With OLF-8 in hand, county must decide Beulah’s future BY WILL ISERN

On Tuesday, Jan. 29 a Navy helicopter ceremoniously lifted off from a roughly 600 acre field adjacent to the Navy Federal Credit Union campus in Beulah and Escambia county finally took possession of the property known as Outlying Field 8. The Navy, in return, got a new, $17.5 million helicopter field in Santa Rosa County. The land swap brings into Escambia County’s possession what is arguably the most desirable and important piece of property for the future economic development of Escambia County. “When you look at all of our property adjacent to the interstate, this is the only tract we have,” said FloridaWest Economic Development CEO Scott Luth. “Everything else we have has been developed, has topography issues or potential wetland issues … I’m not going to say it’s the only one, but it is the largest one closest to the interstate.” At 636 acres with frontage along 9 Mile Road, the land has the potential to create jobs and bring sorely lacking amenities to an area of the county that has seen explosive growth as Navy Federal has expanded its Pensacola campus to employ more than 6,000 people. The trick will be striking a balance between the county’s desire for jobs, Navy Federal’s need for more space, the private sector’s

wishes for the property and the needs of Beulah residents. Offers to buy portions of the land have already come in. Navy Federal has offered $4.2 million to purchase 100 acres abutting the western border of its campus, and a group of private developers have offered $18 million for the remaining 530 acres. Meanwhile, Escambia County has its own plan to use $30 million in BP oil spill money develop the property as a commerce park and create 1,000 jobs. And all of these plans are likely contingent on the results of a master planning process which could take more than a year to complete. OLF-8, as its known, was identified more than 20 years ago as important asset and economic development heads have worked since to see it come into the county’s hands. The question facing county leaders now is, “What is the highest and best use for the land?” District 1 Commissioner Jeff Bergosh represents Beulah on the Escambia County board of County Commissioners and

lives across Nine Mile Road from the OLF-8 property. Bergosh is adamant that the property be used to create the necessary 1,000 jobs so as to qualify for the $30 million in BP oil spill money. Practically, Bergosh said he envisions shops and restaurants along 9 Mile Road and mixed-use development further from the road. “We need more amenities for the community provided by the private sector, and I mean restaurants, shops, things of that nature,” Bergosh said. “It’s sad to say right now if you want a hot meal in Beulah, you’re only option is a Tom Thumb gas station … So if I had to guess right now I think you’ll see amenities, shops, restaurants on the frontage of Nine Mile Road, you’ll probably see a center portion dedicated to some job creation and probably the back maybe some mixed-use, maybe some lofts, something like that, and some sort of a town center feature. That’s what I anticipate the master planner will come up with, but that’s about a year away.” Alongside its offer to

purchase the 100 acres, Navy Federal has also offered to pay up to $2 million to fund the master plan for the property. The company is currently constructing two new massive office buildings at its Heritage Oaks campus that, when complete, will double the amount of office space from one million to two million square feet. When those buildings are complete, company spokesman Bill Pearson said, parking will become a challenge. “That’s where the OLF-8 property really comes in to play for us,” Pearson said. “We would use some of that property to expand some of our parking for that side of the campus, and then we also are committing to creating some recreational space for both our employees and for the public to use.” If the county agrees to sell the 100 acres Navy Federal wants, the company has promised to create an additional 300 jobs, or roughly a third of the jobs necessary to secure the BP money. Navy Federal is on track to have 10,000 employees working at its campus by 2022. Not long after Navy Federal made its offer for the 100 acres, private developers Hemmer Consulting LLC and 68 Ventures LLC put forth their offer of $18 million for the lion’s share of the property. Hemmer developed

the Huntington Creek subdivision in Beulah and is working under the county’s mid-west sector plan to build more than 10,000 homes. Hemmer said he supports the master planning process for the site and would hope to develop a town center project. “I see it as a good opportunity where we have a huge investment in this area,” Hemmer said. “We think the master plan that the county will go through is what should be done there. We think that by letting the county control that planning process it would result in something that we would enjoy developing.” For all the years and dollars it has taken for the county to get to this point with OLF8, the project is effectively at square one. It remains to be seen whether the county will accept either of the offers it has been presented, or whether it will be able to secure the $30 million in BP money. One thing is certain, however. Whatever happens with OLF-8 will change Beulah forever. “I think it’s going to produce something that’s a win-win for the business community, a win for Navy Federal, a win for residents like me who are looking for a couple restaurant options, perhaps a big-box grocery store,” said Bergosh. “I think there’s a lot of good things in store for Beulah and this will just be one part of it.”

