The Delta woman convicted of killing fouryear-old Alexa Middelaer in a 2008 drunk driving crash has had her appeal of her two-and-a-half jail sentence dismissed by the B.C. Court of Appeal Thursday in Vancouver.

Carol Berner surrendered herself into custody following the dissmissal. She was convicted in 2010 of two counts of dangerous driving causing death and bodily harm and two counts of impaired driving causing death and bodily harm.

Berner’s lawyer David Tarnow argued that a one minute and 42 second video of Alexa Middelaer’s preschool Christmas play shown to the courtroom during the victim impact statement at sentencing was influential to the trial judge.

“To allow this to have been done at a sentencing hearing just escalated [emotions] to a level I haven’t seen in 36 years,” said Tarnow, adding this may have contributed to

the length of the sentence.

He also argued the length of the sentence was out of step with other cases involving dangerous driving causing death, and with Berner’s lack of a criminal history she was a “perfect candidate for a community sentence.”

“She’s been on bail for years now and there’s never been any problem,” he said.

But B.C. appeals court justices Christopher Hinkson, Anne MacKenzie, and Catherine Ryan determined the sentence was well within the allowable minimum of 18 months and seven years.

Tarnow admitted the trial judge did not actually see the Christmas video either, nor could he prove it would have had an effect on his judgment.

The Court of Appeal dismissed Berner’s appeal of her sentence but a written ruling will not be issued until a later date.

Berner can still take the appeal of her sentence to the highest court, the Supreme Court of Canada, but her lawyer Jason Tarnow said she has not yet indicated a desire to do so.

“This journey has taken almost five years, which is longer than my daughter was alive,” said Michael Middelaer, father of Alexa, outside the courtoom.

He called the appeal yet another step in the

As for the Christmas video, Middelaer didn’t

think it was unduly influential to the sentencing process.

“The fact of the matter is, that video was brought in by our family to make the courts and society recognize what we are discussing, we’re discussing the loss of a child,” he said.

Berner had previously appealed her conviction to the B.C. Court of Appeal and the Supreme Court of Canada. In both cases, her appeals were dismissed.

Berner’s lawyers argued the trial judge had erred in finding the destruction of Berner’s Oldsmobile by ICBC, before the defence could have it independently inspected for mechanical defects didn’t infringe on her right to make a full defence.

They also argued Berner was found guilty despite a lack of evidence of impairment, and that she had not been advised of her right to counsel before her tape-recorded statement was taken.

On May 17, 2008, four-year-old Alexa – who attended preschool in Crescent Beach – was feeding a horse in Ladner, when Berner struck and killed her. Alexa’s aunt was also seriously injured.

Berner was sentenced to two-and-a-half years in prison and banned from driving for five years, but has so far served just days in custody, having been out on bail pending her appeals.

Canada Post announced Tuesday it will be closing the Ladner Post Office effective April 27, leaving downtown Ladner without a full service retail postal outlet. The closure comes as Canada Post posted its first annual loss in more than 15 years, coming up $325 million short last fiscal year.

Canada Post spokesperson Anick Losier said the Crown corporation has had to make difficult decisions in order to balance it books, but closing a post office is not something they do lightly.

“We have seen a 25 per cent decline in letter volume, so that’s 2 million fewer letters across the system everyday, and Delta is no different than Cape Breton,” she said. “We’re trying to ensure the long-term viability of the organization.”

While consumers opt for emails and online billing over traditional mail service, parcel delivery is increasing with the growth of online

shopping, Losier said.

However, that increase in parcel delivery has not been enough to offset the decreases in letter volume.

Canada Post announced in January it was considering closing its Ladner branch, which has operated at the corner of Delta Street and 48th Avenue since the early 1950s.

Canada Post held a 30-day public consultation before deciding to close the post office, Losier said.

“We look at traffic, transactions, revenue over a five-year period, and is the community well-served [by other postal outlets] in the area,” she said.

“We have to detach from the nostalgia and the emotional aspect, and make the best business decision, the status quo would be much easier, but we have to make the hard decisions.”

The Ladner branch was one of four post offices announced for closure on Tuesday, along with three branches in Montreal.

Losier said there are no immediate plans to sell the building at the corner of Delta Street. Canada Post will con-

The two full-time counter workers will be reassigned elsewhere in Canada Post.

Canada Post said customers will still be served by two post offices within a

five kilometre distance of the 48th Avenue and Delta Street location, with a retail outlet in the Pharmasave on Elliott Street two blocks away, and the Canadian Tire in Richmond.

The move to close the retail location in Ladner doesn’t sit well with Stephen Gale of the Canadian Union of Postal Workers, Fraser Valley West.

“The Ladner Post Office has been a central part of the Ladner community for many years,” said Gale. “The citizens of Ladner will now have no other option other than the one remaining private postal outlet located in Ladner unless they want to drive into Richmond to go to a Canada Post corporate post office.”

Canada Post corporate branches offer specialized services such as admail consultation and sales, passport application verification, student loan application verification, he added.

This news is devastating for the two full-time employees that work at the Ladner post office, Gale said.

“These two employees have worked for Canada Post for 37 and 31 years respectively and both live in Ladner,” he said. “[They] will be forced to relocate to either North Surrey, Langley or Aldergrove to maintain their employment with Canada Post. These two employees had to work many years before they were fortunate enough to be able to work close to home and now that is being taken away.”

Ladner Trunk Road will become more bicycle-friendly over the next two years as the Corporation installs bike lanes eastbound from Highway 17 to 72nd Street.

The $675,000 project will add 1.8 metre bike lanes on both sides of the road from Highway 17 to 64th Street in 2013, and then extend them to 72nd Street in 2014.

The province will contribute $176,050 to connect the cycling network to the South Fraser Perimeter Road through the province’s Bike BC program.

“In terms of active transportation for Delta, this is a huge step,” said Carol Vignale, who sits on Delta’s Environment Advisory Committee.

Vignale said that becoming more active as people age is a key component to maintaining proper health.

“You don’t have to pay a fee to a gym or you don’t have to go out of your way to be active, you just have to get from A to B,” she said.

Vignale, whose principal form of transportation is bicycle, has been involved in trying to get more active transportation for Tsawwassen, including bike lanes on 56th Street.

Matthew Wollin, an employee at Delta Bike Company in Tsawwassen and a member of the Boundary Bay Cycling Club, said there are definitely some difficult areas for

cyclists to navigate in South Delta, particularly getting into Tsawwassen.

