News From the Front Seat This issue of Signals arrives as we enter the fall season and final quarter of 2021.

We continue to face COVID-19 obstacles as our industry struggles with unprecedented supply-chain and inventory challenges. Despite these issues, we remain thankful that BC’s new car dealers are able to remain open, ensuring that British Columbians are able to repair or replace their vehicles when needed.

This unrelenting pandemic has been challenging for everyone, including our government leaders. The NCDA acknowledges the strong leadership and efforts of our provincial and federal governments.

We thank them for their efforts to keep us safe as BC’s new car dealers work to keep people and our economy moving.

As the fight against COVID-19 continues, we salute all health care workers as well as the Canadian Armed Forces and the Canadian Red Cross for sending resources to those in the areas hardest hit by this crisis.

Engaging with government Throughout the pandemic we’ve been privileged to join the BC Government’s COVID-19 Engagement Table with Dr. Bonnie Henry, our outstanding provincial health officer, along with leading BC businesses. These consultations are important to help business associations understand the rationale behind decisions, and to share information with our members as health or-

ders and policies evolve. The NCDA remains committed to providing updated information to our members so they can continue to protect their employees and customers while providing their essential services.

I was also privileged to meet w ​ ith Brenda Bailey, MLA for Vancouver-False Creek and the Parliamentary Secretary for Technology and Innovation. Brenda co-founded Canada’s first women-owned and operated video game studio in 2011.

She most recently served as the executive director of DigiBC, the Interactive and Digital Media Industry Association of BC, where she worked to strengthen the province’s growing creative tech industry, and continued her commitment to bolster diversity and inclusion in the sector.

Brenda is also fond of beautiful classic cars, including her late father’s ‘66 Mustang GTO convertible. I met Brenda for a spin in her car and a wide-ranging conversation.

In late September, we provided testimony to the BC Legislature’s Select Standing Committee on Finance and Government Services as consultations occurred around the provincial government’s 2022 budget.

We reminded the committee of the significant economic and community benefits provided by BC’s new car dealers in the over 55 communities in which they do business.

to keep taxes and regulation to a minimum, and specifically, to review the luxury tax and super taxes. The luxury tax threshold, set at $55,000, ignores inflation and the fact that vehicles today come with greater technology, improved materials and more safety features.

We believe there is something wrong when you can buy a $1-million RV and not pay luxury tax, yet buy a $68,000 pickup truck for work and family, and pay a luxury tax.

Further, we suggested to the committee that additional investments are needed to provide point-of-sale rebates for the purchase of qualifying electric vehicles (EVs) and home and work charging stations.

Incentives or grants to help businesses invest in charging infrastructure is necessary, along with investments by government to install charging stations across BC where people live, work and play.

Like many industries, finding entry-level staff across dealership departments has been challenging, especially during the COVID-19 pandemic. Investments by government to help businesses source the necessary talent, including skilled repair technicians, is sorely needed. Educational investments to prepare British Columbians for rewarding careers in the industry would also be worthwhile.

New industry collaboration We’re delighted to see government and WorkBC respond to our advocacy on the need for our members to find skilled workers. The NCDA will be the first industry association in BC to partner with WorkBC

centres, where member job postings will be provided to WorkBC career counsellors, who offer guidance to candidates on employment. This pilot program will heighten the profile of jobs at BC’s new car dealers.

Other industry news BC Hydro has announced its five-year plan, which includes investments to support the growing adoption of EVs in the province. We will keep member dealers up to date as details become clearer.

Through the summer and into the fall, the provincial government continued its consultation on several topics, from skilled trades certification and paid sick leave to extended producer responsibility (EPR) on electric vehicle batteries.

Federal government advocacy Our national association, CADA, continues to provide leadership around the luxury tax on vehicles proposed by the Liberals.

With BC dealers and their employees feeling the effects of luxury taxes, adding more tax is of grave concern.

As outlined in a recent CADA letter to the federal government, following the implementation of luxury supertaxes in BC, the negative impact included: • The BC luxury tax was highlighted as a key factor in the overall national downturn of luxury sales in a 2019 Scotiabank report; • Forty-three per cent of member dealers in BC reported lower staffing due to the tax. These job losses were not among

the perceived “elite” being targeted by the tax, but by mechanics, technicians, lot attendants and salespeople; and • Luxury car dealers in BC have reported a reduction in PST and GST submissions to the provincial and federal government respectively.

In addition, luxury dealers in BC have reduced investment in eqwuipment and training as they are uncertain of the profitability of their businesses under the current taxation regime.

New CADA chair As we go to press, we’d like to share the breaking news and congratulate Peter Heppner, past NCDA chair and auto show committee chair, on becoming the new national CADA chair. Peter’s leadership as the NCDA dealt with the impacts of COVID-19—including the loss of two auto shows—positions him well to take on the CADA chair role. Peter’s passionate commitment to the dealers of BC and Canada, his love of this business, attention to detail and willingness to take on difficult situations will be a tremendous asset to the national association!

