Winterfestivities Written by Taylor Purvee
I
f you listen closely, you might be able to hear Santa’s sleigh bells ringing on Palafox Street. As Florida wraps up the fall season and prepares for a not-so-brutal winter, Winterfest is coming just around the corner. Named the number one holiday attraction in all of Florida by Florida Travel + Life, this is an event the entire family will take delight in. Every year the performers and contributors at Winterfest work extremely hard to create a unique and exciting experience for children, out-of-town visitors, and locals alike. This Christmas wonderland features musical performance tours of classic favorite movies such as The Polar Express, The Grinch and The Peanuts; the Letters to Santa event; the Elf Parade and more. Denise Daughtry, volunteer and president of the Board of Directors of Winterfest, is passionate about the event, and strives to make it different from other Christmas activities in the area. “There is no other place like Winterfest, no place does what we do and that is part of what makes it so wonderful,” Daughtry said. Winterfest is truly unique, especially to this part of the country. With very little cold weather and no snow, sometimes it can be hard to get into the Christmas spirit; however, Daughtry said Winterfest is sure to change that. “We have a story to tell and I think that is what brings the community together so well. Winterfest is about believing in the spirit of Christmas,” Daughtry said. “Christmas tree lights are great, but what we do is different and unique. There are a lot of elements you wouldn’t find other places. I mean, it is snowing at Winterfest all the time and that doesn’t happen in Florida.” There will be events galore at Winterfest to check out including one of the most popular Winterfest activities—the performance tours. Daughtry explained that through small plays and musical dramas, Winterfest tells the story of the journey to Christmas. Each stop of the performance tour has a redemption story and is all about believing in the spirit of Christmas. “The people in these plays are professional actors with degrees from University of West Florida who have done a lot of performing in the community. They put their all into performing. Everyone will recognize them and I think people really like that.” There will also be two interactive mini tours for children that will take place the week before Christmas. One of the mini tours will be The Polar Express themed; Daughtry said the children will listen to the story of Polar Express, drink some delicious hot chocolate, ride in the train and do some singing before making their way back to the courthouse. On this mini tour, there will also be a competition of who is wearing the best paja-
mas. The second mini tour will be Grinch themed and this tour will be going through ‘Whoville’ to look at the Grinch Christmas tree and a competition will be held for the child who is dressed as the best Whoville character. Another exciting event happening at Winterfest is Letters to Santa. Children will have the opportunity to drop off their Christmas letters when they meet Santa in his sleigh. He will pick his favorite letter and that lucky child will receive the first present of Christmas on Christmas Eve at 8 pm. Children can meet Santa for free and he will be at Winterfest every night of the performance tours, every weekend between Thanksgiving and Christmas, and every afternoon Dec. 15–24. “This is the best Santa Clause within 100 miles or further. He loves his job and this is a beautiful setting,” Daughtry said.With musical elements on every stop of the tour, visitors can be sure that this event will put them in the Christmas spirit. There will also be some new elements coming to Winterfest in 2017 including Santa’s Puppy Party that will showcase puppies from the Escambia County Animal Shelter. These cuties will be up for adoption and free to play with, as puppies are what a lot of children ask for at Christmas. There will also be Christmas story time for children at Winter Wonderland, Charlie Brown’s Christmas tree lot, and Rudolph’s Revue with dancing Christmas trees. Liberty Church sponsors an event called Cajun Night Before Christmas, which is inspired by the children’s book Cajun Night Before Christmas and will be a stop on the performance tour where Papa Noel will hop on the trolley and read a poem. The nativity scene on Gregory Street will be hosted by First Presbyterian Church. Daughtry noted Winterfest would not be what it is without its employees, actors, volunteers and these churches that help make it so great. Visitors should reserve seats and buy tickets ahead of time because the events sell out quickly. Experience the Wonderland of Lights in Pensacola
