Can You Ignore a Lawsuit Filed Against You?
Let’s say you are handed a lawsuit and summons by a process server. It’s a BS case fled by your crazy neighbor for something you clearly didn’t do. You can ignore the suit, right? Wrong. You most certainly cannot ignore it.
Once you’ve been served with a lawsuit, the law is very clear: You have 21 days after the date of service to either fle an answer to the suit or a motion to dismiss it. If you fail to do so, the person suing you can ask the judge for a default judgment against you for everything they asked for in their suit. A judge will almost always grant default judgment against the party who did not respond within 21 days. You don’t get to contest it. You lost the case from the get-go by not responding.
People who are sued sometimes think they don’t need to respond to a lawsuit because they can just explain to the judge how meritless the case against them is. They think a default judgment is like a traffc ticket where they can tell the judge what happened and the judge will see how right they are and dismiss the suit. Judges can’t really do this when someone has not responded to a suit. Instead, judges almost automatically grant default judgments against people who do not respond to the lawsuit. (There are some limited exceptions which are very rare.)
The summons you were served with could not be more clear – it specifcally tells you that if you fail to respond within 21 days that default judgment can be entered against. Believe what it says.

WTI generally works with rural and tribal communities on transportation issues such as mobility, infrastructure, trafc calming and safety. Matt Madsen described how WTI uses its grant money to bring WTI expertise into a community to begin a public process of identifying potential problems and making decisions about how to solve them.
“A lot of Montana towns have main streets that are also highways,” he said, indicating that conficts around transportation issues are a common theme. “With this grant money we were looking for other communities to partner with.”
Madsen described the walk audit as a frst step in the process of addressing transportation issues in an area.
“We really come into the community and start to hear from people,” he said. He also added that data collection and community engagement come long before any recommendations about infrastructure alterations.
As the group moved westward
along State Street, Madsen and Gleason asked that the participants share their experiences of using the corridor, as well as their observations and concerns. Most participants agreed that crossing from one side of State to the other can be difcult and even dangerous in certain locations. While the relocation of the Fire Station will undoubtedly remove some of the pressure from State Street, visibility issues still make crossing less than ideal.
Madsen and Gleason will be compiling the group’s observations in order to create a full report and begin a deeper look at the future possibilities.
The City of Hamilton has sought and secured funds for its partnership with WTI, therefore avoiding usage of general funds for any analysis that may take place.
In another project, city ofcials, along with participation from Bike Walk Bitterroot and input from WTI, are also exploring trafc calming measures within several south-side intersections where speeding and failure to stop has been a recurring issue.

