BY TERRY MILLER Approximately 500 people attended a peaceful vigil at Arcadia Performing Arts Center Monday night, Jan. 25.

The wake honored the lives of two fellow students who were allegedly bludgeoned to death by their uncle Thursday night, Jan. 21. Candles in the shape of hearts adorned the ground where school authorities gave brief speeches about the loss of the Lin brothers.

A man accused of killing his two teenage nephews in their Arcadia home and then fleeing the country was arrested in Hong Kong, according to L.A. Sheriffs’ Department and the FBI. Deyun Shi, 44, was arrested at the Hong Kong International Airport after arriving on a Cathay Pacific flight from Los Angeles, the FBI said.

Shi was named as a suspect after his two nephews, ages 15 and 16, were found murdered inside their home on Jan. 22 in the 400 block of Fairview Avenue.

BY TERRY MILLER According to a press release sent out by Sierra Madre, “Staffing levels within the Sierra Madre Police Department (SMPD) have reached a level where there

are insufficient personnel to provide safe and reliable police services 24 hours a day, seven days a week.”

This in itself, of course, is extremely alarming for any city, but especially one that has been recently plagued

with residential burglaries, yet ironically just named one of the safest cities in California by a survey company.

The troubles at SMPD have been long and serious, including multiple lawsuits both externally, towards the

department from citizens, and internally, from the department against the former chief of police, Marilyn Diaz.

Additionally, the tiny city has little sales tax base, unlike neighboring cities such as Arcadia.

Sierra Madre Police Deptartment’s force has dwindled to half of what was last year’s personnel.

It is a tough time indeed for the embattled little city.

Assistant City Manager Elisa Cox told Sierra Madre Weekly Friday, Jan. 22, that the city is actively seeking new police recruits from the academy but freely admits, “other cities pay considerably more than SMPD, so this is key in the dilemma the city’s chief executives face.”

Cox also said the election and the Utility User Tax (UUT) will, of course, play a crucial role in deciding the fate of the police.

A SMPD sergeant was dismissed during the closed session at the city council meeting on July 14, 2009.

In response to a request for information related to the dismissal, City Manager Elaine Aguilar said, “Personnel matters are confidential, and we really can’t say anything. People have a right to privacy.” No further information was able to be obtained about the dismissal.

According to Federal District Court Filings, John Ellins, an SMPD officer, filed a lawsuit against the City of Sierra Madre and Marilyn Diaz. The suit was filed on June 3, 2009 under the category of “Civil Rights – Employment.”

Marilyn Diaz was the police chief of SMPD at that time.

She was the first female police chief in L.A. County.

Also in 2009, at approximately 3:30 a.m. on Jan. 30, an SMPD officer discovered a Nissan SUV within the city that had been reported stolen. The Nissan was towed back to the rear of the police station on Sierra Madre Boulevard. To their surprise, officers opened the hatchback of the SUV and found a man in the vehicle’s cargo area where he had allegedly been sleeping under a blanket. Why the officer(s) did not see the individual before the car was towed has been the subject of much speculation and supposition.

46-year-old Jason Jensen had allegedly been living in the car that had been reported as stolen. SMPD’s officer Amos then shot Jensen with a single round to the upper torso.

The internal investigation was completed and Amos was placed back on duty.

The city has been divided over the possibility of outsourcing for police services.

On one side, are residents who believe that their police officers do not appreciate their recent pay raises and generally have a negative attitude about working in Sierra Madre. They call for the police services to be outsourced, and save the city money and potentially receive better attitudes.

A central comment in both opinions relates to the salaries of the police department. Some say that SMPD already receives too much money from the city, while the others believe that SMPD remains one of the lowest-paid departments despite help from their recent raise funded by the now-controversial UUT increase passed in 2008.

Aguilar followed up with an email explaining the issue further: “First, there is a UUT revenue measure on the April 2016 ballot. It is the measure the council has put on the ballot for a 10 percent UUT. If the measure does not pass, the UUT will decrease from the current eight percent down to six percent, a loss of almost $1 million in general fund dollars. This is the revenue measure referenced in the city’s press release, not the ‘No-UUT measure.’

“It is important to note that the raises were for three years: 2008, 2009, and 2010.

There have not been any Police Officers’ Association (POA) raises since that time.

Any advances in pay, compared to other police agencies that may have been made in 2010 have eroded since that time. Your article makes it appear that the raises were recent … And not more than five years ago.

the hours of 6 p.m. and 6 a.m. beginning Sunday, Feb. 7. Over the course of the last few months, SMPD lost nine of its 20 full-time employees, three part-time community service officers, and one parttime police officer, and there is the possibility that the department may lose a few more employees. Employees are resigning for a variety of reasons including retirement, an opportunity to work at higher paying departments, and a perceived lack of job security in light of the scheduled decrease of the UUT and the pending revenue measure on the April ballot.”

We contacted Aguilar about the UUT situation and importance it bears on the police force in town.

“The ‘No-UUT measure’ did qualify in regards to getting a sufficient number of qualified signatures. However, it was too late, per the elections code and per the city clerk, to put it on the April 2016 ballot.

“The proponents did not request a special election, so pursuant to the election code the measure would technically go on the April 2018 election. However, the city council could decide to consolidate with a county election, for example the June 2016 or November 2016 election. The council has not yet decided to consolidate with the county – they will be discussing their options during the February city council meetings.

“The UUT revenue measure on the April 2016 ballot is the measure the council has put on the ballot for a 10 percent UUT. If the measure does not pass, the UUT will decrease from the current eight percent down to six percent, a loss of almost $1 million in general fund dollars.

“Police raises that resulted from the 2008 UUT measure - it is important to note that the raises were for three years, 2008, 2009, and 2010.

Police have not received raises in five years,” Aguilar said.