Connections, links and community programs Industry news from around the province Building Stronger Communities Through Driver Training According to Lucy Sager, the Terrace-based founder of the successful All Nations Driving Academy, building stronger communities in northern BC starts with ensuring that youth have the training they need.

Drawing on her background working with large regional employers, Sager spotted a need for teaching driving skills in northern communities. Her All Nations Driving Academy was established to address what she saw as the top barrier to greater employment among Indigenous youth: the lack of a driver’s license. Her efforts to train new young drivers have attracted significant support from government and industry leaders, including from members of the NCDA which employs Indigenous people across the north, where a driver’s license is often required.

Sager’s work has now extended to other community-building efforts like the Shift Leadership Program, which has been set up to “acknowledge and celebrate youth” in northern communities. The successful work of the All Nations Driving Academy has evolved into a broader community-building effort by establishing “community-owned driving academies.” For more information or to learn how you can help, go to driveallnations.ca.

Celebrating Connections: 20th Anniversary of the Completion of the Island Highway The 20-year anniversary of the completion of the Island Highway was celebrated in early September—a milestone many decades in the making. The Island Highway is the name people attach to the whole stretch of Highway 19 from Port Hardy on the north end of Vancouver Island to Victoria in the south.

The construction of a four-lane divided expressway inland from the old route 19 has reduced traffic accidents and led to significant economic development all along its length. It is easy to forget how slow and treacherous the route was from Campbell River to Nanaimo prior to the completion of the inland expressway in 2001, but as Alistair Taylor (writing for the Vancouver Island Free Daily) not-

ed, “The celebration [in 2001] marked the culmination of a 36-year effort to build a new highway from Nanaimo to Campbell River.”

New Link Envisioned: New Eight-Lane Tunnel Announced for the Lower Mainland Another major infrastructure project planned for the Lower Mainland got a boost from the Ministry of Transportation and Infrastructure late this summer. Preliminary plans were revealed for the new George Massey Tunnel replacement on Highway 99 under the Fraser River.

An eight-lane, toll-free expressway is being planned for completion by 2030 at a cost of $4.15 billion. “A new crossing to replace the George Massey Tunnel will improve traffic flow and make travel by transit, walking and cycling more convenient and attractive, without costing commuters hundreds of dollars a year in unfair tolls,” said Rob Fleming, Minister of Transportation and Infrastructure.

Congratulations to Ajay Dilawri of Dilawri Auto Group on Appointment to the Order of BC Ajay Dilawri earned a prestigious honour recently when he was appointed to the Order of BC along with 15 other exceptional British Columbians. The Role of Education in the VSA’s Regulatory Philosophy

BY JIM NICHOLSON, INTERIM PRESIDENT AND CEO, VEHICLE SALES AUTHORITY OF BRITISH COLUMBIA The purpose of the VSA is to “build public confidence in the motor dealer industry in BC by engaging and educating industry and consumers, and ensuring a safe and reliable motor vehicle buying experience.”

Embedded within this purpose is the intention to reduce or mitigate potential risks associated with motor vehicle transactions in BC. Due to the nature of the VSA’s role as a regulator, it has sometimes in the past been seen as ”policing” the regulatory policy, with a focus on punishment. However, a different and more optimistic story is hidden in the numbers.

Let’s dive in.

The VSA believes that prevention is always better than remediation. To that end, the VSA focuses heavily on taking proactive steps to ensure a compliant motor vehicle sales marketplace in BC. Being proactive helps to prevent incidents from occurring and negatively impacting the marketplace.

New Member Program

To illustrate this, consider that during our current fiscal period (five months ending August 2021), the VSA has received 1,493 (total) or 300 calls per month from consumers looking for information or expressing concern over a recent transaction. Of those calls for support, only two per cent have made their way to a formal hearing. There are various reasons why 98 per cent of these situations are resolved; however, the most prominent way is through education. The most significant component of our regulatory philosophy is a focus on education, which runs throughout the VSA’s regulatory efforts.

Each interaction with a stakeholder is an opportunity to improve how these transactions take place.

Of the 300 calls per month from consumers, only 19 per cent become active case files. This low percentage means that the consumer was happy with the information they received, chose to interact directly with the dealer because of that information, or chose not to file a formal complaint. Some 73.5 per cent of these formal complaints were assigned for investigation this year. Of these, 76 per cent have been closed without enforcement

action, and 96 per cent fall into either education or a verbal warning, supporting our goal of education over punishment.

Recently, we have been able to engage more with dealers and salespeople in their premises. One of the positive benefits of this is something we call a “liaison visit.”

These provide an open and collaborative environment for all to better understand the enforcement requirements of the Motor Dealer Act in an informal environment.

The Industry Standards & Inspection Team has focused on these visits throughout August and September, promoting and sharing best practices. To date, over 170 of these visits have been completed. We are receiving positive feedback from dealers, who are pleased with this proactive approach.

The VSA and the automotive industry in BC have made many positive strides towards improving the industry for everyone. Many of these gains have been made in some of the most challenging times in recent memory. We believe this happens when the goal is education and a collaborative working environment with industry places the consumer at the centre of every discussion.