The Pensacola Interstate Fairgrounds are getting a dazzling makeover this holiday season as host of the Wonderland of Lights – a drive-thru display of thousands of twinkling, animated holiday lights. Open from Nov. 23 – Dec. 30, visitors can cruise through the nearly mile-long show in the comfort of their vehicles. Afterwards, visitors can explore Santa’s Village, an indoor winter wonderland. There you’ll find a holiday market with a variety of activities and treats available for purchase, such as pony rides, camel rides, photos with Santa and plenty of holiday treats and sweets. At the center of it all is an impressive 65-foot carousel. Pensacola Camellia Club Presents 79th Camellia Show Saturday December 9 The Pensacola Camellia Club is preparing for its 79th annual Camellia Show and Plant Sale on Saturday December 9 at First United Methodist Wright Place, 80 E. Wright St. in downtown Pensacola. It is expected that there will be approximately 1,500 blooms on display. The show is adjudicated by the American Camellia Society. Camellia enthusiasts from several surrounding states as well as local camellia growers will exhibit and compete for prizes. Free public viewing, after judging has been completed and prizes awarded, will be from 1 p.m. to 4:00 p.m. Camellia sales will be from 9 a.m. until 4:00 p.m. or until all plants are sold. These desirable camellia plants have been selected from camellia nurseries in the Southeast and also propagated by local Camellia Club members. Cost is reasonable at $25-$30 each. In preparation for the Camellia Show, Camellia Club members will hear past president Christi Hankins give a program on Historical Events from Past Camellia Shows at the regular club meeting on Tuesday, November 21, 6:30 p.m. at the Garden Center, 1850 N. 9th Avenue. Also, Skip Vogelsang, Camellia Show Chair, will instruct the attendees on helping with the camellia show. Members are reminded to bring either toys or cash for “Toys for Tots” program. Toys will be displayed at the December Camellia show in lieu of prizes for winning blooms. Then after the show, U. S. Marines will distribute the toys to needy children. The interested public is cordially invited to this free event. In addition, PCC members will meet
again at 7:00 p.m. at the Garden Center on Tuesday December 5 for last minute instructions for the upcoming Camellia Show on Saturday December 9. The Camellia Club has a free advisory service for those with camellia questions. During the blooming season, those with unidentified blooms are asked to bring blooms for our experts to answer your questions about camellia care. For problems which can’t be resolved by bringing in specimens of blooms or diseased camellia branches, club members can make free “house calls” within the Pensacola area. Approximately 100 Pensacola camellia varieties have been registered with the American Camellia Society. There are over 100 camellia plants in the garden including many Pensacola Varieties. Since the local camellia blooming season is normally October through March, this is a great time to view the UWF Camellia Garden. There is signage on the campus or one can stop at the University Police Station and ask for directions. The Camellia Garden can be reached by driving to the very end of Campus Drive, park in lot “V” and the garden is a short walk up the hill. Blue Morning Gallery Temporarily Relocated
Due to ongoing construction on the current gallery location, Blue Morning Gallery has moved temporarily to 41 Palafox Place, the old Dollarhide’s Music Center location. The gallery offers regular hours in the new location. Details regarding the construction and return to 21 Palafox Place will be forthcoming. The current Spotlight on Art Show is an all member Holiday collaborative exhibit featuring art priced at $100 or less. Blue Morning Gallery has new Sunday hours. The gallery will now be open 11-6 every Sunday. New gallery hours beginning after Thanksgiving Day will include Monday through Saturday 10-8:30.

City of Pensacola and Escambia County Housing Finance Authority Partner for Urban Infill Initiatives
The City of Pensacola and the Escambia County Housing Finance Authority are pleased to announce that they will partner to further urban infill initiatives in the City of Pensacola. This month the City and the Authority entered into an interlocal agreement that will provide the framework for joint participation in the Authority’s Urban Infill Revolving Loan Program. The interlocal agreement will further the goal of redeveloping vacant or blighted properties owned by the City into affordably priced new homes, with a primary focus on First Time Homebuyers who wish to work, retire, or otherwise reside in or near downtown Pensacola. The City plans to provide property suitable for redevelopment,
support staff, and technical expertise, and the Authority will offer zero percent interest construction financing and Program oversight. The Authority has completed or has underway twenty-two homes through its successful Urban Infill Program and is pleased to partner with the City in this exciting endeavor. Both the City and the Authority work every day to alleviate the shortage of affordable homes and to make Pensacola’s vibrant urban core all that it can be. UWF announces suspension of Tau Kappa Epsilon fraternity and temporary suspension of Zeta Phi Beta Sorority, Inc.