“You’re fighting side by side with cars and you don’t really get the respect that cyclists deserve,” he said.

Wollin said Ladner Trunk Road is too narrow for most cyclists right now, particularly when semi trucks share the road, but bike lanes would greatly improve cyclist safety.

Areas in South Delta with the least amount of traffic are generally the most popular for cyclists, such as Westham Island and River Road.

Bike BC is a provincial program contributing $31 million in 2013 to communities across the province to improve cycling infrastructure.

Excalibur Party looking for local candidates for May election New political party created to fight voter disillusionment ❙ Adrian MacNair adrian@southdeltaleader.com

The name of B.C.’s newest political party conjures up images of King Arthur and the magical sword in the stone, but its leader is hoping to draw political inspiration from the legend.

Michael Halliday came up with the name BC Excalibur Party during a moment of sudden inspiration.

“It’s quite funny because even people that

have trouble remembering things say they don’t forget the name,” said Halliday from his home in Abbotsford.

According to the legend, the sword of Excalibur united a people during a time of social unrest and the crumbling of society. It ushered in a golden age of knightly ideals—truth, honour, and justice, the motto of the BC Excalibur Party.

Halliday said he decided to start the party after speaking to friends who were fed up with the current political choices.

“I think I’d just gotten to the point where I’d had it with political

parties,” he said.

But it’s not because people are apathetic— Halliday said they’re just sick of the current choices.

“They’re probably in the same boat I am. I mean, who do you vote for?”

Instead, Halliday started his own political party complete with a platform that looks at health care, employment, education, and the full gamut of issues facing voters as they head to the polls on May 14.

Halliday said the party is now looking for candidates to run across the province. Currently there are 13 people

who have indicated an interest in joining the Excalibur Party, but none have officially registered. That includes Halliday himself, who has designs on the riding of Chilliwack.

Halliday isn’t just

looking at the Excalibur Party as a place for people to register a protest vote. He said he identifies with the 50 per cent of eligible voters who choose not to vote each year because the current options—NDP,

Conservative, Liberal, and Green—don’t represent what people want.

“I see ourselves as the actual option for people that are disillusioned,” he said.

Halliday ran for office

in the 2009 election in the riding of Vancouver-False Creek as an independent, garnering 73 of the 16,354 votes cast.

Poll finds support for TransLink tolls, taxes ❙ Jeff Nagel reporter Most Lower Mainland residents are willing to pony up more money for TransLink, but they’re split on exactly what kind of new tax, fee or toll should be imposed. That’s the result of a new online poll conducted by Insights West.

It found 72 per cent of respondents support new funding sources for the troubled transportation authority, which needs billions of dollars to launch rapid transit expansions and maintain the existing system. About half of those supporters want new cash sources balanced with some service cuts as well, while 12 per cent opposed any new funding and say TransLink should simply make cuts.

“I am shocked at the number of people who are actually open to new funding options,” Insights West president Steve Mossop said, adding the results undercut the perception of near-universal public opposition to more money for TransLink.

Those polled were asked if they support raising existing transit fares, property taxes or fuel taxes, or adding new tools like a vehicle levy, a regional carbon tax, new

road or bridge tolls, or a dedicated regional sales tax recently proposed by mayors.

The option that scored best with 37 per cent support was raising transit fares, although backing was lopsided, with regular transit users strongly opposed. But a close and “surprising” second, according to Mossop, was road and bridge tolls, with 36 per cent support and a much more balanced response from both frequent and infrequent transit users.

Mossop said he believes initial anger about the tolling of the Port Mann Bridge is fading fast as drivers get used to the new reality. And he said the results give more ammunition to Metro Vancouver mayors, who want the province to allow comprehensive road pricing – adding small road tolls everywhere instead of just tolling certain bridges.

The option with the third most support was an annual vehicle levy, at 33 per cent, followed by a regional carbon tax at 26 per cent. The most unpopular source is the mayors’ proposal to add a new sales tax within Metro Vancouver of up to 0.5 per cent – 79 per cent of those polled opposed that idea.

MLA shaped by Cold War upbringing

outh Delta independant MLA Vicki Huntington took a roundabout route to politics, but given her pedigree, she was likely destined for public office.

Huntington graduated from UBC in the late 1960s with a degree in political science, and is the daughter of former Progressive Conservative MP and cabinet minister Ron Huntington. She describes herself as a “child of the Cold War,” and that conflict made her appreciate the power and value of democratic rights and principles.

“It’s driven everything I’ve done since,” she says.

Huntington joined the Canadian Army Intelligence Reserve Corps after graduating, and was one of the first women to go through boot camp at CFB Borden under the program. She eventually opted for officer training, attaining the rank of Second Lieutenant.

Women still weren’t allowed to join the RCMP in the early 1970s, so when Huntington decided to join its security services branch, she had to do so as a civilian member, eventually becoming a spe-

cial constable. Huntington eventually landed the position of executive assistant to Canadian Solicitor General Elmer MacKay in Ottawa, thanks in part to her father’s connections in government.

Huntington got involved in local politics after joining Delta Council’s Community Advisory Committee, and in 1993 won the first of four terms on council, running on the same slate as her current provincial opponent, Coun. Bruce McDonald.

“I respect him a great deal, but he’s so deliberately and unequivocally a Liberal,” says Huntington.

“There’s always been a substantial difference of opinion there.”

In 2005, Huntington decided to run provincially after she became fed up with what she felt were arrogant Liberal policies that were hurting Delta.

“They tried to close the Delta Hospital, they lied about the power lines,” she says. “[The B.C. Liberals] were not good for Delta.”

However, Huntington says she felt that as an independent, she could better serve local residents by not being constrained by party politics.

She lost the 2005 race by 1,000 votes to her former political ally Val Roddick. But in 2009, Huntington toppled then-attorney general Wally Oppal by just 22 votes to become the first independent candidate elected in B.C. in 60 years.

As an independent MLA, Huntington says she has more of a voice in Victoria than any backbencher because she can’t be muzzled by a party whip.

Huntington counts the securing of funding for the dredging of Ladner Harbour, as well as increased oversight of oil and gas extraction in northeastern B.C., among her biggest accomplishments in her time as an MLA. In February, Huntington, along with fellow independent MLAs Bob Simpson and John van Dongen, introduced a series of proposed democratic reforms that included restricting corporate and union political donations and encouraging more free votes in the legislature. “[In provincial politics], there’s no opportunity to talk policy, there’s no meaningful debate, so what’s the point?” she says.

