LA County supervisors approve $24M

exonerated men

Without discussion, the Los Angeles County Board of Supervisors Tuesday approved a $24 million payment to settle a civil rights lawsuit brought by two men who were wrongly imprisoned for more than 23 years for a murder they did not commit.

John Klene, 45, and Eduardo Dumbrique, 42, were exonerated three years ago by the District Attorney's Office after nearly a decade of investigation by a nonprofit group who worked on the case.

The Los Angeles men filed their federal civil rights lawsuit in 2022 against the Los Angeles County Sheriff's Department and District Attorney's Office arising from their arrest and conviction for the murder of Antonio Alarcon nearly 27 years ago.

"I hope today provides some measure of justice for John, Eduardo, and their loved ones," LA County District Attorney George Gascón said in a statement provided to

City News Service after the board's vote. "My office has exonerated 14 people who wrongfully and collectively served more than 300 years in prison for crimes they did not commit: each exoneration represents my overriding commitment to upholding the truth in our criminal justice system."

At about 11 p.m. on June 28, 1997, gang member Alarcon, 25, was fatally shot in a drive-by shooting near a pay telephone at 11650 Prairie Ave. in Hawthorne.

A few days later, Santo "Payaso" Alvarez was arrested in Torrance for possession of a weapon and a hypodermic needle. Alvarez, also a gang member, offered information on the murder of Alarcon in exchange for his release. Alvarez claimed he had seen Dumbrique, then 15, and Klene, then 18, together, and heard Klene announce his intention to kill someone from Alarcon's gang. According to their lawsuit,

Klene and Dumbrique were in another city the night of the murder, at the home of Klene's parents watching the heavyweight title fight between Mike Tyson and Evander Holyfield, with a number of witnesses present.

LASDinvestigators, however, took the word of Alvarez, who said Klene and Dumbrique were involved in the shooting, according to the lawsuit. The investigators allegedly fabricated witness statements about Klene and Dumbrique being seen in a green vehicle used in the fatal attack, the suit alleged.

On Dec. 4, 1998, a Los Angeles jury convicted Klene and Dumbrique of firstdegree murder. Both were sentenced to life in prison without parole. Their subsequent appeals were denied.

In March 2012, Klene learned for the first time that another man had admitted he had murdered Alarcon. Klene reached out to Inno-

cence Matters, a Torrancebased nonprofit organization that investigates wrongful convictions. In October 2012, Klene filed a state petition for a writ of habeas corpus.

On February 19, 2021, the motion to vacate was granted, the charge was dismissed, and Klene was released. The prosecution also agreed to vacate Dumbrique'sconviction, and his case was dismissed. Dumbrique was released.

In November 2022, Klene and Dumbrique filed the civil rights lawsuit in Los Angeles federal court alleging they were framed.

The Board of Supervisors agenda for Tuesday explained the reason for the recommendation to settle the suit, saying, "Given the high risks and uncertainties of litigation, a reasonable settlement at this time will avoid further litigation costs. The full and final settlement of the case in the amount of $24 million is recommended."

After pro-Palestinian encampment cleared, USC preps for graduation

USC was preparing for graduation ceremonies Tuesday after a pro-Palestinian encampment was cleared by officers with the Los Angeles Police Department and the university's Department of Public Safety, ending a highprofile demonstration that began in April.

USC announced Monday that "the University Park Campus is now open to students, faculty, staff, registered guests and known vendors with confirmation of work."

The university's various commencement ceremonies — minus the traditional main stage ceremony that was previously canceled — began Wednesday and will continue through Saturday at various locations around campus.

Commencement season has been a bit of a roller-coaster for USC students, given the various protests that have occurred on campus and the establishment of an encampment that was cleared by police early Sunday morning.

"This morning DPS, with the assistance of the LAPD, removed the occupiers who had rebuilt their illegal encampment in Alumni Park. The operation was peaceful. Campus is opening, students are returning to prepare for finals, and commencement set-up is in full swing," USC President Carol Folt said in a statement released around midday Sunday.

"Over the last few weeks, the university exercised patience and restraint as we worked to de-escalate a volatile situation. We've spoken to the occupiers daily, issued repeated warnings, and offered opportunities and locations for them to protest lawfully. We've supported their right to express strong opinions and passions for their cause, as always," she continued.

"Yet when free speech protests devolve into illegal occupations, violating the rights of others, we must draw a line. ... We are in the critical period from the end-of-term quiet study week, through finals and our commencement ceremonies.

"Despite our efforts to de-escalate, the occupation was spiraling in a dangerous direction over the last several days. Areas of campus were blocked, people walking down Trousdale, our main thoroughfare, were harassed, and iconic Trojan symbols were defaced. In addition, university property was stolen, and commencement structures were dismantled. Residence halls, campus throughfares, and libraries had become places of confrontation. Some finals were disrupted with noise and chanting during mandated quiet periods. Yesterday afternoon, outside agitators jumped the perimeter fencing and assaulted our officers.

"This had to stop. With no resolution in sight, I requested the LAPD to assist DPS in removing the encampment as peacefully and safely as possible. At 4:10 a.m., an order to disperse was issued, providing the trespassers one last opportunity to leave voluntarily. In 64 minutes, the encampment was abandoned and cleared. The operation was peaceful with no arrests. We will not tolerate illegal encampments of any kind at USC."

DDuarte looking for LA County artists for utility box art program

uarte is now looking for original designs by local artists to cover four utility boxes in the city.

Los Angeles Countybased artists aged 18 or older are encouraged to showcase their talents while promoting eye-catching public art throughout the city. This application is open to all artists: professional, amateur, and students. All approved designs will be printed on vinyl and installed on city-owned utility boxes by a thirdparty vendor.

The original artwork can be designed or created in any 2D medium such as graphic art, photos, or similar materials. Applicants are encouraged to develop designs in digital format, however, the city will also accept photographs or scans of physical art for the application.

This call for artists is part of the Utility Box Art Program, which aims to transform these metal cabinets into works of art in order to contribute to the unique character of each site location and create a more vibrant and welcoming cityscape.

Utility Box #1

-Located at the southeast corner of Huntington Drive and Mountain Avenue.

-The theme chosen for this location is “Route 66.”

-This location is the westerly gateway of the city and will be one of the first things motorists and pedestrians see as they enter the community. The utility box does not have a meter pedestal and is located within the public sidewalk.

Utility Box #2

Located at the southwest corner of Duarte Road and Circle Road.

The theme chosen for this location is “Medical Health.”

This location is at the easterly entrance to the City of Hope campus, across the street from the light rail station, and adjacent

to the city’s Duarte Road bike lane. The utility box will be very visible for the many staff and visitors who use light rail to commute to City of Hope, in addition to the general public. A meter pedestal accompanies the utility box and a public sidewalk surrounds them.

Utility Box #3

-Located at the northeast corner of Fasana Road and Highland Avenue.

-The theme chosen for this location is “Transportation.”

-This location is adjacent to the city’s light rail station, and across the street from the Duarte Station Specific Plan – the community’s transit-oriented neighborhood. A 344-unit apartment building was completed in 2023, and a second, 292-unit, apartment building is slated to be completed by the end of 2024. Future uses adjacent to this box location may include additional mid-rise apartment buildings, mixed-use, and/or hospitality. This location is located at a “T” intersection and will be very visible to eastbound Fasana Road traffic. There is a meter pedestal with this utility box, but there

is no sidewalk abutting them. A bike “sharrow” lane is located on both sides of Highland Avenue.

Utility Box #4

-Located at the southeast corner of Huntington Drive and Crestfield Drive.

-The theme for this chosen location is “Childhood.”

