Downtown Improvement Board gets new members BY will isern

New blood on one of the city’s most impactful boards could mean a new vision for downtown Pensacola. The Downtown Improvement Board will welcome three new members this month, shifting the board’s governance from appointees made by former mayor Ashton Hayward to ones made by mayor Grover Robinson. The three new DIB members are Adam Cobb, an attorney with Emmanual, Sheppard & Condon law firm, Jean Pierre N’Dione, co-owner and manager of Five Sisters Blues Café and Angelena’s Italian Ristorante and Kevin Lehman, coowner of Pure Barre and Fosko Coffee Barre. The new members will replace longtime former chairman John Peacock, as well as the board’s most recent chairwoman DeeDee Davis and Charlie Switzer, whose terms expired in June. To the extent that the average downtown visitor has heard of the DIB at all, it’s likely been in connection with the botched rollout of a parking management system last summer. Insufficient communication by the board led to mass confusion and frustration among downtown visitors and business owners. The resulting turmoil contributed to the resignation of the board’s executive director and calls from then-candidate Robinson to fix the system. Despite garnering headlines for the parking debacle, the DIB has done much good to

further the mission of making downtown a vibrant cultural and commercial destination for residents, businesses and visitors. The board originated Gallery Night, Palafox Market and the First City Festival of Lights, three events that have grown to become staples of downtown’s cultural calendar. The DIB later offloaded management of Gallery Night and the Pelican Drop to other organizations. More recently, the board has begun work to activate and improve the alleyway between the Jefferson Street parking garage and business on Palafox Street. Still, the parking problem persists. Today, two parking management companies, Passport Parking and Premium Parking, operate two different smartphone apps to manage lots and spaces throughout downtown. As mayor, Robinson has said the DIB’s top priority must be to fix downtown parking. Robinson has pointed to reforms proposed by parking expert Donald Shoup who presented as part of the CivicCon speakers series in October. Shoup proposed a pricing model that changes with demand and the elimination of off-street parking requirements. Robinson selected the three new DIB members based on their willingness to work with City Hall to fix the parking problem, as well as their interest in seeing downtown continue to flourish. Adam Cobb began serving on the DIB’s finance committee shortly after returning to Pensacola from Indianapolis in 2016.

“I look at Palafox and it looks great and there’s all kinds of great things happening throughout downtown,” Cobb said. “I think my goal is to make sure we keep a progressive vision and work toward progressive and inclusive development, something that makes downtown better for everyone. With three of us coming in at once, I think there may be an opportunity to have fresh discussions.” N’Dione said he recognizes that parking is the big issue facing the DIB, but said he wants time to learn the scope of the board’s operations and hear from citizens and businesses within the district. “I think it’s going to be a learning process for me, then just go from there and try to bring my vision and ideas that I have to try to improve what they’ve been doing,” he said. When the time does come to

tackle parking, N’Dione said he expects a compromise will be necessary. “Downtown is growing, so we will have to have some revenue to maintain and improve the district, so money has to come from somewhere,” said N’Dione. “At the same time, I think an education aspect has to be part of process. Putting a meter out somewhere without telling anybody anything just leads to confusion. Citizens have to be educated on how things work and the DIB has to find the best way to do that. “ Lehman was among the most vocal critics of the DIB’s parking rollout last summer, going so far as to hang a large red sign downtown encouraging citizens to take their frustrations straight to the DIB’s monthly meeting. Not one to bellyache about a problem he isn’t willing to help solve, Lehman went on to join the DIB’s parking

committee. He’s since helped to cut parking prices at the Jefferson Street garage and ditch Premium Parking in favor of Passport. In addition to collecting parking revenue, the DIB is primarily funded through the collection of a special tax assessed to property owners within the district. Lehman said he wants to evaluate whether those property owners are getting value equivalent to what they’re paying. “The number one priority for me is judging what kind of return on investment the downtown property owners are getting from the DIB,” he said. “My loyalty is 100 percent to the people paying the bills and I have no loyalty to the DIB as an organization because it’s only job is to serve the people paying the bills.” The three new DIB members will begin serving in July.

