Bruce Cuthbert is walking along the dike with his two dogs on Brunswick Point in Ladner when he stops and points.

“My great grandfather diked this property, he created land out here in the early days,” he says.

“It was all underwater when he got here.”

Cuthbert is talking about his great grandfather Paul Swenson Sr., who purchased 80 hectares of Brunswick Point in 1889 from the Crown. He and his children farmed the property for the next 80 years when it, along with thousands of hectares of farmland, was expropriated by the provincial government for the Delta Superport construction.

The Social Credit government of the day was planning to build a huge industrial park and all the farmland leading to the port was threatened.

But when the NDP government and the Agricultural Land Reserve was ushered into power in 1972, families like the Swensons got their land back. Well, most of it.

One parcel of land, a mere 1.67 hectares, was still occupied by the Brunswick Cannery, which Paul Swenson Sr. helped to build in 1910.

The province has held on to the the tiny property, known as the Wedge parcel because it resembles a slice of land resembling a pizza wedge, ever since.

During the 2007 treaty negotiations with the Tsawwassen First Nation (TFN), however, the province agreed to province the former Indian Band with the first right of refusal on the sale.

Now the province is planning to subdivide and sell the overgrown forested area, and it wants

That doesn’t sit well with Cuthbert, who is concerned it could be developed by TFN once it gets absorbed into treaty lands.

“My particular reaction is it’s best left in the hands of the provincial government,” he said.

“There’s nothing mandating the government to sell the property.”

Rod Swenson, first cousin of Cuthbert, farms 140 hectares of land in Delta, including the swath that surrounds the wedge. He’d like to see the land that originally belonged to his great grandfather returned to the family.

“Anything that interferes with the farming I

don’t like,” he said “If this parcel is given to the First Nations I don’t know what they could possibly put on it. The best thing to do would be to put it back on the farm.”

The issue came back before council last Monday, where Coun. Ian Paton said he was disappointed a solution could not be found to return the land to the family.

“I thought that we were going to make an effort to convince the province that perhaps that piece of land should go back to the original owners, the Swenson family,” he said.

In a delegation sent to council by the ministry of forests, lands, and natural resource operations, it was suggested that the municipality

place a restrictive covenant on the land prohibiting development. But council was skeptical such a document would be enforceable once it is turned over to TFN. Chief administrative officer George Harvie said that on previous meetings with the TFN they have indicated an interest to purchase the land.

“There’s no question that the treaty allows–and the province has set this up–the Tsawwassen First Nation has the right of first refusal of any of those properties,” said Harvie.

He said Delta might support the subdivision with the understanding that the wedge parcel would not be developed and would be left in its current state. But the municipality is unsure how it’s enforceable under municipal laws, and has left it up to the province to proceed with rezoning.

“The challenge for staff is, how we can freeze in time what is there now without any development,” said Harvie. “It’s for the enjoyment of the residents that are using it now, both the Tsawwassen First Nation residents and also the Corporation of Delta.”

Council has sent a letter to the province asking it what direction it plans to take with the land.

Meanwhile, the Swenson family wait and wonder.

Bruce Cuthbert said he doesn’t have any issues with TFN following through on an agreement they have with the province through their treaty negotiations, but would like people to think of the family history.

“Our family suffered the heartache of seeing the farm they had farmed for 80 years taken from them via expropriation in 1968,” he said.

“Many family members experienced stress and other health implications in the years following expropriation as they dealt with the loss of their land and an uncertain future.”

Delta Police have located the body of 43-year-old Cory Fergus, who disappeared last week while retrieving crab traps in Boundary Bay.

Canadian authorities were notified after the US Coast Guard found the body of an adult male in U.S. waters.

Delta Police investigators joined the Canadian Coast Guard in a hovercraft to recover the body.

Police do not suspect foul play at this time, however police will work with the coroner to determine the cause of death.

Fergus was reported missing at 4:30 p.m. on Oct. 7, but was last seen the

night before at approximately 5:30 p.m.

He reportedly left a friend’s residence in Tsawwassen and was believed to be heading to the Centennial Beach area of Tsawwassen to take his boat out and retrieve his crab traps.

Fergus had not been heard from since. A full-scale search, which included the Canadian Coast Guard hovercraft, helicopter, planes and police boats, was launched.

Police did locate his unoccupied vehicle parked at the boat ramp at Centennial Beach and conducted area searches of the immediate and surrounding area but came up empty.

The search was called off Oct. 9 after his empty canoe was located partially submerged in water, 6.5 kilometres south of Point Roberts.

Fergus was a diabetic, but it’s unknown whether that contributed to the accident.

Delta’s fire department wants to offer ‘enhanced’ medical aid ❙ Adrian MacNair adrian@southdeltaleader.com

Delta is vying to become the first municipality in B.C. to allow its fire department to provide enhanced medical procedures ordinarily restricted to BC Ambulance paramedics during 911 calls.

The idea was first floated at a meeting between Health Minister Terry Lake and Delta’s fire chief Dan Copeland, Mayor Lois Jackson, and senior members of the local government at the Union of B.C. Municipalities convention in Vancouver last month.

Delta will now send the province a First Responder Consent and Indemnity Agreement that would allow its firefighters to provide enhanced medical aid.

The province’s Emergency Health Service Act has been recently amended to allow firefighters to collaborate with the province in determining what level of health services are necessary.

In a study of first responders times in Delta, Copeland said 59 per cent of the time firefighters arrive three minutes prior to B.C. Ambulance. The enhanced medical aid would be provided in that “time lag” between firefighters arriving and B.C. Ambulance responding.

“So what we’re looking to do is increase our scope of practice… providing

Entonox, which is pain relief gas for patients, do blood pressure, pulse oximeters, splinting, wide range of airway management, as well as IV management,” Copeland told Delta Council last week.

Only two other jurisdictions in B.C. have received permission from the province allowing its firefighters to provide emergency medical assistance. Fire Departments in Prince George and Sun Peaks outside of Kamloops participated in a pilot project headed by the Emergency Health Services Commission in 2011 and 2012.

“It is groundbreaking in the fact we’re not asking to do a pilot project, we’re asking the health minister and the commission to approve us to actually work to the level of our license through the Emergency Medical Assistance Act,” said Copeland.

