he Corporation of Delta will continue to face a lawsuit filed by the family of preschooler Alexa Middelaer who was killed by an impaired driver in Ladner four years ago.

The civil suit, which includes multiple defendants, alleges the municipality was negligent in its spacing of speed bumps on 64th St. where the crash occurred. On Monday, a judge denied Delta's application for a summary trial where no witnesses are called.

"The arguments that Delta's counsel raised at the court—they did not deal with every explanation of why the close placement of these two speed bumps was a causal factor in this crash," Middelaer family lawyer David Osborne told the Leader.

Delta chief administrative officer George Harvey offered little comment on the case, saying the lawsuit is "in the courts at this time, as everybody knows, and we will go through the process and await the outcome."

way municipalities respond is if there is a legal consequence."

According to Osborne, it could be 12 to 18 months before Delta has its day in court for the trial, "given the number of lawyers and parties involved."

One of those parties is Johanson, a defendant in the case. The Insurance Corporation of BC, who joined the lawsuit as a third party, claim Berner—who was convicted of impaired driving causing death and impaired driving causing bodily harm—was not properly insured at the time of the accident. It's alleged that Johanson parked her vehicle dangerously close to the side of the road.

"We expect ICBC to try to shift blame to other parties other than Ms. Berner," said Osborne. Following my investigation in this case she [Johanson] should be released from the litigation. I'm just satisfied there is no valid claim of negligence against her. I've made that offer months ago, but ICBC has refused to let her out."

Meanwhile, Berner, is out on bail pending an appeal of her 30-month jail sentence. In November the B.C. Court of Appeal reserved decision in the case. reporter@southdeltaleader.com

An RCMP officer who was found guilty of obstructing justice in relation to a road accident that killed a young Tsawwassen motorcyclist will learn his punishment today (July 20).

Cpl. Benjamin "Monty" Robinson is scheduled for sentencing in New Westminster Supreme Court.

In October 2008 he was off duty and returning from a Halloween party when his Jeep collided with 21-year-old Orion Hutchinson's motorcycle at the intersection of 6th Ave. and Gilchrist Dr. After the crash, Robinson gave his driver's licence to a bystander and left the scene to walk his children home. When he returned, he told police he had downed two shots of vodka at home to calm his nerves.

During his eight-day trial this past February, a Crown witness revealed that, at a 2007 Christmas party, Robinson had given partygoers tips on how to beat a drunk driving charge.

The defense countered that Robinson had "severe" alcohol dependency at the time of the collision.

Hutchinson's mother Judith spoke to the media after the guilty verdict was handed down in March, saying "this does not bring my son back, but there is definitely a sense of satisfaction just hearing that very strongly worded word 'guilty'". At the time Judith also added that she would like to see Robinson stripped of his RCMP badge.

Some of the 60 residents displaced by Friday’s fatal blaze at the Tsawwassen Terrace apar tment building have moved to temporary accommodations at the Coast Tsawwassen Inn. Century Group owns both properties and has offered to find rooms at the hotel for tenants of Tsawwassen Terrace.

Michel Latendresse, deputy chief in charge of Delta Fire’s emergency management program, recounted the disoriented residents’ arrival at the South Delta Recreation Centre just after 2 a.m. last Friday morning (July 13).

“The day of the event we opened a reception centre where people could collect themselves and be registered and recorded,” he explained.

Latendresse noted that Tsawwassen Ter-

ra c e — a t w o - s t o re y, 40-unit complex—is a mixed housing building occupied by seniors, families and people with disabilities.

In the three days following the fire, victims were offered food, shelter and clothing resources through Delta Emergency Social Services.

“Those residents are being taken care of from this point on by Century Group,” said Latendresse.

Meanwhile, the blaze—which killed one occupant of the building—is still under investigation, said Delta Po l i c e D e p a r t m e n t spokesperson Sgt. Cal Traversy.

“The autopsy has not been completed yet. We are still dealing with next of kin,” added Traversy.

Delta Police Department’s criminal investigation branch is still on the cordoned-off scene at 16th Ave. and 55th St. collecting evidence and working with Delta Fire to determine the cause

Ken Sim, deputy chief of operations, Delta Fire and Emergency Services, said crews responding to the two-alarm blaze described an intense fire coming out of one suite which spread to the adjoining units on

either side and to four suites above.