WorkBC and NCDA Collaborating to Highlight Job Opportunities with BC’s New Car Dealers

Labour market shortages are not new in BC, and members of the New Car Dealers Association of BC (NCDA) are no exception to experiencing these hiring challenges.

Although labour challenges have been felt over the past few years, the NCDA has received extensive feedback from members about the labour challenges they have faced in the last few months. Thousands of positions need to be filled around the province and finding qualified local talent is one of the top priorities for our members.

NCDA has engaged with various provincial government agencies to try and find solutions for these workforce challenges, and we are pleased to announce a collaboration with WorkBC. “NCDA has been working with WorkBC to develop a streamlined way to promote automotive industry job opportunities through WorkBC Employment Services Centres in an effort to find qualified talent,” said Blair Qualey, NCDA president and CEO. WorkBC is the largest employment-services network in BC with 102 locations throughout the province. WorkBC Centres serve the

needs of both job seekers and employers at a local level.

WorkBC Centres help employers: find qualified job seekers with a diverse range of skills and experience; expand recruitment efforts with local assistance and provincial connections; learn about available wage subsidies; participate in virtual recruitment activities and job fairs; and, access devices and technology for people with disabilities.

To support members with their hiring solutions, NCDA has created a template to gather important details about member job openings in a quick and effective way. This information will be shared with local WorkBC Centres.

Some Cool Cars Coming Soon and a Q3 update PRESENTED BY COX AUTOMOTIVE CANADA

While the direct effects of the COVID-19 pandemic may still be impacting sales in some parts of the country, the biggest issues are on the supply side, not the demand side. According to Canadian Auto Dealer, both production and inventories have been dramatically depleted throughout the industry, primarily due to a global microchip shortage, along with delivery issues for other key supplies.

The net result was 439,166 new vehicle sales in Canada in Q3 2021—a decline of 12.3 per cent from the same period in 2020 and 15.9 per cent from 2019. The third quarter of 2021 was dominated by the impacts of the semiconductor shortage.

Passenger car sales declined 11.3 per cent, which is not an unusual figure given the well-established trend of falling passenger car sales.

But there’s still lots of buzz around “what’s new” and here are some of the cool-cat vehicles coming our way:

Trucks Chevrolet Silverado ZR2 A first for Chevrolet is a brand-new, off-road trim for the Silverado ZR2. Powered by a 6.2L V8 (420 horsepower), the vehicle highlights the first application on Silverado of GM’s Multimatic dampers.

This allows the truck to absorb off-road driving with ease, and provides a comfortable ride for passengers, even when leaving a trailhead, for example. The ZR2 is focused on increasing off-road performance and capability, and includes a unique skid plate package. The ZR2 off-road performance package will also be applied to the 2022 Chevrolet Tahoe SUV.

Toyota Tundra Toyota has reimagined and re-engineered a completely new third generation Tundra for the first time in over a decade. The pickup breaks new ground with a hybrid engine option for several models, all of them using a new twin-turbo V6. This marks the end to the Tundra’s V8 engine era that heralds back to the year 2000, when the 4.7L was the first-ever V8 for a Toyota pickup.

Off the Beaten Path For overlanders, it’s all about the trim

BY BRUCE CAMERON, BLACK PRESS COLUMNIST While much has been written about the accelerating market share of electric vehicles, and the consistently steady growth in truck sales year over year, another important trend has gone largely unnoticed—the huge increase in what is now being called overlanding.

The overlanding trend started at least a century ago in remote places like Australia and Africa, where roads and services were scarce. According to most online definitions, overlanding “is self-reliant overland travel to remote destinations where the journey is the principal goal.” Today, the term has evolved to mean “the practice of exploring the backcountry in a purpose-built vehicle— generally, a high-clearance four-wheel drive—that is equipped to allow its occupants to remain self-sufficient for periods of time ranging from a few days to several weeks,” according to the Specialty Equipment Market Association in the US (SEMA).

Big bucks on after-market accessories Until recently, here in BC overlanding might have been called “off-roading” or “four-wheeling it.” Regardless of what you call it, there is no denying the massive dollars being spent by “overlanders” on after-market accessories for their vehicles. Everything from suspension lifts for greater road clearance to more durable tires, skid plates, LED light bars, roof racks and vehicle-linked camping accessories are being added to new vehicles.

The amount of money being spent on after-market customization for overlanding is tantalizing.

According to SEMA, “The global adventure tourism market— which includes camping, hiking, mountain biking, kayaking, rafting and other pursuits that are closely associated with overlanding—enjoyed a boom in the last decade and is forecast to grow in value from $586 billion in 2019 to $1.63 trillion in 2026.”

This forecast was made before COVID-19 hit, and the pandemic has only fuelled even greater spending on outdoor and overland pursuits.

Enhanced-features packages The huge growth in after-market auto parts (prompted by people decking out new SUVs and building off-road capable vehicles) has prompted many OEMs to offer enhanced-features packages with suitably rugged names like Wilderness, Timberline, Trail Boss, TrailSport and Badlands. And the list of manufacturers offering packages to appeal to overlanders is growing.