Local attorney wins Florida Bar President’s Pro Bono Service Award A local attorney has been recognized by the Florida Bar for her pro bono work and service to the community. Nancy Lynn Carty Hartjen was given the Florida Bar President’s Pro Bono Service Award Feb. 7 along with 21 other lawyers from across the Florida judicial circuits. The award is given to recognize volunteer legal services provided to low-income and disadvantaged people. The Florida Bar’s announcement read “Nancy Lynn Carty Hartjen has given more than 1,200 hours of pro bono le-

gal service in her 10 years as a lawyer in Florida. She has a particular interest in helping first responders, teachers and retired and active military personnel, but her most significant pro bono project reached out to the entire community. Hartjen was co-team leader of Justice on the Block (JOTB), a pilot program in 2017 and 2018 that was part of the Escambia Project. JOTB partnered with community centers and churches to host legal clinics, with lawyers able to attend in person or via Skype. JOTB survived past its pilot status, and Hartjen, who

has spent more than 225 hours on the project, still attends the clinics and continues to represent some JOTB clients in family law matters. Hartjen – who once painted T-shirts and motorcycle gas tanks for a living – came late to the legal profession, though she had long dreamed of being an attorney. After the death of her husband in 2000, she dove back into her studies and eventually earned her J.D. from Roger Williams University School of Law in Rhode Island. She has been a solo practitioner in Navarre since 2008.”

Escambia-Santa Rosa Bar Association’s Young Lawyers Division Awarded Grants The Young Lawyers Division of the Escambia-Santa Rosa Bar Association was recently awarded two $400 grants from The Florida Bar Young Lawyers Division. A Roundtable Grant was awarded for the annual “You’ve Got the JD, Now What?” Panel Program, which is held each year in June at Emmanuel, Sheppard and Condon. The program provides an opportunity for young attorneys, law students, and clerks to get tips on topics such as transition to practice, work-life balance, profes-

Santa Rosa county offers rain barrel workshops Santa Rosa County and UF/IFAS Extension will host a rain barrel workshops Wed., Jan. 30 from 5:30 until 7 p.m. and Wed., Feb. 27 from 10 a.m. until 11:30 a.m. at the UF/IFAS Santa Rosa County Extension office, 6263 Dogwood Dr. in Milton. The Santa Rosa County Stormwater Solutions Program will provide students with the parts and barrels to build a rain barrel at no cost, thanks to funding from the Florida Beverage Association. Rain barrels can be any large con-

tainers placed under downspouts to catch stormwater runoff from the roof. Screens between the barrel opening and the downspout keep out debris and mosquitoes. Collected water can then be used for outdoor watering needs. There is no cost to register for this workshop. Registration open for Escambia County adult softball Registration is underway for the Escambia County Parks and Recreation Department’s spring softball league for adults 18 and up, offering options for co-ed, competitive and recreation teams. North Escambia transportation service kick-off event set for Feb. 19 Escambia County will host a kickoff ceremony for the North Escambia Transportation Service Pilot Project Feb. 19. The event will be held at from 9 a.m. to 11 a.m. at the Community Health Northwest Florida Clinic located at 501 Church St., Century. Applications for the North Escambia Transportation Service will be available, and ECAT officials will be on site to answer questions about the program. The North Escambia Transportation Service Pilot Project is a new doorto-door demand response transportation project that is funded through a Transportation Disadvantaged Mobil-

ity Enhancement Grant. The project will begin Wednesday, Feb. 20 and will provide transportation to services within the area of Century, Molino, Walnut Hill, Davisville, Bratt and McDavid. To qualify for the program, participants must live north of Quintette Road within Escambia County and complete a short application. All trips will require 24-hour advance reservation. ‘Breakfast and a Movie’ returns to the National Naval Aviation Museum Breakfast and a Movie Series returns to the giant screen at the National Naval Aviation Museum, located onboard Naval Air Station Pensacola, every Tuesday in February. Career online high school program offered through Santa Rosa County library system The Santa Rosa County Library System participates in the Career Online High School (COHS) program. This program provides adults 19 and older an opportunity to earn an accredited high school diploma and career certificate online. The library’s program offers a limited number of scholarships to qualified adult learners who are looking to advance their careers, prepare for workforce entry and continue their education. The deadline to apply is March 31 to allow applicants adequate

time to complete a two-week prerequisite course, an in-person interview and a 30-day probationary period before the end of the fiscal year June 1. To apply, applicants must first complete the online self-assessment. Santa Rosa County has had five graduates from the 2016/17 program year and have awarded one scholarship for the 2018/19 program. Escambia County Animal Shelter offering special adoption rates in February on dogs and cats It’s the perfect time of the year to adopt a friend from the Escambia County Animal Shelter. The Escambia County Animal Shelter is offering a special reduced adoption fee of $50 for all dogs and puppies and $20 for all cats and kittens during the month of February. Adoption fees include altering of the animal (spay or neutering services), microchip, heart worm test and the initial vaccinations, including rabies vaccinations. PLAN TO LIMIT ATTORNEY FEES IN ‘AOB’ CASES STALLS By JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE – In what could be a glimpse of the battles to come over the heavily lobbied issue, a Senate committee Monday bottled up a proposal that would limit attorney fees in cases involving the insurance practice known as “assignment of benefits.” The Senate Banking and Insurance Committee tabled a bill (SB 122) sponsored by Chairman Doug Broxson, R-Gulf Breeze, after it became apparent the measure would fail if brought up for a vote. Though the 2019 legislative session does not start until March 5, it was at least an initial blow to the

