Letter or the intent of disclosure laws Dear Barry: We bought a house a couple months ago, and there are railroad tracks running behind the back fence. The sellers and the Realtor said the tracks were used on weekends only for an old, historic train that takes tourists to the Ft Worth Stockyards. This was stated in the listing flier and in the disclosure statement. What they concealed from us was a bill that was passed by the city council two years ago, opening these lines to commuter trains that will be running as frequently as every 20 minutes. When we asked our Realtor why this wasn't disclosed to us, she said they only had to disclose the railroad tracks’ existence and not what will eventually be running on them in the future. We feel that this was totally dishonest, but we don’t know if we have any recourse. What can we do? Real estate disclosure laws vary from state to state. Some requirements are more strict and exacting than others. In your state of Texas, disclosure standards deal almost exclusively with actual physical defects on the property. In some states, such as California, there are requirements to disclose additional issues, such as “neighborhood noise problems or other nuisances,” which of course would call for disclosure

This standard of disclosure is based upon two consider-

ations: 1) that failure to disclose is a violation of professional ethics; and 2) that non-disclosure exposes agents and sellers to legal liability and lawsuits. Whether the sellers and Realtor are liable for non-disclosure is uncertain. Whether they are guilty of unethical business practices is without question, assuming

that they knew about the proposed changes in railroad usage. On the chance that there may be more to the disclosure law than is apparent on the surface, you should have this matter reviewed by a real estate attorney to see if you have legal discourse. It may also be possible to file an ethics complaint against the Realtor with

Now we can realize in some cases it can make sense to only work with one spouse. Although some mortgage loans do not require both spouses to be on the loan. There could be a requirement of the non-borrowing spouse to acknowledge the loan mortgage and perhaps provide their credit score. Working with only one spouse as the mortgage borrower then that person is solely financially responsible for re-

paying the loan. Usually in the event a mortgage payment is missed or the loan is defaulted on, the effects will only be applied to that spouse on the loan and not the other spouse. When there is only one spouse on the mortgage loan then the other spouse’s name will not be on the deed to the home. However, after the close of escrow, the non-borrowing spouse can be added to the title by filing a quitclaim deed as long as both parties agree. Before you make this vast decision I would suggest seeking advice from sources such as a tax professional, a real estate attorney or a financial advisor. Home warranties not created equal Having a home warranty is a smart way to help deal with the inevitable home repair problems that all property owners face at one point or another. After all, a good home warranty can mean getting expert help when your HVAC system needs to be fixed, your water heater needs to be replaced, or your refrigerator requires a new part. But unfortunately, all home warranties are not created equal. And shopping for a home warranty can be tough, especially if you aren't familiar with home warranty coverage

and providers. So to find a home warranty that will protect your home and budget, here are three important questions to ask, along with a few tips on what to look for in a top-notch home warranty.

1. What's covered? Some home warranties are only good for appliances. Others focus on systems within your house, such as your air conditioning, heating or plumbing systems. The best warranties offer broad protection at a fair price, and even allow you to select from vari-

ous coverage approaches based on your needs. When shopping around, inquire about exclusions, limitations and non-covered expenses. Most, if not all, plans DO have these. For example, there may be a cap on the amount of coverage for a particular item; an environmental disposal fee, required in some counties, may be excluded from coverage; or modifications, not covered under the home warranty, may be needed to bring a covered system up to code or in compliance with new standards.

When purchasing an American Home Shield warranty, you choose a $75, $100 or $125 fee for your service requests, which gives you the flexibility to pay more or less for your annual contract. As with all home warranty companies, the price of an American Home Shield warranty plan varies based on multiple factors, including the specific type of plan you choose and your state of residency. But basic coverage starts at about $300 and goes up to around $600 annually for more comprehensive plans - a bargain considering the cost of replacing things in your house that will likely break down at some point. When considering cost factors, also ask if all the items you want covered are included in the base cost of the plan, or

While the primary goal of a home warranty is to repair or replace covered items so that they function mechanically, American Home Shield covers both mechanical repairs and certain non-mechanical items, such as handles, doors, knobs and shelves. That doesn't mean everything is covered, of course. So let's say your child stands on your dishwasher door and breaks the seal. Sorry, but that is NOT a covered repair, because it is not "normal" wear and tear. Also, what happens if a repair person comes to your home and, despite his or her best efforts, simply can't fix something

covered under your home warranty? With an AHS home warranty, if a repair person can't fix a covered item, AHS will replace it. That doesn't mean you will necessarily get the precise brand and color of, say, a washing machine or dryer. After all, you may have bought your laundry set four years ago, and the manufacturer might not even make those exact same models or colors today.
