Access Your Health With Direct To Consumer Lab Testing written by Kelly Oden
Wondering about the source of your fatigue? There’s a test for that. Trying to decide how to best treat your depression?

Everwell Specialty Pharmacy Everwell Specialty Pharmacy works with a company called Spectracell, which allows them to offer a vast array of unique direct access testing including the popular hormone, thyroid, and DNA tests as well as more detailed tests like the neurotransmitter test, the micronutrient test and the telomere test. All labs are available without a doctor’s prescription and some are even covered by insurance. It is often an out-ofnetwork fee and many tests have a typical copay of about $40-$45. “People are becoming increasingly more knowledgeable,” says patient care manager Kara Hyman, BSN RN, “and this provides them with a more active role that they can take in their health.” At Everwell, clients come in and discuss their symptoms and concerns with Hyman and they decide what tests may be appropriate. For blood tests, clients are sent to a lab for the blood draw and have their results within three weeks. “They come back in and we sit down and go over everything in great detail,” says Hyman. “We then decide if there was anything that really needs to be addressed by a doctor. Everything is very personalized to their individual situation.” Thyroid and hormones tests are very popular as well as the cardio metabolic profile, which measures lipoprotein size and density, cardiovascular risk stratification as well as triglycerides and traditional cholesterol screening. One unique offering of Everwell’s is the neurotransmitter test—a urine test that looks at dopamine, serotonin, and norepinephrine. “If someone is prescribed an anti-depressant because they have depression, but they are contemplating whether they want to go that route, we can look at their neurotransmitters to see if they are truly deficient in serotonin,” says Kara. “Do they need nutrients to boost serotonin? Or, if their levels are fine, then they know that an anti-depressant with that make up will not help their depression, so it’s time to look elsewhere—is it hormones or something else? Where is the missing link?” Another fascinating aspect of DTC testing is the emerging field

to be responsible or worry that they’ve had some exposure. It may not be something they want to discuss with their family practitioner. They just want to come in and get the test done. We offer a private and discreet way for them to do that.” Donald says DNA testing is a big part of her business as well. The most common DNA testing is for paternity, but they also do a lot of forensic work—from infidelity to criminal cases. One interesting test Any Lab offers is the new DNA Pharmacology test, which helps figure out which medications match your DNA profile and would therefore be more effective for your body. Another new test is a take-home test that allows users to get a DNA profile of their dogs that will tell owners exactly what breeds make up their furry best friend. “Toxicology is also big in terms of people taking control of their health and wellness,” says Donald. “We offer a comprehensive date rape panel, which checks for the presence of drugs most commonly used in date rape situations. We also offer an alcohol effect panel. This is for someone who feels like they consume a lot of alcohol and they want to see what effect it is having on their body. Is this affecting mwy liver or kidney function? We do a child guard panel—with this we can test a child to see if they’ve ingested or been exposed to drugs. We use this in shared custody situations fairly often.” Mikael says Any Lab’s direct access is beneficial for those who are curious about their health or for those whose insurance won’t cover desired tests. “Many times physicians order tests based on what your insurance will allow or pay for,” Donald explains. “Physicians have a responsibility to order things pertinent to the symptoms you are presenting and that’s great. We are not saying you should take the physician out of the equation, but sometimes you want to be the driver. Sometimes you want to know if what you are doing is working for your health. If any tests results are out of range, we make sure you are following up with a physician. It’s simple. Ten minutes will have you in and out and many times you will have results the next day.”

Gulf Breeze Apothecary Gulf Breeze Apothecary (GBA) offers a Hormone Profile saliva test that consumers can do at home and send off for analyses. The kit tests for estradiol, progesterone, testosterone and DHEA, which is a precursor to several hormones. An adrenal stress protocol can be added to test cortisol as well. Customers can pick up the test kit at GBA, complete the saliva collection process at home and mail in the completed kit for analysis. Hollie Fletcher, a clinical pharmacist at GBA, says many doctors send their patients to them because they prefer saliva tests to blood tests. Other times, a patient’s doctor does not do hormone replacement or is not wellversed in the subject. “In those cases, I can look at the test results with the patient and make recommendations to their provider,” says Fletcher. Although many women who are peri-menopausal, pre-menopausal or menopausal seek out this test, anyone whose hormones feel out of whack will benefit from the testing. Clients are also able to purchase this testing without a prescription or recommendation from a physician. If bio-identical hormone treatment is desired, they will need a prescription from a physician, but Fletcher can help with those recommendations. GBA also does compounding medicine, including bio-identical hormone replacement, which Fletcher says is a more natural approach than some of the commercially available products. Any Lab Test Now Any Lab Test Now is a national chain of franchised testing labs offering hundreds of lab tests direct to consumer including basic bloodwork, DNA, thyroid, hormone, STD, and even forensic testing. “Many people come in because they are feeling tired or not quite right,” says Mikeal Donald, owner of Any Lab Test Now in Pensacola and Daphne, AL. “They want to check their vitamin levels or hormone levels. We also do a lot of B12 testing and we offer B12 injections.” “We also have a number of patients come in for STD testing,” says Donald. “Many people who are in a new relationship want