-This utility box is located on the public sidewalk, in front of the Maryvale Early Education Center along with the easterly segment of Huntington Drive. This location will be most visible to pedestrians and many of the commuters who take Huntington Drive for their evening commute. The utility box does not have a meter pedestal and is located within the public sidewalk.

All submissions must include a Utility Box Art Program application, original artwork, and both a 200-word maximum artist statement and artwork statement. In addition to these requirements, artists can also submit a resume and one to three examples of previous artwork. Submissions for locations with both a utility box and a meter pedestal must include

designs for both boxes. Artists can submit up to two design proposals, but an artist can only have one submission chosen by the city. Artwork will be evaluated by the Arts Ad Hoc Committee and will recommend submissions to the City Council for final approval. If their work is selected, artists will be notified within one week of City Council approval. Selected artists will be paid a $750 stipend per each approved design chosen for those utility box locations that contain only a utility box. Selected artists will be provided an additional $200 stipend per each approved chosen design for locations that have both a utility box and a meter pedestal. The artist will not be responsible for installing vinyl wraps. New sports, events included in Paris Olympics this summer

You're used to seeing track and field, gymnastics, and swimming at the Summer Olympics, but did you know breakdancing is now an Olympic sport? Stacker examined the new sports and events coming to the 2024 Paris Olympics.

Many sports vie to be in the Olympics for greater visibility and to fuel participation. The International Olympic Committee's revenue-sharing model doesn't hurt either — after the 2020 Tokyo Summer Olympics, the IOC distributed nearly $523 million to the international federations governing the sports in the Olympic program.

Though many sports try, getting onto the Olympic program is a complex process that can take years. There are two elements of the Olympic sports program: The initial program consists of the core sports you see at every Games and hosts cityselected sports.

To be considered for Olympic inclusion, the sport must have an international federation that the IOC "recognizes." Recognized international federations

IOC membership votes on the initial sports program about seven years before an Olympics occurs. Once a sport is on this list, it's almost permanently put on the program, although that's not always the case.

Host cities may also add sports to the program — with IOC approval — to make their Olympics unique. Host cities make their selections using a framework of 35 considerations, including the number of athletes, appeal to youth, costs and local popularity. The number of new sports can vary — the 2020 Tokyo Olympics had five new sports.

Paris kept new sports like skateboarding, sport climbing and surfing and added one new sport to the mix.

Sports may also change their events from Olympic year to Olympic year to modernize them, appeal to younger generations, and provide more opportunities for women. In Tokyo, basketball added a 3-on-3 event, giving urban half-court play an Olympic platform. In Paris, you'll also see several new events that will change

have participation from a wide range of countries and continents, a world championship, and abide by many rules, including those against doping and competition manipulation. Recognized status does not guarantee Olympic inclusion — chess, billiards, and cheerleading are all IOC-recognized sports but have yet to be in the Olympics.

Federation took breaking under its wing in its quest to get competitive dance in the Olympics. The IOC included it in the program at the 2018 Youth Olympic Games, where it got more and more attention. Seeking a Games with a youthful, urban feel, Paris nominated it for the sports program.

The competition in Paris will feature men's and women's events with 16 B-boys and B-girls each. They'll compete in a headto-head battle of three one-minute rounds where competitors throw down their moves.

Judges look for the best

the sport's governing body, only welcomed them to the world championships in 2015. In 2022, it announced that men could compete at the Olympics.

At the Olympics, men will only be allowed to compete in the team event — the duet will remain women-only, and they can only take up to two slots on the eight-person team.

Not every team is expected to have men, but Italy's team may include Giorgio Minisini, the first man to compete in a team at a senior-level event. The U.S. may feature 45-yearold Bill May, a pioneer and

physicality, creativity, and personal style because they compare dancers against each other rather than against a set of execution metrics like in gymnastics routines.

Look for American B-girl Sunny Choi, Japan's B-boy Shigekix and B-girl Ami, and Canada's B-Boy Phil Wizard to spin up some moves in the competition.

Men in artistic swimming

The one new sport for Paris 2024 — breaking, or breakdancing — originated in the 1970s with the emergence of hip-hop culture in the United States. While some consider it more of an art form embedded in the culture, a competitive version evolved as a sport.

The World DanceSport

When artistic swimming — formerly known as synchronized swimming — was introduced to the Olympics in 1984, it was a sport for women only. However, men had participated in the sport as far back as the 1940s but were eventually pushed out as universities looked for ways to offer women's sports to adhere to Title IX requirements.

While men still competed at lower levels of the sport, World Aquatics,

Marathon race walk mixed relay

As the IOC pushes for more gender equality, many sports have added mixed relay events to give women more medal opportunities. In track and field — also called athletics — women racewalkers have historically experienced a lot of disparity. Race walking was first included in the 1908 London Games as a men's event. Meanwhile, women didn't get an Olympic event until 2000, the 20-kilometer.

After the 2020 Summer Olympics, World Athletics opted to remove the men's 50-kilometer race not only because it deemed shorter distances more marketable but also to make room for a mixed relay event to give both men and women an opportunity to win two medals.

Traditionally, Olympic kayak slalom has been a solo event with athletes competing against the clock as they traverse a roaring whitewater course. The new kayak cross event turns this into a full-contact sport, as four athletes go down the whitewater course simultaneously, vying to be the first to cross the finish line.

Kiteboarding

Competed at every Olympics since 1900, sailing has continually evolved to feature categories of boats that are popular within the sport. In 2024, kiteboarding for men and women will join the schedule. In this racing class, athletes balance on boards and hang onto a large kite that catches the wind to propel them along the water. With strong enough winds, competitors can reach 45 mph. Players can also wow the crowd with high jumps and tricks.

The competition

Rather than start in the water, athletes drop from an overhead ramp onto the course, paddling downstream and upstream around gates, jostling each other to get the best line.

Another added feature is the roll zone, a section of the course where paddlers must fully roll over in their boat, including a full head submersion.

San Bernardino County Veterans Affairs earned $1,002,750 in state revenue generated by Veteran Services Officers (VSO) in claims filed for federal benefits for veterans and their families.

The state grants 11 million dollars in revenue each fiscal year to be paid to all 55 counties on a pro-rata basis

measured by county VSO office performance. The department received notification from the California Association of County Veterans Service Officers (CACVSO), an organization of professional veteran’s advocates committed to an efficient system of services and advocacy to veterans, that they will be awarded the highest share of the $11 million among the 55 counties to help fund operations.

At 1:19 a.m., employees from a business in the 300 block of West Foothill reported that an unknown subject threw a rock through the window. The subject was gone prior to officers’ arrival. This investigation is continuing.

April 26

At 12:58 a.m., an officer patrolling the area of Myrtle and Pomona saw a vehicle commit a traffic violation. A traffic stop was conducted and the officer made contact with the driver. A computer search revealed the driver was unlicensed and the passenger was wanted by the Arcadia Police Department. The passenger was arrested and taken into custody.

At 10:37 a.m., a caller in the 500 block of West Huntington reported a subject who was refusing to leave. Officers arrived and the subject left. Officers were called back and the subject was arrested and taken into custody.

At 7:31 p.m., while patrolling the area of Primrose and Linwood an officer saw a bicyclist in violation of a vehicle code. The bicyclist was found to be in possession of drug paraphernalia. He was arrested and taken into custody.

At 7:54 p.m., in the area of Huntington and Magnolia, an officer conducted a traffic stop on a vehicle for a vehicle code violation. Further investigation revealed the driver had an outstanding felony warrant out of Monrovia for domestic violence. The subject was arrested and booked before bonding out.

April 28

At 1:12 a.m., an officer patrolling the area of Ivy and Chestnut saw a motorist commit a traffic violation and conducted a traffic stop. The officer made contact with the driver who displayed symptoms of being under the influence. A DUI investigation confirmed that the driver was under the influence. He was arrested and transported to the MPD jail to be held for a sobering period.