On November 17, University of West Florida President Martha Saunders announced measures taken with two Fraternity & Sorority Life organizations. The Tau-Psi chapter of Tau Kappa Epsilon fraternity has been suspended for a minimum five-year period following the conclusion of an investigation into hazing as well as risk-management and alcohol-related misconduct. The activities occurred at an unregistered, off-campus bid day party hosted by the organization and included hazing, underage drinking, risk management violations, drinking games, common source container and coerced consumption of alcohol. Additionally, the Nu Eta chapter of Zeta Phi Beta Sorority, Inc. has been temporarily suspended, pending the results of an investigation into allegations of hazing and risk-management violations. This is an active investigation. Both of these measures were taken yesterday, Nov. 16, 2017, and are effective immediately. “The University takes this type of
behavior very seriously,” Saunders said. “It is unacceptable and is not reflective of the overall culture of fraternity and sorority life on our campus.” UWF provides a variety of resources and trainings to equip members of sororities and fraternities to safely engage in their organizations. The University will continue to work with students, advisors and other stakeholders to identify opportunities to further support students in these areas. There will be meetings and events to discuss these in the coming weeks. “Although we remain committed to the growth and success of the fraternity and sorority community at UWF, we must hold all our student organizations to the standards set forth by the University in the interest of our students’ safety and success,” Saunders said. “I expect our fraternity and sorority chapter members to take all appropriate measures to ensure that chapter activities adhere to University standards and regulations.” For additional information on Fraternity & Sorority Life, visit uwf.edu/fsl.

Youth Basketball Registrations Are Underway The City of Milton is currently accepting signups for basketball covering seven different age groups for boys and girls in grades kindergarten through eighth grade. Also the Guy Thompson Community Center is partnering with the basketball coaches at Milton High School to conduct a FREE basketball clinic for boys and girls in grades third through eighth grade. The six different divisions are as follows: • Kindergarten (coed) • First and second grades (coed) • Boys grades 3 – 4 • Boys grades 5 – 6 • Boys grades 7 – 8 • Girls grades 3 – 5 • Girls grades 6 – 8 Registration can be done at the Guy Thompson Community Center every Monday through Friday from 8 a.m. to 8 p.m. and will continue through Dec. 7 or when an age group reaches its maximum capacity of players. The registration fee is $90 per child. Players will be selected to their respective teams by a draft process that will follow a brief skills workout. The boy’s clinic will be held on Nov. 27th and Nov. 30th with grades third through fifth held from 6-7 p.m., while
the sixth through eighth grade boys will be held from 7-8 p.m. The girl’s clinic will be held on Dec. 2nd and Dec. 6th. On Dec. 2nd the third through fifth grade skills clinic will be from 1-2 p.m., while the sixth through eighth grade will be from 2-3 p.m. On Dec. 6th grades three to fifth grade will be from 6-7 p.m. and grades sixth through eighth will be from 7-8 p.m. “We are excited about the upcoming season,” said Robert Arnold, the Recreation and Activities Coordinator with the City of Milton Parks and Recreation Department. “We have a great program developing with the City of Milton and are looking to build on what was started last year. “This year will be the fourth consecutive year where we have featured two different all girl leagues and we are looking forward to building on this success.” All games will be played at the Guy Thompson Community Center. The Choral Society of Pensacola Continues An Annual Tradition With Handel’s “Messiah” Start your holiday season with Choral Society of Pensacola’s annual performance of Handel’s Messiah. The concert is set for Saturday, December 2 at 7:30 p.m.in Pensacola’s beautiful and historic Saenger Theatre (118 S. Palafox Pl.) First performed in 1741, this meditation on the birth, passion, death and resurrection of Christ has earned a place as one of the best-known and most beloved works in the classical repertoire. It has played an important role in the history of the Choral Society, which grew out a performance of selections at a meeting of the Music Study Club of Pensacola in 1935 and which has presented the work, at least in part, every year since.
Audiences never fail to respond to the wide range of emotions expressed in the work’s varied solos and choral sections, including the familiar and inspiring “Hallelujah” Chorus. This year, four of Pensacola Opera’s Artists in Residence will serve as soloists: Soprano Evelyn Saavedra, mezzosoprano Camille Sherman, tenor Eric Dean Wassenaar, and bass Brent Hetherington. They’ll perform with a sixtyvoice community choir and an orchestra comprising some of the area’s finest musicians, all under the direction of Xiaolun Chen. County, Community Dedicate Wilbur Barry Highway The Escambia County Board of County Commissioners and the community commemorated the renaming of a portion of U.S. Highway 29/ Pensacola Boulevard as Wilbur Barry Highway at a dedication on Monday, Nov. 13 at Smokey’s Real Pit Bar-B-Que. State Rep. Clay Ingram spoke at the event, where the highway sign was unveiled to the public by Wilbur Barry’s family. Ingram attested to Wilbur Barry’s legacy and positive impact on his life personally, which inspired Ingram to request naming the section of state road after him. “Mr. Barry and the Barry family have meant so much to me, personally...they have done more for me than I’ll ever be able to do for
them,” Ingram said. “And they learned that from their dad, Mr. Barry.” District 5 Commissioner Steven Barry also spoke at the dedication, expressing his appreciation to Rep. Ingram on behalf of his family. The section of Pensacola Boulevard between W Street and Marcus Pointe Boulevard/Stumpfield Road was named Wilbur Barry Highway as an enduring tribute to Lloyd Wilbur Barry, Jr.’s service to the community. Wilbur Barry passed away on April 19, 2016. He was a devoted husband and father, a University of Florida graduate and also served as a member of the Army National Guard. Barry made Pensacola his home in 1978 and soon opened Smokey’s Real Pit Bar-B-Que, where he cultivated a second family.