FLYING: pilot on importance of aerial heritage

“A lot of people don’t know that general aviation is for the general public.” Though there are a number of relatively expensive classes and licensing processes, getting a general aviation pilot’s license is something Weed believes is achievable, and to her, worth it.
“I learned to manage risk in an airplane, conquering fear and gaining confdence,” said Weed. “I can’t imagine anything else that does that like this.” Weed, who used to ride horses, compared the freedom of fying with riding. “It’s American heritage, and we’re still doing it!”
Flying goes far back into American history, in fact one of the organizations Weed participates in embodies that history. Chair of the Western Montana branch of the Ninety-Nines, Weed explained that one of the founding members of the organization was one of the most famous pilots of all time, Amelia Earhart. Weed’s chapter is based in Stevensville, and is for the western half of the state. The Ninety-Nines are an international organization of licensed female pilots whose goal is to spread the love and practice of aviation, especially among women.
Along with Earhart were 98 other founding members, from which the organization got its name. The organization provides scholarships to new pilots that helps pay for ratings, which can be some of the most expensive parts of the journey to becoming a pilot.
In Montana, among other places, the organization also paints airport runways. This is a process called air-marking, in which various informative items, such as compasses, elevations and airport names are painted onto the air-strips for pilots to be able to see mid-fight. The Ninety-Nines have airmarked hundreds of airports across the state.
Weed is also a member of the Stevensville Airport Advisory Board, which meets the second Tuesday of every month. The public is welcome to attend airport board meetings and comment during public comment periods. Meetings start at 5:30 p.m. at the Stevensville
Town Hall, near the fre station. In fact, the airport encourages the public to attend.
According to Weed, the airport is owned and operated by the Town, which so far does not heed the advice of the board. This makes improving and keeping the airport up to date difcult. There are several things which are in need of improvement and are even in violation of federal guidelines. These things, Weed says, often take upwards of a year to be addressed by the Town. She and others believe much of this comes from a lack of understanding and familiarity with aviation in general. Weed thinks this is something that communicating with the public would help to fx. Without many basic amenities that are common among other even smaller airports, such as courtesy cars, public restrooms and pilot shelters, the airport may not last.
Weed explained that the airport is in desperate need of attention. She also commented that there are numerous grants available to create these things, but without approval from the Town, nothing can be done.
Weed has been fying for three years, and wants to be a professional pilot. She is currently working towards getting her commercial license. Weed contends that small airports, like Stevensville’s, are essential, not just for her passion, but for the community and for the future of aviation. She explained that airports “ofer a lot more than people realize. We all started learning in these little rural general aviation airports,” said Weed.
“It’s not out of reach!” She explained that rural airports bring aviation to the general public, and provide places for
education and entertainment. Numerous other towns across the country hold thousands of events throughout the year at their airport grounds, from car and air shows to aerial displays and classes.
These small airports are also places where interested prospective pilots, young and old, can fnd scholarships, like the ones provided by the Ninety-Nines. Weed said there are opportunities everywhere. Aside from events, and the jumping of point of many start-up aviators, Weed impressed on how local economies can beneft from general aviation, aside from a location where community events can be held.
According to Weed, municipal airports bring in people from all over, who take aerial road-trips across the country. They often spend time in the many communities in which they land and that also contributes to the local economies. If they have a bad experience, cannot fnd courtesy vehicles to drive around, or fnd difculty getting accommodations, Weed says they will not likely
make the same mistake again.
However, most of the local aviators already live in and contribute to the local economy. “Unfortunately, we are just a bunch of ‘bug-beaters’ out here,” said Weed, referring to the many general aviation pilots of the valley, and the many other small airports dotted across the state. “There seems to be this misconception that people who fy are wealthy,” added Weed. She and others would like to get the airport more involved in the community. They want to do an outreach in Stevensville, possibly later this fall, where they want to help address and remedy some perceived dislike or distrust by any locals towards the airport. They also want to show the community the many wonders and values of general aviation, and what the airport can do for the community.

POOL: Stevensville ofcials work to keep pool on schedule
Continued from page 1 done with the use of the Jean Thomas Park Beautifcation Fund, which was left to the town to help improve the parks.
The second part of the project came as an unexpected shock to the town Parks Department. After the snow and ice melted, Lassiter and others discovered the rim of the pool was completely falling apart. He explained that it was apparently a bad year for concrete all over town. The problem was compounded due to the history of patching the pool rim over time, because there was never enough funds to completely redo the rim. Lassiter saw to the rim being removed and had a contractor come out and cut down eight inches to good concrete. Another contractor will be coming out to repair the rim.
“The concrete was a complete surprise to us,” said Lassiter. The unexpected cost is being funded by a grant from the Rapp Family Foundation and another from the Stevensville Community Foundation.
Even after both grants, Lassiter said the Town will still come up roughly $2,000 short. However, he also explained that through some potential private donations from area businesses, his “hope is to complete this whole project without using any taxpayer dollars.”
“It was a blessing,” said Lassiter.
“There’s some good people here.”
Lassiter also praised the local contractors, who he said gave the town the best deals they could and shufed their schedules around to be there to help. “They want to see this happen too. They live here too,” said Lassiter. The town also saved money by the Parks Department doing much of the cleanup process along the way.
The Town’s goal is to open the pool in June. Traditionally, the pool has opened after the school graduation, which this year would have the opening fall on June 12. However, this will not be possible, explained Lassiter. He said it will likely be late June that the gates open to the public for the summer.
The Town also held a council meeting early in June to vote to raise pool fees. Lassiter said this is not related to the costs to repair the pool, which by then were already under way. This will be the frst fee increase in 10 years, and will only be a dollar more than the existing entry fee. Lassiter said it was necessary because “wages are going up and so is chlorine,” though he said he does not like the fee increase either, but times are changing.

