Developer Chad Henderson unveiled ambitious plans in May to transform a two-block section of downtown Pensacola into an upscale entertainment district.

Chad Henderson made his name acquiring and developing properties across the nation. Now, he’s turned his sights back home. Henderson, a Pensacola native, unveiled ambitious plans in May to transform a two-block section of downtown Pensacola into an upscale entertainment district featuring shops, restaurants, residences and a hotel with rooftop bar. Taking inspiration from Pensacola’s historic streetscape, Henderson is calling the project the East Garden District. He’s hoping to grow the area into an urban living community similar to The Gulch in Nashville. The East Garden District is bounded by Palafox, Chase, Tarragona and Garden streets and spans Jefferson Street. Over the years, Henderson has acquired most of the property in both blocks. The project will see the former Reynold’s Music House building at the corner of Jefferson and Garden streets converted into a destination restaurant, a threestory mixed use building added to Jefferson Street, new shops and restaurants along Garden Street and, a 100-plus-room hotel on Chase Street. Henderson estimates the project will cost about $50 million. “We are focused on having a mix of uses that com-
pliment one another and create a distinct with a sense of place,” said Henderson. “It’s important for us to reactivate the Garden Street retail corridor around Perfect Plain. I thought there was a big opportunity to create a destination restaurant that would serve as a gateway to the East Garden District.” Henderson began acquiring the properties that will comprise the East Garden District before conceiving the idea for the project. As his healthcare real estate company, Catalyst HRE, was growing by leaps and bounds, Henderson purchased the Rhodes Building at 41 N. Jefferson St. from Quint Studer in 2015. Not long after, Henderson bought the 2 South Palafox Building next door. In the last 18 months, Henderson has purchased the Reynold’s Music House building as well the former Irby Engineering and Razor’s Edge Fitness buildings. “At that point I thought it was a really unique opportunity to create a district, so not to redevelop around one building but more about the opportunity to redevelop the whole block and turn it into a district,” he said. Henderson said redevelopment of the buildings on Garden Street will commence immediately, but that the hotel and mixeduse building are still in the design phase. “We’re looking to move
this forward very quickly,” he said. Henderson’s plan calls for a “road diet” for Jefferson street to create wider sidewalks, a pedestrian crosswalk and greenscaping similar to that on Intendencia Street between Southtowne and the YMCA. “We think this ties in really nicely with what we’re all trying to do to create a more walkable, livable
and the details of what’s being discussed and what we can do will have to be worked out, but from a preliminary standpoint it’s great to see another block happening and the revitalization of that area,” said Robinson. “That’s a block on Garden that still has above-ground electrical and we’d love to get those underground.” Henderson said he hopes

The Judicial Conference of the United States is expected to authorize the appointment of a full-time U.S. Magistrate Judge for the Northern District of Florida in Tallahassee. The deadline for applying for the Magistrate Judge position is Aug. 1. The duties of the U.S. Magistrate Judge are demanding and wideranging. Magistrate judges conduct most preliminary proceedings in criminal cases; trials and disposition of misdemeanor cases; various pretrial matters and evidentiary proceedings on delegation from a district judge; and trials and disposition of civil cases upon consent of the litigants. To be qualified, an applicant must: • Be, and have been for at least five years, a member in good standing of the bar of the highest court of a state, the District of Columbia, the Commonwealth of Puerto Rico, the Territory of Guam, the Commonwealth
of the Northern Mariana Islands, or the Virgin Islands of the United States, and have been engaged in the active practice of law for a period of at least five years (with some substitutes authorized) • Be competent to perform all the duties of the office; be of good moral character; be emotionally stable and mature; be committed to equal justice under the law; be in good health; be patient and courteous; and be capable of deliberation and decisiveness • Be younger than 70 years old • Not be related to a judge of the U.S. District Court for the Northern District of Florida A merit selection panel composed of attorneys and members of the community will review all applicants and recommend to the U.S. District Judges for the Northern District of Florida, in confidence, the five persons it considers best qualified. The court will appoint an individual to the U.S.
