Riverside council approves student housing, more parking near Main Library; downtown area to receive affordable housing for seniors

A392-unit mixed-use developmentfor student housing and commercial space along with a new garage that will increase library parking by about 25% gained Riverside City Council approval last week.

The site for the new construction is a former bus station turned temporary parking lot since the Riverside Main Library opened three years ago.

“This project will complement our main library beautifully, injecting vitality into our downtown,” Mayor Patricia Lock Dawson said in a statement. “The entire community benefits from new housing for students, plus retail and office, all within walking distance of parks and restaurants.”

The City Council voted unanimously June 11 to sell 1.7 acres to Pelican Communities LLC in order to move the $78 million project forward. The site is between the library and University Avenue west of Market Street, and housing at the complex will be available to students who attend any college or university.

The development project also includes 12,000 square feet of retail space, 16,700 square feet for offices, a library plaza cafe and a 335-space parking structure. Library patrons will be able to park free of charge for the first three hours, and parking spaces will be available to the public when the library is closed.

Overland Pelican River-

side is the project developer. The firm is connected with Newport Beach-based Pelican Communities LLC and Riverside-based Overland Development, officials said. Pelican Communities has built projects throughout California, including the Merrill Avenue Brownstones apartment complex near the Riverside Plaza.

Despite exemption from state affordable housing requirements, the developers voluntarily have designated 10% of the units as affordable.

Pelican Communities is buying the property for $200 in exchange for providing 60 parking spaces in the parking facility for library use, which is an estimated $2.4 million value, while the value of the land is an estimated $1.83 million, according to the city. While construction takes place, library patrons can validate three hours of free parking at nearby existing parking garages.

“Students from all over Riverside will be able to benefit from this project,” Mayor Pro Tem Steve Hemenway said in a statement. “The transformation of this property from the former bus station to this higher use is remarkable.”

Overland Development’s major projects in Riverside and the Los Angeles area include the Imperial Hardware Lofts, 9+Main Residential, the Hilton Hampton Inn on Market Street and the Hilton Home 2 Suites, which is under construction.

The development project will create about 200 construction jobs, and the completed project will generate $567,661 in annual revenue, according to the city.

A four-story, 59-unit affordable housing complex for seniors is ready for construction in downtown Riverside, the city announced

June 12.

The city and developer Eden Housing Inc. recently broke ground for the new Mulberry Gardens Senior Apartments at 2520 Mulberry St. on a 1.26-acre site that previously had one-story office buildings that were vacated, according to the city’s announcement. The new senior living complex will have a community room, management offices, a mail and parcel room, laundry facilities and a building maintenance shop.

“I am committed to taking care of our seniors which is why developments like this are vital,” Mayor Patricia Lock Dawson said in a statement. “With partners like Eden Housing, we’re tackling our housing crisis one corner, one unit, one household at a time.”

The Palm Springs ShortFest started Tuesday with screenings of 38 short films.

Broken down into themed batches of five to seven shorts each, the 30th annual edition of the weeklong short film festival premiered at 11 a.m. with the "On the Job" set of entries, including "Deep in my Heart is a Song," "Linda," "Officer Stanley," "Pavane," "Shadow," and Yaya.

The full lineup includes 310 live-action, animated and documentary shorts representing 63 countries and territories. That figure includes 49 world premieres, 15 international premieres, 28 North American premieres, nine United States Premieres and 106 California premieres.

Woman who shot spouse at Coachella house convicted of 1st-degree murder

A39-year-old woman who fatally shot her husband during a dispute at their Coachella home was convicted Friday of first-degree murder.

An Indio jury deliberated less than a day before finding Cindy Gicela Parra Hernandez guilty of the 2022 slaying of Francisco Lopez.

Along with murder, jurors convicted Hernandez of assault with a deadly weapon resulting in great bodily injury and spousal abuse.

The verdicts were returned to Riverside County Court Superior Court Judge James Hawkins Friday.

Missing cat reunites with owners in Thousand Palms

Acat and his owners werereunited Saturday at the Coachella Valley Animal Campus after the animal had been missing since April.

Kim Salls and her wife Jill MacDonald, who live in St. Louis, Missouri, were visiting a home they own in Rancho Mirage with their two cats, two English bulldogs and a Brussels griffon when one of their cats, 3-year-old Dale Dragon, went missing on April 10, according to the Riverside County Department of Animal Services.

The Rancho Mirage home has a backyard with 6-foot walls, so the couple believed their pets were safe and secure. However, Salls said she believed the irrigation system came on and scared Dale so much that he leaped over the wall.

"We went everywhere looking for him," Salls said. "We posted signs on our street. We posted signs on other streets," she added.

Salls and MacDonald wanted to continue their search for Dale, but MacDonald needed to return to Missouri for another round of chemotherapy for her Stage 4 cancer.

On May 11, Dale showed up at the Rancho Mirage home of Max Zien and Jilli Joffee, who offered him water after he ran up and climbed Joffee's leg.

"He was so sweet and nice and friendly," Joffee said.

The couple thought the cat belonged to someone nearby, so Joffee left him to roam back to his home, but he showed up again a week later and started making camp in their backyard, shelter officials said.

On June 4, the couple decided to take Dale to the Coachella Valley Animal Campus in Thousand Palms where they discovered his microchip information and contacted the chip company.

An employee at the CVAC asked Zien and Joffee if the cat could remain in their care until the owner could be contacted and a reunion could take place, to which the couple agreed.

"Even our three dogs loved him. So happy to hear he's being reunited with his family," Joffee added.

Riverside County Animal Services officials say the couple's willingness to help highlights the importance

of the Pet Support program, which started in June 2023 and involves the county providing resources for those who need assistance to prevent a pet surrender, and community members helping the county, such as Zien and Joffee.

Approximately 6,000 pets have been diverted from the county's shelters thanks to community members helping and the county staff providing pet owners with

resources, officials said. Salls and MacDonald said they look forward to fattening up Dale Dragon after seeing pictures of him looking thinner.

"He was about 14 pounds — he looked like a big, fat raccoon. It looks like he's been out on his own, fending for himself," Salls added.

Dale Dragon was nicknamed for the John C. Reilly character in the 2008 comedy film "Stepbrothers."

Theft suspect wounded in shooting by DHS police

An investigation was continuing Monday into a shooting by Desert Hot Springs police that left a theft suspect wounded.

Officers located a vehicle at Indian Canyon and 20th Avenue

At 10:59 a.m. Sunday, officers spotted a vehicle at Indian Canyon and 20th Avenue that they believed was connected to a previous kidnapping and firearm-brandishing report, according to a statement issued by Deputy Chief Steven Shaw.

