A Hiatus for History
With downtown demolitions on the rise, we take a look at what the Historic Structure Moratorium could mean for the future of downtown development. The demolition of the John Sunday House in July 2016 has spurred serious discussions of how to handle downtown development, especially in regards to tearing down historic properties in order to pave the way for new development. In fact, between the months of June and August alone, the City had issued a total of 16 demolition permits all for properties in Downtown Pensacola. This is where the Historic Structure Moratorium comes in, as a “press the pause button” originally proposed by City Councilman Brian Spencer, which states that neither recognized historic structures nor buildings within city limits that were built during or before 1916 will be allowed to be demolished over the next six months, while the city’s Planning Board considers new rules for historic preservation and new language defining what can classify as a “historic structure.” The City Council voted 6-2 to implement the 180day moratorium on the demolition of any structures over the age of 100 within the city limits but not within a special review district. According to section 122-10(9) of the City’s code of ordinances on tearing down historic structures: “Demolition of a contributing structure constitutes an irreplaceable loss to the quality and character of the Historic District and is strongly discouraged… Therefore, no permit shall be issued for demolition of a contributing structure unless the owner demonstrates to the (Architectural Review) board clear and convincing evidence of unreasonable hardship.” The provision applies only to the Pensacola Historic, North Hill and the Old East Hill districts. Historically, African-American neighborhoods like Tanyard or Belmont-Devilliers don’t have historic district protections, and the Governmental Center District in which the Sunday House was located isn’t subject to this section of the code. Regulations for the Governmental Cen-
ter District do still require approval by the city’s Architectural Review Board for demolitions, however. For this reason, the Planning Board is proposing that a Historic Preservationist be present during all hearings related to demolition in downtown areas.
Other proposed changes to Section 12-13-2 of the same ordinance have suggested that the Planning Board take charge of the review of demolition permits. Since the Board would like to review demolitions outside historical districts and overlays, the Planning Board has discussed and agreed that someone who is a historic preservationist should sit on the Board for demolition requests; the University of West Florida Historic Trust
would provide such a preservationist as an advisor to the board when it is scheduled to review a demolition request. Language also included that the Board could call upon any branch of the city government at any time for information and advice. However, changes to the code could take up to four months or more. While the Planning Board is still working on defining the language for what categorizes a structure as “historic” and exempt from attempts to

This brings other factors into play when deciding on whether to keep a structure for preservation over removing it in demolition, since there are certain cultural values to consider, too. There is also the question of why we need to demolish buildings in historic areas,
when in fact vacant properties exist for development in the downtown and surrounding areas. According to local real estate agent and fellow Pensacolian John David Ellis, Jr., at least a quarter of MLS listings on the market are listings of vacant lots. “The moratorium will not only give opportunity to reassess history and what we’re doing to preserve it, but I think it will help develop a lot of the vacant property that needs to be developed,” said John David Ellis, Jr., a local real estate agent. “There’s a lot on Alcaniz and Garden streets that’s been sitting vacant for roughly 50 years, and it used to be the site of the Seville Inn. Would you rather have a historic structure that generations to come will appreciate and understand, or have vacant lot?” Ellis goes on to reference how Five Sisters Blues Cafe, which was renovated by Quint Studer, might credit the successful business in part to its historic location in BelmontDevilliers neighborhood. “I think part of the success Studer had with Five Sisters was not only the great food and beautiful renovations,” said Ellis. “I think people associated building with the old record shop that used to be there. They associated it with good memories. These properties have a cultural value, which was proven to be an asset in the case of Five Sisters, and that tends to be overlooked by developers and real estate agents only concerned with property value.” The latest discussion on the demolition of historic structures took place on October 11, 2016, when the board discussed the current demolition process and lack of review and implementation of preservation standards and requirements. Although plans for demolition have been placed on hiatus, what lies in store for Downtown Pensacola’s historic structures remains unclear until the Planning Board reaches a decision--a process that can be helped along with input from Pensacola’s citizens. UWF archaeology program discovers third shipwreck from Luna fleet
