Gregarious Gardener by Top Crop Garden, Farm & Pet

Tomorrow is the day of truth. On February 2, a handful of rodents will decide the fate of gardeners across the continent. From Punxsutawney Phil in Pennsylvania to Wiarton Willie in Ontario and Balzac Billy in Alberta, groundhogs will be crawling from their burrows. If it is a cloudy day, they will snoop around and we will get an early spring. If it is sunny, they will quickly retreat into their dens to wait out another six weeks of winter that are ahead of us. How accurate are their predictions? Over the years, the various groundhogs are reported to have been right about 60% of the time, some being more successful than others. Not bad, for a rodent that is untrained in meteorology, but do we really want to rely on that to plan our gardening season? Probably not, but what the groundhogs are reminding us about is that while snow and ice are still covering our landscape, it is never too early to start thinking about gardening. Take a good look at your yard and garden now and you will be prepared when temperatures start rising and the ground wakes up. Are there any spots that need filling in? Are there cluttered plantings that would benefit from being split up and shared with a friend? When it is cold and dreary outside, sit down with a cup of tea and a good gardening book. Educate yourself on topics that will improve your expertise; then use that knowledge and create a gardening season plan. It will help you stay on track when you get busy. Getting a clean start to the gardening season should be taken quite literally. Through the summer, mineral deposits and other debris can build up in outdoor containers, and it may harbour diseases that can cause problems for your plants. Clean and disinfect your pots and planters thoroughly. It takes minimal effort, but can make all the difference in ensuring success for your containers later. Take stock of your garden tools, repair or replace broken handles, tools and worn-out gloves. Tools also benefit from a thorough cleaning. You might want to put together a gardening tool kit that gives you everything you need in one convenient location. A wander through the garden centre can give you a good idea of gadgets you could be adding. Successful growing starts with the basics – soil and water. Before you start planting, get us to look at a sample of your soil. Take several goodsize samples from your garden and bring them in. We can send it off to a professional lab for analysis and then give you recommendations as to what kinds of fertilizers and ammendments will improve the quality of your soil. Once your garden has been planted, nothing is more important for its ability to thrive than water. Too little water and plants cannot develop properly; too much water will make them prone to rot, and diseases, as well as waste a valuable resource. Drip irrigation systems can be great for those with large gardens or little time while being good for the environment, as less water is wasted. They are easy to install and if you need a hand in designing a system, bring a scale drawing to the irrigation specialist - they will be happy to assist. While you are patiently waiting for the outdoor growing season to start, make sure to brighten up your home and chase away any winter blues. The BC Coroners Service has confirmed the identity of a woman who was found deceased in the Fairmont Hot Springs area on Jan. 24, 2013. She was Cheyenne Michelle Mason-Lalonde, aged 20, a local resident Ms. Mason-Lalonde was found by a friend late in the evening of Jan. 24, 2013, near a golf course in Fairmont Hot Springs. She had been reported missing to the local RCMP detachment. She was deceased at the scene. Foul play has now been ruled out.

Submitted A new revenue-sharing agreement ensures four Ktunaxa Nation communities benefit from resource development within their traditional territory. The agreement is the fourth Economic and Community Development Agreement (ECDA) in the province and fulfils the B.C. government’s commitment to reach 10 new non-treaty agreements under the BC Jobs Plan by 2015. The Economic and Community Development Agreement (ECDA) will enable the Ktunaxa Nation, comprised of the four communities of St. Mary’s, Tobacco Plains, Lower Kootenay and Akisq’nuk First Nation, to share revenues from new coal mine projects in the Elk Valley. The agreement also links to the Strategic Engagement Agreement between B.C. and Ktunaxa Nation, which provides for a decisionmaking and project-review process to ensure the Ktunaxa Nation continues to be involved in decision-making about new mine projects. The ECDA provides stability and greater certainty for coal mining operations in the Elk Valley. In the past fiscal year, mineral taxes derived from all coal mines in B.C. amounted to approximately 90 per cent of total provincial mineral tax revenue. Elk Valley coal operations contribute the majority of this revenue. The ECDA builds on the existing Strategic Engagement Agreement (SEA) with the Ktunaxa, signed in 2010, which guides ongoing government-to-government discussions on natural resource decisions, and is another example of B.C.’s commitment to transform its relationship with the Ktunaxa Nation. The agreement is one step toward addressing the Ktunaxa interest in being recognized as a government in the Ktunaxa Territory, being appropriately accommodated for potential impacts on Ktunaxa Nation’s asserted Aboriginal rights, including title, achieving a greater role in the regional economy and supporting Ktunaxa community development initiatives.

Deer Feeding Prohibition Bylaw

Under this bylaw, no one is to provide deer with food by intentionally leaving food, food waste or other attractive edible material intended for the sole purposed of feeding deer. For example, leaving out a bale of hay, a bag of apples or other compostable food scraps on a residential lot or property where these items are not consistently being grown or produced for human consumption would be seen as an infraction to the bylaw.

