How buyers benefit working with Props 60, 90 Question:

My husband and I have wanted to sell our large home for the past few years, but the problem is, our property taxes would about triple. I heard something from my friend at bunco the other night, that there might be an answer to our issue. Could you please comment on this topic?

Answer:

I am going to assume your friend was referring to how Propositions 60 and 90 might affect your home sale. Let’s take a brief look at these propositions.

Props 60 and 90 offer homeowners, 55 years or older, the ability to transfer the tax base of their previous, principal residence to a replacement residence of equal or lesser “current market value” of that original property, without having to pay more in property taxes on their new property.

Usually, the property tax of a newly purchased residence is based on the current market value, i.e.

the new sale price. When applying these propositions, you can bring your previous home’s tax base with you and this may result in substantial tax savings.

Eligibility is dependent on how old you are when you sell your original property, not when you purchase the replacement home.

You, or a spouse residing with you, must have been at least 55 years of age when the original property was sold. This is a one-time only benefit. Once you have filed and received this tax relief, neither you nor your spouse who resides with you can ever file again, even upon your spouse’s death or if the two of you divorce.

One must qualify and file an application within the guidelines which are strict and cannot be altered:

• You can buy your replacement home within two years before or after the sale of the original residence.

• Your replacement home must cost less than the home you sell. (Some buyers can pay the commission outside of escrow to lower the sales price.)

• If the market value of your replacement dwelling, even slightly exceeds the “equal or lesser value” test, compared to the market value of your original property, you would not qualify.

• If you or your spouse had used this exemption before, then neither of you would be currently eligible.

• The replacement property must be your principle residence and must be eligible for the Homeowners Exemption

or Disabled Veterans Exemption.

• You must buy or complete the construction of your replacement property within two years of the sale of the original property.

• You must file your claim within three years of purchasing or completing your new construction of the replacement • If you file your claim after three years, then the relief will be granted beginning with the calendar year in which the claim was filed.

After both transactions are complete, an application must be filed with the county assessor where the replacement property is located. The claim form, BOE-60AH, Claim of Person(s) at Least 55 Years of Age for Transfer of Base Year

NOTE: The list of counties is subject to change.

On Aug. 30, 2016, the El Dorado County Board of Supervisors approved an extension of their ordinance, which will now sunset on Oct. 1, 2021.

If you are aged 55 or over, and have considered a move, Props 60 and 90 essentially make that possibility more affordable by allowing you to keep your tax base the same. The resulting savings could equate to thousands of dollars per year; take the example

of a home whose current value is assessed at $300,000, even though the market value of the home is much higher.

The current estimated annual property taxes would be $3,750, or 1.25 percent of $300,000.

If that home sells for $700,000 and a replacement home is purchased for $650,000 — normally taxes on the new home would be $8,125 (1.25 percent of $650,000.)

But if the homeowner applies for and receives Prop 60/90 tax relief, property taxes could remain at $3,750, saving them $4,375 per year.

It would be wise to consult with the assessor’s office of the county of your current residence and the county of your replacement property, just to verify this information and eligibility. Consult with your local tax accountant, financial advisor and/ or other professionals regarding your particular situation.

Sellers’ wall repairs were soft, shrinking Dear Barry:

Before we bought our home, we asked the seller to patch several holes, about 3-4 inches wide, in the bedroom walls.

Two days before escrow closed, we did a final walk-through, and the repairs looked perfect.

But after we moved in, the wall patches began to crack and shrink, and we noticed that the surfaces were soft to the touch. What is the problem with these repairs, and what can we do to make them right?

Dwain Dear Dwain:

From your description, it seems that the seller repaired the drywall holes with a single application of drywall joint compound — commonly known as "mud." This method of repair is typically done when handy homeowners, unaware of the specific characteristics of drywall mud, try to affect a hurried fix.

The best approach is to patch the holes with fitted pieces of drywall and then finish the seams with tape and thin layers of mud. To do this properly, solid wood backing should be installed behind the holes to provide a means of attachment for the drywall. However, it is possible to repair small holes with drywall mud alone if you mix some patching plaster into the mud. The plaster eliminates shrinkage

and accelerates the curing time of the mud to a mere few hours.

Dear Barry:

The home I'm buying is in a brand-new subdivision where all of the houses have clay tile roofs. My home inspector noticed that the roof on my house is the only one in the neighborhood that does not have pieces of sheet metal to keep birds from nesting under the tiles. I asked the builder why these are missing on my house, and he said that "bird stops," as he calls them, are not required on tile roofs. Should I insist on having bird stops?

Bird stops are not required, as your builder says, but they are definitely advisable to prevent nests from being built under the tiles. Unfortunately, roofing contractors often omit them

to do everything you can to make sure your credit score stays as high as possible until the loan is approved and signed.

Your goal is to land the best possible interest rate, because even half a percentage point can add tens of thousands of dollars of total interest payments to a 30-year loan (and affect your wealth-building abilities).

During this time, things like continuing to make on-time payments on your existing loans can be helpful in maintaining your credit score.

However, sometimes people unintentionally lower their credit score when they’re actually trying to be fiscally responsible. For example, when shopping around for the best mortgage rate, keep in mind that multiple inquiries can have a negative effect on your credit score, especially if you don’t have a long credit history. Fortunately, many credit bureaus recognize that you may be comparison shopping, so make sure you do this within a defined time frame of 30-45 days.

2. Keep credit utilization low When maintaining a property, having access to credit can be helpful

Unfortunately, keeping a higher balance could result in a lower credit score. As a rule, keep your credit utilization at 30 percent or less. For example, if your credit card has a $5,000 limit, the balance should not get any higher than $1,500. Throughout the billing cycle, keep an eye on the balance, and pay it down when you can.

3. Keep a cushion of cash It happens. You get that call about a water leak, and before you know it, you’re spending your Saturday evening pricing plumbers, searching for one whose overtime rate is only in the range of mildly outrageous.

Being a property manager means expecting the unexpected, and one of the best ways to be ready is to have enough cash at the ready to take care of these problems.

Build an emergency fund in your savings account, and keep your credit paid down so you always have that cushion to fall back on during any crisis.

Flexing those real estate wings

I

t has come to my attention that a surprising number of firsttime buyers I meet suffer from a mild form of buyer interpretation. So the question is: Why? What makes everyone just a tiny bit apprehensive?

The answer is simple: confidence.

First-time buyers seem to be overwhelmed with information, smart investment strategies and for some, the pressure of family funding. “Opportunity is knocking darling. Interest rates are low, but climbing … Our check should help.”

Even with help, nothing happens. It’s hard to commit when you are hosted by your parents.

It’s free. And then, there are those student loans.

The share economy seems to be a workable alternative.

But, watch what happens when that house gets sold. Did you get a piece? Probably not because you were a renter.