insurance industry and other business groups pushing to limit attorney fees in socalled AOB cases. Sen. Tom Lee, R-Thonotosassa, joined three Democrats in opposing the bill, making it impossible for Broxson to patch together a majority on the eightmember committee. Insurers and their allies argue that fee limits are needed because of an increase in AOB litigation that is driving up consumers’ property-insurance premiums. But Lee said there are “some bad actors on both sides of the equation” and indicated he thought Broxson’s bill could end up hurting consumers who need homes repaired for such things as water damage.

“We are going to kill the patient while we try to cure the problem,” Lee said. Sen. Keith Perry, however, said the bill “is a step in the right direction” and argued consumers will face higher insurance rates if lawmakers don’t solve the problem. “We owe it to the working-class people of the state of Florida to do something,” Perry, R-Gainesville, said. Assignment of benefits is a decades-old practice that has become highly controversial in in recent years. Lawmakers have repeatedly considered proposals to address the issue but have not been able to reach agreement. In assignment of benefits, homeowners in need of

repairs sign over benefits to contractors, who ultimately pursue payments from insurance companies. Insurers contend that the practice has become riddled with fraud and litigation, while plaintiffs’ attorneys and other groups say it helps make sure claims are properly paid. Broxson’s bill focused only on attorney fees that insurance companies pay in many AOB disputes. While the bill stalled Monday – or, in legislative parlance, was temporarily postponed – it could be brought up again. Under state law, insurance policyholders are entitled to have their attorney fees paid if they prevail in cases against insurers. In 1972, a Florida Supreme

Court ruling also extended the right to recover attorney fees to people, such as contractors, who have been assigned insurance benefits, according to a Senate staff analysis. But Broxson’s bill would have prevented continuing to extend the right to attorney fees to contractors. The staff analysis said that such a change would “make the assignment of post-loss benefits less valuable. The assignee (the person assigned the benefits) would have to pay his or her own attorney fees to enforce the insurance contract.” Opponents of Broxson’s bill contend that assignment of benefits and the potential of litigation are needed because insurers sometimes try to avoid paying the

amounts of money they should for damage claims. Sen. Darryl Rouson, D-St. Petersburg, said Monday he thinks Broxson’s bill is a “nuclear option to get at a few bad people.” Supporters of the bill, however, contend that lawyers and restoration companies have abused the assignment-of-benefits system, with the problem initially focusing on water-damage claims in South Florida. They argue the problem has moved to other parts of the state and to types of claims such as replacing vehicle windshields. “This is a pandemic that is slowly beginning to spread across the state,” Sen. Jeff Brandes, R-St. Petersburg, said.

Anitere Flores, R-Miami, would regulate the types of surgery allowed in physicians’ offices and who can perform the surgeries. Flores filed her bill in response to a series of articles published by USA Today and the Naples Daily News about two Miamiarea clinics overseen by physician Ismael Labrador. The clinics have lost eight patients over the years and account for about 20 percent of the plastic-surgery deaths in the state. In a text message, Flores responded. “Good to know” when told Monday about the Board of Medicine action. “I’m not the expert,” she said,

adding that “(I) just know that there’s a problem that we need to fix.” Edward Tellechea, the Board of Medicine’s legal counsel, said Flores’ bill would codify into law many of the board’s existing rules. “I’m not sure it’s a good idea because it takes away the flexibility of the board being able to amend the rules,” Tellechea told members of the Board of Medicine Rules and Legislative Committee, which met Thursday in advance of the full board meeting. Chris Nuland, a lobbyist for the Florida Society of Plastic Surgeons, told the Rules and Legislative Committee that Flores’ goal was to have the Board of Medicine regulate not only the state’s physicians, but also their offices.

Flores’ bill would establish three different tiers for office surgery, from level 1, which would be simple procedures such as excising a mole, to level III, which would be more complicated and would require an anesthesiologist on site. “Every physician’s office that lances a boil would have to be licensed as an (ambulatory surgical center),” Nuland said, noting that was a concern for his members. Vila also is concerned with the notion of the board regulating more than just physicians. “We’re certainly going to address the things that fall within the scope of the Board of Medicine,” he said, adding, that Flores’ bill wants the board to regulate the offices. “We don’t control facilities,” he said.