Currently, during a 911 call the person is asked to specify the emergency by fire, ambulance, or police. Only after a series of followup questions does a 911 call trigger a “first responder” to alert all three emergency services.

The new agreement would have firefighters simultaneously dispatched during a 911 call, regardless of what service the caller specified.

“We hear a lot of these instances where people are on the ground, so to speak, and through no fault of [BC Ambulance], they’re not able to get there for anywhere from five minutes, 10 minutes, 25 minutes, even longer has been experienced,” she said.

Chief administrative officer George Harvie said that the training will also be useful in the event of a natural catastrophe.

“The public is going to be expecting that service from their fire department, the ambulance services aren’t going to be able to get to everybody, especially during an

earthquake,” he said.

The current annual budget for the fire department budget is approximately $22 million.

Harvie said the new agreement wouldn’t cost taxpayers any additional money.

The plant comprises a sequence batch reactor system with tertiary treatment capability and will be developed in phases with sufficient capacity to service Tsawwassen Lands according to TFN’s development plans.

Design and construction on the plant is commencing immediately, and the plant is expected to be built and operational by summer 2015 in time to service anticipated growth at TFN. It will replace the existing plant that currently provides sanitary sewer service to Tsawwassen Lands. TFN has had its

own sewer plant since 1996 which services the tiny community of fewer than 350 people. Only one portion of TFN lands has been connected to the Delta sewer system since the 1980’s—the 92-lot Stahaken subdivision.

An independent engineering study conducted for Delta last year confirmed the municipality does not have the sewer infrastructure to meet TFN’s ambitious development plans, which include two massive shopping malls, a new residential community, and an industrial park.

The Treaty First Nation was left to negotiate with Metro Vancouver for a plan, but had been making no progress.

Delta alleges damage of bog in lawsuit Princess Farms named in lawsuit over soil deposit that allegedly damaged bog ❙ Adrian MacNair reporter adrian@southdeltaleader.com

The Corporation of Delta in partnership with Metro Vancouver has launched a civil action in BC Supreme Court against Delta-based Princess Farms and its Langley contractor, alleging both damaged a large area of Burns Bog. The local and regional governments are alleging that 17,000-square-meters (55,774-square-feet) of protected wetlands in Burns Bog were damaged by the companies through soil deposit activities.

The Corporation of Delta and Metro Vancouver, as joint owners of the 2,428-hectare Burns Bog, filed against Princess Farms Ltd., Matcon Landfill Management Inc., and Matcon Civil Constructors Inc. Princess Farms has been preparing for a new blueberry production on a site located on the west side of 104th Street and 64th Avenue in East Ladner.

The farm had been previously approved for an application to deposit 300,000 cubic metres of mixed soil on the site to improve drainage, which Delta’s chief administrative officer George Harvie said is now over 4.6 metres (15 feet) high.

But although Delta Council rejected an application to deposit an additional 36,500 cubic metres of topsoil in late September, the Agricultural Land Commission (ALC) overruled them. The lawsuit alleges damage occurred by or under the supervision

of Matcon and contrary to the terms of the ALC approval, which required that the fill be carried out in accordance with a consultant’s report.

Harvie said Delta staff were conducting monitoring and scientific studies in Burns Bog several months ago when they noticed the damage and commenced an investigation.

“We tried to get into the property but we were denied access,” he said.

Affected areas of Burns Bog include vegetation, trees, wildlife habitat and the peat bog itself, which suffered tearing, heaving

and the vertical and lateral displacement of the peat bog near where fill was placed on native peat on the adjacent farm land.

Run off from the fill may also affect the Bog’s chemistry, according to the municipality.

Harvie said Delta is looking into establishing a new soil conservation and protection bylaw to enhance Delta’s ability to regulate activities on farmland that would prevent such incidents in the future, as they are alleged.

Matcon Civil Constructors were not immediately available for comment.

Smart meter holdout fees get approval from utilities commission Opponents of wireless smart meters are vowing to continue their fight against BC Hydro after the B.C. Utilities Commission granted interim approval of extra fees that will be charged to holdouts. Regulators have set out a three-month process to consider the grounds for the fees, which the province has mandated by cabinet order to recoup millions of dollars in extra costs to accommodate customers who opt not to have a wireless meter.

The utilities commission can’t scrap the fees, but it could decide they’re too high and order Hydro to lower them and refund the difference.

Sharon Noble of the Coalition to Stop Smart Meters said opponents have registered for intervenor status and will urge the commission to delay implementation of the fees while a class action lawsuit against Hydro is before the courts.

“They want to get the fees in place so people feel the pinch as soon as possible and stop resisting,” Noble said, calling it a strategy to break the planned legal challenge.

She said it’s “unconscionable” for the fees to go ahead before opponents get their day in court.

“This is just one more way of intimidating people,” Noble said. “I’m getting 300 emails a day from people who are furious and can’t afford this.”

About 60,000 households that have refused wireless smart meters have been notified of the pending fees. They’ll pay $35 a month extra starting Dec. 1 if they opt to keep their mechanical meter or if they fail to make a choice, as it’s the default option. They can instead switch to a smart meter with the radio transmitter disabled for a $100 setup fee plus $20 a month for manual readings, starting in April. The only way to avoid paying more is to agree to take a smart meter.

Politicians in the legislature and municipalities across the province may not be aware of a federal change to a policy document that could have broad implications for their tax base, according to Delta Mayor Lois Jackson.

She said she spoke to Premier Christy Clark at the Union of B.C. Municipalities convention last month about the draft changes to the additions-to-reserve policy, but Clark had not even heard about it.

Jackson said when she attended a seminar on the topic at the UBCM there was “surprise” from those who were only hearing about it for the first time.

“I stood, rose, and spoke to the issue,” she said. “The provincial aboriginal minister was there, however he had not heard of it before.” Jackson The federal government is drafting an update to its additions-to-reserve policy, originally created in 1972 to bridge a legislative gap between the Indian Act and federal law which sets out conditions before land can be added to Indian Reserves.

A concern with the revised document is that it would allow First Nations to add lands to their reserve that are outside of their traditional territory and not contiguous with their existing reserve.