Tuesday at Twelve Summer Concert Series to launch
The Jean Matthews Tuesday at Twelve Summer Concert Series will commence on Tuesday, June 13, with a concert by The Flaming Suzettes, with concerts every Tuesday at noon through August 22, including Tuesday, July 4.
The concert series was founded in 1990 by Jean Matthews, and is now in its 33rd year. Matthews passed away in 2015, but the concert series remains as her legacy.
The free concerts will take place on the lawn of the Ravalli County Museum every Tuesday from noon until 1p.m., and attendees are encouraged to bring their own lawn chair or blanket and a picnic lunch, and to dress for the weather. In the event of rain or unhealthy smoke levels, the concerts will move to the Community Room of Hamilton City Hall.
There are no food vendors at the concerts, but picnickers are encouraged to take advantage of the many Hamilton eateries ofering grab ‘n go lunches.
Series sponsors for this year’s concerts include the Downtown Hamilton
Business Improvement District, the Rapp Family Foundation, Bitterroot Drug and Main Street Toys, Brothers Mortuary and Crematory, and Trailwest Bank. Mary Jane Honey
Mary Jane Honey, of Darby, passed away peacefully of natural causes at Daly Hospital in Hamilton, Montana on the afternoon of Sunday, March 19th, 2023. She was 97 years old. Services will be at 2:00pm on Sunday, June 11th at the Darby First Baptist Church.
Mary Jane Honey was born Mary Jane Logan on October 26th, 1925, in O’Fallon, Illinois to Bernard Joseph and Julie Lebegue Logan. After attending and graduating from O’Fallon High School, she went to Baptist Missionary Training School – a four-year college in Chicago, Illinois. She graduated in 1948 with her B.A. in Bible Studies and a Social Studies minor. While in college, she taught religious education in the Chicago Public Schools and led Vacation Bible School in rural southern Ohio. Mary Jane was commissioned as a missionary by the American Baptist Convention (then called the Northern Baptist Convention) and in the spring of 1949, she accepted a call to serve as the Christian Education Director and Assistant Minister for the Bitterroot Larger Parish which included Darby, Victor, and Stevensville Baptist Churches.
In 1950, Mary Jane and Robert Kerlee were married in the Darby First Baptist Church. They had two sons, David Leroy, and Eugene Joseph. In 1954, Robert Kerlee passed away, and Mary Jane went back to school at Western Montana College in Dillon to get her B.S. in Education. She taught school at the Baker Creek school up the West Fork of the Bitterroot, in Hamilton at Jeferson School for three years, and at Darby Elementary School where she retired after 23 years as a teacher. Her years teaching 1st grade in Darby were a real blessing to her.
On December 24th, 1963, Mary Jane Kerlee and Lowell R. Honey were married in the First Baptist Church in Darby. Lowell had three grown sons of his own (Ray, Paul, and Robert), and adopted Mary
Jane’s two young sons (David and Gene) after they were married. Mary Jane and Lowell enjoyed traveling. They traveled in all but a few of the states including Alaska and Hawaii, and also traveled to Mexico, England, other countries in Europe including countries in the Mediterranean, and the Holy Land. In her earlier years she enjoyed sewing and during World War II in her high school years she was part of a group that sewed army tents in East St. Louis, Illinois. She also enjoyed camping trips, working in her yard, growing fowers, and canning the fruits and vegetables that Lowell grew in the garden. She also volunteered as a driver for patients who needed transportation. She was a member of the First Baptist Church of Darby, the Connor TOPS club, Women’s Wednesday Bowling League, and mixed bowling teams with her husband, Lowell. After Lowell passed away in 1993, Mary Jane took Hospice Training and became a Hospice volunteer in the Marcus Daly program.
She is survived by her son, Gene Honey, stepson Paul G. (Kathy) Honey of Darby, MT and his children Sadie (Zach) Honey of Denver and Rose Honey of Missoula, Mary Dell (Gary) Honey and her children Wade (Dorothea) Honey of Missoula, Stann Honey of Darby, and Tanya Honey of Olympia, Washington, Dean Kessler (the son of Robert Honey) of South Carolina, and numerous great grandchildren, nieces, and nephews throughout the U.S. She was preceded in
death by her frst husband, Robert Kerlee, husband Lowell Ray Honey, son David L. Honey, stepsons L. Ray Honey, and Robert Dean (Georgia) Honey, and her brothers and sister John, Francis, Harry, and Marie. She will be buried in Lone Pine Cemetery in Darby, MT.
Vahe “Kaz” Yesav Kazandjian, 75, was born on September 8, 1947, in Jafa Palestine and passed away on June 1, 2023, at St. Patrick Hospital surrounded by loved ones. Kaz was a proud American and Patriot who served our country in the Air Force from 1965 until 1968. He was a successful business owner in Tucson, AZ and moved to Victor, MT in November of 2007. Kaz loved to “work” the land and being surrounded by beautiful Montana. Anyone that met him, loved him and is often described as a “unique person with the best sense of humor that would give anyone the shirt of his back”. Darby has extreme rodeo weekend
The best bareback riders in the world descended on the Richard Cromwell Memorial Rodeo Grounds in Darby on June 2nd & 3rd for the Yellowstone Darby XTREME Bareback competition.

