Sailing Out of the Past

W

hen Pensacola was founded in 1559, it served as a thriving naval port as the colony of Florida was developed. Schooners, brigs and barques used to fill the harbors of Pensacola Bay, but these ‘tall ships’ appeared less and less as our technology progressed. However, the harbor will be full of cloth sails once again as Tall Ships Challenge Gulf Coast lands at Pensacola in April of 2018.

By Tanner Yea Taking place from April 1216, 2018, Tall Ships Challenge Gulf Coast 2018 is part of the Tall Ships Challenge series—a series of races and port festivals held every year to honor America’s long maritime history. Normally taking place on the Great Lakes, Atlantic and Pacific, this will be the first time the event will take place along the Gulf Coast. “We are excited to expand the Tall Ships Challenge and its adjoining festivals and events to the Gulf Coast for the very first time,” Tall Ships Challenge Manager Erin Short said. “Pensacola has a rich history and bringing the tall ships here makes sense. The fleet hasn’t been to Pensacola before, so this is a whole new festival for the city and ships to get excited about.” Tall ships generally refer to any large, traditionally-rigged sailing vessel. These include sloops, ketches, yawls, schooners, barques, brigs and brigantines. The term itself dates back to the 19th century, first written by author and mariner Joseph Conrad. Tall Ships

America, the organization behind the event, has roughly 120 different Tall Ships as registered vessels in their fleets. Pensacola has a long naval relationship, perhaps most famously with the wreckage of six of Tristan De Luna’s ships still present at the bottom of Pensacola Bay. In the 1930s, the port saw famous ships like the USS Constitution, and has received several visits from the ship Juan Sebastian de Elcano, a training ship for the Spanish Royal Navy. “There will be six to seven tall ships, which you’ll be able to take day tours of, and nighttime and VIP events will also be held on board the vessels,” said Curt Morse, executive director of the Downtown Improvement Board. The flagship of this fleet will be the Elissa, which stands over 260’ feet tall and was first launched in 1877. The ships will initially launch from Galveston, Texas, and make their way to Pensacola, New Orleans and finally St. Petersburg. Tall Ships America was originally founded in 1973

as a non-profit organization dedicated to enriching youth education through character building and leadership programs aboard their tall ships. Short said the Tall Ships events provide an opportunity for people to go on the ships, speak with their crews, and actually touch history. Visit Pensacola, the primary sponsors of the event, expect to attract 20,000 to 30,000 attendees from both Pensacola and the surrounding areas. Over the 15 years the Tall Ships Challenge series has taken place, it is estimated to have brought a combined $1.9 billion in economic impact to its host areas. “These festivals are a way to bring people downtown, showcase your waterfront to the visiting public and engage your community,” said Short. Tall Ships Challenge Gulf Coast 2018 will be held from April12–16, 2018 at the Port of Pensacola. Ticket prices have yet to be announced. Quick Actions Save Father and Daughters from Rip Current on Pensacola Beach

A rapid response from a bystander, Pensacola Beach Lifeguards, Escambia County Fire Rescue and Escambia County EMS saved the lives of a father and two daughters who were caught in a rip current Saturday morning on Pensacola Beach and pulled approximately 300 yards offshore. Eddie Galloway and his wife, Stephanie Galloway, were visiting Pensacola Beach from Fort Worth, Texas while on their way to Disney World when Eddie Galloway attempted to swim to a sandbar with two of their daughters. In the yellow flag surf, he became separated from the 11-year-old while holding on to their 6-year-old daughter, continuing to be pulled away from the shore by a rip current. A bystander recognized that the trio was in distress and instructed Stephanie Galloway to call 911 while he took his paddleboard out to provide assistance until help could arrive. Pensacola Beach Senior Lifeguard Alex Dingle responded on a surf rescue paddleboard shortly after and requested assistance, and the swimmers in distress were brought ashore by an ECFR personal watercraft. Eddie Galloway and his daughters were assessed by Escambia County EMS before being taken to Gulf Breeze Hospital for further treatment. Stephanie Galloway, who was onshore at the time with their 10-year-old daughter, said she didn’t immediately know that her husband and children were in trouble, but she realized the gravity of the situation after the fact. “It’s probably one of the scariest things I’ve ever been through,” she said. “At first it was very surreal, but after hearing each one of them talk about what had happened – my daughter told me she went under and was spinning twice – it’s really scary to hear.” Galloway said it’s difficult to express just how grateful she is to the bystander and first responders for their quick

