Should buyers waive appraisal contingency?

Question: I am tr ying to buy a house with my agent and I am having no luck because there are mutable offers on every home I like. Each offer I have made has been the full seller’s ask ing price. This is really stressing me out, along with affecting my work and my sleep. My agent has made a suggestion to me when having him write my next offer on a home of taking out the appraisal contingency. I was taken back with concern.

Could you tell me if this practice is even legal?

Answer: Thank you for asking such an interesting question, as this could be helpful to many. To answer your question in short, yes, it is legal to remove the appraisal contingency when making an offer on a home. It is

good to know that most all purchase contracts have severa l cont i ngencies such as; loan contingency, appraisa l contingency, home inspections, title clear contingency, just to name a few. The usual time frame for the contingencies are from 10 to 21 days.

The appraisal contingency is in the purchase contract to not only to protect the lender’s interest, but also protect the buyer’s interest. Let’s face it in more situations than not the lender has more to lose than the buyers do in the event of any

default. To be clear lenders want to obtain the loan as that is their business, however there are strict guidelines for this process.

The appraisal amount must match or be greater than the agreed upon purchase price offer, or the lender will not make the loan at all.

Multiple offers can be very competitive and a low appraisal is every seller’s nightmare. I think your agent was trying to help your offer to gain an edge to seem more appealing by t a k i ng t he p ot ent i a l appraisal problems off the table. However, this would force you in the event the appraisal came back lower than purchase price to have you make up the difference with additional cash. If you have extra cash to put down in this situation and feel comfortable then I would agree with your agent to take

out the appraisal contingency. If you don’t have the extra cash then I would never make this suggestion.

Let’s first look at some reasons for a low appraisal.

It could be that the appraiser is from out of the area and not familiar with current market values. The appraiser could be a newbie. The seller could be over pricing because of emotional ties or greed. The appraiser could be overlooking pertinent pending sales in the area. There could be an error in placing full value on upgraded items. Selected comparable sold properties from the wrong (lesser desirable school district) neighborhood.

In the event you kept your appraisal contingency, let’s look at some solutions to solve a loan appraisal disparity. Buyers can make up the difference in

cash, sellers can simply lower the price of the home equally to the appraisal price or buyers and sellers can agree to split the difference. They can also agree to pay for another appraisal or obtain a completely new lender.

My favorite solution is to dispute the appraisal with the original lender. This can be done by writing a letter to the appraiser and sending the lender a copy as well. The letter should be polite, straight to the point, and without a vicious tone.

It is good to point out specifics of why the value is different in your opinion.

Offer new comparable properties or further information on the existing properties in the comparison that the appraiser selected. You may find out a home took a lower price because of a divorce or death in the home which

caused a lower price. You may ask the appraiser why the comparable homes were selected. Ask the appraiser if he or she would like to take a second look at the home to refresh their memory. Be courteous as the appraiser does not have to change anything if they do not wish to.

In conclusion, sellers should consider themselves lucky when buyers are willing to look at options after a low appraisal. Some buyers will cancel the contract immediately if the appraised amount is one penny less than their offer price. Keep in mind that the appraiser is only human and reflects only one person’s opinion.

Addition to home makes bedroom illegal Dear Barry: I nearly closed escrow on the sale of my home, but the deal fell through over a minor problem found by the buyer’s home inspector. This is an old house with an added bedroom and garage. According to the inspector, the master bedroom has no window to provide fire escape because the additions have covered up the original windows. To me, this is a picky detail. If a fire occurred, I would simply exit through the living room or the back bedroom. Why is that a big problem?

Tom Dear Tom: The big problem is that you might not be able to exit through the living room or rear bedroom. Suppose you woke up to find the house ablaze, including

the adjoining rooms, with all avenues of escape engulfed in flames. At that moment, you might desperately wish for an openable window or any means of direct outside access, but there would be no fulfillment of that wish.

Lack of a bedroom window violates three pertinent requirements: a source of natural light, or outside ventilation, and most important of all, a means of direct escape from the building in the event of an emergency. All three are strictly required

if a room is to be designated as a legal bedroom.