There’s a test for that. Not sure you are getting enough vitamins? There’s a test for that. Hormones feeling out of whack? There’s a test for that, too, and guess what? You don’t necessarily have to visit your physician to find answers. You can access these and many more lab tests through directto-consumer (DTC) lab testing. This type of lab testing is on the rise and putting important diagnostic information directly into the hands of consumers. In years past, most lab testing, including hormonal, thyroid, nutrient and basic bloodwork all required a trip to the doctor, a potentially large sum of money depending on your insurance, and a relatively-long wait for results. The tides of medical care are changing and many consumers are taking their health into their own hands by taking advantage of a variety of home-testing, pharmacy testing and mail order testing options to help monitor an existing health condition, identify a medical disorder, or provide information about personal health issues—including the rapidly growing field of genotyping and nutrigenomics. While a number of online options are available, local labs and pharmacies offer a better solution as they often have staff on hand to interpret your results and recommend treatments or a specialized physician for further advice. Here are a few of the most popular and interesting tests available locally.

Popular genotyping tests include MTHFR, Apolipoprotein E, and Factor V Leiden and Prothrombin. Everwell offers a new genetic test, the Telomere Test, which could potentially have a big impact on lifespan. Telomeres are sections of DNA at the end of each chromosome that serve as a cap to your genetic material. Every time a cell replicates, its telomere will become shorter. Shorter telomeres imply a shorter life span for a cell. The Telomere Test measures the length of the client’s telomeres, which reveals the rate of biological aging and is strongly correlated with risks for chronic diseases. Lifestyle changes and therapies directed at slowing the loss of telomere length may slow aging and the progression of age related disease. For those of you wisely counting nutrients rather than calories, Everwell’s micronutrient panel may help you determine areas of deficiency and allow you to alter your eating and supplementing routines to bring certain nutrient levels up. Micronutrient testing measures how micronutrients are actually functioning within your white blood cells. These tests allow for a nutritional assessment for a broad variety of clinical conditions, general wellness and the prevention of chronic diseases including arthritis, cancer, cardiovascular risk, diabetes, various immunological disorders and metabolic disorders. A Valuable Tool Jodi Brown, a local wellness chef and educator uses DTC lab tests routinely. Initially, she pursued DTC lab testing because she was uninsured and paying out of pocket. “The value for me initially was price,” says Brown. “It’s much cheaper. The other benefit is that there are things that I choose to monitor in my body based on what I know my health conditions are. For example, I want to make sure my vitamin D levels are good. I can order that test, I know the level I need to be at, so I can check it myself and save a trip to the doctor. It allows me to monitor the numbers based on what my
doctor tells me I need to do within a range.” Brown is a big believer in taking your health into your own hands, but she doesn’t believe people should do random blood testing without getting some advice about it first. “If you can develop a relationship with your doctor and figure out the zones and the numbers you should be within for a specific test, then you can follow up on your own. You should never try to diagnose or understand the testing on your own. You should have a professional that you trust do that with you,” she explains. No matter your ailments or concerns, direct-to-consumer lab testing is a discreet, quick and often affordable option for monitoring your health and wellness. The results are confidential unless you choose to share with your medical provider, in which case they become a part of your medical record. DTC testing seems to be here for the long haul, as well. Kalorama Information, a market research firm specializing in healthcare, reports that the U.S. market for direct-to-consumer laboratory testing was worth roughly $131 million for 2015. Sales have increased from just $15.3 million in 2010, largely due to the growing trend for genetic testing. Clients taking advantage of this healthcare option should be sure to speak with their physician or health care provider if any result seems out of the normal or acceptable range.

Escambia County Commission Chairman Doug Underhill Pre-Files for Re-Election Yesterday, Escambia County Commission Chairman Doug Underhill pre-filed for re-election for District 2 County Commissioner in 2018. Underhill won the District 2 seat in 2014 carrying all 12 precincts of the district with 63 percent of the vote. “We are looking forward to a campaign on the issues that are important to District 2 and Escambia County,” Underhill stated. Commissioner Underhill seeks to provide full transparency, offering residents an opportunity to have an
open dialog with their elected officials. Underhill is dedicated to creating high-paying jobs, improving infrastructure, and collaborating with community leaders and their constituents. Since being elected as District 2 County Commissioner, Underhill has set specific priorities including reducing excessive spending of taxpayer dollars, increasing public engagement, and continuous training for county staff. The grant will be utilized to provide a fishing pole for each child participating in the Pensacola Parks and Recreation Department’s summer fishing camps. The Outdoor Pursuits Program offers a basic and advanced fishing camp in the summer where children receive classroom instruction and hands-on fishing

