The Long-Awaited Final Overtime Rule – How Will It Impact Your Business? By Jennifer S. Frank Lynn, Jackson, Shultz & Lebrun P.C

On September 24, 2019, the United States Department of Labor (“DOL”) announced its long-awaited final overtime rule, which will go into effect on January 1, 2020. The final rule raises the standard salary threshold from the currently enforced level of $455 per week up to the new level of $684 per week (which is the equivalent of $35,568 per year for a full-time worker) in order to be considered exempt from minimum wage and overtime under the Fair Labor Standards Act (“FLSA”). The new thresholds account for the growth in employee earnings since the rule was last updated in 2004. The final overtime rule does not change any of the “duties tests” which must also be met (in addition to the salary threshold and being paid on a salary basis) to claim the Executive, Administrative, or Professional exemptions under the FLSA. In addition, the final rule does not include any automatic updates, which had been proposed under prior versions of the rule under the Obama administration. The final rule: Raises the “standard salary level” from $455 per week to $684 per week ($35,568 per year for a fulltime employee); Raises the total annual compensation requirement for highly compensated employees (“HCE”) from the current level of $100,000 to a new level of $107,432 per year; Allows employers to use non-discretionary bonuses and incentive payments (including commissions) paid at least on an annual basis to satisfy up to 10% of the standard salary level;

Revises the special salary levels for workers in U.S. territories and the motion picture industry. The DOL estimates than an additional 1.3 million American workers will now be made eligible for overtime pay. The DOL also estimates that an additional 101,800 workers will be entitled to overtime pay as a result of the increase to the HCE compensation level. In the past, there have been court challenges that blocked a prior version of the overtime rule from going into effect. In 2016, a federal district court judge in Texas ruled that the DOL exceeded its authority in issuing the overtime regulation because the actual text of the FLSA does not mention a salary threshold. The court then granted summary judgment against the DOL. The DOL appealed to the Fifth Circuit, which granted a stay until the new regulation was issued. Now that the new final rule has been announced, there may be further court action to resolve the issue about the DOL’s authority to set a salary threshold in the first place. Employer Takeaway: With the potential for further court challenges, the final rule may face a delay in its implementation. However, in light of the final rule’s impending effective day, employers are well-advised to consider potential increases to exempt employee’s salaries if necessary (up to a minimum of $684 per week), in order to preserve the employee’s status as truly exempt (if that is not possible, employers need to be prepared for potential additional overtime payments). It is also an opportune time to review exempt workers’ job descriptions and duties to ensure these employees will still meet the exemption from overtime pay. Sponsored Content

ew Year’s resolutions run the gamut from the simple to the complex. Resolving to lose weight, which often tops annual lists of the most popular resolutions, falls into the latter category. A 2018 survey from Cision and Varo Money found that 45 percent of respondents resolved to lose weight or get in shape in 2018. Unfortunately, various studies have found that resolutions often fall by the wayside long before people achieve their goals. Such success rates, or lack thereof, might not be too big a deal for people who make silly resolutions that, successful or not, would not have too big an impact on their lives. But many people resolve to lose weight for serious reasons, such as lowering their risk for disease or

improving their quality of life. In such instances, success can be a matter of life or death. After resolving to lose weight, people might be derailed by some common pitfalls. Recognizing these pitfalls and learning how to avoid them can help people achieve their weight loss goals.

You’re not specific enough

Try not to be vague when setting your weight loss goals. Simply saying “I want

You eat more than you think

Audra Wilson, RD, a clinical dietitian affiliated with Northwestern Medicine®, notes that people typically underestimate their calorie intake by 30 percent. Chances are, you’re consuming more calories than you think, even while you attempt to lose weight. hristmas Eve is a great time for low-key, fun traditions that your family looks forward to every year. The holiday season can get overrun with parties, shopping trips, cooking, travel and more. Christmas Eve dinner

And Christmas itself can be full of expectations, along with more cooking, family, unwrapping presents and calling the grandparents to catch up. Traditions help us slow down and enjoy the season. 1. Cut bacon strips in half. Cook until almost crisp and drain. Wrap each piece around a water chestnut and secure with a toothpick. Place in an ungreased 9x13 baking dish. 2. Combine the brown sugar, mayonnaise and chili sauce in a small bowl and pour over bacon wrapped water chestnuts. Bake at 350 degrees for 30 minutes.

1 Tablespoon olive oil 1 1/2 teaspoons brown sugar 1 1/2 teaspoons lemon juice 1 garlic clove, thinly sliced 1/2 teaspoon paprika 1/2 teaspoon. Italian seasoning 1/2 teaspoon dried basil 1/4 teaspoon pepper 1 pound uncooked shrimp, peeled and deveined 1. Combine the first eight ingredients in a gallon zip top bag. Add the shrimp and refrigerate at least two hours. 2. Drain shrimp and discard the marinade. Place shrimp on an ungreased baking sheet and broil 4 inches from heat for 3-4 minutes per side. Avoid overcooking, which leads to rubbery shrimp.
