A Change of Heart
Through Clinical Collaboration and God’s Grace When Baptist Health Care joined the Mayo Clinic Care Network in 2013, the Gulf Coast community of Pensacola celebrated the clinical collaboration and welcomed the additional resources it would bring to the local care of residents. A closer relationship with Mayo Clinic gives Baptist patients access to world-renowned expertise, often with the option to remain close to home. Since joining the network, countless patients have been helped and many lives saved by the combined skills of Baptist and Mayo Clinic experts. – By Dana Barfield One such case is that of heart patient, Jonathan Richmond of Pensacola. In 2000 the then 46-year-old Richmond was diagnosed with congestive heart failure, a chronic condition in which the heart can’t pump blood as well as it should. Since that time, Richmond’s condition has been managed with implantable cardioverter defibrillators (ICDs), medication and lifestyle changes, his blood pressure and weight carefully monitored by a nurse with his insurance company. “The option of a heart transplant was presented to me and I said, ‘no way!’” said Richmond. “I didn’t know then, but the Lord would eventually take that decision out of my hands.” Richmond’s story is a true testament to the value of clinical collaboration. But even more importantly for Richmond and his family, it revealed the mysterious and benevolent workings of a loving God. This is Richmond’s account of how a series of miracles brought him back from the brink of death and restored him to his family.
Jonathan’s Story
One morning in November 2015 my blood pressure was quite low, and I received a call from my nurse telling me to go to the emergency room, which I promptly did. I was having difficulty breathing, and I couldn’t keep any food down because my digestive system had already shut down. My kidneys and liver were beginning to shut down as well. from a catheter in my neck to send to Mayo Clinic in Jacksonville, but I inadvertently pulled out the catheter in my sleep. I was told

My son asked Dr. Yip, “Doc, what’s the plan?” His reply was, “Tonight we pray. If he’s still alive in the morning, we’ll put him on

characteristics, I was placed at the top of the transplant list for my heart type. Within 24 hours, miraculously, a heart was available and my vitals had improved enough that Dr. Yip felt we should attempt the transplant as soon as possible. The surgeon removed my old failed heart and said it was amazing that it was working at all. My old heart was nothing but mush. One of the transplant team members told my family that my clock had been turned back 30 years. Recovery was long and touch-and-go at times. But the results of my ten-month heart biopsy showed no rejection. That is practically unheard of! It has now been a little over a year since I was transferred to Mayo Clinic and every day is a blessing. I thank my sons who drove from Chattanooga and Fort Walton to be with me through my transplant and recovery. I thank my wife who has stuck with me through thick and thin; for better and for worse; in sickness and in health. And I thank God. He revealed Himself and his mercy, grace, love, compassion and power to my entire family through the lifesaving expertise of Baptist Heart & Vascular Institute and Mayo Clinic.

