Reducing Single Use Items By Emily Echevarria

From the appearance of biodegradable paper straws where plastic ones were once stocked to the suddenly commonplace instance of coffee fiends handing over their own tumbler to the barista, there’s a growing consciousness among consumers regarding plastic, single-use items. Reusable grocery totes have been ubiquitous for years but items like to-go coffee and drink cups, plastic bags and baggies, plastic straws, plastic wrap and plenty of other items are under scrutiny from those looking to reduce waste in their homes and lives. Luckily, there are a bevy of strategies and products that can help on the journey to reducing plastic waste. Mary Gutierrez, executive director at Earth Action, Inc. has been working on the issue of plastic waste for years, and said she is happy to see it gaining steam among so many people. Earth Action, Inc. is a 501 (c)(4) that works to promote effective change for environmental, social, and animal advocacy issues. Earth Ethics, Inc. is the associated 501 (c) 3 non-profit organization dedicated to helping the environment. “Earth Ethics has a plastic campaign that we’ve been working on for several years now,” Gutierrez said. “We also just recently become an official partner for the international/national organization Plastic Pollution Coalition.” The Plastic Pollution Coalition (PPC) is a growing global alliance of more than 700 organizations, businesses and thought leaders in 60 countries working together on initiatives and legal actions that aim to reduce plastic pollution. These big-picture initiatives are a necessary part of reducing plastic waste, but individuals can make adjustments and change small habits to reduce plastic waste that can go unnoticed because of its prevalence. Being more mindful of plastic use and wasteful products, packaging, and general waste is a good place to start when looking toward more sustainable living. The Last Straw While something like a plastic drink straw seems like a small and humble convenience of daily life, it’s only in the last few decades that consumers have come to expect them in every drink they’re served in restaurants or drivethroughs, and those hundreds of millions of straws used on a daily basis add up in both landfills and littering waterways. Data from the Ocean Conservancy’s International Coastal Cleanup list indi-

cates that straws place consistently in the top ten list of items found in cleanup efforts. Straws sit at number six, just below plastic bottles (the broad category of plastic pieces is number one). Luckily, it’s also an easy thing to give up or replace with a more sustainable counterpart. Ever’man Cooperative Grocery stocks two options for reusable straws, a silicone straw by KoffieStraw, and a stainless steel version by U-Konserve. Both are perfect for your morning smoothie and easy to carry along for that iced latte you grab on your way into work. You can also support local business and buy bamboo straws from Bob’s Bamboo, a company that hand-makes eco-friendly products with locally harvested bamboo right here in Pensacola. Robert Smyres was a landscaper and farmer by trade when he decided to upcycle some bamboo trimmings from a job. “I took some bamboo in my workshop and made my own set of a few bamboo straws and used them at home for another four or five years,” he said. Only about a year ago he started the Bob’s Bamboo business and says the response has been great. They’re available locally at East Hill Market, Shirley’s Cafe, Four Winds International Market and Geronimo’s Outpost on the beach, and he also ships them to clients in other parts of the country. The straws come in a variety of sizes – big and tall for smoothies or boba drinks, or thinner and shorter for cocktails or coffee. He also sells straw sets, and takes custom orders through the etsy shop SaveEarthProducts. The unique straws are sturdy, dishwasher safe and last for years. He’s currently working on a reusable bamboo spoon to use with the icy treats served at the Rajun Cajun Sno-balls truck. Smyres says he hopes the business continues to grow and in doing so, inspires others to replace the plastic items in their lives. “A plastic straw may just be one thing to replace but it does remind people that if you try you can find something else instead of the plastic,” he said. Modify Your Lifestyle It may seem like an insurmountable challenge to eliminate plastic waste from your life completely, but there are plenty of great places to start when it comes to at least reducing your impact. Gutierrez recommends taking stock of the single-use plastic items you use

in your daily life and start with the lowhanging fruit. Maybe you dutifully bring your grocery totes to every trip to the store, but still use plastic produce bags that can easily be swapped for small mesh or canvas bags. Ever’man sells tote size ChicoBag products as well as a string market bag perfect for your avocado haul by Down To Earth. Also in the produce section, look for produce items that aren’t pre-packaged. Based on your comfort level, Gutierrez says you might also talk to business owners about utilizing these types of unnecessary plastic packaging and advocate for a more sustainable approach. Considering your kitchen and eating on the go, Gutierrez suggests bringing your own silverware to use if you’re heading to a restaurant or cafe that uses plastic ware. For packing for lunches or eating on the go, plastic baggies are a staple, but there are plenty of other options. Most things you would carry in a baggie could also be placed in a reusable container, or in a product like LunchSkins reusable bags, also available at Ever’man. In the bathroom, consider the bottles that encase things like shampoo, lotions, soaps, body wash and the like. Some of

