South Coast Property Specialist (Carlene Franzen) Tips: WHAT ITEMS ARE NEGOTIABLE? When you are buying or selling a property many people focus on the price as the key point of nego'a'on. That is fair enough, but it is also important to remember other nego'able items that can also be used to help you get the price you want. And, as in any “nego'a'on” these items affect both par'es. The next obvious nego'able item is the amount of the deposit. Generally, most par'es agree on 10%, however if the purchaser is limited to the amount of funds readily available at the 'me, both par'es may agree on 5%.

The Se2lement Date can also be used in the nego'a'on process. For example, if the seller is in no par'cular hurry to move out and the purchaser needs more 'me to get their funds in order, a longer se2lement date may be agreed. In some instances, this could be 6 to 12 months, but if the seller agrees to such a period you can expect they will try to nego'ate a higher price as compensa'on for such a long period of 'me.

Some'mes we also see the opposite scenario, where the purchaser may be in no hurry to physically occupy the property and the seller may not have yet finalised their new accommoda'on. In this instance both par'es may agree for the sellers to stay in the property under contract. So, they are effec'vely ren'ng their house off the new owners for an agreed period of 'me.

Inclusions and exclusions can also be nego'able items and we frequently see this with holiday homes where items such as furniture and kitchen appliances/utensils etc are sold as inclusions with the property.

When nego'a'ng any item, whether you are the buyer or the seller, it is very important to formalise any agreement through your solicitor/conveyancer. Sales have fallen through, where there has been confusion or a disagreement at the 11th hour about what the final terms of the nego'ated package were.