Each participants will be able take home a fishing pole once they complete the program. “Teaching our youth the life-long skill of fishing and inspiring them to be good stewards of the environment are the main goals of the Outdoor Pursuits youth fishing programs. Escambia and Santa Rosa Letter Carriers Celebrate the 25th Stamp Out Hunger Food Drive On Saturday, May 13, 2017, Escambia and Santa Rosa Letter Carriers will join forces to help Stamp Out Hunger in our community. In its 25th year, the annual food drive has grown to the largest national single-day effort that benefits millions of Americans who struggle to put food on the table. “This is the single most important food drive in the two counties and will largely determine how well providers will meet the needs of the hungry in the coming months,” said DeDe Flounlacker, Manna Food Pantries’ Executive Director. Residents are encouraged to leave a sturdy bag of non-perishable foods, such as canned soup, canned vegetables, pasta, rice or cereal next to their mailbox prior regular mail delivery on Saturday, May 13. Escambia and Santa Rosa letter carriers will collect food donations for local food banks including: Manna Food Pantries, Warrington Emergency
Aid Center, Feeding the Gulf Coast in Pace and Milton, ACTS Ministry of Holley Assembly of God in Gulf Breeze, and We Care Ministries of Navarre United Methodist Church. Last year, the organizations received a total of 72,367 pounds of food from the drive. “We rely on this food drive to keep our shelves fully stocked to help needy families, children, seniors and the homeless in Gulf Breeze and Navarre.”,” said Pastor Doug Barber, ACTS Ministry of Holley Assembly of God. “Without the help from the NALC and the community during the annual Stamp Out Hunger food drive, ACTS Ministry would almost be non-existent.” Last year, Manna Food Pantries helped a total of 21,129 individuals through their pantries and programs in Escambia and Santa Rosa counties. Of those, 37 percent were children and 27 percent were senior citizens. Manna helped a total of 11,254 families

Pensacola State College students in the General Education Development program will have more scholarship opportunities, thanks to a $1,000 gift honoring James “Jim” Glantz who taught GED classes from 2002 to 2011. Deborah Glantz made the donation in memory of her late husband who was committed to his students and taught until a cancer diagnosis forced him to leave the classroom. “Jim was instrumental in many adults’ lives by assisting them to earn their GED,” Deborah Glantz said. “PSC was the perfect place for Jim; he was a helper. He wanted to give a hand up – not a handout – and teaching GED students let him do that.” As a sober member of Alcoholics Anonymous for 39 years, Jim was also a committed volunteer for Pathway for Change and lived out the importance of giving back. “His love for teach-

ing and his passion for paying it forward will be honored through these scholarships awarded to GED students who are also in recovery programs and are actively rebuilding and improving their lives,” Deborah added. Jim Glantz’ first career was serving in the U.S. Navy for 30 years and retiring with the rank of Master Chief. After earning his associate degree at Pensacola State, he earned a bachelor’s degree in education at the University of West Florida. Then, he taught computer programming at St. Benedict School in Elberta, Alabama in addition to his teaching career at Pensacola State.
Deborah Glantz also is a Pensacola State alum and said that a certification she earned at the college significantly impacted her life. “I worked for the Navy for 22 years as a Certified Addiction Professional and my career started at then Pensacola Junior College,” Deborah said. Hillary Person, PSC Foundation director of development and campaigns, said the Foundation is fortunate to receive the support of so many community members. “Every scholarship gift, no matter the amount, to the college’s Foundation is transformational to the lives of our students,” Person said.
City of Pensacola graduates 40 in Citizens Academy Forty area residents graduated Tuesday evening from the City of Pensacola Citizens Academy. Attendees from across the area concluded this nine week course with a graduation ceremony at Osceola Golf Course. The Citizens Academy is a comprehensive program designed to enhance awareness of and access to City services, and create ambassadors for the City. The graduating class spent nine weeks learning about City departments and visiting City Hall, Pensacola International Airport, Pensacola Police Department, Pensacola Energy, City sanitation facilities and fire stations among others.