A report to Metro Vancouver last Wednesday warned the changes could allow residential, commercial and industrial development in cities across B.C., resulting in the loss of land, taxes and costs associated with servicing agreements. Chief among those concerns in Delta is the loss of farmland, since the federal powers governing Indian Reserves overrules the province’s Agricultural Land Reserve.

There are two First Nations groups in Delta, the Tsawwassen First Nation (TFN) which is a treaty nation that operates outside of the Indian Act, and the Musqueam Indian Band which owns 142 hectares of farmland in Ladner.

Although TFN isn’t affected by the federal change, the Musqueam Indian Band is still federally administered.

Wade Grant, one of the band councillors representing the Musqueam’s 1,300 members, said they have no plans to purchase farmland in Delta, nor develop the parcel they currently own.

“Having said that, we recognize the importance of revamping the additions-to-reserve policy,” he said, adding an application to add a parcel to an existing reserve can take up to 10 years. “It’s antiquated, at the best of times.”

Grant said some mayors who have expressed concern with the policy changes, like Belcarra Mayor Ralph Drew–who sits on Metro’s aboriginal relations committee and is also the Metro representative to the Union of B.C. Municipalities aboriginal committee–doesn’t even have any First Nations members in his community.

“I don’t think that it’s something mayors across the Lower Mainland should be upset about. I think that if they want to have that conversation we’re more than willing to have that conversation with them.”

Grant said Lower Mainland municipalities have been around for just over 100 years, while the Musqueam have been living here for thousands of years. And while Musqueam Indian Band’s main village is composed of 120 hectares, their historical territory encompasses all of Metro Vancouver.

“It’s tough, because people like to lump First Nations all as one group,” he said. “And we’re not all one group.

Musqueam’s just as different to Tsawwassen [First Nation] as Delta is to Vancouver. We have different histories, different opportunities.”

But Grant said, in general, First Nations opportunities are limited by a lack of lands.

Last week, Delta Council approved that letters be sent to provincial ministers following up on discussions held at the UBCM convention on the topic and that letters be sent to all B.C. mayors and councils, MLAs, ministers, members of parliament, and Senators.

Council lauds productive meetings at UBCM The Corporation of Delta had a successful trip to the Union of B.C. Municipalities conference last month, according to a report to council last week.

Not only did Delta learn that a new bridge would replace the existing George Massey Tunnel, council members and senior members of the municipal government met with cabinet ministers, making significant headway on a number of outstanding issues.

“In the time we’ve been together in Delta, a number of years now, it was the best meeting we’ve had with the various ministers, and of course with the premier,” said chief administrative officer George Harvie.

Coun. Ian Paton said their delegation had a positive meeting with Health Minister Terry Lake to discuss early intervention centres for patients with mental health and addiction issues and mental health patient intake procedures.

“Basically, we went there with a list of really good things that have happened in Delta and accomplishments and projects we’ve completed with grant money, stuff that’s been done on budget, on time, and they were pretty impressed,” he said.

New Agriculture Minister Pat Pim discussed Delta’s concerns regarding speculators acquiring agricultural land for non-farm use, and said the province will be undertaking a review of the Agricultural Land Commission. Paton said he confirmed Pim will visit Delta on Oct. 22 for a tour of a potato operation, dairy farm, and greenhouse operation.

The delegation also met with Transportation and Infrastructure Minister Todd Stone, who provided commitments on several issues in Delta Including the installation of a long-awaited median barrier on the S-curve of Highway 10 between Scott Road and Highway 91 that has resulted in previous head-on collisions. As well, there will be an RCMP-enforced prohibition of truck traffic on Highway 17A following the completion of the South Fraser Perimeter Road in December.

Four members of the provincial cabinet, including Pim and Stone, along with Jobs, Tourism and Skills Training Minister Shirley Bond, and Minister of International Trade Minister Teresa Wat, attended a special meeting on the Ashcroft Transloading Terminal.

Marijuana petitioners off target at 30-day mark

Sensible BC spokesman Dana Larsen said the campaign had 65,000 signatures as of Oct. 9 – 15,000 less than their aim of 80,000 by the 30day mark of the 90-day petition drive.

Barton grew up in Chicago and was originally trained as an opera singer. His golden voice was the ticket that helped him see the world, as he worked on touring productions, cruise ships, stage shows, and even as a singing gondolier at the Venetian Casino in Las Vegas.

It was at a show on Vancouver Island where he met his future wife, local music teacher and entertainer Tracy Neff.

referendum is not automatic – the Legislature could introduce the proposed Sensible Policing Act but not put it to a vote.

If it was sent to another referendum it could be non-binding – the HST referendum after a successful Fight HST petition was binding only because Premier Gordon Campbell declared it so. Fight HST also had many

more signatures at their 30day mark – more than 300,000 – and eventually got 705,000.

Suburban ridings in Metro Vancouver, including Delta South, have proven more challenging. So far, Sensible BC has 3,000 canvassers registered, up from 1,600 when they launched.

T

ransportation Minister Todd Stone seems to gradually be opening his eyes to the serious challenge that transportation is to B.C.’s economic future.

The minister, a rookie MLA elected in Kamloops in May, spent some time touring the transit system on Tuesday. He has been in regular contact with TransLink officials, as well as North Vancouver Mayor Richard Walton, chair of the mayors’ council – which has a vote, but not much of a voice, on TransLink.

Transportation issues, particularly transit, are key to the future well being of Surrey and other South Fraser municipalities. Two major bridges have been built and a third is planned.

The South Fraser Perimeter Road is close to completion. At the same time, there has been minimal improvement in transit.

Bridges and roads are important, not just to transport people, but also goods. Transit can serve to ease the pressure on new infrastructure and get people where they need to go.

The Pattullo Bridge is the most obvious example of the complexity of transportation problems. It is no longer a factor in transit, as riders crossing the river use SkyTrain, but as a direct result of the province’s tolling policies, which Stone still defends, it has become much more congested with large transport trucks this year. The aging bridge is in no shape to handle an increase in truck traffic, and it could be argued that excessive truck use will further damage it. A complete ban on trucks may be necessary, given the state of the bridge.

Yet TransLink, the owner of the bridge, is planning to set aside up to $300 million for repairs and maintenance of the bridge. This makes no sense. That money could serve as a significant down payment on a new bridge, which is overdue. At the same time, that $300 million is money taken away from expanding transit routes south of the Fraser River.