The Junior League of Pensacola Presents Iron Chef Kids Competition
Members First Credit Union gifts $100k to name UWF hitting facility The University of West Florida recently received a $100,000 gift from Members First Credit Union of Florida to name the hitting facility used by the baseball and softball teams. The official check presentation was held at 1:45 pm on Saturday, April 29 at Jim Spooner Field, before the baseball and softball home games. The facility is slated to be named Members First Credit Union Hitting Facility, pending UWF Board of Trustees approval. “It is great to have community partners like Members First Credit Union that take an interest in your athletic program,” said Dave Scott, UWF athletic director. “This gift is an investment in the development of our student athletes and will assist in ‘Building Champions for Life.’” The hitting facility is the University’s new multi-purpose, 9,100-square foot indoor training center for baseball and softball, which was opened at the beginning of the 2016 season. The facility includes LED lighting that adjusts according to daylight, regulationheight pitching mounds for baseball, four hitting bays for batting practice with protective netting that can be raised or lowered to allow for larger surface usage, and a section
designed specifically for softball. It is located behind the left field wall at Jim Spooner Field, near the UWF Softball Complex, and allows for simultaneous practices by both teams, even during inclement weather. “Members First is excited to partner with the athletic program at the University of West Florida,” Members First Credit Union President Caryl Greene said. “Our roots are in education, and partnering with UWF seemed like a natural progression. Athletics are an integral part of college life, and we wanted to support education at all levels. Our commitment to community, education and family is in the forefront of everything we do. We are $184 million in assets and have over 16,000 members, but many people still don’t know who we are. We felt this was a way to get our name out there and support a great cause.” Baseball Head Coach Mike Jeffcoat described the new facility as the “icebreaker” for the UWF athletic department’s master plan to upgrade its sports facilities. “It brings immediate benefit to our athletes by providing a first class training environment that projects our commitment to success,” Jeffcoat said. “I want
to thank Members First Credit Union for its incredible gift, and I am honored to see its name placed on our facility.” Softball Head Coach Melissa Paul credited the facility with helping the program attract new recruits. “We are so grateful for this facility and what it has done and will continue to do for our program,” Paul said. “Campers, other teams and potential future Argonauts are blown away by what is one of the top Division II softball hitting facilities in the nation. Our players and staff are so appreciative of the support we have to provide such an amazing facility to work in every day. Thank you to Members First Credit Union for giving us the resources and support we need to stay competitive.” Members First was organized in 1954 as the Escambia County Teachers Credit Union. The Junior League of Pensacola and Everman’s Cooperative Grocery are once again teaming up to offer children and families a little “healthy competition” in the kitchen. The Iron Chef Kids competition will be held Sunday, May 7 at Everman’s Grocery Educational Center from 2 to 4pm. Children from the Junior League’s Kids in the Kitchen program will participate in a cook-off guided by celebrity chefs, including: Everman’s Grocery’s Chris Kimberl, V Paul’s Chris Pichotta, and Pensacola Cook’s Holly McKinney, with celebrity judges, including Fred Robbins, Escambia County Schools Superintendent Malcolm Thomas, Mayor
Ashton Hayward, and WEAR reporter Kimberly Wyatt, choosing the winning recipe. This fun event is free and open to the public. “Kids in the Kitchen is all about making healthy option in the kitchen and grocery store fun,” said Jennifer Mood, community impact chair of the Junior League of Pensacola. “Iron Chef Kids makes ‘healthy’ fun by letting kids to do the two things they love most— get dirty and compete with each other.” One of the Junior League of Pensacola’s community focuses is children’s health and wellness, along with human trafficking. Through its members’ volunteer efforts and programs like Girls on the Run and Kids in
the Kitchen, the Junior League aims to help combat the troubling issue of childhood obesity and its impact on the Pensacola Bay Area. Kids in the Kitchen partners with local elementary schools to encourage families to get into the kitchen together and have fun. The program’s goal is to combat childhood obesity by getting kids to try, make and love healthy food. The Junior League of Pensacola is a women’s volunteer group dedicated to service projects in the Pensacola Bay Area. Since 1956, Junior League of Pensacola members have contributed volunteer support and resources to a variety of community programs and causes.