Honda is introducing a 2022 Passport (and soon Ridgeline) with a TrailSport trim package, the first of what Honda says is a new line of vehicles with enhanced off-road capabilities.

Toyota’s family of off-road vehicles (from the 4Runner to the Tacoma, Tundra and Sequoia) has featured prominently in after-market customizations over the years, but the 2022 Tacoma TRD Pro is being offered for “off-road junkies” seeking “earth-defying capabilities where roads don’t exist.”

Subaru is rolling out its Outback 2020 with a Wilderness trim package that provides “refined ruggedness,” according to Autoblog. The Subaru Ascent is being touted as allowing “camping without the luxury of a tent,” offering almost seven feet of sleeping room with all the seats down.

General Motors is also heavily invested in overlanding, with the Trail Boss package offered on the 2022 Chevy Colorado. According to Car and Driver, GM’s full-blown ZR2 off-road model is being offered on the full-size Chevy Silverado to compete with Ford and Ram off-road models. Other models like the Tahoe and Suburban will also be available with off-road Z71 trim packages.

The Ford Bronco Sport, introduced in 2021 with its Badlands trim package, was an earlier entrant into the overland sweepstakes, but Ford is also beefing up the rest of the line with the Ford Expedition offering a Timberline trim package. And the market-leading F-150 will have several upgraded packages that provide more power and durability, including the Tremor, Raptor and Raptor R, which will feature a 700-hp V8 engine to compete with the Ram 1500 TRX. Dodge Ram claims top spot for “extreme performance pickup trucks” with its Ram 1500 TRX. With a 6.2-litre V8 engine providing over 700 hp, the TRX is clearly the most powerful overlander. It’s fitting that when a Motor Trend team made the first-ever crosscontinent trip this summer in an all-electric Rivian R1T (a promising off-road electric truck), they were accompanied by the present king of the off-road, the Ram 1500 TRX. Not to be overlooked, Nissan has courted the overland crowd for years, even producing a crowd-sourced, purpose-built overland vehicle, the Armada Mountain Patrol, for the Overland Expo event in 2018.

The new 2022 Frontier PRO-4X is designed for people “who take offroad seriously,” and who want to “go deeper into the backcountry.”

Nostalgia meets futuristic aspirations Jeep is positioning itself among overland enthusiasts with a combination of rugged nostalgia (picture the 1941 Jeep in action in Europe) and futuristic aspirations. Jeep’s evocative ad promises a future where overlanding can be accomplished with zero emissions, autonomous driving and even paired with a drone.

The lineup includes the Wrangler 4xe hybrid and the aptly named Gladiator Overland, not to mention the more refined Wagoneer and Grand Wagoneer models. But it is Jeep’s aspirational advertising that stands out.

Overlanding is a strange combination of ruggedness, offgrid self-sufficiency and clean technology. The Jeep ads speak to that quest for independence while relying seamlessly on green technology. It’s as far off the beaten path from mainstream automotive marketing as it gets, and if it works (both the technology and the ads), we may all become overlanders one day.

Q&A With Brenda Bailey

Classic cars, EVs and a Goal of Inclusivity Brenda Bailey is BC’s Parliamentary Secretary for Technology and Innovation and was elected MLA for Vancouver-False Creek in 2020. An avid classic-car lover and collector, Brenda sat down for an interview with Blair Qualey, president and CEO of the NCDA.

Blair Qualey: We understand you are a big car collector. How did cars fit into your level of interest as a young person and what’s the first car you owned? Also, what’s your current vehicle?

Brenda Bailey: Well, I wouldn’t say I’m a big car collector, although I’d like to be. My father was a serious collector, and I got the bug from him. Given the choice between helping Mom in the kitchen or helping Dad in the garage, I always chose the garage. Dad was an American muscle car guy, and I still love that category of car, but my tastes have broadened to European vehicles as well. When I daydream about additions to my garage, I think about iconic cars like a 2002 BMW, an early ‘50s Porsche and, one of my all-time favourites, a ‘66 Mustang fastback.

The story of my first car is fun. My high school in Nanaimo was right next to the vocational college where my dad taught, and he’d work on vehicles there after work. I’d meet him after school and work on whatever the current project was. In grade 12, he was working on a ‘66 Mustang, and I spent a ton of time sanding that car in prep for paint. On grad day, I was dressed in my long red satin grad dress and stepped out on the front porch expecting to see my date in the driveway. But instead, there was the Mustang, painted candy apple red to match my dress, with a big yellow bow on it. That was my first car and a summer for the record books.

My daily driver is a comparatively boring BMW 328 wagon (great for my giant Bernedoodle), but my summer driver is much more fun. I inherited my Dad’s ‘66 Mustang GTO convertible, nicknamed the “Frankenstang.” It’s a fun rig and I love it.

BQ: The Vancouver International Auto Show is an important display of the latest vehicle technology. As you know, events were postponed and cancelled when the pandemic hit BC in the spring of 2020 and this affected the planned 100th anniversary.