Feild, the 6-time World Champion from Genola, Utah, scored 93.5 points on Pickett Pro Rodeo Company’s Night Crawler in the fnal round to win the event. Feild took a majority share of the $54,050 purse, which was the single largest purse in history for a stand-alone bareback event.
“This rodeo is amazing,” said Feild. “The tradition that’s been developed in such a short period of time is fabulous. I’ve been doing this for a long time but here, at this
rodeo, I get amped up, I get fred up. They bring the best stock, they attract the best competitors in the world, and it makes it one of those events you look forward to all year long. When
you’re writing down your goals at the start of the year, Darby’s right there at the top of the list.”
The event was previously called the Darby Riggin’ Rally and is in its
4th year. The event was sanctioned by the Professional Rodeo Cowboys Association (PRCA) and attracted the world’s best bareback riders. Paramount Network’s original series, “Yellowstone,” was the presenting sponsor and it was broadcast on the Cowboy Channel.
On Saturday, June 2nd, 47 riders competed for 10 spots in Sunday’s fnals.
On Sunday, these 10 riders joined the top 20 pre-ranked riders, making 30 total riders for Sunday. These 30 riders all rode once on Sunday, with the top 12 scores making it to the fnals. Corvallis’s Caleb Bennett was the top qualifer on Saturday, scoring 87.5 points. Stevensville’s Richard Champion also qualifed for Sunday’s event.

then rallied with 6 runs in the bottom of the 7th, but fell just short, losing 8-9. Olivia Coulter went 3 for 5 with 3 RBIs, Taylor Pyette went 3 for 4 with an RBI, and Ava Philbrick went 2 for 4 and scored 2 runs. In the next game, Florence fell to Columbus/Absarokee/Park City 2-5.

The softball teams of Corvallis and Hamilton ended their season in the Class A State Softball Tournament in Belgrade on May 25-27. The Hamilton girls won one game and lost two, while Corvallis lost both their games. Hamilton defeated Hardin 7-5 in their frst game. Then lost to Columbia Falls 3-16. In their fnal game they lost to Lewistown 5-13.
Corvallis lost their frst game to Laurel 3-9. Then in their second game they were defeated 6-23 by Frenchtown.
Locals play in Cleverley 8-Man All-Star game
Hooper Read of Darby and Roan Jackson of Victor were chosen to be on the Blue Team in the Bob Cleverley 8-Man All-Star Football Game. This game honors the best 8-man football seniors in the state. It was held at the Bob Green Field in Butte on June 3rd and the Blue team won, 56-40. It was the frst time the game was held since 2019.

High Water Chronicles: we’re almost there
I talked to my friend Travis Thurmond recently about water conditions in our end of the state. Travis and Kathy Schoendoerfer are the Ma and Pa owners of Blackfoot Anglers in Ovando.
“Our river’s been running bank-full and discolored for a long time,” Travis says. “It’s clearing now, but it’s not quite there yet.”

I’m looking at the same scenario to play out a little earlier on the Bitterroot, and from what I saw on a drivearound a few days ago there are plenty of eager foaters out, some of them private and a batch of guides. And that’s as it should be. Unless
the root systems of bank-side trees and drops a few more in every season. They add to the tangle and clutter of previous deposits, which in turn gets moved around by the heavy water of runof. This smooth-looking current that you see from a bridge or at a launch site can be deceiving. It is powerful – and may fow just over the top of a hidden limb that could upend your raft in a heartbeat.
For every death we record on the Bitterroot there are numerous near-misses that could have gone the other way. I keep saying it –again and again, and I’ll keep saying it: don’t underestimate the dangers, and don’t overestimate your own abilities.

