Skugaid owner’s access limited Judge adjourns sentencing
MARIO BARTEL/NEWSLEADER
With a limited income, Desiree Wells says she does as much of her shopping as she can at thrift stores, but she still finds herself trapped in the payday loan cycle when money comes up short.
Are payday loans a bum deal? Some say they prey on the poor, others say they’re a necessary evil Chris Bryan
editor@newwestnewsleader.com
A few months ago, Desiree Wells’ paycheque arrived a couple days late. What would be an inconvenience for some turned into a serious headache when payments for her phone, internet, tablet and payday loan were charged to her empty bank account, resulting in significant NSF (non-sufficient
funds) charges. Wells has an artificial leg which she says limits her ability to work, and earns about $1,000-$1,200 a month providing child care and selling the jewelry she makes. The New Westminster woman lives frugally and shares an apartment with a boyfriend and roommates. The NSF charges have spiralled into the hundreds of dollars, and are the most recent financial difficulty for Wells, who has a bank account but no overdraft due to lack of a positive credit history.
Compounding tight finances is a payday loan habit that she can’t shake. About a year ago, she was short of cash and resorted to an online payday lender for an extra $100. Though she paid it back in full, including the interest fee of about 40 per cent, it meant she was now down about $140 the following month. “Like I’m sure everybody can attest, you get one (payday loan), then the next month you get a little bit more because of what you have to repay,” said Wells. “Then like a
snowball it just gets out of control.” The loan has ballooned to $350 a month, with the interest bringing that number to $500. “It’s now costing me almost $150 every month, just to pay the interest.” She’s managed to hold the line at $350, but it means her already meagre income is significantly diminished. Because Wells’ payday loan was secured online, it was likely not subject to any rules, such as limits on the interest charged. Please see ANNUAL INTEREST, A3

Although a judge has postponed sentencing the owner of a boat docked at the Westminster Quay on a contempt charge his access to the vessel has been restricted. B.C. Supreme Court Justice Victoria Gray has adjourned the sentencing of David Cobb until Aug. 15 to give him time to remove the centuryold Chief Skugaid from a City of New Westminster-owned mooring in front of the Fraser River Discovery Centre. Cobb moved the 100-year-old working boat there in April to avoid legal action from the private owners of the land next door where the Skugaid had been docked since June 2011. The city didn’t want the Skugaid on their property either so they went to court to evict him. An arrangement was made for Cobb to have the boat removed by June 14. Cobb told the NewsLeader then while liability issues made it difficult for him to find a commercial marina willing to take such a large, old boat he would find a spot in time but had yet to move it as of Thursday. CBA MOSAIC TILE UNVEILING CEREMONY Sunday, August 11, 2013 11:00 – 11:45 a.m. Southwest Corner of Columbia and McKenzie Streets The Chinese Benevolent Association (CBA) of Vancouver and the City of New Westminster would like to invite the public to attend the unveiling of a mosaic tile to commemorate early Chinese immigrants to New Westminster. The mosaic, commissioned by the CBA and designed and created by Liz Calvin, depicts the ancient Chinese folk art of paper cutting which has a history of more than 1,500 years. The mosaic is one of nine mosaics which tell the compelling story of economic and social development in the Downtown. The mosaics are located on Columbia Street between Fourth and Eighth Streets.

There’s a fixed cost to the borrowing, the CPLA says, and it’s clearly stated up front. As well, says CPLA president Stan Keyes, dealing with a licensed payday lender is a safer option than turning to an unregulated online lender that could be offshore. “Or to someone in a pool hall where physical harm might be part of the contract,” Keyes said. And bluntly put, payday loan businesses are willing to gamble on a risky venture—people whose finances are already touchand-go. Those who lend to high risk borrowers will experience higher losses.

In fact, the industry has grown because this need has not been met by traditional financial institutions. Just a few years ago, payday lenders were effectively unregulated in Canada. Though payday loans have always exceeded the 60 per cent maximum annual interest outlined in the Criminal Code of Canada, provinces avoided pursuing any criminal action as payday lenders were seen as preferable to black market lending. Late in the last decade, however, Ottawa called on the provinces to install comprehensive legislation and now there is a patchwork of rules across the country. B.C., Alberta and Saskatchewan have similar laws about what can be charged. Please see neW ruLes, A4