Palafox Market Turns 10 Most Saturday mornings, you’ll find a bustle down Palafox street downtown: vendors setting up their booths in the shade of the trees down the median, cars rolling past, dog walkers strolling down either side of the street. It’s May, the time of the year where a slight breeze may rustle the branches overhead, lifting the tablecloths which cover the booths. A busker is singing, and there’s a distinct smell of baked goods wafting through the air. This is the Palafox Market. Palafox Market was started as a joint venture by the Downtown Improvement Board and the Community Redevelopment Agency in order to increase foot traffic and economic growth down one of Pensacola’s most famous streets. May 6 will be Palafox Market’s tenth anniversary. The event itself will feature more than just
the market: there will be entertainment from the band The 3 Bean Soup, a chef cook-off, a beer garden, a kids zone, balloons, caricature drawing/face painting, and a live statue. Market Manager Teresa Duffy expects the event to be a success. Palafox Market features an array of vendors and products for sale. Patrons can purchase fresh produce and herbs, jewelry, paintings, baked goods, live plants, antiques, and much more. According to Duffy, there’s an even spread of requests for every type of homemade products, and every vendor can find success and sales. Farmer’s markets have been on the rise in recent years, as consumers have grown increasingly interested in where their goods come from, specifically fresh produce. With every vendor being local, it’s possible
for patrons to have a relationship with their produce providers, as well as confidence in the quality of the products they’re buying. When asked about a crowd favorite, Duffy said it was too close to pick a standout. “Everybody does well, everybody has repeat customers – we just have great vendors all around.” Every Saturday, Palafox Market plays host to approximately 7,000 patrons. Currently, there are approximately 180 vendors who rotate out every week, in order to offer patrons an array of goods to purchase any given week, and since Duffy’s time as market manager, she’s witnessed significant growth. There used to be around 75 vendors featured each weekend, but now there’s 110, she said; there will be up to 120 vendors for the anniversary weekend. Palafox Market offers
bathrooms, electrical outlets, Wi-Fi, and water for both the patrons and vendors. There is also plenty of free parking available in the area. If there’s something specific you’re looking for, be sure to arrive early; products such as fresh produce tend to sell out quickly. To become a vendor, there are slim but firm requirements: your products must be handmade, homemade, or homegrown, and you must live within 100 miles of Pensacola. Workshop for Non-Profits Seeking Grants Announced
IMPACT 100 of Northwest Florida, which provides significant funding for non-profit 501(c)(3) organizations in Okaloosa and Walton counties, is holding its annual grant workshop on May 23, 2017, to assist groups who want to apply for grants from the organization. The workshop will be held from 9:00am to noon in the Fellow-
ship Hall of Grace Lutheran Church located at 4325 Commons Drive West in Destin. In its first five years of operations, IMPACT 100 has awarded $1.3 million in funding. Eleven non-profit groups have each received grants ranging from $107,000 to $128,000. This year IMPACT 100 is seeking grant
applications that focus on projects in the following areas: Arts & Culture, Education, Environment, Family and Health & Recreation. The May 23rd workshop is designed to help non-profit groups create dynamic grant applications. Topics include grant guidelines, budget by the numbers, what to expect during the site visit.
The workshop will conclude with a panel featuring past grant recipients who will share their observations, experiences and insights. Advance registration for the event is strongly encouraged to ensure a reserved spot at the workshop. The final day to register is May 15, 2017. First City Art Center To Host “Hot Glass, Cold Brew” Mystic May Experience The First City Art Center’s HOT GLASS, COLD BREW, Mystic May Experience event takes place on Fri., May. 12, from 6 to 9 p.m. at its location at 1060 N. Youth Football And Cheerleading Registration Underway The City of Milton Youth Football and Cheerleading Program is ready to start its third year as a member of the Northwest Florida Youth Sports Alliance.