FIRM ASKS JUSTICES TO OVERTURN INSURANCE RULING By JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE – In a closely watched case, a restoration firm asked the Florida Supreme Court on Monday to overturn a ruling that allowed restrictions on the controversial insurance practice known as “assignment of benefits.” Attorneys for Restoration 1 of Port St. Lucie filed a 45-page brief at the Supreme Court arguing that the 4th District Court of Appeal improperly backed restrictions placed on a policy by Ark Royal Insurance Co. in a St. Lucie County dispute involving water damage to a home. Assignment of benefits, or AOB as it is widely known, has been one of the mostcontroversial insurance issues in the state Capitol in recent years and will spur a fight during this spring’s legislative session. The brief was filed just hours before the Senate Banking and Insurance Committee was scheduled late Monday afternoon to take up a bill that would limit attorney fees in AOB disputes – a key issue for insurance companies. In assignment of benefits, homeowners in need of repairs sign over benefits to

Insurers contend that the practice has become riddled with fraud and litigation, while plaintiffs’ attorneys and other groups say it helps make sure claims are properly paid. Restoration 1 of Port St. Lucie filed a lawsuit against Ark Royal Insurance Co after policyholders John and Liza Squitieri sustained water damage to their home. Liza Squitieri contracted with Restoration 1 of Port St. Lucie to do cleanup work and assigned the benefits to the firm. Ark Royal, however, refused to pay the full amount requested by the restoration firm, pointing to an insurance contract that required approval from the husband, wife and the Squitieris’ mortgage company, PNC Bank, for benefits to be assigned to the contractor. Restoration 1 claimed breach of contract but lost in circuit court and at the 4th District Court of Appeal. In the brief Monday at the Supreme Court, attorneys for Restoration 1 argued that insurance regulators have rejected such restrictions on assignment of benefits.

“To be clear, Ark Royal’s requirement that an AOB be signed by the mortgagee (the mortgage company) makes an insured’s post-loss assignment of benefits a practical impossibility,” the brief said. “Allowing it to stand not only eliminates an insured’s right to freely assign postloss claims, but also does an end-around the normal legislative and regulatory processes that are in place to protect the citizens of Florida from such an overreach.” The brief also contended that the restrictions are aimed at achieving the “insurance industry’s ultimate objective of eliminating AOBs.” The case went to the Supreme Court after the ruling by the 4th District Court of Appeal conflicted with a ruling by the 5th District Court of Appeal. Security First Insurance Co. took a case to the 5th District Court of Appeal after the Florida Office of Insurance Regulation rejected a company proposal to add similar AOB restrictions to policies. A panel of the appeals court upheld the position of the Office of Insurance Regulation. The Supreme Court has agreed to take up the St. Lucie County case but has not

scheduled oral arguments. Ark Royal is expected to file its initial brief next month. As a sign of the heavy interest in the case, the Supreme Court has received requests from a variety of groups on both sides to file friend-of-the-court briefs. For example, an insurance industry group known as the Personal Insurance Federation of Florida, the Florida Insurance Council, the Property Casualty Insurers Association of Florida and the Florida Bankers Association filed a request in November to submit a brief on behalf of Royal Ark Insurance. “This issue is of significance to property insurers throughout the state, who are often confronted with post-loss assignments of benefits which have not been executed by all parties who have an interest in the insured property,” the request said. “This issue is likewise of significance to banks who hold the mortgages and therefore have property interests in these properties, with a significant interest in ensuring that repairs are properly made, and with the consent of the mortgagee, as required in the mortgage agreements.”

Addressing members of the Senate Health Policy Committee, Mayhew said DeSantis “recognizes that far too often safety nets become frayed and the needs of our most vulnerable go unmet.” Mayhew said she will focus her efforts on ensuring that Medicaid provides incentives for evidence-based medi-

cine and best practices. “That is clearly part of my vision, part of the governor’s vision, to move the needle to support high-quality care efficiently delivered,” she said. “And that’s not just a phrase, but that we have meaningful, objective data to support that we are providing that access and creating that accountability.” The Agency for Health Care Administration administers Medicaid and is charged with regulation of health-care facilities ranging from nursing homes and hospitals to abortion clinics. Mayhew told senators she will re-evaluate the agency to ensure it is efficiently regulating facilities. “I believe in a culture of continuous

process and quality improvement,” she said. DeSantis announced in December that Mayhew was his choice to run the agency. Prior to heading to Florida, Mayhew served in a top Medicaid position in President Donald Trump’s administration. Trump brought her into his administration after she ran unsuccessfully for governor in Maine, where she had served as commissioner of the Maine Department of Health and Human Services. Mayhew spoke to committee members for about five minutes Monday. Senators didn’t ask Mayhew any questions, but she will appear before the committee again during her Senate confirmation process
