Contractor loses job over asbestos bid Dear Barry:

I hope you don’t mind another asbestos question. As a general contractor, I was bidding on the remodel of an old home. The ceilings had acoustic texture, sometimes known as “popcorn,” so I included the costs of testing and possible asbestos removal in my bid. The homeowners complained that two other contractors had also bid on the job and that neither contractor had mentioned asbestos.

If you stand near a wood fire, you will enjoy the warmth of radiant heat, but while this is happening, the convection that draws smoke up the chimney is also drawing the warm air from within your house, sending it in the direction of Santa Claus after the stockings have been stuffed.

If you wish to heat your home by burning wood, the best approach is to install a fireplace insert. Basically, this is a wood-burning stove, specifically designed to be set into the combustion chamber of a fireplace.

To determine which insert model will fit your fireplace and provide the greatest amount of heat per volume of wood, consult a certified chimney sweep. And be sure to have an approved flue liner installed inside the masonry chimney.

Is a lease option better for seller or buyer?

Question:

My husband just took a job offer in California.

We were both so excited until we saw the high home prices. Someone mentioned something called a “lease option.”

We were wondering if you could let us know what this means?

Answer:

Thank you for your good question. A little bit of history with lease options sales — they were very popular instruments in the late 1970s and early 1980s. They were typically used to avoid mortgages. There are several reasons a property owner might want to use the lease option contract, such as tax purposes, or if the seller could not obtain the price they want in the current market, or perhaps they like the monthly income to name a few. There are various types of contracts and titles of specific methods to the general process of lease option, rent to own, lease purchase, etc.

Please note that usually the agreed upon purchase price is generally a bit higher than the current market value, which is an advantage to the seller. you can have the general idea of what may be of benefit to each party.

The basics of the lease option: A buyer pays the seller a sum of money called option money for the right to lease purchase the property. The option money may be substantial or as little as one dollar; this is, of course negotiable. The buyer and seller will lock in the future purchase price upon execution of the option to purchase.

The option money is almost always not refundable.

During the option period no one else can buy the property. The buyer is not obligated to buy the property at the end of the option term. However the seller is obligated to the contract to sell at the agreed upon terms if the buyer decides to follow through with the purchase. During the time of the lease option the buyer will be paying a monthly agreed upon rent and some of the rent money may or may not apply to the lease option initial amount. This is all negotiable between the owner and buy.

Please note that usually the agreed upon purchase price is generally a bit higher than the current market value, which is an advantage to the seller. The buyer cannot offer the lease option to anyone else without the sellers’ approval. The buyers are often given the responsibility for maintaining the property and paying for all the

expenses related with the upkeep and perhaps other expenses. If the buyer keeps all the receipts and if the lease option is not exercised then perhaps you negotiate up front that the buyer would be reimbursed for those particular costs.

Here are some possible benefits for the buyer: • Time to repair credit, if applicable • Minimum cash out of pocket • Portion of rent monies going towards purchase • Quick move in time • Usually no down payment owed at the end of the term because part of each month rent is going to the down payment Here are some possible benefits for the owner: • Top sales price • Higher than normal rent • No vacancies • Non-refundable option deposit • Peace of mind • Highest quality tenants • Residual income • No maintenance
