We all know that it all comes down to Florida, but why? Since at least 1996, Florida’s Republican/Democrat split has been within six points, most infamously in 2000 when Bush won the election though Gore won the popular vote. Over the last ten elections, Florida voted with the winner nine times. This year promises to be no different, as it is the opinion of most political scholars that Trump cannot win the presidency without Florida. Given the state’s deep segmentation, embattled districts and diverse populations, that may be more difficult than ever. In order to qualify as a swinger, a state must have a demographic makeup similar to the nation as a whole, have been a predictor of success in previous elections, receive widespread media attention, and have close statewide opinion polls. Florida has each of those characteristics in spades, along with Ohio and Pennsylvania. “It’s a very, very competitive state,” said Susan MacManus, professor of political science at the University of South Florida. “According to recent registration stats, there’s only a difference of 256,000 between Republicans and Democrats. You

also have to look at the emergence of the NPAs (No Party Affiliation) and minor parties, as well as the political rise of the millennial generations.” In fact, 18- to 34-year-olds comprise the largest generation in the workforce and the largest contingency of general election voters. Most of them are registered NPA and do not like either of the traditional candidates on the ballot this year. “There’s this notion that Florida is a retiree state, so when you come here, you just talk about Social Security,” said MacManus. “That’s not true anymore.” It was not always this way, of course. Florida used to be just another state that went red or blue. Mostly Democratic after Reconstruction, demographics shifted slightly to give Republicans the edge in the 1950s. At the same time, its population grew rapidly from eight electoral votes during WWII to 29 today, an increase unmatched by any other state except Texas. Add in Cubans, retirees and tourism service workers, and you have an economically and politically diverse state. Whenever it appears one party may have a tenuous hold, another population statistic will shift to throw the balance. MacManus pointed to the increase in the number of Hispanics, blacks and new registrants as evidence that Florida’s population makeup is changing, and with it, messaging within the state must change as well. Most of these individuals, especially Puerto Ricans who left their own country be-

cause of economic collapse, do not feel party loyalty like many American natives do, and so these individuals are up for grabs. Both Democrats and Republicans are working hard to court that demographic who primarily live along the I-4 corridor, a section of the state which accounts for 44 percent of Florida’s voting population. There has been a massive generational shift in recent years with younger and more diverse Hispanics making up a majority of that minority’s population. Younger Cubans are more Democratic, and while you may think that blacks always go to the Democrats as well, there has been some friction recently between native blacks and South American blacks. “We have more diversity than ever, even within our various subgroups,” said MacManus. Asians are also a growing segment of the population, now at 2 percent. Most of these individuals can be found living near military bases and other areas of high-tech concentrations. This emergence of Asians is most likely to register independent though vote Democratic. It seems like a great many of these minorities are in the Democrats’ back pocket, or at least easily courted by them. While that may be true, Republicans have a firm hold on what may turn out to be a secret weapon this election: working class white voters, alienated from Washington, who have never voted before or perhaps are not even registered. Trump’s game plan

has always been to win by expanding the electorate and turning out previously “lowenergy” voters. And while longer-term demographic changes may more handily ensure Democratic victory, there are currently a lot of disenchanted white voters in the North, Northwest and Southwest. “Down there in Naples and Sarasota is where you’ll find a huge number of highturnout, older Republican voters,” said MacManus. “They’ve typically been very dependable, though this election there will be an unknown proportion who don’t vote, as well as some traditionally Republican women who cross over. By the same token, there are some Democrats—especially white males—who can’t bring themselves to vote for Clinton, and they will cross over the other way.” This leaves both candidates in the unenviable position of capturing new populations while trying to ensure their dependable base remains intact. This is where the pivot we often hear so much about comes into play. In political science, a pivot is what occurs when a candidate will risk alienating a small portion of their voters in order to capture a larger contingency of previously off-limits voters. In Florida, a successful pivot cannot happen without visiting almost the entire state, including the oft-ignored Northeast. “Florida has the most electoral votes of any swing state,” said MacManus. “It’s a huge predictor of success.