Huntington says her priorities for her next term, should she get re-elected, will be protecting agricultural land, saving the Pacific migratory bird flyway from development, and continuing to push for democratic reforms in the legislature.

Kids will be kids, and nobody knows that better than Tsawwassen parents David and Tara Anderson.

Their four girls are like any children, playing in the front yard and riding their bicycles on the quiet street outside their home.

But an anonymous letter delivered by a neighbour offering parental advice has them fuming.

The note says the person is worried about the safety of the Anderson children and that there are people who do not live in the area and won’t care what speed they’re driving.

“It would be a tragedy if you or your friend’s children were hit by a car,” the note reads.

The Andersons live on the corner of 18th Avenue and 55th Street, with a “No Exit” sign

clearly marked to drivers indicating that the road ahead is not a thoroughfare. They also put up ICBC-provided signs warning drivers that children are playing in the area, and there are school zone signs with a posted speed limit of 30 km/h.

David Anderson says the note doesn’t accurately describe the situation. He says the signs are posted on both sides of the street well before the intersection and as a reminder children are playing in the area, not as a way to allow his children to play in the roadway.

The note goes on to say that although the safety of children is the main priority, they are also blocking two streets by playing.

“Thank you for watching out for the well-being of your young ones,” reads the conclusion to the letter.

That last line has Anderson concerned.

When Tracey Lieuwen headed out onto the dark Ladner roads at 5 a.m. on a Saturday morning earlier this month, she could never have guessed the wild ride she was in for. She was driving her daughter Emily, 16, and her friend Nadia Langenberg, 17, down to Bellingham to write their first SAT exam at Western Washington University.

With an unexpected 45-minute border crossing lineup, the girls barely made the deadline for the five-hour exam. It might have been no problem, except the girls had an important soccer game on Vancouver Island at 6 p.m. and they had to make a mad dash for the 3 p.m. Tsawwassen ferry.

“It was a crazy day, they had just finished a five-hour exam and I don’t think mentally they were quite prepared to be heading off to a soccer game,” says Lieuwen.

Coach Bob Birarda of the Girls U17 Coastal FC soccer team had rescheduled a noon kick-off in Victoria to allow five players to write the SAT, expecting everybody at the ferry terminal at 2:45 p.m.

The girls got dressed in their soccer gear as they raced for the border.

Lieuwen thought they were going to make it, until she saw the massive lineup headed back into Canada.

A 35-minute wait and another furious dash to the ferry terminal was in vain.

have enough players and would have to forfeit the game to the Vancouver Island Wave. That’s when parent Jeff Derksen worked on a rescue plan.

“He’s much more than a supportive parent,” says Lieuwen, recalling the frantic phone calls. “He’s kind of the lifeblood of this team and has been for a number of years.”

After speaking to his friend Jack Pomerlau at the Boundary Bay airport, Derksen was told pilot Russell Cmolik had agreed to fly him, Nadia, and Emily to Victoria in his helicopter. The girls, who had never been in a helicopter before, took in the breathtaking vistas as they hurtled toward Victoria. Twenty-five minutes later they touched down in the harbour and jumped into a taxi cab to reach the University of Victoria.

Not only did the team get to play, they went on to win 4-0, with Emily scoring the fourth goal.

“There were many humanitarians during this adventure but Russell Cmolik stands out as a truly generous human— even arriving late for his dinner engagement due to this unexpected flight,” says Lieuwen.

Cmolik wouldn’t even accept payment, asking only that they donate to his charity, The Cmolik Foundation, which provides scholarships to B.C. students who do not have the financial means to attend post-secondary school.

Chai tea: Spice is the key Wood N Frog co-owner shares her recipe for the popular drink

hen Sandy McKellar makes Chai tea, it’s a bigger process than simply dipping a tea bag into a cup of hot water.

In fact, when the co-owner of Wood N Frog Coffee Company in Tsawwassen started her new business she was adamant about making her own Chai. She refused to serve commercially-made syrups used in many cafes.

“It’s so much nicer when you’re roasting your own coffee or beverage,” she says while cradling a Chai Latte.

McKellar developed a taste for Chai tea while living in Iran as a child. Iranian Chai teas are infused with cinnamon, saffron, cardamon, and turmeric, and instead of adding milk they drop in raw sugar.

Her not-so-secret ingredient in her Chai is black pepper, which warms all the other senses. The hot water heats the tea but it’s the pepper that makes the spices flourish.

“It’s not voodoo, it’s foodoo,” she says laughing.

❙ VIEWPOINT Offer more than just a lesser evil If BC NDP leaders hope to capitalize on the BC Liberals’ missteps, they need to step up their game and prove to voters there are good reasons to vote for their party. The notion that a vote for one is a vote against the other is simply not good enough reason – by itself – to return to power a party that has had its own shortcomings in the past in the transparency department.

Pundits and pollsters might, indeed, be right that a backlash against Liberals’ mismanagement of their current mandate will result in a win for the NDP. But it should be realized that voters are in the throes of a crisis of confidence with the political process itself. They have not simply lost faith in the BC Liberals – they have lost faith in politicians of all stripes.

In the political game, the NDP’s release of leaked memos concerning Liberal tactics in wooing ethnic voters was a bona fide win. But the NDP’s reluctance – to this date – to follow up such gains by presenting a detailed platform of its own is more than a little troubling, particularly when the BC Conservatives seem to be firing off platform statements every other day.

If New Democrats think the best strategy is to hang fire and keep quiet in the expectation that the Conservatives’ sabre-rattling will be sufficient to split the right-wing vote, it smacks of a cynicism equal to anything Liberal strategists have promulgated.

The NDP must stand for something, not just against something.

Presenting a convincing vision is what it will take for NDP leader Adrian Dix to ultimately put to rest a horrible past blunder in which he falsified the date of a memo to provide an alibi for former premier Glen Clark, who was feeling the heat in a probe into alleged corruption.

Dix has apologized and acknowledged he “owns” his past mistakes. He has also refused to take the bait of campaigning by the Liberals, who are determined to prove that the 14 years since the scandal is not too long for the short memory of the electorate. Dix may have learned some hard lessons about honesty since he was Clark’s chief of staff. And his refusal to fight “dirty” in a mud-slinging battle with his political foes may reflect a genuine desire to focus on issues. If that’s the case, the time is more than nigh to present these issues in a cohesive campaign, rather than a series of statements by Dix and NDP critics hewing to a general philosophy.