Weapons seized in Downtown apartment

Several weapons were seized and two people arrested in a ground-floor apartment near Downtown New Westminster Wednesday. Acting on a search warrant, the NWPD’s street crime unit along with the Lower Mainland’s emergency response team descended on the unit in the 200 block of Carnarvon Street about 7:20 p.m. arresting a man and a woman and seizing several items. Staff-Sgt. Paul Hyland said the residence had been a problem for a long time and police had been monitoring and gathering evidence. “Any time you’re finding multiple firearms, allegedly illegally kept, you’re certainly surprised,” said Hyland of what the police found. “We’re just happy they’re out of the hands of these individuals.” Hyland said the sawed-off bolt action rifle and the eight-millimetre handgun seized only had one purpose and that was to be concealed. Ammunition for both was also seized. Two replica handguns, a replica sub-machine gun and a replica assault rifle were also found. Hyland said although the weapons were capable of only firing pellets, they could easily be mistaken for the real thing. “If someone was to be carrying this around it would be a jolt to anybody seeing them.” Also seized were several hunting knives, a compound hunting bow, several cans of pepper spray, a small quantity of drugs believed to be

QUESTION OF THE WEEK:
Time to legalize?
LAST WEEK:
There’s a reverse echo going on around the country. Whenever Liberal leader Justin Trudeau says something, his comments are invariably followed by a response, usually snide, from the Prime Minister’s Office, in other words, Stephen Harper. Last week, Trudeau was in B.C. and he spoke for the decriminalization of marijuana. He said it’s no worse than smoking or drinking alcohol. And just like those vices, legalizing marijuana would allow the government to tax and regulate it accordingly. Not surprisingly, the PMO came out chastising Trudeau for his comments. Why not? Harper has nurtured a tough on crime reputation. To the Conservative government’s credit crime across Canada appears to be on the decrease, according to Stats Canada data released recently. Interestingly enough, statistics for marijuana-related offences are on the rise and began rising at about the time Harper and the Conservatives won their first minority government. Coincidence? The point is, the Conservative government, previous governments and the U.S. federal and state governments have tried to put the lid on marijuana cultivation, distribution and use. The end result has been a very expensive failure. Estimates of the annual value of the marijuana economy vary, but let’s pick a conservative $10 billion. If marijuana were legalized, the federal government could keep $9 billion and pass $1 billion off to health care, education or social housing. What about endangered species, the coast guard or infrastructure upgrades? It’s time to rethink the approach to the war on drugs, legalizing marijuana would be a profitable and useful first step. —Penticton Western News

B.C. aboriginal progress fragile VICTORIA – The ceremonies have become common at the B.C. legislature. Government officials and aboriginal leaders gather to celebrate resource sharing agreements that allow economic development in areas that need employment but are hampered by a century of uncertainty and dispute over treaties, or lack thereof. This approach emerged a decade ago with forest agreements. The B.C. Liberal government bought back timber cutting licences from big forest firms and made them available for community forests and aboriginal communities who claimed the areas as their traditional territories. Recently the approach was extended to mining revenues and water licence fees paid by private power developers. These are substantial steps forward for the only province in Canada in treaty limbo. A 2010 sharing deal worth more than $30 million in royalties for the Mount Milligan copper-gold mine north of Prince George helped the McLeod Lake Indian Band recover from the pine beetle and forestry slump that devastated its business base.
Tom Fletcher tfletcher@blackpress.ca
After many years of struggle, Mount Milligan expects to go into production this year. Another agreement with Kamloops-area communities shared revenues from an expanded Afton mine. Perhaps the most ambitious agreement was concluded in March of this year when the government signed a deal with the Tahltan Nation for mining and hydroelectric development in remote northwestern B.C. The deal clears the way for a major extension of the BC Hydro grid to power the Tahltan village of Iskut and also the Red Chris metal mine, opening up the region to other mining and hydro potential as well. To get that deal, the province put up $20 million last year to buy back Shell Canada’s coalbed gas leases in the Klappan region, headwaters of the Nass, Skeena and Stikine Rivers.

LE DER
Those leases had become a target of international protest. Even after these expensive concessions, it would be an error to conclude that all is well between the Tahltan and the province. Stikine MLA Doug Donaldson questioned Aboriginal Relations Minister John Rustad on this point during the recent legislature session. The Tahltan Central Council was pleased about shared decision-making on resource projects, until they found out that B.C. had handed the environmental assessment of a new open-pit coal mine over to the federal government. The proposed mine is in the Klappan, known around the world as the Sacred Headwaters. Rustad said shared decisionmaking deals such as the Tahltan agreement do not cover activities of the B.C. Environmental Assessment Office. Whether the review of that coal mine is federal, provincial or combined, it requires extensive consultation with affected parties. That’s great, but all that goodwill could evaporate quickly if a coal mine ends up getting a permit despite Tahltan objections.