The Judicial Conference of the United States is expected to authorize the appointment of a full-time U.S. Magistrate Judge for the Northern District of Florida in Tallahassee. The deadline for applying for the Magistrate Judge position is Aug. 1. The duties of the U.S. Magistrate Judge are demanding and wideranging. Magistrate judges conduct most preliminary proceedings in criminal cases; trials and disposition of misdemeanor cases; various pretrial matters and evidentiary proceedings on delegation from a district judge; and trials and disposition of civil cases upon consent of the litigants. To be qualified, an applicant must: • Be, and have been for at least five years, a member in good standing of the bar of the highest court of a state, the District of Columbia, the Commonwealth of Puerto Rico, the Territory of Guam, the Commonwealth

of the Northern Mariana Islands, or the Virgin Islands of the United States, and have been engaged in the active practice of law for a period of at least five years (with some substitutes authorized) • Be competent to perform all the duties of the office; be of good moral character; be emotionally stable and mature; be committed to equal justice under the law; be in good health; be patient and courteous; and be capable of deliberation and decisiveness • Be younger than 70 years old • Not be related to a judge of the U.S. District Court for the Northern District of Florida A merit selection panel composed of attorneys and members of the community will review all applicants and recommend to the U.S. District Judges for the Northern District of Florida, in confidence, the five persons it considers best qualified. The court will appoint an individual to the U.S.

Magistrate Judge position following a FBI background investigation and an IRS tax check. The individual selected must comply with the financial disclosure requirements pursuant to the Ethics in Government Act of 1978. An affirmative effort will be made to give due consideration to all qualified applicants without regard to race, color, age (40 and older), gender, religion, national origin, or disability. The current annual salary of the position is $191,360. The term of office is eight years. Applications and additional information about the U.S. Magistrate Judge position may be obtained from the Office of the Clerk of Court at all four divisional offices of the U.S. District Court for the Northern District of Florida and on the Court’s Internet website at www.flnd.uscourts.gov. accordance with the instructions provided by Aug. 1. Commissioner May recognized as a FAC Presidential Advocate The Florida Association of Counties recognized Chairman and District 3 Commissioner Lumon May as a Presidential Advocate for their work during the 2019 Legislative Session. Commissioner May received the designation during an awards ceremony held at the FAC Annual Conference in Orange County, Florida. The FAC Presidential Advocate recognition is given to county commissioners who have shown exceptional leadership in advocating with FAC during the 2019 session to advance the counties’ legislative agenda. “As commissioners, we are empowered to stand up for our community, to be the voice for those who can’t speak, and to fight for our right to decide our own future,” said FAC President and Hendry County Commissioner, Kar-

son Turner. “During the Legislative Session, our role becomes increasingly important as hundreds of bills are heard that have a direct impact on our communities. Escambia County animal shelter hosts Tales for Tails The Escambia County Animal Shelter will host Tales for Tails, a public event open to anyone who would like to read to animal shelter pets during Independence Day fireworks shows. The event will be held on Thursday, July 4 from 7:30 -9:30 p.m. Fourth of July can be a frightening time for pets. Reading and providing company to sheltered pets can help reduce the anxiety they feel when they hear loud, booming noises, such as fireworks and thunder. At Tales for Tails, volunteers will only be allowed to read from outside of the kennels. There will be no adoptions, pets allowed out of kennels or pet admittance during the event. Fireworks safety tips and pets: • Pet safety is vital during the Fourth of July. • Never take pets to a fireworks display; instead, keep them safe and secured at home. • Make sure your pet has identification, such as a microchip or collar with an identification tag. Also, keep a county license on your pet and have a recent photo

of your pet available in the event that it runs away. • Do not leave your pet in the car while you watch a fireworks display. In only a matter of minutes, the heat in a car can cause serious health problems or even death. A stressed animal can also cause major damage to the interior of your car. • Be mindful of hot asphalt and sand. Keeping your dog on hot asphalt or sand even for short periods of time can cause severe burns to the pads of their feet. • Keep pets indoors. Turn on the TV or radio as a distraction and close the curtains. • Never leave pets unattended outside, not even in a fenced yard or on a chain, if you are near a fireworks display or if your neighbors are lighting small fireworks. They may try to run away or become tangled up in their chain. • Provide a pet bed or crate in a quiet place to create a small den-like atmosphere and a sense of security. •If you must be outside with your pet, keep the pet on a leash or in a carrier at all times.