That’s consistent with what I hear from Josh McCown at Flint Creek Outdoors in Phillipsburg. “Believe it or not, we’re hitting a few fsh on golden stone dries, even though we’re not seeing any of the naturals.” Josh fshes Rock Creek quite a bit and his experience there is typical. If you really want to catch a few fsh on dries, and work hard for every one, Rock Creek is probably your best bet.
When the Blackfoot does drop into shape, Travis expects it to happen fast. “There isn’t much high level snow to keep runof going,” he says. “We had those 80-degree days in April that burned a lot of it of, and it’s been steady ever since. The river is bank-full, dropping a little bit, and when it drops into shape it’ll drop fast. We don’t have much runof left.”
As Travis and I observed, the rivers are dropping rapidly – mine more than
you’re a seasoned professional who can temper enthusiasm with good judgement, or a real, real good oarsman with top-end equipment who knows the river and has checked with two good sources before going out, don’t foat.
Be safe – watch for new hazards
That’s especially true of the Bitterroot – where every year sees new wood in the river.

I’ll add to that: Don’t foat at all this time of year unless you’ve put in a season beforehand on the same stretch you want to foat now. This river will demand more, tax your resources more, and cost you more if you mess up. You don’t need to foat the Bitterroot to take good fsh from it.
Streamers and small nymphs
A friend of mine recently too a pair of brown trout over 20” on the Bitterroot, and lost three more in the same size range. He wasn’t fshing a dry salmon fy. While we’re seeing a few, the grab isn’t on yet. He was fshing a streamer.
To catch more fsh on Rock Creek, fsh underneath. “We’ve been doing well on the Copper-Gold Kreelex,” Josh tells me.
That fy is copper and gold in coloration; the Sparkle Minnow, a similar fy, is green and white. The green and white Sparkle Minnow has been working on the Bitterroot. Depends where you fsh, what day it is, moon phase and how you hold your mouth as to which fy is going to work best. Experiment – and don’t be afraid to experiment beyond the readymade.
Don’t ignore the smaller fies. Kalen at Blackfoot River Outftters in Missoula and I talked about how the smaller fies can often be the best, even though we’re all anticipating the salmonfy hatch.
“We’re seeing some hatches of bluewinged olives on the lower Bitterroot,” he tells me, and it’s not a bad idea to tie a smaller #14 or #16 nymph of the back of your heavier #4 or #6 salmonfy nymph. The smaller fy will quite often outscore the big one.

Forest installing new culverts – temporary closures planned
The Bitterroot National Forest is planning to install three new culverts on the Darby-Sula Ranger District this summer. The work is scheduled to begin next week and will continue into July.
The first project will take place on Sign Creek east of Sula near Moose Creek Trailhead #168 beginning June 5th and will run approximately two weeks. Heavy equipment from the project will be parked on East Fork Road (Forest Road #432) at
mile post 18, making the road impassable.
The second culvert replacement is scheduled to begin on June 19th on Lick Creek east of Martin Creek Campground. Heavy equipment will again be staged on East Fork Road #432 at mile post 15.8 making the road impassable.
The final project is scheduled to begin on July 10th on Lick Creek east of Martin Creek Campground. Heavy equipment will be parked on
Lick Creek Road #5771 near mile post 0.70 making the road impassable. The project is scheduled to last approximately two weeks.
Signs will be posted in these areas alerting drivers to the construction and road work. All dates are subject to change depending on weather or other factors.
The forest is replacing the culverts at theses location along with doing road repairs and other improvements. The

VETS: veteran support through 22 mile ruck
Conner says he really wants to help do what he can to help put an end to this crisis. So, after contacting the VA in Hamilton directly, Conner was eventually linked up with the Valley Veterans Service Center in Hamilton who put him in contact with VVA. VVA is currently in the process of fundraising to fnish improvements on a wheelchair-accessible bathroom at their 17-acre ranch in Sula. The ranch is used as a venue to host veteran and frst responder groups.
Conner is hoping to get sponsors for his ruck march to help raise funds for VVA’s cause. He will be carrying a 35-pound rucksack, and inside will be a memorial brick for another veteran who took his life. This brick will be placed in the Honor Garden at VVA’s ranch in July.
Conner is currently a junior studying pre-med at Carroll College with plans to attend medical school before commissioning as an Army ofcer.