The official press release the city sent out says, “During the term of the temporary contract, SMPD will continue to staff a dispatcher in the Sierra Madre police station during the nighttime hours. This will allow the dispatcher to greet and assist walk-in lobby traffic, answer routine business calls such as overnight parking permits, and lessen the temporary impact to citizens who call the police department. All non-critical reports and calls for service will

be handled by SMPD officers during their daytime shift.”

The Arcadia City Council is scheduled to review the contract at its Feb. 2 meeting.

The temporary supplemental policing services for nighttime patrol are anticipated to begin on Sunday, Feb. 7, and be in effect until June 2016.

Arcadia Chief of Police Bob Guthrie told Beacon Media, “If approved by both City Councils, the MOU as currently written would run approximately 19 weeks – with a review period near the beginning of May. I’m still in the process of preparing the Staff Report for next Tuesday night, and prefer at this time to hold off on any numbers until final review and approval for next week’s agenda. I would anticipate, however, our agenda being posted online by tomorrow night (Thursday) for next Tuesday’s meeting – where the approved staff report and recommended MOU will be available. As is the case with any such matter, it will be up to our City Council to decide if they think the recommendation in the staff report is appropriate, and worth moving forward with.

“The proposal for the requested services has not been put on hold from what I understand. The City of Arcadia is moving forward with its staff report and recommendation for Tuesday’s Council meeting as previously expected.”

We contacted Sierra Madre Mayor John Capoccia via email for his perspective of the situation currently plaguing the police dept. Here is his reply: “Thanks for the opportu-

nity to give my perspective on our staffing difficulties with our police department.

Our officers have some legitimate concerns. First, there is financial uncertainty given our budget situation, if

the April UUT doesn’t pass, the council will have to make dramatic and painful cuts, which could include contracting for police services with the Sheriff. Second, the police departments in other cities have

stepped up hiring, so some have taken the opportunity to hire on with a department that pays more than we do.

PASADENA Jan. 12 At about 12:31 a.m., Pasadena police officers responded to the intersection of El Molino Avenue and Maple Street regarding a traffic collision. On arrival, officers determined that the collision involved two vehicles.

There were five victims in one of the involved cars and two of them (adult females) sustained fatal injuries. The three other victims were transported to a local hospital, all in very serious condition. The driver of the second car was treated at the scene. The Los Angeles County Coroner responded to the collision to assist.

Jan. 20

At 10:16 p.m., Pasadena police officers responded to the 1600 block of Casitas Avenue regarding gun shots. On arrival, officers canvassed the area; however, they did not locate any evidence of gun shots.

A witness said the sound

might have been fireworks.

The incident was documented on a police report.

At 5:41 p.m., Pasadena police officers responded to the 600 block of Rim Road regarding a suicidal subject.

On arrival, officers located a male Pasadena resident holding a knife to his abdominal area. Pasadena police officers S. Rappuchi and P. Magat negotiated with the subject and subsequently convinced him to drop the knife. The subject was arrested without incident and taken to a local hospital for mental health assessment.

Jan. 22

At 1:02 p.m., Pasadena police officers responded to the 1300 block of North Fair Oaks Avenue regarding an assault with a deadly weapon investigation. On arrival, officers learned that the suspect (male adult) had fired several shots. Officers did not locate any evidence of the shooting; however, they talked with a witness who (only) heard

the shots. Officers did not locate any victims.

MONROVIA

Jan. 23 At 9:15 a.m., a traffic collision was reported in the 400 block of West Maple Avenue. The caller was following a vehicle that struck two parked cars and hit the curb while driving west on Maple. The vehicle pulled into a business parking lot near Fifth and Huntington and stopped. Officers arrived and found the suspect behind the wheel of his vehicle. He seemed disoriented and unaware of his surroundings. The officers determined the subject was driving under the influence of a controlled substance.

He was arrested and taken into custody.

At 8:19 p.m., a vehicle burglary was reported in 600 block of West Huntington. The victim parked his vehicle in a business parking lot and went into

work. He returned later and discovered his vehicle had been ransacked. The victim’s checkbook was taken from the center console and a backpack containing baseball equipment was taken from the trunk. The investigation is continuing.

At 9:37 p.m., a vehicle burglary was reported in the 100 block of Colorado.

The victim parked his vehicle in the 100 block of Colorado and went into work. When he returned to his vehicle after work, he discovered his vehicle had been ransacked. The loss was a wallet from the driver’s door pocket, which also contained his debit card. The victim reported that the debit card had already been used at a business. The investigation is continuing.

front counter regarding a fraud report. The officer discovered an unknown suspect used the victim’s personal information to open three fraudulent credit cards. The victim does not know how the suspect obtained her private information. The investigation is ongoing.

At about 5:52 p.m., an officer responded to a residence in the 1100 block of Sunset Boulevard regarding a theft report. The officer determined an unknown suspect stole the victim’s secured bicycle from her second story patio. No suspects were seen and no witnesses were located.

Jan. 21

Around 8:12 p.m., an officer responded to a residence in the 2300 block of South Sixth Avenue regarding an alarm activation report. Surveillance footage revealed two unidentified suspect(s) entered the residence by unknown means and stole two safe deposit boxes before fleeing.

One of the suspects is described as a white or Hispanic male, 18 to 23-yearsold, with a slim build. The second suspect is described as a white or Hispanic male, 18 to 23-years-old, with a larger build. The investigation is ongoing.

Jan. 22 At about 12:39 p.m., an officer responded to a residence in the 400 block of Fairview Avenue regarding an unknown trouble call. An investigation revealed the victim’s 15- and 16-year-old sons had been found dead in the residence.

Just after 7:57 p.m., an officer responded to Peacock Liquor, 419 South First Avenue, regarding a robbery report. The officer discovered an unknown male suspect, armed with a handgun, entered the location, forced the clerk to give him cash, and fled on foot in an unknown direction. On January 23rd, an officer recognized the suspect from the robbery surveillance footage. The 16-year-old male juvenile from Arcadia was arrested and transported to the Arcadia City Jail for booking.