these items can simply be swapped for ones that don’t use plastic, like bar soap or shampoo bars that come wrapped in paper instead of wash that is packaged in plastic. You could also try a DIY approach to a few of these items and store them in reusable containers, like Freund Reusable Bottles from Ever’man. For your dental care needs, Ever’man also carries Eco Dent Premium Dental Floss, a vegan, recyclable product that does not come in the typical plastic box. Make Your Own Personal Care Products Courtesy of Earth Action Did you know that personal items come in single use plastic containers? Most containers can’t be or aren’t recycled. Buy a glass jar or tin for storing your homemade goods. Not only are homemade goods not using plastic, there are also no fillers, metals or other harmful chemicals. DEODORANT Ingredients: 1⁄2 cup baking soda 1⁄2 cup corn flour A few drops of tea tree oil 2 whole bay leaves Instructions: Combine. Moisten underarms or apply before drying after a shower. Pat on with a cotton ball or sprinkle on a wet washcloth. TOOTHPASTE Ingredients: 4 teaspoons baking soda 1 teaspoon table salt Instructions: Mix the ingredients together. You can make some of this up in advance, just multiply and use four-parts baking soda to one-part salt. Take some of the mixture and add just enough water to make a paste.

The Judicial Conference of the United States is expected to authorize the appointment of a full-time U.S. Magistrate Judge for the Northern District of Florida in Tallahassee. The deadline for applying for the Magistrate Judge position is Aug. 1. The duties of the U.S. Magistrate Judge are demanding and wideranging. Magistrate judges conduct most preliminary proceedings in criminal cases; trials and disposition of misdemeanor cases; various pretrial matters and evidentiary proceedings on delegation from a district judge; and trials and disposition of civil cases upon consent of the litigants. To be qualified, an applicant must: • Be, and have been for at least five years, a member in good standing of the bar of the highest court of a state, the District of Columbia, the Commonwealth of Puerto Rico, the Territory of Guam, the Commonwealth

of the Northern Mariana Islands, or the Virgin Islands of the United States, and have been engaged in the active practice of law for a period of at least five years (with some substitutes authorized) • Be competent to perform all the duties of the office; be of good moral character; be emotionally stable and mature; be committed to equal justice under the law; be in good health; be patient and courteous; and be capable of deliberation and decisiveness • Be younger than 70 years old • Not be related to a judge of the U.S. District Court for the Northern District of Florida A merit selection panel composed of attorneys and members of the community will review all applicants and recommend to the U.S. District Judges for the Northern District of Florida, in confidence, the five persons it considers best qualified. The court will appoint an individual to the U.S.

Magistrate Judge position following a FBI background investigation and an IRS tax check. The individual selected must comply with the financial disclosure requirements pursuant to the Ethics in Government Act of 1978. An affirmative effort will be made to give due consideration to all qualified applicants without regard to race, color, age (40 and older), gender, religion, national origin, or disability. The current annual salary of the position is $191,360. The term of office is eight years. Applications and additional information about the U.S. Magistrate Judge position may be obtained from the Office of the Clerk of Court at all four divisional offices of the U.S. District Court for the Northern District of Florida and on the Court’s Internet website at www.flnd.uscourts.gov. Appointee Sought for Housing Finance Authority The Escambia County Board of County Commissioners is seeking Escambia County residents interested in volunteering to be considered for an appointment to the Escambia County Housing Finance Authority. Appointees serve without compensation. Escambia residents interested in serving on the Escambia County Housing Finance Authority are asked to submit a resume and letter indicating their desire to serve by 5 p.m. Monday, June 17. The Escambia County Housing Finance Authority was established in accordance with Florida law. The authority’s duties are to assist in eliminating shortages of adequate housing, stop reoccurrence of slum conditions and stimulate employment and commerce. Knowledge in the area of labor, finance or commerce required. Authority members serve a four-year term of office. Financial disclosure is required. Requirements: • The authority’s regular meetings are held the second Tuesday of every month and typically last between one to two hours (i.e. 24 hours annually). Board members are also required to

attend special meetings that are occasionally called on an “as needed” basis in connection with proposed multi- and single-family financings.