thinking and actions. Her husband and daughters were evaluated at the hospital, but had no injuries and are doing well after the incident, she said. “I’m extremely appreciative,” she said. “There is no way that I could possibly ever repay any of those people for being there that day. I went home with a full family instead of being a widow with one child.” Escambia County Water Safety Chief Dave Greenwood praised the team effort demonstrated during the response, with Pensacola Beach Lifeguards, Escambia County Fire Rescue and Escambia County EMS working together for a positive outcome. Escambia County Emergency Communications first received the call for a water rescue behind the Holiday Inn Express on Pensacola Beach Saturday, Oct. 28 at approximately 10:28 a.m. The first lifeguard was on scene by 10:38 a.m., and the first ambulance was on scene by 10:39 a.m. “Everything just worked really well,” Greenwood said. “I couldn’t be more happy in a situation like that where you have three different teams in the same department working as one.” Greenwood said it’s important for the public to remember that if a yellow flag is flying, rough surf is still present. And with the Pensacola Beach Lifeguards shifting to winter staffing levels as of Oct. 16, he also emphasized the importance of calling 911 immediately if beachgoers see a swimmer in distress. Lifeguards maintain a presence on Pensacola Beach throughout the winter primarily via patrol vehicles, but lifeguard towers have been taken off the beach until spring. “We do have lifeguards out there, but what I want them to know is if you see someone in trouble, call 911,” Greenwood said. “That way we can get the resources to you quickly. That’s what happened in this situation.”

23rd Annual Cordova Mall Ball to Benefit The Studer Family Children’s Hospital at Sacred Heart on Jan. 27 Tickets for the 2018 Cordova Mall Ball are now available for purchase! Northwest Florida’s largest Mardi Gras ball, the 23rd Annual Cordova Mall Ball will be held Saturday, Jan. 27, 2018, from 8 p.m. to midnight at Cordova Mall in Pensacola to benefit sick and injured children at The Studer Family Children’s Hospital at Sacred Heart. The event is coordinated by the Krewe of Les Petits Enfants (Order of the Small Children) and presented by Wendy’s. Three bands are scheduled for this year’s event. A returnee to the Cordova Mall Ball, Starz is a variety showband offering Top 40, Motown and old-school funk. Also returning is The Astronauts, known for ‘80s pop/ rock and much more. Newcomer to the event is Still Standing, an Elton John tribute band. A New Orleans-style French Market with jazz music is planned as part of the Mardi-Gras style festivities. Facepainting and a fortune teller also will be located in the French Market, and novelties available for purchase will include Mardi Gras masks, Tervis tumblers and koozies. Approximately 25 restaurants will provide food, and a silent auction will be part of the fun, including a signed guitar, jewelry, art, golf packages and much more. The committee is seeking donations of items for the silent auction. Tickets and tables sell out fast every year for this popular event benefitting our community’s children. Every year, Cordova Mall closes early to allow volunteers to set up for the event, an expression of mall officials’ and shop owners’ dedication to the health of our community’s children. Last year, the Cordova Mall Ball raised a total of $458,592. These proceeds, along with proceeds from the events over the next four years, will go toward the purchase of a pediatricfriendly CT scanner. The scanner can capture an image in two seconds, eliminating the need to sedate young patients undergoing this test. During the past 22 years, the event has generated nearly $5 million on behalf of sick and injured children at The Studer Family Children’s Hospital at Sacred Heart, a hospital dedicated to the care of children for more than 47 years. For fiscal year 2016/17, the Santa Rosa County Clerk of Court and Comptroller returned unspent revenues of $559,608.78 to the Santa Rosa County Board of County Commissioners. This makes the fifth consecutive year since taking office, the Santa Rosa County Clerk of the Circuit Court and Comptroller Donald C. Spencer

has returned unspent revenues to the Santa Rosa County Board of County Commissioners totaling $1,586,428.83 over that time. Clerk Spencer says “through fiscal conservative action and quality control and efficiency, we have been able to return unspent funds to the County for the past 5 years.”