Jan. 23

Just after 12 a.m., officers responded to a residence in the 1100 block of South Fourth Avenue regarding a fire. An investigation revealed the location was filled with marijuana plants and the residence was being used to cultivate marijuana. The investigation is ongoing.

Sierra Madre deserves better than to be forced into rash decisions because of a short-term budget problem.”

Many seniors say that creating a financially secure life for themselves and their family is an important goal. As a grandparent, it can be hard to find a balance between supporting (and spoiling) your grandkids while ensuring you do not run short on funds to reach your own financial and retirement goals. Here are four tips to keep it all in check: 1. Know what you can afford. No matter how much you enjoy splurging on your grandkids, your financial security should remain your first priority. There are many unknowns in retirement, including your longevity, fluc-

tuation of the markets, and the impact of inflation on purchasing power. Spend and gift within your means to maintain your own financial health in the future.

2. Determine if you are giving or loaning. If you are giving a gift, understand current federal tax rules, which are based on the calendar year. In 2015, you can give up to $14,000 to each family member before the federal gift tax is applied. And make certain the recipient knows it is a gift for their own tax purposes, and so there is no uncertainty about whether or not they need to pay you back.

If you are loaning money to a grandchild, be very specific about the terms and repayment, and consider having a written document that both parties sign and date. This can help safeguard your financial situation and ensure both of you are on the same page –

now and in the future.

3. Talk about it. Many people tend to shy away from discussions about money and finances with their family. If you would like to help support your grandchildren or save for their future goals like college or a down payment on a home, be sure to communicate this with their parents.

This can help your adult children do a better job with their own financial planning. For example, if the parents of your grandchild know how much you are expecting to contribute to their child’s education, they may be able to decrease the amount allocated to a 529 Plan and invest more toward other goals, such as their own retirement.

4. Establish boundaries.

Even if you want to help your grandchildren financially, depending on their situation, it may not be appropriate to do so, or to repeatedly provide

Reader’s Concern Over Clairbourn

Dear Editor: I have read your paper, mostly the Pasadena Independent, on and off over the last few years. The paper comes across as a family newspaper that does a lot of articles on the local schools. I wanted to express my concern and disappointment that you give coverage to Clairbourn School. You also carry advertisements for the school. I attended Clairbourn for most of my childhood. I am not Christian Science, but it is a Christian Science school. All of the staff is required to be a member of their church. Christian Science is essentially a cult.

I witnessed some of this as a student there over the years.

As an adult I’ve learned more about the religion, if you can call it that. I’ve also spoken to former Christian Scientists, including someone who is the offspring of a Clairbourn teacher, and I’m quite upset by what I’ve learned. Even more upsetting was an article I came across by accident, on The Atlantic website. I have attached a link to the article at the bottom of this letter.

The first section of the article is about the death of Andrew Wantland, who was the son of one of my Clairbourn teachers. Of course no one I talk to at Clairbourn ever told me about Andrew’s death. Andrew died at the age of 12 because his Christian Science father would not take him to a doctor or to a hospital. He died of a very treatable illness: childhood diabetes. Mrs. Wantland, my former teacher, had left Clairbourn and left the religion. But she wasn’t able to save her son from it. I was, and still am, very upset to learn about Andrew’s death.

Based on my experience as a student there, and after what I have learned as an adult, I feel it is very irresponsible to be advertising in any way for Clairbourn School.

You include the school in your paper with other schools, giving readers the impression that it’s no different than a Poly or Chandler. But those schools are not run by child abusing cults. Christian Science parents have been tried for child abuse and even child murder. You can read about this in the attached article.

Parents reading your newspapers may not realize that if they send their child to Clairbourn, all the adults teaching and working with their child have almost no experience with doctors or hospitals. And unlike a school like Poly, and unlike public schools, there is no nurse or medical assistant on campus at Clairbourn.

Many parents won’t realize

that the person teaching their child at Clairbourn more than likely denies their own child medical treatment, and even teaches their child that they are bad if they get sick.

I just don’t feel Clairbourn is a safe place for children. I am surprised that in the year 2015 the school is still in operation. I feel it’s irresponsible for your papers to be advertising and writing about this school, as if it’s a good option for the children in this community. Below is the link to the article I mentioned. BY SUSAN MOTANDER Every year the Pasadena Showcase House for the Arts holds an “Empty House Party” to celebrate the new house the group will begin to remake into its showcase home for the year. “Empty” is the last thing the house in on that evening. Each year the house is filled with the designers, members of the

Showcase organization, and members of the press, all eager to see the bones of the house that is about to be transformed and to enjoy the always spectacular food that is served. Last week the “Empty House” was full of people and ideas as the designers shared their concepts for the spaces they will remake.

This year there are

20 interior spaces and six exterior areas. In some of these areas more than one designer or team has been assigned. All the work began this week as the crews began the work of again transforming this Mission Revival style mansion into a Showcase House (it was the Showcase House almost 30 years ago). The two-story house itself is huge with ap-

proximately 16,000 square feet, including 6 bedrooms and 5 baths. There is even a basement that runs under the entire house and holds a gym, spa, and bar.

In addition to all this there is another 2,032 sq. ft. in the guest house with its 2 bedrooms and 2 bathrooms.

All this work is for a good cause. The monies raised by the tours of the Showcase House support music and the arts in the local communities. There is the Youth Concerts for students at the Walt Disney Concert Hall in downtown Los Angeles.

There is the Music Mobile that tours local schools to introduce young people to orchestra music. And there is the Gifts and Grants program that provides funding for everything from vocal music at lunchtime in Pasadena, to musical instruments for schools. More than $20 million has been given over the years to support the arts in “our community.” This year Beacon Media News will be following Showcase in a different way. We will be following one garden from design through implementation

Pearson Community Room of the main library, the Altadena Library District will continue its Latino American Grant award programming with “Prejudice and Pride (1965-1980)”, episode five of a six-part, NEHsupported documentary film, “Latino Americans: 500 years of History.” Created for PBS in 2013 by the WETA public television station, the awardwinning series chronicles the history of Latinos in the United States from the 16th century to present day.