Sacred Heart CEO Earns National Award from Catholic Health Association
The Catholic Health Association of the United States (CHA) has named Susan Davis, CEO of Sacred Heart Health System in Pensacola, as a recipient of the 2017 Sister Concilia Moran Award. One of two major honors to be presented at the annual Catholic Health Assembly this summer, this award recognizes “trailblazing leaders” and “innovative ideas and achievements by which these leaders have taken Catholic healthcare in new directions.” Named for the first post-Vatican II superior of the Sisters of Mercy of the Union, the Sister Mary Concilia Moran Award celebrates the memory of a woman who was a leader both in religious life and as a hospital administrator and health system executive. Sister Concilia pioneered the development of a new relationship between the Catholic Church and Catholic-based health systems. The processes and systems built under her leadership enabled a new era in Catholic healthcare. This award recognizes the transformative initiatives done under Davis’ leadership at Sacred Heart and at Providence Hospital in Mobile. Sacred Heart and Providence are part of Ascension – the largest non-profit health system in the U.S. and the world’s largest Catholic health system. Davis was
selected to lead Sacred Heart and Providence in 2012. The award also recognizes Davis’ contributions to healthcare during her eight years in Bridgeport, Conn., at the helm of St. Vincent’s Health Services, another Ascension hospital. “Without a doubt, Susan Davis is a woman of passion and compassion, vision, energy, creativity, dedication and deep commitment to healing,” said Patricia Maryland, Dr.PH, President, Healthcare Operations and Chief Operating Officer, Ascension Healthcare. “Susan has always put patients and her community first, and the passion she brings to each project inspires colleagues and staff to join her.” Some examples of Davis’ work that led to her earning this award include: • A tireless advocate for women and children across the Gulf Coast, Davis has been the driver behind Sacred Heart’s efforts to construct a new, four-story children’s hospital on the Pensacola campus. The Studer Family Children’s Hospital at Sacred Heart has served families from across the Gulf Coast since 1969 and is Northwest Florida’s only children’s hospital. The new children’s hospital will increase access to specialized pediatric and maternity care and consolidate inpatient pediatric services in
one convenient location. • Driven by her own experience as a young girl with an impactful mentor, Davis has opened up opportunities for mentoring and volunteerism within the communities she has served. At Sacred Heart, she has served as a mentor for Escambia County’s Take Stock in Children and participated in Habitat for Humanity’s Women Build program for several years. • After being diagnosed with breast cancer in 2016, Davis utilized her own experience to advocate the importance of early detection to hospital staff members and to communities across the Gulf Coast. She sent updates to hospital staff members about her diagnosis and experience throughout her care, wrote letters to area newspaper editors and appeared in television segments and online videos during breast cancer awareness month. • As chair of the Connecticut Hospital Association’s Board Committee on Patient Care Quality, Davis became the voice for safety and high performance for hospitals throughout Connecticut. Her work led to a dramatic improvement in mortality rates for St. Vincent’s Health Services in Bridgeport, Conn., as well as the signing of Senate Bill 248 in Connecticut, which expanded disclosure of medical errors and patients’ access to information about their care. • Davis was instrumental in obtaining a grant of $160,000 from Ascension to launch Connecticut’s first Dispensary of Hope site, which distributed more than $1.8 million of prescription medications to people in need in 2016. Categories for consideration of the Liberty Bell Award include: promoting a better understanding of our Constitution and the Bill of Rights… and fostering a better understanding and appreciation of the rule of law. “I believe everyone here today would agree that one of our society’s most important roles is to assure that future generations will grasp – cherish and sustain – the values set forth in our 3 great documents: the Declaration of Independence, the Constitution, and the Bill of Rights,” Mike Doubek, Executive Director of the ESRBA, said during the luncheon’s program. “Providing a means for easy understanding of those documents has been a cause set in motion throughout Escambia County for several years now.” Doubek then announced that the recipient of the 2017 Liberty Bell Award was the Escambia County School District. The award was accepted by Superintendent Malcolm Thomas. “I was completely surprised by the announcement and honored. Our partnership with John Appleyard and his writing project is one that will continue to enhance our social studies classes in seventh and fifth grades,” said Thomas. “And, having enhanced instruction
in Civics leads to better informed citizens, as these students get old enough to vote or maybe even to run for office someday.” The school district’s seventh grade civics students receive copies of booklets written by Appleyard that cover the Constitution and the Bills of Rights. Appleyard made the first delivery of each book with a presentation in one of the middle schools. He read an excerpt and took questions about the topic and about being a writer. Most recently, the Escambia-Santa Rosa Bar Foundation paid for the printing of Appleyard’s latest work, “The United States is a Nation Ruled by a System of Laws,” that was distributed this year to local fifth graders. “Fifth grade American history starts with the native people of the North American continent, moves on to the European settlers and the colonies, and then to the beginnings of our American government,” explained Arnette. “Mr. Appleyards’s book on the Rule of Law is set in a classroom where students are learning how these early rules still govern our actions today in a variety of ways, not just in our government, but in all of our lives.” Arnette added that de-
ciding to incorporate this book in elementary school, rather than having all three books in seventh grade classes, came from a desire to engage students in discussions of civic values and principles at an earlier level. “An added benefit is that the students will be familiar with Mr. Appleyard and will then look forward to reading his other books in seventh grade, or they might even visit his storytelling cottage, start watching for his columns, or listening to his podcasts about Pensacola history,” said Arnette. “We appreciate the Bar Foundation’s role in helping to make this project possible.” “We are blessed in Escambia County School District by many community groups that are willing to invest in our students’ civic education which impacts our future,” shared Arnette. MAJOR EDUCATION BILL MAKES LATE APPEARANCE By BRANDON LARRABEE THE NEWS SERVICE OF FLORIDA
A sprawling, 278-page education package affecting everything from charter schools to school uniforms emerged from the budget process Friday, raising new questions about transparency in the final days of the legislative session. The legislation (HB 7069), unveiled after 4 p.m. on the next-to-last business day of the session, would settle most of the major education issues that confronted lawmakers during their time in Tallahassee this spring. A final vote on the nearly $419 million proposal is scheduled for Monday. It would encourage charter schools to open up near academically struggling traditional public schools, while also allowing traditional campuses to seek funding to provide additional services to students. It would expand the “Best and Brightest” teacher bonus program, limit testing in public schools and designate September as “American Founders’ Month.” In a move likely to be popular with some parents, public schools except for charter schools would also be required to provide 20 minutes of recess to elementary students.
“I think that is going to go down as one of the greatest K-12 bills in the history of the state of Florida,” said House Speaker Richard Corcoran, R-Land O’ Lakes. But the move to cram dozens of provisions into a budget-related bill that is essentially a must-pass for lawmakers revived a discussion about transparency in the negotiations over a spending plan for the year that begins July 1. Corcoran pledged in the run-up to the session that this year’s budget process would be one of the most open and transparent. But while the Legislature made strides in revealing which members were behind projects slipped into the budget, negotiations over several portions of the budget --including the education bill --- took place largely behind closed doors. Legislative leaders defended the process again Friday, particularly in regard to the education bill. Corcoran portrayed the budget process as an extension of his effort to exert legislative authority. “Under Article III (of the state Constitution), we have that right,” he said. “And I’ve said it to you guys from the beginning: One of my biggest criticisms coming in as speaker was, we’re the body closest to the people, the Legislature. And what
we’re going to do is, we’re going to go out there and we’re going to grab that authority.” Corcoran and Senate President Joe Negron, R-Stuart, also said that many of the ideas incorporated into the budget “conforming” bill have been debated elsewhere. “These are issues that have been part of the legislative process for a long time,” Negron said. On one of the most closely watched education issues, lawmakers revamped the House’s “schools of hope” proposal. That $200 million measure was originally aimed mostly at encouraging charter schools with a track record of helping academically struggling students to open branches near traditional schools that continually do poorly on state report cards. The new proposal would cost about $140 million, but traditional public schools would also be able to request up to $2,000 a student from the fund to help with programs like “wraparound services,” including health care and after-school programs, that might address students’ needs outside the classroom. That was a chief priority of the Senate. As for the “Best and Brightest” teacher bonus program, the plan would vastly expand over the next
three school years before tightening eligibility again. Every teacher rated “effective” on his or her evaluation would get $800; those rated “highly effective” would earn $1,200. Beginning in the 2020-21 school year, teachers would once again be required to perform well on certain standardized tests to earn a bonus of $6,000 a year. But more tests would be eligible for the awards, the mark to make would be slightly lower than it is now, and students who graduate from college with honors would face an even easier bar. The measure would also do away with the Algebra II end-of-course exam, make it optional for school districts to use a state measurement of student learning in teacher evaluations and study using college-entrance exams to replace some state high school tests --- part of an effort to ease the testing burden in public schools. Democrats approved of some of the changes, taking credit for helping to push leaders to alter the “schools of hope” language. “At the end of the day, we take that away and we feel good about the fact that we tailored and tamped down the original `schools of hope,’ “ said House Minority Leader Janet Cruz, D-Tampa. But they also raised con-
cerns about putting together largely popular measures, like those on teacher pay, with more contentious ideas, like some language on teacher contracts that Democrats oppose. “I hate the fact that you take good legislation, and you mix it with bad things,” said Rep. Shevrin Jones, D-West Park. “It basically forced our hands in a lot of areas.” The bill also came perilously close to a replay of 2011, when a rebellion among Republican senators contributed to a rocky end to the session. Many of those senators were unhappy with the use of budget-conforming bills to pass major policy changes. Sen. Bill Montford, a Tallahassee Democrat influential on education issues, indicated late Friday that he had similar qualms this year. “I for one have concerns that perhaps the whole structure of the conforming bill maybe has expanded too much,” said Montford, who also serves as head of the Florida Association of District School Superintendents. Lawmakers also approved legislation on Friday that would increase funding available to students under the state’s de facto voucher program and strengthen protections for expressions of religion in public schools. Those bills head to Gov. Rick Scott for his signature or veto.

