Triple Crown champion American Pharoah arrived back at his barn at Santa Anita last Thursday from Churchill Downs. Arriving First Class on ‘Air Horse One,’ the Triple Crown winner seemed relaxed albeit a bit tired from his travels.

The three-year-old colt, owned and bred by Ahmed Zayat and trained by Bob Baffert, landed at Ontario International Airport from Louisville Thursday morning, around 9:45 a.m. He was transported with a six-unit law enforcement code 3 escort to Santa Anita.

Black License Plates Are Back Now Processing Iconic Plates Reissued by the Legacy License Plate Program

In 2012, when Assemblyman Mike Gatto (D-Glendale) introduced AB 1658 to create the California Legacy License Plate Program, he wanted to do something nice for those who preserve California’s classic-car heritage. Such enthusiasts often view Sacramento as the source of pesky regulations. But even peskier is the fact that after completing a full restoration of that classic Mustang, a car owner had to affix a seven-digit, bright-white, out-of-period license plate on it. Today, the DMV announced that production

of California’s historic black plates has finally begun, and those who ordered them via the Legacy License Plate Program will begin receiving them within the next two to three weeks. Gatto’s AB 1658,

Adam Schiff (D-Burbank) announced that the Appropriations Committee has once again included $5 million in funding in the Fiscal Year 2016 Interior and Environment Appropriations bill for a west coast earthquake early warning system. Last year, for the first time, Congress appropriated $5 million specifically for the system. This continued funding during a time of severe budget constraints demonstrates the importance of the system and Congress’s commitment to seeing the system fully built out. Earlier this year, Schiff

led a group of 35 Members of Congress – primarily from California, Washington, and Oregon – to request that the committee fund an earthquake early warning system for the West Coast. A limited system developed by Caltech, UC-Berkeley, and the University of Washington, in conjunction with the United States Geological Survey (USGS), has already been deployed and has proven that the early warning technology is sound. It will cost an estimated $38.2 million to build out a full system for the west coast, with annual operating and maintenance

Woman Murdered Boyfriend With Canned Foods

On June 18, a woman was charged with killing her 59-year-old boyfriend by striking him in the head with cans of food, the Los Angeles County District Attorney’s Office announced. Deputy District Attorney Jon Hatami said Linda Clarene Jackson (DOB 1/7/56) of Lake Los Angeles faces one count of murder in case MA066297. The felony complaint alleges Jackson used canned food as a deadly and dangerous weapon and that she was convicted in 2005 for making criminal threats in case BA284464. Arraignment was scheduled the afternoon of June 18 in Department A1 of the Los Angeles County Superior Court, Antelope Valley Branch. On June 16, Jackson allegedly killed David Ruiz while he was at her house by bludgeoning him in the head with the canned foods, the prosecutor said. Hatami will recommend more than $1 million bail for the defendant. If convicted as charged, Jackson faces life in state prison. The case remains under investigation by the Los Angeles County Sheriff’s Department.

This is a $12.6 million increase over the FY2016 request-

National Medicare Fraud Takedown Results in Charges Against 243 Individuals Approximately $712 Million Stolen in False Billing the Legacy License Plate Program Attorney General Loretta E. Lynch and Department of Health and Human Services (HHS) Secretary Sylvia Mathews Burwell announced a nationwide sweep led by the Medicare Fraud Strike Force in 17 districts, resulting in charges against 243 individuals, including 46 doctors, nurses and other licensed medical professionals, for their alleged participation in Medicare fraud schemes involving approximately $712 million in false billings. In addition, the Centers for Medicare & Medicaid Services (CMS) also suspended a number of providers using its suspension authority as provided in the Affordable Care Act. This coordinated takedown is the largest in Strike Force history, both in terms of the number of defendants charged and loss amount. The defendants are charged with various health care fraud-related crimes, including conspiracy to commit health care fraud, violations of the anti-kickback statutes, money laundering and aggravated identity theft. The charges are based on a variety of alleged fraud schemes involving various medical treatments and services, including home health care, psychotherapy, physical and occupational therapy, durable medical equipment (DME) and pharmacy fraud. More than 44 of the defendants arrested are charged with fraud related to the Medicare prescription drug benefit program known as Part D, which is the fastest-growing component of the Medicare program overall. “This action represents

