Knowing what you can and cannot do up front with a home you are considering buying is one Way to Save some time and angst for everyone involved. where there is a private road that needs maintenance and someone to manage it. You can also find HOA’s in condominiums and planned unit developments (PUD’s). CC&R’s are just what they stand for: covenants, conditions and restrictions. This can mean no parking your toys where they are visible from the street to no basketball set-ups or parked cars left on the streets overnight to no pink houses and so on.

Our local Multiple Listing Service (MLS) gives sellers the platform to disclose if they have HOA’s and CC&R’s in the listing information and gives buyers the opportunity to know these things exist. But, when does this information get provided to a potential buyer?

Cathy, one of my readers, wrote in asking me to tackle this topic so here you go!

Initially, when looking for a home, your agent will provide you with listing information from the MLS where you will see the information which describes the home and provides pictures. Along with that information, there is also a place to tell the buyer that there is an HOA, what the fee is and what the fee covers. Typically, along with having an HOA, you can expect there to be CC&R’s as well. This isn’t always the case, but tends to be the norm.

So, you are in your yard doing some gardening and a buyer comes along and asks you if there is an HOA in your neighborhood. You say "yes" and

answer the questions (that you can) that are asked of you. Can you answer or are you breaking some cardinal real estate rule? I say, if you KNOW the answer, sure, answer it! If it is something simple like “Can I park my RV in the street?” and you know you can’t — because you are storing your RV — let that buyer know. If you don’t know the answer, then say you don’t know.

When an offer is accepted and escrow is opened and your escrow officer will order documents from the HOA. The fees and length of time they will be completed and received vary. However, once these are received, it is up to the buyer to comb through the documents and make sure the information provided is to their liking.

Sometimes we as agents work in certain neighborhoods or have had enough transactions in our local sub-divisions that we can tell you what we know or provide

you with (possibly) dated information. As an agent representing the buyer or seller, if you know something about the property that is in escrow, it is your duty to disclose it.

If you don’t know, don’t disclose! It’s that simple.

Your buyer will receive up-to-date information during their discovery period and if they don’t like what they find, they can cancel their contract without their earnest money deposit (EMD) being in jeopardy — so long as they have not released all contingencies.

Knowing what you can and cannot do up front with a home you are considering buying is one Way to Save some time and angst for everyone involved. If you ask a neighbor to do so, that’s fine by me, and I would bet many other experienced and professional Realtors feel the same.

Are snap decisions wise for buyers?

I have been looking at homes to buy with my Realtor for only two days and found a house that looks perfect for me. I want to buy it, but because it happened so fast I am reluctant to make an offer without looking at some more homes for sale. I guess what is really sticking in the back of my mind is, I don't want to hear “I told you so!” from my parents.

Answer:

What a great question.

Whether you are in a buyer's or seller's market, the best homes usually get snapped up quickly. When you find a great home that you like, you may not have much time to think it over. I understand that it is difficult to make such an enormous purchasing

decision without at least "sleeping on it." However, if you hesitate, you could lose the house to another buyer. Keep in mind you are not the only buyers in the market and it is a competition. There are several groups of buyers out there who have done their homework and have been searching month after month in hopes of that perfect home. These groups of buyers have already educated themselves as to what is a great deal. So when that good deal on a new home first

hits the market, that educated group of buyers is ready to pounce with the best offer to win the deal.

If you go rushing forward, you may spend some time nursing a case of "buyer's remorse.”

Occasionally we get a morning-after call from buyers who will do anything to get out of the commitment they just made. If you find yourself in this situation, there are two important things to remember. First, your rash accompanies this very common condition, "buyer’s remorse.” Almost everyone who buys a house experiences this feeling, with varying degrees of intensity. Second, you should know that this condition is almost always temporary. If you have a bad case of home-buyers

jitters, call your Realtor and put off any decision about getting out of the agreement until you are certain that you have considered things carefully and rationally.

When you decide to make an offer on your perfect house, your biggest decision is how much to offer. You don't want to pay more than you have to, and sometimes it is hard to predict how much is "enough" for the sellers.

Some sellers price their homes at their bottom line and may be unwilling to negotiate, unless the house has been on the market for a long time.

Others build in a little room for negotiation.

If your offer is very low, your finances look shaky, and you ask the sellers to pick up closing costs, they

may just say "no.” If your original proposal is unacceptable, the seller will usually make a counter offer. While sellers like to get their asking prices, good listing agents prepare them for the possibility of receiving offers that involve some compromises.

What if you make an offer on your perfect house and your Realtor discovers that it already has an accepted offer? Don’t lose all hope! Your Realtor may suggest that you make a back up offer, so that you will be right there and ready if the prospective buyers don't go through with the purchase.

The first rule of being "second in line" is to remain emotionally unattached to that house and to keep looking. Things
