Bylaw dispute process adopted

BY LORNE ECKERSLEY Advance Staff A new system to deal with bylaw infractions including noise, animal control and unsightly property takes effect in Creston in December.

“In the past, bylaw disputes were handled in the provincial court system,” said Mayor Ron Toyota. “Arguing minor bylaw infractions in court was often impractical, due to the time and costs involved.”

Toyota said he is pragmatic about the change.

“The number one reason we are adopting this new system is because the old one was cumbersome. It just didn’t work.”

Jury returns recommendations in Sweatman inquest

A Nelson coroner’s jury has made nine recommendations to prevent future deaths like that of a Nelson Search and Rescue volunteer.

The suggestions are all directed at Emergency Management BC and the BC Search and Rescue Association and include standardized training and equipment for swift water teams, and a review of funding models to better support operations.

he Creston Valley Blossom Festival committee has set the target date for next year’s 72nd annual festival on the traditional May long weekend, from May 17-20, 2013.

After the AGM Nov. 5, plans and ideas for the longest running festival came forward from the old and new membership.

“We are planning for continuity with a

For the second year, Creston’s Shoppers Drug Mart is doing its part to bring a merry Christmas to residents in Crest View Care Village.

Until Dec. 19, anyone can purchase and drop off a gift for the extended care facility’s residents at the down-

town pharmacy.

“We will wrap them and deliver them to Crest View before Christmas,” said pharmacist Karl Mottl.

If last year’s generosity is any indication, the gift drive should be a success once again.

“Last year, we had enough to take a gift for everyone,” said Mottl.

From page 1 The jury heard five lengthy days of testimony from about 20 witnesses last week before beginning their deliberations on Saturday morning. They reached their verdict late that afternoon.

Sweatman’s father, Wynn, told reporters the jury was thorough and his family is happy to have the recommendations.

“I feel like we can now begin to move forward,” he said. “But it’s been a really hard week. From an emotional point of view, we’ve taken a step back a year in terms of coping with this loss.”

Although the recommendations don’t specifically mention the use of steel cable in vehicle recoveries, Wynn said they do suggest that swift water teams use only their own equipment whenever possible.

The jury also said appropriate tools for self-rescue and companion rescue “must be immediately accessible.”

“In one way or another, all of those things contributed to losing Sheilah,” Wynn said. “There’s nothing happy about this for us, but I think Sheilah’s legacy will be a big improvement in standards.”

Wynn was the last witness to testify Friday. He said no facts emerged at the inquest that weren’t previously learned in the 16 months since Sheilah’s death.

“It made me mad it took so long to get to those issues that ultimately end up fairly simple. I told them Sheilah was courageous and passionate and that the managers and the system needs to protect the passionate volunteers.”

1. That Emergency Management British Columbia (EMBC) expand the existing swift water task force to include members of search and rescue operations as well as the RCMP, BC River Guides Association, BC River Outfitters Association, WorkSafe BC and any other appropriate stakeholders.

2. That EMBC and British Columbia Search and Rescue Association (BCSAR) develop universal standards for swift water rescue and recovery training to ensure consistent language and training applications. These universal standards would require all swift water training providers to conform to these prescribed standards.

3. That EMBC and BCSAR develop universal standards for swift water rescue and recovery equipment.

4. That an audit be conducted of all search and rescue communities by BCSAR pursuing civil action in the case.

BC Search and Rescue Association president Don Bindon, who attended the inquest, said his members are “extremely grateful” for the jury’s work.

“These nine recommendations give us an excellent road map. ... We’re going to do our very best to implement each and every one of them.”

Bindon says they have not been waiting for the inquest to make changes — plans are already afoot to standardize swift water training. Although the jury

If any unfamiliar equipment is introduced into a task, a proper risk assessment did not make any specific recommendations around vehicle recoveries, Bindon said they are looking at ways to reduce the hazards of such operations.

The recommendations didn’t mention the use of video cameras in search exercises either — the tragic operation was caught on tape as part of filming for the reality TV show Callout: Search and Rescue, and the jury viewed the footage — but Bindon said he doesn’t think it was a factor.