In contrast to the stumbles of others, the NDP has said it will provide a platform of promises that can be kept. So far, we are still waiting.

Excalibur Party might not be so silly

ews that an Abbotsford man has created the oddly named Excalibur Party has been met with a mixture of bemusement and derision.

Some may think it’s folly, not only because of the unusual name, but for trying to take on the well-established juggernauts currently sitting atop the throne of B.C. politics.

The declared values of the Excalibur Party are truth, honour and justice, which party leader Michael Halliday says hearkens back to a mythical golden age when England became united.

It’s difficult not to confess this all sounds a little bit silly. In keeping with the chivalrous theme, Halliday might be closer to Quixote than he is to Arthur.

But I have to confess, I certainly know where he’s coming from.

Halliday said he started his own political party after the frustration of trying to decide who to vote for and coming up empty.

And there’s some truth in what he says about a disillusioned population of B.C. simply deciding not to vote at all. Whatever the myriad reasons for the poor voter turnout in 2009, only 50 per cent of registered voters bothered to show up at all.

I stopped voting in 2009 when almost immediately following the election the BC Liberals decided to bring about the harmonized sales tax without consultation or advance notice. Following the despised carbon tax from the previous year it was the straw that broke this camel’s back.

I have a deep mistrust of politicians and politics, and who could blame me? I’m an Ontario ex-pat who in 2003 watched as Liberal leader Dalton McGuinty looked di-

rectly into the cameras and promised not to raise taxes. It was a lie.

Or in the 2008 federal election when immediately after voting for Stephen Harper’s re-election on the basis he wouldn’t run a deficit, he decided to run the largest deficits in Canadian history.

Can you blame me for not wanting to vote for people who lie to your face? Can you blame any of the 50 per cent of us in the province?

Maybe Halliday and his Excalibur Party don’t have a snowball’s hope in Haiti of garnering one per cent of the vote, let alone win a riding.

But is it any sillier voting for a party based on an English legend about a magic sword than a party that simply assumes you’re going to vote for it because it’s promised to stop breaking its promises?

Letters to the editor Freedom of information isn’t free Recent articles in the news about Freedom of Information (FOI) and the exposure of sensitive memos on the use and misuse of government-controlled purse strings have brought to mind the difficult time I had when I submitted my own FOI to the Corporation of Delta.

My experience with our local government felt like it was one of “delay, delay, ‘till they go away.”

Back in October 2011, I submitted a request asking for ‘details of the development application and all associated costs and fees’ about EarthKing’s proposal on Hwy 91 and Century Holdings’ Southlands proposal.

Sometime in November 2011, Delta municipal hall sent me notice that I would have to pay a total of $2566.50 in fees for the information requested.

Through the Privacy Office in Victoria, I learned that I could request to have these fees waived. And so the process of request and denial went back and forth for a year until December 2012.

Frustrated by the endless delays I was facing, I agreed to drastically reduce the scope of my FOI and ask for just the receipts for the amounts paid by EarthKing and Century for their development applications.

In this way, I would receive some information without having to pay fees for the extra time allocated for staff.

Early in January of this year, I did receive

the information requested. The amount paid

by EarthKing from 2005 to the end of 2012 has been about $11,000, and by Century for the same period it has been about $42,000.

I had originally hoped to receive information on not just developer costs but the associated costs that Delta taxpayers have forked over for the staff time required for these proposals, but this information was going to set me back the $2566.50.

It’s interesting that Delta privacy officers could provide me with an estimated cost of the staff time that would be required for my FOI request, but apparently there is no such consideration when it comes to the extra hours of staff time required for huge community impact issues like these proposals.

I would still like to know what these proposals are costing the Delta taxpayer, but that is a completely new and different FOI request.

I read a report on the Delta website that estimated the land value on the Southlands, after the zoning change happens, will be worth in excess of $135 million, so the $42,000 works out to 0.03 per cent of that figure.

That’s like spending $0.30 to make $1,000 dollars. Not bad, eh?

I think it’s sad that companies worth many millions of dollars pay our municipality pennies per dollar for these proposals when the average schmuck has to pay a lot of money for the privilege of becoming informed.

It seems clear to me that with so little cost to Century they can continue to put our community through an endless series of proposals on the Southlands until they get their way.

For anyone who would like to view what I received from the Corporation of Delta, I have sent the information over to the folks at Southland the Facts and hopefully they will post it on their website.

Re: “The struggle to find balance with nature,” Uncommon Sense, March 22 I’ll bet that in Big Industry’s universe or dimension, life-sustaining ecosystems are but once again supposed to take a back seat to extremely massive coal extractions and shipping, creating transport corridor nightmares, just for one thing; and, unfortunately, these days such almighty-dollar-first is very far from being unique.

Do B.C.ers in favour of basically unhindered resource-extraction ever thoroughly consider what good is creating jobs when the planet is deathly polluted thus people are getting sick and dying because of mass industrial and vehicular pollution?

Believe it or not, some will dismiss my rhetorical question with a specious, erroneous flip-flop-come-back question of their own, such as, ‘well, what good are clean, healthy ecosystems when there are no jobs to allow people to afford to take a day off and breathe the fresh air?’

It was some 31 miles long, complete with escape tubes, when and if accidents occurred. It takes but 30 minutes to travel the distance between England and France.

Third, the tunnel crossing proposed by George Massey was not just to connect Delta with Richmond as stated by Mayor Jackson but to serve all of Greater Vancouver, Surrey and White Rock, from whom he had to get their support before he could convince the provincial government that it was logical, practical and environmentally sound.

Please before statements are made condemning the present crossing and any future tunnel crossing and it’s history, get the facts.

First, the George Massey Tunnel and all other tunnels in the world are below sea level, plus both Richmond and Delta are below sea level. All river and channel tunnels are built below sea level.

Second, Mayor Jackson said, that another tunnel would be logistically difficult to engineer.