Firefighters receive decontamination kits to fight cancer risk Escambia County Fire Rescue has received 42 post fire on-scene decontamination kits to help mitigate firefighters’ exposure to cancer-causing products of combustion. The decontamination kits will be distributed to county fire departments to be housed on apparatus with pumping capability beginning Tuesday, June 18. The kits were provided as part of a $1 million state-wide firefighter cancer mitigation grant program. New construction and furniture often contain synthetic materials like polyurethane and hydro-carbons. The result is not only material that ignites faster, but produces carcinogens, which can increase existing cancer risks posed by a fire’s gases. In fact, according to a 2016 study by the National Institute for Occupation Health and Safety, U.S. firefighters are at a higher risk for cancer and they are 14 percent more likely to die of cancer than the general public. Each kit includes the tools needed for firefighters to effectively clean gear after a fire: • Flash drive, including educational videos and training outline • Laminated field operation guide • Standard operating guideline

• 5-gallon bucket and leak-proof lid • 5-gallon 6 mil clear bags • Duct tape •Dish soap • Short handle scrub brush • All-purpose spray bottle • Dermal wipes • two 50-foot 5/8” hose lines • two garden hose nozzles • two adapters, 2 feet 5 inches female X 3/4 inch male garden hose thread • Collapsible traffic cone The kits are in addition to a department initiative to issue all certified firefighters two sets of personal protective gear, which further reduces firefighter exposure. A set of clean, dry gear would be available for use at the station while the first set can be initially cleaned on scene with the donated kit. The overall goal is to reduce expose time, not only while on scene, but when returning to the station and responding to other calls. The state of Florida partnered with Ten-8, the University of Miami Sylvester Comprehensive Cancer Center, the Florida Firefighters Safety and Health Collaborative, and the Firefighter Cancer Support Network to provide more than 4,200 kits to 405 Florida fire departments as part of the state effort.

Heroes Among Us speaker series The Cpl. J.R. Spears Detachment of the Marine Corps League announces its 7th annual Heroes Among Us speaker series to be held at Seville Quarter. The series, now in its seventh year, is held at 6 p.m. on the last Thursday of each month from May through October. It is presented by the local Marine Corps League, J.R. Spears Detachment 066. Admission is free and open to the public, although donations will be accepted for the Veterans in Distress

Fund to help veterans in need. The “Heroes Among Us” series, founded in 2013, features people from all branches of the military service. The goal is to let those people share their experiences with others, both civilians and military veterans as well as active duty members. WSRE and the Pensacola Blue Wahoos team up to hit a home run for early learning Families are invited to come “Hit a Home Run for Early Learning” at Blue Wahoos Stadium on Sunday, Aug. 4. VOTING RIGHTS LAW DRAWS COURT FIGHT, REGISTRATION PUSH DARA KAM News Service of Florida TALLAHASSEE – Civil rights groups are hoping a federal judge will strike down a new Florida law that they say does not properly carry out a constitutional amendment restoring voting rights to felons who have completed their sentences. But despite the legal challenges, some backers of what appeared as Amendment 4 on the November ballot are taking a different tack: They’re busy trying to register “returning citizens” and help others pay outstanding debts that, under the new law, could keep them off the voting rolls. “Where others see obstacles, we see opportunities,” Neil Volz, who works for a committee that helped get the amendment on the ballot, told The News Service of Florida in a telephone interview Monday. Lawyers representing voting-rights and civil-rights groups, as well as more than a dozen Floridians who’ve been convicted of felonies, filed three lawsuits in federal court Friday, immediately after Gov. Ron DeSantis signed into law an omnibus elections measure (SB 7066) that included the implementation of Amendment 4. The Southern Poverty Law Center filed a fourth lawsuit on Monday. Under the new law, Floridians convicted of felonies will have to pay financial obligations related to their crimes before they are eligible to have voting rights restored.