“Absolutely not. ... If I believed the video played a role, we would be mak-

That the volunteer policy and procedures manual, specifically the policy for “Utilization of volunteers for search and rescue activities policy”, be reviewed by EMBC to clarify and amend, where required, the roles and responsibilities of varying agencies involved in search and rescue activities. These groups include, but are not limited to search and rescue, policing agencies, coroner, Parks Canada, BC Ambulance and fire services.

8. That during an operation, a specific safety officer be designated whenever possible. This safety officer(s) position will be their sole function.

9. That EMBC with the assistance of the search and rescue stakeholders develop a standardized risk assessment tool for use in swift water operations.

•Police mediated a dispute between a mother and her adult daughter on Hillside Street.

•Tires and rims were stolen from a vehicle on Northwest Boulevard.

•A female reported that her vehicle’s bumper was torn off by a hit and run driver who then took the bumper and left the Northwest Boulevard parking lot.

•An elderly male was reported to be driving without a valid licence.

Police located the vehicle but not the man, and left a warning message.

November 21 •Shots were reported near Mallory Place in Lister but the source was not located.

•Police are investigating a collision on Northwest Boulevard in which one occupant was taken to hospital with a minor head injury.

•A male who attempted to enter a Mallory Place residence in contravention of a court order is now being sought by police.

November 23 •A father on Canyon-Lister Road reported his underaged daughter took his vehicle without consent.

The vehicle was involved in a minor crash shortly afterward on West Creston Road.

•A female who was refusing to leave a Canyon Street business was gone when police arrived.

•A semi went into the ditch on Highway 3/95 near Kingsgate.

•Police were unable to trace the source of a 911 call through the Whimster Road cellphone tower.

November 24 •Calls to 911 through towers on Peters Road and Topaz Creek could not be traced.

•A complaint of threats being uttered was received from Oliver Road in Gray Creek.

•Police who responded to a 911 hang-up call from Kingsgate were told by the male in the residence that he tired of hearing complaints by the female resident, so he called 911, handed her the phone and told her to tell her story to the police.

November 25 •Harassing phone calls to a male on Oliver Road were reported again.

Phone scam doesn’t trick Creston resident

From page 1 •A male attempted to re-enter Canada through the Rykerts border crossing in the company of a female despite having a court order not to be in contact with her. After finding that he had other outstanding warrants, police arrested him and took him into custody.

•When police responded to a call about phone threats being made from an Aldrich Road residence over a vehicle sale last summer they found a severely intoxicated female. She threatened police officers and was arrested and taken into custody.

•A male was warned after he made sexual comments to a pedestrian.

•A 17-year-old male reported being chased to his home by four other males.

•An occupant of an ATV that crashed on Kidd Creek Forest Service Road was taken to hospital.

•When police responded to a 911 call from Riley Road they determined the phone in the home had no record of a 911 call.

Gertie Brown was cutting her husband’s hair when the phone rang with a call that could have bilked her out of hundreds, or even thousands, of dollars.

“I picked up the phone and a voice said, ‘Hello, Grandma,’ ” Brown said. “ ‘I need help.’ ” When she asked the caller who he was, she got a coy reply.

“Who do you think it is?” he asked.

Brown guessed the name of her grandson, Chad, and the caller proceeded, claiming that he had been arrested in Vancouver for drinking and driving and needed money.

Believing that her grandson was in Eastern Canada and not Vancouver, Brown became wary.

“What’s your mother’s name?” she asked the caller, who disconnected the call shortly after.

“It really bothers me that older people are targeted in these scams and I’d like to warn others to ask questions that only their real grandchildren (or other relative) would know the answer to,” Brown said.

Phone scams can be reported directly to the Canadian Anti-Fraud Centre, a national task force that involves the RCMP, at 1-888495-8501.

“I swear to God, if someone tells me right now there’s some miracle body cream out there that would make me feel 100 per cent and prevent me from getting hurt but that could also cause cancer or liver damage down the line, I’d use it in a heartbeat. I would.”