Surrey has seen no expansion of the rapid transit system since 1994, when the extension of SkyTrain to Whalley was completed. The population at that time was less than 300,000.

While the population has grown, there has been some modest expansion of bus routes.

However, most people south of the Fraser River do not use transit because it is so unreliable.

This is particularly true in South Delta, where there are few bus routes and little in the way of new service. The province will not grow economically and gain tax revenue if the transportation system continues to be dealt with on a piecemeal basis. LNG plants are great, but government also needs to take a cohesive approach to dealing with transportation issues.

TransLink funding: leave no stone unturned

Throne speech a poor partisan photo-op

T

he throne speech is one of the many throwbacks to our constitutional monarchy, no doubt originally conceived to remind Canadians of the parliamentary agenda.

And while it may have made a good deal of sense in the pre-Internet days when the nation needed a refresher on the goings-on in Ottawa, it’s utterly and absurdly superfluous in the 24-hour-news cycle that is 2013.

If it were merely a laundry list of things the cabinet members hope to accomplish between now and next year–which it isn’t–that could be understood.

But the throne speech has devolved into what just about every Harper government public relations activity has become: a carefully controlled, contrived and condescending photo opportunity.

Make no mistake. This isn’t about sharing the hopes and dreams of a nation embarking on a new session of parliament. It’s a chance for Stephen Harper to get photographs with

his cabinet, talk about how much the stimulus spending helped us escape the recession, and advertise the Conservative Party.

The level of contempt with which the media is treated in this whole circus situated on parliament hill was best exemplified on Wednesday when the prime minister’s office decreed that a single “press pool” photographer was to be allowed inside the halls of power during the throne speech.

Camera crews were to be permitted, but pesky reporters were not. After all, they might ask questions about European trade pacts, or other off-topic journalistic type stuff.

The throne speech is about taking pot shots at the expense of the NDP and the Liberals, not the government defending its record from public scrutiny. Fear not, however, that record will be provided complete with pre-screened quotes from a strategic communications director.

You may retweet meaningless platitudes as well, such as the one the PMO posted on Twitter: “Despite our accomplishments, we will not rest here. We must go

further and we must go faster.”

When reporters are banned from reporting to the people, where else can one turn but Twitter? There you can learn that the government supports the troops, scrapped the longgun registry, and fixed the economy.

What you won’t hear from the PMO Twitter account, however, is that the former Reformer who once campaigned on a triple-E Senate has presided over the largest expense scandal in the history of the red chamber.

This government has twice prorogued on the people when parliamentary questions became inconvenient to its message.

Perhaps it’s time we prorogue on the throne speech, ignore its public relations massaging and photo ops, and cover real news.

Letters to the editor Queen wouldn’t be accepted under new art guidelines The article in the Oct. 4 South Delta Leader by Adrian MacNair concerning the use of art in Delta hospital was excellent reporting and covered all the basic details well.

I belong to the South Delta Artists Guild and have read, several times, the nine-page policy statement by the Fraser Health Authority dealing with artwork in all facilities under their jurisdiction.

Apart from all the points well covered by the Leader, a few others really concern me, both as an artist and member of the Guild, and as an ordinary citizen.

In the section headed “Content Guidelines for Accepting Artwork” (p.6, item 5.0) it is stated: “Artwork depicting people will not be accepted with the exception of when human forms are part of the background/surroundings and do not have distinguishable features, gender, ethnicity, etc.”

What is the reason for this apparent censorship?

Think this through. FHA would refuse to show a portrait/painting of Malala, the incredible 16-year old Pakistani girl shot by the Taliban for her stand on women’s rights, and nominated for the Nobel Peace

Southlands will be a boon

Prize. She would be turned down on all four counts, including whatever “etc” can mean.

The Queen wouldn’t make it either, nor would a recognizable Mountie, the Pope, or Mahatma Ghandi.

I also would appreciate clarification on the point: “Artwork containing religious images will not be accepted.” Does this include paintings of, say, Notre Dame Cathedral, or the many other wonderful places of worship of various religions?

Concerning the directive that only paintings under glass will be accepted for public display, this immediately cuts out the many paintings done in oil, acrylic, and other mediums which do not require glass protection, as do watercolours or pastels, and are consequently lighter and easier to handle. Are they more threatening to health?

Finally, the best way to hang paintings on walls is to use slot boards, as SDAG does in its gallery.

These are attached to the wall and enable paintings to be hung at any level without wall damage.

Perhaps they could be donated and cut to size – they are not expensive.

As Secretary Treasurer of Delta School District, I received calls complaining about the nuisance created by rebuilding school fields, and also about the noise made by children and adults using the fields on weekends.

The return to commercial farming to the Southlands with its dust and stinks, would be a constant annoyance to surrounding residents.

Farming an isolated property such as the Southlands at a profit, I judge to be impossible, since no one is doing so.

The smaller cheaper houses such as the display home in the mall will be a boon young adults and retirees.

The wonderful gift of 425 acres to the municipality is unprecedented, and must not be allowed to slip away. Its use as parkland, walking trails, garden plots, or what ever else, is a fantastic value to our community.

I believe Delta should take advantage of the location, which has the best climate in Canada’s mainland, by developing an Olympic Training Center, for Canada’s athletes, similar to Colorado Springs in the USA. Please do all possible to move the Southlands plan to fruition.

B.C. marijuana referendum misguided

I

won’t be signing the “Sensible B.C.” petition to demand a province-wide referendum on marijuana enforcement. You shouldn’t either, and here are a few reasons why.

Let me start by saying I’ve been calling for legalization and regulation of pot for 20 years, to conserve police resources and reduce violent crime. Our war on drugs is a failure even for heroin and cocaine, and marijuana is obviously much easier to produce.

But the current effort led by Dana Larsen, B.C.’s clown prince of pot, is not only misguided, it’s dangerous.

The petition does not propose legalization. It seeks to impose a provincial law that would stop B.C. police from using any resources for simple possession charges. This would create a loophole in the federal drug law.

So what would that do? It would protect otherwise innocent customers of the current illegal marijuana trade, while leaving the criminal distribution business in place.

For a closer look at that, I recommend reports from the Surrey Six murder trial now underway, or the upcoming case against three accused assassins of Red Scorpion gangster Jonathan Bacon in Kelowna.