The University of West Florida archaeology program announced on Oct. 21 the discovery of a third shipwreck from the Spanish fleet linked to Tristán de Luna y Arellano’s 16th century expedition to modern-day Pensacola. The discovery comes less than one year after UWF archaeologists identified the terrestrial site of Luna’s colony in a developed neighborhood in Pensacola, marking the earliest multi-year European settlement in the U.S. The third shipwreck was found in Pensacola Bay near Emanuel Point I and II, the first two shipwrecks linked to the Luna expedition. Emanuel Point I was found by archaeologists from the Florida Bureau of Archaeological Research in 1992 and was later investigated by BAR and UWF. Emanuel Point II was discovered by UWF during a summer field school in 2006. The third ship, Emanuel Point III, was discovered by UWF archaeologists and students during the Combined Archaeological Field Methods course on June 20, 2016. After identifying the land settlement in 2015, the UWF team was able to narrow the field of search for the remaining shipwrecks during the summer field school in 2016. “We chose a shallow spot with a sandy bottom to dive to give the students a break after we’d been in another part of the bay where it was deeper and darker,” said Dr. Greg Cook, assistant professor of anthropology and principal investigator of the Emanuel Point II shipwreck. “We thought there probably wasn’t anything there, but had found an anomaly when we surveyed and decided to let the students have fun investigating it. Within two minutes, the divers came up and said they felt stones with their probes. Later that afternoon, the first artifacts were found. I said that day, ‘You know, it shouldn’t be this easy’.” The UWF team has discovered ballast stones, iron concretions and articulated hull of the ship, including frames and hull planking, as well as remnants of ceramics once carried on it. They received a joint permit from the Florida Department of Environmental Protection and the U.S. Army Corps of Engineers to conduct test excavations through March 2017 to determine the extent of the shipwreck and the type of wood used to make the ship, which will indicate if it was among the earliest ships to be built in the New World. “We stand a good chance that this is a different type of ship from Emanuel Point I and Emanuel Point II,” said Dr. John Bratten, chair and associate professor of anthropology and co-principal investigator of Emanuel Point II. “Because it was found in shallower water than the others, it might be smaller, possibly what they called a barca. This dis-
covery is significant in understanding 16th century ship construction.” The UWF archaeology program’s exploration of the Luna fleet has been funded in part by a Special Category Grant totaling more than $290,000 from the Florida Division of Historical Resources. The matching grant, awarded to UWF in 2014, provided funding for faculty, staff and students from UWF to conduct fieldwork, laboratory analysis, artifact conservation and curation, archival research in Spain and public outreach in all seasons for two years. “This is an extremely exciting and timely discovery following the recent investigations at the nearby terrestrial Luna site,” said Dr. Timothy Parsons, director of the Florida Division of Historical Resources. “I’m very pleased that the Division can support this work through our Special Category Grants Program.” Maritime field investigations by UWF, including continuing survey and excavations, have mainly focused on the six ships that were lost during a hurricane that hit Pensacola Bay in September 1559. The Luna expedition included 1,500 soldiers, colonists, slaves and Aztec Indians who traveled in 11 ships from Veracruz, Mexico, to Pensacola to begin the Spanish colonization of the northern Gulf Coast. The hurricane hit Pensacola one month after they arrived, sinking many of their ships and devastating their food supplies. After two years, the remnants of the colony were rescued by Spanish ships and returned to Mexico. The Luna settlement in Pensacola lasted from 1559 to 1561, which predates the Spanish settlement in St. Augustine, Florida, by six years, and the English settlement in Jamestown, Virginia, by 48 years. “Finding the third ship is highly signifi cant because it confirms we have the whole fleet in Pensacola Bay,” added Dr. John Worth, associate professor of anthropology and principal investigator of the Luna land settlement. “The historical documents say that two ships were loaded, ready to go back to Spain. As long as we had just two shipwrecks, it could mean that the rest of the fleet was somewhere else. Now we know
we really do have the fleet, not just two ships that happened to be from the fleet.” Emanuel Point I was found in 1992, and UWF archaeologists continued investigations through 1998 under the direction of Dr. Roger Smith, Florida State Underwater Archaeologist. In 2006, UWF archaeologists and students located Emanuel Point II. UWF continued to examine the second shipwreck with its summer field schools until grant funding was received in 2014. The funding has allowed UWF archaeologists to work continuously at the site and search for additional shipwrecks for two years. The Luna land settlement was identified in October 2015 when Pensacola native Tom Garner discovered Spanish colonial and Native American artifacts at a privately owned residential lot within view of the two uncovered shipwrecks in Pensacola Bay. UWF has continued investigations at the settlement site since it discovery, including offering a land-based field school during Summer 2016. Together, the shipwrecks and land settlement provide a unique insight into the earliest multiyear European colonial settlement to be archaeologically identified in the United States. “They found the third ship closer to land while we were working on a lower part of the settlement site,” said Dr. Elizabeth Benchley, director of the Division of Anthropology and Archaeology and the Archaeology Institute. “Watching the survey boat over Emanuel Point III, seeing how close it was to land and imagining this was where the people came and stepped ashore; it gives me goosebumps. It’s very powerful to put yourself in a location where you can envision what the landscape was like in 1559.” UWF’s research related to the Luna expedition is sponsored in part by the Department of State, Division of Historical Resources, and the State of Florida. Pensacola author Retired Navy Captain Kevin Miller releases second novel: “Declared Hostile”
