2019 Birthright Israel Alumni Fundraiser Contest Official Rules

2019 BIRTHRIGHT ISRAEL ALUMNI FACEBOOK FUNDRAISER CONTEST OFFICIAL RULES SPONSOR The sponsor is Birthright Israel Foundation (the “Sponsor”), P.O. Box 21615, New York, NY 10087-1615.

PURPOSE The 2019 Birthright Israel Alumni Facebook Fundraiser (the “Contest”) is intended to serve as an opportunity for US alumni of the Taglit-Birthright Israel program to give back by fundraising in support of Birthright Israel in order to enable future participants to experience this incredible journey. As further explained below, all fundraising will take place on Facebook™ via the Facebook “Fundraisers” platform.

PLEASE NOTE THAT SPONSOR AND FACEBOOK ARE NOT AFFILIATED IN ANY WAY AND THAT THE CONTEST IS IN NO WAY SPONSORED OR ENDORSED BY FACEBOOK.

TERM The Contest begins Monday, July 29, 2019 at 12:00:00 a.m. US Eastern Time and ends Tuesday, December 31, 2019 at 11:59:59 p.m. US Eastern Time (the “Contest Term”). ALL FUNDRAISING MUST BE COMPLETED BY TUESDAY, DECEMBER 31, 2019 AT 11:59:59 P.M. US EASTERN TIME. The information contained herein – including how to enter, how to win, and the prizes available – constitutes the official rules that govern this Contest (“Official Rules”). By participating in the Contest, you agree to the Official Rules and warrant that your involvement in the Contest complies with all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.

ELIGIBILITY The Contest is open only to United States citizens who: i) are former Taglit-Birthright Israel participants and have completed their Taglit-Birthright Israel trip before or during the Contest Term; ii) have reached the age of majority in their state of residence at the time of entry; iii) who are not winners of any of the Sponsor’s previous contests; iv) have a Facebook account; and v) who do NOT currently reside in Cuba, Iran, North Korea, the Province of Quebec, Sudan, Syria, or any other country where the delivery of prizes with monetary value will be illegal under those US laws in-effect at the time that the Contest concludes. Taglit-Birthright Israel trip madrichim and staff members (who are not former alumni), as well as employees of Sponsor, Birthright

Israel International (Taglit), Birthright Israel North America, Taglit-Birthright Israel trip organizers, and all of their immediate family members (spouses, parents, and children), are not eligible to participate. The Contest is subject to all applicable international, federal, state, and local laws and regulations.

THIS CONTEST IS Void where prohibited by the laws of the United States of America and where prohibited by the laws of the state or country of residence of Contest Entrant, including Cuba, Iran, North Korea, the Province of Quebec, Sudan, Syria, and all other countries subject to sanctions by the United States Department of the Treasury.

TO ENTER All those individuals who enter the Contest shall be identified as “Entrants” in these Official Rules. To enter, please follow these steps: 1. Log into your Facebook account and click “Fundraisers” in the menu or visit facebook.com/fundraisers.

2. Click “Raise Money” and choose “Birthright Israel Foundation” as the non-profit you would like to fundraise for.

3. Set up your fundraiser to end on December 31, 2019. Set any value for the “Goal” to encourage people to give.

4. Set the title of the fundraiser to be “Your Name | Birthright Israel Foundation 2019 Challenge.”

5. Any description can be entered that encourages friends and family to donate and support Birthright Israel Foundation.

6. Set the fundraiser cover photo, either using the default photo provided by Sponsor or personal photo(s) from your Birthright Israel trip.

7. To the extent you choose to use the cover photo provided by Sponsor, you are only allowed to use such photo in connection with your creating a fundraising page in order to participate in the Contest and only for so long as the Contest remains in effect. You promise not to copy, reproduce, edit, modify, create derivatives of, or use the photo in any way other than in its original, unmodified version, for purposes of including it as the cover photo for your fundraiser. Any violation of this permission may result in disqualification. Sponsor reserves the right to revoke this permission at its sole discretion for any reason and at any time.

8. Congratulations, you have created a fundraiser in support of Birthright Israel Foundation.

All donations made through the Contest will be considered tax-deductible and all donors will receive a formal donation receipt with tax language directly from Facebook. Sponsor is not responsible for the issuing of donation receipts in connection with any donations made through the Contest.

Only one (1) fundraising page may be created per Entrant. To the extent it is discovered that you created multiple fundraising page through various Facebook profiles, you may be disqualified.

No donation or purchase of any item is necessary, and a donation/purchase will not increase your chances of winning.

WINNER & PRIZES Winners will be identified based on which Entrants have raised the most total funds in support of Birthright Israel Foundation via their individual fundraising page as of the close of the Contest on Tuesday, December 31, 2019, at 11:59:59 p.m. US Eastern Time. There will be One (1) First Place Winner, One (1) Second Place Winner, and One (1) Third Place Winner based on the highest fundraising totals. In the event of a tie in fundraising totals at a particular winner-level, the Entrant who reached that fundraising amount through the greatest number of unique donors will be declared the winner at that particular winner level and the other Entrant shall be declared the winner at the next winner-level.