• Board members must review various documents (official statements, trust statements, loan agreements, etc.) prior to each monthly meeting. Preparation time generally ranges from one hour for a normal meeting, to four to six hours if there is a substantial item on the agenda. • Board members are also required to be available for any bond issue closings that occur during the year and to also make time during the month to consult with the executive director (and/or be available to sign documents, checks, etc.) as needed in connection with routine authority business. • Board members are also strongly encouraged to participate in various educational workshops and conferences sponsored by the National and Florida Associations of Local Housing Finance Authorities (approximately two a year) in an effort to stay abreast of emerging trends and changes to all the various laws and regulations in the housing finance and municipal finance industries (such as their due diligence responsibilities before approving a bond issue, SEC/MSRB regulations, disclosure responsibilities, etc.) that impact the authority’s mission of providing safe, decent and affordable housing.

Seasonal Services Underway at the Fort Pickens Area The seasonal tram service in the Fort Pickens Area began on Monday, May 20. The trams are operated by Dreamcatcher Shuttle Service of Pensacola, Fla., through a service contract and will largely mirror the tour boat operating schedule. The service is available for all visitors at no charge and will make stops at the Fort Pickens Plaza, Campground, and Langdon Beach. Trams will stop at each of the three shuttle stops between 9:30 a.m. and 5:30 p.m. daily. The new service utilizes electric tram vehicles which can carry 27 passengers and travel at regular park speed limits. The fully accessible vehicles feature solar panels to extend the battery charge and drive time. It offers tour boat passengers and campers a convenient way to access the swim area at

Langdon Beach while offering day-use visitors an easy way to move about the park including the Mine Storeroom, which opened on Friday, May 17. The Mine Storeroom is operated by Pensacola Bay Cruises and is offering snacks, cold drinks, and ice at the Fort Pickens Plaza. The Mine Storeroom is open Monday – Thursday 9:30 a.m. to 4 p.m., and Friday – Sunday 9:30 a.m. to 6 p.m. Pensacola Bay Cruises began their summer operation on Friday, May 17, offering all-day hop-on, hop-off cruises between Fort Pickens, Pensacola Beach, and downtown Pensacola. Visitors arriving by tour boat to Fort Pickens are not required to pay the park’s entrance fee. For more information about the tour boat service in Pensacola Bay visit www.cruisepb.com.

ECFR to Dedicate New Special Ops Apparatus Escambia County Fire Rescue invites the public to join in celebrating the arrival of the new Squad 3 Apparatus at a push-in ceremony on Saturday, June 8 at 11 am at ECFR Station 3, 5925 N. W St. This brand-new apparatus is built to facilitate ECFR’S Special Operations response and fire suppression operations throughout Escambia County, along with operations across the region as needed. At the ceremony, Station 3 firefighters will continue the longstanding fire service tradition of pushing the apparatus into the station bay, commemorating the arrival of a new apparatus into service. Pastor Gordon Godfrey of Marcus Pointe Baptist Church will provide the invocation, and the McGuire’s Pipe Band will lead a short procession behind the ECFR Honor Guard. Squad 3 is a brand-new Pierce PUC built in Appleton, Wisconsin. Along with a four-person crew, it will carry equipment needed to facilitate heavy rescue, extrication, entrapment, medical, high/low angle and fire suppression emergencies. Squad 3 will replace an ECFR en-