Can you share with us any auto show memories and what the return of the show in March 2022 means for consumers looking to make a new vehicle purchase?

BB: Probably my favourite auto show memory was the year you highlighted the history of Corvettes. It was incredible to see the various body styles side by side, year over year. I remember my heart thumping with excitement as I took in one stunning ‘vette after another. If I had to pick one to take home, I could never have made a decision, but I remember the split-window Stingray as truly breathtaking.

I expect there will be loads of new technology and innovations at the next auto show, including the latest electric vehicles (EVs).

There are many benefits to EVs—the average BC driver can save about $1,800 on fuel every year. With fewer moving parts, EV also save the owner maintenance costs. In BC, EV drivers are allowed to use the high occupancy vehicle (HOV) lane even if they are the only one in the car, so that can save time and stress in traffic.

EVs are easier than ever to power up with our growing network of public charging stations. BC currently has one of the largest public-charging networks in Canada, with over 2,500 public charging stations across the province. Through the CleanBC Go Electric EV Charger Rebate program, people can also get money back to help with the costs of adding charging stations to their homes and workplaces.

Consumers can also be the beneficiaries of the CleanBC Go Electric Vehicle Rebate program and the Government of Canada’s Incentives for Zero-Emission Vehicles program. Up to $8,000 in combined provincial and federal rebates are available for the purchase of a new EV. It’s a simple, easy process as the NCDA dealers apply the rebates to the price of the car at the time of sale or lease.

BQ: Can you put into words the impact the pandemic has had on you?

BB: I was elected in October 2020, and the pandemic was in full swing. It was partly due to the excellent job of our government that led to my decision to run. I raised my hand because I think we need good people to stand up and help during times of difficulty, and I know I have something to contribute. I come to the table with a background in business—having twice been a start-up

entrepreneur in the software space—but I also care deeply about social justice issues. It’s more challenging than I could have expected, but I don’t regret taking the leap.

BQ: The environment is a big part of your government’s agenda and it’s obviously important for British Columbians. Could you speak to the value of the partnership that exists between your government and the NCDA in helping to put BC in a leadership position with respect to EV adoption?

BB: By 2040, every new car sold in the province will be a zero-emission vehicle. BC’s transition to a world-leading clean electricity standard is achievable—especially with partners such as the NCDA. I want to thank NCDA members, across the province, for doing their part to encourage customers and community members to move away from combustion engines and into EVs. We cannot achieve our CleanBC goals without this kind of support. The NCDA has helped drive forward the adoption of EVs. NCDA members and your customers can rest assured that in BC we are accelerating the switch to cleaner fuels at the gas pump and making it easier to power EVs. Budget 2021 included $94 million to support rebates for zero-emission vehicles, charging stations, technological development and electrification projects. We have also committed $61 million through StrongerBC, BC’s economic recovery plan, to the commercial transport sector to support rebates and develop new and existing zero-emission vehicles.

These innovations and strategies are helping us meet our climate objectives and global responsibilities.

BQ: Diversity in trades is a focus for government and a means of addressing the labour shortage in BC. Can you share how government is encouraging women to consider careers in the skilled trades, particularly automotive?

BB: Historically, women have played a small part of the skilled automotive trades. It is a key mandate in my role as Parliamentary Secretary for Technology and Innovation to help more people from underrepresented communities, including women, Indigenous, Black, people of colour and other equity-seeking people, get into technology in every sector. A more diverse and inclusive workforce leads to a more innovative and sustainable economy that benefits all. Encouraging female and non-binary apprentices in the automotive industry is important to the future of the sector, so we are working at removing various barriers to increase participation of people of all genders. We provide apprentice supports to reduce financial barriers to trades certification by covering certain training costs, such as tuition, travel, living away from home, childcare costs and loss of wages. BC is also addressing sexism and racism in the workplace to ensure women and others who work in trades are treated fairly and respectfully by coworkers and colleagues.

We want to provide opportunities for women to find the trade they love, such as the automotive industry, and make a satisfying career out of it. What is good for women is good for families, communities and our economy.

BQ: The skills shortage is something a number of industries are facing. We hear from our members that a key challenge is Continued on page 16

the shortage of all automotive skilled trades including service technicians. Can you comment on the government’s plan to tackle the shortage and support service technicians, as well as industry training and education for apprenticeships?

BB: We want to make sure British Columbians, in small and large communities, have access to the services they need, such as being able to have their vehicle serviced or repaired. It is estimated that there will be approximately 73,000 job openings in the trades in BC over the next eight years, so addressing trades shortages is a priority.

To help support higher-paying, more stable employment for trades workers, we recently launched a made-in-BC certification system that we’re calling skilled trades certification. This will increase prestige for the trades, helping attract more people and will create more opportunities for women, Indigenous Peoples and those starting their careers. We will start with 10 initial trades from electrical, mechanical and automotive disciplines. Heavy-duty equipment technicians, automotive service technicians, and autobody and collision technicians will be in the initial 10 trades designated for certification.