The First Prize Winner shall be awarded the prize of two (2) roundtrip economy-class air transportation tickets to Tel Aviv, Israel from any major US airport of your choice. Return flights must return to the same airport departed from. Sponsor shall select the airline that will provide the flight based on the First Place Winner’s desired travel dates and airlines servicing the departure/return location. Both tickets must be booked for the same outbound and returning flights. Travel must occur between January 20, 2020 and December 31, 2020, must be completed within thirty (30) days of the initial outbound flight, and is subject to blackout dates for travel during the summer and holidays. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the airline to be selected by Sponsor at Sponsor’s sole discretion, as detailed in the passenger ticket contract. Estimated retail value: One Thousand Two Hundred US Dollars ($1,200.00) per ticket, for a total estimated retail value of Two Thousand Four Hundred Dollars ($2,400.00). Actual value may vary based on airfare fluctuations and distance between departure and destination.

The Second Prize Winner shall be awarded a prize of one (1) Two Hundred Fifty Dollar ($250.00) gift card from a gift card company selected at Sponsor’s sole discretion. The gift card delivery method shall also be selected at Sponsor’s sole discretion.

The Third Prize Winner shall be awarded a prize of one (1) One Hundred Dollar ($100.00) gift card from a gift card company selected at Sponsor’s sole discretion. The gift card delivery method shall also be selected at Sponsor’s sole discretion.

Prize-winning Entrants will not receive the difference between the actual and the approximate retail value of their prizes, if any. Prizes are not redeemable for cash. No prize transfer, assignment, or substitution by winners permitted. If a prize is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize with an alternative prize at an equal or greater monetary value and/or specifications, unless to do so would be prohibited by law.

Prize-winning Entrants shall be responsible for any taxes associated with their prizes.

WINNER NOTIFICATION Prize-winning Entrants will be notified about their prize via e-mail by Monday, January 13, 2020, or within a reasonable time thereafter. For the name of the winners, send an email after Monday, January 13, 2020 to communications@birthrightisrael.org.

Prize-winning Entrants, at Sponsor’s request, will be required to provide their legal name, mailing address, phone number, email address, as well as additional information as may be requested by Sponsor, and/or sign and return, in the forms determined by Sponsor, affidavits, declarations of eligibility, liability releases, tax-related paperwork, publicity releases, warranties of ownership, licenses, and/or other documentation as required by Sponsor. Any such request will be sent by Sponsor via email to the email address associated with Entrant’s Facebook account used in connection with the Contest, and Sponsor may require that answers to questions or completed forms be returned via email as well. To the extent a prize-winning Entrant fails to timely respond to Sponsor’s inquiries, prize fulfillment may be delayed, in which case Sponsor shall not be liable or responsible for any such delay. Failure to respond to Sponsor’s questions and/or execute and deliver any required documents to Sponsor within ten (10) days following Sponsor’s request, may result in disqualification from the Contest and selection of an alternate prize winner. Alternate winners are subject to all eligibility requirements in these Official Rules.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE WINNER.

PUBLICITY & PROMOTIONS By entering the Contest, each Entrant grants Sponsor the right to use his or her name, general biographical information, and information relating to the Entrant’s fundraising page, worldwide, in perpetuity, and without compensation, in connection with any Contest-related publicity or promotions created by Sponsor.

LIMITATION OF LIABILITY By entering this Contest, all Entrants agree to release, discharge, indemnify, exculpate, and hold harmless Sponsor, Birthright Israel North America, Birthright Israel International (Taglit), and each of their respective officers, directors, assignees, employees, and agents (collectively, the “Released Parties”), from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of or in connection with participation in the Contest, travel to Israel in association with the First Place Prize, or receipt or use or misuse of any prize.

DATA PRIVACY Entrants agree that all personal data provided to Sponsor, including data shared with Sponsor

by Facebook in accordance with Facebook’s privacy policy as a result of Entrant’s creation of a fundraising page through Facebook, may be stored, used, and shared by Sponsor in accordance with Sponsor’s Privacy Policy (birthrightisrael.com/page/PrivacyPolicy) and, in addition, may be used by Sponsor for purposes related to and within the context of running the Contest. As Facebook is an independent third party, all Entrants should read Facebook’s privacy policy before participating in the Contest (as of this writing, located at facebook.com/about/ privacy/update).

ADDITIONAL CONDITIONS Entrants agree that this Contest shall be subject to and governed by the laws of the County and State of New York and the forum for any dispute related to the Contest shall be in the County and State of New York. To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and Entrants expressly waive any and all such rights. Certain restrictions may apply in some jurisdictions.

By participating, Entrants also agree: (a) to be bound by these Official Rules; and (b) that the decisions of the Sponsor are final and binding with respect to all matters relating to the Contest.

Sponsor reserves the right to disqualify any Entrant for posting inappropriate content (including the posting of any information or media on the Entrant’s Fundraiser page which demeans any individual or group, tarnishes the reputation of Birthright Israel or any other entity, or is otherwise not within the spirit of the Contest purposes), failure to follow the Official Rules, misuse of the Contest for purposes other than fundraising in support of Birthright Israel, or tampering with the Contest in any way. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

Sponsor reserves the right to interpret these Official Rules as needed and its decisions are final.

Sponsor reserves the right to correct typographical, clerical, or printing errors in any Contest materials.

RIGHT TO CANCEL OR SUSPEND CONTEST The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest if, for any reason, the Contest is not capable of completion as planned, including but not limited to, any reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest.