JUDGE BLASTS STATE PRISONS OVER HEPATITIS CARE

In a scathing ruling issued Friday, a federal judge found that Florida corrections officials have a “long and sordid history” of failing to treat inmates infected with the Hepatitis C virus and ordered the state to immediately come up with a plan to properly provide care. U.S. District Judge Mark Walker found that the Department of Corrections and its health care contractors had for years refused to treat infected inmates with antiviral medications, known as “direct acting antiviral” drugs, because of the cost. Between 7,000 and 20,000 of the state’s 98,000 prisoners are believed to be infected with Hepatitis C, but only 13 have been treated with the antiviral drugs since 2013, and three of those who received the treatment were plaintiffs in the lawsuit, according to court documents. The treatment, which originally cost up to $75,000 when first released in 2013, now costs about $37,000 for a 12-week regimen and cures the virus 95 percent of the time. But in a harshly worded 32-page order, Walker wrote that cost is no excuse for not providing the treatment, scolding the agency for being “deliberately indifferent” to the medical needs of inmates, a violation of their constitutional rights. “Preventable deaths from HCV (Hepatitis C virus) are occurring within the prison system,” he wrote. Walker ordered the department to update its Hepatitis C treatment policy and to formulate a plan to implement the policy by screening, evaluating, and
treating inmates in line with directions and timelines set out by its expert witness. And he told the corrections agency to come up with the plan “with alacrity,” writing in the order that “this court will not tolerate further foot dragging.” Michelle Glady, a Department of Corrections spokeswoman, said in an email that the agency has asked the Legislature for $19 million “to expand the treatment for inmates with Hepatitis C” and that it contracts with the firm Centurion “to provide comprehensive health services to all inmates in Florida.” “FDC (the Florida Department of Corrections) is absolutely committed to ensuring all inmates in our custody are provided medically necessary treatment that is in line with national standards and our constitutional responsibilities,” Glady said in the email. Hepatitis C is usually contracted through intravenous drug use but can also be transmitted through tattooing or blood transfusions. The disease causes liver scarring, which can significantly impair liver function and ultimately lead to death.

But even the most-recent revision – finalized a week before a five-day hearing in the case last month – is inadequate, Walker found. “FDC needs to clear up the loosey-goosey language in its treatment policy so that it can no longer hide behind the consequences of its own obfuscations,” Walker wrote in a footnote. The department’s latest policy doesn’t guarantee that inmates will be screened or receive treatment quickly enough, Walker found, based on testimony from the corrections department’s own expert. The judge gave the department until Dec. 1 to come up with a new plan and ordered the agency to “increase its capacity and outline a timetable for doing so” because agency officials have maintained they do not have enough staff to start screening all inmates who could be at the highest risk of having advanced liver disease due to Hepatitis C. “This court has no doubt that without a courtordered injunction, FDC is unlikely to treat inmates in

Florida Democratic Party Chairman Stephen Bittel abruptly resigned Friday, just hours after a news report accused him of creating an uncomfortable work environment by leering at women and making suggestive remarks. The hurried exit of Bittel, a veteran fundraiser chosen to head the state party in January after a fractious leadership contest, comes as Democrats were reveling over two recent hard-fought victories and gearing up for critical elections --- including an open governor’s race --- next year. In the Politico Florida report, six unidentified women said Bittel never physically touched or threatened them. But they alleged he made aides and consultants feel so ill at ease they did not want to be alone with the party boss. “When my personal situation becomes distracting to our core mission of electing Democrats and making Florida better, it is time for me to step aside,” Bittel said in a statement released early Friday afternoon on Twitter. “I am proud of what we have built as a party and the wins we have had for Florida families, but I apologize for all who have felt uncomfortable during my tenure at the Democratic Party.” Bittel said he is working with party leaders to set a date for an election to choose his successor. For now, he will be replaced by party Vice Chair Judy Mount, a worker in the state House of Representatives Minority Office who wants the permanent post. Bittel’s boorish behavior was hardly a secret in Democratic circles. But it was impossible for him to remain the chairman after all four Democratic gubernatorial candidates Friday morning demanded that he step down. “It’s not survivable. The sooner that we can move forward in a new direction, the sooner we can begin the healing process,” Democratic consultant Steve Schale said shortly before Bittel resigned. U.S. Sen. Bill Nelson, who had supported Bittel in the leadership race, also supported his exit. “As Stephen Bittel said, he’s stepping aside for the good of the party. Sexual harassment is never accept-