Those words, near the end of an excellent article in last weekend’s New York Times, gave me a clearer understanding about why athletes cheat than anything else I’ve read. They came from the mouth of Pat Schiller, a college linebacker who is trying to make it in the National Football League. In the article about Schiller, written by his uncle, Charles Seibert, the reader gets an insightful look at the meat grinder that is professional sports, where there are hundreds or even thousands of aspirants who would sell their grandmothers for a shot at the big time.

Historian’s comments shock reader To the Editor: I was shocked and extremely upset with the comment of historian Paul Fusssell in the Nov. 8 Advance regarding the poem, In Flanders Fields.

Remembrance Day is a time to show our appreciation of our freedom by honouring those who were killed and those who survived. It is not a time to quote a depraved historian who never went to war nor could comprehend what life was like in muddy trenches with bullets being fired night and day, and also the danger of chlorine gas. His comment about the third stanza of John McCrae’s poem as “vicious” and “stupid” reveals he was trying to lift up his own cowardice by bringing the hero down toward his own level.

Written in 1915, in the early part of the war, it follows that if nobody took the torch and continued to fight the foe who did not want peace before 1918, then all would be lost and all the tens of thousands of dead soldiers died for nothing.

Fussell gets a failure mark in poetry.

Contrary to his idea, a poet has no set of arrangement and analysis that must be followed. His motive is to captivate and

encourage the mind and emotions and, in this poem, to continue the fight for peace and freedom. In Flanders Fields did it all in an excellent way, which only a poem can do.

Fussell had the nerve to call the last lines “propaganda arguments against a negotiated peace.” He is completely in the dark. Ninety-nine per cent of the soldiers in war want the war to end and go back home to girlfriends, wives and children, and would welcome peace any day the enemy would stop its aggression.

I apologize to the people who were and are in the Forces for our town paper’s quote from Fussell, who maligned a true hero. McCrae did not have to fight at the frontline at 41, but chose to be there and support the majority of soldiers who were enlisted at 19-21 years of age.

Time should be left alone To the Editor: (Re: “Creston must change time to avoid confusion”, Nov. 22 Advance, page 7) I respectfully disagree with Holly Pender-Love’s assertion that Creston should change to mountain time. It seems to me that, if there were to be any change, it would make more sense to

change to Pacific time. Our CBC Radio and television programming comes from the West Coast, which is why our noon news now happens at 1 p.m. and supper hour news moves to 7 p.m. and also why many popular TV shows now come on an hour later.

I guess I am one of those retired people happy to leave the time alone.

We are still in process as far as operation of the concession is concerned; we did have a request for proposals earlier that didn’t give us the result we were looking for; however, we have some innovative irons in the fire at present with the outcome clearly defined — quality healthy food and beverage availability for those that step up to the counter and the option for a treat or guilty pleasure. The intent and content of the RFP is to form a relationship with the concession/food service operator and work out the details of the concession operation (such as hours of operation, menu, service) that is beneficial for both parties and the public. It’s a work in progress and we are moving forward with this project keeping the public, user groups and complex interests equally in mind. If you get a chance, come down, check things out and watch for updates.

New floor, new concession kitchen for community complex

Remember when you changed the rug in your house or added hardwood floor and the different look and feel it made in the space? That is where we are with the new skate flooring in the arena lobby and boy, does it look great! Interestingly enough, as project manager Wendell Marshall pointed out, it makes the whole area look bigger as it tends to lower the ceiling and widen the space out and we are sure glad we continued the “swooped” pattern though this area, which provides tiein to the main lobby area and the curves in the ceramic tile flooring.

With the addition of the black cove base around the edges, it looks pretty sharp — come check it out. The icing on the cake was that we had successfully applied for a grant from the Tire Stewardship of BC organization, which ends up with some of the tire levy money you pay when you purchase new skins for the Hummer, but which also provided us with about $17,000 towards the new floor.

