As candidates for Montana’s newly drawn western congressional district competed in their respective party primaries this spring, Montana Free Press asked each of them to complete a written questionnaire to help voters understand their positions on key policy issues. Congress must fund, support, and promote enrollment in the ACA. We must also expand Medicare. Anyone who is interested in enrolling in Medicare should have that option, and if you want to keep your private insurance you should have that Congressoption.must stand up to Big Pharma and stop price gouging on medication. Over 90% of Americans support allowing Medicare to negoti ate with pharmaceutical companies but the only reason it hasn’t passed Congress is because of the money Big Pharma has spent lobbying to get their people elected. As Americans we pay the highest prices of any nation for pharmaceutical drugs, and that needs to change.

Rather than conceding a fair election, an administration obsessed with power called it “stolen.” Bizarrely, this claim was advanced in Montana. Not one elected Republican for sook office because of “fraud.” And there was none, as measured by Republicans across the country. The obsession with retaining power, at the expense of democracy itself, resulted in legislatures in 19 states, including Montana, trying to make it harder to vote. Fourteen states now let partisan bodies overturn future elections they do not like. Former generals warn of a potential coup in 2024.
Q1: Polls indicate many Americans are concerned about the integrity of the nation’s democratic institutions. Both as a political candidate and as a potential member of Congress, what can you do to promote Montanans’ faith in American democracy?RyanZinke (R)

Too often on the trail I hear people say they no longer know who to trust. We need to be clear on this matter that there are special in terests who seek to undermine our institutions, and they do it for money and power. 2020 saw one the highest levels of voter participation in a presidential election. We should be celebrating this high turnout, regardless of the electoral result. However, 19 states have responded by enacting laws that will make it harder to vote. That’s why we need federal legislation to ensure that regardless of where a voter lives, they have safe, secure, and reliable access to voting.
I went on a rural education tour in Seeley Lake, and I learned there were only four houses for sale, all over $700k. That doesn’t work for a teacher with a starting salary of $33,000. Affordable housing is one of the most import ant infrastructures needed to create a healthy, vibrant, and inclusive community. Congress must support efforts to increase the supply of housing with funding and incentives. Currently only one in four eligible projects in Montana are funded because of the limit in federal tax credits available.Wemust also ensure families get a fair shot at owning and renting a home. We’ve all seen the proliferation of Airbnb, short-term rentals, and home purchases by companies in the past few years. Demand in Montana is rising because people are moving here, it should not be rising because investors view it as a way to make a profit. Congress should eliminate tax incentives investors get by buying up homes that could be purchased by families that live and work here in Montana.

I support efforts to expand telehealth and rural health services and provide more flexibility and power to patients and doctors to make decisions outside what’s reimbursable or not. We also need to make improvements to veterans health care and Indian Health Services. We made a promise to our veterans and have treaty obligations — the federal government has fallen short on both.
to get government out of the way and reduce costs and timelines for builders. The federal government can take action to promote the af fordable and stable supply of building materials to include implementing a series of regulatory holidays, increasing domestic production of raw materials and minerals, and ending covid-era policies and spending that are driving up infla tion. We also need meaningful permitting relief; lengthy and costly permitting processes also unnecessarily tie up construction projects.
Q5: To what extent do you see climate change as an urgent issue? What if any federal action would you support to miti gate its effects?
Ryan Zinke (R) Conservation does not mean locking people out of public lands or stopping multiple use of the land. During my tenure as Secretary of the Interior we increased federal energy revenues (which benefits conservation of public lands) by promoting all energy sources, not just fossil fuels or renewables. Under my leadership, we held the largest renewable energy sale in the history of this country with offshore wind and we expanded onshore wind and solar projects. At the same time, we produced record volume of oil and gas, reduced emissions and had the strongest safety year on record. The govern ment’s role should be to ensure a fair playing field for all forms of energy, not select winners and losers with regulations that drive up costs. After a two-year hiatus, the re nowned Emma’s House Gala will spring back to life on Saturday, September 24th from at 6 p.m. at the Events Center at the fairgrounds in Hamilton. The event is the primary fundraising tool for Emma’s House, a nationally accredited CAC (children’s advocacy center) whose mission is to provide essential services to children following incidents and allegations of abuse. The non-profit has been functioning within Hamilton since its inception in 2006, and has assisted literally hundreds of regional children during their very worst moments.