able,” Nelson said in a statement issued by his campaign. County party leaders were deeply divided earlier this year before eventually settling on Bittel as chairman. He’s received praise for his efforts to organize a state party that had been harshly criticized, even among party loyalists, for being ineffective. Florida Democrats were pumped up after flipping a Miami state Senate seat in a hotly contested special election in September and for holding on to the St. Petersburg mayor’s post in a vicious race. Many viewed the victories as a promising sign that Democrats could make significant gains in races next year. But Bittel is the second party leader to quit in disgrace in less than a month. Jeff Clemens, a Lake Worth Democrat who was in line to lead Senate Democrats after next year’s elections, resigned from his Senate seat on Oct. 27 after admitting he had an extramarital affair with a lobbyist. Even after the latest scandal, Democratic insiders remained optimistic that Bittel’s departure would have a minimal impact on next year’s elections, which include a crucial battle for the governor’s mansion and the possibility of a brutal race for the U.S. Senate. Republican Gov. Rick Scott is leaving office next year due to term limits and is widely expected to challenge Nelson. “I don’t know that (Bittel’s resignation) hurts going forward,” Schale told The News Service of Florida. “You’ve got the four candidates for governor are all working and raising money. The Senate Democrats and House Democrats are organizing and raising money and recruiting candidates as they should.” State Democrats are “going to address these immediate issues and heal the wounds,” Mount said in a lengthy text message. But the battle earlier this year about who would be chairman, continued friction between progressive and moderate Democrats and the potential for another heated leadership race could leave Democrats limping. “This is obviously a setback, but we’ve got a lot of good people who care deeply about the party who I know will come together at a time like this and make sure the party keeps moving forward,” said Scott Ar-
ceneaux, a consultant who served as executive director of the state party for more than seven years and who was ousted after Bittel took over as chairman in January. Mount could face off against at least one contender for the leadership post. Alan Clendenin, who has twice lost out in leadership races, said he’s considering making another attempt. “I think there’s a lot of folks, including myself, that are talking to folks about this. That will flesh out in the next week or so. People will look at the lay of the land and see where folks’ support is,” Clendenin, chairman of the Democratic National Committee Southern Caucus, said in a telephone interview Friday. “I’ve always felt that with my background and experience that I’ve brought a skill set and a vision to change the Democratic Party of Florida to be a more effective organization.” But the election of Mount, who is black, could send a “powerful message,” Schale predicted. Mount agreed. “The focus is not on me. But it’s very important to say a black woman leading the Florida Democratic Party for the first time is perfect for this time,” Mount wrote in the text message. The party’s executive committee, which elects the chairman, will meet Dec. 9, the party announced late Friday. Mount appears poised for a fight. “Don’t be fooled. There are a lot of people in times past who have underestimated Judy Mount and the Florida Democratic Party. I’m here to tell you that’s a mistake. We’re going big and we intend to win,” she wrote. Some insiders have questioned whether Mount, a veteran party activist, will be effective as a fundraiser, with a slew of pricey races on the horizon and given Republicans’ history of outdistancing their opponents in collecting contributions. “Money is always key, but I think rather than depending on one individual it will take a village of folks coming together to make sure the party has the money it needs next year in what should be and what I believe will be a good year for Democrats,” Arceneaux said.

