ORDINANCE NO. 3020

AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL MONTE INSTITUTING AN INTERIM MORATORIUM ON THE ESTABLISHMENT OF NEW FOOD TRUCKS OR THE EXPANSION OF EXISTING FOOD TRUCKS (MOBILE VENDOR COOKING, NONCOOKING AND ICE CREAM) WITHIN THE CITY

WHEREAS, California Constitution Article XI, Section 7, enables the City of El Monte (the “City”) to enact local planning and land use regulations; and

WHEREAS, the authority to adopt and enforce municipal code regulations is an exercise of the City’s police power to protect the public health, safety and welfare; and

WHEREAS, the City currently has regulations in place for mobile food trucks, including mobile cooking (primarily traditional lunch trunks), non-cooking food (primarily for the sale of fruits and packaged goods) and ice-cream (with amplified sound) trucks. The City currently has active business license permits for eight (8) mobile cooking and five (5) ice cream trucks; and

WHEREAS, the City of El Monte Municipal Code (“EMMC”) does not, at present, adequately regulate the establishment of mobile cooking, non-cooking and ice-cream trucks for the evening and early morning hours (i.e. night-time mobile food trucks from 6 PM to

2 AM), including what streets and zoning districts they may operate within; and

WHEREAS, mobile food trucks that operate at night-time generate unique impacts. They often park for several hours at one location, thus creating noise, public right-of-way obstructions and traffic impacts. Also, traditional lunch trucks and ice-cream trucks drive to their customers (i.e. construction sites for lunch trucks and parks for ice-cream trucks). With food trucks that operate at night-time, customers drive to them, potentially creating traffic, parking and loitering issues; and

WHEREAS, the City requires time to study the relevant issues and explore appropriate regulations for night-time mobile food trucks concerning their establishment, operations and aesthetics; and

WHEREAS, the City Council desires to direct City staff of the Finance Department, Police Department, Public Works Department, Community and Economic Development Department and City Attorney’s Office to conduct such analysis and to report their findings to the City Council within a reasonable time; and

WHEREAS, California Government Code Section 65858 authorizes the City Council to adopt an Urgency Ordinance for the immediate preservation of the public health, safety or welfare, and to prohibit a use that may be in conflict with the general plan and/or EMMC, that the City Council and City staff is considering or studying or intends to study within a reasonable time.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF EL MONTE, DOES HEREBY FIND, DETERMINE AND ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The above recitals are true and correct and incorporated herein by reference.

SECTION 2. Definitions. For purposes of this Urgency Ordinance, the term “food truck” shall mean any vehicle that operates on public or private streets and provides mobile cooking (e.g. lunch trucks), non-cooking food trucks (e.g. fruit or stack trucks) and icecream trucks (dessert goods).

SECTION 3. Moratorium.

A. The City Council declares a moratorium on the acceptance, processing and approval of any application for the establishment of a new mobile cooking, non-cooking of food and ice-cream trucks. Existing mobile cooking and ice-cream trucks that are fully permitted by the City shall be exempt from this Urgency Ordinance. However, they will not be able to expand their routes and shall comply with the existing 30-minute time limitation at any one (1) location.

B. The moratorium shall be effective for the period set forth in the Urgency Ordinance and extensions thereof, or until such earlier time that the City Council amends the EMMC to address the concerns described in this Urgency Ordinance.

SECTION 4. Urgency Findings.

A. In light of the foregoing Recitals, the City Council finds that the establishment or expansion of mobile food trucks presents a current and immediate threat to public health, safety and welfare, and the approval of permits, licenses or any other applicable entitlement required by the EMMC would result in that threat to public health, safety or welfare.

B. It is the intent of the City Council to consider new regulations, for example, limit the number of mobile food trucks, their geographic distribution, the length of time at any one location, their hours of operation and enforcement measures.

C. This Urgency Ordinance will afford City staff a reasonable amount of time to study the matter.

D. In light of these findings and all evidence in the record, the City Council finds that this moratorium is justified in accordance with Government Code Section 65858.

SECTION 5. California Environmental Quality Act (CEQA). This Urgency Ordinance is exempt from CEQA based on the following:

A. This Urgency Ordinance is not subject to CEQA in that it can be seen with certainty that there is no possibility that the Urgency Ordinance may have a significant effect on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). The adoption of the proposed Urgency Ordinance is covered by the “common sense rule” that CEQA applies only to projects that have the potential for causing a significant effect on the environment. The adoption of the proposed Urgency Ordinance does not have such potential.

B. This Urgency Ordinance is categorically exempt from CEQA under Section 15308 of the CEQA Guidelines, as it is a regulatory action taken by the City pursuant to its police power and in accordance with Government Code Section 65858 to assure the maintenance and protection of the environment and adoption of contemplated local legislation, regulation and policies.

SECTION 6. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Urgency Ordinance, or any part thereof is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Urgency Ordinance or any part thereof. The City Council hereby declares that it would have passed each secti9on, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phase would be subsequently declared invalid or unconstitutional.

SECTION 7. Effective Date. Pursuant to Government Code Section 36937, this Urgency Ordinance shall become effective immediately upon adoption if adopted by at least five/sevenths of the City Council and shall be in effect for 45 days from the date of adoption, unless extended as provided by Government Code Section 65858.

PASSED, APPROVED, AND ADOPTED by the City Council of the City of El Monte at the regular meeting of this 7th day of March, 2023.

The successful bidder shall have THIRTY (30) working days to complete the work. Liquidated damages shall be $500.00 per calendar day.

