South Coast Property Specialist (Carlene Franzen) Tips: NSW Fair Trading introduces strict new rules for Airbnb and the short-term rental accommoda#on market The ABC news has just reported that NSW Fair Trading has announced a new code of conduct for short-term rentals in New South Wales. It includes a "two strikes and you're out" policy that could result in problema2c hosts and guests being banned from holiday le;ng for five years. The ABC reported the following: “The industry code will come into force on December 18 and includes standards to be followed by hosts, guests, le;ng agents and online booking plaAorm operators. Minister for Be(er Regula2on Kevin Anderson said the code included abiding by criminal and local planning laws including keeping noise to an acceptable level. Anyone caught breaking the code will be reported to a property agent or the police who will then forward the complaint to NSW Fair Trading.

Mr Anderson said an exclusion register would be kept by Fair Trading and a "two strikes and you're out" policy would mean anyone breaching the code can be banned from holiday le;ng for five years. He said $550 on-the-spot fines could also be issued, escala2ng to several thousands of dollars for serious breaches of the code. “Loud noises, par2es, raucous behaviour, jumping in the pool at 4am and screaming and shou2ng," Mr Anderson said. "If you wouldn't do it in your own house, don't do it in someone else's community and think you can get away with it."

How does the code affect me?

Guests:  Must not make noise that unreasonably disrupts neighbours  Must not cause damage to the premises, including any common property in a strata scheme  Are responsible for the ac2ons of visitors and must ensure they comply with the behaviour standards set out in the code Hosts:  Must hold insurance that covers liability for third party injuries and death  Must enable neighbours to contact them about concerns between 8am and 5pm each day  Must take reasonable steps to ensure guests meet behaviour obliga2ons in the code  Must ensure the premises is not rented out to a guest who is recorded on the exclusion register  Must register on the short-term rental accommoda2on premises register, which will commence in 2021 Source: NSW Fair Trading Airbnb head of public policy Derek Nolan said the company was already extremely strict in its dealings with bad behaviour and had taken 400 proper2es off their plaAorm in recent months for not complying with guidelines. "We welcome the code of conduct — it will reinforce the policies we already have on Airbnb," he said.

The Department of Planning, Industry and Environment is also developing a government-run premises register and a state environmental planning policy for short-term rental accommoda2on to come into effect in 2021.

Mr Anderson also said measures would be taken to ensure complaints were legi2mate before penal2es were imposed. "Vexa2ous complainants will go through checks and balances," he said. "We know some people just don't like having short-term holiday rentals next door to them."