The legal challenges, combined into one case by U.S. District Judge Mark Walker, allege the legislation unconstitutionally “creates two classes of citizens,” depending on their ability to pay financial obligations that many don’t even know about. The law, which went into effect Monday, is a throwback to Jim Crow-era policies aimed at preventing black Floridians from voting, argued lawyers for the Brennan Center for Justice at the New York University School of Law, the American Civil Liberties Union of Florida and the NAACP Legal Defense and Educational Fund. “Florida has a long, troubling history with voter suppression tactics, many explicitly motivated by racial discrimination – including the very felony disenfranchisement provision revised by Amendment 4,” they wrote in a 74-page complaint filed Friday. The amendment, approved by more than 64 percent of Florida voters in November, granted restoration of voting rights to felons “who have completed all terms of their sentence, including parole or probation.” The amendment excluded people “convicted of murder or a felony sexual offense.” The meaning of “all terms of sentence” became a flashpoint during this spring’s legislative session, sparking an emotionally charged, partisan schism over whether the amendment required payment of court-ordered fees, fines and restitution when the financial obligations are part

of a sentence, as is almost always the case. Black Democrats were particularly incensed about the linkage between finances and voting, which the lawsuit refers to as an unconstitutional “poll tax.” The law “conditions plaintiffs’ right to vote on their wealth and penalizes returning citizens who are unable to pay,” in violation of the U.S. Constitution, the plaintiffs’ attorneys wrote. And the statute also will “prevent or at least chill voter registration and voting” because the state lacks a unified system tracking the amount of money owed by people convicted of felonies, the lawsuit alleges. “It is really, really difficult to get the information that you need to be confident that you’re up to date with your legal financial obligations,” Myrna Peréz, director of the Brennan Center’s Voting Rights and Elections Program, said in a telephone interview. “The databases don’t speak with each other. They’re incomplete. They’re inaccurate. They’re out of date. It’s really hard to prove that there isn’t going to be some other contradictory database out there.” Many people “who have been working so hard to get their lives back online don’t want to take a risk,” of registering to vote if they are uncertain about their eligibility, she added. “They don’t want to be wrong, because the consequences are so very high. I believe that that is by design. I believe that the folks who

passed these laws knew exactly what they were doing,” Peréz said. But state House Speaker Jose Oliva, R-Miami Lakes, and other supporters of the law say it properly carries out the constitutional amendment, which was reviewed by the Florida Supreme Court before it went on the November ballot. Oliva said it is “crystal clear” that the Supreme Court approved the language of the amendment “with a requirement to pay back fines and make crime victims whole.” “Voters voted to give felons a second chance, but they didn’t vote to give them a free pass from accountability and payment of debt to society,” Oliva said in a text Monday. “We are confident the court will see the depths to which the Florida Supreme Court went to firmly establish that things like paying fines are a large part of completing your sentence.” Many people who have been released from jail or prison are indigent and will be permanently unable to pay the fees, the lawsuit argues. According to a report compiled from data gathered by Florida clerks of courts cited in the lawsuit, county clerks collected about 20 percent of court-imposed fees and fines in 2018. The law, however, includes provisions allowing third parties to waive outstanding debts, and felons who are unable to pay can ask judges to convert their financial obligations to community service. But those avenues are also

problematic, the lawsuit alleges. For example, financial obligations resulting from federal or out-of-state cases can’t be resolved through Florida courts. And third-party payment recipients – including collection agencies, insurance companies and private individuals – “have absolute discretion to grant or deny a person’s request” to have their financial obligations terminated “for any reason, no reason, or based on personal whims,” the plaintiffs’ lawyers argued. While the battle is being waged in court, advocates of the amendment are holding “community events” to help felons register to vote, raising money to help them pay off financial obligations, and meeting with judges, supervisors of elections and others with the goal of creating processes that will make it easier – and faster – to pay off debts and get registered. “We’re excited to work with local officials to help expedite the completion of sentences for returning citizens who want to move on with their lives. We’re also working to help people directly complete their sentences, as well as work through the clemency process, to help those folks who currently are not eligible,” said Volz, treasurer of the Florida Rights Restoration Coalition. The impact of the amendment hasn’t been diminished by the legislation to carry it out, he added. “A lifetime ban for people with felony convictions is gone,” Volz said.