Rustad’s Nechako Lakes constituency is also a focal point for oil and gas pipeline proposals. Donaldson highlighted another problem. Last year the government signed a reconciliation agreement with the Gitanyow First Nation near Terrace, one of many communities struggling to get through the B.C. treaty negotiation process. That agreement included a joint land-use plan. Then the Environmental Assessment Office asked the Gitanyow for its input on proposed gas pipelines through its territory, to feed the government’s liquefied natural gas plans. Again, the joint land-use plan has no provision for pipelines. The Gitanyow hereditary chiefs wrote to the B.C. government in July, threatening to go to court over the pipeline proposal and questioning the value of their hard-won reconciliation agreement. Resource revenue sharing agreements and shared landuse plans are well-intentioned and represent real progress. But these situations show how fragile they are.

COMMENT
Bring a bag, clean up We have a serious problem at dog parks in New West. The purpose of dog parks is to provide canines with exercise and socialization. They need to be safe and sanitary. There is a minority of park users who are either careless or ignorant. The careless ones do not pay attention to their pet and therefore miss when their pet does its business. I promise you, if you bring your dog to a dog park they will do a poo, so pay attention to your pooch and clean it up! The ignorant ones are another story—they simply don’t care, oblivious to fact the disease and debris left behind affects their pets too. And so they probably should not be pet owners. There is lots of nasty left behind in plain sight and given the variety of evidence, offenders range from the owners of chihuahuas right through to Great Danes. We all need to make an effort to keep all play areas clean
and safe for our pets. Come on people, take responsibility— bring a bag, clean up. Larry Hill New Westminster
Public needs to know Re: Price of victory (Editorial, NewsLeader, July 24) Approximately 60,000 BC Hydro customers emerged victorious in fighting the installation of smart meters? Apparently, the provincial government announced those customers who have not yet had the smart meters installed now have the right to refuse them and keep their present analog ones. I understand those rights come with a price—a monthly fee of $20 to have BC Hydro come read the analog meter. These customers would also be subject to some consequences. We proclaim this a victory? In my opinion it is no more than a tactic to keep peoples’ mouths shut with a fee and
consequences attached. It can hardly be recognized as a “victory.” That said, my biggest concern is the apparent health effects some smart meter opponents are attributing to these meters, such as headaches, chest pains, burning skin, high blood pressure and sterility, to mention a few. I had my smart meter installed two years ago and though to date I have not experienced any symptoms, I do think our government should conduct a study on health risks potentially attributed to these smart meters. The public should be well informed. Frank Di Cesare Burnaby

Pattullo closed this weekend The second of three weekend Pattullo Bridge closures this summer will take place this weekend. TransLink will close the bridge on Friday at 9 p.m. until Monday at 3 a.m. Crews will be repairing sections of the concrete deck and repaving portions of the bridge. The work will not involve structural issues such as narrow lanes, barriers to protect pedestrians and cyclists, or seismic concerns that have caused TransLink to explore options of replacing or repairing the bridge in its 76th year. The first closure occurred the weekend of July 20-21 with the final one coming Aug. 24-25. If heavy rain causes a postponement of any of the work, it will be completed the Sept. 7-8 weekend.

A distressed person showed up at the front counter of the New Westminster police department recently who benefited from a recent agreement between the NWPD and Fraser Health (FH). It was clear they had mental health issues, and Const. Art Wlodyka, the NWPD’s mental health liaison officer, who was sitting at his desk nearby, quickly got up to speak to them, and within a few minutes had summoned a mental health worker from Fraser Health (FH) to assist and assess what could be done to help them out. “That would not have happened if [Wlodyka] wasn’t in that position,” says Sgt. Diana McDaniel, who witnessed the incident. “A member would have been dispatched to the front lobby and there would have been yelling and screaming and they would have been irate and disruptive.” Although there has been a loose arrangement between the two organizations for a while, it was formalized in June and announced last Thursday. The partnership includes Fraser Health providing consultation when officers are concerned about somebody
experiencing mental health issues or having a substance-related crisis, outreach to clients, referrals to mental health teams or any other appropriate agency, and sharing of expertise that increases police knowledge of mental health issues. There is also a psychiatric liaison service with the Royal Columbian Hospital emergency department. “It’s going extremely well,” said McDaniel. “The communication has been fantastic, very open. Certain cases have been able to be dealt with much quicker and much more effectively having that team.” It’s a program that has already proved successful in other areas for Fraser Health including Burnaby, the Tri-Cities, Abbotsford and Chilliwack. Andrea Haworth, a Fraser Health mental health coordinator in New Westminster, said the program allows for mental health workers to be available to decrease crises and be more preventative, often avoiding having to hospitalize patients while getting them on the right track. She added the police also get firsthand experience learning how to deal with various mental health issues. “It’s a win-win,” said Haworth.