After police tried unsuccessfully to stop the vehicle,

the driver, 50-year-old Jason Gieling, allegedly "led two police officers on a pursuit into the open desert" and "got out of the car with a handgun in his hand," according to the statement.

A shooting ensued, and Gieling was wounded and taken to a hospital, where he was still recovering from injuries "not believed to be life-threatening" as of Sunday night, according to police. It was unclear if Gieling fired any shots, but no other injuries were reported.

Gieling was wanted on a felony warrant for grand theft, Shaw said.

Where in the world are people most optimistic about AI?

When the internet firstbecame widely available in the 1990s, Americans and Canadians were among its quickest adopters. Shortly after, the rest of the world began to follow. Three decades later, the web has dramatically changed how people and businesses operate.

Today, around 90% of North Americans and 60% of people globally have access to the internet.

The majority of shopping, banking and socializing occurs online. The IRS reports that around 90% of American taxpayers now file their taxes electronically, and, as of 2023, the Pew Research Center found that 58% of American adults say they prefer getting their news digitally, while only 27% say they get their news from television.

In 2022, when artificial intelligence took the world by surprise with the release of ChatGPT, some users were quick to compare its sudden advancement to the rise of the internet. After a decadeslong "AI winter" of relatively stagnant progress, the technology suddenly started to move at a blistering pace. Two years later, chatbots are already changing how writers, programmers and researchers work.

Verbit analyzed survey data from Bosch to see where in the world people are the most excited by AI and how they hope it will change their lives. According to the December 2023 survey conducted in seven countries,

73% of people worldwide believe generative AI is as consequential as the rise of the internet.

Optimistic about AI

Bosch surveyed respondents between the ages of 18 and 69 from Brazil, China, Germany, France, India, the United Kingdom and the United States. The survey might not be representative of adults in every country polled; in China, for instance, Bosch only interviewed people from the wealthiest cities.

The data reveals a striking trend: In general, respondents from middle-income

These fears are not unfounded. AI is developing quickly, and estimates about its impact on the job market vary. One 2023 analysis by Goldman Sachs estimates that AI could partially automate one-fourth of work tasks in America and two-thirds of occupations. According to the investment bank's research, office administrative roles, legal professions, as well as architecture and engineering jobs are vulnerable to AI automation.

Historically, automation and new technology have vastly changed the workforce. For instance, agricultural innovations slashed the agricultural workforce; only about 1% of American workers are farmers today. The internet has eliminated certain businesses, such as movie rental stores and travel agencies. However, innovations have also opened doors. Deep data engineers and prompt developers are just some of the roles AI might help create. If AI is as disruptive as the internet, it could mean that many jobs will become obsolete — and others will be born.

Rescued dog at Joshua Tree National Park reunites with pet owner

A man and his dog reunited last week at the Coachella Valley Animal Campus after a recent rescue in Joshua Tree National Park. Christian Corona of Chino Hills was camping June 9 at the Jumbo Rocks campground when his 10-month-old Doberman, Onyx, seemingly got spooked and ran away. Many attempts to find the dog all day Saturday and early Sunday were unsuccessful. Later on Sunday, Joshua Tree National Park officials started getting reports of a dog sighting. Onyx had climbed to a perch on rock formations, approximately 200 feet up, near the campground. JOSAR – a search and rescue outfit that includes volunteers and National Park Service staffers –was activated to retrieve the dog. Fortunately for the JOSAR team, Onyx was in a spot that didn’t require much technical climbing. And the hike to the pooch only took about 15 minutes.

With the July 4th holiday fast approaching, the City of Riverside is reminding residents that all fireworks are illegal within the city limits, and anyone found using illegal fireworks is subject to a $1,500 fine. At 12:09 a.m., an officer was patrolling a park in the 1600 block of South Myrtle when he located a male camping in the park after hours. He was arrested and taken into custody.

At 1:43 a.m., a resident in the 800 block of West Duarte reported a male in the street yelling. Officers arrived and located the subject. Upon contact officers determined he was heavily intoxicated and unable to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

At 8:09 a.m., a resident in the 400 block of East Walnut reported his vehicle stolen. This investigation is continuing.

At 9:37 a.m., a caller in the 1900 block of South Myrtle called to report his vehicle had been burglarized. The rear passenger window was opened and the suspect(s) ransacked the vehicle. This investigation is continuing.

At 5:23 p.m., officers were dispatched to the area of Primrose and Huntington regarding an injury traffic collision between a vehicle and a bicyclist. The bicyclist sustained scrapes and scratches. He was transported to a hospital for treatment. The at-fault driver was cited at the scene.

At 7:52 p.m., while patrolling the 800 block of Royal Oak an officer saw a suspicious subject and made contact with him. A computer search revealed the subject had warrants for his arrest. An investigation revealed the subject was in possession of weapons and drug paraphernalia. He was arrested and taken into custody.

At 1:21 p.m., a resident in the 1000 block of Oakleaf reported her son was fighting people in the house and breaking things. Officers arrived and determined he was a danger to himself and others. He was transported to a medical facility for a mental evaluation.

At 4:04 p.m., a victim in the 100 block of North Melrose reported a hit and run traffic collision. The suspect car col-

lided into her vehicle and fled the scene. This investigation is continuing.

At 5:24 p.m., a caller in the area of Myrtle and Duarte called to report a driver asleep behind the wheel while in a traffic lane. Officers arrived and located the driver who appeared to be under the influence of narcotics. An investigation revealed he was under the influence. He was transported to a hospital for further investigation.

At 10 p.m., officers patrolling the 100 block of West Lime saw a vehicle in violation of a vehicle code and conducted a traffic stop. An investigation revealed a loaded firearm in the bed of the truck where a passenger was sitting. The driver was arrested and taken into custody.

At 10:08 p.m., a caller in the 100 block of West Lime requested a welfare check on a person laying on the ground. Officers arrived and located the subject who was determined was too intoxicated to care for himself. He was arrested and transported to the MPD jail to be held for a sobering period.

June 8

At 2:47 a.m., an officer conducted a traffic stop on a vehicle in the 100 block of South Myrtle for a vehicle code violation. An investigation revealed the driver was impaired and driving under the influence of alcohol. He was arrested and transported to the MPD jail to be held for a sobering period.

At 6:07 a.m., an employee from a business in the 400 block of East Duarte called to report a break in. The glass door was shattered and money was taken. This investigation is continuing.

At 6:25 p.m., a victim in a retail shopping center in the 1600 block of South Mountain reported his work vehicle stolen. This investigation is continuing.

At 9:21 p.m., an employee from a store in the 1600 block of South Mountain reported a male subject walked into the store, took property and fled without paying. When employees attempted to stop him, he used physical force to flee. The subject was gone prior to officers’ arrival. This investigation is

continuing.