Magistrate Judge position following a FBI background investigation and an IRS tax check. The individual selected must comply with the financial disclosure requirements pursuant to the Ethics in Government Act of 1978. An affirmative effort will be made to give due consideration to all qualified applicants without regard to race, color, age (40 and older), gender, religion, national origin, or disability. The current annual salary of the position is $191,360. The term of office is eight years. Applications and additional information about the U.S. Magistrate Judge position may be obtained from the Office of the Clerk of Court at all four divisional offices of the U.S. District Court for the Northern District of Florida and on the Court’s Internet website at www.flnd.uscourts.gov. Appointee Sought for Housing Finance Authority The Escambia County Board of County Commissioners is seeking Escambia County residents interested in volunteering to be considered for an appointment to the Escambia County Housing Finance Authority. Appointees serve without compensation. Hurricane Preparedness Tips from Escambia County June 1 marks the first day of the Atlantic Hurricane Season. Escambia County would like to encourage residents to stay informed and be prepared in the event of a disaster. Take action now and follow these steps to make sure you and your family are prepared this hurricane season: 1. Know your evacuation zone and familiarize yourself with routes. In 2018, Emergency Management released a “Know Your Zone” website for residents to look up their evacuation zone. You can look up your address to see if your home is in evacuation zone A, B, C, D, E or none as well as view the impacts of storm surge in your neighborhood. Knowing your evacuation zone is one of the most important hurricane preparation steps you can take. It is very important that you look up your evacuation zone each year to find out if and when you should evacuate, even if you have looked it up in the past, as zones can change. Most importantly, don’t rely on previous storm experience. 2. Pack an emergency supply kit. It should contain three days of clothes, nonperishable food, pet food, water and a battery operated radio and flashlight with extra batteries. Also include a first-aid kit with items such as gloves, adhesive bandages and prescription medications. 3. Complete a family communication plan. Plan how you will assemble your family and loved ones, and anticipate where you will go
for different situations. Get together with your family and agree on the best ways to contact one another in an emergency. Inform out-of-town family and friends of your emergency plans and stay in contact. 4. Plan your evacuation route and destination before an evacuation order is issued. Anticipate where you and your family will go for different situations. Be sure to make preparations for pets and family members who made need special accommodations, such as a wheelchair ramp, oxygen tank or specific medications. 5. Stay Informed. Know where to go for trusted sources of information during a hurricane event. Sign up for alerts from your local emergency management office so notifications, including evacuation orders, go directly to your phone and email. Monitor local news for hurricane watches and warnings in your area and follow directions of local officials. Make sure you have a battery-operated or hand-crank radio available should the power go out. 6. Review your hurricane strategy each year with family members, including evacuation plans. WFPL Summer Reading Club Underway Summer Reading Club 2019 “A Universe of Stories” is underway through Saturday, Aug. 2 at all West Florida Public Libraries locations, with opportunities for adults and youth to participate and win a variety of prizes. All participants can log and track their summer reading minutes through a mobile app, Beanstack Tracker; or on their desktop computer through
mywfpl.beanstack.org. Through Beanstack, participants can earn virtual badges for their reading milestones, earn virtual badges for attending certain programs and will automatically be entered in appropriate prize drawings. Youth, ages 3 to 17 years old, will keep track of every 15 minutes they read. Prizes begin at 12.5 hours of reading. This year, adults will keep