At 1:25 p.m., a resident in

the 1300 block of South Fifth reported a burglary that had occurred two weeks prior. This investigation is continuing.

At 7:06 p.m., a customer of a store in the 600 block of West Huntington discovered someone stole her wallet while she was inside the store and the suspect had made several fraudulent transactions. This investigation is continuing.

April 29

At 2:10 a.m., a resident in the 400 block of East Greystone reported his vehicle stolen. Officers searched the area for the vehicle, but could not locate it. This investigation is continuing.

At 8:57 a.m. officers were patrolling the 200 block of East Evergreen and located two subjects inside an abandoned residence. One of the subjects was found to be in possession of drug paraphernalia. He was arrested, cited, and released at the scene.

At 11:31 a.m., while patrolling the area of Duarte and Shamrock an officer saw a vehicle commit a traffic violation. The driver was found to be in possession of drug paraphernalia. He was arrested, cited, and released at the scene.

At 3:43 p.m., a resident in the 1300 block of Orange called to report that his vehicle had been ransacked overnight and tools were taken. This investigation is continuing.

At 8:42 p.m., an officer patrolling the area of Duarte and Magnolia saw a vehicle commit a traffic violation and cause a traffic collision. One of the parties complained of pain, but refused medical treatment.

At 2:03 p.m., while patrolling the area of Myrtle and Pomona an officer conducted a traffic stop on a vehicle for a violation. The driver admitted to being in possession of drug paraphernalia. He was arrested and taken into custody.

At 3:03 p.m., a resident in the 1700 block of South Mayflower walked into the MPD lobby to report his wallet and credit cards stolen out of his vehicle. The credit cards were used at several locations before they were canceled. This inves-

At 10:12 a.m., a battery was reported in the 900 block of Norumbega. Officers arrived and determined that the victim was attempting to repossess the suspect’s vehicle and the suspect battered the victim. This investigation is continuing.

At 10:38 a.m., an employee of a business in the 100 block of West Foothill called to report that one of their windows had been broken overnight. This investigation is continuing.

At 3:06 p.m., a restaurant in the 800 block of West Huntington called to report a subject was trespassing. Officers made contact with the subject, and confirmed that he was in violation of a trespass authorization form. A computer search revealed the subject had two warrants for his arrest. He was arrested and taken into custody.

At 8:50 p.m., a vehicle fire was reported in the 900 block of East Huntington. Officers and MFD arrived to extinguish the fire. No injuries were reported. This investigation is continuing.

April 28

At 1:35 a.m., an officer responded to the area of Colorado Boulevard and Old Ranch Road regarding a vehicle in lanes of traffic with hazard lights on. The vehicle was missing both front tires and had severe collision damage. Upon contacting the driver, the officer detected a strong odor of alcohol emitting from the driver. Through a series of tests, the officer determined the 34-year-old female from Monrovia was driving under the influence of alcohol. She was arrested and transported to the Arcadia City Jail for booking.

April 29

At 12:55 a.m., officers responded to a residence in the 400 block of Walnut Avenue regarding the report of a burglary. An investigation revealed several suspects stacked patio furniture and entered the home through a second

story window. The suspects ransacked the home stealing a watch and the surveillance system. The suspects were seen leaving the scene in a white UHaul cargo van.

At 9:10 a.m., an officer responded to a residence in the 100 block of East Arthur Avenue regarding a vehicle vandalism report. The victim left his vehicle parked in the driveway of the residence overnight. He returned to his car in the morning and discovered that an unknown suspect smashed the front passenger side window.

April 30

At 3:52 p.m., officers responded to Arcadia High School, 180 Campus Drive, regarding an assault on two juveniles. The suspect exited his vehicle and began punching two teenage boys. After others intervened to stop the fight, the suspect got into his car and drove into one of the boys, striking him with the car. Both boys sustained minor injuries. The suspect fled the scene in a dark colored Toyota Highlander. An investigation by Arcadia Police Detectives led to the apprehension and arrest of the 42-year-

old suspect from Arcadia. At 3:37 p.m., officers responded to the area of Live Oak Avenue and Second Avenue regarding the notification of a stolen vehicle in the area. Officers located the vehicle, occupied by a female driver with her small child in the rear seat, in the 600 block of Duarte Road. The driver was found to be in possession of methamphetamine. The driver called her girlfriend to take custody of her child and an investigation revealed the girlfriend had an outstanding warrant for her arrest. The child was released to a grandparent. The 30-year-old female from South El Monte and her 34-year-old girlfriend from El Monte were arrested and transported to the Arcadia City Jail for booking.

May 1

At 7:46 a.m., an officer responded to a residence in the 700 block of Fairview Avenue regarding a vandalism report. An unknown suspect used a pellet gun to shoot the victim’s sliding glass door. Three additional reports were taken. Employees at Rusnak, 101 N. Santa Anita Ave., reported the windows of three vehicles

had been shattered by a pellet gun. Reports were also taken at Starbucks, 300 E. Huntington Drive, and O2 Karaoke, 1220 S. Baldwin Ave., where a pellet gun was used to shatter the front glass doors of the locations during nighttime hours.

At 8:41 a.m., officers responded to a residence in the 1400 block of Carmelita Place regarding an audible alarm activation. Surveillance footage revealed three suspects walking onto the property. The suspects turned off power to the house and used a ladder to climb up to the second story where they broke the window to the master bedroom causing the alarm to sound. The suspects fled the scene in an unknown direction. They were described as male suspects with thin builds. Suspect one was wearing a black sweatshirt, black pants, a black baseball cap, black and white shoes, a black mask, and black gloves. Suspect two was wearing a black sweatshirt, gray pants, a black and gray baseball cap, a black mask, and black shoes. chamber was simple: protection and promotion of commerce. Throughout the years, the chamber has morphed into an entity that promotes and enables businesses to actively engage with their customers and their community. Yes, the winds of change are upon us. But I feel strongly that the chamber can harness these winds and use them to soar into the future, and they better, lest they be blown overboard.

The chamber will have to adapt to this new world of high-speed technology. It wasn’t that long ago that no one knew what AI was. Now people are using it daily, via digital assistants, social apps, banking, predictive search, etc. Maybe one of the ways the chamber will adapt will be by helping businesses stay up to date and knowledgeable about technology, and how their business can

benefit from it, protect itself from it and stay current and relevant in this era of highspeed technology and information.

DDT chemicals making way into deep-sea food web, alarming researchers

Marine life off the Los Angeles coast may still be impacted by the effects of a long-disused DDT dumping site, a report by UC San Diego's Scripps Institution of Oceanography and San Diego State University researchers found Monday.

In the 1940s and 1950s, the ocean off the coast of L.A. was a dumping ground for the nation's largest manufacturer of the pesticide DDT -- a chemical now known to harm humans and wildlife, according to researchers.

While legal at the time, details of the pollution some 15 miles offshore from Catalina Island have deeply concerned scientists and the public since they gained wider recognition in 2020, the authors write.

According to their findings -- published Monday in the journal Environmental Science and Technology Letters -deep-sea fish and sediments collected from near the dump site remain contaminated with numerous DDTrelated chemicals.

"These are deep-sea organisms that don't spend much time at the surface

and they are contaminated with these DDT-related chemicals," said Lihini Aluwihare, a professor of ocean chemistry at Scripps and co-author of the study.

"Establishing the current distribution of DDT contamination in deep-sea food webs lays the groundwork for thinking about whether those contaminants are also moving up through deepocean food webs into species that might be consumed by people."