No state looks more like America than Florida. A Republican cannot win without Florida—and cannot win Florida without visiting each of its regions. You cannot ignore the Panhandle, because they’re high turnout, but Tampa is the biggest media market, and of course Orlando is a third of registered voters. A lot of candidates will ignore Jacksonville, but that’s crucial and could send one candidate or another over the slim margin of victory.” So who does MacManus think has the best shot? “The polls right now are slightly favorable to Clinton, and registration trends give her a 0.9 percent edge, but so many crucial things haven’t unfolded yet,” said MacManus. “Typically, presidential debates, for example, will move Floridians more than most other states. A misstep at the debate could really change everything.” There’s too much that’s unpredictable right now, according to experts, and Florida is within the margin of error within most polls. While an aggregate of polls puts Clinton at about 75 percent of winning the Sunshine State and Trump at 25 percent, it should be noted that those odds were inverted just a month ago. Until November, we will continue to see the state play a massive role in the conversation around politics and political forecasting. Expect to see lots of media ad buys and frequent visits, and keep a close ear out for speeches that try to cater to everyone while alienating no one.

The Veterans Court will be co-located with the civil legal clinic. Through the Veterans Court, individuals will be able to consult with the public defender and, if appropriate, have a hearing with the judge to address certain criminal warrants, fines, and related issues that may be keeping the Veteran from finding stability. On Friday, September 23, 2016, in Pensacola, veterans in need of service will gather to Stand Down. “Stand down” is a military term meaning relaxation from readiness or alert. In active duty, this means a break to re-group from the stresses of combat—the opportunity to renew their spirit, health and overall sense of well-being. For our local homeless and at-risk veterans, it means much the same—a chance to re -group from the stresses of homelessness and instability to be served by our community. Included among these services are a Veterans Court (staffed by the State Attorney, Public Defender, Clerk of Court, and Judiciary) to address outstanding misdemeanors and warrants and a Civil Legal Clinic (staffed by pro bono attorneys, paralegals, and students) to help our veterans address their civil legal problems.

REGULATORS READY TO WEIGH POWER PLANT DEAL By JIM SAUNDERS THE NEWS SERVICE OF FLORIDA

With Florida Power & Light saying the deal would ultimately save money for customers and provide environmental benefits, state regulators next month will consider a proposal by the utility to pay $451 million for a coal-fired power plant in Martin County. But in documents filed last week, attorneys for consumers and major commercial electricity users questioned the deal, including raising concerns about risks for FPL ratepayers. The Florida Public Service Commission is scheduled Oct. 3 to begin a twoday hearing on the proposal, which involves FPL buying the 330-megawatt Indiantown Cogeneration facility

from Calypso Energy Holdings, LLC. The deal is rooted in a long-term contract, known as a power purchase agreement, that FPL has to buy electricity from the plant. The utility contends that parts of the agreement now require it to pay above-market prices and that buying the plant and the contract could provide $129 million in long-term savings for customers. Also, it argues in documents filed with the Public Service Commission that the purchase would provide environmental benefits because FPL would reduce the amount of electricity generated at the coal-fired plant. “Through its ownership of the facility, FPL will have sole discretion to make operational and environmental

decisions, including early retirement or repurposing of the facility,” Robert Barrett, vice president of finance for FPL, said in written testimony submitted in June to the Public Service Commission. “For instance, although this coal unit has no real economic value to the FPL system as demonstrated by its very low capacity factor, the site is suitable for future gas or solar generation given the transmission infrastructure and proximity to a natural gas pipeline. By acquiring the PPA (power purchase agreement) and acquiring the asset, FPL will be able to control all economic and environmental decisions regarding the facility.” But the state Office of Public Counsel, which represents consumers on utility issues, and the Florida In-

