Buyers lament having no home inspection Dear Barry: W hen we bought our home, we were on a tight budget, so we did not hire a home inspector. After moving in, we began having electrical problems, so we hired an electricia n to see w hat wa s wrong. He said that half the house is wired to one circuit, and it's going to cost a lot to redo the wiring. Buying a home without having it professionally inspected is a big mistake, as you are now discovering, and it is surprising that people choose to invest so much money without spending a few hundred dollars to prote c t t hat i nve st ment .

Competent Rea ltors encourage their clients to hire home inspectors. If your agent did not do this, that was an professional breach.

Aside from the question of liability for electrical repairs, you need to learn what other defects are not yet disclosed. Try to find the most thorough and experienced home inspector in your area. A competent inspector will reveal many more condit ions t hat you shou ld k now about, possibly even ones that involve health and safety issues,

and possibly some the sellers definitely should have been aware of.

Dear Barry: We h i r e d a h o m e inspector prior to buying our new home. Now that we've moved in, we find no ex haust hood above the kitchen range. The inspector tells us that no hood is requ i red, but ever yone k nows ra nge hoods a re sta nda rd equipment in all kitchens. We think the inspector failed to disclose this defect and is now trying to make excuses. What is your opinion?

Andy Dear Andy: Range hoods have been standard equipment in homes for so many years that they are commonly presumed to be required by t he bu i ld i ng code.

dwelling, and your disappointment at not havi n g o n e i s understandable.

The Uniform Mecha nica l Code cont a i n s a l l of t he ba sic requirements for ventilation at cooking fixtures.

The only pertinent regulations for exhaust hoods at ranges involve commercial stoves, such as those in restaurants.The code may eventually be upg raded to i nclude hoods i n resident ia l kitchens, but thus far, no such requ i rement has been enacted.

E x per ienced home inspectors typically point out the lack of a range hood simply to inform clients of an unusual and undesirable condition, but inspectors are under no obligation to provide this disclosure.

Saving our plants from too much water Paul McCartney wrote a song titled, “Too Much Rain.” Has anyone been singing it lately? You can hear me bellowing it out at my home, that’s for sure. But seriously, can there be too much rain?

For your garden and potted plants, the answer is a definite yes. Here are a few things you can do in and around your home to ensure your plants stay hea lt hy a f ter t h is wet winter.

First of all, our plants need oxygen to survive and if their roots are surrounded by water, their cha nc es of d row n i ng increase. First, be sure your irrigation system is turned of f (somet hing that needed to be done earlier). Then, stay out of your garden, as that will compact your soil, which l i m it s root g row t h.

Consider putting mulch between plants or rows.

Or, you can put boards out to walk on which will help keep your soil consistent.

Aerat i ng you r ga rden when the soil dries will help the roots get oxygen as well. Lastly, wait until your garden has dried out before you start to work in it. If you find your garden in standing water more often than not, consider making a raised bed.

I f you h ave pot te d plants, the best thing you can do is move them to a

sheltered area. If you can’t do that, perhaps you can bring shelter to them by using a table, chair or even tarps, if needed. I have a Daphne plant that sits in a cast iron container which doesn’t have any drainage. I turn her on her side when we get big rains and that seems to manage the water. The plant doesn’t get put upright immediately after the rain stops either. I wait for the soil to show it has dried out quite a bit and not just on the surface.

If you can’t do any of these things, when the weather does dry out, you can take your plant out (hopefully it is still somewhat dormant, if not, be gentle with the root system), and rinse the roots to get of f a ny f u nga l spores that may be forming. Then dust the roots

w it h a f u ng icide a nd repot. Also, be sure you have your pots on “feet” to ensure they are raised off of the ground and that the drain holes are clear at the bottom of the pot.

Here are a couple of signs of plants they may have had too much water: wilting leaves, leaves that are turning yellow and falling off, or foul-smelling soi l . If you see t hese symptoms, your plant is asking for help.

We are all grateful to have so much rain after years of drought.

Understanding the benefits of arbitration Question: My husband and I had been looking at homes to buy with our agent for on ly a week when he found the one we wanted.

We excitedly went back to our agent's office to write up our offer on the home.

W hen ou r a gent w a s explaining the purchase contract he wanted us to sign, we really got lost with the part regarding arbitration. Could you please explain further?

Answer: I will do my best to shed light onto this topic. The sta nda rd Ca l i for n ia Association of Realtors purchase contract contains a provision for buyers and sellers to choose to work with arbitration or litigation in the event a conf lict arises that cannot be resolved.

Arbitration and litigation can seem intimidating when it comes to your future home purchase. In most cases rea l estate sales carry on smoothly with minor bumps in the road. This is where real estate professionals come in handy as they are able to resolve most conflicts that arise. However, when a conflict arises that cannot be resolved, then this is when the further legal options come into play.

In the event arbitration is agreed, then it will be used to resolve the conflict. The arbitrator select-

ed will be a retired judge or attorney with at least five years of real estate experience. Arbitration is typically private and less intimidating. The formal rules of the courts do not apply. Each party submits their evidence to the arbitrator and is allowed to have an attorney, but it is not a requirement. During this process both parties are allowed to call witnesses, cross-exa m ine witnesses and make arguments to the arbitrator.

Additional requirements i nclude w r it ten statements from each of the pa r t ies’ posit ion i n advance. Once the hearing is finished the arbitrator is allowed several days before offering the decision and the award. This process can be scheduled a nd resolved qu ick ly.

A rbit rat ion is usua l ly more time-efficient and cost-effective. Good to know, the result of arbitration is binding. To be clear, if you use arbitration neither party has the right to appeal and must live with the outcome.

When a conflict arises in real estate that cannot be resolved, this is when further legal options come into play, specifically: arbitration. agreed then it will be used to resolve the conf lict.

This is a formal process where both parties submit evidence to the judge and jury and rely on them to make a binding decision regarding the dispute. During litigation, formal rules and procedures of t he court are st r ic t ly ad hered to.

Litigation is public record.

Us u a l l y b ot h pa r t ie s invest in their own real estate attorney for representation. Litigation is

very expensive and emotional stressful. In most cases, the losing party may need to pay for both the attorney fees. If either party is dissatisfied with t he outcome, t hey a re allowed to make appeals, which can cause the case to carry on for up to several years.

If you t hink you are interested in arbitration it would be wise to sign the purchase contract with that selection to lock in that option. In the event

you decide to wait, you could still try to arbitrate later. However, if you did not initially agree on arbit rat ion a nd a con f lict arises, then you could be forced into litigation.

Some folks who went through litigation would agree that it is best to put a horrific situation behind them as soon as possible and move forward with their lives verses experiencing the heavy cloud of a prolonged lawsuit.