DESANTIS BACKS UNDERGROUND POWER LINES, VETOES FEES CHRISTINE SEXTON and JIM SAUNDERS News Service of Florida

TALLAHASSEE – Gov. Ron DeSantis on Thursday signed a bill that could lead to more underground power lines in hurricane-vulnerable Florida and vetoed two measures that would have imposed health care-related fees. The bill dealing with power lines (SB 796) came after millions of residents and businesses lost electricity in hurricanes during the past three years. State officials and utilities have long faced questions about why more power lines are not buried underground, where the lines could be less susceptible to punishing winds and falling trees. Utilities already have underground power lines in some areas. But a key part of the bill would change the way underground power-line projects are financed, a change that could lead to more projects – but also higher bills for utility customers. While acknowledging the potential higher costs, supporters of the bill pointed to the economic damage done when electricity goes out for extended periods, such as after Hurricane Irma in 2017 and Hurricane Michael in 2018. “This is what I do know, right now we spend billions of dollars every

time the power goes out to get it back on,” House sponsor Randy Fine, RPalm Bay, said near the end of the spring legislative session. “Those of you who lived through Irma remember we import hundreds, if not thousands, if not tens of thousands of people to come down here to get our utilities back on. That costs hundreds and hundreds of millions of dollars. To some degree, a lot of that goes away if we do this.” Generally, utilities such as Florida Power & Light, Duke Energy Florida, Tampa Electric Co. and Gulf Power incorporate storm-hardening costs in their base electric rates, which are set for multiple years. The Florida Public Service Commission goes through months-long processes to determine base rates, looking at financial and technical issues that involve numerous parts of utility operations. But the bill creates a separate Public Service Commission process that will allow utilities each year to seek to collect money from customers for storm-protection projects, such as building underground power lines. Commission staff members met this week with representatives of consumers and utilities to begin working on the process, in anticipation of the bill being signed. The bill passed the Senate in a 39-1 vote and the House in a 110-3 vote. Nevertheless, it faced opposition

during the session from the senioradvocacy group AARP Florida and the Florida Industrial Power Users Group, which represents large commercial electricity customers and is often involved in regulatory issues. They expressed concerns about the potential higher costs for consumers. DeSantis’ office late Thursday released a list of four bills that he had signed and two he had vetoed. The moves brought to four the number of bills he has vetoed from the session that ended May 4. With DeSantis saying his goal was to decrease health-care costs, the bills he vetoed Thursday would have authorized the state to levy fees to help support two new programs. One of the measures (HB 7073) involved fees linked to an initiative to allow prescription drugs to be imported from Canada and other countries. The bill would have authorized the state to collect fees for two new types of permits: an international export pharmacy permit and an international drug wholesale distributor permit. The Florida Board of Pharmacy has already started moving to create the international export pharmacy permit and has published an initial draft application that included a $255 fee. DeSantis also vetoed a bill (HB 7067) that would have required the Department of Health’s medical li-

censure boards to charge a $150 registration fee for out-of-state health care professionals seeking to provide telehealth services to Florida residents. The fee was passed because Florida law requires that the costs of regulating health-care practitioners must be borne by the people who receive licenses and licensure applicants. The bill also would have required a biennial renewal fee of $150 for out-ofstate telehealth providers. DeSantis has signed two bills (HB 19 and HB 23) that are aimed at importing prescription drugs and boosting the use of telehealth. While he was a supporter of those measures, DeSantis took issue with the permit fees. “These pieces of legislation (HB 19 and HB 23) provide a framework for Floridians to access more affordable prescription medication and to utilize the services of physicians via a cheaper and more affordable convenient medium,” DeSantis wrote in his veto letter. “With this in mind, the imposition of fees would undercut these efforts and would likely make administering the programs more cumbersome.” Legislators were forced to place the fees in separate bills because of a constitutional amendment that requires any fee or tax increase to be in stand-alone legislation.

DESANTIS MOVES QUICKLY ON ‘JOB GROWTH’ MONEY Jim TURNER News Service of Florida TALLAHASSEE – Gov. Ron DeSantis wasted little time announcing the state has $40 million for economic-development projects his office can fund during the fiscal year that began Monday. The governor’s office sent out a news release Monday morning noting that applications were being accepted for the Job Growth Grant Fund, which was created under former Gov. Rick Scott as an alternative to giving incentive money directly to companies that promised to bring new jobs and facilities to the state.