SB 854 Requirements:

This project is subject to the requirements of SB 854. No prime contractor or subcontractor may be listed on a bid proposal for a public works project unless registered and qualified with the Department of Industrial Relations pursuant to Labor Code section 1725.5. No prime contractor or subcontractor may be awarded a contract for public work on a public works project unless registered and qualified with the Department of Industrial Relations pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. The bid proposal must include a print out from the DIR registration website showing that the prime contractor and each subcontractor is currently registered and qualified. No bid proposals will be accepted nor any contract entered into with a prime contractor without proof of registration as required above. [Unless within the limited exceptions from this requirement for bid proposals only under Labor Code Section 1771.1(a)] from participation in any federal assistance programs in accordance with Executive Orders 12549 and 12689 and its implementing guidelines. The Contractor agrees to immediately notify the Federal awarding agency if the Contractor or any of the Contractor’s agents, sub-contractors or employees who may perform services under this contract become debarred, suspended or excluded from participation in federal assistance programs or federal contract transactions.

Contract Work Hours and Safety Standards Act:

To the extent this Contract is in excess of $100,000 and involves the employment of mechanics or laborers, the Contractor agrees at all times during the term of this Contract to comply with and abide by the terms of the Contract Work Hours and Safety Standards Act, codified at 40 U.S.C. 3701 et seq., as supplemented by regulations at 29 CFR Part 5, and that such terms and regulations are a part of this Contract and incorporated herein by this reference.

CITYWIDE SIDEWALK, CURB & GUTER REPLACEMENTS PROJECT No. 24009

Bidders shall attend a mandatory pre-bid meeting to acquaint Bidders with the contract requirements and site conditions that may affect the work. The mandatory pre-bid meeting will be held on Tuesday, April 4th, 2023 at 10:00 A.M. in the Rosemead Community Recreation Center at 3936 Muscatel Avenue. The City will only consider Bids submitted by those Bidders who attend the Mandatory Pre-Bid Meeting. All other bids will be considered non-responsive and subject to rejection.

The project consists of removal and replacement of concrete sidewalk, curb and gutter, driveway approaches, and curb ramps Citywide as indicated on the construction plans, including tree removals, tree replanting and other incidental and appurtenant work necessary for the proper completion of the project.

The engineer’s estimate for this project is in the range of $550,000.

Each bid must be accompanied by a bidder’s security in an amount not less than 10% of the amount of the bid, as a guarantee that the bidder will, if awarded the Contract, enter into a satisfactory agreement and provide a Performance Bond and a Payment Bond, each not less than 100% of the total amount of the bid price.

No bidder may withdraw his bid for a period of sixty-one (61) days after the above bid opening date.

FEDERAL CONTRACT PROVISIONS FOR COMMUNITY DEVELOPMENT BLOCK GRANT

Davis-Bacon Act and Copeland Anti-Kickback” Act.: This contract will befunded in whole or in part with federal housing and community development funds. The Federal Labor Standards Provisions, including prevailing wage requirements of the DavisBacon and Related Acts will be enforced. To the extent this Contract is for construction services in excess of $2,000, the CONTRACTOR agrees at all times during the term of this Contract to comply with and abide by: (i) the terms of the Davis-Bacon Act(codified at 40 U.S.C. § 3141 et seq., as supplemented by regulations at 29 CFR Part 5), and that such terms and regulations are a part of this Contract and incorporated herein by this reference; and (ii) the terms of the Copeland “Anti-Kick Back” Act ( codified at 40 U.S.C. § 3145 et seq., as supplemented by 29 CFR 3), and that such terms and regulations are a part of this Contract and incorporated herein by this reference.

This project is a public work in the State of California, funded in whole or in part with public funds. Therefore, the higher of the two applicable prevailing wage rates, federal or state, will be enforced. The Contractor’s duty to pay State prevailing wages can be found under Labor Code Section 1770 et seq. Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and to employ apprentices, including forfeitures and debarment. The State Wage Decision is on file at the City Clerk’s office, and is also available online at http://www.dir.ca.gov/dlsr/.

Apprenticeship Program:

Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices.

Section 3 Statement:

To the extent this Project is funded in excess of $200,000, Section 3 regulations are required. Found under 24 CFR Part 75, the purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD financial assistance are, to the greatest extent feasible, directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing.

Equal Employment Opportunity:

Conflict of Interest:

In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict of interest provisions in 2 CFR 200.112 and 24 CFR 570.611, respectively, shall apply. No employee, officer or agent of the subrecipient shall participate in selection, or in the award or administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved. The Contractor represents, warrants and agrees that to the best of its knowledge, it does not presently have, nor will it acquire during the term of this Agreement, any interest direct or indirect, by contract, employment or otherwise, or as a partner, joint venture or shareholder (other than as a shareholder holding a one percent (1%) or less interest in publicly traded companies) or affiliate with any business or business entity that has entered into any contract, subcontract or arrangement with the City. Upon execution of this Agreement and during its term, as appropriate, the Contractor shall disclose in writing to the City any other contract or employment during the term of this Agreement by any other persons, business or corporation in which employment will or may likely develop a conflict of interest between the City’s interest and the interests of the third parties.

The CITY OF ROSEMEAD will affirmatively ensure the disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, disability, sex or national origin in the consideration for an award.

Any contract entered into pursuant to this notice will incorporate the provisions of the State Labor Code. Compliance with the prevailing rates of wage and apprenticeship employment standards established by the State Director of Industrial Relations will be required. Bidders shall be licensed in accordance with the provision of Chapter 9, Division 111 of the Business and Professions Code of the State of California. Bidder shall have a Class “A” license in good standing at the time Bids are received.

The Council reserves the right to reject any and all bids and to waive any informality, technical defect, or minor irregularity in any bid submitted.

Award of Contract Agreement is proposed for April 25th, 2023. This project is funded in part by the U.S. Department of Housing and Urban Development (“HUD”).