A change to the state’s “stand your ground” self-defense law is heading to Gov. Rick Scott after the Senate agreed late Friday to go along with a House proposal. The House and Senate both wanted to change the law but had clashed on a legal issue in the bill (SB 128). But with time running out in the legislative session Friday, the Senate voted 2214—with Tallahassee Democrat Bill Montford joining Republicans in support—to accept the House proposal. The move came in ex-
change for getting the House to accept the Senate’s more far-reaching language on a separate measure (SB 436) dealing with religious expression in public schools. “I thought that it was a reasonable resolution to both matters, and they’re both constitutional issues,” said Sen. Rob Bradley, a Fleming Island Republican who sponsored the “stand your ground” bill. “And we wrapped it all up in a bow, and we resolved them both in a satisfactory manner.” The overall issue stems from a Florida Supreme Court ruling in 2015 that said defendants have the burden of proof to show
they should be shielded from prosecution under the “stand your ground” law. In “stand your ground” cases, pre-trial evidentiary hearings are held to determine whether defendants should be immune from prosecution. While the House and Senate broadly supported the idea of shifting the burden of proof from defendants to prosecutors in the pre-trial hearings, they differed on a legal standard. The House proposal said prosecutors in pre-trial “stand your ground” hearings would have to overcome the asserted immunity sought by defendants through “clear and convincing evidence.” The
Senate fought for a higher standard of proof, known as “beyond a reasonable doubt. The two chambers needed to reach agreement by Friday, the final scheduled day of the annual legislative session. Lawmakers will meet again Monday to vote on budget-related issues but will not take up other matters. In the end, the Senate agreed to go along with the “clear and convincing evidence” standard. Proponents of the bill, which had support from groups such as the National Rifle Association, said shifting the burden of proof would better protect the rights of defen-