In total, 13 suites were affected by fire or water damage.

“It was a good save because it was a very hot, intense fire when crews responded,” Sim said.

"Everyone can be their own broadcast media company," he says an enthusiastically. "Musicians have the ability to control everything from creation right down to distribution. You can be your own record company."

McIlroy needed an instrument to start more arts and culture opportunities in Delta. So, he joined the Tsawwsassen Business Association, and is now its president. An image of a smart phone and the phrase "TBA is connected" on the association's visually-appealing, user-friendly homepage signifies he is at the helm. As expected, there is also a link to Arts and Culture Initiatives in the community.

Going into his sophomore year as the man in charge of musical acts for the annual Tsawwassen Sun Festival, celebrating its 40th anniversary this year, McIlroy is jazzed about music being incorporated throughout the August long weekend event.

Traditionally, music was only showcased on a main stage on the last day of the festival. That is until McIlroy was given the artistic director reins. The Tsawwassen Arts Centre, Winskill Park and Earthwise Garden are among seven venues that will feature live performances over the four days.

He's crafted an eclectic musical lineup teaming with homegrown talent, and aimed at pleasing all—teenagers, young adults, families and seniors. McIlroy has also arranged what he calls a "special anniversary gift concert" for the Sunday night: The Left, a Vancouver recording act inspired by music greats like the Beatles and Coldplay.

There will be a Mentor of the Arts award presented on that evening. Legendary local blues man Jerry Doucette is a past recipient.

"It's a real contributor to the arts community," says McIlroy, of those who receive the honour.

It would appear McIlroy himself is deserving of such recognition.

A lifelong musician, McIlroy recalls his seventh grade North Burnaby garage band jamming to grand funk, grinning through that wave of nostalgia. Then there was some touring after Maria Spitale Leisk high school with another band, until McIlroy arrived at his mid-twenties and found another love, his future wife, who inspired him to find a better-paying vocation that would support a family.

Telecommunications turned out to be McIlroy's other calling.

"I recognized in '96 that the Internet was going to change everything," says McIlroy, who is interrupted by his BlackBerry incessantly buzzing at his side.

In the early days of the information superhighway he pondered how live events could be broadcast to mobile phone users. Today he can show us exactly how.

McIlroy developed a software program called mediaManager, which is used mainly by professional sports clients who profit through advertising revenue from broadcasting their live events online.

Of course, McIlroy still moonlights as a musician. The drummer for Delta88—a well-known R&B band around town— talks about harmonious friendships.

Naturally, his three children can also carry a tune. His youngest son Tyson is the principal guitarist for The Simpson Brothers—founded by Tsawwassen twins Rob and Rich Simpson. The alternative band recently won first place and a cool $10,000 in Shore Radio 104's Best of BC contest.

Two long-standing, family-run Tsawwassen businesses on 12th Ave.–Jack’s TV & Stereo and Harris Nursery & Florist—have closed.

Almost half a century ago, in 1965, Jack Learmont opened a full service TV and electronics store in Tsawwassen. His son Bill, who took over the business 10 years later, watched TVs evolve from transistor and tube to LED and LCD. Bill rode the new wave of TV technology—and the business continued to hold its own even when the big box electronics stores arrived.

Jack’s TV, which took in $3.5 million in revenue in 2008, had the distinction of being one of the top 10 independent TV retailers in Canada, said Bill.

But sales have slowly dwindled

in the last four years to just over $1 million annually. Bill blames the recession and better quality TVs. “We shut down our service department about five years ago. [Electronics] didn’t break as often,” he said.

But Jack’s TV would continue to include home delivery and setup for its clients, not wanting to break from a tradition of offering personable customer service. Bill figures it’s the last standing independent electronics store in the South Delta area.

He will continue to assist his customers, some of whom are third generation, with any service issues or questions about electronics purchased at the store.

Business futures Carol Miles brings a little Yaletown to Ladner with well-appointed women's shoe store It took a trip to South Africa for Carol Miles to know where her business future was going.

While abroad earlier this year, she saw a "divine pair of shoes" and thought to herself that a shoe store should bring them in to Canada.