The word “logistically” is defined as “something done in a logical or practical way.” Yet another tunnel upriver from the George Massey Tunnel would be both logistically, practical and environmentally sound. Let us not forget that the Fraser River Estuary where the present and any future crossing has been designated a Wetland of International Significance under the Ramsar Convention, as the largest migratory bird wintering area in Canada, and the largest estuarine habitat on the Pacific

Massey Tunnel needs to go green

D

id you know that today 26 per cent of people traveling through the tunnel are on transit and that transit accounts for a mere one per cent of vehicles. That is a surprising good news statistic posted at the first George Massey Tunnel Replacement Project Consultation which impressed those who attended bac in December. People on buses do not cause tunnel gridlock. Improvements like higher bus frequency and new bus lanes approaches at the tunnel since the 2010 Olympics have further reduced the time it takes to get to Bridgeport Skytrain Station. The public is discovering this new faster, no gridlock, no parking, less-expensive way to travel so that 40 per cent of Vancouver-bound people through the Tunnel take transit. Given the success and cost-efficiency of transit through the tunnel, it would seem a obvious that expansion of transit is the way to go green via a new river crossing with the addition of the other active green transportation modes that is, cycling and walking.

The clear cause of gridlock tunnel congestion is single occupancy cars which account for 77 per cent of the 80,000 vehicle trips per day through tunnel. Truck movement is 12 per cent and HOV is 10 per cent of vehicles. While is it true that transit will not work for everyone’s transportation needs. In a recent informal survey about 60 pre cent of current single occupancy drivers said that they would not be able to use transit. More good news is that about 40 per cent of drivers would be willing to switch to transit. It follows that a clear solution to the river crossing would involve reduction or at least no increase of single occupancy vehicles and a substantial increase in transit and cycling. Unfortunately this common sense scenario is not one of the five potential crossing scenarios offered at the Phase 2 tunnel project planning consultations. All suggested options with the exception of Option 1 involve expanded capacity for cars. Removing the gridlock congestion for cars will no doubt, increase the percentage of cars at this crossing and reduce the Transit option. If it is easier to drive, why not?

It is time to explore a new green crossing of the river at Massey Tunnel. Why not a light transit/cycle/pedestrian bridge across the river? Imagine a rapid-bus only bridge with a cycle/pedestrian access similar to the Canada Line bridge over the North Arm of the Fraser. This crossing would be perfectly timed to link to Surrey’s plan for improved rapid transit since about 40 per cent of tunnel traffic originates from Surrey and points east.

This transit/cycle crossing plan would also be attractive to Richmond and would comply with Metro Vancouver’s transportation goals as outlined in their Regional Growth Strategy and B.C. government’s efforts to reduce greenhouse gases emissions.

Ask yourself where we want to be in 20 years. Do we want more vehicles through the crossing or can we find another greener and healthier solution? Get your comments to George Massey Tunnel Replacement Project by April 2, 2013. Information available online at masseytunnel.ca.

ord Laviolette is a man of few words, but his silence speaks volumes when he considers the sacrifice Carroll Meilleur is willing to make for him.

After spotting a Facebook page started by Gord’s wife Michelle, Meilleur is donating her kidney to the Ladner father of two, who has spent the past five years undergoing daily kidney dialysis.

Meilleur had never even met the couple.

“When you think about what is being asked…” Gord says, his voice trailing off. “We’re just so incredibly grateful. What an amazing gift.”

Gord’s kidney troubles began in October of 2007, when he received a small cut on his wrist while playing beer league hockey. The cut seemed innocuous enough, but streptococcus bacteria from his hockey gloves caused the cut to get infected.

“It was new gear too,” Gord says. “It wasn’t even that bad.”

The strep bacteria got into his blood stream and made its way to the kidneys, causing them to fail.

“Post-streptococcal glomerulonephritis,” says Michelle with quick and perfect pronunciation. It’s a phrase she’s heard all too much of over the past five and a half years.

Gord was soon able to overcome the infection, but the damage to his kidneys had taken a toll. He would need a new kidney, and in the mean time, daily dialysis to help filter his blood. It would be 10 years before Gord would likely receive a kidney from a deceased donor, they were told, and he might not live longer than that without one.

“That was a tough phone call to get,” says Michelle. “We weren’t expecting that.”

So for the past five years, Gord has under-

gone near constant peritoneal dialysis to stay alive. Every three to four hours, he pumps his abdominal cavity full of a glucose mixture about 2.5 litres worth - through a tube surgically inserted into his belly. A few hours later, he drains the fluid, which contains the wastes normally filtered from the blood by the kidney.

“It really takes a lot out of you,” Gord says.

“I’m extremely fatigued all the time, and that’s hard to deal with. I used to be more active and not run out of steam as easy.”

The Laviolettes own a company that recycles roof shingles, but Gord has barely been able to work since his ordeal began. Their six-year-old son Nash has only ever known his dad to be constantly tired and bloated from the fluids pumped into his body.

In March of 2012, Michelle went for lunch with a couple of friends, and shared with them how sad and frustrated and upset she was with Gord’s condition.

“It was the fourth anniversary of Gord starting dialysis, and anniversaries, they make you think about the big picture,” she says. “I was fearful about how Gord could wait another six years [ for a deceased donor].”

Michelle’s friends suggested she start a Facebook campaign asking friends to consider being a living donor for Gord, and get tested to see if they were compatible.

Initially Gord was somewhat resistant to the idea.

“I couldn’t ask someone to do that,” he says.

“But I sure could,” says Michelle.

So she created a Facebook page called “Are you an O?”, referring to the blood type needed to donate.

Big day, big desicions Wedding trends are changing. You are starting to see so many more low-key weddings then you ever used to. People are starting to ask, “Should we host a cocktail party or go to the full sit-down dinner?”

Each one has its pros and cons, and they both have their own unique place.

Cocktail receptions are typically thought of as being more intimate and relaxed, easier to organize, and in some ways they are the less expensive route to travel. But that isn’t always the case.

Clients tend to forget that if you are feeding a group of guests hors d’oeuvres, timing is key. If cocktail service is starting late and guests are made aware that it is a cocktail reception, guests will eat their dinner prior to the reception and just expect a lighter meal. However, if you are having the wedding during or overlapping the dinner hour, your guests won’t have a chance to eat in advance, and you will need more food for each person. Sit-down dinners are definitely the more intricate route, from details as small as timing to seating charts, but we try to take as much of the challenge and the stress of it out for you. There is also the price component: Sit-down dinners do have a reputation of becoming a higher price event. However, you will find that pricing in our area is very fare compared to booking a wedding in downtown Vancouver.