Florida legislative leaders put the finishing touches Friday on a package of budget-related bills, as the new spending plan weighing in at roughly $83 billion was released to lawmakers and the public. The network of interlocking deals came too late to allow the legislative session to end Friday, as scheduled. Because of a 72-hour “cooling off” period required by the state Constitution, the House and Senate will not be able to vote to approve the spending measure before 2:43 p.m. Monday. “It’s just been a very long journey,” House Speaker Richard Corcoran, R-Land O’ Lakes, said Friday afternoon at a final negotiation session with Senate Presi-
dent Joe Negron, R-Stuart. The two sides had already agreed on the spending plan in a meeting Thursday. The concluded work Friday on a series of bills tied to the budget. The budget, which provides funding for state functions for the year beginning July 1, would provide a modest increase for the main formula for school funding, give state employees their first raise since 2013 and slash Medicaid payments to hospitals by $521 million. Some of those health-care cuts could later be filled in by spending from a federal program still being negotiated between Gov. Rick Scott and the Trump administration. The budget will also, notably, not include economic-development incentive money sought by Scott and will slash tourism-marketing funds. The governor continued a tour of the state Friday
aimed at pressuring lawmakers to cave on the issues. Despite the governor’s broadsides, and some criticism from outside groups, legislative leaders said they were pleased with the final plan. “I think that the budget is a good budget that we can be proud of, that has a commitment to the issues that we care about today,” Negron said. The budget shows a bottom-line total of $82.4 billion. But that figure does not include some education and state-employee costs that are tucked in related bills and would bring the total to nearly $83 billion. Education groups, in particular, were already beginning to say Friday that the plan was inadequate. The Association of Florida Colleges knocked a $30.2 million cut to the Florida College System. “These reductions will have a lasting impact on local
communities and students, and could take years to restore,” Michael Brawer, the association’s CEO, said in a lengthy statement issued Friday. “Some colleges report that they will be less able to respond to local and regional needs with affordable workforce programs. Others indicate they will have to reduce courses and offer hundreds of fewer sections, delivered by trimmed down faculty staffing. This will create crowded classrooms, and less flexibility for access to courses by working adults.” Public school districts have also opened fire, questioning a provision that would increase the main school funding formula, the Florida Education Finance Program, by just $24 per student. “Considering the overall economic strength of our state, it is alarming that the basic funding needs of Florida public school students

dants. But critics argued, in part, that the change would lead to cases ending before all the facts are revealed. Sen. Jose Javier Rodriguez, D-Miami, said Friday the House version didn’t alleviate his concerns about the bill. “If you talk to prosecutors, they’re already gearing up just in case we pass this bill to expend significant amount of resources, in literally every single case where there is violent activity, where they (defendants) can raise this at the pre-trial stage and force the prosecutors to basically put on a trial at the pretrial stage,” Rodriguez said.