Money from the fund is supposed to go for job training and public infrastructure projects. “We know the importance infrastructure projects and workforce training has on economic development,” DeSantis said in a prepared statement. The $40 million is part of the state’s $90.98 billion budget for the 2019-2020 fiscal year that took effect Monday. DeSantis did not persuade lawmakers to put $85 million into the fund, an amount that Scott, now a U.S. senator, received for the program in each of his final two years as governor. The fund was created in 2017 after a legislative battle

about incentives, including a failed request by Scott in 2016 to provide $250 million in economic-development money that could go directly to businesses. Former House Speaker Richard Corcoran, a Land O’ Lakes Republican who is now the state education commissioner, repeatedly called such incentives “corporate welfare.” Some Democrats, meanwhile, initially criticized the Job Growth Grant Fund as a “slush fund” that lacked oversight. The economic-development agency Enterprise Florida and the state Department of Economic Opportunity are required to review proposals before awards are

granted. Ken Lawson, executive director of the Department of Economic Opportunity, said in a statement Monday the money will go to “smart strategic investments.” During the 2019 legislative session, budget leaders, before agreeing to the $40 million, expressed some concerns about the wide discretion the governor had in using the money for regional projects. Senate Appropriations Chairman Rob Bradley, RFleming Island, noted early in the session that his primary concern was that the “legislators are appropriators, not the executive.” In one of his final acts as governor, Scott effectively

tapped the remaining dollars from the fund for the 20182019 fiscal year, which ended Sunday. Projects included $5 million to the town of Callahan to provide water and wastewater service to an 1,841-acre industrial site; $4.7 million for Lakeland to develop two hangar facilities at Lakeland Linder Regional Airport; and $2.3 million for Bradford County to build an access road through the Keystone Heights Airport. Over the two years, Scott used the fund to assist 56 projects across the state. In the past fiscal year, more than 100 proposals, seeking a combined $620 million in funding, were submitted to the state Department of Economic Opportunity.

SOLUTIONS SOUGHT FOR ALGAE WOES JIM TURNER News Service of Florida TALLAHASSEE – Experts looking into toxic algae outbreaks that have exploded in state waterways want to know if anyone has a proven, innovative cleanup strategy that can be used. And they want to know quickly. The Florida Department of Environmental Protection is formally accepting information through July 15 on ways to prevent, combat or clean up harmful algal blooms in freshwater bodies and estuaries. Thomas Frazer, Florida’s chief science officer, said Monday during a state Blue-Green Algae Task Force meeting in Fort Myers that he and other officials at the state department have already been fielding calls from people with ideas about fighting the algae. “I wouldn’t want to limit the people who have expressed interest,” Frazer said. “There are times that people

may not have a ton of preliminary data … but sometimes there are really good ideas.” The better ideas will go before the task force at its Aug. 1 meeting, Frazer said. Gov. Ron DeSantis issued an executive order in January to create the task force in response to outbreaks of toxic algae and red tide across the state last year. The source of outbreaks in Florida and the Gulf of Mexico is blooms of a single-celled organism called Karenia brevis algae, which produces toxins that kill fish, birds, sea turtles, manatees and dolphins and can cause shellfish poisoning in humans. The problems particularly drew attention in Southeast and Southwest Florida, as algae plagued water bodies such as the St. Lucie and Caloosahatchee rivers and red tide caused fish kills. Frazer said the task force won’t be asked to pick proposals or vendors

but to determine if projects have merit to move forward for potential state grant funding. Frazer said officials are open to “all different kinds of potential solutions,” which could mean chemical, biological, mechanical ideas or any combination of those methods. As part of a request for information, more than 35 questions are asked, from potential environmental impacts to the size of water bodies that could be effectively treated. “With regard to cleanup, specifically, we want to make sure the technology provides near-term ecological and human health relief,” Frazer said. Some people making proposals could be asked to appear before the task force to answer questions about their proposals. Frazer said additional people may even be needed to review the viability of proposals. Part of the grant-making process will be determining who is behind

proposals because some information could come from more than one person. The focus of the task force is Lake Okeechobee and waters on both sides of the lake, but the state is also looking at possible algae impacts as far north as the St. Johns River. As part of the $90.98 billion budget for the fiscal year that began on Monday, $4 million is slated to go to expanding “statewide water quality analytics for the nutrient over-enrichment analytics assessment and water quality public information portal.” Separately, a new law (SB 1552) provides $3 million a year for the next five years to the Florida Red Tide Mitigation and Technology Development Initiative to research the causes and impacts of red tide. The initiative was created between the Florida Fish and Wildlife Conservation Commission’s Fish and Wildlife Research Institute and Sarasotabased Mote Marine Laboratory.

