2019 Birthright Israel App Contest Official Rules

2019 BIRTHRIGHT ISRAEL APP CONTEST OFFICIAL RULES SPONSOR The sponsor is Birthright Israel Foundation (the “Sponsor”), P.O. Box 21615, New York, NY 10087-1615.

PURPOSE The 2019 Birthright Israel App Contest (the “Contest”) is intended to serve as an opportunity for US alumni of the Taglit-Birthright Israel program to learn more about the new Birthright Israel App (“App”) and win an opportunity to attend Trybal Gatherings Berkshires 2019 in the process.

PLEASE NOTE THAT SPONSOR IS NOT AFFILIATED WITH TRYBAL GATHERINGS, INC. OR EVENTBRITE, INC. IN ANY WAY AND THAT THE CONTEST IS IN NO WAY SPONSORED OR ENDORSED BY TRYBAL GATHERINGS, INC. OR EVENTBRITE, INC.

TERM The Contest begins Monday, August 26, 2019 at 2:00:00 p.m. US Eastern Time and ends Tuesday, August 27, 2019 at 4:00:00 p.m. US Eastern Time (the “Contest Term”). ALL ENTRIES MUST BE RECEIVED BY TUESDAY, AUGUST 27, 2019 AT 4:00:00 P.M. US EASTERN TIME. The information contained herein – including how to enter, how to win, and the prizes available – constitutes the official rules that govern this Contest (“Official Rules”). By participating in the Contest, you agree to the Official Rules and warrant that your involvement in the Contest complies with all requirements set out in the Official Rules.

ELIGIBILITY The Contest is open only to United States citizens who: i) are former Taglit-Birthright Israel participants and have completed their Taglit-Birthright Israel program before the Contest Term; ii) have reached the age of majority in their state of residence at the time of entry; iii) who are not winners of any of the Sponsor’s previous contests; iv) have downloaded the App; and v) who do NOT currently reside in Cuba, Iran, North Korea, the Province of Quebec, Sudan, Syria, or any other country where the delivery of prizes with monetary value will be illegal under those US laws in-effect at the time that the Contest concludes. Taglit-Birthright Israel trip madrichim and staff members (who are not former alumni), as well as employees of Sponsor, Birthright Israel International (Taglit), Birthright Israel North America, Taglit-Birthright Israel trip organizers, and all of their immediate family members (spouses, parents, and children), are not eligible

to participate. The Contest is subject to all applicable international, federal, state, and local laws and regulations. THIS CONTEST IS VOID WHERE PROHIBITED BY THE LAWS OF THE UNITED STATES OF AMERICA AND WHERE PROHIBITED BY THE LAWS OF THE STATE OR COUNTRY OF RESIDENCE OF CONTEST ENTRANT, INCLUDING CUBA, IRAN, NORTH KOREA, THE PROVINCE OF QUEBEC, SUDAN, SYRIA, AND ALL OTHER COUNTRIES SUBJECT TO SANCTIONS BY THE UNITED STATES DEPARTMENT OF THE TREASURY.

TO ENTER All those individuals who enter the Contest shall be identified as “Entrants” in these Official Rules. To enter, please follow these steps: 1. Click on the link sent to you through a push notification within the App. The link will send you to a short entry form hosted on Sponsor’s website (the “Entry Form”).

2. Please complete all the information requested through the Entry Form and submit it.

3. You may also enter the Contest by mailing the following information to the attention of Birthright Israel Foundation at P.O. Box 21615, New York, NY 10087-1615: i) your name; ii) your email address; iii) your telephone number; and iv) when you attended the TaglitBirthright Israel program.

Only one (1) Entry Form may be completed per Entrant. To the extent it is discovered that you have submitted multiple Entry Forms, you may be disqualified.

No donation or purchase of any item is necessary, and a donation/purchase will not increase your chances of winning.

WINNER & PRIZES One (1) winner will be selected at random from among all Entrants (the “Winner”).

The Winner shall be awarded the prize of two (2) Cabin Lodging Tickets to Trybal Gatherings Berkshires 2019, set to take place from Friday, August 30, 2019 through Monday, September 2, 2019. Additionally, the Winner will be entitled to up to Two Hundred Dollars ($200) in travel reimbursement aimed at assisting the Winner and his/her “plus one” to travel to the Berkshires for the Trybal Gatherings Berkshires 2019 event. Winner will be responsible to save and submit to Sponsor all travel-related receipts to obtain reimbursement (additional details below).

Participation in Trybal Gatherings Berkshires 2019 is subject to the terms and conditions set forth by Trybal Gatherings, Inc. as detailed on their website.

Estimated Retail Value: Five Hundred Eighty Dollars ($580.00) per ticket, for a total estimated retail value of One Thousand One Hundred and Sixty Dollars ($1,160.00) for the tickets, plus up

to Two Hundred Dollars ($200) in travel reimbursement, for a total value of up to One Thousand Three Hundred Sixty Dollars ($1,360.00) for the entire prize. Actual value of tickets may vary based on additional taxes and fees.

Winner will not receive the difference between the actual and the approximate retail value of his/her prize, if any. Ticket prize is not redeemable for cash. No prize transfer, assignment, or substitution by Winner permitted. If the prize is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize with an alternative prize at an equal or greater monetary value and/or specifications, unless to do so would be prohibited by law. The Winner shall be responsible for any taxes associated with his/her prize.