the largest criminal health care fraud takedown in the history of the Department of Justice, and it adds to an already remarkable record of enforcement,” said Attorney General Lynch. “The defendants charged include doctors, patient recruiters, home health care providers, pharmacy owners, and others. They billed for equipment that wasn’t provided, for care that wasn’t needed, and for services that weren’t rendered. In the days ahead, the Department of Justice will continue our focus on preventing wrongdoing and prosecuting those whose criminal activity drives up medical costs and jeopardizes a system that our citizens trust with their lives. We are prepared – and I am personally determined – to continue working with our federal, state, and local partners to bring about the vital progress that all Americans deserve.” According to court documents, the defendants participated in alleged schemes to submit claims to Medicare and Medicaid for treatments that were medically unnecessary and often never provided. In many cases, patient recruiters, Medicare beneficiaries, and other coconspirators allegedly were paid cash kickbacks in return for supplying beneficiary information to providers, so that the providers could then submit fraudulent bills to Medicare for services that were medically unnecessary or never performed. Collectively, the doctors, nurses, licensed medical professionals, health care company owners and others charged are accused of conspiring to submit a

total of approximately $712 million in fraudulent billing. “The people charged in this case targeted the system each of us depends on in our most vulnerable moments,” said FBI Director James Comey. “Health care fraud is a crime that hurts all of us and each dollar taken from programs that help the sick and the suffering is one dollar too many.” “Health care fraud drives up health care costs, wastes taxpayer money, undermines the Medicare and Medicaid programs, and endangers program beneficiaries,” said HHS-OIG Inspector General Levinson. “Today’s takedown includes perpetrators of prescription drug fraud, home health care fraud, and personal care services fraud, three particularly harmful types of fraud plaguing our health care system. This record-setting takedown sends a message to would-be perpetrators that health care fraud is a risky way to line your pockets. Our agents and our law enforcement partners stand ready to protect these vital programs and ensure

that those who would steal from federal health care programs ultimately pay for their crimes.” The Medicare Fraud Strike Force operations are part of the Health Care Fraud Prevention & Enforcement Action Team (HEAT), a joint initiative announced in May 2009 between the Department of Justice and HHS to focus their efforts to prevent and deter fraud and enforce current anti-fraud laws around the country. Since their inception in March 2007, Strike Force operations in nine locations have charged over 2,300 defendants who collectively have falsely billed the Medicare program for over $7 billion. Including these enforcement actions, nearly 900 individuals have been charged in national takedown operations, which have involved more than $2.5 billion in fraudulent billings. This announcement marks the first time that districts outside of Strike Force locations participated in a national takedown, and they accounted for 82 defendants charged in this takedown.

A new California Appellate case just published August 8, 2013, “Glaski v. Bank of America”, holds that a homeowner can challenge his lender’s right to foreclose by showing that the Deed of Trust never made it into the securitized trust until after the trust’s closing date. Assemblymember Chris Holden (D-Pasadena) released the following statement on today’s passage of a final budget for the 2015-16 year. It now goes to Governor Brown for signature before going into effect July 1. “Making the first meaningful steps to reinvest in California since the recession, the Legislature today gave final approval to the 2015-16 budget bills. Thanks to the state’s growing economy our education system was a primary beneficiary. This budget invests $14 billion more than last year in California’s K-12 and community college systems. Throughout the recession, skyrocketing costs and

increasing out-of-state enrollment made attending a UC or CSU almost unattainable. Recognizing that a robust and accessible higher education system is critical for the growth of our state, this budget expands Competitive Cal Grants by 15% and lowers in-state tuition for middle class families by 20%. Jobs and the economy are two of our highest priorities. One of the reasons I am proud to support this budget is because it represents an effort to uplift the working poor and children of the working poor. It doesn’t raise taxes or complicate our business climate. Rather, we accomplished this through the

earned-income tax credit and the local control funding formula. California is mired in the worst drought in recent history. Recognizing the need for immediate action, the budget allocates the first round of the Water Bond, spending $2.38 billion on groundwater resources, desalination technology and projects to preserve our water supplies. And, as part of the state’s commitment to a sustainable environment, this budget provides millions in new funding to hire 42 new well inspectors to ensure that any drilling activity in California is conducted in a safe and responsible manner.”

Former Business Manager at O.C. Private School Sentenced to 41 Months For Embezzling $2 Million

A Trabuco Canyon man who admitted embezzling more than $2 million while managing a private elementary school was sentenced recently to three years and five months in federal prison, announced Stephanie Yonekura, the Acting United States Attorney for the Central District of California, and Bill L. Lewis, the Assistant Director in Charge of the FBI’s Los Angeles Field Office. The Honorable Dean D. Pregerson sentenced Ricardo Nieva, 50, to 41 months in federal prison. Judge Pregerson also ordered Nieva to pay restitution in the amount of. $2,093,667.84. Nieva pleaded guilty to two counts of wire fraud in connection with the embezzlement scheme in 2014. According to court documents, Nieva was the business manager at The Pegasus School, in Hun-