Presentation will include special guest Dr. Daniel “Sancho” Castro, an educator who has served as college president and superintendent at both Riverside City Col-

lege, and Los Angeles Trade Technical College. His community college experience also includes service as vice president of academic affairs, associate dean of student activities, instructor of sociology and Chicano studies at various community colleges around Los Angeles. Castro served as senior legislative consultant to the California State Legislature as district manager for the 32nd Congressional District. He also ran for the state assembly, played an active role in many local campaigns and elections, and has been honored and recognized by a host of political leaders for his service to the community. For 16 years, he produced, and was the voice behind, “The Sancho Show” on public ra-

dio. His show stressed the importance of education to the Chicano community. He also produced the Chicano Music Awards, which raised funds to keep young people in higher education. He was significantly involved in the Chicano student movement as well as in the community during this vital time in Chicano American history.

“Prejudice and Pride (1965-1980),” episode five: In the 1960s and 1970s a generation of Mexican Americans, frustrated by persistent discrimination and poverty, find a new way forward, through social action and the building of a new Chicano identity. The

movement is ignited when farm workers in the fields of California, led by César Chavez and Dolores Huerta, march on Sacramento for equal pay and humane working conditions.

Weightlifting has numerous benefits to our physical and mental health, but it can be intimidating to break into for those who mainly stick to cardio. While lifting heavy-looking equipment in the company of more experienced lifters can seem daunting, you can remove some of the anxiety by avoiding these common mistakes: Lifting Too Much Weight An easy way to get an injury right away is to overestimate how much you should be lifting. Those who are under the age of 18 should be especially careful, because their bodies are not done growing yet, and this age group is more likely to do too much right away. Just like a long-distance runner did not start out running marathons, neither should someone new to weightlifting try to lift the heaviest weight out there.

Start with small amounts, and slowly work your way up.

Failing to Use Equipment Properly Too many gym-goers are unaware of how to properly

use the equipment, which can be a safety hazard for both them and those around them. Those who are new to weightlifting should seek assistance from a trained professional before attempting to use the equipment, and understand how to take care of it after they are finished.

For instance, using lockjaw barbell collars on weightlifting bars is needed; otherwise, the weight could slip off and cause serious injury.

Improper Form You can do as many reps as you want, but using an improper form for squats and the bench press will not give you much progress and could potentially lead to injury.

Unfortunately, many people think that there is nothing required to weightlifting except to lift heavy things and put them back down. Using the right technique will keep you and others safe, and also allow you to see the best gains in your strength training. Here are some basic tips for proper form in common weightlifting practices: Your knees should not be over your toes during squats; avoid arching your

back when you bench press; pull a lat pull-down bar toward your chest rather than your lap; lower weights slowly onto the ground rather than drop them suddenly.

Isolating Muscle Exercises Isolating muscles is when you do weightlifting that focuses, or isolates one muscle. By focusing on one muscle group, you might not see the progress that you want. In order to reap the most benefits from weightlifting, you should incorporate exercises that target multiple areas of muscle rather than one, known as compound exercises. Try compound exercises such as the flat bench press and the standing military press.

Not Enough Rest Between Sets You would think that resting between sets would be detrimental to your workout, but studies say otherwise when it comes to lifting heavier weights. In fact, your body needs a resting time of at least three to four minutes to achieve the best results.

Any less, and it could negatively impact your ability to gain muscular strength.

Chang was the city’s first Chinese-American elected to the council in 1994. He served the city for six years.

Brink is a Sergeant in the Los Angeles County Sheriff’s Department, and Van Fleet is an insurance agent.

Verlato is perhaps best known for her work with Save the Arcadia Highlands, which recently settled a lawsuit with the city over two residential development projects.

The city is holding an all-mail-in-ballot election. Ballots must be postmarked by April 12 and received no later than Friday, April 15.

EDUCATION Dual Immersion Program at Alhambra Unified School District

BY MAY S. RUIZ There has been a sea change in the employment landscape in the past decade as evidenced by shifts in what is available to people looking for work. Some positions that today’s youth would one day fill might not even exist yet, or may be located in foreign countries.

The Alhambra Unified School District (AUSD) has been actively finding opportunities for its student population to be ready for 21st century job requirements. This fall, AUSD is rolling out its Dual Immersion Program to add to its slate of initiatives to make their students competitive in the global community.

Leading this charge is Jim Schofield, program director. He says, “Dual immersion is critical because future jobs could be in other parts of the globe. More and more, we do business with other countries, and knowledge of the local language is essential.

An employee who can speak, read, and write in the dialect is much more valuable to the company.”

According to Dr. Gary Gonzales, assistant superintendent for AUSD, the Dual

Immersion plan started two and a half years ago as a collective effort by his division.

He postulates, “We felt the AUSD is perfect for this initiative because of the diversity of our enrollment. Additionally, if we are to prepare students for participation in a global economy, bi- or tri-literacy is essential.”

In March of last year, Schofield, who at the time was the principal at San Gabriel High School, was tapped to head the initiative. He went through a transition period and in July was fully on board.

He and other AUSD administrators, instructional specialists, and teachers visited several schools with dual immersion programs to get ideas and to see for themselves how it is working.

Schofield remembers one particular school they went to in Venice and relates what they encountered. “We went there three months into the school year and the students were responding to their teacher in Mandarin.

It was amazing how quickly they absorbed a new language! This is why we decided to start Dual Immersion in transitional kindergarten, when it is developmentally

AUSD chose Spanish and Mandarin because their research showed that 26 percent of California’s population speaks Spanish, with two percent speaking Mandarin.