Boys and Girls Club of The Pensacola Humane Society Emerald Coast Hosts Community partners with national Awareness Breakfast organization to host fundraising Boys and Girls Clubs of the Emerald Clubs of the Emerald Coast has been workshop Coast is excited to announce its annual in the forefront of youth development, Great Future’s Breakfast will be hosted by the Honorable Buzz Ritchie with keynote speaker Ms. Sue Straughn. This free breakfast event on Thursday, November 9th at 7:30AM will be held at the Englewood Center Club located at 2751 North H Street in Pensacola. The goal of the breakfast is to bring together area leaders and share the incredible impact the club has on at risk children in the Pensacola community. Executive Director Leslie Hunter-Huff says she always looks forward to inviting the community into the Englewood Center and sharing the club’s inspiring story. “There is something special about seeing the work of Boys & Girls Clubs with your own eyes. Locally the after school program serves 115 members in grades K-12, between the ages of 5 and 18, from thirteen different schools across Escambia County at two program sites: Englewood Center and Montclair Elementary School. More than half of the program participants are male (53%) and 90% of Club Members are African-American. In an effort to decrease crime and violence in our community, Boys and Girls Clubs provides a variety of programs that foster academic success, healthy lifestyles, good character and citizenship; additionally, Monday through Friday from 2pm to 7:30pm, members have access to educational, artistic, and recreational activities whose sole aim is to produce law-abiding, intelligent, and productive citizens.

Rat Pack Reunion raises over $140k for elders The seventh annual Rat Pack Reunion fundraiser, hosted by Council on Aging of West Florida to increase awareness and support for senior programs in the area, raised approximately $146,000 this past Friday night. Almost 350 individuals attended the gala, which featured dinner, drinks, dancing, a “raise the paddle” fundraising segment and honorary videos and speeches from four community leaders. This year, those leaders were Marianne McMahon, Nels Offerdahl, John Peacock and Roger Webb. The Rat Pack Reunion has become a popular staple of the black-tie social scene in Pensacola and attracts some of the area’s most notable philanthropists, businesspeople and elected officials. Planning for the event takes place throughout the year with a dedicated committee and a fervent fundraising effort. The money raised locally from this event will be leveraged for an almost million-dollar impact across Escambia and Santa Rosa counties by helping fund programs like Meals on Wheels, The Retreat Adult Day Health Care Center, in-home services, and more. “As it is every year, the Rat Pack Reunion was fun for the rats, entertaining for the participants, but most of all, impactful and life-changing for Council on Aging clients,” said Charlie Switzer, Rat Pack committee co-chair. “The money raised at this event will directly

Humane College is partnering the Pensacola Humane Society to host a fundraising workshop in Pensacola, Florida at the Skopelo’s New World on Tuesday, November 7. The workshop, Strategic Fundraising Planning: An Animal Shelter’s Guide to Raising Money, is a designed exclusively for executive directors, board members, fundraisers and volunteers who play a role in fundraising for private nonprofit and municipal animal welfare organizations. Taught by one of the leading experts on animal shelter fundraising, the workshop teaches participants what fundraising activity does and doesn’t work then guides everyone in the development of a strategic fundraising plan specific to their own organization. Jennifer Bitner, executive director of the Pensacola Humane Society, who helped bring the workshop to the Florida panhandle remarks, “The Pensacola Humane Society is pleased to be a supporting partner of the fundraising workshop. SENATE DEMOCRATS PREPARE TO PICK NEW LEADER By DARA KAM THE NEWS SERVICE OF FLORIDA

