If a better offer comes in during the Active Contingency period, the seller will issue the buyer a “Notice to Perform.” This gives the buyer the option to remove the contingency and proceed with the purchase or quit if they cannot supply the funds.

• Coordinate the escrow dates. If you are looking because your home is in escrow, time the closing dates so they dovetail with each other. Remember to leave room for recording.

Technically, you do not own the home until it is recorded and you should not take possession until it is recorded.

• Set up a home equity line. The buyer should have this in place well advance of mak ing an offer. The amount of theo-

equity in the buyer’s home will factor in the amount of f u nds ava i lable.

Depending on the size, the equity line could be used to fund the purchase of the new home.

• Obtain a bridge loan: This loan literally bridges the funding gap between the time period money from the sale of buyer’s home is available to the closing date of the new home. Note: the buyer is responsible for paying off the bridge loan within the time specified in the loan agreement even if their home does not sell.

Scenario 2 Sell before you buy • Have your house on the market? Ask for a longer escrow. This tactic will provide time to find a new/replacement property before you vacate your current residence. This approach can eliminate a

double move, ( current residence to a temporary housing to new home).

• Rent back contingency: If you sell before you find a new home, you can negotiate a rent back. If they agree, the new buyers will lease the property to you for specific amount of time, ex: 5 weeks. Expect to pay above the going rental rate as the new ow ner s w i l l probably expect an incentive to accommodate your request.

According to their website, they have over 3,000 hand-carved pumpkins.

Make your backyard into a safe haven for birds Ready or not, bad weather is on its way. Before the snow starts falling, take some time to transform your backyard into a safe refuge for winter-weary birds before unpredictable, ha rsh weat her begins. The experts at Cole's Wild Bird Products suggest t imely t ips to encourage birds to seek sustenance and shelter in you r back ya rd t h is winter.

Start by taking an inventory of your existing feeders. Inspect each for damage and replace if necessary. Consider adding new feeders to attract even more birds and allow for fewer trips to refill them during especially cold and stormy days. Now is also the perfect time to stock up on high-energy bird feed so you're ready to go when the first flakes fall.

Electrical safety for whirlpool bathtubs Dear Barry: Please help me resolve a debate I'm having with a local home inspector. I have a sma ll business installing bathtub whirlpool systems.For added safety, I use plastic pipe to prevent electrical connections between the tub and pump equipment. A home where I had installed one of t hese systems was recent ly sold, and the i n spec tor fau lted my installation for lack of electrical ground fault protection. I explained to him that plastic piping cannot conduct electricity from the pump to the tub, but he insisted that GFCI protection is required. How can I convince him that the system is safe without adding a GFCI outlet?

The home inspector has pointed out a significant safety violation. Ground fault circuit interrupters (GFCI) are not only necessary, they are required by code. GFCI’s are designed to prevent injury or death from electric shock, by shutting off the power when a short circuit to ground occurs. This is particularly important where bathtubs are connected to electrical equipment.

The use of plastic pipe to prevent electrical contact between the tub and pump may seem practical at first

glance, but you've overlooked the fact that the water inside the plastic pipe can conduct electricity. If the circulation pump should ever develop a leak, 110 volts could electrify the bath water, with life-ending consequences to the unsuspecting bather.

The logical and practical solution is to install a simple GFCI outlet in the power supply to the pump.The additional cost for materials is approximately $1520. By including this added protection for your customers, you will resolve your debate with the home inspector, while maintaining compliance with the National Electric Code.

Using plastic piping to connect a whirlpool tub to the pump equipment is risky, because the water conducts electricity.

Dear Barry: The home I just bought has a forced-air heating system: the first one I've ever owned. The owner's manual says the filter

should be changed regularly, but it doesn't say how often that should be done.

Should sellers counter a low offer?

Question: Dear Kari, My home was listed on the market for 10 days when my agent said he received an offer from an agent and would like me to come to his office to view the offer. I was shocked at the low price of the offer.

So t he big question is should I try to work it out or wa it for somet hing better?

Even if an opening offer is beneath what the seller feels is reasonable, it is advisable for the seller to respond with a slight reduction from the asking price.

The first offer is often the opening of a negotiation process.

Answer: Even if your home has been listed for just a few days, if you r home is priced well, you can reject the offer and be reasonably confident that a bett e r o n e w i l l f o l l o w.

However, now might be the time to take a hard look at your asking price. If your price is on the high side, the offer may not be t h at u n r e a s on a ble. I would recommend that you don’t “just say no” to a low offer until you have explored all the options.