According to the authors, from 1948 until at least 1961, barges contracted by DDT-producer Montrose Chemical Corporation would motor from the Port of Los Angeles out toward Catalina and pump manufacturing waste laden with sulfuric acid and up to 2% pure DDT directly into the Pacific Ocean. This practice was legal until 1972 but largely overshadowed by Montrose's other waste disposal practice -- pumping a more dilute acidic slurry that also contained DDT through L.A. County sewers and into the ocean off Palos Verdes, researchers said.

That site is now an underwater Superfund site, and the researchers said

they cannot yet rule it out as the cause of the deep-sea fish and sediment contamination.

Dumpsite 2, the Catalina site, was rediscovered in 2011 by UC Santa Barbara researcher David Valentine.

The Los Angeles Times published a story exposing the dump site in 2020.

Since then, Aluwihare, study co-author Eunha Hoh of SDSU, and other collaborators began a series of research efforts. They seek to answer two main questions:

-- Are the chemicals at Dumpsite 2 being stirred up and ingested by marine life?; and

-- Is there a chemical fingerprint unique to what was dumped there in comparison to what was piped off Palos Verdes?

The researchers collected 215 deep-water fish spanning three common species near Dumpsite 2. Chemical analysis revealed that the fish contained 10 DDT-related compounds, all of which were also present in sediment samples taken at the same time, the authors write.

According to the researchers, species collect-

ed at shallower depths contained a lower concentration of contaminants and were missing a pair of DDTrelated compounds that were present in the deepest fishes.

"None of these fish species are known to feed in the sediment of the seafloor," said Anela Choy, biological oceanographer at Scripps and co-author of the study. "There must be another mechanism that is exposing them to these contaminants. One possibility is that there are physical or biological processes

resuspending sediments around Dumpsite 2 and allowing these contaminants to enter deeper water food webs."

These findings lead the researchers to believe the concentrated chemicals on the sea floor are making their way into the wider food chain.

"Regardless of the source, this is evidence that DDT compounds are making their way into the deep ocean food web," said Margaret Stack, an environmental chemist at SDSU and the study's lead author.

Janitors approve new contract

Janitors who are members of SEIU-United Service Workers West in Los Angeles, Orange County, San Diego, the Bay Area and Sacramento have overwhelming ratified a new contract, the union announced Tuesday.

"That is cause for concern because it's not a big leap for it to end up in marine mammals or even humans."

Hoh said understanding the pathways by which the DDT-related chemicals are entering the food web is vital.

"We are still seeing this DDT contamination in deep-sea organisms and ocean sediments more than 50 years after they were dumped there," she said. "I'm not sure if that company expected the consequences of their pollution to last this long, but they have."

After their contract expired April 30, thousands of janitors who clean California's largest office buildings, studios, and tech campuses were set to strike if they did not reach an agreement.

However, they were able to reach agreement on a new contract with the state's largest janitorial employers that includes wage increases,

pensions for all members and protections against abusive workloads, according to union president David Huerta.

Union members voted to approve the contract Monday.

"The amount of work that janitors were asked to do on a shift, especially after the pandemic, has reached dangerous levels, and people are getting injuries from heavy lifting and repetitive motion," said Maria Ortiz, a janitor from Los Angeles and a member of the bargaining committee.

"We weren't going to accept an agreement that didn't include workload protections.

Late last year, New York City made headlines when it all but banned Airbnbs and other short-term rentals within city limits. Reasons to be Cheerful revealed that in August 2023, Airbnb had more than 25,000 shortterm rentals listed in the city.

Tenant groups across the city accused short-term rental platforms of hollowing out neighborhoods and causing already-high rents to grow even higher.

"You would see tourists on the streets in neighborhoods where there weren't any hotels," recalled New York-based artist and activist Murray Cox.

The sound of rolling suitcases could be heard at all hours. Once tight-knit communities began to feel lifeless. When Cox ran the numbers on his own neighborhood — Bed-Stuy in Brooklyn — he found about 1,000 listings. Cox also heard horror stories from other parts of the city.

"People would move into a building and then find that the building was full of tourists day in and day out," he said. "In some cases, they would be so uncomfortable they'd feel forced to leave."

So, in September of 2023, New York City decided to do something about it. A series of bold requirements capped the total number of short-term rentals (STRs) and limited guests to just two at a time. They required STR operators to be primary homeowners — and to be present in the home while hosting. The city also promised to enforce those requirements, a move that would wipe out nearly 90% of active listings at the time.

The towns outsmarting Airbnb to make more homes available for residents

revolutionary, New York's crackdown isn't the first of its kind. In fact, it's part of a growing trend — one largely spearheaded by much smaller towns. Over the last decade, communities from Irvine, California, to Durango, Colorado, have implemented clever regulations, taxes and zoning policies to hobble the STR market — or, in some cases, eliminate it altogether. As the success stories pile up, a growing body of research points to the dramatic positive impacts of policies like these, including lower rents, more equitable housing markets and the promise of a sustainable tourism economy.

When Airbnb was founded more than a decade ago, it was heralded as the harbinger of a new sharing economy. In theory, home-sharing platforms — including Airbnb, Couch-

surfing, VRBO, FlipKey and Homestay — would put underutilized bedrooms to use, matching budgetconscious travelers with locals in need of a little extra cash. The system would funnel tourism dollars into small towns in a more equitable way. It seemed like a win-win. But within a few years, one clear loser emerged: communities.

"It didn't take very long for people to realize the sharing economy was basically a scam," explains Cox, who later went on to found data-sharing platform Inside Airbnb. "People weren't using that car that was sitting in the driveway to drive Uber. And people weren't just renting out a sofa or a spare bedroom." Instead, people saw an economic opportunity they could invest in. And they started buying whole homes to rent out on Airbnb.

In many cases, speculators and investment companies were buying multiple homes expressly for shortterm rental use. A spokesperson for Airbnb notes that "the majority of Airbnb hosts in the US share just one home on Airbnb to help supplement their income and welcome guests whose spending supports billions in tax revenue and economic activity for communities." According to an analysis Cox performed in 2022, about two-thirds of Airbnb rentals in the US are in a property portfolio, which means the host owns and rents more than one property. At the time, he found nearly 23% of Airbnb hosts had two or more homes or apartments listed on the site. That made up 607,085 listings — or 63% of entire-home listings. And the top 1% of operators have more than 300,000 Airbnb listings among them

— a stat that points to huge conglomerates gobbling up the market.

These days, Airbnb isn't just a way to share underutilized bedrooms; it's big business.

Right now, about 90% of Airbnbs in Bozeman, Montana, and Nashville, Tennessee, — both popular vacation spots — are whole homes. Both Bozeman and Nashville are also relatively small towns with exploding local populations and limited housing stock. That means that every home set aside for a year-round STR listing is a home unavailable to local residents struggling to find — and afford — housing.

As the Airbnb spokesperson noted, "Experts agree the chronic, decades-long underproduction of new

housing supply is driving today's housing affordability challenges."

But in extreme cases, the STR explosion has been a contributing factor in forcing longtime locals to move away. The so-called "Airbnb Effect" can hollow out once-vibrant communities.

This effect is most visible in popular vacation hot spots. In Hawaii, for example, out-of-towners have bought up so many homes that few are left for Native Hawaiians.

"On Maui alone, 52 percent of homes are sold to nonresidents, and 60 percent of condos and apartments have gone to investors and second homeowners," Stanford researcher Noah Jordan Magbual wrote in a recent report. "The once indigenous population of the Hawaiian archipelago are now outcasts in their own home."

The Airbnb Effect also impacts bigger urban areas. In 2015, one study found that STRs had sucked at least 10% of New York's available housing off the market. Another New York study showed that this reduction in supply led to rent increases of up to hundreds of dollars per year. In Barcelona, the effect is even more severe, with rents rising by 7% and housing costs rising by up to 17% in popular neighborhoods.