Tenancy Act that would make landlords more responsible to provide safe, adequate housing, establish mandatory penalties for those who don’t and implement a regime of provincial inspectors to ensure the timeliness and quality of repairs. “I heard the stories,” said McGovern, the chair of Burnaby’s chapter of ACORN. Those included neglectful landlords who didn’t keep their properties in good repair or ignore pest problems and intimidation by landlords. “We need more protection for tenants from those kinds of landlords,” said McGovern.
The general lack of lowincome housing compounds the problems, said McGovern, because many tenants are afraid to stand up against troublesome landlords and risk getting put out onto the street. “It’s frustrating,” said McGovern. “People are desperate, so they’ll take what they can get.” A leaflet handed out by ACORN members asked for a meeting with Housing Minister Rich Coleman so he can “take action to protect the citizens of B.C. who are renters.” “We’re just hoping for a bit of sympathy,” said McGovern.

No ‘showdown’ with teachers By Tom Fletcher Black Press
The B.C. government is pressing ahead with its goal of a 10-year agreement with B.C. teachers, appointing a “public administrator” to replace school trustees on the board of their provincial bargaining agency. Education Minister Peter Fassbender said the change is temporary, and the B.C. Public School Employers’ Association will continue to play an important role in talks with teachers and support staff. BCPSEA will be under the direction of Michael Marchbank, CEO of the Hospital Employers’ Association, when talks with the B.C. Teachers’
uP to
Federation resume in September. Fassbender’s announcement surprised school trustees around the province. He said he spoke to or left messages for trustees on the BCPSEA executive before making the announcement in Vancouver Wednesday. The move is to meet a demand of the B.C. Teachers’ Federation to bargain directly with the B.C. government, Fassbender said. The government also intends to eliminate essential services rules that keep schools open with minimum staff during strikes. Fassbender denied the suggestion he is setting up a “showdown” with teachers that would
shut down schools and turn the public against unions. The structural change is needed to achieve the stability for students and parents promised by Premier Christy Clark, he said. “It’s not about pitting them against us,” Fassbender said. “It’s about finding a new road map where we can achieve that goal.” A two-year contract extension and wage
freeze imposed by the government on teachers expired at the end of June. Jim Iker, who took over this spring as BCTF president, told CKNW Thursday his union isn’t opposed to a long-term settlement, as long as more resources are there to improve classroom conditions. The BCTF is returning to court this fall to seek restoration of bargaining for class
size and special needs support. School support staff represented by the Canadian Union of Public Employees are to resume negotiations for a new contract this month, after walking away last spring because their negotiators didn’t believe BCPSEA had an adequate mandate to get a settlement. CUPE employees have not had a raise in four years.

Artist finds inspiration close to home New Westminster Cultural Crawl returns this weekend Mario Bartel
photo@newwestnewsleader.com
Artist Lorrie Wager doesn’t just live in Queensborough. She’s inspired by it. Since moving to the Port Royal neighbourhood three years ago, Wager’s found herself creating more and more pieces from the things she sees and experiences while walking her dog Leo along the waterfront trails every morning. When a scene or moment catches her eye, she captures it with her cellphone camera and the digital image will eventually become the basis for a multimedia piece or painting she creates in her garage studio. Wager, who’s one of the featured artists in the New Westminster Cultural Crawl that runs Aug. 10 and 11, is a firm believer in working “on what you know and what’s familiar.” By exploring her immediate environs,
she says, she’s “creating a different language of my space. I’m creating a sense of place for myself.” Wager hopes her artistic interpretations of scenes that are easy to overlook will give others a new “appreciation of the little bits of things they can see. “Everyday things can look beautiful,” says Wager, who works as an art programmer for the City of Vancouver. Even the rusting barges moored along the channel near Wager’s home, or the vast expanse of new cars freshly offloaded from huge transport ships can have an innate beauty when the light is hitting them just right. “Sometimes it just hits you,” says Wager. The ever-changing character of the flowing Fraser is also an endless source of fascination, says Wager. “I love the way the river is alive. Every month it looks different.” • For a full guide to the artists and MARIO BARTEL/NEWSLEADER Lorrie Wager finds inspiration for her art while walking her dog Leo along the trails near her Queensborough venues in this year’s Cultural Crawl, go to home. She is survived by: husband Arthur (Bud) Smith, children La-Lonnie Oster (Larry), son Dallis Smith (Linda) & with her first husband, Henning Jensen (deceased 1944), son Wayne Jensen (Marian) & daughter Diane Wark (Pete). She dearly loved all her family including 6 grandchildren & 4 great grandchildren, her surviving siblings, Peggy, Grace, Fraser, many cousins, nieces, nephews & their families. There was always music in their life & home. Her last 13 months were spent in Extended Care, where she loved to listen to her favorite songs on her MP3 player.