The invitation said Black Tie Only and you know what that means.
It means this isn’t some put-onthe-old-feedbag kind of event. You’ll need your best manners, and you should brush up on where the glass goes and what to do with your fork. You don’t want any faux pas attached to your name, no emotionally-charged statements, and let’s hope you’re not self-conscious. As in “Dinner with the President” by Alex Prud’Homme, the world will be watching you eat.
For as long as there’s been a President of the United States, someone’s had to make sure the guy had nourishment because it’s not like he’s got time to run to the kitchen whenever he’s hungry, right? So somebody plans the menu, the First Lady weighs in, the table is set, and in the end, meals with the President have historically been loaded with interesting dishes, culinary quirks, divine desserts, and sour grapes.
To feed the Continental Army, says Prud’Homme, George Washington resorted to theft. Thomas Jeferson knew that great food was a way to put political foes more at ease with one another, while Dolley Madison thought the same with snuf as dessert.
Abraham Lincoln helped cement one of our most beloved national holidays into our lives. Later, Ulysses Grant was known for big dinners of up to thirty-fve courses and Theodore Roosevelt held one dinner that caused big controversy. Our heaviest president to date, William Taft, loved a mussel-and-heavy-cream soup called Billy Bi, which probably didn’t help his diet. On the other side was Woodrow
Wilson, who was “utterly disinterested in food.”
Herbert Hoover was a speed-eater. FDR loved terrapin soup, and considered it a “lucky” dish to serve.
Roosevelt’s cook, a Mrs. Nesbitt, was inherited by the Trumans, who intensely disliked her. Mamie Eisenhower called herself a “cooking school dropout.” LBJ used BBQ as a political
asset, Bill Clinton’s diet was a closely-watched thing, George W. Bush loved his baseball-stadium-themed meals, and Barack Obama ushered in a “foodie” White House that tried to change the way America ate.
So what do you do with the extra spoons, the fnger bowl, the sticky butter knife, and do you need four drinking glasses? You won’t need to know any of that to read “Dinner with the President.” You can just sit down and take a bite.
That’s not to say that this book is completely informal: the opulence of a state dinner shines through in the tales author Alex Prud’homme tells, complete with country leaders, ladies in gowns, and tuxes with tails. You can almost see the glitter. On the other hand, the casualness of, for example, an intimate several-hundred-guest barbecue seems charmingly homespun until you remember that, in politics, food isn’t always just food.
There are battles between chefs and chiefs in this book, tasty historical anecdotes, favorite White House dishes that will make you glad you aren’t at that state dinner, and recipes to make you feel positively Presidential. For you, that makes a “Dinner with the President” a book you’ll eat up.

The Bitterroot National has received a Notice of Intent (NOI) to conduct mineral exploration from U.S. Critical Materials and U.S. Critical Metals Corp. within their registered lode claims in the Sheep Creek location on the West Fork Ranger District for the 2023 feld season.
The historic Sheep Creek Columbite Deposit Mine Site is located in the southwestern corner of Montana in Ravalli County, in the headwaters of the West Fork of the Bitterroot River. The area is approximately 38 miles south of Darby. Deposits were discovered in the area in 1953 and have been studied and sampled since the early 1960s.
Submission of a NOI for a proposed mining operation is required in order to provide the Forest Service district ranger with sufcient information to determine if the level of proposed activity will require a plan of operations.

If the Forest Service authorized ofcer determines NOI operations will likely cause or are causing signifcant resource disturbances, the operator must submit a proposed plan of operations for approval. Operations cannot continue until a plan of operations is approved. Submission of a plan of operations then triggers NEPA and other applicable requirements.
U.S. Critical Materials and U.S. Critical Metals Corp.’s recently submitted Notice of Intent (NOI) for 2023 is a continuation of work that was proposed in their previous NOI from 2022. A copy of this NOI is posted on our website at www.fs.usda. gov/bitterroot under ‘Quick Links’. Proposed exploration activities include continued sampling using hand tools, soil and stream sediment sampling, rock chip sampling, mapping and sampling of adits, ground geophysical surveys, and helicopter or drone-supported geophysical surveys. Close out for the 2023 season is expected to be on or before October 20, 2023.
The NOI was accepted for the 2023 operating season which determined that a plan of operations is not required at this time.
By law, processing locatable minerals plans is nondiscretionary for the Forest Service. Miners have possessory rights associated with mining claims which authorizes the miner the right to use the surface for mining purposes including use and occupancy necessary for processing. All miners are subject to 36 CFR 228 Subpart A including requirements to submit a plan of operations and post a reclamation bond.