Says Schofield, “While two percent doesn’t sound like a huge number, it is the second most-spoken language after Spanish. And the reality of the state of the economy is that so much business goes to China.

It’s safe to say that the U.S and China have a codependent relationship.”

Schofield, describes AUSD’s model, “Each class will ideally comprise onethird English-speaking only students, one-third partner language learners, and onethird native speakers. The Spanish classes will be based on a 90:10 model – in kindergarten all the subjects will be taught in Spanish except for English Development, which is 10 percent of the students’ day. As students move on to first grade, 80 percent of their subjects will be in Spanish with 20 percent of reading and writing development, and so on as they progress each year until they reach 50:50 in fifth grade.”

Adds Schofield, “We are comfortable with having students learn using the 90:10 model because Spanish and English are both rooted in Latin and use Roman alphabet; there’s more transference with Spanish.”

The Mandarin model, will be 50:50 at the outset.

Schofield explains the rationale for this, “Mandarin is made up of characters which students have never seen or encountered. Students will have Chinese language development, math, science and culture taught in Mandarin; English language, math and

social science instruction in English.

“We have also determined to start educating in traditional Mandarin then switch to the simplified version. I presented our plan to district constituents, parents, and students who wholeheartedly embraced our thinking,” Schofield continues.

AUSD administrators are currently on the curriculumbuilding stage on their Dual Immersion initiative, deciding on instructional materials. Schofield says they will be holding site meetings with the initial group of parents

who have shown interest in the program. “They will have a lot of knowledge and input.

In March, we will have the first official parents meeting with those whose children have been accepted into the program.”

To ensure students receive a high-quality education, educators in the dual language program will receive the same training in state standards and strategies all AUSD teachers get.

The district will also hire only teachers who are authorized to educate on the specific language.

They are hoping there would be enough community demand for the program as the district is committed to see it go all the way through 12th grade.

“It will take 14 years to get there and by then I might be retired. But it would have been a great honor to be asked to lay the foundation for this program. If successful, AUSD students who have participated in it would be better equipped to enter in the competitive global community. And that would be a very satisfactory and gratifying outcome indeed,” Schofield concludes.

the muscles in my back were fighting each other and my left knee was complaining a little.

No one thing was horrendous but putting them all together along with a few human contacts I was going to have to make, I decided it was time to “take two� of the "take two aspirin and call back tomorrow" line.

I was out of aspirin. I went to the store to buy a bottle. There were three shelves of pain killers. I will not list the brand names because I do not want to be sued. Besides, my column space is limited.

I looked over the shelves for my favorite brand. Found it. Then I looked for the just plain old 325mg pain-relieftype. They were not there.

There was extra strength arthritis formula. There was long lasting analgesic something. There were separate formulas for sinus pain, muscle strain, night time pain, headache, menstrual, joint, and backache.

Alleged Murderer Continued from page 1

Kong Herald, the Chinese national arrested in Hong Kong for allegedly murdering two teenage brothers, William and Anthony Lin, in Arcadia agreed to be extradited Monday, Jan. 25, but claimed there were "problems" with the charges.

Shi was detained by police at the Hong Kong airport Saturday, Jan. 23, after landing on a flight from Los Angeles.

A police officer close to the case said the authorities acted very quickly to arrest him.

Following medical checks, Shi was formally arrested Sunday, Jan. 24.

He is accused of murdering his nephews aged 15 and 16 after his wife filed for divorce, according to the Los Angeles Times.

Shi had already attacked his wife who was the sister of the boys' father, the report said.

Shi, who had scratches on his face when he appeared in a Hong Kong district court Monday, Jan. 25, agreed to be extradited to the U.S. and said he wanted to return, "as soon as possible." It remains unclear when he will be returned to the U.S. to face prosecution.

Local media had reported he was heading to mainland China, which unlike Hong Kong does not have an extradition treaty with the U.S. Shi said he had not been fleeing but was transiting through Hong Kong to deal with business in the southern Chinese city of Shenzhen.

"The allegations against me include a lot of problems," Shi told the court through an interpreter.

"I would like to give a clear account to the U.S. government."

Judge Clement Lee remanded him in custody despite his application for bail.

The case was adjourned until Feb. 11, pending a full extradition request from the U.S. Hong Kong police's detective Senior Inspector Jonathan Close said that once the extradition had been fully approved, U.S. Marshals would come to the city within 30 days to collect Shi. Arcadia School issued the following statement after the news broke: “The Arcadia Unified School District family offers our deepest condolences to the Lin family, their friends, and loved ones. Their bodies were not discovered until Friday morning, Jan. 22, by their parents, who thought they were safe asleep in their beds.

Shi is also wanted for allegedly attacking his wife with an axe Thursday night, Jan. 21, in La Cañada Flintridge because she wanted a divorce.

According to deputies, the victims’ parents were visiting the suspect’s wife at a hospital the night the teenagers were killed.

Deputies say the boys’ mother discovered their bodies. They suffered blunt force trauma, according to a press release by the sheriff’s department.

Authorities found Shi’s car at Los Angeles International Airport.

The proposed Zone Change (Mixed Use) is consistent with the General Plan, as amended; and that public necessity, convenience, general welfare and good zoning practice justify the proposed changes.

FACT: The proposed Zone Change is consistent with the City’s General Plan, as amended, including the goals, objectives, policies, and action programs in the City’s General Plan, as amended. The Project location has been identified as a compatible continuation of the Mixed-Use area to the north, and will foster new development and revitalization of the adjacent commercial area.

The proposed Zone Change and Project will be a positive benefit to the surrounding properties and to the City at large. Therefore, the proposed Zone Change is consistent with the General Plan.