We are also looking at creating multiple pathways to completion of certification for all workers, so no one is left behind.

BQ: Given the pandemic and all of the various challenges and demands, if you were to look back three or five years from now, what would you like most to be remembered for?

BB: It has been part of my role to support diversity and inclusion as core pillars for the BC government. These pillars also reflect

my personal values. Helping more people from underrepresented groups get their first job in the technology sector has been a milestone. We’ve helped thousands of skilled Indigenous, Black, people of colour, women and other equity-seeking people get jobs with BC-based tech companies that need their talent to keep growing. Putting people first, particularly those who have been disproportionately impacted by the pandemic or historically underrepresented, has been important to me. While there is always room for improvement, BC is on a clear path toward ensuring greater inclusion.

BQ: Given the stress and work involved in managing a pandemic, what do you do to unwind when you can find time to relax?

BB: Like many people, spending time in the outdoors and with loved ones within my limited COVID-19 bubble has helped me recharge. There isn’t much that can top cruising in the ‘66 GTO with the top down, my dog in the backseat, his hair blowing in the wind like Fabio.

BQ: We would like to thank you for time, but more importantly for your leadership during a period that is clearly unprecedented. Any final thoughts for the close to 400 new-car dealers who operate businesses in communities across the province?

Online Dispute Resolution, Simplified British Columbia’s Civil Resolution Tribunal

You closed a deal last year for a brand-new sedan, under a standard vehicle financing agreement.

tirely, and now you have doubts about whether the buyer will pay this month. The amount of the missed payments owed to you is relatively small, and you are not entirely enthused about having to start a lawsuit in Small Claims Court and go through a lengthy court process on your own.

For automotive dealers, commencing a court action for every unsettled debt, large and small, may be impracticable and costly.

Understanding how you can take advantage of the Civil Resolution Tribunal’s (CRT) online resolution process may save valuable time and expense when enforcing your rights.

What is the CRT and what does it do?

The CRT is an online tribunal that adjudicates on various types of claims worth up to $5,000, including any claims related to debt, personal injury or a breach of contract. Just like the Small Claims Court and the Supreme Court of British Columbia, the CRT has the power to make binding decisions and orders on any claim within its jurisdiction. Any decision or order made by a member of the CRT is binding on the parties, and such decisions or orders may be enforced through the Small Claims Court.

The purpose of the CRT is to provide dispute resolution services in a manner that is accessible, speedy and affordable. Accordingly, the CRT’s process is flexible and easy to use, and individuals can navigate the entire process, often without the day-to-day assistance of a lawyer. While a lawsuit in Small Claims or the Supreme Court can take months or even years to resolve, the CRT’s resolution process has a much shorter turnaround by virtue of its streamlined processes.

How does it work?

Starting a claim: If you have a claim for debt, personal injury or breach of contract worth $5,000 or less, you can submit it to the CRT by applying for a dispute resolution, using the CRT’s website, or by paper, by filling out and filing a “Notice of Dispute.” There is a $125 fee for applying for dispute resolution online ($150 if applying by mail, email or fax), but this fee will generally be reimbursed if your claim is successful.

In your claim, you are required to describe the dispute’s relevant facts (i.e., your version of the events) and the nature and amount of relief you are seeking. Once you have filed your claim, the respondent will have an opportunity to set out their version of the facts within a set period of time.

Negotiation and facilitation: After the parties have filed their claim and response, they will have an opportunity to negotiate with one another and attempt to resolve the dispute. The CRT’s web platform (where you can login with your dispute file number) has a messaging platform where you can instantly correspond with the other party. Although the messages are monitored by the CRT, the negotiation process is entirely in the hands of the parties.

If the parties cannot resolve the dispute through the negotiation process, they will move onto the CRT’s facilitation phase. The facilitation process is very flexible, and the steps taken will depend on the circumstances of your dispute. Generally speaking, facilitation often involves: clarifying the nature and background facts of the claim to ensure each party understands the claim; facilitating further negotiation to see if the parties can settle the dispute; exchanging evidence where doing so would assist in resolving the dispute; and preparing for the CRT’s decision process.

The decision process: If the parties cannot resolve the dispute during negotiation or facilitation, they can ask the CRT to decide on the dispute for an additional fee. A CRT case manager will assist the parties in preparing for the decision-making process by arranging timelines for submitting evidence and arguments. While lawyers can assist with compiling evidence and forming arguments, they cannot speak on a client’s behalf, without first being approved by the CRT. The decision-making process is typically conducted online, in writing; the parties submit their evidence and written arguments through the CRT’s website or via e-mail, and the CRT member considers the matter, based on those submissions. In some cases, however, a hearing may be necessary via telephone, video conferencing, or in person.

Once the CRT has received the parties’ evidence and arguments, the CRT member will render a decision on the dispute. Any final decision or order rendered by the CRT is binding on the parties and can be enforced in Small Claims Court.

Through the CRT, individuals can settle their disputes or obtain binding decisions without having to make court appearances, and without a lawyer representing them. So long as the nature of the dispute and the value of the claim falls within the CRT’s jurisdiction, any individual can apply to the CRT for dispute resolution.

