Legacy of the ESRBA

First, let me say thanks to those who worked hard to make Law Week 2019 a success! Our Law Week Committee, comprised of Michelle Olliff, Rachel Sheffield, and Haley VanFleteren, did an outstanding job of organizing each of the events. I also extend a special thank you to Judge Pitre for hosting our Law Week religious service at St. Ann’s. I am confident that those who attended the Law Day Luncheon enjoyed the interesting panel discussion as much as I did. The panel discussion was moderated by Charles Beall, who always goes the extra mile to serve our Association. Finally, thanks to Jeff Nall and his team and to the many other people who served behind the scenes.

Each of the Law Week events reminded me of the majesty of the law and of our profession, and also reminded me of the wisdom and service of those who have gone before us. It humbles me to know that we are all links in a long chain that stretches a long way back and that will, eventually, carry-on without us. As Michael D. O’Brien wrote in his novel, The Island of the World (Ignatius Press, 2007): “We are born, we eat, and learn, and die. We leave a tracery of messages in

the lives of others, a little shifting of the soil, a stone moved from here to there, a word uttered, a song, a poem left behind. I was here, each of these declare. I was here.”

In the meantime, let’s enjoy the blessings that God has given us today.

My year as our president is winding down. It has certainly gone by quickly!

The 2018-2019 year involved some important transitions as Mike Doubek retired as our Executive Director after many years of service and as Jeff Nall successfully took-up those reins. To add to those changes, our office has moved to a new location, 260 S. Tarragona Street, Suite 160.

It has been an honor and privilege to serve our Association, and I have enjoyed getting to know many of you better. Our annual installation banquet will be on July 11, 2019 at V-Paul’s, at which time the new Officers and Executive Council will be sworn-in.

I hope to see you there.

ESRBA’s New Office Location

The Judicial Conference of the United States is expected to authorize the appointment of a full-time U.S. Magistrate Judge for the Northern District of Florida in Tallahassee. The deadline for applying for the Magistrate Judge position is Aug. 1.

The duties of the U.S. Magistrate Judge are demanding and wideranging. Magistrate judges conduct most preliminary proceedings in criminal cases; trials and disposition of misdemeanor cases; various pretrial matters and evidentiary proceedings on delegation from a district judge; and trials and disposition of civil cases upon consent of the litigants.

New Professionalism Requirement Amendment to Rule 6-10.3(b) Effective March 5, 2019, 5 of the required 33 credit hours must be in approved legal ethics, professionalism, bias elimination, substance abuse, or mental illness awareness programs, with at least 1 of the 5 hours in an approved professionalism program. Compliance for the new rule will begin in the member’s next reporting cycle following the March 5, 2019 effective date.

T

he Florida Bar Board of Governors met on May 24, 2019, in Palm Beach. The major actions of the board and reports received included: The Board approved a proposed amendment to Rule 4-7.13, regarding misleading advertisements. At issue is a common approach, often through Google AdWords, that allows a lawyer to use a competitor’s name to trigger search engine results and drive internet traffic to the advertising lawyer’s website. The amendment prohibits “any statement or implication that a lawyer or law firm is affiliated or associated with the advertising lawyer or law firm when that is not the case.”

A new member benefit, ROSS Intelligence, was approved and added to the more than 60 free or discounted products and services already offered to Florida Bar members. As an outgrowth of President Michelle Suskauer’s Criminal Justice Summit in October, the Board created a 10 to 15-member committee to “act as a forum for discussion and provide subject-matter expertise in criminal justice legislation, without advocating for a particular legislative position.”

The committee is scheduled to begin work in July, and has a June 30, 2020 deadline.

The Board of Governors approved a $44.6 million budget, marking 18 consecutive years without a member fee increase. The General Fund Budget includes $42.1 million in total revenues and nearly $44.6 million in total expenses. The budget now goes to the Florida Supreme Court for final approval.