BATTLE LINES SET AMID TIGHTER BUDGET FORECAST By BRANDON LARRABEE THE NEWS SERVICE OF FLORIDA With a budget shortfall looming in future years, lawmakers began setting the stage Monday for a fight over state spending during the 2017 legislative session. The Joint Legislative Budget Commission, a panel of House and Senate members charged with supervising spending while the Legislature is out of session, approved a long-range financial outlook for the state Monday. In the coming budget year, which begins July 1, the outlook projects a surplus of just $7.5 million—a tiny sliver of the state spending plan, which is now roughly $82 billion. The following year, a budget gap of $1.3 billion could open up, followed by $1.8 billion the year after that. Republicans, who have run the state budget process for two decades, quickly zeroed in on a culprit: The state is being wasteful with the money that it has. “It is 100 percent because of spending. Nothing else,” said incoming House Speaker Richard Corcoran, a Land O’ Lakes Republican who has been budget chief for two years. Corcoran dismissed suggestions that the $784.9 million in tax cuts and tax holidays that lawmakers have approved over the last three years helped to create the situation the Legislature now faces. Instead, he suggested that reducing state government’s current spending will be the focus. He specifically highlighted spending on incentives for businesses—something that

the House has opposed—and said that in the coming session, the Legislature would likely discuss doing away with Enterprise Florida, the state’s public-private economic development agency. “I think that we’ve got to move away from spending money on the 1 percent and start spending money on essential services for the people that need it most,” Corcoran said. “Spending money in economic development is a bad idea.” At the same time, there are already proposals that would pour more money into some areas of the state budget. Incoming Senate President Joe Negron, R-Stuart, has pushed an additional $1 billion for higher education, as well as a plan to use bonds and federal money to boost Everglades restoration. Corcoran said those ideas were not off the table but would have to be offset with cuts elsewhere. Democrats, meanwhile, suggested that tax cuts were to blame. Rep. Janet Cruz, who is set to lead the House Democrats next year, issued a statement calling for lawmakers to take a look at those tax cuts before slicing spending. “Actions have consequences,” Cruz, D-Tampa, said. “The last two years in particular, and for many years before, the majority has made decisions that are costing us now and into the future. Tax breaks that for the most part benefit big business interests mean we won’t have the flexibility to put the people of Florida first.” The dueling positions suggested a possible return to the budget fights the played out in the Capitol after the

financial downturn in 2008. Republicans leaned heavily on spending cuts while Democrats called for measures that would increase revenue. The GOP at the time agreed to increase tobacco taxes and motor-vehicle registration fees, which have since been rolled back, but avoided broad-based tax increases. There are conclusions in the new long-range financial outlook that could change the potential shortfalls, in some cases dramatically. For example, the outlook assumes some increases in spending on areas like education and health care, projecting those areas to be handled the same as they have been in recent budget years. The report includes a threeyear average of tax cuts and projects similar decisions in the coming session. It accounts for lawmakers setting aside $1 billion each year to deal with unexpected changes in the economy or additional needs that could crop up. No major changes are expected to that policy because lowering the state’s reserves substantially could make it more expensive to issue bonds to pay for construction needs. Senate Appropriations Chairman Tom Lee, R-Brandon, noted that state economists will produce two more forecasts of revenues before the Legislature sits down to write the budget next spring. He also said other events, including potential approval of a new gambling agreement with the Seminole Tribe of Florida, could ease the shortfall. “You could have a gaming compact. You could have some good things that happen,” Lee said.

dustrial Power Users Group, which represents major commercial customers, filed documents Friday that raised objections to the proposed deal. The Office of Public Counsel said it acknowledges “that the proposal before the commission appears to provide material incremental benefit to customers above and beyond the level of total payments that would have been made” under the existing agreement. But attorneys for the office questioned whether the proposal was the best deal possible. “(The Office of Public Counsel) does not believe that FPL has met its burden to prove that the method used to eliminate the PPA is the most cost effective one available, that the proposed buyout price is the lowest