For some cities, the proliferation of STRs has become more than just an economic issue; it's existential. That's especially true in New Orleans, the longtime home of Jeffrey Goodman, an urban planner

and consultant who specializes in STRs.

"We were one of the earlier cities to experience the growth in short-term rentals," Goodman said. "And we're in a unique place because so much of what we sell is culture. It's art. It's food. But the people who make the art and cook the food and play the trumpets have a hard time living here." So, if the locals who make New Orleans special are forced to move away, what's left?

"There are a lot of cities asking themselves this question," said Goodman. "Are we a city anymore or are we just Disneyland?"

According to Goodman, the Airbnb Effect is stronger in small communities, like mountain towns or beach towns, which tend to have limited housing stock, high home prices and little flexibility to adapt to fluctuations in housing availability. That may be why small towns were among the first to fight back.

In 2014, Durango — a town of 20,000 in southwestern Colorado — passed a series of regulations to combat what one local newspaper called "The Airbnb Apocalypse." The town, an adventure epicenter for mountain bikers, climbers, skiers and other outdoor sports enthusiasts, isn't just a tourist magnet. It's also home to Fort Lewis College, a premiere university for Native American students and Colorado locals.

That was an experience Durango was anxious to protect.

Durango's 2014 regulations banned STRs outright in student neighborhoods.

They also limited STRs to 2% of the housing stock elsewhere.

"In doing this, the city made it clear that preserving student housing took precedence over any money they were going to get from tourism," Goodman said.

Today, city planning officials say the program has been a huge success.

"Durango led the way in creating effective guardrails to protect the community from being overrun with STRs," said Scott Shine, director of Durango's Community Development Department. Today, he said, STRs make up just 1.4% of the city's total housing stock. They just aren't really an issue anymore.

A year later, Santa Monica — an affluent California beach town of 90,000 — passed its own ordinances, banning STRs offering stays of less than 30 days for an entire home. The city also extended its 14% hotel tax to STR operators and made it illegal to operate them without a valid business license. According to one estimate, the ordinance has since dropped the city's number of Airbnb listings by 61%.

San Francisco enacts platform-accountability policies to end the Airbnb Effect

Many of these novel STR policies look great on paper, but the truth is that they're hard to enforce. Few cities have spent more time thinking about this issue than San Francisco.

San Francisco-based housing activist Dale Carlson first heard about the Airbnb Effect back in 2014, when the city was

undergoing a major housing affordability crisis. When he learned that nearly 5% of the city's limited housing stock was devoted to Airbnbs, he decided to get involved.

Carlson helped bring together a coalition of tenants, hotels and property rights groups. By 2015, they'd successfully lobbied for a city ordinance that required hosts to register their STRs, have a business license and pay hotel taxes. But it wasn't enough.

"We still ended up with 15,000 or 16,000 listings," Carlson said. So, his group asked voters to get behind an entirely new concept: the principle of platform accountability.

"The idea is that [the rental platform] can list and or rent anything it wants, but it can only collect a booking fee on the stuff that's legal," Carlson explained. If passed, the ballot measure would put the onus on Airbnb — not the city — to police unregistered and therefore illegal listings. Airbnb fought the initiative,

and it fought hard.

"We were defeated in the ballot. Airbnb spent close to $10 million—they outspent us 20 to 1," Carlson said. But despite the heavy spending, Airbnb barely eked out the win. "So many people had told us, 'You're never going to beat them because they're too big and powerful,'" Carlson says. "But suddenly they didn't look so powerful. And we didn't seem so vulnerable."

Carlson's coalition reworked the initiative and tried again. The next time, the ballot measure passed. Within a few months, Flipkey listings in the city had dropped by about 90%, and short-term Airbnb listings plunged by about 75%, according to some estimates. Cities across America were watching. Others, like Boston and New York, ultimately adopted platformaccountability policies of their own.

Another important aspect of San Francisco's policy is that hosts can only

use their primary residences as STRs. According to Carlson, that's dramatically limited speculative purchasing.

"All the folks who were buying up units or renting units and then subletting them on Airbnb — that's all gone," he said.

A few years later, Irvine, California, enacted an even more severe policy — with more dramatic results. In 2018, the city banned all short-term rentals under 30 days and hired a fintech firm to track down and report scofflaw hosts. This ban more than halved the number of Airbnb properties.

As of 2023, rents in the city had dropped by up to 3%, according to a recent study. That saves tenants about $114 per month on average.

Choosing the right STR regulations can be very location-dependent, said Goodman, the city planning consultant. Some towns might need a combination of ordinances, while complete bans might work better in others.

But according to Michael Seiler, the College of William and Mary researcher who led the Irvine study, we now have strong evidence that limiting STRs can indeed reduce rents. And, he said, it's likely that Irvine's solution could be successfully applied in other towns.

"If I was another policy maker in a sister city, I would say let's at least try it," Seiler said. "Because we've shown that it does work here."

New York hasn't been the only city to act in recent years. In 2023, Bozeman passed regulations forcing

STR platforms to ask for operators' permit numbers. The policy makes it difficult for bad actors to list their homes illegally, and makes it easy for the city to doublecheck that listings are appropriately registered and legally operating. Bozeman also mandated that STRs be primary residences — not second homes purchased as rental properties.

There may also be some market solutions around the corner. A cadre of startups are taking up Airbnb's original mission and reworking it into a more holistic, communityfriendly approach. New platforms like Trusted Housesitters and ReFlat are making it easier to find mutually beneficial housing swaps, while millennials are bringing time-shares back into vogue in Colorado ski towns.

In the future, these regulatory and entrepreneurial solutions could work together to give travelers affordable lodging options — without sacrificing the needs of local communities.

"A lot of people will say Airbnb is here to stay, but New York City shows you that's not necessarily the case. When they decided to enforce their housing laws, it was really effective," Cox said. "New York City's approach is a good model to show that we can be as restrictive as we want. It's up to us."

The State Legislature enacted a series of laws that require cities to streamline housing approvals through a ministerial process. These laws preclude the City’s ability to deny a housing project based on subjective reasons. To comply with these State housing laws, the proposed Ordinance removes the Conditional Use Permit (CUP) requirement and discretionary review for multiple-family residential development in all multiple-family residential zones and the Neighborhood Commercial (NC) zone. The proposed Ordinance also establishes new objective design standards for multiple-family residential development.

Specifically, Ordinance No. 2024-01 amends Section 2.56.030 of the Monrovia Municipal Code (MMC) to remove duplex and multifamily developments from the Development Review Committee’s neighborhood compatibility design review and exclude residential development projects from the Committee’s review of grading permits.

The proposed Ordinance also amends MMC Section 17.08.010 to delete the major Conditional Use Permit requirement for multiplefamily dwelling uses from multiple-family and NC zones. The Ordinance amends MMC Section 17.12.005 to remove the category titled “Multifamily residential not subject to a CUP” from the list of construction projects subject to review and notification.

Ordinance No. 2024-01 also amends MMC Section 17.12.030 to add new subsections that: (i) require all new multiple-family development to comply with all applicable Zoning Code requirements and a new set of objective design standards; and (ii) provide notice re-

quirements for applicants of multi-family residential projects. Finally, the proposed Ordinance amends MMC Section 17.24.050 to include pavement requirements for driveways and parking spaces for residential developments.

Pursuant to the California Environmental Quality Act (CEQA) and the State CEQA Guidelines, the proposed Ordinance is within the scope of the zoning text amendments that were analyzed in the previously adopted Mitigated Negative Declaration (MND) that was adopted in connection with the General Plan’s 2021-2029 Housing Element Update. The MND found that with the imposition of the mitigation measures that were set forth therein, there were no significant environmental impacts that would arise from the proposed Zoning Text amendments and proposed amendments to the General Plan.