At 9:25 p.m., a victim in a car dealership in the 1400 block of South Mountain called to report his vehicle had been tampered with. He left the vehicle at the dealership for several days and when he returned he discovered the door was unlocked and the ignition had been damaged. This investigation is continuing.

At 11:59 p.m., officers were alerted to a stolen vehicle in the 100 block of Fig. The vehicle was located and confirmed stolen out of Los Angeles. This investigation is continuing.

June 10

At 1:04 p.m., a victim walked into the MPD lobby to report his tools were stolen from his vehicle in the 200 block of Violet. This investigation is continuing.

At 2:19 p.m., while patrolling the 1500 block of South Myrtle an officer saw a vehicle in violation of a vehicle code. A traffic stop was conducted and the officer made contact with the driver and occupants. A computer search revealed a passenger had a warrant for his arrest. He was arrested and taken into custody.

At 11:51 p.m., a female suspect wanted for domestic violence walked into the MPD lobby to turn herself in. She was arrested and taken into custody.

June 2

At 11:40 a.m., an officer responded to a residence in the 100 block of West Foothill Boulevard regarding the report of the theft of a catalytic converter. The victim left his car parked in his driveway overnight. He was awakened by a loud noise around 3:30 a.m. The victim looked out of his window and saw a car parked in front of his residence. Three suspects were seen entering the car and fleeing the scene.

At 9:17 p.m., officers responded to the area of Duarte Road and El Monte Avenue regarding a traffic collision that had just occurred. The driver crossed into opposite lanes of traffic and collided

with another driver head on. Upon contacting the driver, the officer detected a strong odor of alcohol emitting from her. Through a series of tests, the officer determined the 32-year-old female from Monrovia was driving under the influence of alcohol. She was arrested and transported to the Arcadia City Jail for booking.

June 3

At 1:58 p.m., officers responded to JCPenney, 400 S. Baldwin Ave., regarding a grand theft report. A loss prevention officer witnessed the suspect select 20 pairs of jeans and exit the store without paying. The suspect was described as a male wearing black pants, a black shirt, and a black hat.

At 2:01p.m., An officer responded to a residence in the 1400 block of South Sixth Avenue regarding a theft report. The victim left his work bag containing several tools on the driveway of the residence. He stepped away for five minutes and returned to find his tool bag had been stolen. Security footage revealed the suspect exited a GMC SUV, stole the tool bag, and fled the scene in the SUV southbound on Sixth Avenue. An investigation by Arcadia Police Detectives led to the arrest of the suspect, a 33-year-old male from El Monte. He was arrested and transported to the Arcadia City Jail for booking.

At 6:32 a.m., officers responded to Motel 6, 225 W. Colorado Place, regarding a domestic dispute. A couple and their 8-month-old baby were staying at the location. An investigation revealed the suspect was under the influence

of methamphetamine when he kicked and punched his girlfriend leaving visible injuries. He fled the scene prior to the officer’s arrival. An emergency protective order was issued.

An investigation by Arcadia PACE officers led to the arrest of the suspect two days later. The 30-year-old male from Arcadia was arrested and transported to the Arcadia City Jail for booking.

At 10:10 a.m., officers responded to the 00 block of Bonita Street regarding the report of three males looking into vehicles parked in the alley. An officer observed one male using the utilities of a residence without consent. The subject was in possession of a stolen package, and he had an outstanding warrant for his arrest. The 41-year-old male from Long Beach was arrested and transported to the Arcadia City Jail for booking.

June 5

At 4:34 a.m., officers responded to the 200 block of East Sycamore Avenue regarding an activation of an Arcadia Police Department GPS tracker. Arcadia PD detectives had previously deployed decoy packages containing bait property and tracking devices to combat the increase in package thefts from residential areas. Officers tracked the package to a solo vehicle collision into Living Spaces, 407 W. Huntington Drive. The stolen package was recovered inside the vehicle along with stolen mail. The suspect driver and passenger were transported to a local hospital for treatment.

At 7:17 p.m., an officer responded to the parking lot of the Shops at Santa Anita, 400 S. Baldwin Avenue, regarding the

report of a vehicle burglary. Unknown suspect(s) smashed the front passenger side window of the victim’s vehicle and stole clothing.

June 6

At 10:14 p.m., officers responded to 24 Hour Fitness, 125 N. First Ave., regarding a stolen vehicle report. Around 8 p.m. the victim parked his Dodge Ram pickup truck on the second level of the parking structure. He returned two hours later to find it had been stolen.

June 7

At 2:29 p.m., officers responded to a residence in the 400 block of Cambridge Drive regarding a burglary report. Unknown suspect(s) entered the home through an open office window. The suspect(s) stole a passport, a wedding ring, and cash.

At 6:49 p.m., officers responded to a residence in the 700 block of Old Ranch Road regarding the report of a burglary. Surveillance footage revealed a male suspect in the rear yard. The suspect forced entry to the home by smashing the rear sliding glass door. He ransacked the home, stealing cash before fleeing the scene.

At 7:44 p.m., officers responded to a residence in the 600 block of Hampton Road regarding a burglary report. Surveillance footage captured two suspects inside the home. The male suspects were wearing black hooded sweatshirts and gloves. The suspects forced entry into the home by smashing the rear bathroom window. The loss was unknown at the time of the report due to the homeowner being out of the country.

Monrovia Old Town report: Summer fun & fundraising

If you have not been to the new Monrovia Farmer’s Market, you are missing out! Not to be confused with the Friday Night Street Fair, this is a completely separate event. Every Saturday from 9 a.m. to 2 p.m., at Station Square, you will find a multitude of wonderful vendors. All vendors are certified California Farmers. Some but not all of the vendors offer organic produce. There are fruits, vegetables, a butcher, a fishmonger, fresh bread and baked goods. I didn’t see it, but I heard there is even ice cream. You can best believe I will find that booth this Saturday.

I’m not sure if the band is a sure thing every week, but it was really nice to be able to listen to live music while shopping. I’m hopeful even more vendors will join in. Honestly, there are enough produce vendors now, but I’ve got my fingers crossed for eggs, fresh pasta, cheeses and beef jerky. Go early before it gets hot, but definitely GO! It is a wonderful addition to our town.

How a network of nonprofits enriches fundraisers while spending almost nothing on its stated causes

In September 2020, the Federal Trade Commission joined regulators in four states to sue four men behind a notorious telemarketing company called Outreach Calling. The FTC alleged that the company, which it described as a “sprawling fundraising operation,” had raised millions on the promise of helping the needy — cancer patients, veterans, firefighters — but instead used the money to line its pockets.