Also proceeding on schedule is the installation and hook-up of all the equipment in the concession. If you happened to be here a week or two ago, you might have seen the semi-trailer parked out front that hauled 26,000 pounds of stainless steel shelves, appliances, stoves and counters, amongst other food prep paraphernalia. It is pretty impressive to see mostly everything in place after going through three or four incarnations of design drawings with the kitchen consultant as we

Author chronicles decades of dieting in All My Sizes SUBMITTED A typical New Year’s Eve would find her buried in the binge to end all binges while planning the diet to end all diets. Still fat and frustrated despite having dieted for decades, she dreads the number on the scale as much as she hates herself for being there again.

Her pre-diet stepping-onthe-scale ritual inevitably prompts the dreaded raging scream, “Out damned fat, out!” With pizza in one hand and pen in the other, she sets down to chart another fat-fated course to that magical land of eternal slender.

Born and raised in the backwoods of B.C., Ruth Boehmer, who lives in Creston, received her diploma in nursing from Lethbridge Community College in 1976.

She went on to complete a master’s degree in health promotion and a PhD in psychology. After launching her last of four children out into the world, she set her time and mind to writing, starting with a compilation of decades of journal entries recording the misery of losing and gaining weight over and over again.

Blossom singers offering annual Christmas show

BLOSSOM VALLEY SINGERS

Boehmer ’s four-decade struggle with weight and body image inspired the writing of her book, All My Sizes: Four Decades of Diet Hell. As a young woman, she began keeping a journal, finding four decades later that much of her life story centered on her obsession with dieting and weight problems.

She has penned the miserygo-round of the modern woman in All My Sizes: Four Decades of Diet Hell. Intensely personal, Boehmer captures the heart, mind, and soul-war of the diet-binge cycle caught on paper in the hate of the moment.

Featuring journal entries from mid-adolescence to middle adulthood, All My Sizes is a firsthand account of the author's struggle with food, weight and body image. There is no resolution or how-to guide, only a cacophony of diet drama authentically capturing the battle every woman faces when she believes she's not “enough”.

The Blossom Valley Singers mixed choir expects tickets to be a hot item for this year’s Christmas concert, their second season in the new venue at Prince Charles Theatre. The Singing Christmas Tree had to be retired last year when the United Church was no longer available, and some patrons were turned away at the door when last year’s Sunday afternoon performance was sold out.

“It was disappointing to those who missed out, and we regret we had no seats for them,” said BVS president Elvin Strand. “We’re limited to two concerts because of the higher cost of the auditorium, but we hope the word gets out that people should buy advance tickets if they want to be guaranteed a seat.”

This year’s concert is all about Christmas Magic, the sequel to Singing in the Christmas Trees. The choir of more than 60 voices, under the direction of Anita Stushnoff and accompaniment of Monte Anderson, will perform a variety of traditional, ethnic and contemporary carols.

Some of the selections will be punctuated with brass, wind and bass

accompaniment. Also featured will be the Prince Charles Secondary School choir, the Creston Children’s Choir and the Key of She. The Blossom Valley Singers has brought choral music to the valley for more than 25 years. Proceeds from ticket sales after expenses are directed to the needs of the growing choir (which had to purchase more risers and back rails) and the community.

Two scholarships are awarded annually for deserving students seeking further studies in music. Monies were also directed toward part of the cost of the electronic piano, which has been donated to the PCSS band room. The piano, a welcome addition to the resources available to the choir for rehearsals and performances, will be used in this year’s concert in lieu of the grand piano.

“The grand would be lovely, but we have so many singers and extras, there’s just no room for everything on the stage,” said Stushnoff.

The concert runs Dec. 7 at 7 p.m. and Dec. 9 at 2:30 p.m. Advance tickets are $12 for adults and $8 for under 14 years, available at Black Bear Books or from members of the choir. Tickets at the door are $14 for adults and $10 for under 14.

A computer virus can affect or even delete files and images stored on your hard drive.

Consider taking time over the holidays to back up your files and protect your photos so you don’t lose those precious memories.

The best defense is prevention. Here are some key things you can do to protect your computer: • Install anti-virus software and make sure you update it regularly.