MEDICAL MARIJUANA DEAL GOES UP IN SMOKE

Unable to bridge a gap over how many marijuana dispensaries the state should have, Florida lawmakers Friday failed to pass legislation that would have created a framework to carry out a constitutional amendment legalizing medical marijuana for wide variety of patients. Implementation of the voter-approved amendment now rests in the hands of state health officials, who have been harshly criticized by legislators, patients, vendors --- and judges --- for their handling of the state’s current medical marijuana regulations. “The Florida Legislature chose political gamesmanship over the will of 71 percent of voters,” said Ben Pollara, executive director of the group Florida for Care, who also served as campaign manager for the political committee that backed the amendment. “The will of the people was thwarted again today by Tallahassee politicians, but they can’t deny us forever. Florida for Care will continue fighting to implement the Constitution and bring a compassionate medical marijuana law to this state’s patients.” A potential deal collapsed Friday evening after the House amended its proposal (HB 1397) to impose a cap of 100 retail outlets for each of the state’s medical marijuana operators, over the objections of some Democrats. The Senate had proposed a cap of 10, at least for now. “I’m nervous that bouncing this back … will kill this bill
and we will be stuck with a situation where the Department of Health has to implement Amendment 2, which can be disastrous for patients,” objected Rep. Carlos Guillermo Smith, D-Orlando. House Majority Leader Ray Rodrigues, the bill’s sponsor, pointed out that lawmakers had hours to go before the session was scheduled to end at midnight. “If the Senate can’t get this bill heard and decided in the next 3.5 hours, that problem’s with them, not with us,” Rodrigues, R-Estero, said. The Senate ultimately did not take up the final House proposal. The Senate bill sponsor, Rob Bradley, called the Legislature’s failure to act disappointing, saying he would rather lawmakers had control over the amendment’s rollout instead of the Department of Health. “That’s a real concern. The Legislature at some point in time needs to have a bill that implements Amendment 2. It’s disappointing that we didn’t get it done this session,” Bradley, a Fleming Island Republican said. “We just couldn’t bridge the gap, and that just happens sometimes.” Bradley started floating a plan to implement the amendment during committee hearings in January. Republican leaders in the two chambers set out contrasting approaches, with the House favoring a morerestrictive proposal and the Senate approving a plan that had a more-aggressive schedule for increasing the number of operators responsible for growing, processing
and distributing marijuana and derivative products. In the days leading up to Friday’s end of the legislative session --- for issues other than the budget --- the two chambers ironed out most of their differences on that issue. But a critical sticking point that emerged late in the session --- caps on the number of dispensaries each medical marijuana operator would be allowed to have --- ultimately proved too big a divide to resolve. The Senate on Thursday modified its proposal (SB 406) to limit each marijuana operator a maximum of 10 retail locations. The number would have increased as the number of eligible patients registered in a statewide database grew. But, while the House originally wanted fewer licensed marijuana operators in the state, the House’s bill would have allowed the purveyors to have an unlimited number of storefronts. Critics maintained that an unlimited number of dispensaries would give an unfair advantage to the seven operators currently licensed by the state. The caps were aimed not at limiting patient access but to ensure that “the golden ticket holders in the state will not be able to continue a monopoly moving forward,” Smith said during floor debate on the House’s proposal late Friday evening. But Rodrigues maintained that a proliferation of dispensaries would ultimately benefit patients. “Just because you’re first to the market, doesn’t mean you own the market,” Rodrigues
said. “I believe the free market will work, and quality will rise to the top, and the public will respond to that.” More than 71 percent of voters signed off on the constitutional amendment, largely bankrolled by Orlando trial lawyer John Morgan, in November. The constitutional amendment allows doctors to order marijuana as a treatment for patients with cancer, epilepsy, glaucoma, HIV, AIDS, post-traumatic stress disorder, amyotrophic lateral sclerosis (ALS), Crohn’s disease, Parkinson’s disease or multiple sclerosis. Doctors also have the power to order marijuana for “other debilitating medical conditions of the same kind or class as or comparable to those enumerated, and for which a physician believes that the medical use of marijuana would likely outweigh the potential health risks for a patient.” A ban on smoking pot products was one of the most fiercely debated issues for patients and advocates, but House and Senate leaders refused to back down from the prohibition. The House did agree, however, to allow marijuana operators to sell pot in vaporizable or edible forms. Morgan has threatened to sue the state over the issue. The amendment allows any Florida citizen to sue state officials if they fail to implement the amendment properly. Lawmakers first created a framework for the state’s marijuana industry more than two years ago, when they legalized non-euphoric, or low-THC, cannabis for patients with epilepsy, severe muscle spasms or cancer.
Under the 2014 law, nurseries that had been in business for at least 30 years and grew at least 400,000 plants were eligible to apply for one of five licenses to grow, process and distribute marijuana and derivative products in different areas of the state. The operators were supposed to start dispensing the low-THC products by Jan. 1, 2015, but a series of legal and administrative challenges delayed the rollout. As a result of the challenges, health officials were forced to issue two additional licenses. Anticipating that the amendment would pass in November, lawmakers last year expanded the law to allow full-strength marijuana for terminally ill patients. “We’re disappointed that we weren’t able to change a lot of the policy to allow access to patients across the state,” said Igniting Florida President Nikki Fried, the lead lobbyist for San Felasco Nurseries, one of state’s seven current medical marijuana vendors. “We’re hoping the Department of Health will faithfully implement the constitutional amendment and the will of the people.” Early this year, the Florida Department of Health began the rulemaking process to implement the amendment and held five workshops throughout the state to take testimony from the public. “The department is committed to quickly moving through the rulemaking process to create a regulatory structure for Amendment 2,” Department of Health spokeswoman Mara Gambineri said in a statement.
LAWMAKERS FAIL TO REACH DEAL ON WORKERS’ COMP

Tangled in a battle about attorney fees, Florida lawmakers could not reach agreement Friday on a bill aimed at holding down workers’ compensation insurance rates. The House and Senate swapped proposals Friday, the last scheduled day of the annual legislative session, but could not resolve differences after weeks of heavy lobbying by business groups, plaintiffs’ lawyers and labor unions. Lawmakers will meet again Monday to pass a budget but will not take up issues unre-
lated to the spending plan. House Insurance & Banking Chairman Danny Burgess, R-Zephyrhills, told House members during an afternoon debate that lawmakers were “trying to get across the finish line” on the workers’ compensation issue. “Every small business, every business owner in the state is watching what we do,” said Burgess, who spearheaded the House’s proposal (HB 7085). But critics said a limit on attorney fees in the House bill could prevent injured workers from having adequate legal representation in disputes with insurance companies. “The House bill will ab-
solutely restrict the access to courts,” said Rep. Sean Shaw, a Tampa Democrat who is a former state insurance consumer advocate. While workers’ compensation drew the most attention, two other major insurance issues also fizzled as the session ended. Lawmakers did not move forward with a proposal to eliminate the state’s nofault auto insurance system. Also, they did not address an issue known as “assignment of benefits” that property insurers blame for increased homeowners’ rates. The workers’ compensation issue has been high-profile since last spring, when
the Florida Supreme Court found two parts of the system unconstitutional. One of the rulings tossed out strict limits on fees paid to attorneys for injured workers. Those rulings played a key role in state regulators later approving a 14.5 percent increase in workers’ compensation insurance rates. That hike started taking effect in December. Business groups blame attorney fees for driving up costs in the workers’ compensation system and focused heavily on trying to get lawmakers to curb the effects of the Supreme Court’s fee ruling. But they ran into opposition from plaintiffs’ attorneys
and labor unions, who argued that fee limits hurt workers --- and that lawmakers should look to increase benefits for people injured on the job. The House proposed capping attorney fees at a maximum of $150 an hour, while the Senate proposed $250 an hour. In a last-ditch bid for an agreement, the House upped its proposal to $180 an hour, but the Senate adjourned Friday night without considering it. Along with the fee issues, senators also balked at House proposals to cut reimbursements to hospitals that provide outpatient treatment to injured workers.
LAWMAKERS REACH DEAL ON HIGHER ED FOUNDATIONS