“We try to make it as comfortable as possible,” says Emma’s House Board of Directors President, Alexis Holland, as she describes not only the building, but the wide variety of services that Emma’s House provides. Holland, who had served on the Board for several years before becoming president, explains that the purpose of the CAC is to streamline the incredibly difficult process of assisting a child who may have experienced abuse. Without the services that a CAC like Emma’s House can offer, a child may have to relive his or her abuse dozens of times while enduring questioning from multiple sources and in a variety

What he was trying to say, and the doctor final ly figures out, is, “If you ask us, they’ll be gone.”AllDr. Westin has to do is ask, and any environmental villains he identi fies will be deported by the alien to a “depository planet.” His mission is to get rid of bad people (each person is worth a certain number of years) to add 200 years to earth’s life. However, every time a villain is deported, one of Dr. Westin’s body parts is replaced with a “refurbished” part that is better and stronger than the real one. As he rids the world of the worst environ mental offenders, he slowly becomes “Dr.“HeRefurb.”hasto go through this painful process to save the earth,” says Essen, “dealing with many moral dilemmas in making these decisions.”

“We got some great players, we even had pro tryouts, but the players stopped having fun,” he said. “I got threatened when I kicked a player out for poor sportsmanship. So I shut down the league.”
Essen said he moved to the Bitter root “not realizing that I had moved into one of the most conservative areas in Montana. There’s a lot in the book about the shock of that.” And lots of other stories, too. For example, Essen loves the sport of baseball and started a Bitterroot Baseball League for adults. But he had to give it up be cause “the sportsmanship was so poor. Players started throwing the balls at the umpires when they didn’t like how they were calling the balls and strikes. That was it for me.”

He said the book follows his life of environmental activism, starting with his protesting snowmobiles in the Boundary Waters Canoe Area (BWCA), a big wilderness in northern Minnesota (Essen grew up in Duluth). The protest resulted in the passage of a bill that protects the BWCA from snowmobiles. Essen also ran a talent agency in Minnesota before moving to Montana in 1996.
Essen also ran a telecommunica tions company for a number of years, before becoming a full-time writer. He began writing professionally in the 1990s as a features writer for Gig Mag azine. His first book, “Cool Creatures, Hot Planet: Exploring the Seven Con tinents,” won six national awards, and the Minneapolis Star-Tribune named it a “Top Ten Green Book.” His second book, “Endangered Edens: Exploring
the Arctic National Wildlife Refuge, Costa Rica, the Everglades, and Puerto Rico,” won four national awards. His previous novels include “Time Is Irreverent,” “Time Is Irreverent 2: Jesus Christ, Not Again!” and “Time Is Irreverent 3: Gone for 16 Seconds,” all of which became Amazon #1 Best-Sell ers in multiple categories.

It’s important the federal government retains land so that it may be used by the public, rather than off-loaded to states with the eventual goal of privatizing it when the state can no longer afford to maintain it. We cannot let the checkerboard challenges of private and public lands continue to intensify.

Yes. We must bring federal policy more in line with Montana and a number of other states. However, addiction to drugs, even marijuana, is real and damages lives and communities. We must increase support for treatment programs and ensure that marijuana is not sold to teenag ers and the edible market is regulated for safety.

I support making college more affordable by increasing the availability of need-based scholar ships and by charging students the same interest rate that the federal government charges banks, 0%. I also support free and affordable tuition to community colleges.
I never have and never will support the sale or transfer of federal lands. In fact, I was nearly kicked off the House Natural Resources committee my freshman year of Congress for voting against all sale/transfer efforts and for LWCF reauthorizations. The federal government must prioritize public access and multiple use of public lands. As Secretary, I opened up hunting and fishing access on millions of acres of federal lands, including in Montana. We constantly sought land swaps and acquisitions to open ac cess to landlocked parcels, and we made historic investments in infrastructure for National Parks. The rationing of access at Glacier National Park would have never happened under my watch. The answer is modernizing infrastructure to allow folks to enjoy more of the park versus shut ting the park.
Absolutely, which is why I cosponsored legislation for a balanced budget amendment to the Constitution. If elected, I will maintain my seniority from previous terms in Congress. I will use that position to seek a spot on the appropri ations committee to defund and zero out regula tions that cost the economy and projects and of fices that are wasteful or outside the scope of the federal government. I’ll also work with colleagues to reorganize and reform the executive branch. As Secretary, I saw firsthand how bureaucratic, antiquated and, frankly, wasteful the federal government is. When you try to change anything the answer you’d get back is “Well, we’ve always done it this way.” It has to stop. Billions of dollars in grants go out with no oversight, just autopilot. Jobs are filled blindly without even considering if the tasks could be done better elsewhere. And at the Department of Defense alone there are more than 800,000 employees that aren’t military. Then there’s the procurement process…
(R)