Florida Senate Democrats will vote next week on a replacement for former Sen. Jeff Clemens, who was slated to take over as caucus leader after the 2018 elections but who resigned Friday after admitting an extramarital affair with a lobbyist. Caucus members are regrouping after Clemens’ abrupt exit but are divided about who should take over the leadership post. Sen. Audrey Gibson, a Jacksonville Democrat and one of three remaining senior members of the caucus, is amassing support but faces opposition from Sen. Randolph Bracy of Orlando and possibly others before next week’s vote. “I think this whole week we’ll have people deciding whether they will or they won’t. What I do know for sure is we will have an election next week to replace him. The other thing I know is that I am not in that field,” current Minority Leader Oscar Braynon, D-Miami Gardens, told The News Service of Florida in a telephone interview Monday. The race for the next leader, who will be instrumental in raising money for the 2018 elections, will also affect a heated contest about who will be at the helm of the caucus for the 2021 and 2022 legislative sessions. “Just technically, it opens up another slot that everyone who was running in `20-`22 was eligible for. And it gives people a chance to get their sea legs,” Braynon said. Gibson and Sens. Bobby Powell of West Palm Beach and Gary Farmer of Fort Lauderdale had lined up to seek the leadership position after Clemens’ term was scheduled to end following the 2020 elections. On Monday, Farmer said he was supporting Gibson as Clemens’ replacement, and Powell wouldn’t say whether he planned to get in the mix next week. Sen. Lauren Book of Plantation has indicated she isn’t interested in the post at this time, and sources close

to Sen. Darryl Rouson of St. Petersburg say he’s not in the running, either. The search for Clemens’ replacement comes after Senate Democrats were buoyed last month by Sen. Annette Taddeo’s high-profile victory over Republican Jose Felix Diaz in a Miami-Dade County special election. Former Sen. Frank Artiles, R-Miami, resigned from the Senate District 40 seat in April after a profanity-fueled and racially charged outburst at a private club near the Capitol. Some believe that Artiles or his supporters were involved in the revelations about Clemens’ affair with Broward County lobbyist Devon West, first reported Friday by Politico Florida. Artiles did not return a phone call seeking comment Monday. Democrats downplayed any possible rancor related to the leadership race. “We’re all very energized by the Taddeo win, so the last thing we should be doing is lining up in a circular firing squad,” Farmer told the News Service. Gibson, elected to the Senate in 2011 after eight years in the state House, Braynon and Sen. Bill Montford of Tallahassee are the longest-serving Democrats in the upper chamber. Numerous senators interviewed Monday said they believed Gibson, a woman and senior member of the caucus, would be the best fit for the job, given the controversy related to Clemens. “With the potential of a culture of harassment and mostly women being victimized by that, I think Audrey is especially qualified to be our leader at this time,” said Farmer, who’s promised to help Gibson raise money and work on campaigns next year. Gibson said she’s garnered the votes of at least “a simple majority” of the caucus, including members who had pledged their support for her in the 2020 leadership race. Sen. Perry Thurston, a Fort Lauderdale lawyer who previously served as House minority leader, called Gibson “the best candidate” who has “the background, the contacts and the Democratic

principles to lead us,” especially as Democrats hope next year to flip several seats in a chamber where Republicans hold a 24-15 majority. “I think we’re at a point where the caucus is going to make a decision on what direction we’re going to go in,” Thurston said. “I think it would be great for the state if, under Sen. Gibson’s leadership, we were able to get closer to a 20-20 split in the Senate.” Powell, D-West Palm Beach, would not say if he planned to challenge Bracy and Gibson. “My number-one goal is to make sure that the caucus is unified and moving forward. Whatever that takes, that’s what I’m going to do. I’m not going to say I’m running or I’m not running,” he said. Powell called the loss of Clemens, who was elected to the Senate in 2012, “a tremendous blow” to the caucus. Both men are from Palm Beach County, and Powell said he considers Clemens a friend. “He’s one of our longest-reigning senators. We had Jeff. We had Oscar (Braynon). Montford. And Gibson. To lose one of our four standard bearers …,” he said, trailing off. Powell said the caucus must “address what happened” and figure out how to move forward. “I think right now it’s kind of early to be jockeying for position. We lost a member. It’s a painful episode. My number-one goal is to unify the party. I don’t want to discuss leadership right now,” he said. Despite the discomfort of a disgraced former leader, Clemens’ hurried departure and division about who should step into his place, Democrats say they will emerge strengthened. “There’s no doubt that we can recover. I think the swiftness with which things happened enables us to be able to do that. If it had dragged on, if he stayed and things kept trickling out, that’s one thing,” Gibson said. “He technically wasn’t leader yet, anyway. He was leader-designate. And I know that we’re just hot off the Taddeo race, which was a collective effort.”