The case was meant to put fundraisers on notice. The FTC would not only go after charities that improperly spent donor dollars, but it would “aggressively pursue their fundraisers who participate in the deception,” a news release said.

The executives and corporate entities behind the operation were fined more than $58 million. They were also banned from all charitable fundraising for life. But regulators kept one door open in most of the settlements: the ability to continue fundraising for political purposes.

For Thomas Berkenbush, who was a co-manager at Outreach, that provision would prove to be a windfall.

Before the deal with the FTC was even finalized, Berkenbush filed paperwork to establish a new company, Office Edge LLC. Since then, Office Edge has been paid about $866,000 for fundraising from organizations that similarly claim to be working on behalf of cancer patients, veterans and firefighters. The difference? These groups are not charities, they’re political nonprofits that claim to use donations to influence elections and support broad political causes.

The groups that are hiring Berkenbush are known as 527s, after a section of the tax code. They include federal political action committees — organizations that raise money to elect or defeat candidates and are regulated by the Federal Election Commission — but also a lesserknown group of nonprofits. These 527 groups limit their direct support to political candidates, removing them from the jurisdiction of the FEC or similar state agencies and leaving their regulation to the IRS. They do not have restrictions on how much donors can contribute, but the donations are not tax deductible.

“We advocate for the needs of veterans, by informing voters of these needs and asking them to take action. This is our only purpose,” the statement for the National Coalition for Disabled Veterans reads. It also says, “When you make a contribution, we want you to know that a minimum of 90 cents of every dollar will be dedicated to covering our fundraising costs and outreach efforts.”

dants — who did not admit or deny any of the allegations in the FTC complaint — were required to submit yearly compliance reports to New York, disclosing all fundraising activity for five years after the agreement was reached. The office confirmed that some of the defendants have reported business activity with 527 groups but did not say whether this prompted any investigations. Berkenbush did not respond to requests for comment.

is scant evidence the organizations calling Eggers do what they claim.

A ProPublica investigation has connected Berkenbush to a network of at least 10 of these 527 groups that have raised more than $33 million on the promise of supporting admirable causes, but that have spent little on activities that could be construed as having a political purpose. Most of the money goes to fundraisers who have only been paid by 527s in the group ProPublica identified.

Experts say that it’s hard for the public to follow the business practices of 527 groups because of how difficult it is to access the records that the IRS publishes about their activity. Data about 527 organizations is published on an IRS website in a hard-to-use data file with a limited search interface. On top of that, experts said that there is lax oversight by the federal agencies in charge of regulating the groups.

“There is no enforcement whatsoever,” said William Josephson, the former head of the charities bureau within New York’s attorney general’s office. “It’s just not a big enough issue for the IRS.”

The FTC declined to comment on why some of the settlement agreements in its case against Outreach Calling permitted political fundraising. The New York attorney general’s office, whose lawyers played a significant role in the case, told ProPublica that it can’t prohibit political fundraising because of First Amendment protections. But it maintained that the settlement agreements forbid the defendants from engaging in any fraudulent conduct while fundraising, regardless of the organization’s tax status or stated purpose.

Eggers lives in Pasadena, California, has Parkinson’s disease and frequently volunteers his time and money for various causes. He made a pledge to give $100 to the group, later telling a reporter that he gives out of appreciation for the people they claim to be helping.

“They really do need it,” he said in an interview. “They’ve worked hard enough to deserve it.”

Eggers has given at least $1,500 to the nonprofit in the past three years. He said his phone rings two to three times a day with different causes asking him for money. However, there

The American Breast Cancer Coalition, for example, has taken in nearly $9 million from donors since 2019 and has spent less than half of 1% of that on “voter advocacy and outreach.” The rest of the money — millions of dollars — goes to companies with names like Action Committee Marketing, Capital Vendor Management and Berkenbush’s Office Edge. Berkenbush’s company pulled in $222,000 just from this one organization.

The network has paid millions to a handful of other vendors, including one of Berkenbush’s former colleagues at Outreach Calling, whose company brought in more than $3.4 million in expenditures. He and his firm did not respond to requests for comment.

Another man, Alan Bohms, was paid more than $575,000 by the American Breast Cancer Coalition through a company he controlled named Campaign Marketing Inc., which also did business under the names Insight Data Management and Prestige Tax & Payroll. a member of Outreach Calling or subject to the FTC order, but he has previously paid the company millions to fundraise for one of his nonprofits.

In an email, Bohms defended the money that the groups spend on fundraising, writing that the phone calls are central to “educating and engaging the community about the PAC’s mission and objectives.”

ProPublica reporters uncovered the web of connections between the groups by compiling the reports they file into a searchable database, offering a level of visibility similar to what’s available for records collected by the FEC. (Read more about our new database.)

Web of Connections

Even on their surface, the connections between these groups are obvious: Six of the organizations in this network have websites that were built using the same platform and share similar designs. All but one process donations using an obscure payment system also used by several political nonprofits that federal prosecutors began investigating after a New York Times story last year.

Nearly all used similar or identical language when describing the purpose of the organization in IRS filings. They share significant overlap in both donors and contractors, and they often reuse the same language when describing expenditures or donors, including multiple organizations listing an identical description for services from different companies: “Fundrais-

ing, Donor Management, Database Services, Direct Mail Services, Postage.”

At least half of the organizations ProPublica identified worked with the same Morristown, Tennessee-based accounting firm on their IRS filings, Purkey, Carter, Compton, Swann & Carter. Bohms also uses the firm for his own nonprofit, the Volunteer Firefighter Alliance, telling ProPublica that the firm maintained high standards of integrity. The firm did not respond to requests for comment.

Fire departments across the country warned people against donating to Bohms’ charity, and both he and the charity were written about in a 2020 Salon story that connected Bohms to a network of “scam PACs.”

“VOLUNTEER FIREFIGHTER ALLIANCE is a FRAUD!” exclaimed one 2021 post on Facebook from the Alpha Fire Company in Centre County, Pennsylvania. “Do not give money to this organization! They are not your local fire company.”

Records show that one of the charity’s main fundraisers was Outreach Calling, the company shut down by the FTC. The Volunteer Firefighters Alliance paid $4.8 million to the company for fundraising in total. Bohms defended Outreach’s work, telling ProPublica that he “found Outreach Calling to be very professional and had never experienced any problems with them.”

Bohms’ family members also appear to help run the nonprofits that pay his companies. His sister, Julie Forsythe, is listed as the treasurer of the National Cancer Alliance, which

“works to establish the end of childhood cancer by making it a state and national priority.” Another organization, the National Coalition for Disabled Veterans PAC, reports its treasurer as Bohms’ aunt, Judith Gragert. In the last five years, these two organizations have raised over $7 million from more than 700 donors around the country.