Fire Services Begins Carrying Pet Oxygen Kits

Cranbrook Fire & Emergency Services began carrying three O2 Fur Life pet oxygen kits on their first responder vehicles, thanks to a generous donation by One of the Family Pet Care Centre on January 21, 2013. Firefighters have been trained on the kits, which allow pets involved in smoky fires to receive immediate oxygen therapy on scene, to combat poisonous carbon monoxide and greatly increase their chances of survival. Each kit comes with three sizes of masks to get the best fit for the animal, whether it is a dog or cat. The orange bag can also be used to restrain cats to pull them out of dangerous situations and not get scratched and to administer oxygen.

Ktunaxa treaty negotiations clarified by Bill Bennett, Kootenay East MLA Treaty negotiations between Canada, BC and the Ktunaxa were recently in the news and some citizens have made public statements that are partly true and partly wrong. In this short space, I will try to provide accurate information on treaty negotiations, as well as where I stand as MLA. First off, there is no final treaty, we are years away from a final treaty

and there may or may not be a final treaty. Next, some history. A profound event happened in 1982 that influences how governments work with First Nations. Our Canadian Constitution was changed to recognize aboriginal rights and a unique aboriginal interest in crown land. Since 1982, in hundreds of legal cases, the courts have interpreted what those rights and title interests mean. This makes it difficult to know what govern-

ment’s responsibilities are. Bottom line, BC is legally obligated to consult with First Nations on almost everything that is proposed for crown land. And the theory is, treaties bring more certainty. While it is true BC could leave the Canada-BC treaty process, the Supreme Court of Canada has said repeatedly, aboriginal rights and title issues are better resolved by negotiated treaties than court actions. And since BC loses most court actions, it makes more sense to try to negotiate treaties. Better these important matters are in the hands of democrati-

cally elected Canadian, BC and First Nations governments, than the courts. Unlike all other provinces, BC has very few treaties. In the 1700’s and 1800’s when other provinces were negotiating treaties, Canada and BC negotiated treaties only in the Peace and on southern Vancouver Island. This makes our situation in BC much more complex and challenging. The treaty process in BC has not been particularly productive, with only 2 treaties negotiated since the Canada-BC process started. However, it took Canada and BC over 100 years

to get into this situation and the job is incredibly complex and difficult. The current status of the Ktunaxa negotiations is that the three governments have agreed tentatively on a 33,458 hectare package of land that represents less than ½% of the traditional territory once occupied by the Ktunaxa. No land has been transferred or will be any time soon. Approximately 22,000 hectares are located in three large rural blocks in the Goat, Flathead, and Madias-Tatley River watersheds. The remaining parcels are smaller and are distributed throughout the

east and west Kootenays. The land scattered around Jimsmith Lake and New Lake, which has been controversial in Cranbrook, consists of 867 hectares. The land portion of a treaty is negotiated by starting with the 6.6 million hectares of traditional territory, then removing chunks. All private land and forest roads are removed, as are critical wildlife habitat, parks, protected areas, transmission lines, and formalized recreation areas (example, Cranbrook Community Forest). Local government and the forest, agriculture, mining and tourism industries have been consulted on the choice of land for the tentative package. It is my longstanding view that the public should have more information about land being considered. However, when the NDP started the Ktunaxa process before I was MLA, the negotiators signed an agreement that the participants cannot disclose maps. This has been a source of frustration to me as MLA and to many in the public. I agree with my friend, former MP, Jim Abbott, who has long stood up for the public on this issue, that the public should have ample opportunity to understand what is being negotiated, including impacts on access to crown land.

I now have maps at my MLA office which show the tentative land package. I invite my constituents to come into my office in Cranbrook to view the maps. I strongly believe that maps should be put up on a web site for easier viewing, but the agreement cannot be arbitrarily changed. All 3 parties must agree. If there is eventually a final treaty, Ktunaxa land will be of two types: public and private. I am told most land will be classified as public and will continue to be accessible for public recreation. This is obviously an important point and one that I will be focusing on in my endeavors on behalf of my constituents. I support trying to make the treaty process more effective, because I don’t think we should be allowing the courts to make such important decisions and because BC needs the certainty over crown land use. The future of our economy and the frankly the future prosperity of First Nations people depends on effective access to crown land. Marjorie Eleanor Neilson 1926 - 2013 Marjorie Eleanor Neilson was born March 28, 1926 in Fredericton, New Brunswick, to Hilda (Copp) and Philip Pincombe. She passed away on Wednesday, January 23, 2013 at the Foothills Hospital in Calgary. She was pre-deceased by her beloved husband of 64 years, Paul Neilson, and her son, David Neilson. Marjorie was a devoted mother to her daughters, Paula Neilson and Patricia Neilson (Don Greer) and a caring mother-in-law to Faye Neilson. She was a much loved grandmother to Lisa (Christopher) Reed, Lori (Kent) Baher, Robyn and Susan Pape, Craig and Lauren Greer, and great-grandchildren Jeza, Lola and Kyle Baher and Brylie Reed. She will be sadly missed by family and friends. The celebration of Marjorie Neilson's life took place at Christ Church Anglican in Cranbrook on Tuesday, January 29th at 1:30 pm, with her Interment taking place prior to the service at 12:30 pm. Experience: Previous work experience in a similar environment is required. Skills: Well developed oral and written communication, good organization and time management skills. Knowledge of child development and age-appropriate developmental activities.