However, it is important to keep in mind that although the CRT is more accessible and more easily navigable than court proceedings, this does not mean that the bar to succeeding in your claim is any lower than that before the courts. Claimants are held to the same burden of proof as required in court and must prove their claim with sufficient evidence. With identity theft, chargeback fraud, online and in-store scams, there are several ways fraudsters can target your business. In this edition of Moneris’ Blue Book of Business Scams, we’ll cover online scams and share easy steps you can take to prevent fraud.

If you’re not vigilant about protecting yourself as an individual, you could leave your business vulnerable. Let’s take a look at the online threats that are out there.

Malware Malicious software, or “malware,” has been around for a long time; it involves a scammer trying to install software on your computer to access your personal information. It could come in the form of a link or pop-up message in a spam email or a fake website to infect computers.

How to protect yourself against malware The first and most obvious way to avoid malware is to install a trustworthy virus scanner to protect your computer. Just make sure you keep it current, and if you have any questions, get advice from a professional.

Aside from that, there are some precautions you can take on your own to protect yourself: • To access a website, make a habit of typing it directly into your browser or using a saved bookmark link rather than clicking a link from an email.

• Be careful with websites offering “free” downloads. Always double-check the source and understand the risk of clicking on something if you’re unsure.

• Don’t click on pop-up ads! They may result in harmful programs installed on your computer.

Credit card fraud with online shopping Finally, the most direct threat to your online business is credit card fraud. While it’s much more difficult to spot the warning signs of a fraudulent online purchase, you can protect your dealership: • Include AVS and CVV fraud protection tools directly within your checkout page.

• Monitor online sales for multiple low-value purchases from the same buyer over a short period.

• Review and quality-check orders made with multiple payment cards listing the same shipping address.

• Consider the risks of international shipping and ensure you’re shipping to countries that have reliable courier service.

• Scrutinize orders that use billing and shipping addresses from different countries.

• Look out for high-value items with expedited shipping selected.

What to do if you get scammed The truth is, even the most careful business owners can be scammed. The Competition Bureau recommends that you report scams or fraudulent purchases to the local entities that prevent these crimes. You can contact the Spam Reporting Centre about phishing or smishing messages you receive. You can report credit card fraud to your bank or financial institution.

The best defence is being prepared

“Phishing” and “smishing” use two different media to carry out the same scam. Phishing uses unsolicited emails that appear to be from a legitimate organization, like a bank, business or government agency. Usually, the sender tries to get you to provide personal information, such as credit card data, passwords or social insurance number, by clicking a link. Smishing uses SMS messages, like texting, to do the same thing.

While you can’t stop scammers from taking advantage, you can stay informed and take every preventative measure you can to keep your business safe.

• Delete emails or text messages from a company if you don’t regularly interact with them.

• Preview hyperlinks before clicking on them by hovering your mouse over the link.

• Do not use the phone number or email address displayed in a suspicious message. Only use the contact information you can get from a trusted website.

• Look for spelling or grammar mistakes—this can be a big tip-off.

• Don’t accept friend requests on social media from people you don’t know.

Employer Scores Rare Win in Wrongful Dismissal Case Clients should take note before taking a case to court

BY MICHAEL WEILER, KSW LAWYERS The courts have not been particularly kind to employers in wrongful dismissal suits these days. Many decisions find employers liable for damage based on significant notice periods, aggravated or punitive damages.

However, this decision was almost 100 per cent in favour of the employer on key issues. And, in fact, the employer was awarded costs even though the employee was successful in getting a judgment.

In Leclair v Patel Pharma Inc., 2021 BCSC 1904, the employee, aged 41, was terminated by the employer without cause or notice.

She was a retail manager for nine years and 10 months and earned $82,000 a year.

The employee pursued every claim she could when neither the evidence nor the law supported her. Time and space do not allow a full analysis, so we highlight some key points below—visit our employer portal page to read our full article: ksw.bc.ca/employment-labour-blog/.

Court rejects some evidence tendered by the employee

Reasonable notice

The case proceeded by way of summary trial based primarily on affidavits and discovery evidence. The employee tried introducing evidence from her own discovery transcript, relied on the statement of her lawyer regarding the costs of benefits, and tried to introduce letters that were inadmissible due to settlement privilege.

The court rejected the evidence objected to by the employer.

The court examined the four “Bardal” tests to determine reasonable notice. The employee argued she was entitled to 16 to 18 months notice based on what she claimed was 18 years total continuous service. The employer argued that the range of notice was nine to 12 months. The court agreed with the employer and held that the notice period was 10 months. After deducting the paid severance, the employee’s damages were $55,690—a far cry from what she claimed at $125,000.

Employed by the franchisee (separate legal entity), the employee tried to argue that her entire service with other stores should be considered for a total of 18 years instead of the 10 years she was with the employer.

The court held that her length of service was nine years, 10 months as argued by the employer.

