Paper Cer ficates of Title on Their Way Out Realestatebusiness.com.au reported this week that paper-based Cer(ficates of Title (that have existed for over 150 years) are on their way out, to be replaced by a fully electronic system. This change was made legally possible by the new legisla(on in the Real Property Amendment (Cer(ficates of Title) Act which had an amendment to abolish cer(ficates of (tle.

The aboli(on date for paper cer(ficates of (tle is the 11th October 2021 which will allow the government to shut down the last remaining paper lodgement mechanisms so that all transac(ons will be done via eConveyancing. The NSW government reports that eConveyancing already accounts for nearly 95% of all conveyancing transac(ons being se'led and lodged.

The ini(a(ve is a result of 5 years of work between government and various industry groups including the Law Society of NSW, the Australian Ins(tute of Conveyancers NSW, the Australian Banking Associa(on and representa(ves from Australian banks, NSW Land Registry Services, PEXA and Sympli.

Maintaining the old (150 years old) paper-based system has been seen as an administra(ve burden with around four and a half thousand applica(ons for a replacement of a cer(ficate of (tle are received by the government each year, at a cost of approximately $150 each.

The Registrar General, Jeremy Cox said “NSW is re(ring redundant paper processes that have existed for over 150 years and embracing a digital future which is faster, more efficient and more accurate.”