Delta gymnasts headed to Western finals Four members of Delta Gymnastics are off to the 2013 Western Canadian Gymnastics Championships in Winnipeg this May. Representing Team B.C. at the competition will be Ryan Woodhead, Caleb Richmond, Bradley Gulbranson, and Zachary Starko, each competing in male artistic gymnastics.

The gymnasts were selected to Team B.C. following trials held in North Vancouver, Langley and Surrey earlier this year.

The tournament will help identify future high-performance athletes and prepare them for competitions such

Cyclist Ann Walsh is preparing for a 400km one-day cycling journey from Kelowna to Delta this June to help raise money for the Canadian Cancer Society.

Walsh is the health promotion coordinator for the cancer society and will be taking part in the Ride2Survive fundraiser.

Walsh says she wants to challenge herself on a physical, mental, psychological, and spiritual level, and will be riding in memory of her uncle, mother-in-law, grandmother, colleague, and friends.

“Cancer sucks and too many people have lost their lives,” she says. “It was and is important for me to do something and make a difference in the lives of people living with cancer.”

The riders will leave at 3:30 a.m. on June 22 and arrive here in Delta by 11 p.m.

The ride begins at 350 metres

above sea level before climbing to 1728 metres at the Pennask Summit. It’s all downhill until Merritt (600 metres above sea level), when the cyclists must negotiate the Coquilhalla Pass, before making it to the coast where the ride ends in Delta at sea level.

In all, the ride features more than 3,600 vertical metres of climbing.

Walsh says she’s never thought of herself as an elite athlete, but she realizes the value of living a healthy routine.

Almost half of all cancers can be prevented through a healthy lifestyle, according to the Canadian Cancer Society.

To prepare for the trip, Walsh is doing weekly rides totaling more than 200km, and hopes to personally raise $2,500 to help fight cancer.

Every single dollar raised from the fundraiser goes directly to cancer research, with $2 million having been raised so far.

Cressey selling second development with amenities on penthouse level

Top-floor amenity space a new trend Traditionally, the topmost floors of a high-rise are set aside for the penthouses, allowing those with a larger budget to purchase the best views in the building. Cressey is giving that view to all of its residents by placing two floors of amenities space on the top floors of its upcoming MThree development.

“MThree will be the tallest building in Coquitlam at 48 storeys,” says Cressey’s Hani Lammam. “You can see ocean essentially.”

The top two floors of the building will be made almost entirely of glass, and will hold a fitness facility, musical practice rooms, lounge and outdoor barbecue space, among other things.

There will still be penthouse-style homes in the development.

Cressey has tried this experiment before, at their recent Southeast False Creek development, James.

“It was wildly successful,” Lammam says. “People can host parties and gatherings in the space. It gives them a bit more space to entertain.”

James also includes an outdoor space, secure children’s play area and community garden plots on its roof.

“This kind of space draws people there,” Lammam says.

A priceless gift Firefighters pitch in to help paralyzed mother of two get her life back with specially-equipped van Robert Mangelsdorf, editor South Delta Leader Sitting in her light-weight titanium-frame wheelchair, Jennifer Rumley is almost at eye-level with her two young children; three-year-old Cameron and five-year-old Kaitlyn. The children are bundle of energy on this sunny day. Less than a year ago she would have been able to keep up with them, chasing them as they play.

Rumley became paralyzed from the waist down after suffering cavernorma hemorrhage a kind of spinal aneurysm - resulting from an undetected birth defect which left blood vessels wrapped dangerously around her spinal column.

But thanks to the remarkable generosity of her dearest friends and perfect strangers - including firefighters from across Western Canada - Rumley is getting her life back.

Close to $70,000 in donations has been raised to purchase a specially-equipped van with a custom wheelchair lift and hand-drive controls for her. Having the van, Rumley says, doesn’t just mean she can get from A to B now. It gives her independence and lets her be a mom again.

“It’s been hard to believe,” she says of the generosity she and her family have received. “It’s still not real.”

Rumley’s husband Mike Bjarnason is a Delta firefighter, and when word got around about her condition, donations came pouring in from Bjarnason’s fellow firemen and women.

Local firefighters held a pub night fundraiser for Rumley in November, raising close to $30,000.

“It’s been unbelievable,” says Bjarnason.

“Having all the support has made it a lot easier for us. Not just financially, but we had guys cooking meals for us, coming by the house, helping with the kids, babysitting, doing what-

ever we needed, they were there.”

Delta firefighter and union local president Brad Wilson soon got the word out to departments as far away as Edmonton.

“We’re firefighters, so we look after each other,” he says.

But even Wilson was surprised at the response.

Across B.C. and Alberta, firefighters who had never even met Bjarnason or his wife, donated more than $23,000.

“We had some small departments way up in the middle of nowhere, and every guy would put in a couple hundred bucks,” he says. “It’s amazing.”

Friends of Rumley also put on a fundraiser at the local Boston Pizza, where close to 300 people came out to raise $10,000.

“It was quite shocking and very humbling,” Rumley says. “People from every corner of my life came out to help me.”

Adjusting to life in a wheelchair is never easy, but Rumley was arguably better prepared than most. Before she was paralyzed, she was a workplace therapist at Langley General Hospital, and worked with many people who suffered similar paralysis.

After a particularly vigorous workout close to a year ago, Rumley says she began to experience severe back pain.

“Right away, I knew something was not right,” she says.

Rumley was sent to Vancouver General, where an MRI showed the blood vessels had ruptured and bled into her spinal column, causing irreparable nerve damage.

“When I went in to VGH I was walking,” she says. “And six days later I was in a wheelchair.

“It was just a total freak thing.”

Historic Ladner home for seniors with mental health issues deemed too old to upgrade Adrian MacNair, reporter South Delta Leader A heritage home that has housed seniors with mental health issues for the past three decades will soon close its doors and move to North Delta.

Delta Lodge, located on Arthur Drive, is a family-run nursing home for people with a wide range of mental health issues that has operated out of a 108-year-old farm house for the past 29 years.

Although the owners have made numerous attempts over the years to find a way to renovate the building to meet modern health care standards, it was deemed too costly and difficult owing to its status as a heritage building.

"This has been a process in terms of identifying a location that has been ongoing for a few years so it hasn't been something that's transpired over the past six months," said Roy Thorpe-Dorward, a spokesman for Fraser Health.

Fraser Health has worked with BC Housing for several years to identify a new location that was within the same municipality and as close to the old facility as possible.