track of every 30 minutes they read and prizes will begin at 25 hours. Youth prizes include books, rocket backpacks, model rockets, solar chargers, meteorites, wooden spaceship kits and more. Once the survey period has ended, the Escambia County Planning Board will host a workshop to discuss comments submitted through the survey and determine if revisions to the current tree protection standards are necessary. LONG-SOUGHT DISASTER AID PACKAGE PASSES HOUSE Jim TURNER News Service of Florida TALLAHASSEE – A federal disaster-relief package, long sought by Florida officials and Panhandle residents recovering from the ravages of Hurricane Michael, received approval Monday from the U.S. House after three earlier attempts were blocked. The 354-58 vote, which came after the House returned from a 10-day holiday recess, sends the $19.1 billion package to President Donald Trump. The Senate backed the measure 85-8 on May 23. The funding package was delayed for months, as Trump fought Democrats over their push for additional funding for Puerto Rico, which continues to recover from Hurricane Maria in 2017. Also, the president wanted to include money to address migrants at the border with Mexico. The Category 5 Hurricane Michael made landfall Oct. 10 and caused massive damage in the Panhandle. But as the two sides in Washington bickered, and as days became weeks and months, additional disasters occurred, from flooding in Arkansas and Iowa to tornadoes in Ohio,
and the disaster-relief package ballooned from $7.8 billion. After the Senate approved the disaster-relief bill, the House tried to pass it three times by “unanimous consent,” a move that does not require most members to be present. But Republican lawmakers blocked the bill each time while the House was in recess. U.S. Rep. Neal Dunn, a Republican from Panama City, expressed frustration Monday with his GOP colleagues who blocked the measure, which includes $1.2 billion to rebuild Tyndall Air Force Base, one of the storm-battered region’s biggest economic drivers. “Some of you will say your principles require a recorded vote, even though the contents of this bill have been known for months and debated for months,” Dunn said. “In fact, we had a chance to vote on the amendments to it just two weeks ago. For those upset at the cost, OK, spending in Washington is a problem, but are you actually willing to make an empty gesture about balancing the federal budget on the backs of Americans who have lost everything? Are you willing to force the airmen of Tyndall, the Marines at Camp Lejeune
to halt the work to repair their bases because they ran out of money over a month ago?” Dunn added that the package he “hammered” Congress to approve for nearly eight months also assists Florida’s agriculture industry, which suffered nearly $1.5 billion in damages from Michael. Most of the agriculture damage was to Northwest Florida’s timber industry, which isn’t covered by federal crop insurance or other programs. “Are we willing to bankrupt them? Because a no vote today does exactly that,” Dunn said. State Agriculture Commissioner Nikki Fried issued a statement after the vote expressing thanks for the bill’s approval but also noting that the 2019 hurricane season has already begun and debris
from Michael has increased the threat of wildfires. “This disaster recovery is long-overdue – but, better late than never,” Fried said. “I’m thankful that the Panhandle communities will finally be on the path to recovery.” U.S. Rep. Mario DiazBalart, a Republican from Miami, said the funding package will also assist “unmet housing, business and infrastructure needs” in the region. The funding includes $1.4 billion for Puerto Rico, including $600 million for nutritional assistance. U.S. Rep. Chip Roy, a Texas Republican who was one of the three congressmen – U.S. Reps. John Rose, R-Tenn., and Thomas Massie, R-Ky. were the others – who blocked the bill from being
approved through unanimous consent, said it was important that Congress vote on the measure. Roy also continued to express concern with the amount being spent. “I am still troubled we’re poised to spend $19 billion that is not paid for when we are racking up $100 million an hour in national debt,” Roy said. “At some point, before it is too late, Congress will get serious about restraining outof-control spending. We’ve racked up approximately $24 billion in additional debt since the recess. At least today we’re voting.” U.S. Rep. Tom Cole, ROkla., while supporting the relief package that will help more than 40 states, expressed displeasure that Congress couldn’t reach a deal to include $4 billion Trump sought for the southern border. “Most of that money is to take care of the unprecedented influx of unaccompanied minors,” Cole said. “Our Democratic friends claim they care about these young people. But they fail to provide the funds required to feed, house and provide medical care for this population. This is something that we need to look at and frankly deal with immediately.”