Like all of these groups, neither used much of the money they raised in support of their stated efforts. Effectively all of the expenditures that both groups reported were for either fundraising or other administrative costs. Together, the organizations paid more than $300,000 to Campaign Marketing Inc., the company owned by Bohms.

Gragert and Forsythe did not respond to requests for comment. Bohms told ProPublica that he works with 527 groups “strictly in the capacity of a vendor,” and that the payments made to his companies were for legitimate services. He denied any involvement in decision-making at the groups that listed his aunt and sister as treasurer.

“It is important to understand that the payments made to fundraisers encompass more than just fundraising activities,” Bohms wrote in an emailed response. “These funds support a broad range of outreach efforts, including phone calls and direct mail campaigns that are designed to inform the public about the PAC’s goals and initiatives.”

At least one of the groups ProPublica identi-

fied has been sued over its fundraising practices. A pair of call recipients filed a lawsuit seeking class-action status in 2022 against the National Police & Sheriffs Coalition PAC. Lawyers for the plaintiffs alleged that the group used prerecorded voice calls to contact potential donors without their consent, in violation of FCC rules that are meant to protect consumers from telemarketers.

“Many of these PACs are illegitimate,” said Eric Weitz, whose law firm is on the team representing plaintiffs. “They prey on people’s political leanings.”

One of the defendants named in the lawsuit was Frank Pulciani, the organization’s treasurer. Pulciani maintained that prerecorded messages were not improperly used in calls to donors, and that the fundraising company the group hired was responsible for ensuring that calls complied with the law. Pulciani settled with the plaintiffs for undisclosed terms, and the organization

was dissolved in February of last year.

Pulciani is also closely connected to Bohms. The two men, who both produce and act in low-budget films, recently worked on a project called “Murder by Association.” In its trailer, posted to YouTube, Bohms and Pulciani can be seen decked out in suits and dark sunglasses.

Pulciani did not respond to requests for comment.

Robert Bernhoft, whose firm represented Pulciani in the lawsuit, declined to comment.

Used and Abused

For Eggers, the donor who gave to the American Breast Cancer Coalition, the revelation that some of the organizations he’s been supporting are using almost none of what they raise for their stated purpose was discouraging.

“I feel like I’m being used and they’re being abused,” he said, referring to those he aimed to help with his donations.

On the mantle above Eggers’ fireplace rests a

selection of plaques, framed photographs and certificates that showcase his commitment to giving. One award from 2012, titled “Lending a Helping Hand,” recognizes his 31 years of volunteering for a local organization providing services to the homeless. Another, from a regional branch of the American Red Cross, celebrates his donations to a blood platelet program.

He showed ProPublica a letter he received from the American Breast Cancer Coalition this past April.

“Through your muchneeded support, we hope to educate the public about our nation’s important Breast Cancer health bills,” reads the letter, thanking him for his donation. It noted that the group was not a charity — key to the FTC order against former Outreach Calling employees. And further down, it stated, “A large portion of proceeds from this campaign are used to defray the costs of fundraising.”

An electric vehicle charging station is any level of electric vehicle supply equipment station that delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle. The proposed ordinance is intended to bring the City of San Gabriel’s Municipal Code up to compliance with State legislation regarding the expediting and streamlining procedures for electric vehicle charging stations.

Ordinance No. 708 was approved for introduction and first reading at the City Council Regular Meeting of June 4, 2024. City Council waived the reading of Ordinance No. 708 in full and adopted Ordinance No. 708 by title on June 18, 2024 by a vote of 5-0.

An Indio man who gunned down an 18-year-oldcrime witness was convicted Monday of first-degree murder and other charges, while jurors began deliberating the fate of his co-defendant.

An Indio jury deliberated two days before finding 28-year-old Alexis Daniel Rosas guilty of the 2019 slaying of Makayla Jean Massey, also known as Anita Garcia, of Victorville.

Along with murder, the panel convicted Rosas of attempted murder and found true special circumstance allegations of killing a witness to a crime and lying in wait. Jurors also found true sentenceenhancing gun and great bodily injury allegations.

Riverside County Superior Court Judge Jennifer Gerard did not immediately schedule the start of a penalty phase of Rosas' trial, deferring until the separate jury weighing the fate of co-defendant Maury Duarte returned with a decision.

Her jury went behind closed doors Monday morning to begin deliberating and did not reach a verdict. Deliberations will resume Tuesday at the Larson Justice Center.

As Rosas faces a potential death penalty, the jury in his case will decide whether to recommend either capital punishment or life in prison without parole, according to Thalia Hayden of the Riverside County District Attorney's Office.

Duarte, 32, is charged with first-degree murder and special circumstance allegations of killing a witness to a crime and lying in wait.

She's being held in lieu of $1 million bail at the Smith Correctional Facility in Banning, and Rosas is being held without bail at the Byrd Detention Center in Murrieta.

According to a trial brief filed by the District Attorney's Office, Massey's

boyfriend, identified only as "Abram," had been at odds with Rosas, a documented member of an Indio street gang, bearing the moniker "Trigger," for some time. The conflict had resulted in the defendant allegedly harassing and attacking the victim on multiple occasions.

On June 24, 2019, the feud led to Rosas allegedly going to the abandoned house in the 45-400 block of Oasis Street where Abram and Massey were residing and shooting him in the chest — an act which the victim witnessed and detailed to Indio police immediately afterward.

Abram was hospitalized but ultimately recovered from the non-lifethreatening wound.

After the shooting, Massey checked into a Motel 6 in Indio, possibly in an attempt to hide, but Rosas learned of her whereabouts and that she had made contact with police, prompting him to plan her murder, prosecutors said.

He enlisted Duarte's assistance, and they used her 2005 Toyota Camry to get around. In the predawn hours of June 25, 2019, Rosas went to the victim's motel room and persuaded her to come out, then physically restrained her

inside the Toyota, which Duarte drove to a vacated ranch in the 82-600 block of Avenue 53 in Thermal, court papers alleged.

Once at the location, Rosas shoved the petrified victim out of the car and ordered to start walking toward a gate.

"The defendant kicked her in the stomach, causing her to fall to the ground," the brief said. "Rosas then shot Makayla five times. One shot was to her head. He knew he had killed her after the second shot, but he continued to shoot bullets into her body."

He left the victim where she was slain, and he and Duarte headed back toward Indio, dumping the .380-caliber semiautomatic pistol that he'd used to kill Massey on a roadside, according to the prosecution.

Massey's remains were discovered within a couple of days, leading to a sheriff's investigation that pointed to Rosas as the murderer.

The defendants were arrested without incident on Avenue 42 in Indio on June 30, 2019.