Hillsborough County Republican Ross Spano announced plans Thursday to run for attorney general, becoming the third member of the House and the fourth Republican seeking to replace term-limited Attorney General Pam Bondi next year. Spano, the chairman of the House Criminal Justice Subcommittee is joining a Republican field with Rep. Jay Fant of Jacksonville, Rep. Frank White of Pensacola and Ashley Moody, a former Hillsborough County circuit judge. “If I felt like the right person was in the race to be the attorney general of the state of Florida, you can trust me, I wouldn’t be
running,” Spano said. “I’m the only person among the three that are in the race right now that has these following things: the legislative experience; the conservative values; and the actual courtroom experience. I’ve been practicing law for 19 years. I’ve been in the courtroom for that time.” Spano, who was first elected to the House in 2012 and has been ruminating with his wife on the statewide contest for about eight months, also described a longheld belief in defending victims of inequality or injustice. Spano, who practices in the areas of estate planning, trusts, business law and corporate formation, appeared undeterred that he is entering a contest in which Fant, White and Moody have a head start in
amassing cash and in lining up endorsements. All three have raised more than $1 million through their campaign accounts and affiliated political committees. White’s money includes $1.5 million that he contributed to his campaign. Fant has put $750,000 of his own money into his campaign. Moody, from Spano’s backyard, has the backing of Bondi. Spano, who lives in Dover and is a father of four, said he will start to roll out endorsements in the next few weeks. As for catching up financially, he has a way to go. His House re-election account raised $13,000 in October, and he began Novem-
ber with nearly $44,000 on hand. “I’ve been through this process before, not on a statewide basis, but even in our House race we’ve had to spend a half-million dollars,” Spano said. He went through $242,000 when first elected, $234,000 in 2014 and $372,000 for his 2016 re-election. A new political committee, known as Liberty and Justice for All, also could help boost his candidacy financially. Ryan Torrens, an attorney from Hillsborough County, is the only Democrat to have opened a campaign account for the race. News reports in recent weeks also have raised the possibility that Rep. Sean Shaw, D-Tampa, could run for the Cabinet post.

Florida Agriculture Commissioner Adam Putnam and Congressman Dennis Ross on Friday criticized a lack of funding for the state’s storm-ravaged citrus industry in the latest disasterrelief package proposed by the White House. Putnam said a $44 billion request sent to Congress by the White House Office of Management and Budget “puts government reimbursement in front of real taxpayers and completely leaves out the citrus industry.” “I am confident our delegation will modify this relief package into something meaningful for Florida farmers and ranchers,” Putnam said. The state has estimated agricultural losses from Hurricane Irma at $2.5 billion. The storm made landfall Sept. 10 in Monroe and Collier counties and caused widespread damage as it moved up the state.
Ross, a Lakeland Republican, urged members of the Florida congressional delegation to oppose the new proposal without relief for citrus growers. “Floridians have been kicked to the curb in this proposed disaster supplemental, which lacks relief for Florida’s citrus growers who suffered immensely from this storm,” Ross said in a prepared statement. “The Florida delegation specifically requested this relief because there isn’t a citrus grove that wasn’t affected, with some experiencing 100 percent losses – worse than anything the industry has experienced in over 20 years.” In a post-Hurricane Irma estimate of damages on Oct. 4, the state Department of Agriculture and Consumer Services projected citrus losses at $761 million from Irma, followed by the nursery industry at almost $624 million in losses. The cattle industry damage assessment was $237.5 million, while the dairy industry was estimated to have $11.8 million in losses.
Members of the state House Select Committee on Hurricane Response and Preparedness said Thursday those damage estimates are too low. Rep. Jared Moskowitz, D-Coral Springs, estimated that the damages to just the citrus industry could exceed $1 billion. Putnam and Gov. Rick Scott have pushed to include aid for Florida farmers and ranchers in the current package after failing to secure money in two prior relief packages approved since hurricanes Harvey, Irma and Maria slammed Texas, Florida and Puerto Rico. Scott sent a letter Wednesday to Senate Majority Leader Mitch McConnell, R-Ky., and House Speaker Paul Ryan, R-Wis., that outlined a need for disaster relief for Florida as well as Puerto Rico. The letter also expressed a need for money to speed repairs to the Herbert Hoover Dike around Lake Okeechobee and for Congress to reform the National Flood Insurance Program.
Mick Mulvaney, director of the White House Office of Management and Budget, said in a letter Friday to the U.S. House that the latest package isn’t the final request as damage assessments are still underway for Puerto Rico and the Virgin Islands. “Accordingly, the administration will continue to identify, refine, and articulate additional emergency funding requirements working with the governments of Puerto Rico and USVI,” Mulvaney wrote. The funding request – to be spread across the Gulf Coast and Caribbean – includes $1 billion for agriculture. However, the largest part of the overall package, $25.2 billion, would replenish the Federal Emergency Management Agency and Small Business Administration’s disaster relief accounts. Another $12 billion would go to create a grant program for flood mitigation projects. The proposal also seeks $4.6 billion to help repair federal property damaged by the storms.