SUPREME COURT SIDES WITH PLAINTIFFS ON MALPRACTICE RECORDS

Warning of attempts to “whittle away” at a 2004 constitutional amendment, the Florida Supreme Court has rejected arguments by hospitals that they should be shielded from turning over records to plaintiffs in medical-malpractice cases. The latest Supreme Court ruling came last week in a Polk County case and followed a January ruling in a Duval County case. While the details of the cases were different, they both focused on a 2004 constitutional amendment, commonly known as Amendment 7, that was backed by plaintiffs’ attorneys and was designed to expand access to medical records in malpractice lawsuits. Records held by hospitals and other medical providers can play a key role in malpractice cases. The 2004 constitutional amendment was intended to provide access to what are known as “adverse medical incident” reports. In the Polk County case, the Supreme

Court overturned a decision by the 2nd District Court of Appeal that said Bartow Regional Medical Center did not have to turn over records that were produced during an external peerreview process by an outside company. Justice R. Fred Lewis, in a 32-page majority opinion Thursday, wrote that such reviews can’t be excluded from the requirements of the constitutional amendment. “Such a result would be directly contrary to the intent and express words of Florida voters to have greater access to adverse medical incident records than they did before the passage of Amendment 7,” Lewis wrote in an opinion fully joined by Chief Justice Jorge Labarga and justices Barbara Pariente and Peggy Quince. “Moreover, the result asserted by Bartow would provide a trap door through which hospitals could totally avoid their discovery obligations by outsourcing their adverse medical incident reporting to external, voluntary risk management committees separate from those required by the Florida statutory scheme.” Justice Ricky Polston agreed with

the outcome, though he did not sign on to the majority opinion. Justice Alan Lawson, in a dissent joined by Charles Canady, said the Polk County hospital should not have to turn over the external reports because they were prepared in anticipation of litigation. “Applying Amendment 7’s plain language consistently with this (Supreme) Court’s holding regarding its intent, like the Second District, I would conclude that the expert reports at issue --- prepared at the request of the hospital’s counsel, outside of the ordinary peer review process, in anticipation of imminent litigation --- are not `records made or received in the course of business’ subject to disclosure pursuant to Amendment 7,” Lawson wrote. Medical malpractice has long been a highly contentious legal and political issue in Florida. In 2004, that resulted in a ballot war between plaintiffs’ attorneys and medical groups, with voters approving three constitutional amendments. Those amendments required the disclosure of adverse medical-incident reports; prevented physicians from being licensed if they

have committed three incidents of medical malpractice; and sought to cap plaintiffs’ attorney fees. Litigation about the medical-records amendment has spent years moving through the legal system. Last week’s Supreme Court decision came in a lawsuit filed by Amber Edwards, who went to Bartow Regional Medical Center in 2011 with stomach pains and was diagnosed with gallstones. During a procedure, her common bile duct was cut, later requiring her to be transferred to Tampa General Hospital for emergency corrective surgery, according to the Supreme Court majority opinion. Edwards sued the hospital and a physician, touching off the years-long battle about providing medical records. Meanwhile, in the January ruling in the Duval County case, the Supreme Court rejected arguments that a federal patient-safety law shielded the Baptist Health System from turning over some documents in a malpractice lawsuit. The U.S. Supreme Court early this month declined to take up an appeal by the hospital system.