Court papers said both Rosas and Duarte conspired in retail fraud, but neither has documented prior felony convictions in Riverside County.

College of the Desert launches program for currently, formerly incarcerated

College of the Desert is rolling out an educationalinitiative Tuesday for formerly and currently incarcerated people.

Through an approximately $1.5 million grant from by the California Community Colleges' Rising Scholars Network, the program will fund on-site classes for young adults in carceral systems and resources for students who have been incarcerated in the past.

"By investing in these students, we are empowering a society where everyone has access to learning opportunities for personal and profes-

sional growth," Dean of Counseling Amanda Phillips said in a statement. "The Rising Scholars program will inspire those who have experienced the criminal justice system by providing them with the tools they need to succeed."

The nearly $1.55 million grant, which covers an initial five-year period, will apply toward an inaugural program on campus this fall.

The Rising Scholars Network, a byproduct of Corrections to College California, seeks to "increase public awareness of the benefits of career and education options for students who are and

were formerly incarcerated," according to COD spokesperson Nicholas Robles.

"We're pleased to announce that nearly 25% of youth enrolled or detained at Indio Juvenile Hall are eligible for college, while 80% of Indio's Pathways to Success program participants are eligible to attend this year," Christopher H. Wright, chief probation officer of the Riverside County Probation Department, said in a statement.

Amazon slapped with heavy penalties for alleged violations at IE warehouses

Amazon has been slapped with $5.9 million in fines for alleged violations at two Inland Empire warehouses of a state law intended to prevent overworking employees, which the corporation said Tuesday were unjustified and will be challenged.

California Labor Commissioner Lilia Garcia Bower said Amazon warehouses in Moreno Valley and Redlands

operated in violation of the Warehouse Quotas Law, established in 2021 under Assembly Bill 701.

"Thepeer-to-peer system that Amazon was using in these two warehouses is exactly the kind of system that the ... law was put in place to prevent," Bower said. "Undisclosed quotas expose workers to

increased pressure to work faster and can lead to higher injury rates and other violations by forcing workers to skip breaks."

3.5. California Public Contract Code, § 3300

In accordance with the provisions of California Public Contract Code, § 3300, each Bidder must hold an active Class A and Class C-10 at the time of bid submission, except as to joint venture Bidders, who shall be licensed as provided in California Business and Professions Code, §§ 7029.1 and 7028.15(c).

Pursuant to the provisions of §§ 1770 to 1782 of the California Labor Code, the California Department of Industrial Relations has determined the general prevailing rate of wages in the county in which the work is to be done. A copy of the general prevailing rate of wages is on file with the City Engineer and is available for inspection and reference during regular business hours.

3.6. § 4104 of the California Public Contract Code

A Contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of § 4104 of the California Public Contract Code, or engage in the performance of this public works project unless currently registered and qualified to perform public work pursuant to California Labor Code, § 1725.5. It is not a violation of California Labor Code, § 1771.1 for an unregistered Contractor to submit a bid that is authorized by § 7029.1 of the California Business and Professions Code or by §§ 10164 or 20103.5 of the California Public Contract Code, provided the Contractor is registered to perform public work pursuant to § 1725.5 at the time the contract is awarded.

3.7. Department of Industrial Relations

The Contractor must post job site notices prescribed by regulation in accordance with California Labor Code, § 1771.4.

AN ORDINANCE AMENDING PASADENA MUNICIPAL CODE TITLE 2, ARTICLE 2, CHAPTERS 2.40, 2.265, AND 2.275 TO CENTRALIZE THE CITY’S RISK MANAGEMENT FUNCTIONS WITHIN THE CITY MANAGER’S OFFICE

The People of the City of Pasadena ordain as follows:

SECTION 1. Pasadena Municipal Code, Title 2, Article 2, Chapter 2.40, Sections 2.40.020 and 2.40.030, are renumbered to read as follows:

“2.40.020 – City manager – Charter functions, powers and duties.

Pursuant to the Charter, the city manager shall be the chief administrative officer and head of the administrative branch of city government with the following administrative and executive functions, powers and duties:

A. To supervise, coordinate and administer the various functions of the city;

B. To see that the provisions of this Charter and all laws and ordinances of the city are enforced;

C. To appoint, promote, discipline and terminate the employment of all officers and employees of the city in accordance with the personnel system created pursuant to this Charter except those officers appointed by the city council which officers shall have the power to appoint their respective staffs;

D. To exercise supervision and control over all departments, divisions and offices of the city except the city attorney, city prosecutor and city clerk, and their respective staffs;

E. To establish a manual of rules, practices and procedures necessary to the administration of the city's personnel system;

F. Except when his removal is under discussion, to attend all meetings of the city council; but he/she shall have no power to vote as a member thereof;

G. To recommend to the council for adoption such measures and ordinances as he/she shall deem necessary or expedient;

H. To see that all terms and conditions imposed in favor of the city or its inhabitants in any contract or in any franchise are faithfully kept and performed; and upon knowledge of any

violation thereof to call the same to the attention of the city attorney, whose duty it shall be to take such steps as are necessary to protect and enforce such terms and conditions;

I. To prepare and submit to the city council the annual budget;

J. To keep the city council at all times, fully advised as to the financial condition and needs of the city;

K. Reserved.

L. The city manager, or his designee, shall have the authority to adopt and/or certify environmental reviews performed in compliance with the California Environmental Quality Act.

“2.40.030 – Department functions.

The department shall be responsible for providing the functions set forth in Section 2.40.020 and the following functions:

A. Administer the city's public information program;

B. Administer the city's KPAS program;

C. Administer the city's economic development program;

D. Administer the city's intergovernmental affairs program;

E. Administer the city’s accessibility program and provide staff services and support to the accessibility and disability commission;

F. Administer the city’s risk management program, which includes enterprise risk management, workers’ compensation, safety, loss control, property and liability insurance, and liability claims management functions;

G. Provide support and general direction as requested for the City’s Internal Audit program;

H. Perform such other duties relating to the office as shall be required of him/her by law, ordinance or the city council.

SECTION 2. Pasadena Municipal Code, Title 2, Article 2, Chapter 2.265, Section 2.265.020, is amended to read as follows:

“2.265.020 – Department functions.