HOUSE SEEKS TO DEFEND MEDICAL MARIJUANA LAW JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE – As court battles continue about whether the state is properly carrying out a 2016 constitutional amendment that broadly legalized medical marijuana, the Florida House is again trying to weigh in. House attorneys Friday gave notice that they will appeal a Leon County circuit judge’s ruling that blocked the House from intervening in a lawsuit to help defend a controversial 2017 law that was designed to carry out the constitutional amendment. The move came as the House also is asking the 1st District Court of Appeal to allow it to intervene in another case about the 2017 law. The notice filed Friday, as is common, does not detail the House’s arguments. But it seeks to overturn a decision last month by Leon County Circuit Judge Charles Dodson that kept the House out of a lawsuit filed by Patients and Producers Alliance, Inc. against the Florida Department
of Health. The non-profit Patients and Producers Alliance argues in the lawsuit that the 2017 law violates the constitutional amendment because it improperly restricts medical-marijuana firms. The House has contended in circuit court that it should be allowed to defend the law, in part pointing to the state’s need to navigate federal laws, under which marijuana remains illegal. “The Florida House of Representatives, as one-half of the state’s policymaking branch, is well-situated to respond to the plaintiff and the court in defense of (the 2017 law),” the House said in a January filing in circuit court. “Notably, the MMA (medical marijuana amendment) gives implementation authority – not policymaking authority – to the Department of Health, and the Florida Constitution’s strict, express separation of powers precludes this court from exercising policymaking authority. That leaves the Legislature with the sole constitutional authority to make the necessary
policy choices for how to implement the MMA within the limits of an otherwise conflicting and superseding federal drug policy.” But Dodson issued a two-page order last month rejecting the House’s arguments and cited a November decision in another case in which he blocked the House from intervening. The House also has appealed the ruling in that case, filed by the Tampabased firm Florigrown. “The court concludes that the Department of Health is the proper defendant in this case, and because even the Legislature’s policymaking authority must comport with the Constitution, the House does not have a direct and immediate interest in the matter at issue in this litigation such that it stands to gam or lose by the direct legal operation and effect of any judgment rendered by this court,” Dodson wrote in rejecting the House’s involvement in the Florigrown case. The 2017 law has drawn a series of legal challenges because of restrictions it placed on the fast-growing
medical marijuana industry. As an example, the law drew a challenge because it banned smokable medical marijuana. After the state lost in circuit court, Gov. Ron DeSantis this year pushed through legislation that eliminated the ban on smokable marijuana. The Patients and Producers Alliance and Florigrown lawsuits challenge issues such as restrictions on the numbers of firms that can be approved to do business and a requirement of what is known as “vertical integration.” That requirement forces firms to grow, process and sell medical marijuana – as opposed to businesses being licensed to play different roles in the industry. Dodson last year ruled in favor of Florigrown and issued a temporary injunction requiring state health officials to begin registering Florigrown and other medical-marijuana firms to do business. The state, however, has appealed the temporary injunction, with a hearing scheduled June 11 at the 1st District Court of Appeal.

MEDICAL RECORDS DEBATE RE-EMERGES Jim Saunders News Service of Florida TALLAHASSEE – Nearly 15 years after Florida voters approved a constitutional amendment about access to records in medical-malpractice cases, a Jacksonville hospital has launched a federal lawsuit arguing it should be shielded from being required to turn over documents to a patient. The lawsuit, filed this month in federal court in Jacksonville, is the latest in a series of legal disputes about whether hospitals need to disclose records about patient care as part of malpractice litigation under the 2004 constitutional amendment. The Florida Supreme Court in 2017 issued rulings that broadly interpreted the constitutional amendment to
require records to be turned over. In the new case, however, attorneys for UF Health Jacksonville are asking a U.S. district judge to declare that the disputed records are shielded under a federal law that “preempts” the state constitutional amendment. Also, the hospital contends that it could face federal penalties if it is required to turn over the information because of the constitutional amendment. It asks for an injunction against such penalties. The federal law, known as the Patient Safety and Quality Improvement Act, or PSQIA, passed in 2005 and allows hospitals to voluntarily submit information about medical errors to “patient safety organizations” --- and offers certain confidentiality protections. The law was aimed, at least in
part, at encouraging health providers to submit information that could be analyzed and used to prevent future medical errors. UF Health Jacksonville, which also goes by the name Shands Jacksonville Medical Center, did not spell out all of the underlying details in the case. But it said it received a letter in February requesting all “adverse medical incident documents” related to the care of Nada Caro, a patient from June 2018. “Shands is subject to a patient request for this information pursuant to the Florida Constitution,” the lawsuit said. “The information, however, is both privileged and confidential under the PSQIA. The Florida Supreme Court, in recent decisions interpreting the relevant Florida constitutional provision, appears to
mandate disclosure of the information. If Shands complies with the patient’s request, the Secretary (of the U.S. Department of Health and Human Services) has authority to impose a significant civil monetary penalty against Shands for violating the PSQIA’s nodisclosure requirements.” The 2004 constitutional amendment, which appeared on the ballot as Amendment 7, was passed amid legal and political battles between health-care providers and plaintiffs’ attorneys about medical-malpractice laws. The amendment was intended to provide access for patients and their attorneys to adverse medical incident reports, which can play an important role in malpractice cases. The UF Health Jacksonville lawsuit names U.S.