Registration for Youth Cheerleading is now through May 19 and the cost is $95 per person. This includes participation in the Milton High School Cheerleading Camp but not the cost of the uniform. Humane Society Director Chosen for Elite Fellowship
Sarah Humlie, Executive Director of the Pensacola Humane Society, has been chosen for an elite Executive Leader Fellowship sponsored by Maddie’s Fund at the Charleston Animal Society. The Fellowship is an intensive mentorship opportunity for professionals committed to developing and strengthening their knowledge and skill-set in no-kill animal sheltering management and leadership. Humlie was one of only two people selected through a rigorous competition of candidates from throughout the United States and Canada. The purpose of the program is to create dedicated and passionate future leaders of no-kill animal sheltering through a 12-month field placement and leadership training. Humlie will spend the year in Charleston, South Carolina, beginning June 1. The Pensacola Hu-
mane Society is proud to have been the springboard for her acceptance into such a prestigious program, which is designed for professionals in middle to senior management positions who are consensus builders with analytical and planning skills, and who have shown inspired leadership in developing and nurturing a dynamic organizational culture that embraces growth and new ways of thinking. “I’m excited for the opportunity to increase my knowledge of how to move Pensacola toward being a no-kill community,” Humlie said. “Learning from the experts in Charleston, where they’ve been able to maintain no-kill status for the last four years, will enable me to do that. ENVIRONMENTAL BUDGET TALKS FALTER By BRANDON LARRABEE THE NEWS SERVICE OF FLORIDA
Negotiations between the House and Senate about funding for environmental and water programs imploded Saturday, as talks over a new state budget moved up the ladder ahead of a Tuesday deadline. A visibly irritated Sen. Rob Bradley, R-Fleming Island, announced Saturday that he would ask for all of the issues that once separated the House and the Senate on the agriculture and natural resources budget to be kicked up to the two chambers’ budget chiefs. That means all the issues that Bradley, who chairs the Senate’s environmental budget panel, worked out with House counterpart Ben Albritton, R-Wauchula, are back to being unresolved. House Appropriations
Chairman Carlos Trujillo, R-Miami, and Senate Appropriations Chairman Jack Latvala, R-Clearwater, will now have to work out the entirety of the environmental budget. They will also make decisions across the roughly $83 billion spending plan, after issues that couldn’t be resolved by other House-Senate committees “bumped” up to the two chairmen Saturday afternoon. Trujillo and Latvala were scheduled to hold their first meeting at 7 p.m. Saturday to discuss education issues. Lawmakers face a Tuesday deadline to finish the budget if they hope to end the legislative session as scheduled Friday. The state Constitution requires a 72-hour “cooling off” period before lawmakers can vote on the budget, which will take effect July 1. The blow-up in the talks between Bradley and Albritton came as Bradley underscored alleged games-
manship by the House. For example, on one landbuying item, the House started out at $10 million. After the Senate’s first offer included no money for that, the House moved to $14.5 million. In its second offer, the Senate accepted that figure—only to see the House move back to $10 million. “I think it just is a situation where this was destined to fail from the beginning,” Bradley told reporters afterward. “This budget was never going to work out in any meaningful way.” Albritton denied there was any attempt by the House to play games. He noted that the House initially had less funding for the total environmental budget than lawmakers ultimately agreed to spend. That, for example, was why the House started the process with a lower figure on another line item, beach projects, but ended up proposing more than the Senate.
“It just shows beaches are important to the House,” Albritton said. Spending on the environment has been a top priority of Senate President Joe Negron, R-Stuart, and water projects are often used for leverage in the budget process. But Albritton brushed aside any notion that higher-ranking lawmakers interfered in the negotiations, saying he hadn’t spoken to House Speaker Richard Corcoran, R-Land O’ Lakes, about the new offer and had only briefly talked with Trujillo. Still, Bradley and Albritton professed admiration for each other, and at one point of the final meeting, Albritton reach over to pat Bradley on the shoulder as the Senate chairman vented about the shifting amounts. Elsewhere, lawmakers found common ground. Very little of the education budget has moved to Trujillo and Latvala, after two years in
which large swaths of school spending headed to the second round of spending talks. Lawmakers were still trying to work out how to spend almost $414 million set aside to encourage charter schools to move into areas with academically struggling schools and to expand eligibility for the state’s “Best and Brightest” teacher bonus program. Rep. Manny Diaz Jr., a Hialeah Republican who chairs the House education budget committee, said lawmakers had to be careful on an issue like Best and Brightest, where the setting of certain eligibility standards would decide how many teachers qualify and how large the bonus would be for each one. “I think that the math there is pretty complex, and we want to make sure we get it right as well,” he said. Higher education was also largely hammered out, though some specific aspects were still in the air.