• Install a firewall and keep it turned on.

• Be cautious when clicking on links that look suspicious or come in emails or on social networking sites.

Dorothy Arsenault (nee Lemaire) February 20, 1927 ~ November 12, 2012 November 12, 2012 marked the beginning of a spiritual journey for our much loved mother, grandmother and great-grandmother, Dorothy Arsenault, as she left this earthly life and joined her family in heaven.

She will be fondly remembered with laughter and tears by her Àve special daughters and their caring husbands, Elaine & Bob Kolebaba, Diane & Charles Meadwell, Denise & Terry Jaeger, Debra & Carey Isaac, Lita & Tim Heidinger, 12 wonderful grandchildren, 14 delightful great-grandchildren, one sister and other family members.

Dorothy’s love of music will sound in our hearts as we honour and cherish the life that she lived for 85 years surrounded by the warmth of family and friends. In keeping with Dorothy’s wishes cremation has taken place and Mass of Christian Burial was held to celebrate Dorothy’s life November 27, 2012 at Our Lady of the Sacred Heart Cathedral, The Pas, Manitoba. This Cathedral is where many of her important life events were celebrated beginning with her marriage in 1947 to Simon Arsenault, the joyous baptisms of their daughters and several grandchildren, and the wedding and funeral masses of her loved ones.

Dorothy returned home for her last celebration and was laid to rest beside her dear Simon at Lakeside Cemetery, The Pas, as we said our Ànal farewell and blessings.

The family extends a special thank you to the staff at Concordia Hospital, Winnipeg, for their kindness, compassion and care.

Obituaries Catherine Tessman November 20, 2012 Catherine (Rena) Tessman passed away suddenly on November 20, 2012 in the Creston Valley at the age of 90 years.

Rena married Michael Pawelko in Calgary, AB and together they moved to northern Alberta where they operated a Case dealership. Rena later married David Tessman. They moved to High River, AB, where they resided for several years before moving to Creston, BC, making Arrowcreek, BC and later Erickson, BC, their home.

Rena enjoyed all her family, grandchildren and great grandchildren. She spent endless hours crafting and tried her hand at any project. She truly enjoyed her knitting needles and refused to send you home without a scarf, a pair of slippers, or an afghan. Rena was a member of T.A.P.S. and she always looked forward to their special events and outings. She made many new friends and spoke highly of the people and organizers involved with the T.A.P.S. association.

Crafty Croonies were also a special part of her group.

Rena also made awesome bread, cinnamon rolls and enjoyed her garden and Áowers.

Rena was predeceased by her mother and father, William and Isabella Norton; sister Faye; two granddaughters Lynne and Diane; husband David Tessman; daughter-in-law Renee and daughter Faye.

She will be lovingly remembered by her daughters Belle Daignault (Wally McDevitt), Dodie Smith, Doris (Joe) Daignault, Maxine (Dan) Gaudry, Bev August, Eileen (Jerry) Klassen, Emily Wilson and Grace Tessman; sons John ( MaryNell) Pawelko and Marx (Lisa) Tessman; brother Bud Norton; twenty grand children and twenty-Àve great grandchildren.

A Memorial Tea was held on Saturday November 24, 2012 from 2:00 – 4:00 at the Royal Canadian Legion.

Interment of Ashes to take place at a later date.

Thunder Cats tie two on road in Okanagan

The Creston Valley Thunder Cats earned two points on the weekend, with overtime losses to the Summerland Steam and the Kelowna Chiefs on a road trip to the Okanagan.

The Steam began the scoring in Friday’s game, with a power-play goal at 8:44, followed by Thunder Cats goals by Trevor Hanna at 5:33 and Ethan Rusnack at 0:02.

Summerland tied the score 2-2 by the end of the second period, but the Thunder Cats fought back, with a goal by Brady Ward tying the score at 3-3 near the end of the third.

“Near the end of the game, we let up for a whole shift and they scored with 31 seconds left,” said head coach Josh Hepditch.

Thunder Cat Colby Livingstone managed a shorthanded goal with five seconds left, sending the game into overtime.