The result is a new eight-year-old, 18-bed facility on River Road in North Delta, recently purchased by BC Housing and renovated for $500,000.

Located beside the 103-year-old Trinity Lutheran Church in Annieville, residents will be moving from one historic part of Delta to another.

"Staff are very cognizant that when any of us move to a new community we need an opportunity to orient and to settle and to learn where things are," said Becky Doherty, housing manager for mental health and substance use for Fraser Health.

There are large communal living spaces, a functional and spacious kitchen and well-maintained, landscaped and fenced grounds. The facility has been newly furnished, is on a bus route, and is within walking distance to a local shop.

The good news is that the staff at Delta Lodge, consisting of a mother, father, and two sons all working as registered nurses, will be moving with the residents to the new facility to continue care.

Patricia Fleming has her hands full.

Not only does she tend to the daily upkeep of the Boundary Bay Earthwise Garden and Farm – soiled hands and all – Earthwise Society’s executive director is gearing up to be, for the fourth year, a teacher.

Starting on April 8, and running for the following 16 weeks, Earthwise Society is hosting the spring semester of its annual Organic Master Gardener course.

It’s not for the faint of heart, nor the casual gardener – not at around $700 a pop.

The course is aimed at both enthusiastic home gardeners and landscape professionals (working in both design and maintenance) looking to upgrade their credentials.

Fleming describes the course as an “intense” combination of classroom study and hands-on

exercises for those with already a good knowledge of gardening.

“It’s like being in school,” she notes. “There are assignments you have to do.”

In recent years, with new pesticide bylaws, there has been an increase in interest in organic gardening.

“There’s more demand on landscape professionals to maintain a garden without the use of chemicals,” explains Fleming. “It helps them build up their credentials and market themselves to potential clients – to put something after their name.”

The Organic Master Gardener course provides continuing education credits in arboriculture and landscape agriculture and can lead to eligibility for an examination that leads to certification in organic land care from the Society for Organic Urban Landcare (SOUL).

To teach the course, Fleming will be joined by Jennifer Ryan,

an instructor of horticulture at the University of the Fraser Valley.

The course will focus on healthy soil, the basis of all organic gardening.

Students will learn about composting, small-space urban landscaping, water-wise planting, gardening for habitat, Japanese zen gardens and edible gardens.

Students will be provided with a textbook and access to resource materials through an Earthwise “online campus.”

The Organic Master Gardener program will run every Monday from 6-9 p.m. from April 8 to June 24, including a few weekends.

Reach rocks for kids Delta's Reach Child and Youth Development Society is hosting its second annual Rockin’ for Reach benefit concert and dance in Tsawwassen on April 13, with proceeds going to help build a new, community-based child development centre in Ladner for children and youth with developmental disabilities.

Last year the event sold out to a crowd of 280 people who came from all over the Lower Mainland, and raised close to

$9,000 for Reach.

Headlining the event again is Vancouver rock and blues band Incognito, with special guest Jerry Doucette (“Mama Let Him Play”) and opening act Tyson McIlroy, guitarist for The Simpson Brothers Band, and Carter Low. Event fundraising activities include a 50/50 draw, $5 Easter egg prizes, and the return of the silent "Rock-tion" auction offering music themed products including an electric Fender Squire guitar signed by Paul McCartney, framed album

autographed by Bob Dylan, and Bruce Springsteen and the E Street band, and framed sheet music autographed by Adele.

Booze-soaked party buses get warning from minister Jeff Nagel, reporter Surrey North Delta Leader

Transportation Minister Mary Polak says party bus operators in B.C. have been warned they must obey laws that ban liquor consumption by their passengers or face costly licence suspensions.

But at the same time Polak says the province is reviewing the current regulations to check whether they still make sense.

A commercial vehicle like a limousine or a bus is considered a public place in B.C. so boozy revellers on board are drinking in public contrary to the Liquor Control and Licensing Act and can be subject to a $230 fine and liquor pour-outs. Any drinking in a moving vehicle is also against the Motor Vehicle Act and it's also a violation of the operators' licences under the Passenger Transportation Act. "I have made it very clear to the operators I have absolutely no difficulty pulling their licences if it's found any one of them is not in compliance," Polak said.

That message was delivered to operators at a meeting Thursday by officials of B.C.'s Passenger Transportation Board.

The stretch SUVs or buses are often outfitted with nightclub lighting and may act as rolling parties, particularly for those under age, rather than deluxe transportation to an actual event.

"It's kind of tough to swallow that [operators] are saying 'Look it's not our fault' when their advertisements in many cases imply alcohol is going to be part of the celebration these folks are going to be paying for," Polak said.

"It's very troubling."

She said her immediate concern is underage drinking by teens and the associated risks, particularly as grad celebration season approaches.

The party bus business isn't a big industry, but Polak said it's growing and it's time for a broader review of how the laws

apply and whether changes are justified.

Legalization of alcohol use on limousines or party buses – strictly for adults – is one option that might be considered, she said.

"Is there any benefit?" she asked. "I don't know the answer but it's a question worth asking."

Asked whether the province's shift to tougher roadside administrative penalties for impaired driving, rather than criminal prosecution, may have fueled the industry, Polak said she doesn't think so.

"This industry has been growing prior to the 0.05 [blood-alcohol level] legislation and the changes that went with that," she said. "I think it's more a reflection of society's ideals arround alcohol and their own decisions on what's appropriate and what isn't."

"I'm very familiar with the quality of care they provide, it's exceptional and we're very pleased to have them carry on as the contracted caregivers at the new site," said Doherty.

She said the family will provide continuity and reassurance for the residents to make the move less stressful.

Thorpe-Dorward said the key reason for the move is about accessibility. The new facility has a wheelchair lift, wider hallways, and bigger bathrooms.

"The goal over time is upgrade all older sites to current standards, mostly to do with accessibility but also a single occupancy room," he said.

Single occupancy rooms are now the preferred health care standard for residential care in order to cut down on the transmission of cold and flu.

The Ladner home is owned by the current service providers, so Fraser Health isn't looking at converting the home for another type of health care facility.

The Delta Lodge owners declined to comment on the story for privacy reasons, but said the house in Ladner will likely go up for sale.

For Rumley, one of the biggest adjustments has been having to constantly rely on others to do many of the simple things a lot of moms take for granted, like dropping off the kids at school, or picking up some groceries.