Larsen’s loony law would tie police hands when they are trying to hold someone on a lesser charge while they search for evidence of something nastier. This is a source of many simple possession charges today.

Police chiefs have a different idea, asking for the option of treating simple possession as a ticket offence to keep the court time to a minimum.

Both of these notions have the same obvious flaws. They don’t deal with sales to minors and they divert no revenue to government, leaving most of that in the hands of criminal dealers who buy cocaine, guns and fancy cars.

Colorado and Washington have gone the legalization route, so far without interference from their federal government. These states

need money, and they don’t need more crime or ill-considered hippy gesture politics.

Meanwhile in Ottawa, Health Canada is trying to convert a poorly regulated mess of small-scale medical marijuana licences to a free-market system of commercial producers.

Local politicians tore a strip off Health Canada officials at their recent convention, after years of warnings that federal licences were scattered at unknown locations, often used as fronts for larger grow-ops.

Mission Coun. Dave Hensman predicted that when a grower gets a letter cancelling his licence, he’s more likely to roll up a big joint with it than to shut down.

Burnaby Coun. Nick Volkow suggested the response would echo an old Cheech and Chong routine: “Dave’s not here, man.”

Here’s another reason not to support Larsen: the conduct of his organizers.

One fellow set up a petition table at, of all places, the Terry Fox Hometown Run in Port Coquitlam. After scrawling “pot cures cancer” on the table, he proceeded to interrupt speeches by cancer survivors and the run itself by yelling the same false slogan.

You can imagine how people with terminal cancer and their loved ones would react. Some would know that marijuana may alleviate side effects of chemotherapy, just as it can ease suffering for some multiple sclerosis patients. But the suggestion of a cure is as cruel as it is moronic.

Larsen’s “cannibus” has been rolling around B.C., reaping uncritical media coverage. It even blundered into the recent Walk for Reconciliation in Vancouver, an event to mark the end of federal hearings into the effects of residential schools on aboriginal children.

I wouldn’t support the Larsen bunch for anything, unless it involved them looking for jobs.

Just say no.

Light rail a solution for Delta Your Oct. 4 edition contained all the elements of a successful resolution to the tunnel problem much discussed therein in the lead article, editorial, and letters to the editor.

Firstly the tunnel should be preserved for use by rapid transit by building a light rail line from Bridgeport down Hwy 99 through the tunnel to an initial terminus station near the Town and Country Inn, with a park and ride.

Ultimately, the light rail could run to White Rock. Light rail in the tunnel would leave room for

the placement of ballast so that the fill over top of the tunnel could be removed to provide the extra shipping draught needed to fulfill the hidden agenda of the Port Metro Vancouver.

It may even be possible to add enough ballast to prevent “floatation” during earthquake liquefaction.

Secondly, the new bridge would only need to be six lanes and much less expensive than the 10 lane monster currently promoted.

This would mean smaller ramps

and less loss of agricultural land.

The new light rail would get commuters out of their cars and relieve pressure on the Oak Street bridge and so obviate the need to upgrade it.

Potentially a win-win solution for all the major stakeholders. Of course it would require an unusual level of coordination between the Province, TransLink, Metro, and various other municipal governments and quasi-government agencies.

hef Derek Bothwell remembers the exact moment when he started to think differently about the food he put on his plate, and into his body.

While travelling through Australia as a 19-year-old, Bothwell was perplexed that he couldn’t find the orange cheddar cheese he knew and loved from back home in Canada.

When he asked a grocery clerk where he could find the North American staple, he was met with a puzzled response.

“Orange cheese? Why would cheese be orange?”

The cheese he knew had been processed and dyed to hide its poor quality and poor ingredients.

“It never really dawned on me that cheese is

not supposed to be that colour,” he says. “That’s when I really started thinking about what I was putting inside me.”

Today Bothwell, who is the general manager of Chill Winston in Vancouver, knows exactly what goes into his food, because he controls almost every aspect of its production, from pasture to plate.

At Tsawwassen’s Earthwise Farm and Garden, he and his staff tend a plot where they grow fresh seasonal vegetables for the Gastown eatery, from carrots to lettuce, to squash and beets.

Bothwell comes down to the farm once a week and has every one of his staff members put in time digging in the dirt.

Knowing where your food comes from, and how much time and effort it takes to bring it to

the plate, gives his staff a greater appreciation for the ingredients they use.

“When your onions come in a crate that’s dropped off by a truck, whatever,” he says. “But once you see how much work goes into growing that onion, you treat with respect.

“And of course, they taste so much better, theres no comparison.”

Bothwell and his staff will be serving up local delicacies on Saturday, Nov. 2, as Earthwise Society hosts its fifth annual Hundred Mile Harvest Banquet.

The five-course gourmet feast celebrates local food and community, in addition to raising funds to help Earthwise continue to operate. Each year, hundreds of children visit the Earthwise Farm and Garden to learn about

growing food and to connect with nature, and thousands of pounds of fresh produce are distributed to those in need through Delta Food Coalition.

This year, Earthwise’s goal is to raise $15,000 in support of these programs.

Bothwell says he also hopes to raise awareness about the many positive aspects of buying local produce. Even in Delta, which is covered in farmland, the average food item travels between 2,500 and 4,000 km to reach our plates, gulping up fossil fuels along the way.

“First off, it’s the taste,” he says of what sets local produce apart. Because vegetables don’t have to be shipped long distances, they are picked ripe and served fresh, instead of being artificially preserved.

“But flavour and health aside, I think it’s important to support the local economy,” Bothwell says. “If people don’t support their local farms, they’re going to be gone. We have enough condominiums, but we don’t have a lot of organic farms.”

The 100-mile diet fad is anything but a fad, he explains. This is how the entire human race has eaten since time immemorial. But in the past century, something changed, and Bothwell and other locavores like him want to see it changed back.

“We’ve forgotten where our food comes from,” he says.

While eating a diet of locally-produced foods does limit one’s culinary options, Bothwell says he enjoys the challenge of having to cook seasonally.

“It increases your creativity, because you can’t go to your standbys and the things you’ve done before,” he says. “It forces you to try things you might never have tried.”

Much of the food for the Nov. 2 event has been grown at the Earthwise Farm and Garden.