Health and Human Services Secretary Alex Azar as the defendant. As of mid-day Thursday, the federal government had not filed a response. But in one 2017 ruling, the Florida Supreme Court rejected the notion that the federal law trumps the state constitutional amendment. “The federal act was intended by Congress to improve the overall health care in this system, not to act as a shield to providers, thereby dismantling an important right afforded to Florida citizens through Amendment 7,” said the majority opinion in a case involving another Jacksonville hospital system. “Moreover, health care providers should not be able to unilaterally decide which documents will be discoverable and which will not in medical malpractice cases.”
FEDERAL MONEY WILL BOLSTER EVERGLADES FLOW Jim TURNER News Service of Florida TALLAHASSEE – Long-sought federal money is coming to complete a project that will raise a section of the Tamiami Trail to improve the flow of freshwater through the Everglades. U.S. Transportation Secretary Elaine Chao advised state officials Monday that $60 million will be provided to the National Park Service for elevating a 6.5-mile section of the roadway that runs west from Miami. “Combined with the $40 million I requested from the Florida Legislature, the project is now fully funded,” Gov. Ron DeSantis said in a tweet. “Elevating the Tamiami Trail will allow for an additional 75 to 80 billion gallons of water a day to flow south
into the Everglades and Florida Bay.” The state money is included in a $91.1 billion budget approved by the Legislature last month. The budget, which is for the fiscal year that starts July 1, has not formally been sent to DeSantis for approval. The 91-year-old Tamiami Trail, or U.S. 41, crosses the Everglades and forms part of the northern border of Everglades National Park. Environmentalists say it has dammed the natural flow of water from Lake Okeechobee through the Everglades to Florida Bay. “The water crisis facing the Everglades is really two-fold,” Everglades Foundation CEO Eric Eikenberg said in a prepared statement. “At the northern end of the Everglades, excess water flowing into Lake
Okeechobee has forced massive discharges of algae-causing water into the Caloosahatchee and St. Lucie Rivers. Meanwhile, in the southern Everglades, the lack of fresh water impacts wildlife and destroys critical habitat. In Florida Bay, it is ruining the delicate saltwater balance, killing seagrass habitat needed to support world-class recreational fishing in the Florida Keys.” The Everglades Foundation said construction of two elevated bridges has helped the water flow, but the additional federal and state money will go toward raising a section of the roadway between the bridges and installing culverts. The funding has been pushed by members of Florida’s congressional delegation and state officials.
“Without this critical funding to raise the road, recently authorized projects to the north, including the Central Everglades Planning Project and the Everglades Agricultural Area Reservoir would not be able to achieve their full restoration capabilities,” U.S. Sen. Marco Rubio, R-Fla., wrote Monday. “Everglades restoration is absolutely necessary to ensure the environmental sustainability and economic vitality of one of the most dynamic regions of our nation, and I will continue to work collaboratively across federal, state, and local government to address any roadblocks slowing down our progress.” As governor in 2013, U.S. Sen. Rick Scott, R-Fla., proposed $90 million in state funding to keep the federal elevation work on schedule.