“We were relying on my parents to drive them back and forth to school when Mike was

working,” she says. “[With the van], I feel like a mom again, I can drive them to school and take them to their events, and be a part of the community.”

The family has also had to move out of their two-bedroom townhouse and into a groundfloor condo that’s more wheelchair-accessible.

But just because an injury

changes your life, doesn’t mean you stop being a mom, Rumley says.

“You adapt,” she says.

“But with the van, now I feel like I’m getting back to how it was before this happened. You start to forget about being paralyzed and start to get back to normal.” editor@southdeltaleader.com

Delta Police crime beat North Delta

• Delta Police located a male on March 19 on the 7600-block of 115th Street who was wanted on a warrant of arrest for possession of a weapon out of Vancouver.

The man was arrested without incident, transported to cells and is being held pending his appearance in court.

• A resident on the 11900-block of 79th Avenue called Delta Police on March 19 to report his vehicle had been stolen from his front driveway sometime during the evening. Investigation revealed that his garage had been accessed and items stolen from within. A neighborhood canvass was completed with negative results and the investigation is ongoing.

• Delta Police located a male in breach of his release conditions out of Kootneays on the 11800-block of 88th Avenue. The man was arrested without incident, transported to cells and is being held pending his appearance in court.

• The owner of a shed on the 11000-block of Davie Way reported a break-in to police on March 18. The break-in was believed to have taken place sometime over the previous few weeks and items stolen were entered into the police database.

• On March 18, a three-car motor vehicle collision on the 11300-block of 86th Avenue resulted in a fight between the parties. Delta Police responded, with the forensic identification attending to assist the investigation.

Two of the parties were taken to hospital with minor injuries.

• Delta Police received a call about a large oil spill at the intersection of Nordel Way and 120th Street on March 17. The oil had spread across two south bound lanes causing hazardous driving conditions. Investigation revealed the spill was due to a large commercial trucks pipes bursting. Delta Works attended and cleaned up the spill, resulting in the roadway being closed for a few hours.

• A Delta police officer shot and killed a pit bull on March 16 after it attacked the officer and his dog.

At just before 11 p.m., two Delta police officers were on patrol with their police dogs in the 700-block Chester Road on Annicis Island in North Delta. Two pit bulls approached, attacking the officers and the dog.

Police say they took out a baton and struck one of the attacking dogs causing it to flee. However the second pit bull continued to attack. Several attempts to fend off that attack were fruitless. One of the officers drew his sidearm and fatally shot the dog.

The pit bulls' owner and a second person arrived and allegedly attempted to obstruct the investigation. The two were subsequently arrested without incident, and have been released pending charges of obstruction of

a police officer.

The officer was treated at the hospital and is home recovering from a bite wound and possible broken bones to the hand which required numerous stitches.

The police dog has suffered puncture wounds to the head, ear and eye area and is currently receiving medical attention. The second officer is reported to have received several minor injuries to both hands as a result of fending off the other pit bull.

The investigation continues.

• Delta Police responded to a call at North Delta Secondary on March 15 that a male had lit smoke bombs inside the school hallway. The school was evacuated until the Delta Fire Department could clear out the smoke.

Witness statements and neighborhood enquires were obtained with positive results. Investigation continues to locate a possible suspect for charges.

• On March 12, Delta Police received a report from a woman on the 800-block of Cliveden Avenue that a vehicle belonging to her company had been broken into, and that an unknown suspect had stolen a credit card.

The investigation revealed that the credit card had been used fraudulently over the course of several days, and the card was subsequently cancelled. A business canvass was conducted with negative results, and investigators will be following up with businesses that the card was used at in an attempt to locate CCTV surveillance video. The investigation is still ongoing.

• A resident on the 10800-block of Monroe Drive called police on March 12 to report that two known suspects had just broken a window at her home. Upon arrival to the scene, investigators located a male and a female and spoke with them about the incident. A query of one of the suspects determined that he was in breach of his court ordered conditions, and he was subsequently taken into custody without incident. The 17-year-old male was transported to police headquarters where he was held pending his appearance in court and charges of mischief under $5,000 and breach of undertaking are being recommended. The female was later escorted to her residence where she was released with no charges.

South Delta • A resident called Delta Police on March 16 to report they had located bones along the Tsawwassen Beach area. Delta Police attended and seized a single bone which appeared to be from an animal. Investigation on going to test to confirm that it was in fact from an animal.

• On March 15, Delta Police

received a report that a building on the 1900-block of Tsawwassen Drive had been broken into sometime overnight. Police arrived and investigation revealed that the building was not accessed, although unknown suspects attempted to gain entry causing damage to the building. An investigation is ongoing.

• Police responded to a report of an intoxicated person being difficult as a result of being refused service at the liquor store at 6:15 p.m. on March 9 at the 5200-block of Ladner Trunk Road. Police informed the suspect that any store can refuse service to any customer whether intoxicated or not. Suspect subsequently left the area.

• At 11:22 a.m. on March 9, a report was received that the door of a business on the 1000-block of 56th Street was unlocked and had set off the alarm. Police arrived and met with the person responsible for the lab who stated that nothing appeared suspicious inside and that her cleaners must have left the back door unlocked, • Two males were observed smashing glass at a house in the 1200-block of 56th Street at 1:30 a.m. on March 9. As the police arrived the suspects fled on foot.

Police were able to apprehend one of the suspects who was arrested for mischief and causing a disturbance. Damage caused by a beer bottle hitting the window of the house is $400.

• A driver of a vehicle pulled over for a traffic stop and admitted to having marijuana in the vehicle and was arrested for possession, at 9:45 p.m. on March 8, at Highway 17 and Tsawwassen Drive. A search of the vehicle revealed one gram of marijuana. The passenger was found to have an outstanding warrant and was arrested. Marijuana seized for destruction, driver released at the scene.

• Police located several youth behind Delta Secondary School drinking and being loud at 7 p.m. on March 8. The youth were required to clean up the grounds, warned, and escorted off the property.

• Delta Police took a drunk driver off the road on March 5 on the 5700-block of Ladner Trunk Road. A witness called police to report the possible drunk driver and investigators were able to locate the vehicle and conducted a traffic stop. The driver of the vehicle admitted to consuming alcohol, and was given a roadside breathalyzer test. As a result of the test, the driver of the vehicle was given a 90-day immediate roadside prohibition, and the vehicle was impounded for seven days. The driver and two passengers were released at the scene.