They say, “write what you know,” and for former tactical naval aviator Captain Kevin Miller that means writing detailed and engrossing military thrillers. Miller, who lives and writes in Pensacola, has just released his second novel, “Declared Hostile.” It is the second in a series that began with the Amazon best-seller, “Raven One.” His books bring readers into the cockpit, the ready room and to the skies to experience the pressure and precision involved in aircraft carrier operations. Miller illustrates details from his own experience in combat, “I spent many hours circling the skies of Iraq and Bosnia during No-Fly Zone patrols. The aircraft I flew the most in my career is the FA-18 Hornet; it is the same aircraft the Blue Angels fly,” said Miller. A third generation naval officer, Miller graduated from the University of Mississippi, earned a Master of Science in Business Management from Florida State University and a Master of National Security Policy and Strategic Studies from the Naval War College. During his 24 years in the Navy, he flew the A-7E Corsair II and FA-18 Hornet operationally and commanded a carrier-based strike-fighter squadron in combat, logging over 1,000 carrier-arrested landings. He deployed overseas six times throughout the 1980s and 1990s aboard the aircraft carriers Nimitz,
Dwight D. Eisenhower, George Washington, Theodore Roosevelt and Enterprise. Miller finished his naval career in the Pentagon serving on the staff of the Secretary of the Navy, retiring in 2005. His personal decorations include the Bronze Star, the Air Medal (with combat “V”), and two strike-flight Air Medals. After retirement, he went on to work at two Washington DC defense-consulting firms. In 2010, he joined the Naval Aviation Museum Foundation in Pensacola as
Executive Vice President and Chief Operating Officer and was instrumental in the launch of the National Flight Academy. Today he is a self-employed defense consultant and author. POLLUTION NOTIFICATION PLAN CONTINUES TO DRAW OBJECTIONS By RYAN RAY THE NEWS SERVICE OF FLORIDA
Despite some changes to reassure the business community, the Florida Department of Environmental Protection continued to hear objections Monday to a pollution-notification rule proposed in the wake of high-profile incidents in Pinellas and Polk counties that raised questions about state environmental regulations. The proposed rule, ordered by Gov. Rick Scott, would require any business, county or city government responsible for a pollution incident to notify the public within 24 hours. It was developed after a major St. Petersburg sewage spill and after a sinkhole at a phosphate plant south of Lakeland sent toxins into the Floridan Aquifer and threatened drinking water. Some revisions to the rule were released Friday after members of the public --- primarily advocates for utility companies --- testified at a series of workshops about concerns the proposal would saddle them with undue regulatory burdens and substantial new compliance costs. Within 24 hours after the initial public notification, according to the revised
language released Friday, the responsible parties would have another day to release specifics of the pollution’s likely effects. The revisions also specify exactly how the news media would have to be notified: at least one local newspaper, by email or hand-delivered notice, and at least one local network television station, also by email or written correspondence. The department also released a statement of economic impact to the affected industries. The proposal “will not have a direct or indirect adverse impact on economic growth, private-sector job creation or employment, or private-sector investment of $1 million” over five years, according to the department. But that prediction did not quell the worries of industry groups, which said business or local government in-house press shops were ill-equipped to handle the public notification aspect of the new rule. “This is, I think, an undue burden on these companies. … We feel like notifying DEP and letting DEP notify the local governments would be the best course of action,” said Tisha Keller of the Florida
Trucking Association. David Childs, representing the Florida Chamber of Commerce and the Florida Water Environment Association Utility Council, stressed that the department should notify the public, as it has “toxicologists, biologists and communications staff, as well as the bully pulpit of the executive branch of state government,” unlike businesses and small local governments that might not have the resources to provide the notice. Another consistent complaint from municipal and industry interests was that the rule had simply moved too quickly. Scott ordered the rule’s drafting in September. Despite the ongoing concerns, the department has indicated it will continue according to its plan to begin finalizing the rule immediately after 5 p.m. Wednesday, when a public comment period formally ends. “We certainly will take the comments that were previously provided, as well as those today, and the department will make a final decision on what the final rule will look like,” said Robert Williams, chief deputy general counsel at the department.