tington Beach from 1995 until September 2013. While Nieva held that position, he was authorized to sign checks drawn on the school’s bank accounts to conduct the school’s business. Nieva was not authorized to withdraw money for business unrelated to the school. Beginning in late 2006, and continuing until around May 2013, Nieva knowingly defrauded the Pegasus School by signing checks payable to himself and cashing those checks drawn on the school’s bank accounts without authorization. Nieva cashed 256 checks that were deposited into his personal account via wire transfers from the school’s bank account. The total loss to the school was more than $2 million. In order to avoid detection, Nieva altered bank statements and checks. He also prepared bogus sum-

maries, ledgers and monthly financial reports, according to his plea agreement. He used these falsified documents to conceal his unauthorized withdrawals from the school’s Board of Trustees and finance committee, as well as a third party company that performed the school’s monthly bank reconciliations. According to the plea agreement, defendant Nieva used the unauthorized proceeds from these checks to pay for personal expenses and luxury items, including vacations, private school tuition for his children, donations to private sports programs, a time share, a golf membership and season tickets to the Anaheim Angels. This investigation was conducted by the Federal Bureau of Investigation. The case was prosecuted by the United States Attorney’s Office.

The portrait of John Lennon. An animated pink pig. The classic book cover of The Catcher in the Rye. A White Walker from Game of Thrones riding a dead horse. And a replica of the Italian painting Il bacio (The Kiss). These are just some of the 210 murals at the 23rd Annual Pasadena Chalk Festival held at the Paseo Colorado on June 20 and 21. More than 600 artists drew murals on concrete areas in and around the shopping mall. A free event on Father’s Day weekend, this annual festival always attracts many families. Participating artists voted for outstanding artwork by their peers at the festival’s end. Different award categories included Best of Festival, Most Humorous, Most Inspirational, and Best New Artist, a new award this year. Visitors picked the “Paseo Colorado People’s Choice” award. Light Bringer Project president Tom Coston said the festival idea originated in 1993 when Nancy Siegmund, an intern for Light Bringer Project, saw chalk painting in Paris. It debuted that same year at Pasadena City Hall, and about 100 artists came. From then on, it only grew. In 2010, Guinness World Records declared it as the largest street painting festival. An exhibition at the Pasadena Museum of History will highlight the festival’s history for its 25th anniversary. Artists have grown in their skills and abilities in street painting. According to Coston, artists are usually nervous their first time because they have not done street painting before. “They become adequate to good to great,” Coston noted. “Now they are stars. It’s amazing to watch their growth.” Artist Philip Ferdinand, 34, of Pasadena, said every time he comes back to the festival, he has gotten better and better. This year, he drew Marilyn Monroe. previous festival murals include Pinocchio and Rosetta from Tinker Bell. His fifth year at the festival, Ferdinand commented of the festival’s benefits. It gives him the opportunity to meet other artists, be part of the artists’ community, and advertise his work. “They feel like parts of me,” he noted about his peers. “They are theirselves playing out other parts of myself in their own articulate way, like a grape vine. We’re all fruits of the vine. I like to watch other people’s skill and other people’s technique because they are just another fruit of the vine that I haven’t reached the point of potential or approach that they have yet. They’re so rich on their skill it humbles you.” Lauren Mora, 21, of La Puente, created a peace sign with the word “Imagine” above it. Her sixth time at the event, Mora explained that the festival reinforces the idea that art is an outlet for fun and self-expression for the artist. She mentioned the sad fact that the art will be washed away eventually, despite the numerous hours of labor put into it. “At least hundreds of people get to see it, so it’s not a complete loss,” Mora noted. Leonides Aguirre, 35, of South Pasadena, was a rookie artist to the festival. On Saturday, Aguirre so far had drawn Darth Vadar holding a Lego book. He planned to later add a table and a Lego box with

actual Legos on it, so it looks like Darth Vadar is building a Death Star. “The experience and also learning how to push myself a little bit further, [and] try different things,” Aguirre commented about lessons he wanted to take from the festival. “[Also to] see other people’s artwork and see techniques that they use.” Barbara Masters of Pasadena explained that she comes back to the festival every year because she is attracted to the artists’ creativity and the variety of chalk art from year to year. Vivian Han, 29, of China, said watching the beginning stages of drawing allows her to learn the artists’ processes in completing the picture. Besides watching artists work, visitors had the chance to auction for small painted canvases created by the participating festival artists. Proceeds from the festival benefited arts and learning programs of the Light Bringer Project, a Pasadena-based nonprofit arts organization who organized the festival. Some of those programs include Room 13, an international network of student-driven creative art studios with locations in Los Angeles and Pasadena, and LA Futures Academy, a program that engages lowincome high school students with professional real world experiences in the advertising, marketing and communication realms.