That got her thinking about what she felt Ladner needed in the way of retail shopping experiences.

And at the end of May she opened the South Delta Heels Company which Miles describes as a boutique that brings a little bit of Downtown Vancouver's Yaletown to Ladner Village.

"I want to be able to offer women good, comfortable, attractive shoes," she says as she looks around her wellappointed store with comfy chairs, couch and a wall adorned with an array of shoes.

"I wanted to make it a nice place to

come for people to enjoy the artwork and enjoy the experience," she says, adding the location two doors down from Bombay Joe's on Bridge St. has become quite a gathering place for shoppers.

With summer shoes on display— soon to be followed by fall and winter lines—Miles suggested a recipe perfect to serve on the patio.

She says her strawberry spinach salad is one of her most popular recipes, and right now timely, too.

"It's great for this time of year because strawberries are in season," she says. "But even if they aren't mangoes work very well."

And instead of candied almonds, as the recipe below states, candied pecans are another alternative."

Strawberry spinach salad INGREDIENTS 1 lb. spinach, fresh 1 pint strawberries, fresh, hulled and halved 1 cup slivered almonds ¼ cup sugar (to make candied almonds, slight roast them in a non-stick pan and when toasted, add 1/4 cup sugar and coat.

DIRECTIONS Combine spinach, strawberries

Salad dressing ¼ cup sugar 2 tbps. sesame seeds 1 tbps. poppy seeds 1 onion, minced ¼ cup Worcestershire sauce ¼ tbps. paprika ½ cup vegetable oil ¼ cup vinegar (you can use regular white, cider or wine vinegar) almonds in a bowl. Drizzle salad dressing over top when served.

I was biking along the dyke north of Beach Grove in Tsawwassen on July 6 when I came across two consultants who had been conducting biological surveys in Boundary Bay for Port Metro Vancouver.

They were returning to their car parked on the dyke and when asked, they indicated that they were doing studies connected with the Port’s Terminal 2 expansion on Roberts Bank.

So, why out in Boundary Bay? They said they were obtaining baseline data for birds in the area, including Western Sandpipers.

This seemed strange. Asking around I have uncovered a much more sinister explanation.

What the Port’s survey work on Boundary Bay may be trying to “prove” is that the feeding area and biofilm on Roberts Bank, that is so important to the survival of millions of birds especially Western Sandpipers, is not unique and exists elsewhere in the area.

Previous studies have shown that if a Western Sandpiper stop-over site is compromised, which could well be the case if Terminal 2 were to go ahead on Roberts Bank, then the entire species would suffer a population-level decline.

Birds that could no longer use the site for fueling their longdistance migration would either not make it to the breeding grounds or would not be in good enough condition to breed once they got there. We need to “listen” to what the birds themselves are telling us. Almost every Western Sandpiper in the world uses Roberts Bank because it offers a uniquely rich habitat and far fewer

School district idea on target The Delta School District looks like it's on track to knock its latest revenue-generating idea out of the park—and at the same time meet a community need.

Last week, the district pitched its plan to see if a pair of covered, artificial turf fields— located on school property—would garner public support.

And judging by some of the local sports groups the South Delta Leader contacted for a story on the subject the answer is yes.

Many of those sports organizations that already keep school facilities busy after hours renting gym space like the idea of being able to practise outdoors on artificial turf under a roof.

It would get the field sports groups— many of them junior teams in soccer and baseball—away from the hard bounce of the gym floor and into more conducive surroundings, albeit on a synthetic pitch.

School district officials say the proposal is for two turf fields—one in South Delta, and the other in North Delta. And the best part of the deal is it would not use education dollars to build and run—corporate sponsorship would help foot the bill.

And, presumably, when the construction and maintenance and running costs are paid for, the rental from local sports teams would serve as a much-needed revenue stream for Delta schools.

Now that's creative thinking—something the Delta School District has been noted for over the years when education funding has been squeezed.

Delta has been able to stave off sweeping cutbacks—except for the closure of two elementary schools in South Delta a few years ago due to declining enrolment—thanks to endeavours such as its international student program. And it has attracted students from outside the district, and retained some local ones, by offering a wide array of school academies that focus on various arts, education, and sports.