Florida’s Senate president and House speaker stepped in Sunday afternoon to take over budget negotiations, with several issues still in play as lawmakers race a Tuesday deadline to finish work on a nearly $83 billion spending plan. Talks over the weekend between Senate Appropriations Chairman Jack Latvala, RClearwater, and House Appropriations Chairman Carlos Trujillo, R-Miami, led to agreements on spending levels for public education, higher education and $40 million in water projects. But every other area of the budget was at least partially unresolved. Those ranged from minor issues in an area of the budget dealing with basic government operations to dis-
cussions in health care about how to structure a $651 million cut in Medicaid payments to hospitals. Also unresolved was essentially the entire environmental budget outside of the water projects. And while the dollars for public education have been decided, bills determining the shape of plans to encourage charter schools to open branches near struggling traditional schools, and an initiative to expand a teacher bonus program, haven’t been finished. Because of a constitutionally required 72-hour “cooling off” period, a final deal on the budget has to be struck by Tuesday for the legislative session to end Friday, as scheduled. Some of the policy issues, like on education, could be finished later in the week. In reality, the budget discussions themselves are part of an intricate maneu-
ver to bring the session to a close. Other issues, like an expansion of the homestead property-tax exemption favored by House Speaker Richard Corcoran, will also play a role. Moving most of the budget issues to Corcoran, RLand O’ Lakes, and Senate President Joe Negron, R-Stuart, fueled complaints that the spending negotiations this year have been more opaque than in recent years. “I think the process of kicking everything up is not transparent at all,” said Sen. Perry Thurston, D-Fort Lauderdale. Some lawmakers seemed to be unsure whether the remaining budget items would be negotiated in public or behind closed doors before a spokeswoman for Negron said that offers between the two chambers would be exchanged in an open meeting. But even what would be a part of the budget was still
changing. Latvala and the Senate announced Sunday they were removing pay raises for state employees from the budget and would instead place them in a bill making changes to the state’s retirement system and health-insurance program. That bill is scheduled to be heard Monday by the Senate Appropriations Committee. Latvala, who has made a salary increase for state workers his top priority, told reporters he was making the move “for protection.” “The House wanted the pension reform and the insurance reform in return for the pay raise,” he said. “So we’re putting it all in one place so it either all moves along or it all goes down the tubes.” The Senate plan would boost pay across the board by $1,400 a year for employees making $40,000 or less, and by $1,000 a year for employees making more. Some
employees in particular jobs would get extra increases. The proposal is similar to an increase approved by the Legislature in 2013, the last time state employees got a raise. The Senate appeared to push back a House plan to slash 44 positions from the office of Gov. Rick Scott. Trujillo said Sunday afternoon that those cuts were “off the table, for the most part.” But Scott, who has been rebuffed on funding for economic development incentives and tourism marketing, remains a wild card in the unwinding of the budget process. “In our initial budget there’ll be some things he’ll like. And then there’ll be some things he doesn’t like,” Latvala said Sunday morning, before adding cryptically: “And then we’ll probably have the chance to correct those that he doesn’t like.”