These operational requirements for nonconforming automobile repair facilities prohibit working outside of enclosed buildings and parking on public streets overnight or in front of a residential use, and regulate the storage of vehicles and outdoor storage of equipment. The Ordinance also provides a permit process to allow certain deviations from the operating requirements for nonconforming automobile repair facilities. An automotive repair operations permit allows some or all of the following activities if specified conditions are met: outdoor operations, outside storage, parking vehicles in certain approved locations, and the use of temporary shade structures and outdoor storage containers. The Ordinance does not apply to automobile repair businesses that have a conditional use permit for their operations.

The proposed Ordinance also amends Section 2.56.030 of the Monrovia Municipal Code to provide the Development Review Committee with the authority to hear and approve, conditionally approve, amend, or deny, operations permits for nonconforming automobile repair facilities.

Reports: LA County deputy arrested in probe of drugs at Castaic jail complex

ALos Angeles County Sheriff's Department deputy was arrested in connection with a probe into the smuggling of drugs into the county jail complex in Castaic, according to officials and media reports Tuesday.

The sheriff's department issued a statement confirming only that an unidentified employee had been arrested.

"The department's Internal Criminal Investigation Bureau initiated an investigation into allegations involving an employee," according to the department. "We arrested the employee on April 30th for felony charges. The employee is relieved of duty pending the outcome of the case."

Although the department did not identify the employee, various media reports Tuesday identified him as 39-year-old Michael Meiser. Jail records show Meiser was arrested April 30 and booked early May 1, although it was unclear what he was booked for.

Jail records did not provide any information about his release.

According to reports by the Los Angeles Times and Los Angeles Public Press, Meiser was assigned to the department's Operation Safe Jails anti-gang unit at the North County Correctional Facility in Castaic, and he was arrested for allegedly smuggling narcotics in the jail. The LA Public Press reported that he was caught with drugs and cash during a surveillance sting.

Both outlets said Meisner's arrest was part of a larger, ongoing investigation into the activities of the Operation Safe Jails unit.

In a statement to The Times Tuesday afternoon, Richard Pippin, president of the Association of Los Angeles Deputy Sheriffs, said the union is "aware that there is a criminal investigation underway regarding one or more employees working in our jails."

"All law enforcement professionals are rightfully held to a high standard both on and off duty," Pippin told the paper. "ALADS will wait until we have access to all the information yielded by the investigation before commenting further."

Retired lieutenant continues testimony in informant scandal hearing

Aretired Orange County sheriff's lieutenant Tuesday brushed off any connections he had with a Sunset Beach murder case that has led to an evidentiary hearing regarding allegations of illegal use of jailhouse snitches, insisting he was unaware of what happened in the trial and the informant scandal that followed.

Retired Lt. Roger Guevara continued testifying in the San Diego evidentiary hearing regarding allegations of misuse of jailhouse informants in the case against Paul Gentile Smith, 64, who is charged with killing 29-year-old Robert Haugen in Sunset Beach on Oct. 24, 1988.

Smith's attorney, Scott Sanders of the Orange County Public Defender's Office, is trying to lay the groundwork for dismissal of the case or some other sanction related to allegations of outrageous governmental conduct. On June 10, now-Orange County Superior Court Judge Ebrahim Baytieh, who was Smith's original prosecutor, will testify in the hearing being held before San Diego County Superior Court Judge Daniel B. Goldstein.

Newsom: World’s largest wildlife crossing on track to open early '26

The world’s largest wildlife crossing is likely to open in early 2026, Gov. Gavin Newsom announced Tuesday.

Construction crews have installed more than half of the beams that form the Wallis Annenberg Wildlife Crossing, which spans across both sides of the 101 Freeway in Agoura Hills, according to the governor's office. Last month, the first of 82 large concrete beams went up over the 101 at Liberty Canyon Road.

Philanthropy has raised more than $34 million in funding for the crossing, and the state has provided $58.1 million, officials reported.

“Our work to build more, faster is already paying dividends across our state," Newsom said in a statement. "This wildlife crossing is just one example of how California is building infrastructure that connects rather

than divides. With projects like this, we’re reconnecting and restoring habitats so future generations can continue to enjoy California’s unmatched natural beauty."

The 101 Freeway is among the largest barriers preventing wildlife connectivity in Southern California. The Annenberg crossing aims to reconnect habitats and benefit many Southern California species, "including people," according to the governor's announcement.

The crossing will provide animals with a safe and sustainable way of avoiding the surface of the freeway and offer them increased options for finding food, shelter and mates, "which is increasingly important in light of climate change and continued human development that is pressuring species survival," officials said.

"More than 30 years

of conservation work has gone into strategic habitat linkages on both sides of U.S. Highway 101 so that this wildlife crossing will connect protected lands in the Santa Monica Mountains and the Sierra Madre Range," the announcement said.

A key intention of the forthcoming 101 crossing is the completed freeway overpass will reduce collisions between high-speed vehicles and animals on one of North America's most congested highways.

This project also has an education component for the millions of motorists who will pass under the crossing, as officials try to advance the "30x30 goal" to conserve 30% of state lands and coastal waters by 2030 to ensure "wildlife can move across conserved habitats that provide shelter, food and water."

was fired by Orange County District Attorney Todd Spitzer, citing a failure by Baytieh to turn over evidence to the defense in Smith's first trial, which resulted in a conviction in 2010 for murder and special circumstance allegations of torture and robbery. After the conviction, Smith pleaded guilty to soliciting an attack on the lead investigator in the case, sheriff's investigator Raymond Wert, but those charges were later dismissed by prosecutors after they agreed to a retrial of Smith's murder case in 2021.

The evidence in question was a report of an interview investigators had with jailhouse informant Jeffrey Platt, who detailed how he questioned Smith about his case, despite Smith being represented by an attorney, which is what attorneys consider a Massiah violation.

Guevara said Tuesday he did not even learn of Smith's conviction in 2010 until he was subpoenaed to testify in the evidentiary hearing.

Guevara said he understood that informants were not allowed to question other defendants who were represented by an attorney, but he just didn't know that it was known as a Massiah violation.

"You just didn't know the case name, Massiah," Sanders asked him.

"I thought I had a clear understanding of it," Guevara said of what was allowed when using informants.

"You understood in 2009 law enforcement is not allowed to encourage in-custody defendants to question other defendants about charged crimes?"

Sanders asked.

"Yes," Guevara replied.

"But you had information in this case that Jeff Platt wanted to question a charged defendant about his case," Sanders asked.

"I knew he wanted to work as an informant on this case ... but I had no idea what would come of it," Guevara said.

He said he passed along the request to Wert.

"I knew it went on to Wert, but I had no idea how he would proceed with it," Guevara said. "I didn't have a case to hand over (to prosecutors or defense attorneys). The case was already Wert's."

Goldstein asked Guevara, "You believe all you needed to do was turn it over to the case agent?"

"I didn't know anything about the case," Guevara replied. "I couldn't question him further. Once he gave

me that information, my job was to find out who the case agent was so he could make sense of it."

Guevara acknowledged he had the ability to document the request and add it to what deputies called Tred records, which kept an accounting of the movements of inmates in the jail.

"You chose not to," Sanders asked.

"Yes," Guevara respond-

ed.

Guevara, who retired in 2019, said he mostly worked with Platt as an informant on Operation Stormfront, a federal and state crackdown on white supremacists.

Guevara's memory of tagging along with nowretired investigator Bill Beeman to question Smith's girlfriend, Tina Smith, was hazy.

Guevara asked Tina Smith during the session, but he couldn't remember doing that.

"I didn't have any curiosity (about the Smith case) because it wasn't my case," Guevara said.