Young Lawyers Division YLD secures grant for Onbikes Pensacola

by Jessica Etherton We previously reported that ESRBA YLD President Jessica Etherton and YLD Vice President Kelsey Stone attended THe Jessica Etherton Kelsey Stone Florida Bar’s YLD Affiliate Outreach Conference in St. Petersburg in January. They presented a grant application on behalf of Onbikes Pensacola. The ESRBA YLD has attended The Florida Bar’s YLD Affiliate Outreach Conference and requested grant funds to support Onbikes Pensacola for the last three years. Onbikes Pensacola was started by young lawyers in Pensacola and is a 100% volunteer board made up of mostly lawyers under the age of 35. Onbikes raises money throughout the year through scholarships and grants and uses the money to purchase bikes wholesale from a national manufacturer. The wholesale bikes come in boxes and must be assembled.

Onbikes hosts “bike builds” where community volunteers come out and help to assemble the boxed bikes. Onbikes’ main event is a large bike build in December where hundreds of bikes are built at one time.

Thanks to the support of The Florida Bar YLD and from local sponsors and other grants, Onbikes Pensacola has been able to provide two bikes, helmets, and locks per day to children since its inception in December 2016 (that’s over 2,000 bikes, helmets, and locks)! In 2017, The Florida Bar YLD awarded Onbikes with enough money to pay for the helmets and locks for over 100 children at the spring bike build. Onbikes was ultimately able to give away 167 bikes because of the costs offset by The Florida Bar YLD and other organizations. Onbikes also instituted a safety brochure program, and a YLD branded safety brochure is given with every bike. In 2018, The Florida Bar YLD awarded Onbikes with enough funds to pay for a temporary storage for its inventory of bikes, helmets, and locks.

By storing an inventory, Onbikes was able to do several smaller, more targeted bike builds throughout the year, which allowed Onbikes to provide bikes to smaller and different charities who were unable to transport the bikes themselves.

This year, Jessica and Kelsey requested The Florida YLD’s support of Onbikes through a monetary award to fund the purchase of a covered trailer. Many of the charities, schools, and organizations that request bikes from Onbikes do not have the means to pick up large orders of bikes, so a covered trailer is the perfect solution both for delivery and storage. OnBikes recently received the grant award from The Florida YLD for $1,750! The funds will go toward the eventual purchase of the covered trailer, and with this grant, Onbikes will be to impact even more children through even more charities.

Electronic Access to Court Records

Preparations for Florida Supreme Court Administrative Order 19-20 On April 16, 2019, the Florida Supreme Court, via Administrative Order 1920 (“AOSC 19-20”), brought the rules governing access to state court records in line with the rules governing appearance of an attorney. Specifically, AOSC 19-20 amended the Standards of Access to Electronic Court Records and Access Security Matrix to provide that an attorney’s level of access to court records, regardless of the medium, must be changed to provide reduced access when the attorney’s appearance terminates pursuant to rule 2.505 of the Florida Rules of Judicial Administration.

Currently, rule 2.505 provides that an attorney may utilize one of three approaches to appear as counsel in a case.

An attorney may become an attorney of record by serving the first pleading or paper, by filing a notice of appearance, or through substitution of counsel. In like fashion, rule 2.505 provides four events that trigger termination of an attorney’s appearance in a proceeding. An attorney may withdraw from a case or alternatively substitute counsel may appear for a party.

Both of these events require ratification by order of the court. In family law cases, an attorney may terminate his or her limited appearance by filing a notice pursuant to rule 12.040 of the Family Law Rules of Procedure. Finally, and likely the most frequent scenario, is termination of the attorney’s appearance automatically upon entry of a final order and after the time for appeal has expired, where no appeal is taken.

Prior to AOSC 19-20, once an attorney was of record in a case, he or

she enjoyed a greater of level access to court records even after the attorney’s appearance ended. AOSC 19-20 changes this providing that an attorney’s access must be changed to that of a Registered User when the attorney’s appearance terminates pursuant to any of the criteria set forth above and more specifically described in rule 2.505. The Access Security Matrix provides a number of different roles to differentiate the varying levels of access depending on who is accessing a case. Attorneys of record are User Role 3 and Registered Users are User Role 5. An attorney will transition on the Access Security Matrix from User Role 3 to User Role 5 once he or she is no longer attorney of record in a case.

