What exactly is an REO home?

Question:

My husband and I are looking to buy a home.

My friend at church got a great deal buying a REO home. Could you please explain this to us?

Answer:

Thank you for your curious question. REO stands for "real estate owned" and references homes that have been taken back by the banks using the process of foreclosure. The process of foreclosure varies from state to state. In California, lenders are allowed to foreclose on deeds of trust or mortgages in default with the method of judicial or a non-judicial foreclosure process. The process used more often is non-judicial foreclosure or also referred to as trustee's sale.

When a home buyer or borrower stops making their monthly payments to the lender, then they are deemed to be in default. Typically the lender will contact the borrower and may not take action for several

months. Banks are not in the real estate business to buy homes, yet to lend money so folks can buy homes. Banks don't really want to take your home, but to try to create a solution to get the home back on track and caught up on payments. In the event this is not doable, then lenders will begin foreclosure proceedings.

The foreclosure process starts with a Notice of Default referred to as a NOD. Then the lender or the trustee for the lender files the Notice of Default with the county. The homeowner may be delinquent of payment for 15 days or more than one year. The home owner is allowed a certain time frame to resolve the issue — this is often referred to as the reinstatement period. The homeowner

REO stands for “real estate owned.” may reinstate the loan during this time frame by making the delinquent payment current right up until five days prior to the sale of the home.

If the homeowner is not able to redeem the home, then the bank will evict them through the proper process. The bank will try to sell the home through real estate auction for cash in as-is condition and sometimes

without a viewing of the property by the potential buyer. The bank will make no repairs on these homes and there will be no disclosures required.

Remember that some of these homes may have been vacant and unattended to, with the water and gas shut off for years.

This alone may cause problems.

In the event the bank is not able to sell the home through auction,

then the home will usually then be sold on the open market. Usually these homes are offered at less than current market value, but not always. Rest assured, if the home is offered for less than market value then there are typically 10 to 20 offers on the home. The bank is looking for the best offer possible with the hope of a bidding war between the buyers.

If you find yourself wanting to be a contender, I can offer some advice from experience.

Be wise and do your homework with your Realtor first. Have your Realtor do a comparison analysis with similar REO homes in that area. Look at the current market climate — is it a buyer's market or a seller's market? Try to have a contractor evaluate the home before making an offer. If your offer is not all-cash, you most likely will need to increase your offer in order to gain the upper-hand. You may consider offering to pay some of the banks closing cost fees, such as transfer tax, escrow fees and so on. Keep your inspection period as short as possible. Rely on your Realtor's advice as he or she will have some tips and advice to help you win the home.

In October and November, I realized one day while driving that I had feelings of anger and frustration toward other people. It seems there are a lot of aggressive drivers on the road. Everyone is in a hurry, off to their destination and not taking into consideration the people around them. It wasn’t

feeling good to get in my car and be cut off or tailgated and it was affecting me in many ways.

However, once I realized I was turning into the people who were affecting me negatively, I talked about it with some dear friends. They helped me to realize what I needed to do to change my outlook.

I have started taking the necessary steps needed to change my behavior.

I'm worried about my house. Last week, I learned that the foundation violates the building code because it does not extend deep enough into the ground. If the building department finds out, I'm afraid they'll make me build a new foundation. What do you think I should do? ~ Miranda

Dear Miranda:

Municipal building departments are typically not in the business of policing code compliance in existing

buildings. Their primary function is to enforce legal conformity in new construction, additions, alterations, and demolition work. Budgetary constraints and limited personnel restrict their ability to do much else.

Exceptions to this generally occur when complaints are filed by neighbors. For example, someone might notify the building department

when a non-permitted addition blocks their view, or when someone converts their backyard shed to a rental unit, or when there are blatant safety violations involving electrical wiring, gas piping, or fire safety. It is unlikely, however, that a shallow foundation would offend or even attract the attention of anyone, unless of course your house is sinking

into the ground or breaking apart.

Non-complying conditions of one kind or another can be found in nearly all homes. The discovery and citing of such conditions would require a code-enforcement bureaucracy the size of the IRS, with new forms of taxation to provide requisite funding.

Intermittent popping sounds in an attic occasionally occur in homes with clay tile roofs.

In most cases, the noises are caused by thermal expansion of the wood framing and hardware as daily temperatures rise and fall. Typically, this is more of a nuisance problem than a serious construction defect. However, substandard workmanship or faulty roof design is a possibility that should not be ruled out until you've obtained an engineer's evaluation of the attic framing.

If the problem is structural, additional symptoms may include cracks in walls and misalignment of doors. Whether structural or not, total elimination of the popping noises may or may not be possible. Minimizing them may be the most you can reasonably expect. An effective step in this process is to reduce heat build-up in the attic by means of increased ventilation. A few turbine vents along the ridges can lower attic temperatures on warm days as much as 30 degrees, and even more during the summer. Reducing temperature changes in the attic can reduce expansion of the structural components of your roof.