Noncompliance means that a purported three-bedroom house has only two legal bedrooms. From a buyer's perspective, this significantly reduces the value of the home, as well as its marketability for future resale. Unfortunately, there appears to be no practical solution. If an illegal bedroom has no exterior wall, the problem is not correctable. The situation is certainly lamentable, but the inspector had no choice but to disclose it to the prospective buyers.

Dear Barry: A friend advised me to turn off the water supply valves to my washing machine whenever the laundry is not in use. She said that leaving the valves

turned on can have a negative effect on the water pipes in the house. Does this sound practical to you?

Cheryl Dear Cheryl: Your friend’s advice has some advantages, but not for the reasons cited. Whether the laundry valves are turned off has no effect, positive or negative, on your plumbing system. However, shutting off the valves can reduce stress on the hoses that connect to your washer, and here’s why that matters.

Many homes have suffered severe damage when old washer hoses have burst open. What commonly happens, especially with old hoses or when water pressure is high, is that a hose will develop

4 factors that affect the cost of a new roof No one wants to pay more for something than they have to, especially when it comes to a large home improvement purchase. So, why can there be thousands of dollars difference between contractor bids for neighboring homes? And how can homeowners get an idea of what a new roof will cost?

In general, labor for a new roof should make up 60-65 percent of the cost and most of the remaining cost, 30-35 percent, should be the cost for materials, according to Rick Taylor, a longtime roofing contractor now working as a training manager for TAMKO Building Products, Inc. After labor and materials, the remaining costs, approximately 5-10 percent of the total, should consist of disposal for any building materials

that need to be removed and any additional fees like paying to have the shingles craned up to the roof or renting scaffolding for the job.

As for the specific dollar figure, there are many factors that go into a roofing bid. Here are the top four factors that can affect the cost of a new roof.

Size

The larger the house, the larger the roof, and the more shingles needed to cover it. According to industry standards, one square of shingles is the

amount needed to cover 100 square feet of roof, and as a rule of thumb for most three-tab and laminated shingles, there are three shingle bundles in each square. To estimate the number of squares needed, divide the total square feet by 100.

When calculating how much roofing you need, be sure to take into account any additional, detached buildings that would benefit from having a matching roof to the main house - for example, a detached garage, sheds or gazebos.

Why properties fall out of escrow In a strong market, like our current greater Auburn market, some buyers believe that a property that has been on and off the market must have serious flaws.

The reality is often quite different. Let’s explore some of the reasons a property can transform into “The bride’s maid from being the bride” 1. It’s worth what?

In a multi-bid scenario, a property can get bid-up to where it will not appraise, i.e. the lender will not lend on the house without the borrower/buyer making up the difference between the purchase agreement amount and the appraisal amount. This can be a deal-breaker for buyers on a tight budget or those seeking a VA or FHA loan approval. Ouch!

2. Oh, no! The buyer’s home isn’t selling! Buying a home takes resourc-

es. Often a buyer will need to sell their current home to unlock the necessary funds to purchase a new home. This is called a contingency sale. If the buyer’s home fails to sell within the specified time stated in the purchase agreement, the escrow is canceled. A back-up buyer can take their place and begin Escrow. No back-up buyer? The property goes back on the market.

Side note: This is where the services of a smart, seasoned Realtor comesin. Any contingent offer based on the sale of the buyer’s home needs to be vetted carefully.

3. The buyers want

$10,000 to fix that? Seriously? No way, dude.

Sellers can short circuit a buyers' “request for repairs” by doing the pest/home inspection(s) and making needed repairs prior to marketing the property. Buyers lose a potential negotiation point and the likelihood of a smooth escrow increases. Request for repairs can make or break an escrow.

When buyers feel bruised by the purchase price or sellers feel they are being needlessly hassled, either party can dig in their heels and squash the deal. The selling process restarts.

4. Burrr ... cold feet In California, a buyer has 17 days to walk away from a purchase agreement.