TRUMP CALLS FOR SPEEDING UP LAKE OKEECHOBEE DIKE WORK By JIM TURNER THE NEWS SERVICE OF FLORIDA

With the White House pointing to ties between President Donald Trump and Gov. Rick Scott, repairs to the Herbert Hoover Dike around Lake Okeechobee might be done more quickly than anticipated. Trump on Thursday directed Mick Mulvaney, the chief of the White House Office of Management and Budget, to accelerate the work. “The administration, working closely with Florida Gov. Rick Scott, will now plan to expedite work at the project,” the White House said in a news release late Thursday. Scott quickly thanked the president in a tweet. The news release didn’t outline costs or timelines for the work, which is intended to allow the lake to retain more water without causing a threat to surrounding communities. Trump previously set aside $82 million for the work

in his proposed 2018 budget. The remaining work has been projected to cost up to $930 million. The U.S. Army Corps of Engineers since 2001 has spent more than $870 million on projects designed to reduce the risk of “catastrophic failure” to the aging 143-mile earthen dam that also features levees, hurricane gates and other water-control structures, according to the Army Corps. The Legislature included $50 million in this year’s Florida budget to help speed the Army Corps repairs. State lawmakers also approved an $800 million plan spearheaded by Senate President Joe Negron, R-Stuart, to start work on a reservoir south of the lake. The Senate plan --- which depends on federal matching funds --- allows Florida to bond the money as a way to speed the reservoir’s construction. The intent is to move water south from the lake, rather than to the east and west when the lake’s water level gets too high.

The White House announcement said the dike work “is still more than a decade away from completion.” Scott has pushed to move up the completion by 2022. “This April, Gov. Rick Scott spoke with President Donald Trump regarding the importance of fixing the federally operated Herbert Hoover Dike,” the governor’s office said late Thursday. “Following their conversation, President Trump committed to fixing the dike.” The ongoing repair work started in 2007, according to the White House release. “This project is important to the state of Florida and we are honored to play a role in the funding, and now acceleration, of this essential infrastructure initiative,” Mulvaney said in the White House release.

UNCERTAINTY SURROUNDS GENERATOR RULES AMID APPEAL By CHRISTINE SEXTON THE NEWS SERVICE OF FLORIDA

Long-term care providers are receiving conflicting messages about whether they have to comply with a Tuesday deadline in a state attempt to require emergency generators, but an administrative law judge says he doesn’t have the power to help clear up questions. Administrative Law Judge Gar Chisenhall on Friday issued a 66-page final order invalidating two state emergency rules that called for nursing homes and assisted living facilities to quickly add generators to run air-conditioning systems. Gov. Rick Scott’s administration appealed the order to the 1st District Court of Appeal and said the rules remain in effect during the appeal. Industry groups Florida Argentum, which represents assisted living facilities, and LeadingAge Florida, which represents nursing homes and assisted living facilities, filed a joint motion Monday asking Chisenhall to clarify whether the emergency rules are put on hold during the appeal process. Chisenhall on Monday issued a one-page ruling saying he had no authority to make clarifications to recommended orders or final orders. “While the undersigned has the authority to correct a scrivener’s error … the Florida Administrative Code does not authorize motions seeking rehearing, reconsideration, and/or clarification,” Chisenhall wrote, denying the request for clarification. “Because the relief sought by LeadingAge Florida and Florida Argentum goes beyond the scope of a scrivener’s error, LeadingAge Florida and Florida Argentum must seek relief in a different forum.” In the motion for clarification, attorneys for the industry groups wrote that “within hours of the division’s