If the plan comes to fruition it will likely be a win-win situation with sports groups having a comfortable place to play, and the school district gaining revenue to offer more in the classrooms.

Curious case of the missing tombstone has South Delta ties Mission RCMP solve mystery after contacting family of longtime Ladner resident MISSION RECORD

Mission RCMP have discovered the mystery behind a tombstone that was found outside Cedarwood Manor in May. The grave marker was inscribed with the name Fat Look Chan, but police didn't know where it came from or where the next of kin lived.

Normally the RCMP would take the item and wait for somebody to make a claim, but because of the sensitive nature of the item, police investigated to see whether it had been stolen from a graveyard.

the tombstone didn't belong to any cemetery in Mission, or anywhere even closeby.

Eventually, Jones contacted the Chans, who were surprised to hear the news.

"Initially we had assumed that it was the headstone that was in Boundary Bay cemetery in Tsawwassen, and we obviously assumed the worst, that it was vandalism," said Tom Chan, Fat Look's son who now lives in Edmonton.

But it didn't seem to make sense that someone would steal the headstone and drop it off 90 kilometres away.

When Chan called the cemetery,

however, the tombstone was still in place, which made the whole affair even more confusing.

As it turns out, when Chan's father passed away in the seventies, the original tombstone was engraved and placed in the cemetery. It was replaced in 1993 when his mother was interred beside her husband, essentially creating a duplicate.

"So we assumed that the company that replaced the headstone and removed the original would've just disposed of it," said Chan, but clearly that didn't happen.

How it made its way to Mission is still a mystery, but Chan says

Metro Vancouver leaders say they're optimistic Ottawa will contribute one third of the $1.4-billion cost of replacing its Lions Gate and Iona sewage treatment plants and ease some of the pain for home owners who face sharply higher utility bills.

Federal environment minister Peter Kent was in Delta Wednesday to announce new federal effluent regulations that mandate sewage system upgrades to a minimum of secondary treatment.

Metro board chair Greg Moore said he's hopeful one third of the upgrade cost here will be covered by the federal government and be matched by the province.

The new rules had been widely expected and Metro Vancouver is already designing the replacement of its Lions Gate plant, which must be complete by 2020.

EnerChoice products are established by using the testing program from EnerGuide, a Government of Canada initiative that rates the energy consumption of household appliances. These fireplaces carry minimum EnerGuide efficiency ratings of 62.4% (fireplaces), 61% (inserts), and 66% (stoves). The efficiency tells the Home Owners how much heat will return into their home. "It's been aged in oak barrels which," Smith says, "makes for a heavier, more refined beer that we have on tap'.

"This is a summer dish, with a nice, light salad, marinated beans with basil and lemon, a little olive oil and a nicely grilled steak."

The meal is one Smith said he was introduced to while working at Vancouver's famed Il Giardino under Pino Posterero.

"I'm not traditional Italian, I grew up in Sweden. But Pino showed me regional dishes they grew up with, and it's the one I eat myself. It's quick, summeroriented, and easy to do."

Developers including work-live spaces in new projects

Achieving the work-life balance Living in the Lower Mainland can sometimes mean a long commute between work and home. Many developers are making this easier on homeowners by incorporating worklive spaces in their new homes.

Marjorie Ada Henderson passed away peacefully at Irene Thomas Hospice in Ladner, BC on Tuesday, July 10, 2012. Present was her son Steve, grandson Aaron, along with Legion members Jacky and Donna (the girls). Marjorie has now been reunited with her husband, Robert Francis Henderson, who passed away in 1986.

She is survived by her four children, Carol Paulin of Dawson Creek, BC, Susan LeMottee of Prince George, BC, Rick Henderson of Chilliwack, BC and Steve Henderson of Ladner, BC, six grandchildren and their children, extended family as well as a life time of friends.

A Memorial Service will be held at Cedar Park Church, 5300 44th Avenue, Ladner, BC on Saturday, July 21, 2012 at 11:00 am, with a Reception following the service.

A Gathering held in Marjorie’s honor will take place at The Royal Canadian Legion, Branch #61, 4896 Delta Street, Ladner, BC following the service.