One of the noisiest, most bizarre and seemingly longest campaign seasons in American history careened toward the finish line Monday, with candidates at all levels zipping across Florida as major races remained up for grabs. Republican presidential nominee Donald Trump needs Florida’s 29 electoral votes in his fight with Democratic nominee Hillary Clinton for the White House, and incumbent U.S. Sen. Marco Rubio, also a Republican, is trying to fend off a re-election challenge from Democratic Congressman Patrick Murphy. Voters were also set to pick the winners in 26 of the state’s 27 congressional districts --- Miami Congresswoman Frederica Wilson doesn’t have a general-election opponent --and dozens of legislative seats, with Democrats hoping to make gains on both fronts, even if outright control seems unlikely. And a pair of high-profile constitutional amendments, one dealing with solar power and the other with medical marijuana, also faced final decisions. More than 6.4 million Floridians had already cast ballots by Monday afternoon, either through the mail or through in-person early voting, leaving partisans scouring the tea leaves to search for a pattern. “There’s never been a more important tomorrow in modern electoral history in the United States,” said Vice President Joe Biden, visiting the campus of Florida A&M University in Tallahassee. “That’s not hyperbole. That’s simply fact.” Trump, meanwhile, tried to rally support during a campaign stop in Sarasota. Late-breaking polls indicated that Clinton and Trump were virtually tied in the state, while most
surveys gave Rubio a lead ranging somewhere between a little and a lot --though many showed his lead hovering within the margin of error. Biden tried to tie Rubio with the more unpopular Trump, whom Rubio endorsed after a bitter fight when both men were running in the Republican presidential primaries. “You got a guy running for the United States Senate here ... who says that he disagrees with Donald Trump on these things, but doesn’t have the courage to stand up and say, ‘I won’t vote for him.’ ... Ladies and gentlemen, this goes to your character,” Biden said. Later, he added: “These guys are cut from the same political cloth.” Both sides claimed to see positive signs in the early voting totals. Bill Dunn, the Republican National Committee’s director of early and absentee voting, said that in 2012, Democrats had a 168,000-vote edge in early and absentee voting in Florida, while Mitt Romney lost the state by 74,000 votes. Dunn said Democrats had an 87,000vote edge as early voting closed Sunday in Florida. “This is an 81,000-vote improvement, which completely erases the margin that Romney lost by,” Dunn said. Looking at early voting alone, Dunn said the raw vote counts are up “all across the board.” But looking at each party’s percentage of that vote, Dunn said the Republicans had improved while the Democrats dropped. “What we see today is very encouraging,” he said. But veteran Democratic strategist Steve Schale said on Twitter that the earlyvoting electorate was more diverse in 2016 than four years earlier, in large part thanks to rapid growth in voting by Latinos. Trump has angered many Hispanics with charged comments
about immigration. “Need to look at more data, so not ready to predict a spread (though I have number in mind), but the majority of data looks good for HRC,” Schale wrote, using Clinton’s initials. Republicans were expected to maintain a majority of the seats in the state’s congressional delegation, but a few districts bear watching Tuesday. Republican Congressman David Jolly is fighting former Gov. Charlie Crist in a district in Pinellas County, while South Florida features a battle between U.S. Rep. Carlos Curbelo, a Republican, and his Democratic predecessor, former Rep. Joe Garcia. Meanwhile, longtime Republican Congressman John Mica faces a stiff challenge from businesswoman Stephanie Murphy in a Central Florida district. U.S. Army veteran Brian Mast, a Republican, could take the congressional seat in northern Palm Beach County and the Treasure Coast that Patrick Murphy is vacating to run for the Senate. Mast is locked in a race with Randy Perkins, who made his fortune in disaster relief. In the Legislature, Democrats were hoping to get back to at least 41 seats in the Republican-dominated House, giving them more leverage over the flow of legislation in chamber. They are at 37 seats now. And they were looking to get closer to parity in the Senate, which currently features 26 Republicans and 14 Democrats. But Valerie Scoon, a professor from Florida State University who attended the Biden rally in Tallahassee, might have highlighted what the day meant to many Floridians. “I think we just mostly feel excitement about this election, and some relief that we are going to be able to move forward past the election season,” she said.