Back from a trade mission to Argentina that took place while legislative leaders hammered out details of the budget in private, Gov. Rick Scott continued a push for his top priorities —the state’s tourism marketing agency, incentives for businesses and Lake Okeechobee dike repairs. Scott’s office announced in his absence that a cut to Visit Florida spending would negatively impact both the state’s revenue and bond ratings, but the governor stopped short of threatening to veto any budget that fails to fulfill his funding requests. Addressing reporters outside his Capitol office between individual meetings with more than a dozen lawmakers, Scott said there is a lot of “frustration” over the way the session is going. But the governor repeated that he intends to review the budget after it reaches his desk. “I’m going to look at all my opportunities,” Scott said, when asked about a potential budget veto. “I’ll go
through the budget. I’m going to do whatever is the best for the citizens of this state.” The House and Senate have reportedly reached agreement on a number of key budget issues, negotiating in favor of House Speaker Richard Corcoran’s desire to eliminate Enterprise Florida and to cap tourism funding for Visit Florida at $25 million. Scott initially sought $76 million for Visit Florida, upping the request to $100 million on April 18. “I cannot believe that legislators don’t understand the value of continuing to market the state,” Scott said on Thursday. “We’ve gone from 82 million tourists a year before I got elected (to) last year almost 113 million tourists. That’s a lot of jobs.” Lawmakers last spring allocated $78 million for Visit Florida, for the current year that ends June 30. But Corcoran and other leaders have harshly criticized the public-private agency over its $11.6 million sponsorship of a cooking show hosted by celebrity chef Emeril Lagasse, a $1 million contract with rapper Pitbull, and ongoing spon-
sorship deals with Londonbased Fulham Football Club and an IMSA racing team. Scott accused lawmakers of having “turned their backs on constituents” by failing to fund his priorities. “I don’t understand how we’re turning our backs,” House Appropriations Chairman Carlos Trujillo, R-Miami, told reporters Thursday evening. “I think we’re turning our backs on Floridians when there’s waste and abuse and people are spending money who do absolutely nothing to have it. I think that’s turning our backs on constituents.“ Scott wants $85 million for economic business incentives through Enterprise Florida, which House leaders have repeatedly labeled “corporate welfare.” Senate Appropriations Committee Chairman Jack Latvala said the House has agreed to provide operational funding for Enterprise Florida. “That’s a long way from where the House was when they wanted to do away with both of them,” Latvala, RClearwater said, Thursday. “You just have to compro-
mise and try to move on and keep things going and wait for tomorrow for another shot.” Earlier this session, the House signed off on Corcoran’s plan to abolish Enterprise Florida and a number of other economic development programs, rolling many of the agency’s functions into the Department of Economic Opportunity. Scott’s request for $200 million to help the federal government speed repairs to the dike around Lake Okeechobee came late in the session, scheduled to end on May 5. The request is intended to aid Senate President Joe Negron’s request to speed construction of a reservoir south of the lake as part of a regional water cleanup project. But Trujillo sounded skeptical when asked about the money for the dike, saying Scott did not include it in his original budget request. “So if you look at the governor’s original budget that he presented to my committee and presented to the Senate, at no point did we ever discuss $200 million,” Trujillo said. When asked, Trujillo

said the project has merit. But, he added, “I don’t think there is merit in ever lending the federal government $200 million they should be responsible for.” Scott walked the halls of the Capitol early Thursday afternoon, meeting individually with lawmakers—a rarity for the governor whose visits with legislators have been confined to Scott’s office. Latvala said Scott talked about “how nice Argentina was and all the economic development things he’s got in the works as a result of going to Argentina.” But Latvala remained mum about the rest of his discussion with the governor. SENATE TRIES TO BRING ‘PEACE’ WITH GROVELAND FOUR APOLOGY

Hoping to provide closure in a decades-old case of racial injustice, the Senate formally apologized Thursday for the prosecution and persecution of four black men accused of raping a white woman in 1949. The legislation approved Thursday (HCR 631) also asks Gov. Rick Scott and the Florida Cabinet to pardon the “Groveland Four” —Charles Greenlee, Walter Irvin, Samuel Shepherd and Ernest Thomas. All of the men are dead. But descendants have traveled to Tallahassee to advocate for the bill, saying it