With all functioning governments, this is an area that requires bipartisan solutions — not partisan attacks — so that everyone sacrifices a little to rein in the debt. This is an area where a bipartisan working group must unite and identify agreed-upon areas where taxes can be raised and which programs can be cut. Both must happen.

Q7: What do you see as the most important priorities for the management of federal lands in Montana? Should the federal government consider transfer ring some federally held land into state ownership?RyanZinke (R)
Public lands cannot exclusively serve com mercial and corporate interests. Conservation is about how we protect public and private land from misuse, how we protect the quality of water, how we preserve access to hunting and fishing places, and how we make sure Montana’s public lands remain open to all of us. Congress has a vital role in making those things happen.
I will support local conservation solutions that start from the ground up. The Blackfoot Clearwater Stewardship Act brought ranchers, loggers, recreationists, business owners, and conservationists together to chart a path forward for the Blackfoot River watershed.
Monica Tranel (D)
The best reforms support local innovation and control, increase teacher pay, and reverse the defunding of public schools. The Leave No Child Behind Law discriminates against rural areas by employing criteria that deem rural schools to be failing when they are not. Schools then suffer by losing funding and not being able to attract and retain quality teachers. We must fund schools so that all of Montana’s children can succeed.
Ryan Zinke (R)
The reality is we can have some debt but we must be responsible stewards for the future.
Monica Tranel (D)
I am running for Congress to fight for poli cies that allow families to make their world a bet ter place, in their own way, on their own terms. I fully support a woman’s decision to choose whether or when to have a child and will fight in Congress to protect that fundamental right.
IN THE MATTER OF THE ESTATE OF: JOHN ANTONE BER TOLERO, Deceased. Probate No.: DP-22-70 Dept. No.: HOWARD1F. RECHT

Monica Tranel (D)
We must also support families when they de cide to have children. Child care is 35% of some families’ budgets. Congress can provide child tax credit, paid family leave, affordable child care, and more.
Ryan Zinke (R)
Q10: What changes, if any, would you like to see to current federal regulations regarding firearm ownership?
Monica Tranel (D)
I have an A rating from the NRA because I believe in the Constitution and that our Second Amendment rights “shall not be infringed.” As a Navy SEAL, Secretary of the Interior and a Montanan, I can say without a doubt our Second Amendment rights protect all the others. As Secretary I opened access for hunting and rec reational shooting on millions of acres of federal lands and repealed Obama-era rules that banned traditional ammo on federal lands and prevented the BLM from managing land as shooting ranges. As Congressman, I would support legislation to further solidify Montanans’ Second Amendment rights such as to: recognize concealed carry reci procity, ensure equal access to capital for firearm manufacturers, remove suppressors from the NFA, prohibit the VA from stripping veterans of their Second Amendment rights without judicial process, and a series of other measures. I also support local and state efforts to teach hunter education in schools.

I grew up on a ranch. I know responsible gun ownership is a way of life in Montana. The national debt also is a po litical football, with the party in power increasing it and only complaining about its size when the federal government is not supporting their political agenda.
Q9: In the event Roe v. Wade is overturned by the U.S. Supreme Court, would you support federal legislation that either guarantees abortion access or that, alternatively, establishes legal protections for life beginning at conception? What specific provisions would you like to see included in future federal abortion law?
Among 36 industrialized countries, the U.S. is the only one to not provide early education programs to all 4-year-olds. And we are last among 36 countries that provide child care for 3- to 5-year-olds. I support efforts to create high-quality early childhood programs.