To put this into perspective, for circuit civil cases, an attorney who is no longer of record is permitted to request to view court filings, but will not be able to see information made confidential by Court order or made automatically confidential pursuant to rule 2.420(d)(1) of the Florida Rules of Judicial Administration.

A similar result occurs for felony cases wherein an attorney must request to see records and will not be able to view confidential information if they are no longer the attorney of record. There is no exception for redaction of confidential information even if the requestor is the one who originally filed the document.

Furthermore, requests to view Court records are processed in the order in which they are received and it may take the Clerk’s office several days to process a request depending on the length and complexity of the record requested.

The Clerk’s office is on schedule to fully implement the Supreme Court’s Administrative order on July 1, 2019.

Therefore, attorneys should ensure they are prepared to start saving court filings either in paper or electronic format. The average size of a single-page scanned image in PDF format is about 50 kilobytes. This means you can store roughly 20 images utilizing 1 megabyte of disk space. External hard drives with a terabyte (one million megabytes) of storage space can be purchased at your local electronics store for less than $100.

Cloud storage is also available and may be more cost effective and manageable for your office. It may help in your preparations to know that the average number of pages in a felony, circuit civil, and domestic relations case is 82, 188, and 64, respectively. Counsel may want to utilize some of the Florida Bar’s resources for going paperless at www.legalfuel.com.

• While court technology had been approved and vetted prior to her taking the Chief Judge bench, Judge Nobles has overseen the implementation, training, equipment changes, budgetary issues, staff, and finalization of many of the technology advances utilized in the courts of the First Judicial Circuit. SmartBench is an internal judicial viewer which works in concert with the information systems utilized by the Clerks of Court across the circuit. Judge Nobles ensured training was available for everyone in the First Judicial Circuit and the applicable stakeholder agencies. She supported the needs of the judiciary when observations, questions, and concerns came to her attention. Through it all, Judge Nobles supported the entire circuit through the vastest transition in technology in the history of the courts to date.

n July, we will welcome a new Chief Judge in the First Judicial Circuit, Circuit Judge John L. Miller.

Before the transition though, we would like to reflect on Chief Judge Linda Nobles’ tenure. Judge Nobles was elected for the position of Chief Judge and her duties began July 1, 2015. In addition to the many responsibilities of the Chief Judge, he or she also inherits duties on behalf of the judiciary in the circuit, as well as increased travel commitments for State committee work and legislative participation.

Consideration must also be given to day-to-day operations and decisions, administrative tasks, and the collaborative relationships fostered with other agency and community leaders.

Chief Judge Nobles arrived to the Chief Judge position at a time of vast changes in courts as a whole.

Let’s take a look back at several of her accomplishments.

Security Hardening • Implemented equipment placement for secured access to all judges in Escambia County. Restricted access to judicial offices is a reality in the Blanchard Building which houses the highest population of judges, court staff, stakeholder agencies, and, consequently, the number of visitors.

• Added to the mandates from the Supreme Court were the processes required to transition many court processes away from the use of paper into a digitized structure for end users - including the public, members of the Florida Bar, stakeholder agencies, and the entire court staff.

Again, Judge Nobles spearheaded all the necessary components to effectuate this change.

Construction and Renovation

2019 Liberty Bell Award Recipient Connie Bookman

However, in Connie Bookman’s line of work, hope fuels her vision for a better community, one free of substance abuse and poverty. Liberty Bell recipient and founder of Pathways for Change Connie Bookman speaks on her journey to breaking the cycle.

Bookman is no stranger to service. She has dedicated her career to being an advocate for the most vulnerable members of the community. After receiving her undergraduate degree in Social Work from St. Leo University and a Master’s in Social Work from Florida State University, Bookman worked for 15 years as a medical social worker for Baptist Health Care, serving terminally ill clients. In 1992, Bookman developed the only residential treatment program in the Pensacola area for single homeless women. She went on to become Executive Director of The Christian Counseling Center in 1999 where she began a partnership with Florida State University, Troy University and University of West Florida’s Social Work and Psychology Departments.