gine and rescue apparatus that both responded to a charter bus crash in March 2018 on Interstate 10, which involved a bus falling into a 50-foot ravine while transporting high school students. The crew used rope rescue techniques to evacuate several seriously injured students from the ravine and provided extrication expertise to rescue and remove trapped victims from the wreckage. This Technical Rescue Team is the only one of its sort between Mobile, Alabama and Tallahassee, Florida. The old engine and rescue apparatus will be placed into reserve status to be utilized when front line equipment is down for maintenance or repairs. This apparatus, along with the advanced level of training of the firefighters assigned to Special Operations, will help Escambia County Fire Rescue continue to provide a high level of emergency services to the citizens of Escambia County. Senior Chill Out to help elders remain safe and cool this summer The annual Senior Chill Out, a oneday donation drive to collect new air conditioners, fans and/or funds to help seniors beat the heat, will be held by Council on Aging of West Florida, WEAR ABC 3, WFGX 35, Cat Country 98.7, NewsRadio 92.3, and Lowe’s Home Improvement on Friday, May 31 at area Lowe’s stores (Fairfield Drive, Airport Boulevard and Nine Mile Road in Pensacola; Highway 98 in Gulf Breeze; and Highway 90 in Pace) from 6 am to 6:30 pm. The community is encouraged to help seniors who experience dangerous health complications as a result of the stifling summer heat by donating ACs or fans. Monetary contributions are also appreciated. According to the Centers for Disease Control and Prevention, more people die from exposure to extreme heat each year than from hurricanes, lightning, tornadoes, floods and earthquakes combined. The elderly are particularly vulnerable to the adverse effects of excessive heat due to their body’s decreased ability to regulate temperature. They are also in potential peril because of medical conditions and prescription medicines that can impair their ability to feel hot or even perspire.

“It’s extremely uncomfortable and even dangerous to elders for their homes to reach 90 degrees inside during the summer,” said John Clark, President/CEO of Council on Aging. “Our community partners enable us to tangibly make life better for these frail, older adults.” Each year, hundreds of local elders are helped through the program. In 2018, Council on Aging was able to assist nearly 600 at-risk older people avoid the costly and hazardous effects of heat-related health complications. “A car accident years ago resulted in two knee surgeries and brain injuries,” said Veronica Minor, a 64-year-old who lives with her brother and granddaughter. “I can only work about 10 hours a week, so I can’t afford to repair my central AC unit. Thanks to Council on Aging, we have window units in almost every room, so my granddaughter and I can remain cool and comfortable through the summer.” Information on heat stress and heat stroke will be available at the event, as well as information on how our community’s vulnerable seniors can receive donated AC units and fans.

Mayor Accepting Applications For Appointment To Downtown Improvement Board Mayor Grover Robinson announced today he is beginning to take applications for appointment to the Downtown Improvement Board (DIB). Mayor Robinson will be making three appointments to fill upcoming vacancies on the DIB board. Members are appointed to three-year terms by the mayor and are approved by the city council.

Those who are interested in serving on the DIB will need to fill out an online application. Forms are available on our website cityofpensacola.com. The deadline to submit an application is tomorrow, May 30 at 5 p.m. ABOUT THE DIB The DIB is a Dependent Special District funded by a special tax levy on properties within its district boundaries. The district

consists of 44 blocks that encompass the urban core of downtown Pensacola. The mission of the DIB is to promote and enhance Downtown Pensacola as a vibrant cultural and commercial destination for residents, businesses, and visitors. Squad 3 will replace an ECFR engine and rescue apparatus that both responded to a charter bus crash in March 2018 on Interstate 10, which involved a bus falling into a 50-foot ravine while transporting high school students. The crew used rope rescue techniques to evacuate several seriously injured students from the ravine and provided extrication expertise to rescue and

remove trapped victims from the wreckage. This Technical Rescue Team is the only one of its sort between Mobile, Alabama and Tallahassee, Florida. The old engine and rescue apparatus will be placed into reserve status to be utilized when front line equipment is down for maintenance or repairs. This apparatus, along with the advanced level of training of the firefighters assigned to Special Operations, will help Escambia County Fire Rescue continue to provide a high level of emergency services to the citizens of Escambia County. DESANTIS SIGNS INSURANCE ‘AOB’ OVERHAUL

TALLAHASSEE – After repeated legislative battles about the issue in recent years, Gov. Ron DeSantis on Thursday signed a bill that will revamp the controversial insurance practice known as “assignment of benefits.” DeSantis and other supporters of the bill (HB 7065) pointed to abuses of the socalled AOB process. The bill signing, while expected, was a major victory for the insurance industry, which contends that AOB fraud and excessive litigation have helped lead to higher property-insurance rates. “I thank the Florida Legislature for passing meaningful AOB reform, which has