Hamilton squeaked out a 27-20 victory against Frenchtown in the battle of the Broncs on Friday, Sept. 9th in Hamilton. Hamilton found themselves in unfamiliar territory, as they trailed Frenchtown 14-20 in the 4th quar ter. Hamilton turned the tide with clutch playmaking, led by junior wide receiver and defensive back Taylor Searle. With 11:51 left in the 4th quarter, Searle’s defender fell down on a deep rout, and quarterback Tyson Bauder heaved the ball down the field. Searle snagged the 50/50 ball away from the defender, kept his feet, and strolled into the end zone. That tied the game at 20-20. Then on Frenchtown’s next possession, Searle intercepted a pass and Hamilton got the ball back, leading to a Bauder one yard TD run, and giving Hamilton a 27-20 lead. Frenchtown had a chance to tie or win at the end of the game, but Hamilton’s defense held strong, preserving the victory.

Stevensville got their first win of the season with a 50-0 thrashing of Browning on Friday, Sept. 9th. Because of the smoke, the game was moved from Stevensville to Ronan. Running back Kellan Beller rushed for 146 yards and had two TDs. Quarterback Gracen Trevino had two touchdowns, one rushing and one passing. Connor Lenahan and Beller each returned an inter ception for a TD.

In their 13C rematch from earlier this year, the Darby boys were eager to fend off the Victor Pirates. Besides a slow first quarter where the Tigers trailed by 4, the rest of the game was really just a slow march to victory. Darby head coach Krystal Smith said, “Ball movement, defense, and hustle are what helped us pull the win against Victor.” This seemed to be a good representation of Darby’s success against the Pirates. The Tigers did a good job of being patient in their offensive movements and took high percentage shots at the basket. When asked what their week of practice looked like leading up to this matchup and what they anticipated, Coach Smith said, “We always know that a rival game can go any way, so our biggest advice was to keep our head in the game, play our game and hustle and work together and they definitely worked together! And with a little press the whole game we wanted to slow them down and try taking advantage of a few mistakes.”

Drawing together all the wrestlers in the valley over the weekend Florence hosted the 2022 Mike McChesney Battle of the ‘Root. And it was once again Corvallis with 99 points that took home the trophy this year, bringing pride and honor to that program. Florence came within striking distance at 70 team points followed by Hamilton at 53 and Stevensville at 47 total points. Besides the team rankings and scores, individual athletes were recognized by the competing schools’ coaches. Jason Davis from Corvallis, wrestling at 138, was recognized as the “Bitterroot Valley Outstanding Wrestler.” Davis pinned Dillon Janes in 2:45. The lone Florence senior, wrestling at 205, was recognized as the Bitterroot Valley Wrestling Ambassador, won by pin in his match earlier in the day against Cadogan Wheat of Hamilton.ForFlorence Head Coach Skip Rosenthal, the event is unique in a variety of ways. He said, “The ‘Root is really a special event. In addition to bragging rights, it is one of the rare opportunities Florence gets a chance to wrestle against the other Bitterroot Valley teams since Florence is B/C and Hamilton, Corvallis, and Stevensville are A. It is also the only time where it is just our local teams. Many of our families know each other, have battled in earlier generations, and actually get a chance to connect at this event.” Rosenthal said the event began about 10 years ago, at the direction of the valley coaches.
Corvallis traveled to Dillon on Friday, Sept. 9th and lost, 6-45. Dillen Potter had seven catches for 79 yards and a touchdown, and had two inter ceptions on defense.
When asked later what he liked about his experience, Grazzani said, “My favorite aspect about being an exchange student is to experience a new type of life and culture with new people and have the opportunity to play basketball at a higher level than before.”“I’veplayed basketball in Italy for five years,” said Grazzani. “This is my sixth year in a club, because in my country school and sports are separate programs.” Grazzani usually exhibits a positive attitude and it wasn’t surprising to hear his response when asked what he liked most about his team and experience thus far. “I love how we support each other on our team. Our coaches are trying to make us compete and get better every
“I was a proud, proud coach, they channeled a great amount of emotion,” said Heather Berry, head coach of the Darby Tigers, following their dramatic win over valley rival Victor, 51-47. Going into Friday’s game the Lady Tigers had struggled in their first game against the Pirates, but it was a different story this weekend. Coach Berry aimed at clarifying expectations and focusing her athletes on what they could control.TheLady Pirates controlled the game, much like they did in the first matchup, until late in the fourth quarter. With a minute-forty remaining in the game it was 4143 Pirates and Victor senior Bella Schicilone forced a foul driving the lane and found herself at the foul line with the hope of going up by four. She nailed the first one, 4144, then missed the second. With the ball back, Lady Tiger number 12 Samantha Shull launched up a jumper that banked in. Now in transition racing down the floor, Schicilone drove hard in the paint and drew another foul with the opportunity to extend the Pirate lead. After missing the first, she hit the second, 43-45 Pirates. Then Lady Tigers inbounded the ball rushing down with 47 seconds remaining when freshman Petra Mustafa rebounded the long shot and banked in a basket with a foul sending her