possible buyout price, and that this transaction is in the best interest of FPL’s customers, and thus is prudent,” the document said. Similarly, attorneys for the Florida Industrial Power Users Group pointed to concerns about risks for ratepayers. “Coal-fired generating plants are currently facing many challenges, including market, environmental, regulatory and economic pressures,” the business group said in a pre-hearing document. “The risks associated with these challenges should not be shifted to FPL’s ratepayers, and if done so, FPL should ensure that ratepayers risk is limited in a meaningful and measurable way.” The proposal is similar to a deal that the Public Service Commission approved

in 2015 for FPL to buy the coal-fired Cedar Bay power plant in Jacksonville. FPL cited that decision in its effort to win commission approval of the Indiantown deal. “Like the Cedar Bay transaction, the (Indiantown Cogeneration) transaction involves the acquisition of a coal generating facility in order to alleviate an unfavorable power purchase obligation,” the utility said. “Moreover, the commission found in the Cedar Bay order that the agreed-upon accounting and recovery treatment created customer savings, and stated that the transaction served to ‘mitigate the impact on customers of the Cedar Bay power purchase obligation, and (was) reasonable, cost-effective, and prudent.”

ENTERPRISE FLORIDA TOP JOB DRAWS A CROWD By JIM TURNER THE NEWS SERVICE OF FLORIDA With dozens of candidates seeking the job, finalists to run Florida’s business-recruitment agency could be named later this week. Enterprise Florida, which remains on pace to select its next president by Sept. 28, received 101 applications for the position. A search committee expects to create a shortlist on Friday. “Our goal that day will be to narrow and confirm a shorter list, maybe it’s three, maybe it’s something different than three, but it will be something shorter than what we’re working on now,” said committee Chairman Stan Connally, the president and CEO of Pensacola-based Gulf Power. The finalists will be asked to interview individually and as a group with the committee, Connally said during a telephone conference call Monday. The goal is for the committee then to forward one candidate to the full Enterprise Florida Board of Directors, which will make a final decision. The position is expected to pay between $175,000 and $200,000 a year.

The committee is seeking to come up with a replacement for former President Bill Johnson, who was appointed by Gov. Rick Scott in 2015 but stepped down this year after legislators declined to go along with Scott’s request to provide $250 million to Enterprise Florida for corporate recruitment. Johnson’s departure came as Scott ordered a review of the public-private agency that resulted in slashing staff and operations by onethird. Scott, who is on the Enterprise Florida board, told reporters outside the Capitol on Monday he intends to work with the committee but doesn’t have favorite from among the applicants. “We’ve got to keep focusing on how we continue to recruit companies, how we continue to make this a state in which every business wants to grow,” Scott said. Among the applicants are: Joe Hice, Enterprise Florida’s chief marketing officer; Richard Biter, a retired Florida Department of Transportation assistant secretary; and Susan Pareigis, former president & CEO of the Florida Council

of 100, a group of business executives that has long advised governors. Other applicants include: Adam Brecht, an executive assistant to former U.S. Sen. Alfonse D’Amato of New York; Greg Pilkington, who is responsible for budgetary functions at the World Customs Organization in Brussels; Keith Brown, former head of real estate for the Jacksonville Transportation Authority; Michael Finney, who until Oct. 2015 was senior economic growth adviser to Michigan Gov. Rick Snyder; and Steven Petty, former chief economist for Florida TaxWatch. Enterprise Florida Vice Chairman Alan Becker said during the committee meeting that creating a short list shouldn’t be difficult if the panel looks for candidates who have knowledge of economic development, experience working with a legislature or government, and organizational leadership experience. “There are plenty of them that have one of those, a lot have two, and very few that have all three,” Becker said. “My guess is we’ll be able to narrow it down,” Becker said.