WINNER NOTIFICATION The Winner will be notified via the telephone number provided in the Entry Form by Wednesday, August 28, 2019, 11:59:59 p.m. US Eastern Time, or within a reasonable time thereafter. For the name of the Winner, send an email after Tuesday, September 3, 2019 to shalom@birthrightisrael.org.

Winner, at Sponsor’s request, will be required to provide his/her legal name, mailing address, phone number, email address, as well as all requested information about Winner’s “plus one” who will attend Trybal Gatherings Berkshire 2019 with winner, and any additional information as may be requested by Sponsor. Winner shall, additionally and at Sponsor’s request, sign and return, in the forms determined by Sponsor, any and all documentation requested by Sponsor, including liability release forms and tax forms. Any Sponsor requests will either be sent by Sponsor via email to the email address associated with the email provided by Winner in the Entry Form or shall be requested by Sponsor over the phone via the telephone number provided by Winner in the Entry Form. Sponsor may require that answers to questions or completed forms be returned via email or explained via telephone as well. To the extent the Winner fails to timely respond to Sponsor’s inquiries within the timeframe established by Sponsor in its communications with Winner, prize fulfillment may be delayed, in which case Sponsor shall not be liable or responsible for any such delay. Failure to respond to Sponsor’s questions and/or execute and deliver any required documents to Sponsor within the timeframe established by Sponsor in its communications with Winner may result in disqualification from the Contest and selection of an alternate winner. Alternate winners are subject to all eligibility requirements in these Official Rules.

Following Winner’s participation in Trybal Gatherings Berkshire 2019, Winner may submit all relevant travel expense paperwork to Sponsor for reimbursement of up to Two Hundred Dollars ($200) in travel expenses. To qualify as a reimbursable travel expense, the expense must be in relation to physical transportation, lodging, food costs, or incidental costs related to travel, and must have been incurred between Tuesday, August 27, 2019 and Friday, September 6,

2019. In order to be eligible for reimbursement, Winner must submit to Sponsor an invoice for the amount of reimbursement requested, showing an itemized listing of expenses labeled in correspondence with relevant receipts, and together with all actual receipts (credit card statements showing charges will not be valid for this purpose). Winner should submit all of the foregoing as a single scanned document via email to shalom@birthrightisrael.org by Friday, September 6, 2019, 4:00:00pm Eastern Time. Sponsor reserves the right to disqualify any receipt for reimbursement based on the receipt being invalid for any reason, including being illegible, corresponding with a non-travel expense, or representing charges incurred outside of the period eligible for reimbursement.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE WINNER.

PUBLICITY & PROMOTIONS By entering the Contest, each Entrant grants Sponsor the right to use his or her name, general biographical information, and information relating to the Entrant’s fundraising page, worldwide, in perpetuity, and without compensation, in connection with any Contest-related publicity or promotions created by Sponsor.

LIMITATION OF LIABILITY By entering this Contest, all Entrants agree to release, discharge, indemnify, exculpate, and hold harmless Sponsor, Birthright Israel Foundation, Birthright Israel North America, Birthright Israel International (Taglit), and each of their respective officers, directors, assignees, employees, and agents (collectively, the “Released Parties”), from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of or in connection with participation in the Contest, travel to/from and participation in Trybal Gatherings Berkshires 2019, or receipt or use or misuse of the prize.

DATA PRIVACY Entrants agree that all personal data provided to Sponsor, including data shared with Sponsor via the Entry Form and through communications with Sponsor, may be stored, used, and shared by Sponsor in accordance with Sponsor’s Privacy Policy and, in addition, may be used

by Sponsor for purposes related to and within the context of running the Contest and prize fulfillment. Additionally, by virtue of the fact that Sponsor will need to submit the Winner’s provided information to Trybal Gatherings, Inc. in order to secure Winner’s prize, Winner agrees that any information provided by Winner to Sponsor may be used by Trybal Gatherings, Inc. and/ or Eventbrite, Inc. in accordance with the Eventbrite privacy policy (as of this writing, located here).

ADDITIONAL CONDITIONS Entrants agree that this Contest shall be subject to and governed by the laws of the County and State of New York and the forum for any dispute related to the Contest shall be in the County and State of New York. To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and Entrants expressly waive any and all such rights. Certain restrictions may apply in some jurisdictions.

By participating, Entrants also agree: i) to be bound by these Official Rules; and ii) that the decisions of the Sponsor are final and binding with respect to all matters relating to the Contest.

Sponsor reserves the right to disqualify any Entrant for failure to follow the Official Rules, providing false or incorrect information, for reasonable concern that Entrant’s participation in the Contest is motivated by a desire to attack or tarnish Sponsor’s reputation, or tampering with the Contest in any way. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

Sponsor reserves the right to interpret these Official Rules as needed and its decisions are final.

Sponsor reserves the right to correct typographical, clerical, or printing errors in any Contest materials.

RIGHT TO CANCEL OR SUSPEND CONTEST The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest if, for any reason, the Contest is not capable of completion as planned, including but not limited to, any reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest.