become a racket in recent years,” DeSantis said in a prepared statement. “This legislation will protect Florida consumers from predatory insurance practices.” Assignment of benefits is a decades-old practice that has become controversial in recent years, at least in part because of an increase in residential water-damage claims. Those claims have primarily dealt with issues such as broken water pipes and leaks, rather than hurricane damage. In assignment of benefits, property owners in need of repairs sign over benefits to contractors, who ultimately pursue payments from insurance companies. While insurers have complained about fraud and litigation, plaintiffs’ attorneys and other groups argue AOB helps

make sure claims are properly paid. They accuse insurers of often trying lowball amounts paid for work. Lawmakers in recent years considered changes to the AOB process but could not reach agreement, amid heavy lobbying by groups on both sides of the issue. This year, however, the House and Senate bridged differences and sent the bill to DeSantis. The bill includes numerous changes, including creating a system that will effectively limit attorney fees in AOB lawsuits filed by contractors against insurers. The fee changes, which involve a formula, would not apply to lawsuits filed by policyholders. Also, the bill will let insurers offer policies that restrict or do not allow assignment of benefits. The concept is that

such policies could be offered at lower prices to homeowners. The AOB bill was one of 25 that DeSantis signed into law Thursday. Several of the measures were what are known as “local” bills, which deal only with issues in specific parts of the state. Also, DeSantis signed a series of “claim” bills, which direct government agencies to pay money because of injuries or deaths. Ordinarily legal damages in such situations are capped by the state’s sovereign-immunity laws. Among the other bills signed was a measure (SB 186), sponsored by Sen. Tom Lee, R-Thonotosassa, that creates a public-records exemption for photos, videos or audio recordings that depict the killing of victims of mass

violence. Such incidents of mass violence are defined in the bill as involving the killing of three or more people, not including the perpetrators. The bill pointed to the potential impact on victims’ family members if such photos or recordings are made public and cited mass shootings in recent years at Pulse nightclub in Orlando, the Fort Lauderdale-Hollywood International Airport and Marjory Stoneman Douglas High School in Parkland. In addition, DeSantis signed a measure that will make it a crime to sell, distribute or show child-like sex dolls. Supporters of the measure (SB 160), such as Senate sponsor Lauren Book, DPlantation, said it is designed to combat pedophilia.

MORE MENTAL-HEALTH TREATMENT SOUGHT FOR CHILDREN CHRISTINE SEXTON NEWS SERVICE OF FLORIDA TALLAHASSEE – Florida has an estimated 400,000 children who need behavioral-health services, but 55 percent of them don’t get any treatment, members of a health-care panel were told Thursday. That translates to 220,000 children across the state, or about one child in every classroom, health official Jeffrey Brosco told members of the Florida Healthy Kids Corp. Board of Directors during a meeting in Orlando. “There’s 220,000 children that get no treatment, whatsoever. Let that sink in,” Brosco told the board members, who are charged with running the Florida Healthy Kids program, which offers health and dental insurance for children ages 5 through 18. “If I told you there were 200 kids with cancer who aren’t getting treat-

ment, you’d say, ‘That’s outrageous.’ Two thousand, twenty thousand, you would be up in arms,” he said adding, “It’s outrageous.” Part of the problem, Brosco said, is a lack of availability of health providers. According to Brosco’s presentation, Florida has one psychiatrist who treats children and adolescents for every 100,000 children. Brosco is director of Florida’s “Title V” funding program, which supports efforts to improve the health and wellbeing of mothers and children, including children with special needs, and their families. Brosco wants to use the Title V program to help build regional collaboratives anchored by schools including Florida State University, Florida International University, the University of Florida, the University of South Florida and the University of Miami. Florida has $20 million in Title V

money this fiscal year, and Brosco said he wants to target $9 million to help establish the regional collaboratives. Through the collaboratives, Brosco hopes to help increase the capacity of primary-care providers such as pediatricians, family doctors and advanced registered nurse practitioners to identify and treat what Brosco called common pediatric mental-health conditions, including attention deficit hyperactivity disorder, or ADHD, anxiety and depression. Another way to increase access is through telehealth consultation services, Brosco said. Generally, telehealth involves using the internet and other technology to provide health care remotely to patients. Access to mental-health services has drawn heavy attention in the Legislature since the mass shooting last year at Marjory Stoneman Douglas High School in Parkland that killed

17 people. Attention this year also focused on the suicides of two students who had survived the shooting at the Broward County school. Lawmakers this month approved a 2019/20 state budget that includes $75 million for mental-health services at schools, a boost from the $64 million given to school districts for the current year. The money is linked to the Marjory Stoneman Douglas High School Public Safety Act passed after last year’s shooting. Florida First Lady Casey DeSantis also has made mental health one of her priorities and earlier this month announced what she calls the Hope for Healing campaign. The campaign will pull in resources from the state Department of Education, the Department of Children and Families and the Department of Juvenile Justice to help youths and families avert drug addiction and address mental-health issues.