In overtime, Livingstone earned a game misconduct, leaving his team to successfully kill a penalty.

“Anytime that you can kill a penalty in overtime is huge, especially at this time of year,” Hepditch said. “We’re trying to build that for the later part of the year. That’s something we might have do in the playoffs, so doing it right now is a big thing.”

After the Thunder Cats missed their chance on a breakaway, the Steam scored with 14 seconds left.

The next night’s game followed a similar format, with the Thunder Cats going strong until the game was nearly over.

“We had a lapse in the last part of the third period,” said Hepditch.

“We played a good 57 minutes and had a bad three minutes, and they scored three goals.”

The Chiefs scored two more at the beginning of the third period, followed by the Thunder Cats’ fifth, by Johnston, before a Chiefs goal brought the score to 5-4 at 0:23.

“We put ourselves in a pretty good position to win,” said Hepditch, so a faceoff at the Chiefs’ end with seven seconds left should have guaranteed a Thunder Cats win, but the

“We still have to know we have to play those last seven seconds,” said Hepditch. “It’s good for kids learn every second means something.”

“We came out with no effort and absolutely no energy. We deserved to lose this game.”

The lone goal was scored by Jellis, assisted by Logan Rast and Nathan Griffioen. James Porter Jr. was named player of the game.

Having learned a lesson from the earlier game, the Chiefs played better against Penticton — even though they were down 2-0 after the first period, they were battling and skating hard.

The team kept the pressure on and at 17:40 in the second got on the board with a goal by Jellis. A big goal by Serge Chatwin at 17:58 of the third tied the game at 2-2, the final score. Although they had had numerous chances down the stretch, the Chiefs came up empty.

Chiefs lose two, tie one before winning 3-1 over Salmon Arm The Creston Chiefs peewee team played in the Nelson peewee tournament Nov. 16-18, an early season test for the local team to see where they stand in the Kootenays.

Playing Castlegar, the top team in the West Kootenay, the Chiefs played their best game of the early season. An early mistake cost them the first goal, but they got stronger as the game went on.

The refereeing played a huge role in the game, but the penalty killing was great all weekend. After Castlegar scored with 1:12 left in the second period to make it 2-0, the locals came out and dominated the third period with skating and hitting — Creston couldn’t score, having chances but no finish.

The coaches thought the Chiefs matched Castlegar evenly in the intense game, and Brayden Jellis was named player of the game.

Overall, the team learned if they put the effort in, they will be in the mix of tier 3 hockey. The coaches are proud of the team for their first time playing tougher teams and playing intense games. They passed the test and this will make them a better hockey team down the road.

Holly and Jon releasing new CD Doc MacLean SUBMITTED

Holly and Jon (Holly Hyatt on vocals and bass, Jon Burden on vocals and guitars) have just released their third album, an acoustic blues and roots album, and are playing a CD release show at the Snoring Sasquatch on Dec. 1.

Their first CD received national radio airplay and was heard worldwide on Sirius Satellite Radio. They have played on shows with artists such as Harry Manx, Paul Reddick, Colin James, Jeff Healey, Roy Forbes, David Gogo, the Trews, Jim Byrnes and Leon Russell.

The new album is entitled

1929 and contains nine original songs and two Robert Johnson tunes.

Holly’s voice has been described as “soaring from deep inside the well of Eva Cassidy and Aretha Franklin.” Combined with Jon’s fiery and passionate guitar playing, their style of blues and roots music is pure smokestack lightning.

Ricky’s All Day Grill With a new local manager and the addition of popular items like freshly-made soups, Ricky’s All Day Grill welcomes new customers and old into its cozy confines.

Manager Melody Totten will be a familiar face to many, having managed the popular Rendezvous Restaurant and worked at Munro’s, the Kokanee Inn and Jimmy’s Pub and Grill.

“My first job was in a kitchen in Jaffray,” says Melody, who grew up in Bull River and graduated from high school in Cranbrook.