SECTION 3. (2013) 56 Cal. 4th 729, holding that cities have the authority to regulate or ban outright medical marijuana land uses; and WHEREAS, under the Federal Controlled Substances Act, codified in 21 U.S.C. Section 801 et seq., the use, possession, and cultivation of marijuana are unlawful and subject to federal prosecution without regard to a claimed medical need; and WHEREAS, on October 9, 2015, Governor Jerry Brown signed the “Medical Marijuana Regulation and Safety Act” (“Act”) into law; and WHEREAS, the Act becomes effective January 1, 2016 and contains provisions which allow for local governments to regulate licenses and certain activities thereunder; and WHEREAS, the Act contains a provision which sets forth that the State shall become the sole authority for regulation under certain parts of the Act, unless local governments have “land use regulations or ordinances regulating or prohibiting the cultivation of marijuana…” (Health and Safety Code §11362.777(c)(4); and WHEREAS, several California cities have reported negative impacts of marijuana cultivation, processing, and distribution uses, including offensive odors, illegal sales, and distribution of marijuana, trespassing, theft, violent robberies and robbery attempts, fire hazards, and problems associated with mold, fungus, and pests; and WHEREAS, marijuana plants, as they begin to flower and for a period of two months or more, produce a strong odor which is detectable far beyond property boundaries if grown outdoors; and WHEREAS, the strong smell of marijuana creates an attractive nuisance, alerting persons to the location of the valuable plants, and creating a risk of burglary, robbery, or armed robbery; and WHEREAS, the indoor cultivation of marijuana has potential adverse effects to the health and safety of the occupants, including structural damage to the building due to increased moisture and excessive mold growth which can occur and can pose a risk of fire and electrocution; additionally, the use of pesticides and fertilizers can lead to chemical contamination within the structure; and WHEREAS, the Attorney General’s August 2008 Guidelines for the Security and Non-Diversion of Marijuana Grown for Medical Use recognizes that the cultivation or other concentration of marijuana in any location or premises without adequate security increases the risk that nearby homes or businesses may be negatively impacted by nuisance activity such as loitering or crime; and WHEREAS, based on the experiences of other cities, these negative effects on the public health, safety, and welfare are likely to occur, and continue to occur, in the City due to the establishment and operation of marijuana cultivation, processing, and distribution uses; and WHEREAS, the Arcadia Municipal Code (“Code”) does not fully address the cultivation, processing, delivery and distribution of medical cannabis; and WHEREAS, based on the findings above, the potential establishment of cannabis dispensaries, cultivation, cannabis manufacturers and delivery of cannabis uses in the City without regulation poses a current and immediate threat to the public health, safety and welfare in the City due to the negative land use and other impacts of such uses as described above; and WHEREAS, the issuance or approval of business licenses, subdivisions, use permits, variances, building permits, or any other applicable entitlement for cannabis dispensaries, cultivation, cannabis manufacturers and delivery of cannabis will result in the aforementioned threat to public health, safety, or welfare.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 9220.45.1.3 of Part 2 of Chapter 2 of Article IX of the Arcadia Municipal Code is hereby amended in its entirety to read as follows: “9220.45.1.3. MEDICAL MARIJUANA USES. For purposes of this Code, the following definitions shall apply: A. “Cannabis” means all parts of the plant Cannabis sativa Linnaeus, Cannabis indica, or Cannabis ruderalis, whether growing or not; the seeds thereof; the resin, whether crude or purified, extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin. “Cannabis” also means the separated resin, whether crude or purified, obtained from marijuana. “Cannabis” also means marijuana as defined by Section 11018 of the Health and Safety Code as enacted by Chapter 1407 of the Statutes of 1972.

B. “Cannabis dispensary” means a facility where cannabis, cannabis products, or devices for the use of cannabis or cannabis products are offered, either individually or in any combination, for retail sale, including an establishment that delivers cannabis and cannabis products as part of a retail sale.

C. “Cannabis manufacturer” means a person that conducts the production, preparation, propagation, or compounding of manufactured cannabis, or cannabis products either directly or indirectly or by extraction methods, or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis

at a fixed location that packages or repackages medical cannabis or cannabis products or labels or relabels its container D. “Cultivation” means any activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of cannabis.

E. “Delivery” means the commercial transfer of cannabis or cannabis products, and includes origination or termination within the City as well as a delivery business.”

SECTION 2. Section 9213 of Part 1 of Chapter 2 of Article IX of the Arcadia Municipal Code is hereby amended in its entirety to read as follows: “9213. OMISSION OR AMBIGUITY; MEDICAL MARIJUANA USES PROHIBITED. A. If any "use" is for any reason omitted from the lists of those specified as permissible in each of the various zones herein designated, or if ambiguity arises concerning the appropriate classification of a particular use within the meaning and intent of this Chapter, or if ambiguity exists with reference to matters of height, yard requirements or area requirements as set forth herein and as they may pertain to unforeseen circumstances, it shall be the duty of the Planning Commission to ascertain all pertinent facts concerning said use and by resolution of record set forth its findings and the reasons therefor. Such findings and resolutions shall be referred to the City Council and, if approved by the Council, thereafter such interpretation shall govern.

B. Cannabis dispensaries, cultivation, cannabis manufacturers, and delivery of cannabis, as defined in Section 9220.45.1.3, shall be considered prohibited uses in all zoning districts of the City.

No use permit, variance, building permit, or any other entitlement or permit, whether administrative or discretionary, shall be approved or issued for the establishment or operation of dispensaries, cannabis cultivation, cannabis manufacturers, and delivery of cannabis as defined herein in any zoning district, and no person shall otherwise establish such businesses or operations in any zoning district.”

SECTION 3. CEQA. The City Council finds that this Ordinance is not subject to the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Sections 15060(c)(3) because this activity is not a project as defined by Section 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, and pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that it will not have a significant effect or physical change to the environment.

SECTION 4. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrases be declared unconstitutional.

SECTION 5. Effective Date. This Ordinance shall become effective upon the thirty-first (31st) day following its adoption by a majority vote of the City Council.

