Seller refuses to make repairs Dear Barry:

I just received the inspection report from my home inspector, but I’m wondering if it was worth it. He did a thorough job and found a long list of problems with the electrical wiring, the forced air furnace, and the roof.

But when I asked the seller to have these issues repaired, he said, “The house is as-is. Take it or leave it!” What's the good of having a home inspection, if I have to buy the house in as-is condition?

Rob Dear Rob:

The purpose of a home inspection is not to produce a mandatory repair list for the sellers. It is to inform you of the actual condition of the property so that you will know what you are buying before you buy it, if you buy it. A common homebuyer mistake is to present the seller with an inspection report as though it were a mandatory repair order.

This does not mean that you can't make reasonable repair requests

of a seller, and in most cases, sellers are willing to make some repairs or to adjust the selling price.

Commonly accepted requests involve safety issues such as electrical defects or problems with gas fixtures. Functional problems, especially those involving water leakage, are also regarded as reasonable repair requests. Unfortunately, not all sellers are reasonable about these things, and they are not obligated to make such repairs unless required by law or by the purchase contract.

Real estate transactions often fall out of escrow because buyers use a home inspection report as a redress of grievances or because sellers are rigidly resistant to anything but an as-is sale. My advice is to weigh the costs of the repairs against the

Functional problems, especially those involving water leakage, are regarded as reasonable repair requests. selling price and value of the home. If the selling price plus the repair costs exceed the value the home would have after repairs, you might want to find another property. Keep in mind, also, that there is no such thing as a flawless house.

fine. A month later I had it serviced and found out it was cracked. An old paper that was attached to the fixture says it’s been cracked for over a year.

The home inspector says he is not liable. Is that right?

There are two issues here: the home inspector's findings and the seller's disclosure. If

there was a notice in plain sight on the boiler, the home inspector was negligent for not having read it. If the crack was visible without dismantling the boiler, the home inspector would be liable for failing to disclose a visible defect.

Aside from the home inspector, if the boiler had been tagged with a defect notice by a contractor or other expert, the seller should have

been aware of this and should have made disclosure when you were in escrow.

Either way, someone should take responsibility for this defect, and you should ask the home inspector if he is insured for errors and omissions.

So septic systems are mostly found in rural areas. However, I live above old town Auburn and in our cul-de-sac, there are three homes still on septic systems.

As a listing agent, I encourage my sellers to get their tank pumped and inspected prior to going on the market to eliminate any surprises.

As a buyer’s agent, we will always ask the seller to have their system pumped and inspected as one of our inspection contingencies. Be sure if you are buying or selling to have the septic system pumped and inspected.

Depending on how often and how heavily your system is used will determine how often you should get your tank pumped. Navo recommends every three to five years. However, I have known people who go very easy on their system allowing them to go for many years without pumping.

Going easy means not a lot of use and a minimal

amount of solids (other than human) being put into the system.

Using regular household products will not harm your tank. However, those chemicals will be leaching out into your land at some point.

Also, if heavily used, these soaps can kill the bacteria needed to breakdown the solids in your tank, so it is best to use products that work with your septic system.

Here are some laundry soaps that have been tested and recommended for a healthy septic system: Arm & Hammer Laundry Detergent, Charlie’s Soap Laundry Detergent, Earth Friendly Laundry Products and Dr. Bronner’s Sal Suds.

Using hand soaps that are anti-bacterial are also not good for your system for the same reason mentioned previously.

Mild soaps and shampoos and liquid soaps are best — this includes laundry soaps.

Using biodegradable products is also a plus.

If you use a garbage disposal, plan on hav-

ing your tank pumped a little more often due to the solid waste going into your system.

It is recommended to not have a garbage disposal if you have a septic tank, but that isn’t always the case so be wise about what you put down your kitchen drain.

Those one-time wipes are also hard on your system. Even if the packaging says it is OK to be flushed, it is recommended that they be tossed in the trash. Or better yet, just don’t use them and get a bidet like they have in Europe!

Rent versus own: Which is the right choice for you?

If you’re thinking of buying your first home, you’ve probably wrestled with the decision to rent or own your home — and for good reason.

Owning a home is a big commitment. With it comes a lot of responsibility and a long-term financial relationship.

But which is right for you? To answer that, let’s lean into the facts.

The improving housing market Good news! Since the depths of the recession, the housing market has made a heroic comeback. That can be attributed to a number of factors, including a drop in unemployment

and a stronger economy.

But as the housing market has recovered, it has experienced some growing pains. With a sharp increase in demand, housing supplies are being strained. This means, among other things, that prices are going up.

For families and individuals still recovering financially, finding affordable housing options can be difficult.

This applies to home sales and rentals.

Making the decision With rental and sales markets heading toward record highs, the decision falls back to what is

best for you. Specifically, what is financially feasible.

Let’s look at the basic numbers. According to the U.S. Census Bureau, the median gross rent paid from 2012 to 2016 was $949 monthly. Compare that with the median selected monthly owner costs with a mortgage, which was $1,491 over the same time period.

Then there are utilities. The median monthly electricity cost for renters in 2015 was $82, with owners paying $117.

For piped gas, the median amount renters pay monthly is $42, while owners pay $58.

carry renter’s insurance.

Some landlords will also charge maintenance and other fees. Utility costs will also vary depending on the quality of the structure and materials used as well as size of the rental space.

Homeowners will pay property taxes, insurance and an estimated $500 annually for routine maintenance, according to the Census Bureau.

The benefits of homeownership At a glance, it may seem that renting is the lower cost option. But there are certain benefits to homeownership that may offset the additional

regular costs. According to the Tax Policy Center, the primary benefit to owning a home is imputed rental income. Simply put, making a monthly payment on a home that you own is like paying rent to yourself.

While that money is not taxed, it comes with another benefit — potential tax deductions.

When you file your federal taxes, you may be able to deduct a portion of the mortgage interest you pay. Talk to a tax professional for more information on the expenses you can deduct.

Beyond the numbers