The department shall:

A. Facilitate collaborative efforts and a coordinated approach to improve and expand the delivery of quality community services in the city;

B. Administer various programs in the city designed to protect, improve and restore the personal welfare and well-being of city residents of all ages;

C. Develop strategies to respond to unmet community service needs and gaps within the city;

D. Provide staff services and support to the human relations commission, the human services commission, the northwest commission, the recreation and parks commission, the commission on the status of women, and the senior commission;

E. Coordinate with public and private sectors to address the social and economic needs of the residents of the city;

F. Operate and maintain all parks (including park areas, park improvements, and facilities), the grounds in the civic center, the grounds of the public library and all branch libraries, and such city-owned property as shall be provided by ordinance or as directed by the city manager;

G. Operate and maintain the Arroyo Seco, including Hahamongna Watershed Park, Brookside Park, and the Lower Arroyo, and provide administrative coordination of programs and other major activities in the Arroyo;

H. Plant, maintain and remove trees and shrubs within all parks, as described in subdivision (F) and the Arroyo Seco, as described in subdivision (G);

I. Operate community and recreation services programs for the city consistent with the city charter, ordinances and administrative policy;

J. Develop and conduct a comprehensive recreation program to meet the needs and interests of the residents of the city;

K. Perform such other related duties as shall be required by law, ordinance or the city manager.

SECTION 3. Pasadena Municipal Code, Title 2, Article 2, Chapter 2.275, Section 2.275.020, is amended to read as follows: “2.275.020 – Department functions.

The department shall be responsible for providing the following functions:

A. Establish and administer a centralized system of financial administration for the city, including activities relating to accounting, budgeting and auditing as required by the city manager and subject to the limitation of the Charter;

B. Issue business licenses and permits and administer related matters;

C. Administer the treasury of the city;

D. Issue and collect bills for the electric, water and refuse utilities and for various other city services as required;

E. Administer and supervise the issuance of bonds, certificates of participation, and other financial instruments of the city, community development commission, and various authorities established by the city;

F. Perform such other related duties as shall be required by law, ordinance or the city manager.

SECTION 4. The City Clerk shall certify the adoption of this ordinance and shall cause this ordinance to be published in full text.

SECTION 5. This ordinance shall take effect upon publication.

The City reserves the right to reject any and all Bids, to award all or any individual part/item of the Bid, and to waive any informalities, irregularities or technical defects in such Bids and determine the lowest responsible Bidder, whichever may be in the best interests of the City. No late Bids will be accepted, nor will any oral, facsimile or electronic Bids be accepted by the City.

5. Contractor License. At the time of the Bid Deadline and at all times during performance of the Work, including full completion of all corrective work during the Correction Period, the Contractor must possess a California contractor license or licenses, current and active, of the classification required for the Work, in accordance with the provisions of Chapter 9, Division 3, Section 7000 et seq. of the Business and Professions Code. In compliance with Public Contract Code Section 3300, the City has determined that the Bidder must possess the following license(s):

• a. Pursuant to Section 3300, of the Public Contract Code, the classification of the bidder’s Contractor’s License shall be “Class A”. Failure of a bidder to obtain adequate licensing at the time the contract is awarded shall constitute a failure to execute the Contract and shall result in the forfeiture of the Bid der’s Bond.

• b. For federally funded projects, the Contractor shall be properly licensed at the time of award.

The successful Bidder will not receive a Contract award if the successful Bidder is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active. If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents.

6. Subcontractors’ Licenses and Listing. At the time of the Bid Deadline and at all times during performance of the Work, each listed Subcontractor must possess a current and active California contractor license or licenses appropriate for the portion of the Work listed for such Subcontractor and shall hold all specialty certifications required for such Work. When the Bidder submits its Bid to the City, the Bidder must list each Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104 (Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor information that Section 4104 requires (name, the location (address) of the Subcontractor’s place of business, California Contractor license number, California Department of Industrial Relations contractor registration number, and portion of the Work). In addition, the City requires that the Bidder list the dollar value of each Subcontractor’s labor or services. The City’s disqualification of a Subcontractor does not disqualify a Bidder. However, prior to and as a condition to award of the Contract, the successful Bidder shall substitute a properly licensed and qualified Subcontractor— without an adjustment of the Bid Amount.

7. Permits, Inspections, Plan Checks, Governmental Approvals, Utility Fees and Similar Authorizations: The City has applied and paid for the following Governmental Approvals and Utility Fees:

NONE

All other Governmental Approvals and Utility Fees shall be obtained and paid for by Contractor and will be reimbursed based on Contractor’s actual direct cost without markup. See Instructions to Bidders Paragraph 14, and General Conditions Paragraph 1.01 for definitions and Paragraph 1.03 for Contractor responsibilities.

8. Bid Forms and Bid Security: Each Bid must be made on the Bid Forms obtainable from the City’s Bidding website listed in the paragraph 1 above. Each Bid shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Glendale,” for an amount equal to ten percent (10%) of the total maximum amount of the Bid. Alternatively, a satisfactory corporate surety Bid Bond for an amount equal to ten percent (10%) of the total maximum amount of the Bid may accompany the Bid. Said security shall serve as a guarantee that the successful Bidder, within fourteen (14) calendar days after the City’s Notice of Award of the Contract, will enter into a valid contract with the City for said Work in accordance with the Contract Documents.

9. Bid Irrevocability. Bids shall remain open and valid for ninety (90) calendar days after the Bid Deadline.

10. Substitution of Securities. Pursuant to California Public Contract Code Section 22300, substitution of securities for withheld funds is permitted in accordance therewith. 11. Prevailing Wage Resolution. Bidders are hereby notified that in accordance with the provisions of the Labor Code of the State of California, the City Council of the City has ascertained and determined by Resolution No. 18,626 (as amended), the general prevailing rate of per diem wages of a similar character in the locality in which the Work is performed and the general prevailing rate for legal holiday and overtime Work for each craft or type of worker needed in the execution of agreements with the City. Said resolution is on file in the Office of the City Clerk and is hereby incorporated and made a part hereof by the same as though fully set forth herein. Copies of said resolution may be obtained at the Office of the City Clerk.

12. Prevailing Wages. This Project is subject to the provisions of California Labor Code Section 1720. Contractor awarded this Contract and all Subcontractors of any tier shall not pay less than the minimum prevailing rate of per diem wages for each craft, classification, or type of worker needed to perform the Work. The Director of Industrial Relations of the State of California, pursuant to the California Labor Code, and the United States Secretary of Labor, pursuant to the Davis-Bacon Act, have determined the general prevailing rates of wages in the locality in which the Work is to be performed. The rates determined by the California Director of Industrial Relations are available online at www.dir.ca.gov/DLSR/PWD/. Davis-Bacon wage rates are available online at www.wdol.gov/. To the extent that there are any differences in the federal and state prevailing wage rates for similar classifications of labor, Contractor and its Subcontractors shall pay the highest wage rate.

13. California Department of Industrial Relations ― Public Works Contractor Registration.

Beginning July 1, 2014, under the Public Works Contractor Registration Law (California Senate Bill No. 854 - See Labor Code Section 1725.5), contractors must register and meet requirements using the online application https://www.dir.ca.gov/public-works/contractorregistration.html before bidding on public works contracts in California. Afelon who joined two others in burglarizing an illegal marijuana grow in Anza, where the 64-year-old proprietor was gunned down, was sentenced Friday to 21 years in state prison.