Monrovia City Notices ORDINANCE NO. 2015-15 AN ORDINANCE OF THE MONROVIA CITY COUNCIL AMENDING CHAPTERS 5.04 AND 5.96 OF TITLE 5 OF THE MONROVIA MUNICIPAL CODE TO PROHIBIT THE DELIVERY OF MARIJUANA AND MEDICAL MARIJUANA PRODUCTS AND MOBILE MARIJUANA DISPENSARIES IN THE CITY THE CITY COUNCIL OF THE CITY OF MONROVIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Recitals.

A. In 1996, the voters of the State of California approved Proposition 215 (codified as California Health and Safety Code § 11362.5, and entitled “The Compassionate Use Act of 1996” or “CUA” sometimes herein).

B. In 2004, the Legislature enacted Senate Bill 420 (codified as California Health and Safety Code § 11362.7, et seq., and sometimes referred to herein as the “Medical Marijuana Program” or “MMP”) to clarify the scope of Proposition 215 and to provide qualified patients and primary caregivers who collectively or cooperatively cultivate marijuana for medical purposes with a limited defense to certain specified State criminal statutes. Assembly Bill 2650 (2010) and Assembly Bill 1300 (2011) amended the Medical Marijuana Program to expressly recognize the authority of cities and counties to “[a]dopt local ordinances that regulate the location, operation, or establishment of a medical marijuana cooperative or collective” and to civilly and criminally enforce such ordinances.

C. In City of Riverside v. Inland Empire Patients Health and Wellness Center, Inc. (2013) 56 Cal.4th 729, the California Supreme Court held that “[n]othing in the CUA or the MMP expressly or impliedly limits the inherent authority of a local jurisdiction, by its own ordinances, to regulate the use of its land. . .”

D. On October 9, 2015 Governor Brown signed Assembly Bill No. 243, Assembly Bill No. 266, and Senate Bill 643 into law, which collectively are known as the Medical Marijuana Regulation and Safety Act (hereinafter “MMRSA”). The MMRSA establishes a State licensing scheme for commercial medical marijuana uses while protecting local control by requiring that all such businesses must have a local license or permit to operate in addition to a State license. The MMRSA also preserves local control and requires a local government that wishes to prevent marijuana delivery activity, as defined by Business & Professions Code section 19300.5(m) of the MMRSA, from operating within the local government’s boundaries, to enact an ordinance affirmatively banning such delivery activity (Business & Professions Code section 19340(a)).

E. While zoning provisions of the Monrovia Municipal Code prohibit all types of medical marijuana dispensaries in the City, the Municipal Code does not expressly prohibit the delivery of medical marijuana or mobile marijuana dispensaries. The number of medical marijuana delivery services operating in the State of California that would service the City is unknown because the State does not maintain a registry of mobile marijuana dispensaries or medical marijuana delivery services and their service areas. Successful enforcement of regulations against storefront medical marijuana dispensaries has been found to coincide with an increase in mobile marijuana dispensaries and marijuana deliveries.

F. Mobile marijuana dispensaries and marijuana deliveries have resulted in criminal activity, as delivery drivers are targets for armed robbery. As a result, drivers may choose to carry weapons to protect themselves. There have been a number of recent news reports of armed robberies of marijuana delivery services in California: On December 22, 2014, police in the City of San Bernardino reported that a customer robbed a mobile dispensary driver at gunpoint, which led to an hours-long standoff with police. On March 13, 2014, there was an armed robbery of a medical marijuana delivery vehicle that occurred in Long Beach that resulted in a physical fight between the medical marijuana employee and two suspects. In April 2015, a delivery driver for a medical marijuana dispensary was robbed at gunpoint in the Western Addition area of San Francisco.

On August 20, 2015, police in the City of Monterey reported that a man held a medical marijuana delivery driver at gunpoint and fled with marijuana and cash. On September 25, 2015, a medical marijuana delivery man was robbed of the marijuana, cash and his car in Altadena. Thus, the delivery of medical marijuana and the operation of mobile marijuana dispensaries both to and from the City could require the City to use its limited resources to monitor and prevent unintended negative consequences of those activities.

G. The delivery of medical marijuana to residences in the City also increases the risk that children and minors will gain unpermitted access to medical marijuana at the point of delivery.

H. Based on the foregoing, the City Council finds that in order to more fully protect the public health, safety and welfare, prohibiting

the businesses of mobile marijuana dispensaries and the delivery of medical marijuana in the City is proper and necessary to avoid the risks of criminal and unintended activity that may result from such activities. It is the intent of the City Council that this ordinance shall preserve local control and regulation over the businesses defined herein, and that these regulations shall take effect prior to March 1, 2016.

Section 2. The facts set forth in the Recitals of this Ordinance are true and correct.

Section 3. Section 5.04.030 (Definitions) of Chapter 5.04 of Title 5 (Business License Regulations) is hereby amended to add the following definitions: ““Delivery” shall have the same meaning as set forth in the MMRSA, as the same may be amended from time to time, and shall include the commercial transfer of medical marijuana or medical marijuana products from a dispensary, up to an amount determined by the bureau to a primary caregiver, qualified patient, or person with an identification card as defined in Section 11362.7 of the Health and Safety Code, or a testing laboratory. “Delivery” also includes the use by a dispensary of any technology platform owned and controlled by the dispensary, or independently licensed under the MMRSA, that enables qualified patients or primary caregivers to arrange for or facilitate the commercial transfer by a licensed dispensary of medical marijuana or medical marijuana products.

“Marijuana” shall have the same meaning as “cannabis” as set forth in the MMRSA, as the same may be amended from time to time, and shall include all parts of the plant cannabis sativa linnaeus, cannabis indica, or cannabis ruderalis, whether growing or not; the seeds thereof; the resin, whether crude or purified, extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin.