University and state college foundations would be prohibited from using public funds to pay for their employees beginning in 2022 and would face more disclosure requirements under an agreement reached Friday by legislative leaders. The agreement is a modification of a House proposal that would have immediately prohibited the use of public employees or public funding
in the largely private foundations, which are also known as direct-support organizations. Universities are currently spending about $53 million to support foundation personnel, while state colleges are spending $9.9 million. Under the agreement, they will have five years to end that practice. In addition, the bill would immediately prohibit the use of state funds for travel by the organizations and would require disclosure of all expenditures involving public funds and the disclosure of all travel expenditures

involving private funds. The House originally sought a fuller disclosure of all expenditures and activity by the foundations, with the exception of the identities of private donors. House Speaker Richard Corcoran, R-Land O’Lakes, called the compromise a significant advancement in transparency for the direct-support organizations. “Is it where we wanted to go? We would like to go even further,” Corcoran said. “But to move that along to the extent that we have and
to have that accountability for the first time is something that is remarkable.” The foundation language is part of a broader higher-education bill (SB 374) linked to a nearly $83 billion budget for the fiscal year that starts July 1. The bill includes an array of major policy changes for the 12 state universities and 28 state colleges. The bill would require universities to offer block tuition, where students pay a flat fee per semester rather than a credit-hour charge, by the fall of 2018. It would create a 13-member
Board of Community Colleges to oversee the state college system, which is now under the Board of Education. In addition, the legislation would cap enrollment for students pursuing four-year degrees at state colleges to no more than 15 percent of the total enrollment at each school. Universities would be held to a new performance standard, measuring the schools on their ability to graduate students in four years, rather than the current six-year standard.

These chicken sandwiches, which are topped with Brie, pesto, fresh tomato and arugula on sourdough bread and toasted on the grill, are just the excuse you need to get outside and enjoy the weather with family and friends. Grilled Chicken Sandwiches with Pesto, Brie and Arugula
Recipe courtesy of the National Chicken Council Servings: 4 1/2 cup olive oil, divided 2 tablespoons lemon juice 1 clove garlic, minced 1/2 teaspoon kosher salt 1/2 teaspoon freshly ground pepper 1 pound thin-cut chicken cutlets 1/4 cup basil pesto, divided 1 large tomato 8 slices crusty sourdough bread
4 ounces Brie, thinly sliced 1 cup packed baby arugula Heat grill to high. Combine 1/4 cup olive oil, lemon juice, garlic, salt and pepper; pour into plastic zipper bag. Add chicken, seal and marinate at least 30 minutes. Grill chicken 2-3 minutes, turn and grill another 2-3 minutes, or until chicken registers internal temperature of 160 F. Remove and reserve. Spread each piece of bread with 1/2 tablespoon pesto. Slice tomato into eight slices. Place chicken on four bread slices. Top with Brie slices, arugula and two tomato slices. Top with remaining bread slices, pesto side toward tomato. Brush outside of each sandwich with about 1/2 tablespoon of remaining olive oil. Place on grill, reduce heat to medium and grill 2-3 minutes per side, or until bread is nicely toasted and cheese is melted. Remove from heat, cut each sandwich in half and serve.
Recipe courtesy of the National Honey Board 2 cups graham cracker crumbs 1/2 cup butter or margarine, melted 4 packages (8 ounces each) cream cheese 3/4 cup honey 1/4 cup flour 5 eggs 1/3 cup heavy cream 1 tablespoon lemon zest, grated 1 teaspoon vanilla fresh berries, for garnish fresh mint, for garnish To make crust: In small bowl, stir together graham cracker crumbs and butter until well blended. Press mixture evenly onto bottom and sides of greased 9-inch springform pan; set aside. Heat oven to 350 F. To make filling: In electric mixer bowl, combine cream cheese, honey and flour. Beat until smooth. Add eggs one at a time, beating well after each. Beat in cream, lemon zest and vanilla. Pour cream cheese mixture over crust; bake 15 minutes. Lower oven temperature to 200 F and bake 1 hour and 30 minutes longer, or until center no longer looks wet or shiny. With oven off and door ajar, let cheese cake cool 1 hour in oven. Remove cheesecake to rack to cool completely. Cover and refrigerate cheesecake at least 4 hours before serving. Garnish with fruit and fresh mint. Pair with chardonnay like Joseph Carr.