PARTIES BATTLE FOR HILLSBOROUGH HOUSE SEATS

Three Florida House races in political bellwether Hillsborough County are among the state’s most competitive. Anchored by the sprawling Tampa metropolitan area, Hillsborough is a target on the western end of the state’s vaunted I-4 Corridor for both parties, and Democrats will have to make gains there Tuesday to put a serious dent in the Republican Party’s two-toone supermajority in the House. In District 60, two wellfunded candidates, Republican Jackie Toledo and Democrat David Singer, are duking it out to replace House Majority Leader Dana Young, who is leaving the seat to run for the Senate. The Republican State Leadership Committee, a state-house campaign arm of national Republicans, listed the district as a “race to watch” in October and is actively backing Toledo, 40, who raised $302,000 for her campaign. Toledo, an engineer, won a narrow 248-vote primary victory over businesswoman Rebecca Smith on Aug. 30 and is looking to parlay a fundraising edge and a slight GOP voter-registration advantage into a general election win. Singer, 39, raised some $161,000 and is trying to end two decades of Republican control of the district, which includes affluent South Tampa as well as MacDill Air Force Base, home to United States Central Command headquarters In nearby District 63, Rep. Shawn Harrison, RTampa, is facing a stiff re-election challenge from Tampa City Councilwoman Lisa Montelione in a swing seat that typically favors Democrats in presidential-
election cycles and Republicans in non-presidential years. Harrison was first elected to the seat in 2010 but lost to former Democratic Rep. Mark Danish in 2012, only to win the seat back in a 2014 rematch. Harrison, 51, raised nearly $300,000 to try to stave off Montelione’s challenge and has cut a moderate profile in the House in keeping with the centrist bent of the district, which includes the University of South Florida and many of the suburban bedroom communities surrounding Tampa, such as Carrollwood and Lutz. For her part, Montelione, 55, raised about $246,000 and has the backing of the state Democratic Party and an endorsement from President Barack Obama. Democrats boast a roughly 5 percent registration advantage in District 63, but many of those registrants are college students and other “sporadic voters” who are often costly for campaigns to organize. To Tampa’s east lies another of Florida’s most competitive House districts, District 59, where Obama won by less than 1 percentage point in 2012 against Republican presidential nominee Mitt Romney and in 2008 against John McCain. Rep. Ross Spano, R-Dover, outperformed the top of the ticket to win the seat in 2012 by a thin margin, 51 percent to 49 percent, over Democrat Gail Gottlieb. The attorney and small businessman cruised to an easy win in the 2014 midterms, but this year faces a challenge from 38-yearold Brandon attorney Rena Frazier. Spano amassed a whopping $372,000 in campaign contributions, nearly double Frazier’s $198,000 fundraising effort. In recent years, Republicans have managed to gen-
erally outmatch Democrats in Hillsborough legislative races, despite Tampa being represented by Democratic mayors and U.S. House members for decades. Montelione said Friday that a slate of well-recruited Democratic candidates --- combined with the unpopularity of Republican presidential nominee Donald Trump among the growing numbers of noparty affiliation voters --could help turn the tide for Democrats in Tallahassee. “Having these seats go back every two years from presidential to off-cycles serves no one,” said Montelione, calling Hillsborough districts a “road to parity” for House Democrats, who are outnumbered 81-37 after term-limited Rep. Michelle Rehwinkel Vasilinda of Tallahassee recently switched from being a Democrat to an independent. Montelione predicted Democratic gains in Hillsborough County in 2016 and in subsequent cycles. “I plan to win my district this year and with strong help from the Florida Democratic Party and House Victory, I intend to keep it next cycle as well,” said Montelione, who is resigning her seat on the Tampa City Council to pursue state office. But without help from the same demographic shifts that are boosting Democratic fortunes in Orlando, for instance, many state Republicans are doubtful Tampa-area Democrats will be able gain a long-term electoral edge. “As long as Republicans continue to recruit solid, socially moderate candidates in the region and continue to run an effective ground game, “ said GOP political consultant Taylor Patrick Biehl, “I expect Hillsborough legislative seats to remain heavily GOP for some time.”