“Marijuana” also means the separated resin, whether crude or purified, obtained from marijuana. “Marijuana” also means marijuana as defined by Section 11018 of the Health and Safety Code as enacted

by Chapter 1407 of the Statutes of 1972. For the purpose of this Ordinance, “marijuana” does not mean “industrial hemp” as defined by Section 81000 of the Food and Agricultural Code or Section 11018.5 of the Health and Safety Code.

“Medical marijuana product” shall have the same meaning as “cannabis product” or “medical cannabis product” as set forth in the MMRSA, as the same may be amended from time to time, and shall include marijuana, as well as concentrates and extractions, intended to be sold for use by medical marijuana patients pursuant to the Compassionate Use Act of 1996 (Proposition 215).

“Medical Marijuana Store, Dispensary, or Coop” shall be broadly and liberally interpreted to mean any location, structure, facility, vehicle, store, coop, residence or similar facility used, in full or in part, as a place at or in which marijuana is sold, traded, exchanged, bartered for in any way, made available, located, stored, placed, or cultivated, including any of the foregoing is used in the delivery of marijuana.” NOTE: Replaces the existing definition of “Marijuana Store, Dispensary or Coop.”

“Mobile marijuana dispensary” shall mean the use of any vehicle or conveyance of any type that in any way involves or facilitates growing, cultivating, distributing, delivering, selling or making available to persons, with or without financial payment or consideration, marijuana or medical marijuana products, including marijuana for medical purposes as described in California Health and Safety Code Section 11362.5.”

Section 4. Section 5.96.020 of Chapter 5.96 of Title 5 (Business License Regulations) is hereby amended in its entirety to read as follows: “5.96.020 Permit Required; Business Prohibited.

No person shall engage in, conduct, or carry on the business of a medical marijuana store, dispensary or coop, a mobile marijuana dispensary, or delivery of marijuana or medical marijuana products anywhere in the City without obtaining a valid business permit pursuant to this Title. Medical marijuana stores, dispensaries or coops, and mobile medical marijuana dispensaries are prohibited in the City and unlawful. Any delivery of marijuana or medical marijuana products to or from the City is expressly prohibited and unlawful. In accordance with Section 5.04.160, no business permit shall be issued for any such business.”

Section 5. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption of this Ordinance, and the prohibitions established hereby, may have a significant effect on the environment, because the Ordinance will only impose greater limitations on activities in the City, and will thereby serve to eliminate potentially significant adverse environmental impacts. It is therefore not subject to the California Environmental Quality Act review pursuant to Title 14, Chapter 3, Section 15061(b) (3) of the California Code of Regulations. A Notice of Exemption will be prepared.

Section 6. If any sentence, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining provisions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each sentence, clause or phrase thereof irrespective of the fact that any one or more sentence, clauses or phrases be declared unconstitutional or otherwise invalid.

Section 7. Neither the adoption of this Ordinance nor the repeal or amendment by this Ordinance of any ordinance or part or portion of any ordinance previously in effect in the City, or within the territory comprising the City, shall in any manner affect the prosecution for the violation of any ordinance, which violation was committed prior to the effective date of this Ordinance, nor be construed as a waiver of any license, fee or penalty or the penal provisions applicable to any violation of such ordinances. This Ordinance is declarative of existing law.

Section 8. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause this Ordinance to be published within 15 days after its passage, in accordance with Section 36933 of the Government Code.

On Wednesday, Jan. 20, the La Salle Lancers hosted St. Anthony in a Camino Real League matchup. The Saints from St. Anthony proved too much for La Salle to handle, as they pulled out the hard fought victory, maintaining their undefeated record in league play, 4-0 (14-6 overall). La Salle is now second place in the league standings with a record of 3-1 (13-6 overall).

Last Friday, Jan. 22, the Arcadia High School girls’ varsity soccer team fell to the Crescenta Valley Falcons in a close loss. Tied up at the end of the first half 1-1, the Falcons found the back of the net again in the second half to secure a 2-1 victory. Despite the narrow defeat, the Apaches maintain a fantastic league record of 7-1 (10-3 overall).

Arcadia High Runner Receives Most Prestigious Award in High School Sports

BY JONATHAN TSOU Hundreds of thousands of high school cross country athletes attempt to become the fastest runner in the country. Phillip Rocha, an Arcadia High School senior, has just done it.

Last week, Gatorade announced their 31st year Gatorade Runner of the Year. Phillip was given the award for the state of California and joins the ranks of past Gatorade State Players of the Year, including Alan Webb and Meb Keflezighi.

Phillip becomes only the third Cross Country runner from Arcadia High School to receive the honor.

The award is administered by the Gatorade high school sports leadership team, which include top sport-specific experts and a media advisory board of accomplished prep sports journalist. Phillip was selected based on his outstanding athletic achievement, his high standards of academic achievement, and his exemplary character on and off the course.

come as a surprise. Recently, Phillip Rocha claimed his second consecutive CIF State Division I Cross Country Championships while he set a new Division I Boys’ course record.

Phillip Rocha has also broken numerous track records; including the Stanford Invitational, the Clovis Invitational, and the Mt. Sac Invitational. Phillip placed second at the Foot Locker Cross Country Championships and second at the Foot Locker West Regional Championships. Not only that, Phillip represented the United States at the Youth World Cross Country Championships.

Off the track, Phillip has been a member of the Fellowship of Christian Athletes and also volunteered around Arcadia on the behalf of many youths running programs.

Michael Feraco-Eberle, Rocha’s Cross Country Coach, said, “Phillip is an athletic prodigy, and he pairs that prodigious talent with a ferocious will to improve.” Feraco-Eberle also noted that Phillip has taken time to work with younger athletes, and his willingness to share knowledge has become one of the greatest gifts to the team and the school.

Runner Amanda Lam said that, “[Phillip] is always funny and trying to make others laugh.” She also emphasized, “He is not someone

to gloat about how fast he is, and is humble about his achievements.”

Although Rocha remains undecided upon a

collegiate destination, he has received numerous scholarships from top colleges around the United States.