These experiences culminated in Bookman founding Pathways for Change (PFC), a faith-based addictions treatment program, in 2005. PFC provides mental health counseling, case management, and vocational and educational training that assures 100% employment upon graduation. The effectiveness of the program is recognized by the courts; Pathways for Change is a viable sentencing program in Escambia. This 18-month court ordered “therapeutic community” costs $15,000 per year, vs. $26,000 a year for a regular jail sentence, saving taxpayers over $1 million each year with its 70% success rate.

Beyond her heart for service, Bookman’s community impact can be attributed to her ability to organize and facilitate collaboration. Bookman recruited 12 nonprofit executive directors who committed to meeting monthly for one year to strategize a plan that would be most impactful for PFC clients. PFC has over 30 community partners who share in the success of this cost-effective reentry program. Reflecting on the importance of community partners, Bookman states, “Our relationship with community partners is vital. PFC cannot be an expert in all area of services.” PFC relies on the supplemental support of organizations

like George Stone Vocational School, Community Drug and Alcohol Commission, Escambia County Health Department, the United Way, Community Action Program Commission, the Studer Community Institute, Opening Doors Homeless Coalition, and Area Housing Commission. Bookman also recognizes the importance of support from the local bar stating, “The Escambia Santa Rosa Bar Association has supported PFC over the years, sharing information about our services to pro-bono legal service agencies such as Emerald Coast Legal Aid and Legal Services of North Florida and having promoted our fundraising and awareness events in their newsletters and publications.”

Bookman’s service has not gone unnoticed. In addition to being honored as the 2019 Liberty Bell recipient, Connie has also received the FSU School of Social Work Field Educator of the Year, the Quint Studer Servant Leaders Award, the Freedoms Foundation George Washington Honor Medal, and the 1st Judicial Circuit Chief Judge Award of Service, to name a few. states, “I had been skeptical of some of the alternative sentencing programs, but my clients who went [to PFC] were changed people. My client is a manager of a successful business and has not picked up a drink or used in 10 years. If not for Connie and her tireless efforts to change people’s lives, people like him and others might not have had the chance to turn their lives into success stories.”

If you are plagued with the misconception that one person cannot make a difference, take heed to Bookman’s words. “The single greatest motivator for our clients are the mentors in their lives.

The purpose of the Liberty Bell Award program is to recognize community service that has strengthened the American system of freedom under law and to accord public recognition to men and women, particularly non-lawyers, for outstanding service in one of these areas: 1. Promoting a better understanding of our Constitution and the Bill of Rights; 2. Encouraging greater respect of law and the courts; 3. Stimulating a deeper sense of individual responsibility so that citizens recognize their duties as well as their rights; 4. Contributing to the effective functioning of our institutions of government; and 5. Fostering a better understanding and appreciation of the rule of law.

Gulf Breeze High School takes top honors in mock trial competition

he 2019 Florida Law Related Education Association (FLREA) Mock Trial Competition was a tremendous event in the First Circuit, due in no small part to the Escambia-Santa Rosa Bar Association (ESRBA).

Originally, eight teams signed up to compete.

Due to scheduling conflict, only six teams eventually participated. But, that represented a significant increase in participation nonetheless.

This program persistently features phenomenally poised, practiced, and prepared young people. Their enthusiasm and dedication are simply inspiring. These are young people of the local community, preparing for their futures through a rigorous academic endeavor. They are supported by dedicated attorneys, teacher coaches, and sponsors. In recent years, there has even been one high school principal that attends to support.

There were also familiar faces in the audience, former members of these teams.

These young alumni have transitioned from student to mentor. Their return to support their high school team epitomizes the strong character and citizenship of the students that are persistently involved in this competition. These are student citizens that are engaging their communities and building skills. These are students of which we should all be proud.

Throughout the planning

and execution of this event, the competition was supported by ESRBA Executive Director Jeff Nall. And, it was indeed a proud moment when Young Lawyer President Jessica Etherton presented the awards following the final round.