would clear the men’s names and end any lingering shame of the accusations, which are now widely discredited. The House had already adopted the resolution, meaning the vote by the Senate formalized the Legislature’s apology to the four men, two of whom were killed before their cases worked all the way through the justice system. “We cannot go back to this terrible event and undo it,” said Sen. Gary Farmer, a Fort Lauderdale Democrat who sponsored the measure in the Senate. “But we can acknowledge our wrongs. And we can bring peace and healing and closure to the families who have suffered for so long.” The incident began in
1949, when a 17-year-old woman and her husband claimed that the four men raped her near Groveland in Lake County. Three of the men were tortured until two confessed to the crime. Thomas, who initially escaped, was killed in Madison County after a manhunt. The other three men were convicted, with Greenlee receiving a life sentence and Irvin and Shepherd condemned to death. An appeal of the Irvin and Shepherd convictions, with the men represented by future U.S. Supreme Court Justice Thurgood Marshall, prompted the high court to overturn the verdict in 1951. Irvin and Shepherd were shot
several months later, purportedly in self-defense, by Sheriff Willis McCall and a deputy. Shepherd was killed. After Irvin was convicted and sentenced to death again, Gov. LeRoy Collins commuted his sentence. Irvin was paroled in 1968 and died two years later. Greenlee, who was paroled in 1962, died in 2012. The case gained increasing attention after the publication in 2012 of Gilbert King’s book “Devil in the Grove,” which won the Pulitzer Prize. The Groveland resolution was approved by the Senate one day after members also adopted an apology for the mistreatment of youths held at the now-shuttered Arthur G. Dozier School for Boys in
Marianna, similar to another measure passed by the House. Farmer said the two proposals showed a determination by lawmakers to atone for the state’s past sins. “Combined, I think these bills and our recognition of these dark times show that we will always be vigilant against racism, against hatred,” he said. In Tallahassee last week to advocate for the apology, Carol Greenlee—the daughter of Charles—said it meant something more to the families of the victims. “My nephew can wear his name Greenlee proudly now,” she said, “because the truth has come out.”
‘STAND YOUR GROUND’ CHANGE REMAINS IN LIMBO

High noon is approaching in a standoff over part of a controversial bill dealing with “stand your ground” self-defense cases. The House and Senate have both backed passing a bill that would shift a key burden of proof in “stand your ground” cases, but they have taken different stances on an important legal detail. The Senate is deciding which chamber’s proposal to put up for a vote next week, the final scheduled week of the 2017 legislative session. Sen. Rob Bradley, a Fleming Island Republican who is sponsoring the Senate bill (SB 128) said Thursday the issue won’t “die in messages”—the process of bills bouncing back and forth between the House and Senate. “There is going to be some bill in some form,” Bradley said. “We’re either going to take the House bill, or we’re going to replace the House bill with the Senate position and send it back. We’re going to deal with it one way or another.”
The issue stems from a Florida Supreme Court ruling in 2015 that said defendants during pre-trial hearings have the burden of proof to show they should be shielded from prosecution under the “stand your ground” law. The House and Senate would shift that burden to prosecutors, a change backed by groups such as the National Rifle Association. In changing the burden of proof, the House wants to require prosecutors in “stand your ground” cases to overcome the asserted immunity sought by defendants through “clear and convincing evidence.” But the Senate, which rejected the “clear and convincing evidence” language earlier this session, wants a higher standard known as “beyond a reasonable doubt.” The “stand your ground” law has long been controversial. It says people can use deadly force and do not have a duty to retreat if they think it is necessary to prevent death or great bodily harm. Critics contend that either the House or Senate approach to the issue would make it easier for people involved
in fatal shootings to use “stand your ground” when there are no victims to counter the self-defense claims. The Senate approved the bill 23-15 on March 15, while the House gave its version a 7439 vote of support on April 5. While the “stand your ground” issue remains to be resolved, Second Amendment advocates have had relatively little to show for the legislative session. On Thursday, the Senate prepared for a possible vote Friday a measure (SB 616) that would allow people with concealedweapons licenses to hang onto their handguns until they reach security checkpoints inside courthouses. The proposal cleared the Rules Committee on Tuesday. But even if it is approved by the entire Senate, the fate of the bill remains to be seen as the House doesn’t have a companion bill. Senate Judiciary Chairman Greg Steube, a Sarasota Republican who is sponsoring a number of firearmrelated bills including the courthouse measure, said he hopes House Speaker Richard Corcoran will pick