The employee claimed she was entitled to a bonus in addition to lost salary. The evidence fell short of establishing a right to a bonus. Similarly, the employee’s claim in respect of benefits was also dismissed.

with another retailer but at a substantially lower starting salary of $58,000. The court held that failure to accept the job was a failure to mitigate and reduced damages by one month.

Aggravated, punitive and breach of good faith The court dismissed these claims. The employee argued that the employer gave a negative reference letter so she was entitled to aggravated damages. The court held that there is no obligation to provide a reference for a departing employee.

What’s keeping your dealership compliant?

Costs The court awarded the employer its costs because it had been substantially successful, even though normally the party who gets awarded a judgment (the employee) would get costs against the other party.

Takeaways This case reflects the dilemma employers face when an employee makes claims without legal or factual foundation. Employers who do not want the effort and costs of litigation settle beyond what their counsel advises. Seeing this case might make other employees’ counsel pause before taking a case to trial. We strongly urge our clients to consider the merits of their case and base their settlement discussions on them. In many cases, mediation is an effective tool to achieve settlement and significant legal fees.

The longtime event is now known as the Auction for Athletes, and it sports an eye-catching new look that will turn heads and expand reach to make a difference for these two charities. While this annual fundraiser has a fresh coat of paint, under the hood it’s the same high-performance engine that’s been changing lives for more than three decades.

Previously known as the New Car Dealers Foundation / Special British Columbia’s Olympics BC Auction, the event supports Special Olympics BC’s automotive empowering programs for athletes community has with intellectual disabilities, and a long, proud the foundation’s grants and scholhistory of making arships for automotive industry programs. a difference This year’s auction ran from May through this 27 to June 2 and raised a record auction. $215,000. Olympics BC athletes across the province. Many SOBC athletes knew the pain of loneliness long before COVID-19, and the pandemic has intensified their isolation. Funds raised in the auction are helping to restart the programs SOBC athletes rely on for sport, health, skill building and, most of all, friendships.

“For me, personally, Special Olympics really has made a huge impact in my life, and without you supporting us, I wouldn’t be who I am today!” said Susan Wang, SOBC-Surrey athlete.

British Columbia’s automotive community has a long, proud history of making a difference through this auction.

The event started in 1987 as the Casino Auction in support of Special Olympics BC. Held at Canada Place, the inaugural event saw more than 800 people take part in a fun night of games and festivities, as well as an exciting auction to raise funds and awareness for Special Olympics.

Chaired by automotive community leader Sherrold Haddad, the first event was a great success, raising $50,000 to support the development of Special Olympics programs in BC. Following this accomplishment, the auction became an annual event. As times changed, the auction grew and changed too. In the late 1990s, as organizers sought to expand the auction so dealers outside the Lower Mainland could participate, the dinner/auction began the transition from an in-person event to the online auction it is today. This transition began under the leadership of committee chair Tom Harris, a great champion of Special Olympics, who sadly passed away in 2017.

The auction has played a critical role in helping Special Olympics BC grow from two weekends of games with about 500 participants, to involving more than 5,200 athletes in 55 communities around the province.

DRIVING INSIGHTS | Canadians’ Attitudes Towards Buying a Car Online Have Changed

BY DREW HARDEN, MANAGER, CX RESEARCH & INSIGHTS AT CARFAX CANADA When we first asked car buyers if they would like to buy their next vehicle online, it was late 2019 and only 12 per cent of Canadian usedcar buyers were ready to buy entirely online. Since then, the process of buying a vehicle has changed substantially. Dealerships have found themselves having to operate “by appointment only,” and this has served as a catalyst for many to adopt additional online shopping tools. At the same time, Canadians have embraced online shopping, with curbside pickup becoming a part of their everyday lives. So, are Canadian car buyers finally ready to buy a car entirely online?

Customers still aren’t ready to purchase online CARFAX Canada Driving Insights surveyed over 2,000 Canadians who had recently bought a new or used vehicle, many under these new buying conditions. Even with consumers purchasing more products online, interest in buying vehicles entirely online has decreased since 2019. Only eight per cent of Canadian car buyers, new or used, want to buy their next vehicle online and have it show up at their door; the remaining 92 per cent would still prefer to buy a vehicle in the dealership.

Does age make a difference?

When it comes to buying vehicles online, another common question is whether it is an opportunity to attract younger car buyers.

buying a car online may be more natural to them. Age does play a small factor with interest in buying online, but it peaks with 12 per cent of new car buyers ages 18-24. On the other hand, only six per cent of the 55-plus crowd are interested in buying new or used online. Interest does vary slightly by age, but the results are not different enough to be actionable.

Buying online is still a niche Changes to how we lived and shopped throughout 2020 have not impacted Canadians’ interest in buying cars directly online. In fact, we see that car buyers may even miss the dealership, with fewer now wanting to buy online than in previous years. With less than one in 10 car buyers wanting to buy completely online, regardless of if they’re buying new or used, there is an opportunity here but it is still a niche. This likely means that our current approach to online car buying hasn’t gotten customers past their desire to see and drive a car in person, and to get some help from a salesperson.