There is great value in these students, parents, and coaches witnessing the engagement of our local bar association.

The top three 2019 First Circuit finishers were Gulf Breeze High School, Tate High School, and Catholic High School. With the generous financial support of the Escambia-Santa Rosa County Bar Association Foundation, Gulf Breeze traveled to Orlando to compete in the FLREA state competition. They finished fourth in Florida. The team was also honored with a professionalism award and one team member was named best witness overall in the state competition.

The competition was also fortunate to have volunteer student timekeepers from Pensacola State College and the University of West Florida Legal Studies program; yet another example of community and student mentorship. It is inspiring to see college students volunteering in support of a valuable high school activity in the community.

Finally, this Circuit is privileged that the Escambia Santa Rosa County Bar Association Young Lawyers Division provides significant annual financial support for this competition. Their generosity allows this competition to proceed in the courthouse, which requires payment for security services.

It is their financial support that allows the competition to bestow trophies and other recognitions to these phenomenal local students, recognizing their hard work.

Without the support of the Bar Association and Foundation, the First Circuit competition would simply not be all that it is. The First Circuit communities, schools, students, and parents are grateful for your time, your contributions, and your support. Local leaders look forward to this competition each year, and look forward to seeing all of you again in 2020.

An Icon of the Pensacola Legal Community

rofessor Susan Harrell officially retired from the University of West Florida at the end of the spring semester of 2019.

While I know her as a colleague and friend in the Legal Studies program, many others know her as a zealous advocate for her clients and for her utmost professionalism in the courtroom.

Susan attended Cumberland Law School and began practicing law in 1984. After spending six years in practice in criminal and family law, she moved on to become a faculty member in the Legal Administration program (that is what it was called back then) at UWF in 1990. For the next 29 years, Susan put all of her energy into her teaching and research.

Even as a professor, Susan never forgot her roots as an attorney and has continued to advocate for greater ethics and professionalism from members of the bar. She has been a prominent member and supporter of both the Escambia-Santa Rosa Bar Association and the Northwest Florida Paralegal Association.

She attended numerous conferences and gave many presentations throughout her time at UWF, and fittingly, her

last presentation was given this past April on – you guessed it – ethics and professionalism.

While I will miss having her wise counsel, the ones who will undoubtedly miss her the most are her students.

Her passion for teaching and the law is infectious and she puts every ounce of her efforts into preparing students for careers in the law. Susan has been accused once or twice of giving “tough love,” but make no mistake about it – her advice and constructive criticism is always designed to best position students after life at UWF, even if that means a career outside the law. If you ask Susan a straight question, you’ll always get a straight answer.

The class she has become synonymous with is Legal Research and Writing. I can say unequivocally that students who are immersed in the class during that semester are, to say the least, mildly unhappy.

It is intense, with regular trips to the library and countless Westlaw sessions. She drills the intricacies of proper citation format, the need to always Shepardize, and the differences in conventional writing and legal writing. Her students sometimes refer to it as “boot camp,” and rightfully so.

After the class is over, students change their tune.

There are so many students who tell me that they are so grateful that Susan Harrell taught them Legal Research and Writing.

Every single time I ask a former student, either in law school or working as a paralegal, what was their most important class at UWF, the answer is always the same – Susan Harrell’s Legal Research & Writing class. They recognize the benefit of knowing how to do legal research, and they are fortunate enough to have learned from the master.

Susan will be greatly missed and her impact on

her colleagues and students is immeasurable. But, she has earned her retirement and will get the opportunity to do what she truly loves – travel the world. I hope she thinks about us as she is traversing the Antarctic, exploring the jungles of Africa or island hopping in the Pacific Ocean.

Her presence will not be forgotten, and what the Legal Studies program has achieved is due in large part to her persistence and drive to make UWF a better place to learn.