LETTERS RATCHET UP NURSING HOME REGULATORY FIGHT By CHRISTINE SEXTON THE NEWS SERVICE OF FLORIDA
Florida Gov. Rick Scott, who has consistently bemoaned unnecessary regulations on businesses, is escalating a legal and regulatory feud with the state’s long-term care industry. The latest salvo has come in the form of letters that the Scott administration is demanding be sent to residents of nursing homes and assisted living facilities, as well as to their families or legal guardians. The letters are a requirement for facilities that requested --- and received --- additional time to comply with two emergency rules requiring them to have backup power generators and enough fuel to cool buildings for four days. The initial deadline was Wednesday. Though an administrative law judge invalidated the rules last month, the state appealed the decision and maintains that they remain in effect during the appeals process. Long-term care providers disagree but aren’t ready to buck the Scott administration, which issued a news release Thursday warning that facilities will be fined if they have not come into compliance with the rules or received variances that give them the additional time. Nursing homes are troubled by the requirement of sending the letters. A particular concern is a line, in bold font, that says: “This letter is to inform you that your facility has failed to comply with this emergency rule.” Menashe Sapirman, administrator of Claridge House Nursing & Rehabilitation Center in North Miami, said he was shocked and angry that has forced to send the letters after hiring an attorney and timely submitting the variance request to the Agency for Health Care Administration. “My first thought was, `No. We didn’t fail to comply. We followed the variance process, which is a legally granted process that AHCA told us to proceed with. How are we failing to comply?” he asked. “The reality is, it’s horrific to tell a facility to send out a letter that said we failed to comply. It’s a hurtful slap in the face.” Sapirman called his attorney and a statewide nursing home association to consider his options and was advised he had none. But before mailing the letters, he said, he was struck by the idea to write a cover letter to “introduce” the AHCA-required letter. “Thank God I had the wisdom to think of this. The cover letter introduced the letter by saying we are happy to announce that we are going above and beyond and plan to install a generator that will power the entire building but that it will take longer and that a variance had been approved. Hopefully, the cover letter is so positive, it undoes whatever any
negativity that may come from the letter,” he said. Scott, who is widely expected to run for U.S. Senate next year, has long contended that Florida is “business friendly” and that the attitude has helped the state’s economy improve. But critics have contended that the business-friendly stance included a lax attitude toward regulating nursing homes. The governor took a new tough stance against the long-term care industry after residents of The Rehabilitation Center at Hollywood Hills died in the sweltering heat following Hurricane Irma. Eight residents at the Broward County nursing home died Sept. 13, three days after Irma knocked out the facility’s air conditioning. Scott issued the emergency generator rules after the deaths, but the requirements immediately came under attack from facilities that said generators could not be ordered, installed and approved by state regulators and local officials by the Nov. 15 deadline. In response to the protests, Agency for Health Care Administration Secretary Justin Senior encouraged long-term care providers to seek variances – -temporary exemptions – from the requirements. And they did. There were 605 requests for variances submitted by nursing homes across the state that said they couldn’t meet the requirements by the deadline, according to a News Service of Florida review of state documents. A review of the Agency for Health Care Administration’s website showed that on Thursday, the agency had acted on 39 of them. Assisted-living facilities also heeded Senior’s advice. Those facilities submitted 1,334 requests for variances, according to Florida Department of Elder Affairs spokeswoman Ashley Chambers. But the two agencies have not been completely in lockstep in how to deal with the facilities. The Department of Elder Affairs approved 10 assisted-living variances in early November without requiring the facilities to send out letters to residents and family members. It wasn’t until Nov. 9 that the department began including the letters as a condition of the variance approval. Even then, some of mandated letters did not include the language about failing to comply with the rules. When asked about the inconsistencies, Chambers said the department worked with the Agency for Health Care Administration and “changed the letter” so it mirrored the one that AHCA required to be sent out. AHCA spokeswoman Mallory McManus said the agency is requiring nursing homes to send out the correspondence because residents have the right to know whether the facilities are complying with “lifesaving” measures. She also downplayed the idea that the letters could frighten residents and their family