By the end of the third quarter, this game was still very close, 32-28, but the final score was 41-60. Darby had a great fourth quarter, outscoring the Pirates 28-13. Townsend and Smith both had stellar 4th quarters, each posting 8 and Reed had 6 in that quarter.“Until the game is over, my only thoughts are to keep putting the ball

You saw the players and fans go berserk when Faith al most scored in the first minute of the varsity game!”Both teams came out fast and strong in the first quarter, not really giving much up on defense for either team but Stevi managed to come out ahead 10-7 going into the second quarter. But, like she has done many times this sea son, Florence’s Kasidy Yeoman went off in the second quarter with 11 of the Falcons 27 to end the second half.

The 2021-2022 season has apparently been somewhat of a rekindling of the wrestling community in Florence. “As far as the Florence team’s performance, I couldn’t be more pleased,” said Rosenthal. “We’re in a bit of a rebuilding year with a new coaching staff and a renewed commitment to wrestling from the Florence School Administration and School Board. We will have a school-sponsored Middle School Program beginning this year and will be moving into our new dedicated Wrestling Room in the next couple of weeks. But not for long.
“We have been really pushing for the boys to take good quality shots and tonight they all did that,” said Smith. “Hooper took over attacking the key while Preston, Cully, Sawyer, Andrew, Jackson, and Nolan worked on shooting when they were open and driving to the hoop.” When asked which players really stood out she responded, “That’s a tough one, this game all of our players did a roll and did it well.”

Hutchin son had 21 on the night, scoring mostly in transition but she was also effective pulling up from the mid and three-point range as well. But the Lady Jackets are most effective in the more runand-gun style of play.
Wolves are not “killing ma chines.” Only human beings and things used by human beings can be “killing machines” because only hu man beings are capable of complex and even malicious thought. Only human beings kill for sport; other creatures kill for food or self-de fense.Wolves can’t just take out a gun and bring down an elk; they risk their lives to do so, and if they kill more than they can eat at the time, it’s probably because they haven’t eaten for a while and they will most likely come back to the kill rather than go after more.
And while every human being is probably an a**hole from time
to time, if they are thinking and caring, they are not simply and radically “Republican” or “Dem ocrat” or “socialist” or “fascist” or even “rural” or “urban” or “friend” or “enemy.”Everyone, without exception, wants to be comfortable, safe, and happy; we just sometimes see dif ferent ways of getting there because we live different lives in different places and under different circum stances. Some people apparently will never be happy until they own the whole world and can do with it as they please. Some people just want to get good care for their kid’s broken leg and/or eyes and/or teeth without going under financially.

I lean “liberal” because I gen erally like people and want them to be able to be happy in their way and leave me alone to do the same. That’s why I am willing to pay taxes to support a government elected fairly by ALL THE PEOPLE, which means we all talk with and listen to each other and try to understand our various wants and needs and then elect people of integrity who have – not necessarily money but – a broad view and will try to represent all of us and our wants and needs. It’s complicated. “Not only do the named Plaintiffs have different legal theories than much of the class, they have made those legal theories the focus of the litigation. In fact, of the nine counts raised in the complaint, six are asserted exclusively on behalf of those who cannot pay for pretrial services,” they wrote. “In sum, the indigent and non-indi gent class members will be prosecuting different legal theories and are subject to different standards of proof and different defenses. “I believe the judge un derstands the fundamental problem with Ravalli County’s pre-trial fee system,” said Telfeyan. He said at several points the attorneys for the defendants had trouble jus tifying why they are charging fees prior to trial. He said the fact that the court heard arguments for four hours was an indication of how serious ly the court was taking the matter.Telfeyan said that he would expect a written order in the case to come within a couple of weeks to a month. This is a critical case that will affect hundreds of people in Ravalli County, he said.

complaints against the indi viduals.Inreference to another lawsuit in which an injunc tion was sought to restrain an “illegal bond-setting practice” the judge rejected the injunc tion request, noting that “the order would contemplate interruption of state pro ceedings to adjudicate asser tions of noncompliance by petitioners. This seems to us nothing less than an ongoing federal audit of state crimi nal proceedings which would indirectly accomplish the kind of interference that Younger v. Harris, supra, and related cases sought to prevent.”