Law Week 2019

By Jeff Nall The Escambia-Santa Rosa Bar Association (ESRBA) recently held its annual week-long extension of Law Day. The week of activities provided an opportunity for all those who participated to join peers across the nation to celebrate the rule of law and reflect on how law and the legal process protect our liberty, strive to achieve justice, and contribute to the freedoms that all Americans share. “Law Week 2019 was a great success,” said ESRBA Young Lawyers Division president Jessica Etherton. “All of the events that the Law Week Committee planned were very well attended by both judges and attorneys, and everyone had a wonderful time networking and meeting new members of our legal community.”

The theme selected by the American Bar Association (ABA) for Law Day 2019 was Free Speech, Free Press, Free Society. According to the ABA, “the theme focuses on these cornerstones of representative government and calls on us to understand and protect these rights to ensure, as the U.S. Constitution proposes, “the blessings of liberty for ourselves and our posterity.”

More than 65 attendees gathered to honor the local judiciary at V. Paul’s Italian Ristorante on Tuesday, May 14. The Judicial Reception, sponsored by the ESRBA’s Young Lawyers Division and Mike Chastain with Dex Imaging, also provide an opportunity for judges, attorneys, and paralegals to mingle and network in an informal after-hours social setting.

Locally, Law Week 2019, presented by McMahon and Hadder Insurance, included a judicial reception, a luncheon, and a religious ceremony.

Each event provided ESRBA members and guests to engage with the theme and each other in a variety of settings.

The panel was comprised of journalist, author, and television contributor Molly Barrows Vigodsky, editorial cartoonist and columnist Andy Marlette, and attorney James Green, Jr. of Clark Partington. The panel explored the role of the press, the shared responsibilities of media outlets and the public to search for the truth, and the impact of social media. Attorney

and former newspaper editor Charles Beall of Moore, Hill and Westmoreland, P.A. moderated the enlightening discussion.

The eventful week concluded with several dozen members of the local judiciary and Escambia-Santa Bar Association, and their families, joining host Judge Stephen Pitre, Monsignor Luke Hunt, and parishioners of St. Ann Catholic Parish for a mass at its main campus in Gulf Breeze. “Leadership can be envisioned by Mt. Rushmore; freedom revealed by our flag or Lady Liberty. Law Week exists to recognize the rule of law and the benefits to all. To a large extent, confidence and security result from laws that are meant to give predictability. The marketplace of ideas has safe shelter in the courtroom where it is measured on its substance.

These were some points addressed at the religious ceremony at St. Ann’s Catholic Church in Gulf Breeze which concluded this year’s Law Week,” explained Judge Pitre.

“And although the celebratory week has come to an end, our appreciation endures.”

Law Day Winning Essay

T

hroughout history, technology posed challenges to the freedoms of speech and expression. The printing press made speech and writing more accessible to the common masses which weakened the powerful. The invention of radio and television allowed the rapid spread of events across large populations, but, at the same time, brought scenes of violent war into homes at dinnertime. Now, as the internet streamlines the spread of information across the entire world, it too is bringing new kinds of threats and that means new fears of attacks on the First Amendment.

Social media companies like Facebook, YouTube, and Twitter are revolutionizing the way we communicate and challenging our beliefs about free speech, however, the First- Amendment protections that exist can and should remain the same.

Even though most everything about the primary way we exchange ideas is digital, the basic acts of discussion and debate remain personal. While the discussion may have moved from the park bench to the PC, speech is still speech. Unfair

censorship is still unfair. Human nature remains unchanged. Cases decided by the US Supreme Court within the past five years, demonstrate the ways that new technology does not bring new problems.

It just recycles old problems again.

When technology advances, previously held legislation is called into question.

In 1976, The United States v. Kelner, a case concerning a threat of assassination against the Palestinian leader Yassar Arafat, was decided by the United States Supreme Court. Russell Kelner, a member of the Jewish Defense League, verbally threatened to assassinate Arafat while he was in New York for a United Nations assembly. The case was simple.

It was a verbal threat with intent to kill, clearly illegal. Kelner was convicted.