Guevara appeared to question Tina Smith about another person involved in the solicitation to kill Wert, but Guevara said he couldn't recall asking her about it.

"I stepped out, I missed part of the conversation, so I wanted to get back in tune with it," he said of the reason he asked a few questions.

"You were talking about Jeff Platt," Sanders asked.

"Definitely not," he responded.

When Sanders asked Goldstein about admitting various news clippings about the informant scandal into the record to undermine the credibility of witnesses saying they weren't aware of it, the judge said it was unnecessary because sheriff's Sgt. Michael Padilla had already testified that reading local news stories was part of the job in the unit that assigned inmate housing locations.

Guevara said he did not follow the informant scandal that grew out of the prosecution of Scott Dekraai, the

worst mass killer in county history. The scandal led to the death penalty being taken off the table for the defendant and the recusal of the Orange County District Attorney's Office from the case.

Under questioning from Senior Deputy District Attorney Seton Hunt, Guevara said in 2009-10 he was mostly focused on Operation Stormfront.

"Were you keeping up with those cases?" Hunt asked him.

"No," he said.

"Did you have time for that?" Hunt asked.

"No," he said.

He could not say exactly why he was along for the Tina Smith questioning. Guevara said it was "good policy" for investigators to bring a partner along for questioning of a witness, "particularly if it was a woman."

A partner can help with "trying to read (a witness), trying to get body language, all sorts of things," Guevara said.

He downplayed his jumping into the questioning.

"When I was talking to her ... it was just to make her comfortable," Guevara said. "You interject to keep things calm and level."

The Annual Action Plan (2024-2025) functions as an annual application for federal funds under HUD formula grant programs, specifically, the Community Development Block Grant (CDBG), Emergency Solutions Grant (ESG), Home Investment Partnership Act (HOME) and any other HUD entitlement programs potentially available to the City of Pasadena. The Annual Action Plan describes the strategy to carry out federal programs, indicates the general priorities for allocating funds and describes the basis for assigning the funding to each priority. The document includes a description of the proposed activities, funded with the HUD Community Development formula grant funds during the upcoming program year (July 1, 2024 – June 30, 2025) to address priorities.

3.4. California Public Contract Code, § 3300

In accordance with the provisions of California Public Contract Code, § 3300, each Bidder must hold an active Class A - General Engineering Contractor at the time of bid submission, except as to joint venture Bidders, who shall be licensed as provided in California Business and Professions Code, §§ 7029.1 and 7028.15(c).

Pursuant to the provisions of §§ 1770 to 1782 of the California Labor Code, the California Department of Industrial Relations has determined the general prevailing rate of wages in the county in which the work is to be done. A copy of the general prevailing rate of wages is on file with the City Engineer and is available for inspection and reference during regular business hours.

3.5. § 4104 of the California Public Contract Code

A Contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of § 4104 of the California Public Contract Code, or engage in the performance of this public works project unless currently registered and qualified to perform public work pursuant to California Labor Code, § 1725.5. It is not a violation of California Labor Code, § 1771.1 for an unregistered Contractor to submit a bid that is authorized by § 7029.1 of the California Business and Professions Code or by §§ 10164 or 20103.5 of the California Public Contract Code, provided the Contractor is registered to perform public work pursuant to § 1725.5 at the time the contract is awarded.

3.6. Department of Industrial Relations

The Contractor must post job site notices prescribed by regulation in accordance with California Labor Code, § 1771.4.

This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

Contractors and subcontractors must furnish electronic certified payroll records directly to the California Labor Commissioner’s Office utilizing the Department of Industrial Relation’s electronic certified payroll reporting system.

3.7. Electronic Bid bond

Electronic Bid bond is required. Bidders must provide all required information for the City to verify the bond with their bid. The People of the City of Pasadena ordain as follows:

SECTION 1. Pasadena Municipal Code, Title 2, Article VII, Chapter 2.365, Section 2.365.080 is amended as follows:

“2.365.080 – Claims against the city; delegation of claims functions to risk and insurance administrator.

Claims and actions for money or damages against the City of Pasadena or its employees are governed by the provisions of Chapter 1 of Division 3.6 of the Government Code commencing with Section 900 and following.

All claims or demands against the city shall conform to the requirements of Part 3 of Division 3.6 of Title 1 of the Government Code, or of a form provided by the city clerk. The procedures for presentation, consideration and action upon all claims filed pursuant to this section shall be the same procedures provided by Chapter 1 and Chapter 2 of Division 3.6 of the Government Code.

Pursuant to Government Code Section 935.4, the city risk and insurance administrator is authorized and directed to act on claims presented to the city by investigating such claims, and sending out all appropriate notices, including late claim rejections and denial notices. If the city council is provided with a list of recently-presented claims, such provision is for information only, in view of this delegation. The city risk and insurance administrator is authorized to allow, compromise or settle claims in a sum not to exceed $5,000.00.”

To ensure the safety of their workers, it is the responsibility of the contractor to provide Qualified Electrical Worker (QEW) services in the event their workers are not qualified to work in energized high voltage electric vaults or near high voltage electric lines on power poles. GWP will not provide QEWs for this purpose. • During construction, all questions regarding engineering and construction shall be directed to MA's Project Manager.

• Permitting: The selected contractor will be required to apply for and acquire all necessary permits to complete entire project as listed and described in this RFP and associated attachments.

o GWP will pay the permit fees directly to Public Works department. However, if the Contractor pays for any required permits, he/she shall be reimbursed for the actual direct cost of all Permit Fees, as defined in Paragraph 1.01 and addressed in 1.03 of the General Conditions. Bider shall exclude the cost of Permit Fees from Bidder's Base Bid sumand from Bid Alternate prices. • Traffic Control: Contractor(s) will provide temporary traffic control services and the necessary equipment generally consisting of the following categories: 1) Work area traffic control setup 2) Job site flagging 3) Lane closures 4) Road closures 5) Vehicle, bicycle and pedestrian detours. All traffic control plans will require approval from the City of Glendale Traffic Engineering Department prior to construction commencement. City will provide approved traffic control plans to the contractor. The contractor shall execute traffic control based on the approved plans. Any changes made in the field to traffic control shall be the con tractor's sole responsibility

• Materials: The selected contractor will be responsible for providing materials necessary to complete the work. Contractor shall provide cut sheets with material specifications to the City for all materials for approval prior to ordering. All material approval requests shall be submitted to MA's Project Manager for approval. The contractor shall purchase all materials as immediately as possible after executing the contract. This will help alleviate the impact of any upward price changes in this highly volatile market. Each proposal shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Glendale”, for an amount equal to ten percent (10%) of the total maximum amount of the Proposal. Alternatively, a satisfactory corporate surety bid bond for an amount equal to ten percent (10%) of the total maximum amount of the bid may accompany the Proposal. 9. Proposal Irrevocability: Proposals shall remain open and valid for ninety (90) calendar days after the Proposal Deadline.

10. Substitution of Securities: Pursuant to California Public Contract Code Section 22300, substitution of securities for withheld funds is permitted in accordance therewith.

11. Prevailing Wages: This Project is a “public work” subject to the provisions of California Labor Code Section 1720. The DBE that is awarded this Contract and all Subcontractors of any tier shall not pay less than the minimum prevailing rate of per diem wages for each craft, classification, or type of worker needed to perform the Work. The Director of Industrial Relations of the State of California, pursuant to the California Labor Code, has determined the general prevailing rates of wages in the locality in which the Work is to be performed. 12. Evaluation of Design-Build Entity’s (DBE’s) Qualifications: The Statement of Qualifications, which is required to be submitted by each Proposer, will be reviewed and evaluated by a review group comprised of GWP staff to determine if the Proposer’s qualifications meet the required criteria for experience and qualifications stated in the RFP. If the City determines that the Proposer does not meet these requirements, and/or if it is believed that the Proposer will not be able to competently do the work required for successfully completing the project, the Proposer will be disqualified and will not be given further consideration for continuing with the Proposal evaluation process and such Proposer will receive a “Fail” score. This is a Pass/Fail score evaluation.