APPROVAL OF DISASTER RELIEF PACKAGE DELAYED NEWS SERVICE OF FLORIDA A long-stalled federal disaster relief package, which is expected to help the Panhandle’s recovery from Hurricane Michael, will have to wait for a vote until the U.S. House returns from this weekend’s holiday recess. U.S. Rep. Chip Roy, R-Texas, raised an objection Friday that blocked the $19.1 billion aid package from advancing through the House via unanimous consent, after the Senate voted 85-8 in support of the bill Thursday. “If I do not object, Congress will have passed into law a bill that spends $19 billion of taxpayer money without members of

Congress being present here in our nation’s capital to vote on it,” Roy said from the House floor. “Secondly, it’s a bill that includes nothing to address the clear national emergency and humanitarian crisis we face at our Southern border.” Roy, while arguing that the disaster package does not specify funding sources to offset an increase in the national debt, called a White House push to include $4.5 billion for border security in the package “quite modest.” Along with providing aid to areas of Northwest Florida and Georgia that sustained damage in October’s Hurricane Michael, the package addresses flooding and wildfires in other parts of the coun-

try. The House is set to return Tuesday. Two weeks ago, the Democratic-led House approved a $19 billion disaster-aid package, despite opposition from President Donald Trump over additional funding Democrats want for Puerto Rico, which continues to recover from Hurricane Maria in 2017. The House and Senate then negotiated a package that includes $900 million in assistance for Puerto Rico and $1.2 billion to help rebuild Northwest Florida’s Tyndall Air Force Base, which is close to where the Category 5 Hurricane Michael made landfall with 160 mph sustained winds. If approved by the House, the package would then go to Trump.

SUPREME COURT REVERSES COURSE ON EXPERT WITNESSES Jim Saunders News Service of Florida

TALLAHASSEE – In a move that left little doubt about the new direction of the Florida Supreme Court, justices on Thursday reversed a controversial 2017 decision about the testimony of expert witnesses in lawsuits. While drawing relatively little public attention, the expert-witness issue has been a political battleground for business groups and plaintiffs’ attorneys. The ruling Thursday effectively sided with the position of business groups and Republican lawmakers – and cemented that the newly revamped Supreme Court is willing to reverse course on past decisions. After taking office in January, Republican Gov. Ron DeSantis appointed justices Barbara Lagoa, Robert Luck and Carlos Muniz to replace longtime justices Barbara Pariente, R. Fred Lewis and Peggy Quince, who were forced to leave because of a mandatory retirement age. The appointments have turned what was widely

viewed as a liberal court into a conservative court. The 5-2 ruling Thursday was rooted, at least in part, in a 2013 law approved by the GOP-controlled Legislature and then-Gov. Rick Scott. The business-backed law tightened a standard for expert witnesses, whose testimony can play a pivotal role in complicated civil and criminal cases. Supporters of the 2013 law argued that the state needed to prevent testimony that is “junk science.” Lawmakers decided to move to what is known in the legal world as the “Daubert” standard, which is more-restrictive than the state’s longstanding expert-witness standard, known as the “Frye” standard. Federal courts use the Daubert standard, but opponents of using it in Florida courts said it would make cases more expensive and time-consuming. In 2017, however, the Supreme Court, which has the power to set court procedures, blocked the move to the Daubert standard. The majority in that 4-2 decision – Pariente, Lewis, Quince and Justice Jorge Labarga – pointed to “grave

constitutional concerns” about the Legislature’s effort to change the standard. Dissenting in the case were justices Charles Canady and Ricky Polston. On Thursday, however, Canady, Polston, Lagoa, Muniz and Justice Alan Lawson made up a majority that said it had decided to “recede” from the earlier decision. As a basis, it pointed to “this court’s exclusive rulemaking authority and longstanding practice of adopting provisions of the Florida Evidence Code as they are enacted or amended by the Legislature.” “Whereas the Frye standard only applied to expert testimony based on new or novel scientific techniques and general acceptance, Daubert provides that ‘the trial judge must ensure that any and all scientific testimony or evidence admitted is not only relevant, but reliable,’ ” the opinion said. “Moreover … the Daubert amendments will create consistency between the state and federal courts with respect to the admissibility of expert testimony and will promote fairness and predictability in the legal sys-