Fast forward to 2015, Anthony Elonis is arrested for making threats against his wife and several others by means of Facebook comments. In trial, he claimed that his comments were not threats. He used his social media as a place to vent. He said that he never intended to actually harm people. He

claimed that because the threats were nothing more than Facebook venting, he should not be convicted. This is nonsense. Threats are threats. They have always been. Never before has threatening to do bodily harm to your wife, coworkers, and a kindergarten class been acceptable or protected, no matter what communication medium has been used. Elonis was eventually convicted, but the trial took much longer than it should have. The legislation applicable in United States v. Kelner still stands. It is a federal crime to “transmit [ ] in interstate or foreign commerce any communication containing…any threat to injure the person of another, 18 U.S.C. § 875(c).

There should have been no question. The presence of Facebook in this case caused confusion that would have ordinarily not been present.

In addition to the constant restrictions, our freedoms regarding speech and expression have also remained constant.

The most cited case regarding the bounds of our freedom, Schenck v. United States, happened in 1919, long before the invention of social media or even the computer. While this case originally only concerned wartime freedom, decisions that were made reflect perfectly the boundaries of our freedom of speech in peacetime, most notably, Justice Oliver Wendell Holmes’s famous quote, “The most stringent protection of free speech would not protect a man in falsely shouting fire in a theater and causing a panic.” This has long hence been the standard for our freedom. We can say

Recently, social media companies have challenged this freedom. Facebook, Twitter, and YouTube have all been accused of unfair censorship of their users; they censor and delete everything that they find offensive or unacceptable.

Each of these large media corporations have clauses within their terms and conditions that restrict what they refer to as hate speech. Hate speech has no legal definition; moreover, companies using terminology like this in their terms and conditions means that they can virtually censor whatever they want.

Large corporations have often used this power in order to suppress viewpoints that they do not agree with in order to push a certain agenda. This is dangerous because we live in a world where most of our ideas are transferred through these social media giants, and the access to conflicting opinions is the only way to find common ground and move forward as a nation. If only one side of an issue is represented, no discussion occurs, and no progress is made. Speech that does not incite lawlessness is legal, and censoring it is detrimental to the progression of society. No one disagrees with the concepts proposed in the Constitution, but when looked at through the lens of the progression of technology, people forget the principles that they would have ordinarily supported without question.

The marketplace of ideas has shifted from governmentally controlled forums, such as two men talking on a park bench, to privately controlled ones. Because the power social media companies possess over the spread of ideas is similar to the power of the government, they are no more allowed to censor speech than the government is.

Every time new technology is released, the same pattern repeats itself: people are confused, in response to confusion, they over regulate. This nation has changed a lot, but some things have held true. We have the same basic regulations on speech that we had in 1975, and in 1919, and in 1776, and they have worked. We do not need to change our legislation. We simply need to hold true to the principles found in the Constitution’s first amendment.

What Lawyers Really Think About Judges

If I am going to write an article about judges’ peeves about lawyers, it seems only fair that the lawyers get to express their grievances about judges.

Now, I have a favor to ask. And, no, I do not know what I am getting myself into.

I would like as many lawyers as possible to review me on the judicial review site on the Florida Bar web page. I am told lawyers do not use this site because they fear being identified and that there would be some form of retribution. They simply do not trust The Florida Bar to keep their identities confidential.

HOWEVER, if enough of you submit reviews, two results will occur. First, to the extent there is consistency in the comments, it will inform me how attorneys view my performance. Second, there is strength in numbers: If you are the ONLY one submitting a review, then it is possible the judge can fairly accurately determine who you are. If there are one hundred reviews, it would be next to impossible to identify any one particular lawyer.

So, please, log into The Florida Bar web page. Under “My Status,” on the left-hand side, you will see “Judicial Feedback.” You can click on Circuit Judges, then click on the First Circuit, and then you will find the form to review me.

While you are at it, you might want to review some other judges.

This is not an ego trip. I have an ulterior motive. If I can get you to review me, and there are no ill consequences, you may be more willing to review other County, Circuit, and/or Appellate judges in the State. By judges getting this feedback, there may be positive change and improvements.