Patricia Fleming is the executive director of the Earthwise Society and says that “gourmet” need not be

made with international ingredients to be exotic, and that supporting small farms and local food systems is both worthwhile and delicious.

“There’s a huge interest in eating healthy and nutritious foods,” she says. “So people are asking themselves, where does their food come from, where is it grown and how.”

Small scale farms at the edge of urban areas are very important in providing fresh, healthy delicious produce, she says.

“There’s an issue of food security,” says Fleming.

“Small urban farms can make fresh locally-grown produce more accessible.”

Starting a 100-mile diet is about reconnecting with where our food comes from, and she has just one simple piece of advice for those interested in eating more local foods.

“Know your farmer.”

Notice of Public Hearing – Southlands Application The Municipal Council of The Corporation of Delta will hold a Public Hearing, in accordance with the Local Government Act, to consider the bylaws and permits referred to below relating to the Southlands application:

Date: Monday October 28, Tuesday October 29 and Wednesday October 30, 2013 Time: 3:00 pm — 9:30 pm The Public Hearing will recess at approximately 6:00 pm each day and reconvene at 6:45 pm Place: South Delta Recreation Centre 1720 56 Street, Delta, BC Any persons who believe that their interest in property will be affected by the proposed project and bylaws shall be given an opportunity to be heard at the Public Hearing on matters contained in the bylaws and/or proposed by the application.

(File No. LU006390) Location: The Southland Properties, being 301 Boundary Bay Road, 500 Boundary Bay Road, 581 Boundary Bay Road, 6400 3 Avenue, an unaddressed property on 56 Street with the PID 007‑551‑061, an unaddressed property on 56 Street with the PID 007‑551‑070, and an unaddressed property on Timbervalley Road with the PID 007‑551‑347, as shown outlined in bold on MAP NO. 1.

Applicant: Patrick Cotter, Cotter Architects Telephone: 604‑272‑1477 Proposal: Application for Official Community Plan Amendment, Rezoning, Development Application Procedures Bylaw Amendment, Development Variance Permit, Development Permit and Phased Development Agreement in order to allow a comprehensive development that would include agricultural uses, natural habitat, public open spaces and greenways on approximately 80 percent of the subject site, and residential, commercial and institutional uses on the remaining approximately 20 percent of the subject site.

The subject site comprises seven properties with a combined area of 217 ha (537 ac). The application involves a request for 950 new residential units in various forms and densities, including single family homes, townhomes, apartments and live‑work units. A maximum of 7,432 m² (80,000 ft²) of ground‑oriented commercial space is also requested. The proposed amenities would include agricultural areas, a Market Square and related improvements, natural habitat, public open space and greenways on the lands to be transferred as amenities to The Corporation of Delta (Delta).

The owner proposes to transfer 172 ha (425 ac) of land to Delta to be held in public ownership. This amounts to approximately 80% of the total site, less the proposed 2.4 ha (6 ac) Southlands Homestead (see MAP NO. 2 for location of Southlands Homestead site). The land to be transferred to Delta would be used for agriculture, natural habitat, public open space (including a Market Square) and greenways.

The owner proposes to provide a $9 million amenity contribution that would be put in a special reserve fund administered by Delta for the sole purpose of improving agricultural drainage and providing irrigation designated by Delta to improve and sustain the capability of the agricultural land that is proposed to be transferred to Delta. The owner also proposes to provide Delta with an intersection amenity payment of $165,000 toward future improvements to the intersection at 56 Street and 12 Avenue.

The owner also proposes to lease back from Delta approximately 18.7 ha (46 ac) of the land proposed to be transferred to Delta for small‑scale farming in addition to leasing and operating the proposed Market Square area for a minimum of ten years. These proposed leases are not included in the Phased Development Agreement and will be subject to a separate application by the owner to Delta for approval of the terms and programs to be included in such leases. The owner has developed some conceptual plans regarding the possible small scale farming and the use of the Market Square facilities, but these conceptual plans have not yet progressed to a proposed lease stage. If the owner does develop the concepts into lease proposals that Delta is willing to consider, Council will provide an opportunity for public input before approving any leases to the owner. There will not be a separate or a continued Public Hearing for the review of the lease proposals.

The remainder of the agricultural land that would be transferred to Delta would be available for lease by Delta to third parties for larger scale soil‑based farming, subject to certain Agricultural Principles described in the Phased Development Agreement.

“The Corporation of Delta Official Community Plan Bylaw No. 3950, 1985” Amendment Bylaw No. 7167 To amend Section 1.8 of Schedule A of the Official Community Plan (Regional Context Statement) by replacing the Regional Context Statement Map with a new Regional Context Statement Map which is Schedule 7167‑1 to Bylaw No. 7167, to illustrate the following changes: • Change the regional land use designation of approximately 27% of the Southlands properties from Agricultural to General Urban, and include these lands within the Urban Containment Boundary; and • Change the regional land use designation of approximately 19% of the Southlands properties from Agricultural to Conservation and Recreation.

“The Corporation of Delta Official Community Plan Bylaw No. 3950, 1985” Amendment Bylaw No. 7168 To amend the land use designation for portions of the subject site in the Future Land Use Plan in Schedule A from A Agricultural to SV Southlands Village, SG Southlands Gateway, P Parks and Recreation Areas and ESA‑3 Environmentally Sensitive Area 3, as shown on MAP NO. 2.

To amend the land use designations for portions of the subject site in the Tsawwassen Future Land Use Plan in Schedule D.1 from AGR Agricultural to SV Southlands Village, SG Southlands Gateway, P Major Parks and Recreational Areas, and ESA-3 Environmentally Sensitive Area 3, as shown on MAP NO. 2.

To amend Schedule D.1 by deleting Objective D.2 and replacing it with a revised Objective D.2 as stated in the bylaw, deleting Policy D.1 and replacing it with a revised Policy D.1 as stated in the bylaw, and deleting the map entitled “The Southlands” and replacing it with a new map entitled “Southlands Agricultural Area and Guichon Property” as shown in the bylaw.

To designate portions of the subject site as SD5 Southlands Village Development Permit Area, as shown on MAP NO. 3, by identifying this Development Permit Area on Map IIB in Schedule E of the Official Community Plan; and adding the guidelines for the SD5 Southlands Village Development Permit Area provided in Schedule 7168-3 to the bylaw to Schedule E of the Official Community Plan.