PERRY EXIT ALLOWS SCOTT TO PLACE IMPRINT ON HIGH COURT By DARA KAM THE NEWS SERVICE OF FLORIDA Gov. Rick Scott will make his first appointment to the Florida Supreme Court after Justice James E.C. Perry announced Monday he will retire in December. Perry, 72, is forced to leave the court because the state Constitution requires justices to retire when they turn 70 years old. The law also allows justices like Perry to fulfill the remainder of their terms, depending on when their birthdays fall. Perry, a Columbia Law School graduate, was appointed by former Gov. Charlie Crist to the state's high court in 2009. Nine years earlier, then-Gov. Jeb Bush tapped Perry to serve as a trial judge in the 18th Judicial Circuit. "After over 16 years of proudly serving the citizens of the state of Florida, first as a circuit judge and currently as a justice of the Florida Supreme Court, I am constitutionally mandated to retire at the end of my current term," Perry wrote in a letter announcing his Dec. 30 retirement. The letter was delivered Friday to Scott and released to the public Monday. Perry is among five jurists who make up a liberal-leaning majority of the seven-member court, which has drawn the wrath of the Republican governor and the GOP-dominated Legislature. Other members of that bloc are Chief Justice Jorge Labarga and justices Barbara Pariente, R. Fred Lewis and Peggy Quince. Scott's anticipated appointment of a third conservative to the bench, joining justices Charles Canady and Ricky Polston, "may very well change the way the court has been ruling on cases," former Justice Gerald Kogan said in a telephone interview Monday. While judges are on the whole open-minded and fair, they can sometimes render "surprise" votes on certain hot-button issues, Kogan said. "When any judge comes to a court, that judge does not get rid of all of their lifetime experiences and their philosophies. Even if they are honest and above board, it's going to impact the way in which they will render a decision, depending on the particular case that comes before the court," he said. "I've seen people vote on the court in a certain way which would be completely out of context for what they usually do. But that's because they have a certain philosophy in a certain area." Scott, who regularly appoints judges to lower courts, told reporters Monday that he takes the role seriously. "Think about it, every individual, every business wants to make sure when they go through the court system, it's going to be a fair system. It shouldn't matter what judge you get," Scott said. "What I try to do is find people that will uphold the law. And so it's a responsibility I have and I take very seriously." Scott said he is looking for two characteristics in a candidate. "If you talk to any judges that I've appointed, that I've interviewed, I generally care about two things. Are they going to be humble in the process, and are they going to uphold the law. That's what I care about. I want people that want to uphold our existing laws," he said. "I get to sign or veto bills. I don't pass laws. I expect our court system

to uphold the laws of our state." Scott will pick Perry's successor from a list of nominees provided by a nine-member Judicial Nominating Commission. The panel includes Jesse Panuccio, who formerly served as the governor's general counsel and as Scott's executive director of the Department of Economic Opportunity; Daniel Nordby, a lawyer who worked for the Florida House of Representatives and the Florida Department of State, and is also a former general counsel of the Republican Party of Florida; and Fred Karlinsky, an influential insurance lobbyist. The nominating commission is expected to submit between three and six names to Scott in November, though the list could come as early as October, said Jason Unger, chairman of the panel. Perry's replacement will have to be a resident of the area covered by the 5th District Court of Appeal, which stretches across the state from Brevard to Citrus counties and includes counties such as Orange, Volusia, Marion and St. Johns. Applicants must also have been a member of The Florida Bar for at least the past 10 years, as required by the state Constitution. "We generally look for the six most qualified applicants," said Unger, who was appointed to the commission in 2008. "I don't think we can hypothesize on how applicants can judge, necessarily." Sandy D'Alemberte, a former president of the American Bar Association and Florida State University, said he is worried that changes instituted under Bush "have pushed the judicial nominating commission process much closer to being patronage committees." "The integrity of the people on the nominating commissions is at stake as well. I don't think they can wind up, for a Supreme Court appointment, nominating somebody who's a political hack. I just don't think they'll do it," D'Alemberte said. "They may nominate somebody conservative, but I hope they won't nominate somebody who's so archly political that has only credentials as a party operative." Born in North Carolina, Perry— who said he decided to become a lawyer the night civil-rights icon Martin Luther King Jr. was assassinated—became Seminole County's first black judge after being appointed by Bush. After graduating from Columbia Law School, Perry returned to the South and went to work for Georgia Indigent Legal Services. "The betterment of mankind was always my objective in life," Perry told the Florida Bar Journal earlier this year. Perry "contributed immensely to the collegiality of the court and the jurisprudence of Florida," D'Alemberte said. Florida Bar President Bill Schifino called Perry "a giant of a man." "Justice Perry's a terrific man and we're going to miss him greatly. He has served the citizens of the state well," Schifino said. Perry brought "a very human touch" to the bench, former Justice Harry Lee Anstead said in a telephone interview. "That was probably the most important quality he brought to our judiciary as a trial judge and when he came to the Florida Supreme Court," Anstead said.