13. Evaluation of Design-Build Entity’s (DBE’s) Proposal: Those Proposers that successfully meet the required qualification’s criteria and that receive a “Pass” score, per Item No. 12 above, will continue with the Evaluation process of their submitted Proposals in conjunction with their submitted Qualifications. The Proposals and Qualifications will be reviewed and evaluated by the same review group of GWP staff discussed in Item No. 12 above, to determine the best qualified DBE.

Each Qualifications/Proposal will be evaluated on the basis of the DBE’s experience and qualifications as measured by:

 45% Price and fees (hourly personnel rates and billing unit charges). While price and fees are important, they will not be used as the sole determinant in the selection process. Prices and fees for the project in its entirety– Base & All Alternate Proposal Items– will be included in the evaluation. It is the City’s preliminary assumption that the entire project will be built.

 15% Description of project approach and schedule. Demonstrated understanding of the project’s nature and GWP’s needs. Provide detailed plans on how to deliver the project timely and efficiently.

 30% DBE’s response to the Request for Qualifications; demonstrated DBE experience on similar (Scope & Dollar amount) water projects that include installation of ductile-iron water pipelines. The Proposer must submit information and references for only three (3) of its most recently completed projects where the Proposer acted as a DBE contractor. For at least one of these projects the design-build team, comprised of a contractor and a licensed civil engineering design company, must be the same two companies that are being proposed for partnering for the current RFP No. 3938 design-build project. At least one previous design-build project must have been with a Municipal water provider.

UCLA Office of Campus Safety launches investigation

An investigation was underway Tuesday into a violent attack that occurred last week targeting a pro-Palestinian encampment in UCLA's Royce Quad, with the university calling in local and federal law enforcement agencies who could be using high-tech detective tools in hopes of tracking down the perpetrators.

The attack was carried out by dozens of masked assailants beginning late April 30 and continuing into the early morning hours of May 1. The group set off fireworks that detonated in and around the encampment, and there were reports of pepper spray and bear repellent being deployed.

Representatives of the Palestinian encampment said more than a dozen people were injured, primarily due to the exposure to pepper spray.

Police in riot gear eventually quelled the violence, but law enforcement and the university were criticized for failing to intervene more quickly, allowing the unrest to continue for several hours.

In a message to the UCLA

community Monday, Chancellor Gene Block said the university remains committed to identifying those who carried out the attack.

"To that end, inaugural Associate Vice Chancellor and Chief Safety Officer Rick Braziel is leading a law enforcement investigation to identify the perpetrators of the violence and hold them to account," Block said.

"The LAPD has committed a detective to assist in our investigative efforts, and we have also connected with the FBI about possible assistance. We have spoken to Los Angeles County District Attorney George Gascón to solicit his help in ensuring that the instigators will be prosecuted to the fullest extent of the law."

Citing unnamed law enforcement sources, the Los Angeles Times reported that the investigation will include the use of facialrecognition technology, while also employing license plate readers to determine who entered the campus or was driving in the vicinity that night. The investigative tools being employed are comparable to those

used by federal authorities investigating the Jan. 6, 2021, insurrection at the U.S. Capitol.

"AVC Braziel and I have directed UCPD to invest whatever resources are needed to conduct a rapid and thorough investigation into the violent attack," Block wrote in his notice.

"UCPD is currently reviewing all available footage from last Tuesday night and speaking to witnesses who were present. We urge anyone who saw the violence firsthand or who has information about the attack to report it as soon as possible."

In the wake of the attacks and the next night's law enforcement raid that cleared out the encampment and led to more than 200 arrests, Block over the weekend announced the creation of the Office of Campus Safety, with Braziel placed in charge of the operation.

Block said that office is also conducting a review of the UC Police Department's response to the attack and conducting an analysis of UCLA's security protocols. It is assessing all acts of

violence that have occurred on campus over the past 12 days. Braziel is expected to create a plan to put in place to establish additional means of protecting students, staff and visitors on campus, Block said.

"Holding the instigators of this attack accountable and enhancing our campus safety operations are both critical. Our community members can only learn, work and thrive in an environment where they feel secure," Block wrote.

Gov. Gavin Newsom and other elected officials have called for an investigation into the law enforcement response to the attack on

USC graduation

The encampment had been rebuilt after previously being cleared on April 24, when 93 people were arrested.

The USC campus had been relatively calm in the days prior to Sunday's clean-up operation.

Last Wednesday, dozens of USC faculty members marched through the campus in support of protesters. That march occurred hours after a virtual meeting between members of the campus Academic Senate and Folt, who was joined by Provost Andrew Guzman.

Folt wrote earlier that "the university has initiated disciplinary review processes for individuals who have violated both our policies and the law. We will take any

further actions required to maintain campus safety and security, consistent with our legal obligations.

"The university is legally obligated to ensure that students, faculty, and staff can move freely throughout our campus while pursuing their studies, work, and research. Every part of our campuses, including Alumni Park, must be fully accessible and free from vandalism and harassment."

At least 12 student protesters received interim or full suspensions from the university, a media liaison from the "Gaza Solidarity Occupation" told the Daily Trojan, the campus newspaper, on Sunday evening.

residents were told they had until 5 p.m. Monday to pack their items and leave, a student protester who requested anonymity due to safety concerns, told the Daily Trojan.

In a statement Monday, USC officials said, "We are unable to discuss disciplinary matters because of student privacy laws and the confidential nature of personnel matters."

USC became a focal point of Southland pro-Palestinian protests following its April 15 decision to cancel valedictorian Asna Tabassum's commencement speech in response to complaints about her online posts critics called antisemitic. USC officials insisted the move was solely a security issue, not a

political decision.

Still, tensions continued to mount — leading to the mass protest April 24 and attempted occupation of Alumni Park that resulted in the 93 arrests and the clearing of the earlier encampment.

The university eventually opted to cancel its May 10 main stage commencement altogether, but vowed to move forward with the usual array of smaller satellite graduation ceremonies for the school's individual colleges.

The union that represents campus police officers at the 10 University of California schools blamed UCLA administrators for the delayed response to the attack and other violence between counter-protesters and people at the pro-Palestinian encampment.

The Federated University Police Officers' Association said in a statement Saturday that the probe by Drake into the university's "planning,

actions and response by law enforcement" must consider the UC's own guidelines for response to campus protests.

"The written guidelines for roles and responsibilities make clear that senior UC administrators on each campus are solely responsible for the university's response to campus protests; those administrators decide the objective, and campus police are only responsible for tactics in implementing those objectives," FUPOA President Wade Stern said.

"As such, the UCLA administration owns all the fallout from the response and lack of response to this protest."

The event will feature cultural dances and performances, crafts, food trucks, an artist talk, and more.

Kim's mural for USC PAM visually encapsulates the impact of migration from Asia and the Pacific Islands in shaping the distinctive cultural fabric of Los Angeles. The mural portrays 41 birds in harmonious flight, each representing a sovereign Asian or Pacific Islander nation and its official national bird. The collective imagery symbolizes the universal search for

home, a commonality that connects all humankind and all species.

“Traditionally, the king and queen would sit in front of a painted screen that had the sun and the moon on either side; it denoted yin and yang, the perfect

balance, principles that make the universe work, along with dignity, heaven's favor, and mandate for the king, essentially each time they sat down publicly in front of the imagery, it evokes the idea that it's a momentous moment in