“Delta Zoning Bylaw No. 2750, 1977” Amendment Bylaw No. 7169 To amend “Delta Zoning Bylaw No. 2750, 1977” by rezoning portions of the subject properties to P Public Use, Comprehensive Development (C.D.) Zone No. 423-R, Comprehensive Development (C.D.) Zone No. 423-MS and Comprehensive Development (C.D.) Zone No. 423-SH, while the remaining lands retain the current A1 Agriculture zoning. The proposed zoning for the different areas of the subject site is shown on MAP NO. 4. The proposed rezoning would permit a maximum of 950 residential units in the Comprehensive Development (C.D.) Zone No. 423R, one existing single family dwelling in the Comprehensive Development (C.D.) Zone No. 423-MS, and three existing single family dwellings in the Comprehensive Development (C.D.) Zone No. 423-SH, a maximum of 7,432 m² (80,000 ft²) of groundoriented commercial space in designated areas with a maximum building height of three storeys above a parking level.

Development Permit LU006390 To address streamside protection and enhancement issues related to the preservation, protection, restoration and enhancement of fish and wildlife and their habitats in and along streams, to protect the natural environment and to protect the development from hazardous conditions through siting and design control.

Development Variance Permit LU006390 To vary “Delta Subdivision and Development Standards Bylaw No. 5100, 1994” as follows: • Vary the standard road cross-section on 3 Avenue from Boundary Bay Road to 65B Street to requiring road widening for a 1.5 m (5 ft) wide cycle lane in the east bound direction, and not requiring lane widening, curb and gutter, sidewalk, streetlighting and landscaping.

• Vary the standard road cross-section along the 56 Street frontage to not requiring road widening, curb and gutter, sidewalk, streetlighting and landscaping.

• Vary the standard road cross-section along the Boundary Bay Road frontage to requiring road widening for a 1.5 m (5 ft) wide cycle lane in each direction, and not requiring curb and gutter, sidewalk, streetlighting and landscaping.

The proposed agreement also sets out the voluntary contribution by Century Industries Ltd. of certain amenities including land, buildings, a $9 million Agricultural Amenity Payment, Intersection Amenity Payment and Market Square improvements, as set out in the bylaw.

• Vary from the ornamental streetlighting standard to the proposed streetlight standard for streetlights to be located on all internal local roads, and provide pathway and parking area lighting of a similar standard.

The agreement, if adopted, would be in force for a period of 20 years provided that the other terms of the agreement are fulfilled.

• Waive the requirement to dedicate 3 m (10 ft) of roadway for the 6 Avenue frontage and the corner truncation dedication at the southeast corner of 6 Avenue and 56 Street.

• Require road dedication as required for traffic signalization improvements at 56 Street and 4 Avenue.

• Require water metering for all lots.

“Development Application Procedures Bylaw No. 4918, 1992” Amendment Bylaw No. 7170 To delegate authority to the Director of Community Planning and Development to issue and execute development permits in the SD5 Southlands Village Development Permit Area.

Phased Development Agreement Bylaw No. 7271 This bylaw proposes to authorize The Corporation of Delta to enter into a Phased Development Agreement with Century Industries Ltd. with respect to the lands shown outlined in bold on MAP NO. 1. The specified zoning bylaw provisions for the Phased Development Agreement include “Delta Zoning Bylaw No. 2750, 1977” and the following zones specific to the subject properties: Comprehensive Development (C.D.) Zone No. 423R, Comprehensive Development (C.D.) Zone No. 423-MS and Comprehensive Development (C.D.) Zone No. 423-SH. The zoning includes single family and multi-family residential units, commercial space, a Market Square, agriculture, natural habitat, public open space and greenways. The Phased Development Agreement would also establish a process to ensure the development maximum caps of 950 residential units and 7,432 m² (80,000 ft²) of commercial floor area are tied to the lands by way of registered covenant.

The agreement would require the provisions of the Zoning Bylaw that regulate items such as use, density, siting, location of buildings and subdivision requirements to apply to the subject site for the 20 year term as they stood at the date of this agreement unless otherwise agreed by the owner and Delta. The agreement would also require the subdivision and development standards for water, drainage, sanitary sewage, roads, streetlighting, traffic signals and landscaping set out in “Delta Subdivision and Development Standards Bylaw No. 5100, 1994” to apply for the 20 year term as they stood at the date of this agreement, as modified by the specified variances.

The proposed agreement also entitles the owner to transfer parcels or the property as a whole or in part to third parties. The Phased Development Agreement “runs with the land” in the case of a transfer of the entire development property, but Century Industries Ltd. can obtain a release from its obligations only if Delta enters into an assumption agreement to that effect among Century Industries Ltd., the transferee and Delta. In the case of transfers of subdivided portions of the development land Century Industries Ltd. would retain the responsibilities for servicing and any outstanding obligations under the Phased Development Agreement unless Delta agrees that such responsibilities would be assumed by a purchaser by entering into an assumption agreement among Century Industries Ltd., the purchaser and Delta pertaining to the property being purchased.

Although you renovate the home, it still may not have the layout, size, or the location your family needs/ wants. The Delta Photo Club and the South Delta Artists’ Guild have teamed up to present the art exhibition Interpretations: A Playful Exploration of Paintings and Photographs this month at Gallery 1710.

A sense of adventure and playful curiosity are the concepts behind Interpretations, a unique firsttime exhibit and collaboration between the South Delta Artists

Guild and the Delta Photo Club.

Artists often work from their own photographs, creating original artwork that reflects their own vision and artistic sensibilities.

Interpretations explores what would happen if a number of artists interpreted the same photo.

Members of the Delta Photo Club submitted photos from which SDAG artists explored their own interpretations. Similar to “plein” air painting challenges in which artists work from the same location and interpret a scene,

the fun lies in how each artist will convey his or her unique vision of the photograph.

The show runs until Nov. 17 at Gallery 1710 (Kiwanis Centre for the Visual Arts located at 18th Ave. and 56th St. Tsawwassen).

An opening reception is being held this Saturday, Oct. 19 from 1 to 4 p.m. featuring a live musical performance by Instant Connections.