“It’s not a small problem, it’s a huge problem,” said Telfeyan. “We are hoping to make a difference.”
Plaintiffs claim in response that “although Defendant Judges suggest Plaintiffs seek to impose liability against them, Plaintiffs request only declaratory relief against Defendant Judges relating to their roles as county policy makers in creating and im plementing the Jail Diversion Program policies. Defendants also mischaracterize Plaintiffs’ case as requiring a searching inquiry of individual circum stances, but members of the four proposed classes share common injuries, common legal theories, and common claims.”Ravalli County’s response to the class action certifica tion follows the District Court Judges’ reasoning for the most part, concluding that the Plaintiffs fail to establish that common questions of fact or law predominate in this case, and further fail to show that a class action is the superior method for fairly and effi ciently adjudicating Plaintiffs’ claims. Certification under Rule 23(b)(3) is therefore improper, they claim.

To the extent the Judges have failed to follow this statutory directive in ac tual practice, the alleged devi ation necessarily depends on a host of facts unique to each defendant’s case. As such, there is no common question which is capable of classwide resolution.” They argue specifically that the plaintiffs have failed to sustain their burden to satisfy the rules governing the establishment of a class action, having to do with “numerosity, common ality, typicality, and adequate representation,” as well as other“Thererules.is no common an swer to any question against the Judges that would resolve an issue in dispute in one stroke,” they contend. “None of these questions will yield an answer capable of resolv ing any issue in dispute. the Judges regardless,” they wrote. They claim the judges are being sued “for nothing less than applying Montana law when setting bail and pretrial conditions… Plaintiffs wish to challenge the statutes authorizing the Judges to set pretrial conditions serviced by a pretrial services agency, there are mechanisms to do so, but they do not include suing the Judges for following the Theylaw.”also claim in their motion to dismiss that the plaintiffs cannot demonstrate redressability, or a causal nexus. They further claim that in order to grant the relief requested, the Court would necessarily have to review and determine the lawfulness of prior state court decisions imposing pretrial conditions which is not permitted under the 11th Amendment. They also argue that the plaintiffs’ claims could have and should have been litigated in State court. In their own motion to dismiss, the Sheriff and Jus tices of the Peace argue that the county defendants named in their official capacity are not the proper parties to be sued. The charges against the Sheriff in his official capacity, they argue, is the equivalent of charging Ravalli County and should be dismissed as duplicative. The motion contends that because a Jus tice of the Peace is presiding over a criminal case, acting as an agent of the State of Montana, the claims against them are barred by the 11th Amendment and should be dismissed.Theyargue that none of the claims against the County are valid. They argue that it is the state and not the county that sets all the requirements for the program that are in dispute. The county is sim ply carrying out the court’s instructions and its decisions, they claim. They also note that evidence of discriminatory in tent was also lacking. They go on to claim that the plaintiffs fail to state an adequate claim for due process violations or unequal administration of the law. Like the District Court Judges they also argue that a decision in favor of the plaintiffs would interfere with the underlying criminal
Attorneys for the Judges also argue that the primary relief being sought is pre dominantly monetary and not declaratory while the rules re quire that it be predominantly declaratory.Theyalso argue that certification of a class action is premature, writing, “in the event the Court is inclined to certify the proposed classes, it should take up the Judg es’ dispositive motions first by ruling on the pending motion to dismiss and then, if the case survives, setting a briefing schedule on the Judges’ motion for summary judgment.”

Attorneys for the Judges also contend that the plain tiffs have not shown that the claims of each plaintiff named in the suit do not differ significantly from the claims or defenses of the class as a whole. The claims, they contend, “must arise from the same events or course of conduct and must be based on the same legal theory.” In this case, they argue they do not. The fact that all four named plaintiffs are indigent and claiming violations of their rights based on their poverty distinguishes them from other non-indigent plaintiffs.

“Because Plaintiffs’ federal constitutional claims may be mooted or substantially nar rowed by resolution of their state law claims, this Court should abstain from hearing the federal constitutional claims and Plaintiffs should be required to litigate their claims in state court,” they wrote.Judge Dana Christensen said that he was taking the arguments under advisement and would issue a decision promptly.EqualJustice