Thyme-Scented Roasted Vegetables and Beets

Servings: 4 Prep time: 20 minutes Cook time: 30 minutes 1 jar (16 ounces) Aunt Nellie’s Whole Pickled Beets, drained, halved 1/2 pound baby carrots 1 medium onion, cut through core into 1/2-inch wedges 8 ounces shallots, peeled, halved if large 1 tablespoon olive oil 1 teaspoon dried thyme leaves 1/2 teaspoon salt 1/4 teaspoon freshly ground black pepper 1 clove garlic, minced Heat oven to 400 F. Line 15-by-10-inch jelly roll pan with aluminum foil. Add beets, carrots, onion and shallots. Drizzle with oil; sprinkle with thyme, salt and pepper; toss to coat. Roast, uncovered, 15 minutes. Add garlic to vegetables; toss well. Return to oven and continue roasting 15 minutes, or until vegetables are tender and lightly browned. Note: 1 tablespoon chopped fresh thyme may be substituted for dried thyme leaves.

Spicy Carrot-Sweet Potato Casserole

Servings: 6 Prep time: 10 minutes Cook time: 30 minutes 1 jar (15.5 ounces) Aunt Nellie’s Glazed Small Sliced Carrots 1/4 cup orange juice 1 teaspoon ground cinnamon 1/2 teaspoon ground ginger 1/2 teaspoon grated orange peel 1 cup cooked sweet potato pieces (about 2 inches each) 1/4 cup coarsely chopped pecans Heat oven to 350 F. In large bowl, gently stir together carrots with jarred liquid, orange juice, cinna­mon, ginger and orange peel. Spray 1 1/2- to 2-quart baking dish with nonstick cooking spray. Arrange sweet potatoes in dish. Pour carrot mixture over potatoes. Sprinkle with pecans. Bake 30 minutes, or until bub­bling and heated through. Allow to stand 5-10 minutes before serving. Beet, Feta and Walnut Scones Servings: 8 Prep time: 25 minutes Cook time: 20 minutes 1 jar (16 ounces) Aunt Nellie’s Sliced Pickled Beets 2 cups all-purpose flour 1 tablespoon baking powder 1/2 teaspoon salt 1/2 teaspoon ground black pepper 1/2 cup milk (2 percent or skim) 1/3 cup olive oil 1 egg, beaten 1/4 cup thinly sliced green onion 1 tablespoon chopped fresh rosemary 1 small clove garlic, minced 2/3 cup crumbled feta cheese (not fat-free) 1/2 cup coarsely chopped toasted walnuts 8 rosemary sprigs

Heat oven to 400 F. Drain beets well. Chop coarsely; set aside on paper towels. In large bowl, whisk together flour, baking powder, salt and pepper. In small bowl, whisk together milk, oil and egg. Stir in onion, rose­ mary and garlic. Add milk mixture to flour mixture. Stir to combine. Gently stir in feta and walnuts, just until com­ bined, then add beets and stir gently to combine. Turn out onto lightly floured surface. Knead dough three to four times to smooth. Pat into 9-inch round on ungreased baking sheet. Cut into 8 triangles; do not separate. Lightly press rosemary sprigs into each scone. Bake 20 minutes, or until light golden-brown. Cool on baking sheet; set on wire rack. Serve warm or at room temperature.