GAETZ FACES HOUSE PROBE AFTER COHEN TWEET News Service of Florida staff U.S. Rep. Matt Gaetz faces a House investigation into allegations he tried to intimidate President Donald Trump’s former lawyer before a congressional appearance this year. The House Ethics Committee said Friday that Gaetz, a Fort Walton Beach Republican, failed to provide testimony after a complaint from a House member alleged that Gaetz sought to intimidate former Trump attorney Michael Cohen. A statement from the committee said Gaetz was informed on May 16 that its ability to resolve the complaint would be hindered without his testimony. He was given until June 24 to respond or else an investigative subcommittee would be established to review the allegations that “Gaetz sought to threaten, intimidate, harass, or

otherwise improperly influence” Cohen. “Because Rep. Gaetz did not provide the committee with testimony, the committee was unable to dispose of the complaint by the rule-based deadline,” said the statement by committee Chairman Ted Deutch, D-Fla., and U.S. Rep. Kenny Marchant of Texas, the committee’s ranking Republican. The statement noted the establishment of a subcommittee --- to be chaired by U.S. Rep. Anthony Brown, D-Maryland, with U.S. Rep. Michael Guest, R-Miss., as the ranking member --doesn’t indicate a violation has occurred. Gaetz, a confidant of Trump, didn’t immediately return a request for comment. But in a statement to The Hill, Gaetz defended his refusal to comply with the House investigation. “If members of Congress want to spend their time psychoanalyzing my tweets, it’s certainly their

prerogative,” Gaetz told The Hill. “I won’t be joining them in the endeavor.” In February, Gaetz accused Cohen, who is married, of having “girlfriends” on the eve of Cohen giving testimony to Congress. “Hey @ MichaelCohen212 --- Do your wife & father-in-law know about your girlfriends? Maybe tonight would be a good time for that chat. I wonder if she’ll remain faithful when you’re in prison. She’s about to learn a lot...,” Gaetz said in the tweet. Gaetz later removed the tweet and issued an apology. Critics accused Gaetz of engaging in witness tampering. In May, The Florida Bar sent a similar complaint against Gaetz to a grievance committee, which is expected to spend three to six months reviewing the issue. DESANTIS VETOES WARNINGS ON LOTTERY TICKETS Jim TURNER News Service of Florida TALLAHASSEE – Lawmakers seeking to slap gambling-addiction warnings on state lottery tickets and advertising once again failed to scratch out a winner. On Friday, Gov. Ron DeSantis, noting potential impacts to money for education, vetoed a controversial bill (HB 629) that sought to require the following warnings to be prominently displayed on the front of all lottery tickets: “Warning: Lottery games may be addictive,” or “Play responsibly.” DeSantis in a letter accompanying his veto noted that Florida Lottery officials

expressed concerns the new warning requirements could affect marketing and participation in multi-state games. “As governor, one of my key priorities is making higher education affordable for Florida families,” DeSantis wrote. “This bill reduces the Lottery’s ability to continue to maximize revenues for education and negatively impacts Florida students.” The veto came as DeSantis signed seven other bills on Friday. The lottery bill, sponsored by Rep. Will Robinson, RBradenton, had been a priority of House leaders. Former Gov. Rick Scott, now a U.S. Senator, vetoed a similar measure in 2017, saying it would impose

“burdensome regulations” on the games and retailers. The Florida Lottery, which already encourages customers to “play responsibly” and promotes a tollfree number about gambling problems, would have become the first in the nation to include warning labels similar to what can be found on cigarette packs. Lottery officials argued the change could cause an annual reduction between $79.4 million and $232.7 million in money that games generate for education. They also warned the added gambling-addiction language could require the need to print larger tickets, which would increase costs and potentially affect contracts with retailers that provide

vending machine games. In addition, they contended the warnings could affect the state’s participation in multi-state games, such as Powerball and Mega Millions, and end scratch-off games that feature the TV shows “The Price is Right” and “Wheel of Fortune” and board games Monopoly and Scrabble. “The regulations imposed by the bill would impact the Lottery’s ability to continue to take advantage of all these avenues and have the potential to impact the revenues available for educational enhancement,” DeSantis wrote in the letter. State economists, who analyzed the potential effects of the bill, didn’t take such a dire view of the changes.

