Before you list: the ABCs of prep When it comes time to selling a home, a lot of people still think of the old adage, “location, location, location.” Well, as with everything else, this too has changed and is now “location, condition and price.” Yes, location still means a lot to buyers; however, so does the condition and the price of the home.

Today, bu yer s have access to homes that are for sale through the magic of the internet. Before a prospective buyer calls about a home, they most likely they will know more about it than their Realtor.

What does this mean to a seller? It means that buyers ca n compa re your home to others before walking in the door. So, making sure your home is in tip-top shape when it hits the market is of utmost importance! And, if there are some issues with the home, it is best to know about them before you get into escrow.

W hen I list a home, some of the subjects the sellers and I cover are inspections and presentation, which can go hand in hand. If a roof looks near the end of its life, we talk about having a roofing compa ny come out to inspect it for an expert opinion as to its longevity.

If the roof is near the end of its life, a roof certificate for two or three years or a

home warranty with limited leak repair is a lot less than a new roof, and will help a buyer feel more con f ident i n t he pu rchase of the home.

Another inspection is the pest inspection. This is where t he inspector checks the home for dry rot, fungus and infestation of termites and/or w ood b or i ng b e et le s.

These are called section one items on the report.

I f t h i s r ep or t i s p erformed after t he home goes into escrow, a buyer can potentially request these repairs be made, or a credit off the agreed purchase price. The buyer’s lender can also request this work be completed before lending on t he home. Having your pest inspection completed prior to listing your home can potentially save you thousands. I’ve seen it with my own eyes!

If you have a well or a septic tank, plan on having these items inspected as well. I recommend these to be done prior to putting them on market, preferably the week prior.

Audit your home before listing it. Retiling a roof or fixing a leak will make a huge difference in list price.

Help! I don’t want to buy that house their offer. There may be issues regarding the specifics of your offer, but a good Realtor can guide you through it.

Seller provided false disclosure of permits Dear Barry: I'm buy ing a n older home that was advertised as fully remodeled. The seller disclosed in writing that all work had been done with permits, but when my home inspector found no firewall in the garage, he advised me to call the city to verify permits. That turned out to be wise advice because the building department had no record of a ny remodeling work. Now the seller says the home was "redecorated," not remodeled, and that this does not require a permit.

T h e w o r k , h o w e v e r, included new wiring, new water piping, complete recon st r uc t ion of t he kitchen and bathrooms, and much more. These revelat ions have completely undermined my confidence in everything the seller says. I'd like to buy t he home but a m afraid to proceed with the sale. What is your advice?

Nathan Dear Nathan: It is surprising that any seller would undertake the risky position of false or incomplete disclosure.

Violations of this k ind give rise to needless legal disputes. In the realm of real estate sales, full disclosure is not only a matter of essential ethics, it is a legal requirement for sellers and agents in most states and has been since

the 1980’s.

According to the first chapter of the building code, permits are required for buildings that are altered, repaired, or improved. Even for work that is exempted by the code, separate perm it s a re requ i red for plumbing, electrical, and mechanical installations.

Therefore, the alterations in this situation were subject to permit requirements.

If you proceed with the purchase of this property, accepting the remodeling work as-is, you will have to d isclose a l l of t he n on-p e r m i t t e d a l t e rations to future buyers of t he propert y, and t hat would adversely affect value and marketability.

A better solution, if you proceed w it h t he purchase, is to have the seller apply to the city for an "as-built" permit. If the seller agrees, the work w ou ld b e s u bj e c t t o a ppr ov a l b y t he c it y inspector, and non-complying conditions would have to be corrected. On the other hand, the best solution might be to find a

Question: Dear Kari, My wife and I are going to be selling our home very soon. I wanted to use my cousin who is an agent for more than 25 years, but my wife says we have to use her parents’ real estate broker. This topic is so confusing for many because the terms “real estate broker” and “real estate agent” are so similar in nature. A Realtor is a licensed real estate agent who abides by a special code of ethics and is a member of the National Association of Realtors, who must function or work under a real estate broker at all times. another broker as an associate broker (in that situation would function only as a Realtor), or he can own a real estate company and have several Realtors under him. A Realtor cannot open a real estate company, unlike a broker. Real estate brokers are required by law to take more classes and pass a broker's test to attain the title of broker.

A n ot h e r d i f f e r e n c e between Realtors and brokers is that brokers have a much higher level of liability if they were to become involved with a lawsuit in which they were a part of.

When a broker functions as a manager, he takes responsibi l it y for t he

actions of all the Realtors that work under him and for his own actions as a broker. This leaves the broker more open to exposure. On the other hand, a Realtor is not as liable for his actions because he has a real estate broker as a safety net to lean on.

When a broker is acting on his ow n, he or she receives 100 percent of the commission, but in the event if he were to work under a broker, he would receive the same amount of monies as a Realtor. The broker of record ta kes money off the top from the Realtor and/or a broker’s associate, neither one is paid more money.

Good to note, although a broker is required to have more education, this does not mean that he has more experience in real estate than a Realtor. A real estate broker literally could have just passed the broker's exam and have no experience selling a home, and yet hold the title of

broker. This is good to k now because when decid i ng bet ween a Realtor and a broker, it’s important to dive in and find out how much experience your agent has. A more experienced Realtor will probably know how to negotiate the sale for your best interest.

Therefore, just because a broker has taken the classes and passed the test to become a broker doesn’t mean that particular broker has a wealth of experience. By the same token, your husband’s broker cousin seems to have loads of experience selling real estate. What I mean to say is you cannot choose an agent to sell your home simply based on their title,

Urine is naturally high in nitrogen, so when pets urinate on lawns, the grass might turn yellow or brown due to the excess nitrogen content.