up the proposal when it comes over from the Senate. Steube refused to say many of his other proposals—including proposals that would allow people with concealedweapons licenses to openly carry guns or carry firearms on university campuses or into airport terminals— are dead for the session. Steube has been unable to advance many of the bills through his divided Judiciary Committee, largely because of opposition Sen. Anitere Flores, R-Miami. “They’re still live bullets, I mean the language is alive, but I think the members of the Senate have made it very clear where they’re at,” Steube said. On Wednesday, the Senate voted 22-13 to approve a measure (HB 849) that would allow people with concealedweapons licenses to pack heat at private religious institutions that have schools. The proposal will have to go back to the House because the Senate included a change that would prohibit people from carrying guns during school hours or when school activities are underway. The restriction
was not included in the bill when passed by the House. Supporters have said people with concealedweapons licenses should be able to be armed at churches for security reasons. “In this era across the country, we have had attacks during worship services, burglaries or thefts or robberies during worships, and people appear at church services with problems,” Sen. Dennis Baxley, R-Ocala, said. “There is a security aspect in every environment and many people are willing to embrace that responsibility.” Outside of law enforcement officers, state law prohibits people from carrying guns at schools. With some high-profile gun bills getting stuck in the Senate, the House hasn’t focused on the measures. “Obviously, I think there is interest in the House, but without any movement in the Senate, we’ve decided to spend time on things that we can actually get done,” Rep. Neil Combee, an Auburndale Republican who is a key backer of gun-rights bills, said early this month.
for drug crimes or whether judges should have more discretion in sentencing. Senate Criminal Justice Chairman Randolph Bracy, D-Orlando, proposed changing the bill to give judges the ability to move away from mandatory-minimum sentences for fentanyl trafficking. In the end, senators approved the amendment in a voice vote. But first, they weighed in on the problems fentanyl is causing in their communities—and the effects of mandatoryminimum sentences dating back to the onslaught of crack cocaine in the 1980s. Sen. Dennis Baxley, ROcala, said his son, a deputy sheriff, implored him to take steps to address problems with fentanyl. He argued that mandatoryminimum sentences were
appropriate for fentanyl trafficking because of an epidemic that he described as a “fire out of control.” “This is serious business, and we need the most serious response we can give it,” Baxley said. But Senate Minority Leader Oscar Braynon, D-Miami Gardens, recounted how mandatory-minimum sentences stemming from the 1980s “broke up families” and “tore up my community.” He and other senators said such sentencing can lead to young addicts going to prison and that increased rehabilitation and treatment is needed. The bill (HB 477) would create a first-degree felony offense for trafficking in fentanyl and similar drugs, with trafficking defined as involving four grams or more. When approved by the
House last month, the bill also included mandatoryminimum sentences. It would have required a minimum of three years in prison and a $50,000 fine for people who have between four and 14 grams; a minimum of 15 years in prison and a $100,000 fine for people who have 14 to 28 grams; and a minimum of 25 years in prison and a $500,000 fine for 28 grams or more. Under Bracy’s amendment, judges would be able to “depart” from the mandatory-minimum sentences “if the court finds in giving due regard to the nature of the defendant’s crime, the defendant’s criminal history and character, and the defendant’s chance of successful rehabilitation, there are compelling reasons on the record that imposition of the mandatory
minimum is not necessary for the protection of the public.” The Senate could vote as soon as Wednesday on the amended bill, which would then go back to House. During the debate Tuesday, lawmakers such as Sen. Kelli Stargel, R-Lakeland, argued that the dangers of fentanyl justified mandatoryminimum sentences. Stargel said her daughter has lost two friends to fentanyl overdoses. “This is a very, very serious drug, and fentanyl is killing people,” Stargel said. But Democrats and some Republicans argued that mandatory-minimum sentences have not worked and that judges should be able to consider other options. “We do too much punishment,” Sen. Gary Farmer, DFort Lauderdale, said. “We do not do enough rehabilitation.