CANCER CARE FIGHT ENDS UP IN COURT CHRISTINE SEXTON News Service of Florida TALLAHASSEE – A bitter battle between doctors and a major cancercare company that led to last-minute maneuvering in the Legislature is now heading to federal court. 21st Century Oncology, the state’s largest provider of radiation oncology services, is asking a federal judge to block the state from enforcing a new law that would retroactively ban noncompete contracts the company entered into with five physicians. The company filed the lawsuit Thursday, naming Attorney General Ashley Moody and Secretary of State Laurel Lee as defendants. The company is seeking a temporary restraining order that would suspend the disputed part of the law and a preliminary injunction barring the state from enforcing it. The provision was tucked into a broader health-care bill in the waning days of the session. “The last-minute addition appears to be a targeted attempt to invalidate existing non-compete agreements for a specific group of physicians,” one

of the motions said. Attorneys argue that the new law violates federal and state constitutional protections to enter into contracts. The lawsuit came months after a group of physicians sued 21st Century Oncology. The Fort Myers NewsPress reported that the physicians contend “the cancer-care provider acts as a ‘monopoly’ by employing all radiation oncologists in Lee, Collier and Charlotte counties and, through restrictive contracts, prevents them from leaving and competing against them.” The provision inserted in the new law (HB 843) retroactively bans nocompete clauses for Florida-licensed doctors who practice a medical specialty in a county where one company contracts with all the physicians who practice in that specialty. The law bans restrictive contracts for three years after a second company comes into the county and starts providing the care. If not enjoined, attorneys for the company argued in the complaint, the law would allow the five physicians

to “dramatically alter the substantive rights of the contracting parties by reaching back into the agreements, removing one of the key bargainedfor provisions.” 21st Century Oncology operates multiple treatment centers. It is the largest provider of radiation oncology services in Florida, including in Lee County, where it is the only company currently providing the services. Attorneys say there are nine physician contracts in Lee County that the company signed, including with four current employee-physicians and five former employee-physicians, that include restrictive covenants. If not enjoined, 21st Century may be forced to reconfigure its healthcare model, including physician employment, attorneys argued in the lawsuit. The ban was tucked into one of several health-care bills that were negotiated behind closed doors. The bill, signed this week by Gov. Ron DeSantis, dealt with a number of issues that range from allowing patients to stay overnight at ambulatory surgical centers to limiting HMOs and insurance

companies from using “step therapy protocols” for prescription drugs in certain circumstances. 21st Century Oncology isn’t the only provider impacted by the legislation. It also will affect hospitals in rural counties that usually seek similar contracts with physicians. Vince Sica, chief executive officer of DeSoto Memorial Hospital in Arcadia, told The News Service of Florida last month that the ban will further stress the rural provider’s ability to offer reliable specialty health care. “Eliminating rural hospitals’ ability to negotiate terms for private contracts with physicians would bring into health care all the worst problems associated with ‘free agency’ in professional sports,” he said. “Rural communities already struggle to attract and retain physicians. “ R.D. Williams, CEO of Hendry Regional Medical Center in Clewiston, agreed. “If we cannot enforce our contracts with physicians, it may very well put us in a position where we cannot maintain the services that our community needs,” he said.

OUSTED BROWARD SHERIFF TO RUN FOR POST IN 2020 News Service of Florida staff Suspended Broward County Sheriff Scott Israel on Monday filed paperwork to run again next year for the post he was stripped of by Gov. Ron DeSantis. In an executive order suspending Israel from office in January, the Republican governor accused the veteran law enforcement official of “incompetence” and “neglect of duty” related to the February 2018 mass shooting at Marjory Stoneman Douglas High School in which 14 students and three staff members were killed. DeSantis also accused Israel of mis-

handling the response to a mass shooting at HollywoodFort Lauderdale International Airport that resulted in five deaths. Israel has appealed his suspension to the Florida Senate, which has the power to reinstate or remove elected officials. The filing of the campaign documents was no surprise; Israel, a Democrat who was first elected in 2012 and re-elected four years later, has repeatedly pledged to run again for his old job. Israel and his lawyers have called the suspension a “political ploy” by DeSantis designed to curry favor with voters. During a Senate hearing in his appeal last month, Israel said his removal from office was