ruling, the Agency for Health Care Administration and Department of Elder Affairs announced that the emergency rules remained in effect, regardless of the final order, and advised that nursing homes and assisted living facilities must continue to act in compliance. The Agencies did not explain their reasoning.” Agency for Health Care Administration spokeswoman Mallory McManus confirmed the agency maintains that “the rules are in effect during the appeal process.” The motion for clarification said that for many years, appellate rules allowed agencies to get automatic stays of such orders, but the rules were changed in 2009. Scott issued the pair of emergency rules days after an evacuation of a sweltering nursing home in Broward County. The evacuation came three days after Hurricane Irma knocked out the air-conditioning system at The Rehabilitation Center at Hollywood Hills. Eight residents of the nursing home died Sept. 13, with six more dying after the evacuation. Scott’s emergency rules would require nursing homes and assisted living facilities to have generators in place by Nov.15 and enough fuel to power the facilities for 96 hours. The rules also would require the facilities to submit emergency management plans by Tuesday to local officials detailing how the facilities will meet the mandate. In a final order issued Friday, Chisenhall said the state did not prove the public was in imminent danger --- a prerequisite for an emergency rule --- and, moreover, said that the rules were an invalid exercise of legislative authority because they expanded what was allowable under law. Meanwhile, the state also is trying to move forward with the rules through the traditional rule-making process and will hold a meeting on them this week in Tallahassee.

The Florida Health Care Association, a nursinghome industry group that has not been part of the administrative case, sent out correspondence to its members shortly after the ruling on Friday, saying that despite Chisenhall’s final order, Agency for Health Care Administration Secretary Justin Senior “indicated that the rule is still in effect while being appealed.” Emmett Reed, executive director of the Florida Health Care Association, advised members that the agency “is moving ahead with permanent rulemaking; therefore providers should continue with their variance and emergency power plan submission until the stay and appeals process is exhausted.” Amid the legal battle, long-term care providers have filed requests for variances from the emergency rules. Florida law authorizes agencies to grant variances and waivers to rules that cause a substantial hardship. Nearly 400 requests have been published in the Florida Administrative Register from nursing home and assisted living facilities that claim they cannot comply with the requirements. On Monday, the Florida Health Care Association sent a letter to Senior and Jeffrey Bragg, secretary of the Department of Elder Affairs, asking for a process known as “negotiated rulemaking” to resolve the issues. “Now that the administrative law judge has determined the emergency power plan rules to be invalid, we call upon AHCA and DOEA to end the current variance process, which is costing facilities precious time and financial resources to justify why they cannot meet these unattainable rules,” said the letter, signed by Reed. “FHCA asks all parties to use the administrative law judge’s ruling to reset the discussion, exit the courtroom and come to the negotiation table to strengthen residentfocused procedures for facilities’ emergency power plans.”

DEMOCRATS CAMPAIGN FOR GOVERNOR AS FIELD COULD GROW By LLOYD DUNKELBERGER THE NEWS SERVICE OF FLORIDA The three top Democratic candidates for governor sat on a stage Saturday night in the Fiesta Ballroom at Disney’s Coronado Springs Resort and answered more than an hour’s worth of questions on issues facing Florida. There were few differences in the responses from former U.S. Rep. Gwen Graham of Tallahassee, Tallahassee Mayor Andrew Gillum and Winter Park businessman Chris King as they addressed party activists and supporters gathered at the Florida Democratic Party’s 2017 state conference. All three candidates supported the expansion of Medicaid and called for stronger environmental protections, including a response to climate change. They voiced support for public schools, a higher minimum wage and gay rights. And they repeatedly took shots at Gov. Rick Scott and President Donald Trump. But a major question went unasked and unanswered: Who will join the three contenders on the political stage before the Aug. 28 Democratic primary next year? One potential answer sat at a $10,000 dinner table in the audience. “I’m here. I’m thinking about it,” Orlando trial lawyer John Morgan said. “(Florida Democratic Party Chairman) Steve Bittel begged me to buy a table, and I finally gave in.” Morgan said he will decide about the governor’s race in the spring. On Wednesday, Miami Beach Mayor Philip Levine is expected to announce his entry into the race. “The mayor has great respect for everybody in the race right now,” said Christian Ulvert, an adviser to Levine’s political committee who attended the Democratic gathering. The possibility of the five Democrats vying for the nomination would make it the most crowded Democratic gubernatorial field since 1978, when Graham’s father, former Gov. Bob Graham, emerged from a primary and a then-required runoff election to win the nomination over a half-dozen rivals. The large field brings more uncertainty and possibilities to the race, although key factors remain demographics, geography and, perhaps most important, money. The three announced candidates have a head start and have been working to establish their identities among Democratic voters. At the party forum, Graham talked about her election to Congress in 2014 over a Republican