The most important thing a home owner could do is ensure their wood-burning fireplace is swept, cleaned and have a visual inspection yearly to ensure there are not any blockages, creosote build up or deficiencies that could increase the risk of chimney fires.

Having proper hearth extensions in front of the fireplace along with a spark screen that properly covers or closes will ensure that embers stay inside the firebox. Also, a good set of hearth tools will allow the home owner to safely add or adjust logs while burning.

Responsible wood-burning should include using only properly dried wood and not burning paper, garbage, overly wet wood, or treated wood as these items can increase the build-up of creosote in the chimney, deteriorate the firebrick and flue liner, plus add unpleasant pollutants and smoke in the air.

This year we have noticed an increased interest in wood-burning solutions with a focus on high-efficient inserts and stoves which are designed for safer burning while giving the home owner a strong heat source for their home. Preventing inflammation: a roadmap to better health Happiest fall wishes everyone! I thought I would address some questions about inflammation that have come up frequently at The Village Clinic.

How does inflammation affect my health?

Inflammation is the body’s natural response to injury and to outside invaders that your body perceives as a threat. For example, if you sprain an ankle it will swell. Get a splinter, and see the redness on your finger as your body mounts an immune response. Your body eventually heals and the inflammation goes away. However, research is now clear that sometimes our bodies are in a low grade and sometimes not so low grade inflammatory state.

In a chronic state of inflammation, the inflammation can settle into your muscles, joints and tissues. Research has shown that inflammation is a leading cause of many diseases including cardiovascular disease, cancers, colitis, Alzheimer’s, psoriasis, ADD, arthritis, chronic pain states, and more.

Chronic low grade inflammation in our bodies can have devastating effects on our health long term. Stress, poor diet, obesity, lack of exercise, genetic predisposition and toxins can all contribute to increasing chronic inflammation.

Preventing and reducing inflammatory states is vital. And that is where naturopathic medicine can shine.

I still believe an integrative medical approach is fantastic in helping achieve optimal health. I also know that reducing inflammation in a body can improve patients symptoms and conditions, often quite profoundly. Western society feeds inflammatory states – we wash down some processed food with a pop while driving stressed because we are late to our next meeting. Truly this is fuel to our inflammatory state.

An anti inflammatory diet is low in the three so-called evils: sugar, dairy and wheat is a great place to start. One of my nutrition professors used to say, “Eat real food. Not too much. With many colours. Mindfully. And don’t forget to drink water.”

Supplements like antioxidants, vitamin c, turmeric, omega three fish oils and many more are very helpful. The evidence base for these vitamins and supplements is very clear. A 2009 study by the Institute of Human Nutrition in the UK found very positive results in inflammation reduction with the use of probiotics, especially with kids suffering from irritable bowel syndrome and

adults with ulcerative colitis. The study also found reductions in allergy symptoms with probiotic supplementation.

Inflammation can be a good thing in the short term. It can help us heal. But we need to be more proactive in reducing chronic inflamma-

tion so that we can live happier and healthier lives.

Alberni plan no threat to Deltaport ❙ Jeff Nagel reporter news@southdeltaleader.com

A proposal by Port Alberni to act as a shipping hub for both Metro Vancouver and Seattle is being pitched as a way to get trucks off the road by sending containers up the Fraser River by barge.

The concept is that a $1-billion 300-acre container handling terminal would be built along the inlet at Port Alberni, where containers would be offloaded, organized and then floated on barges to destinations in the Lower Mainland and Puget Sound.

Big container ships that now sail past Alberni Inlet could stop, offload all their cargo and return to sea, cutting off three to four days of extra sailing normally spent visiting other terminals, says Alberni Port manager Zoran Knezevic.

Virtually no containers now go up the Fraser River but Knezevic said barges could readily reach the distribution centres of Walmart, Canadian Tire, Home Depot and most other major retailers that are dotted along the river in Richmond, Delta, Surrey and Coquitlam.

That would reduce the amount of trucking now required to haul containers to those centres from either Burrard Inlet or Deltaport.

“It’s a much more efficient, environmentally friendly and cost-effective way to move containers,” said Knezevic, who presented the idea Wednesday to Metro Vancouver directors.

He said the use of the river as a “natural highway” could reduce the

one million containers that now moved by truck in the Lower Mainland each year, congesting the roads.

The concept is still in the preliminary stages and no detailed business case has been prepared.

But Knezevic said it has run into early skepticism and concern from Port Metro Vancouver officials, who fear port expansion opponents will seize on it as evidence their huge Terminal 2 container expansion proposal at Deltaport is unnecessary.

He denies the Alberni proposal is a threat to Deltaport.

“It’s not competitive, we’re not going to rob anybody,” Knezevic said.

“We are looking at doubling the number of containers coming through Port Metro Vancouver so I think they could easily complement each other.”

The Alberni port’s written presentation notes its “much smaller environmental impact” compared to Terminal 2.

Richmond Mayor Malcolm Brodie said the Alberni proposal is interesting because smaller barges can readily send goods up the river without removing the Massey Tunnel and attempting to dredge the channel deeper for big ships.

“This offers a possible opportunity to restructure the requirements we have in the Lower Mainland where we have congested roads, very high cost of land and a $3-billion project to take away the George Massey tunnel and build a bridge,” Brodie said.

Peter Xotta, Port Metro Vancouver’s vice-president of planning and op-

erations, also told Metro directors the port will need to explore alternative methods of moving containers, and Port Alberni’s proposal may be part of the solution.

Xotta noted terminals in Metro Vancouver have the advantage of rail access that brings containers loaded with forest products or grain, which then end up empty and perfectly positioned to take retail goods.

“We need to think about what’s getting back into that container to go the other way.”

Area mayors want the

port to do more to extend their hours of operation, so trucks could haul more containers at night instead of clogging roads during commuting hours.

“Port Metro Vancouver is very directly and aggressively attacking this issue,” Xotta said.

He cited the construction of multiple overpasses that are reducing congestion at railway level crossings. Xotta said some night offloads do happen from port terminals but it tends not to be done with enough advance notice for destination warehouses to be open to receive at night.

The Sun Devils are still undefeated in Southern AA Conference action with a perfect 3-0 record to top the standings, and haven’t lost to a AA team since 2011.

Canadian authorities were notified after the US Coast Guard found the body of an adult male in US waters.