James Max Robinson, 43, of San Bernardino, pleaded guilty in April to voluntary manslaughter under an agreement with the Riverside County District Attorney's Office. In exchange for his admission, which came at the outset of his and his co-defendants' trial, prosecutors dropped murder and other charges against Robinson.

During a hearing at the Southwest Justice Center Friday, Superior Court Judge Stephen Gallon imposed the terms stipulated under the plea deal.

A Murrieta jury in May convicted her and Jesse Robert Thurbush, 43, of Victorville, of first-degree murder for the 2019 slaying of James Cidney Brown.

Along with the murder count, jurors found Miller and Thurbush guilty of burglary, false imprisonment and special circumstance allegations of killing in the course of a burglary and killing during the commission of a robbery.

Thurbush, who is being held without bail at the Byrd Detention Center in Murrieta, is slated for sentencing July 26.

According to a brief filed by Robinson's attorney last year, when he sought to have some of the charges against his client dismissed, Miller invited Robinson and Thurbush to her Rancho Cucamonga home on the night of Nov. 2, 2019, to smoke methamphetamine.

Last week the mastermind of the deadly burglary, 48-year-old Jodi Lynn Miller of Rancho Cucamonga, was sentenced to life in prison without the possibility of parole.

The brief, based on evidence presented during the trio's 2022 preliminary hearing, said Miller wanted to steal marijuana and money from Brown, about whom she'd received information from a friend, James McCance, who tended to the illicit outdoor cannabis grow at the victim's property in the 39000 block of El Toro Road.

Miller got a layout of the property from McCance and, as they smoked meth, she persuaded Robinson and Thurbursh to join her in the robbery, according to the brief. The threesome set off in the predawn hours of Nov. 3, 2019.

They arrived just before 6 a.m., cutting through a fence to gain access, then parking outside the victim's house, where Miller armed herself with a revolver, and the two men armed themselves with rifles, with Robinson remaining outside to watch for law enforcement, the brief said.

slipped into the home through an unlocked back door and found a worker, John Fuggiero, asleep on a front room sofa and Brown asleep in his room with the door shut, according to the brief.

The defendants subdued Fuggiero with zip ties and sprayed him in the face with pepper spray, then proceeded into Brown's room, where Robinson discharged spray into the victim's closed eyes, causing him to wake in a panic and bolt out of the room, according to court documents.

The judge scheduled a sentencing hearing for July 19 at the Larson Justice Center. Hernandez is being held without bail at the Smith Correctional Facility in Banning.

The defendant faces 25 years to life for the murder charge, an additional 25 years to life for a gun enhancement, and one further year for the assault conviction, according to Thalia Hayden of the Riverside County District Attor-

ney's Office.

There were conflicting accounts regarding what happened between the defendant and victim, whose relationship was plagued with dissension.

On the day of the killing, Aug. 7, 2022, the victim — who had only recently returned to living at home after moving out because of an extramarital affair — and the defendant had been to a store to purchase items for their business, during which time they argued intensely, according to the District Attorney's Office.

the bedroom. The defendant told the investigator she managed to grab the pistol, then put it back in a drawer. She then proceeded to detail different scenarios about what transpired as daybreak approached,

Miller was directly in the fleeing man's path and fired several shots, the brief said.

"She was standing there with a gun and ... shot Brown because he was running at her," according to the brief.

Miller and Thurbush ransacked the property for 20 minutes, looking for money and marijuana packages, then fled, along with Robinson, court documents said.

Fuggiero freed himself from the restraints an hour later, calling 911. Deputies arrived at 7:30 a.m. and found Brown dead in the front room. Fuggiero was treated

for minor injuries.

After Central Homicide Unit detectives searched the grounds, the illegal grow was razed, and all remaining cannabis was seized and destroyed.

The investigation spanned almost 18 months before the three defendants were connected to the murder and arrested in the summer of 2021.

Both Robinson and Thurbush each had prior convictions for burglary. Miller had a prior felony in another jurisdiction, but it was not specified.

Ramirez said, including one in which Lopez pulled the gun away from her after she initially took possession of it and shot himself in the head.

The second scenario was that the defendant maintained control of the firearm and leveled it at Lopez, who told her, "If you have balls, pull the trigger," at which point she shot him in the forehead, the detective said.

"She said after she called 911, she went back to Francisco's body and placed the handgun ... underneath his hand," Ramirez testified.

Deputies arrived at the couple's home in the 84-000

block of Fiesta Road shortly after 5 a.m. to investigate reports of a shooting and found Lopez dead from the head wound.

Hernandez was questioned at the scene and later at the sheriff's Thermal station, culminating in her arrest the same day. She had no documented prior felony convictions. However, according to the prosecution's trial brief, there had been assault allegations against her in 2022 after she struck her husband with a vehicle during a driveway squabble, causing him to roll completely over the car and land on his face.

The agency said multiple engine and hand crews were sent to the brusher, supported by Cal Fire air tankers and water-dropping helicopters, encountering flames burning at a moderate rate, away from the nearest homes.

As of 9 a.m. Tuesday, the blaze was completely contained and mapped at 892 acres, according to the fire department.

Weather conditions were expected to remain favorable throughout the day, enabling crews to finish mopping up.

The cause of the fire was under investigation.

350-Acre Fire Burns in Palm Springs near Tramway Road

A vegetation fire burned roughly 350 acres in Palm Springs Monday.

Springs Fire Department responded to the fire near Tramway Road at 11:25 a.m. Monday, according to the city. The blaze — later dubbed the Tuscany Fire — quickly spread across about 200 acres, increasing to 350 acres by 3 p.m., according to the Bureau of Land Management, which was assisting in the firefight.

The fire was 50% contained by Tuesday morning, according to Riverside County Fire Department.

The Palm Springs Aerial Tramway halted operations due to the smoke and visibility issues.

No evacuation warnings were immediately issued, and no injuries or structural damage were reported.

The cause of the fire was not immediately known.

Blaze injures firefighter, displaces two people, three dogs

A firefighter and a civilian were injured during a residential fire Saturday in Blythe that displaced two residents and three dogs, the county fire department announced.

The fire was reported at 11:10 a.m. Saturday in the 17500 block of Blythe Way, according to the department.

One firefighter suffered a minor injury and was taken to a hospital. A civilian was also rushed to a hospital and listed in stable condition after suffering a medical emergency, authorities said.

The attic fire was contained to the residence after additional resources were requested.

The cause of the fire was not immediately known.