members. “Families and residents deserve transparency,” she said in an email to The News Service of Florida. The new backup-power requirements not only have existing providers concerned, they are affecting potential new providers such as 58-year-old Beverly Pyne, who planned to open a six-bed assisted living facility and hire at least three staff members. After caring for her sister who passed away from cancer and losing her father-in-law who lived in South Florida, she wanted to help others who needed her assistance. With the blessing of her engineer husband, they invested about $50,000 in their Miramar home, which has been updated and remodeled to “create a palace for them to live in.” As Floridians started evacuating the state when Hurricane Irma barreled toward the peninsula, Pyne drove from Georgia to Florida looking forward to the new life she had been planning. She arrived in Miramar on Friday, Sept. 8, and hoped to schedule a fire inspection the following Monday but Hurricane Irma changed her plans. “All hell broke loose,” she recalled. In the weeks following the storm, Pyne has reconsidered opening the assisted living facility, mostly because of the fuel requirements. She doesn’t want to store 96 hours of fuel on her property, saying it would be an “incubator for an explosion.” Another option is to have natural gas to power the generator, but she said the cost estimates to run pipes to her house have been about $19,000. Now she wonders whether she should open the facility, and her husband, who is working in Washington, D.C., is encouraging her to walk away from the plans. The notion that Scott touts himself as the “jobs governor” and encourages businesses to locate in Florida because of the business-friendly atmosphere, she said, is a joke. “Dream on,” she said. “He’s full of crap, and the talk is cheap.” But Scott and administration officials have adamantly defended the long-term care regulations as being needed to protect seniors. “During emergencies, health care facilities must be fully prepared to ensure the health, safety and wellbeing of those in their care, and there is absolutely no excuse not to protect life,” Scott said in announcing the emergency rules in September. “The inability for this nursing home (The Rehabilitation Center at Hollywood Hills) in Broward County to protect life has shined the light on the need for emergency action. Failure to comply will result in penalties, including fines up to $1,000 per day and the possible revocation of a facility’s license.”

Bear-proofing money from the state is going to seven counties, a parks department, a homeowners’ association and a community for surviving spouses of retired U.S. Air Force enlistees. The Florida Fish and Wildlife Conservation Commission announced Friday how it will spread $515,283 available this year in the “BearWise” program, which is intended to help purchase bear-resistant trash cans and strengthen existing containers. The largest award will go to Seminole County, which is receiving $189,000 to purchase bear-resistant trash cans for residents in the western portion of the county. Other counties getting money are Lake, Volusia, Highlands, Orange,
Walton and Franklin. Collier County Parks and Recreation is getting $3,675 to put bear-resistant trash cans in three county parks. Holley by the Sea Improvement Association in Santa Rosa County will get $65,000 to modify 3,700 trash cans against bears. And the Air Force Enlisted Village will receive $7,700 to strengthen dumpsters in the Shalimar community near Eglin Air Force Base and Hurlburt Field. Lawmakers approved $415,000 for the “BearWise” project this fiscal year, with an additional $100,000 coming from the Fish & Wildlife Foundation of Florida through the sale of “Conserve Wildlife” license plates. A majority of the BearWise money requires communities to have ordinances aimed at residents and businesses keeping garbage secured from bears looking for food. The
issue stems from bears going into neighborhoods in some areas of the state, creating the possibility of dangerous interactions with humans. For the second consecutive year, the money is coming after the Fish and Wildlife Conservation Commission voted against holding a controversial bear hunt. As part of a decision in April against holding a hunt, the commission wanted staff members to conclude work on 10year bear management plan, which at the time was at least two years from completion. The state held a hunt in 2015 that resulted in 304 bears being killed. With money available from permits sold for that hunt, the BearWise program awarded $825,000 in 2016 to 11 counties, three cities and two homeowners’ associations. Three Central Florida counties –
Seminole, Lake and Orange – each received $200,000 in 2016. Overall, the money was used to purchase 4,000 bear-resistant trash cans, 2,500 sets of hardware to secure regular trash cans and 40 dumpsters that were modified to keep bears out. Roughly 4,000 black bears are estimated to live in Florida, from the forests of Southwest Florida through the Panhandle. The current population is considered a success story, as the numbers had fallen to as low as 300 to 500 in the 1970s when bears were put on the state’s list of threatened species. Bears were removed from the list in 2012. But as the bear population has rebounded and more homes and businesses have been built in the animals’ native habitats, incidents of human-bear interactions have grown.