She came to Creston immediately upon graduating and started to work at the Creston Valley Bakery. In 1997 she moved over to the Rendezvous, and became manager there in 2000 until its closure in 2003.

Working in pubs was enjoyable, she says, but Melody is happy to be back in the restaurant business.

“I missed the restaurant—it’s a different atmosphere,” she says. “And I like the management aspect of my job.

I’ve learned something from everywhere I worked.”

Ricky’s All Day Grill is Melody’s first franchise experience and, while there are guidelines designed to ensure quality, she has worked to put her own spin to suit the local market—home-made soups, for instance.

“This is such a great facility—it has a relaxed atmosphere and we are proud to support high school students by employing them,” she says. “I want Creston to enjoy Ricky’s. Come and try it out! And I welcome input on how we can improve.”

Now in her third month on the job, Melody says cream cheese-stuffed French toast with triple berry sauce is a popular breakfast item, as are the Breakfast Bowls and Eggs Benedict—everything is cooked to order to guarantee the freshest of tastes.

Lunch has become a popular mealtime for freshlymade soup lovers, and the Clubhouse, a triple decker featuring maple bacon and slow-roasted turkey. Baby back ribs, slathered in a choice of sauces, are in demand at dinner time.

“We serve good sized portions and customers enjoy the option of having full menu service in our cozy lounge,” Melody says. It’s a good spot to catch a live game of football or hockey.”

Daily lunch and dinner specials keep customers coming back, as do the weekly drink specials.

singing blues in annual tour SUBMITTED

Doc MacLean is pleased to announce that Canada’s seventh annual biggest little blues tour will take a second run through the West.

Since kicking off in September, the National Steel Blues Emergency tour has brought blues medicine coast to coast, answering some 75 calls to nine provinces. The all acoustic songs and stories in the round presentation has conducted operations in venues large and small, grand and humble across the land. After nearly 50 sold out shows with Morgan Davis, Doc MacLean will be continuing his western expedition with a handful of select, solo dates, including Nov. 29 at the Snoring Sasquatch.

Doc MacLean is a blues vagabond writing from the dark side of the blues highway. He’s spent the last 40 years exploring the road atlas from A to Z — surfacing sometimes on big stages in fancy halls, sometimes streetside trolling for change and a meal.

No managers, agents, record companies. No fancy new guitars. He’s a traveller, a collector and teller of songs and stories — a songster in the blues tradition. Blues Revue magazine has called him “the Prince of Darkness.”

With over 200 shows a year across Canada in a battered Lincoln, a working man’s 1929 National and a pocket full of harmonicas, Doc MacLean’s National Steel Blues Emergency tour continues to deliver real music to real people in real places.

Bylaw disputes

From page 1 “If someone disputed a $50 ticket, because we don’t have a court registry in town, the bylaw officer would have to travel to Cranbrook,” said Toyota. “Then he would have to issue a summons to the disputant for a court hearing, and it just went on from there. The whole process didn’t make any sense.”

Residents and town staff will have a clear process for resolution under the new bylaw dispute adjudication system.

The first step involves discussions with a locally appointed screening officer who has firsthand knowledge of the bylaw in question. For an improper parking notice, for instance, the screening officer would be a staff member from the appropriate town department. The screening officer provides information directly pertinent to the dispute. The disputant can then choose to accept the decision and pay the fine or provide a reason for the infraction (illegal parking for a medical emergency, for example, in which the screening officer has discretion to reduce or cancel the fine). The disputant might also work with the screening officer to work on a compliance agreement that could result in a reduced fine.

In cases where the disputant wishes to contest the bylaw infraction notice, a third party adjudicator assesses the dispute. A personal appearance by the disputant is not mandatory. A submission can be made in writing or over the telephone. The adjudicator is appointed by the attorney general and simply decides whether or not the bylaw was violated.

Creston joins more than 50 B.C. municipalities that have volunteered to adopt the alternate system of bylaw adjudication since 2004.

“To help ease the transition into the new system, bylaw notices issued in December will be issued as warnings only,” Toyota said. “The new system will be fully implemented in the new year.”
