautiful fall day, just outside of Toronto. The “RAM Roundup” was a great opportunity to get my hands on these new trucks well before they arrive at BC dealerships.

Looks A big part of the RAM brand success has been built on the sturdy and macho exterior styling. Front and centre is a grille that was enlarged, but better integrated, for the 2013 model year. Depending on the trim the grille finish can be chrome, painted or with a different insert. This feature is one RAM owners love so, in this case, larger ALL TREATS, NO TRICKS -

is better. Behind the grille are “active shutters” that close at higher speeds to help send the wind around the vehicle to improve aerodynamic efficiency. The same idea was also behind the longer side step, which helps reduce buffeting down the side of the trucks.

One option that I find fascinating, and would seriously consider, is the $1500 air suspension that can be lowered for easier entry into the RAM or loading into the bed. Plus this system automatically lowers over 100km/h to also reduce aerodynamic drag. At lower speeds and for off-road duties, the air suspension can be raised for better ground clearance. Having had a chance to drive several RAM trucks with this feature I notice the already smooth ride is even better and the cabin is further insulated from vibration.

Shooting for the Perfect Drive Keith Morgan

I keep hearing TV F1 commentary teams talking about the perfect race in relaƟon to the now fourƟme world champion SebasƟan VeƩel.

As I watched the German driver for InĮniƟ-Red Bull race team take the chequered Ňag in India on Sunday, the repeated reference to his perfect race reminded me of another open-wheel racer.

Back in the early 1990s, Vancouver Indy racer Ross Bentley strived for what he called the ‘Perfect Drive’, not on the track but on the roads of B.C. Ross, now coaching race drivers and street drivers in Washington state, always told me that he found the racetrack a safer place to drive. On the track he preƩy much knew what other drivers were going to do, whereas drivers on the street were very unpredictable.

And I was reminded of that the other morning when a young driver whizzed

by me in the curb lane, then cut in front and crossed two more lanes to turn leŌ at an intersecƟon just a block ahead. Of course, he didn’t signal when he got there either!

Ross devised a liƩle game that he played every day while travelling to and from work across town.

The Perfect Drive Concept was designed to help drivers concentrate and I can’t help it would a great game for us all to play some 20 years on from when he Įrst outlined the idea to me.

“The idea is to drive smoothly at a constant speed with minimal braking,” explains Ross, who tells me he sƟll tries to achieve the Perfect Drive daily.

“To do so, you must anƟcipate light changes and ease oī when you approach a stale green. You have to slow in such a way that if your passengers had their eyes closed they wouldn’t be aware of the exact point you stopped.”