tem, as well as help lessen forum shopping.” But Labarga, in a dissent, pointed to recommendations from a Florida Bar committee that played a role in the Supreme Court’s 2017 decision to not change the standards. “I agree with the committee that the Daubert amendments create a significant risk of usurping the jury’s role by authorizing judges to exclude from consideration the legitimate but competing opinion testimony of experts,” Labarga wrote. “Where evidence is not based upon new or novel science, juries should be permitted to hear the testimony of experts, evaluate their credibility, and analyze and weigh their opinions and conclusions to reach a just determination on the issues presented by the case.” Luck, one of the DeSantis appointees, also dissented, saying the Supreme Court did not follow its procedures before issuing the decision Thursday. Those procedures involve committees and The Florida Bar Board of Governors studying proposed court rule changes and making recommendations.

“Because we established mandatory procedures for exercising our rulemaking authority (under part of the Florida Constitution), we are as required to follow them as everyone else,” Luck wrote. “There is no exception for administrative ease, and there is no proviso for we’ve-heard-it-all-before.” Since DeSantis appointed the new justices, speculation has swirled about issues that the court could address – and possibly revisit. The News Service of Florida reported this week, for example, that justices are weighing whether to undo a major 2016 ruling in death-penalty cases. William Large, president of the Florida Justice Reform Institute, a group that lobbied for the 2013 expert-witnesses law, pointed to potentially far-reaching ramifications of Thursday’s decision. “The Florida legislature passed the Daubert expert evidence standard in 2013, but a previous majority of the Florida Supreme Court refused to acknowledge that change,” Large said. “The court’s decision today to finally adopt the Daubert standard will change the face of Florida jurisprudence.”

Red, White and Blue Watermelon Parfait 1 cup blueberries 1 container (6 ounces) Greek yogurt (vanilla, lemon or coconut) 1 cup watermelon, plus three pieces diced watermelon whipped cream, for serving In pint canning jar, layer blueberries, yogurt and 1 cup watermelon. Top with whipped cream and garnish with three diced watermelon pieces. Note: To make ahead or make thicker, drain Greek yogurt on paper towels to absorb some liquid.

Patriotic Charcuterie Board 1/2 medium seedless watermelon, cut into wedges 1/2 cup fresh raspberries 1 1/2 cups fresh blueberries 10 strawberries (dipped in white chocolate, if desired) 5 ounces fresh goat cheese 1/2 cup toasted, salted cashews 2 ounces cured meats like prosciutto, pancetta, coppa, salami, soppressata, sausage or pepperoni 1 Honeycrisp apple, cored and sliced lemon juice fresh basil leaves On large board or platter, arrange watermelon, raspberries, blueberries, strawberries, cheese, cashews, meat and apples. Patriotic Fruit Salad 1 watermelon honeydew blueberries Slice 1/4 inch off bottom of watermelon, lengthwise, to create stable base. Use pencil to draw zig-zag lines for basket opening. Using paring knife, make cuts through rind. Carefully remove top section, pull out large chunks of flesh and cut them into 3-by-3-inch squares. Trim 3/4-inch thick slices off squares to use for cutting out stars with 1 1/2-3-inch, star-shaped cookie cutters. Use ice cream scoop to remove flesh from inside basket and cut scoops into quarters for fruit salad. Place in bottom of basket. Add honeydew and blueberries; stir to combine. Cut out white stripes from honeydew. Garnish top of fruit salad with watermelon stars, honeydew stripes and blueberries.

Flag Kebab Cake 1 pint fresh, washed blackberries 12 wooden skewers 1 seedless watermelon, flesh cut into 1-inch cubes 1 angel food cake, cut into 1-inch cubes (white part only) dips, such as yogurt, chocolate, caramel or marshmallow (optional) Thread five blackberries on each of five skewers, followed by alternating watermelon and cake cubes. On remaining skewers, alternate watermelon and cake so first and last cubes are watermelon. Place skewers on platter; fruit and cake will create stars and stripes when lined properly. Serve with dips, if desired.