incumbent in a conservative-leaning North Florida district. “I sent the tea party Republican packing. I won in a red year, in a red district,” Graham said. “We’re going to have a blue wave.” Graham, a former school board attorney, is also making public education a key part of her message, accusing Republicans of turning schools over to the “education industry.” Her name may resonate with Democratic voters who remember her father, although he was last on the ballot as a U.S. Senate incumbent in 1998. At the forum, Graham invoked his name, saying the ethics of her administration would be patterned after her father who “served 40-plus years with integrity.” Graham is the only woman in the race, which could be a factor with women voters representing 58 percent of the Democratic electorate in the 2016 presidential primary. In responding to forum questions, Gillum used his experience as a Tallahassee city commissioner and mayor to talk about specific programs aimed at helping juveniles stay out of the criminal justice system, establishing solar-energy programs and attracting higher-paying jobs. Gillum, the youngest candidate in the field at 36, is the most charismatic speaker, talking about his rise over “intergenerational poverty” to earn a college degree and embark on career in public service. He picked up an endorsement at the party conference from Julian Castro, a former secretary of the U.S. Department of Housing and Urban Development and a leading national Democratic Hispanic leader. But Gillum has been dogged by an ongoing FBI investigation into the city of Tallahassee government. Although he has said he is not a target of the probe, it remains a negative factor until it is resolved. It has hurt Gillum’s fundraising, where he trails the field. Gillum is the only African-American candidate in the race, with black voters representing 27 percent of the Democratic presidential primary electorate last year. Gillum and Graham both call Tallahassee their hometown, forcing them to share a limited geographic base. King, a political novice, comes from the politically pivotal I-4 corridor, but his challenge will be raising his profile among Democratic voters. He has not been active in state or local politics, with former Orlando-area Congressman Alan Grayson saying the first time he met King was at Saturday’s forum. King talked about his outsider status as an asset. “We have had two decades of losing gubernatorial elections. I argue that we have got to do something

different,” King said. “We need a fresh voice, a fresh face, a communicator. We need somebody who can win.” King said he will bring his experience as an entrepreneur and developer of affordable-housing projects to his administration. He said Florida, which he characterized as being “at the back of pack” in major economic indicators, needs to do more to improve the economy. He promised to make state and community colleges free for Florida students, saying increasing education levels of Floridians is a key to a better economy. An area of concern for Democratic leaders is the relatively lackluster fundraising thus far by the announced candidates. Graham led the field with about $2.7 million in available cash through Sept. 30 in her campaign account and a closely tied political committee, according to the state Division of Elections, with King holding about $1.8 million. But that is dwarfed by Agriculture Commissioner Adam Putnam, the leading Republican candidate for governor, who had raised nearly $20 million in the same period for his campaign and a political committee, with about $14 million in cash on hand. Putnam’s financial advantage may be reduced by the expectation he could face three major opponents in the GOP’s Aug. 28 primary. If Levine enters the race, he will become the Democrats’ leading fundraiser. His political committee had raised $4.77 million through Sept. 30, with most of it unspent. Levine, a successful businessman before he ran for Miami Beach mayor, has a net worth in excess of $100 million, said Ulvert, raising the possibility he could self-fund a portion of the race. Levine could also have a geographic advantage as the only candidate from densely populated Southeast Florida, where a third of the 4.8 million Florida Democrats live. Money is not an issue for Morgan, who used part of his wealth to launch and pass a ballot initiative last year to broadly legalize medical marijuana. And unlike the other candidates, Morgan has already established a statewide presence through his medicalmarijuana advocacy and ubiquitous television advertising for his Morgan & Morgan law firm. Morgan is not rushing his political decision. He said his immediate priority will be attending the Breeders’ Cup races next weekend at the Del Mar Racetrack near San Diego, where he has a thoroughbred in contention.
